“Disturbing Events From ‘Behind The Scenes'”: “Criminal Referral Smear”; What Trey Gowdy Knew — And When He Knew It

Suspicion grows that the leaks behind the bungled New York Times “criminal referral” story came from the Republican side of the House Select Committee on Benghazi chaired by Rep. Trey Gowdy (R-SC). First Times public editor Margaret Sullivan hinted that the original “tip” came from “Capitol Hill.” Over the weekend, Rep. Elijah Cummings (D-MD), ranking Democrat on the select committee, revealed proof that Gowdy knew of the (utterly non-criminal) referrals by the inspectors general for the intelligence community and the State Department to the Justice Department, in advance.

Criticizing the stumbling scramble to publish without checking what turned out to be inaccurate information, Cummings complained in an article on the Huffington Post of “a series of inaccurate, partisan leaks designed to attack former Secretary of State Hillary Clinton. Many of these attacks rely on anonymous sources to describe – and often mischaracterize – documents reporters have not seen.” The Maryland Democrat’s post ought to have received much more attention than it has received so far. It offers a disturbing perspective on events from “behind the scenes,” on the day that the Times broke its ill-fated scoop:

On Thursday morning at 10:27 am, my staff received a copy of a letter sent from Select Committee Chairman Trey Gowdy to FBI Director James Comey. To the best of my knowledge, that letter has never been made public.

Chairman Gowdy’s letter warned the FBI Director that the Chairman was aware of a “formal referral” that was made to the FBI “by impartial officials within the Executive Branch” related to “classified information.”

I had no idea then — and still have no idea today — how Chairman Gowdy knew about this referral before everyone else, and his office has refused to respond to my staff’s inquiry.

At 12:03 p.m., the office of the State Department Inspector General (IG) sent an email to staff on several committees with a copy of a memorandum describing its joint work with the Intelligence Community IG reviewing the FOIA process for Secretary Clinton’s emails. This memo did not mention any sort of referral to the Department of Justice.

At 2:30 p.m., my staff and I had a previously scheduled meeting with the State Department IG, so we asked him about Chairman Gowdy’s letter and whether he was aware of any referral.

He told me he never asked the Justice Department to launch a criminal investigation of Secretary Clinton’s email usage. Instead, he said officials from the Intelligence Community IG — not the State Department IG — notified the FBI and Congress that they had identified information they believed was classified in several mails that were part of the FOIA review.

Importantly, the State Department IG made clear that none of those emails had been marked as classified when Secretary Clinton received them.

At 5:44 p.m. that evening, the Intelligence Community IG’s office sent a notification to the Intelligence Committees describing — for the first time — its referral to the FBI. This notification detailed a counter-intelligence referral, not a request for a criminal investigation of Secretary Clinton.

When I woke up on Friday morning and read the news, I was stunned. I immediately issued a public statement and released the congressional notification from the Intelligence Community IG.

I then got on the phone with both IGs from the State Department and the Intelligence Community. They confirmed that they never asked the Justice Department to launch a criminal investigation of Secretary Clinton’s email usage. Instead, they said this was a “routine” referral, and they said they had no idea why the Times story was so flawed.

But Cummings has his own ideas about that problem — and wonders why the Times reporters never checked with him or other Democrats on the committee, who could have corrected the ruinous mistake before publication. Combined with the timeline posted last week by the Clinton campaign’s Jennifer Palmieri, the Cummings post indicates just how irresponsibly this story was handled by the paper of record. Yet so far, the Times‘ editors and proprietors have offered nothing much beyond that public editor’s note — no apology for smearing Clinton, no accountability for any reporter or editor. Just an implausible excuse or two and a deflection of responsibility to those naughty sources, whose identities will of course remain protected. So why shouldn’t they perpetrate more inaccurate smears? They will.

Meanwhile, reporters covering the House might start asking some tough questions of Gowdy and the man who appointed him, Speaker John Boehner. Most likely, they never will.

“Is The Iran Deal ‘Liberal’?”: Shifting The Reigning Washington Foreign-Policy Paradigm From War-Making To Deal-Making

So, Senator Chris Coons, what do you think of the Iran deal?

There’s a pause. I have spoken a few times in recent weeks to the Delaware Democratic Senator, because a) he is deeply immersed in the details of this negotiation and b) he’s coming from what seems to me roughly the right place here: He wants to support his president and he wants to see diplomacy succeed, but he doesn’t trust Iran and he wants a deal that has a chance of actually working. He’s thoughtful and smart and not a demagogue, and his ultimate support (or not) of the thing really will hang on the details and what he concludes about them.

So he opens by telling me that he first wants to give credit to President Obama and John Kerry for getting this done, because any negotiation is hard, this one almost incomprehensibly so. Then he gives an answer: “It seems on the face of it from press accounts to meet most of the goals that were set.” He hadn’t read it yet, but he’d read enough about it to draw a few conclusions.

