“Doing What They Do Best”: House Republicans Just Passed A Bill Forbidding Scientists From Advising The EPA On Their Own Research
Congressional climate wars were dominated Tuesday by the U.S. Senate, which spent the day debating, and ultimately failing to pass, a bill approving the construction of the Keystone XL pipeline. While all that was happening, and largely unnoticed, the House was busy doing what it does best: attacking science.
H.R. 1422, which passed 229-191, would shake up the EPA’s Scientific Advisory Board, placing restrictions on those pesky scientists and creating room for experts with overt financial ties to the industries affected by EPA regulations.
The bill is being framed as a play for transparency: Rep. Michael Burgess, R-Texas, argued that the board’s current structure is problematic because it “excludes industry experts, but not officials for environmental advocacy groups.” The inclusion of industry experts, he said, would right this injustice.
But the White House, which threatened to veto the bill, said it would “negatively affect the appointment of experts and would weaken the scientific independence and integrity of the SAB.”
In what might be the most ridiculous aspect of the whole thing, the bill forbids scientific experts from participating in “advisory activities” that either directly or indirectly involve their own work. In case that wasn’t clear: experts would be forbidden from sharing their expertise in their own research — the bizarre assumption, apparently, being that having conducted peer-reviewed studies on a topic would constitute a conflict of interest. “In other words,” wrote Union of Concerned Scientists director Andrew A. Rosenberg in an editorial for RollCall, “academic scientists who know the most about a subject can’t weigh in, but experts paid by corporations who want to block regulations can.”
Speaking on the House floor Tuesday, Rep. Jim McGovern, D-Mass., summed up what was going on: “I get it, you don’t like science,” he told bill sponsor Rep. Chris Stewart, R-Utah. “And you don’t like science that interferes with the interests of your corporate clients. But we need science to protect public health and the environment.”
The House, alas, is staying the course, voting this week on two other bills aimed at impeding the EPA, including one that prevents the agency from relying on what it calls “secret science” in crafting its regulations — but which in reality, opponents argue, would effectively block the EPA from adopting any new rules to protect public health. The trio, wrote Rep. Eddie Bernice Johnson, D-Texas, in an editorial for the Hill, represents “the culmination of one of the most anti-science and anti-health campaigns I’ve witnessed in my 22 years as a member of Congress.”
The White House has threatened to veto all three.

“The Hostility Of Latter-Day Republicans”: For Obama, No Point In Being Conciliatory Now
I didn’t watch much TV last night, but I got the impression that whenever the gabbers ran out of steam in describing what was unfolding, they’d revert to blah blah blah about whether the results would re-inaugurate some sort of Era of Good Feeling in Washington.
It’s unclear to me if this sort of talk reflects incredible delusions about the hostility to compromise of latter-day Republicans, or the belief that Barack Obama and Democrats have no play but total surrender. Either way, it makes no sense, even if both sides make the obligatory cooing sounds about bipartisanship and “solving the country’s problems” for a few days.
Last night’s results, in fact, will enormously ratchet up pressure on Republican congressional leaders to act as though their party is already in charge. We’re much more likely to hear ultimatums than peace offerings. I’d figure Boehner and McConnell will let the White House know, privately and publicly, that life can get easier if Obama (a) approves the Keystone XL pipeline, (b) indefinitely delays any DACA expansion, and (c) indefinitely delays final action on climate change regs.
Maybe (a) is a viable option; for all any of us knows, the administration has already decided to approve Keystone. But pure merits aside, backing off on DACA would squander the most important political chip Obama can play for his party before leaving office, and backing off climate change regs might well kill prospects for doing anything on the most important long-range challenge facing the country for many years to come. I personally cannot see anything within the power of congressional Republicans to offer Obama that would justify either concession. Saying “no,” on the other hand, will almost certainly cause Republicans heartburn over the inevitable divisions of opinion about how, exactly, to respond (after the shrieks of rage have subsided). Add in the fact that an awful lot of Republican activists and opinion-leaders are going to vastly over-interpret the midterm results into either a “mandate” or a sign of manifest destiny, there’s little reason to think the GOP is going to listen to those who think the next two years must be devoted to changing the party’s image. At this point, it would be a terrible idea for Obama and Democrats to help Republicans achieve a “pragmatic” makeover they’re not willing to earn by disappointing the almighty “base.”