Still, Coons says he hasn’t made up his mind yet how he’ll vote. “I’m aware that it’s easier to be critical than supportive because this deal is so complex and the stakes are so high,” he told me. “I do think the diplomacy was worth exploring.” He wouldn’t say this of course, but it seems to me unlikely that Congress can kill the deal; Obama needs the backing of only 34 senators, which would result in a failure to override his certain veto of a “no” vote. It’s hard to imagine he can’t get that.

We’ll circle back to Coons, but first let’s acknowledge a point that liberal Obama-backers everywhere ought to acknowledge in this case: The deal is a big gamble. Nobody can know today that it will work in the main goal of keeping the Islamic Republic from getting a nuclear weapon. Of course, nobody knows for certain that it will fail either, and Lindsey Graham and Tom Cotton and John Boehner’s instant and predictable Munich-ification of a deal they obviously hadn’t even read was revolting.

But the way to counter their false, know-nothing certitude is not with more false, know-nothing certitude. From a liberal internationalist point of view, it’s clearly a good thing that Obama is trying to shift the reigning Washington foreign-policy paradigm from war-making to deal-making. The war-makers have been wrong about everything for the last 15 years, have told us endless lies, have harmed American credibility, have sown destruction and death—and, by the way, have done a hell of a lot more to strengthen Iran than we doves have. So deal-making is a fine principle for which to strive. But that doesn’t mean the deal is without risks and downsides, and liberals do themselves and the world no favors by not acknowledging them just because Tom Cotton is such a dreary soapbox haranguer.

Here were Coons’s four concerns in the order he listed them to me. First, the inspections regime; second, the timing of the sanctions relief; third, the degree to which the International Atomic Energy Agency will be able to keep track of the possible military dimensions of Iran’s nuclear activities; and fourth, restrictions on centrifuge development after about year 10. “I need to have a much better sense of the breakout time after 10 years,” Coons said, noting concerns that limits on centrifuge development might ease after the tenth year.

For my money, Coons’s second concern is the biggest potential problem here. Iran will get a $150 billion windfall starting in December, and while the regime will presumably spend some of that money at home, it’s a certainty that the Syrian regime and Hezbollah and Hamas and the Houthis in Yemen are all going to get their share.

Combine this money with the deal’s lifting of the conventional arms embargo, which hasn’t gotten much attention yet but you can be sure will get more, especially once Congress starts holding hearings on this, and you have a recipe for Iran to make far more trouble in the region than it has been in recent years. It should not comfort Americans, and American liberals in particular, that the likes of Bashar al-Assad and Hezbollah leader Hassan Nasrallah, both busy murdering Syrian children and suppressing any chance of real democracy being able to grow in Syria and Lebanon, praised the deal to the heavens.

Coons told me he had a lengthy phone call with Joe Biden Tuesday, and “that’s precisely what I was discussing with the vice president.” He said he’d let Biden speak for himself, but he did tell me that he pressed Biden on questions like what we’d be doing to beef up our commitments to our allies and to check Iranian influence. He says Biden assured him that stern measures were in the works. We’ll see about that. This, too, will be much discussed in the upcoming hearings, and it’s not only Republicans who have these concerns.

Obama says people should judge the deal only on whether it prevents Iran from getting a nuclear weapon, that it isn’t designed to change the nature of the regime or address regional terrorism. What this means is the administration made the decision that keeping a nuke out of Iran’s hands was the job that took precedence over all other tasks. All in all that’s probably the right call. Lindsey Graham said Tuesday that this deal would start an arms race. Not if it holds. If anything, it’s the opposite that’s true: Without a deal, Iran would surely develop a bomb more quickly, leading Saudi Arabia and perhaps others to do the same.

But surely Obama doesn’t mean to suggest that we shouldn’t discuss the other possible consequences of the deal. American liberals in particular should discuss these things. Nuclear non-proliferation is an old-school liberal value, but so is seeing our country take stands against the fundamentalist extremism that Iran exports and the kind of slaughter of civilians we see in Syria.

I was pleased to see that Hillary Clinton’s statement on the deal took both of these concerns seriously. Oddly, it’s not on her website. I got it via email, and the part that impressed me says this: “Going forward, we have to be clear-eyed when it comes to the broader threat Iran represents.  Even with a nuclear agreement, Iran poses a real challenge to the United States and our partners and a grave threat to our ally Israel. It continues to destabilize countries from Yemen to Lebanon, while exacerbating the conflict in Syria. It is developing missiles that can strike every country in the Middle East. And it fuels terrorism throughout the region and beyond, including through direct support to Hamas and Hizballah.  We have to broadly confront and raise the costs for Iran’s destabilizing activities…”

That’s real liberal internationalism, and I hope she spells out in the coming weeks what “broadly confront” means. I’d rather have her doing it than Jeb Bush or Scott Walker.