Besides, Democrats have another task that should absorb their time for the next year or so: coming up with a agenda for keeping the economic recovery going while boosting its tangible benefits for the 99%. Making progress on that front would be better medicine for the Democratic Party and for the country than considering concessions to the people who think there’s not enough inequality today.

“Theatrical Posturing, Not Much Lawmaking”: What We Talk About When We Talk About A Republican Senate
Presuming we have a Republican Congress next year, there’s going to be a lot of talk right after the election about what that will change 1) politically and 2) substantively. While I’m ordinarily an advocate of more substantive discussion and less political discussion (not that I have a problem with political discussion, since I do plenty of it myself, it’s just that it should be leavened with consideration of the things that actually matter), there’s a potential problem in the substantive discussion that I think we should be on the lookout for.
For instance, this morning on the radio I heard some energy expert whose name I didn’t catch say that if Republicans take over the Senate, we’re likely to see the government shift its focus toward fossil fuels and away from renewables. Which sounds perfectly logical until you ask how such a shift is supposed to take place.
This is what is often missing from policy discussion: enough acknowledgment of the institutional processes that determine how policies actually get set and altered. If you’re going to say that a Republican Congress is going to produce a particular policy change, you have to be clear that you’re saying the following events will occur:
1. Republicans will write a bill to do the thing.
2. The bill to do the thing will not only pass the House but more importantly garner 60 votes in the Senate, which means it will get the votes not only of Republicans but also of some Democrats, thereby overcoming a Democratic filibuster.
3. President Obama will sign the bill to do the thing.
It’s possible that that sequence of events could occur in some cases. For instance, Republicans have had a feverish desire to build the Keystone XL pipeline for some time, and they’ve come to attach an importance to it that’s way out of proportion to its actual impact. They seem to say with all sincerity that building the pipeline is a key to American prosperity, which is beyond absurd—building the pipeline would create a few thousand temporary jobs, and the number of permanent jobs maintaining it would literally be in the dozens. But President Obama never seemed adamantly opposed to the pipeline, and one could imagine him signing on if he got something in return. You could also see the pipeline getting a few Democratic votes from red state Democrats who want to show that they love the world’s dirtiest fuel (tar sands oil) and are therefore not hippies, so it could get 60 votes.
That might or might not happen, but it’s at least conceivable. It wouldn’t, however, represent some massive shift in our nation’s energy policy, whatever else you might think about it. And it’s an extremely unusual case.
On almost everything else Republicans want to do, either the bills they write won’t overcome Democratic filibusters, or they’ll be vetoed by the President. Much of the time, that will be because instead of embarking on a good-faith effort to find some accommodation with Democrats, they’ll just propose the thing they really want. It might be possible to forge a compromise on tax reform, but that would be a lengthy and involved process, so Republicans will just try to pass a bill slashing corporate tax rates, which won’t become law. There are ways the Affordable Care Act could be improved, but instead of working with Democrats to find them, they’ll be much more inclined to just pass repeal votes, whether it’s repeal of the entire law or repeal of individual provisions one by one (or, more likely, both).
In other words, we’re going to get an awful lot of theatrical posturing, and not very much lawmaking. We shouldn’t mistake the latter for the former.

“Learning From History”: What Can Brown Do For You? (Not A Damn Thing!)
U.S. Sen. Jeanne Shaheen is turning the focus to energy this week. Shaheen’s campaign today released a report highlighting votes her Republican opponent, Scott Brown, has taken on energy policy that she says will take New Hampshire in the wrong direction. And tomorrow, the state Democratic Party will host Massachusetts lawmakers and a New Hampshire energy expert to discuss Brown’s energy record…
While energy hasn’t been a central issue to the campaign thus far, both candidates have outlined positions on the topic.
At an energy forum in Concord last month, Brown touted an “all of the above” approach that includes support for nuclear, wind, solar, biomass and geothermal. He has continually called for the approval of the Keystone XL pipeline, a proposed oil pipeline that would run from Canada to the U.S.
Shaheen shouldn’t fail to point out that Brown’s views on energy are obviously influenced by one of the darkest forces in American politics:
Karl Rove is also lusting after a Brown win in the Granite State. If New Hamsphire voters judge candidates by the company they keep, they will judge Brown as harshly as Keith Olbermann did four years ago.
Those who don’t learn from history are doomed to repeat it. I hope that New Hampshire voters have learned from history.

“Selfless Libertarian Activist?”: Charles Koch Personally Founded Group Protecting Oil Industry Hand-Outs, Documents Reveal
“Lifestyles of the Rich Environmentalists,” produced by a group called the Institute for Energy Research, is a slick web video campaign designed to lampoon Leonardo DiCaprio and will.i.am as hypocrites for supporting action on climate change. The claim is that wealthy celebrities who oppose industrial-scale pollution supposedly shouldn’t fly in airplanes that use fossil fuels. The group, along with its subsidiary, the American Energy Alliance, churns out a steady stream of related content, from Facebook memes criticizing the Environmental Protection Agency, to commercials demanding approval of new oil projects like the Keystone XL, to a series of television campaign advertisements this year attacking Democratic candidates in West Virginia, Colorado, North Carolina and Alaska. On Capitol Hill, IER aggressively opposes any effort to repeal tax breaks afforded to the oil and gas industry.
Documents obtained by Republic Report reveal for the first time that the group was actually founded by none other than Charles Koch, the petrochemical, manufacturing, and oil-refining tycoon worth an estimated $52 billion.
IER has no information about its founding members on its website, and only lists a board composed of seemingly independent conservative scholars and businessmen. Earlier reports revealed that IER/AEA has received grants from Koch-funded foundations, and its leadership includes several individuals who have at times worked for Koch or Koch-related interests. But this is the first time it has been revealed that Charles personally founded the organization.
In October of 1984, Charles, then using a Menlo Park, California address, founded a non-profit called the Institute for Humane Studies of Texas. That organization briefly lost its charter in 1989 for failure to pay the Texas state franchise tax. Four years later, incorporation documents reveal, the group rebranded as the Institute for Energy Research, or IER, which later formed a subsidiary called the American Energy Alliance.
IER/AEA’s advocacy contrasts sharply with Charles’ personal brand as a selfless libertarian activist. The industrialist has argued that he is resolutely against special government handouts, such as tax credits or subsidies that benefit one industry over another. “Far from trying to rig the system, I have spent decades opposing cronyism and all political favors, including mandates, subsidies and protective tariffs—even when we benefit from them,” Charles wrote in a column for The Wall Street Journal this year.
But Charles’ group, IER/AEA, has fought to protect special tax breaks that benefit fossil fuel producers. Along with issuing press releases against various federal efforts to eliminate oil and gas industry tax credits, IER/AEA commissioned a study claiming that such tax reforms would have an adverse effect on jobs and on oil production.
Charles and his brother David are personally responsible for founding and funding much of the modern conservative infrastructure. The popular libertarian think tank, the Cato Institute, was in fact first named the Charles Koch Foundation, Inc before rebranding. The largest political organization in America outside the Democratic and Republican parties is Americans for Prosperity, the Tea Party-organizing foundation also founded by the Kochs.
The latest organs in the Koch political network have carefully guarded the sources of their funding and direction. There is the new youth group, Generation Opportunity, along with the new veterans-related campaign organization, Concerned Veterans for America. But IER/AEA’s true origin casts new light on its motivations.