“This One’s A Doozy!”: House Republicans Manage To Trip Over Confederate Flags

The recent debates over Confederate symbols have been limited almost entirely to states and local communities. Federal policymakers can show some leadership on the issue – and many have – but the decisions about Confederate flags, statues, road names, and license plates aren’t made in Washington, D.C.

This week, however, congressional Republicans found a way to trip over the issue anyway.

The developments started rather innocuously. Late Tuesday, after just a couple of minutes of debate, the U.S. House passed a measure sponsored by Rep. Jared Huffman (D-Calif.) that would “prohibit the display of Confederate flags on graves in federal cemeteries.” Earlier in the day, the House also instructed the National Park Service to no longer sell Confederate flag in gift stores.

The measures passed by way of voice votes, and the developments didn’t generate much attention. That is, until last night, when Rep. Ken Calvert (R-Calif.) announced a dramatic change: a Republican amendment was set to undo what the House had just done.

Facing pressure and brewing media interest, late this morning, House GOP leaders were forced to pull the underlying bill altogether. Politico reported:

House Republican leadership was forced to pull a spending bill from the floor Thursday after an uproar over the Confederate flag threatened to sink the entire measure.

This one’s a doozy, so let’s unpack what happened.

At issue is an Interior Department spending bill, which was already considered controversial because it includes funding for the EPA – and the right does not care for the EPA. But some Southern Republicans complicated matters, telling the leadership they were prepared to help kill the spending measure altogether over the anti-Confederate amendments.

Republican Rep. Steven Palazzo of Mississippi, for example, said in a statement, “Congress cannot simply rewrite history and strip the Confederate flag from existence. Members of Congress from New York and California cannot wipe away 150 years of Southern history with sleight-of-hand tactics.”

House Democrats, not surprisingly, responded with apoplexy over the GOP majority reversing course, defending Confederate flags, and attempting to scrap two amendments that passed without controversy just two days ago.

Faced with growing turmoil, House Speaker John Boehner (R-Ohio) pulled the spending bill from the floor. Boehner told NBC News’ Luke Russert that the spending bill “is going to sit in abeyance until we come to some resolution.”

The Republican leader added that he does not want to see the issue become a “political football.” If today’s floor fight is any indication, it would appear Boehner’s too late.

South Carolina lawmakers managed to get this right, but the same cannot be said about Congress.

Postscript: It’s worth noting that while Rep. Ken Calvert (R-Calif.) was the member who announced the proposed reversal, he was not the one pushing for the change. Calvert said he introduced the amendment at the behest of the House Republican leadership, which was acting under pressure from Southern lawmakers.

“GOP Failure Theater”: How Conservatives Convinced Themselves That Another ObamaCare Loss Is Just Prelude To Greater Victory

There’s a ritual carried out by losing candidates on election night, in which they come before their supporters gathered in a hotel ballroom, look out at all the long faces and tired eyes, and say, “This has been a noble crusade. And though we may have lost today, the battle for the things we believe in goes on. I’ll be there fighting for that vision, and I hope you’ll be there with me.” Everyone applauds, and then they all go home.

Now that the Supreme Court has ruled against what was simultaneously the most absurd and the most threatening challenge to the Affordable Care Act, conservatives are enacting something similar to that election night ritual. In private, many are expressing relief, since there was widespread worry that if the King v. Burwell lawsuit had succeeded, they would have been responsible for at least six million Americans losing insurance subsidies, and quite appropriately gotten the blame for it. But what are they saying publicly?

The politicians are finding virtue in consistency; their line is that this changes nothing.

“Today’s ruling won’t change ObamaCare’s multitude of broken promises,” said Mitch McConnell.

“ObamaCare is fundamentally broken,” said John Boehner. “Today’s ruling doesn’t change that fact.”

“Today’s ruling makes it clear that if we want to fix our broken healthcare system, then we will need to elect a Republican president,” said RNC chair Reince Priebus, who also made the fascinating observation that a Hillary Clinton presidency would be terrible for America.

Naturally, conservatives are disgusted with Chief Justice Roberts, whom they regard as an unreliable ally, unlike Justices Scalia, Thomas, and Alito. Quin Hillyer of the National Review summed up their feelings: “He is a disgrace. That is all.” But as far as conservative commentators are concerned, the perfidy extends beyond the Supreme Court to the cowards and quislings in Congress. And so, in a particularly optimistic strain of thought, they’re arguing that the decision is really an excellent outcome.

That’s because it has saved the right from another round of what blogger Allahpundit calls “GOP failure theater,” in which Republicans in Congress “make a pretense of putting up a fight in hopes that conservative voters will be impressed and to obtain some sort of mostly meaningless concession to wave at them when the inevitable, and predestined, cave finally happens.”

Similarly, Ben Domenech argues that the decision is a good thing for conservatives, because now Republican candidates will have to come up with really good health care plans to enact when they take back the White House: “Thus, I think the ruling today probably increases the likelihood of repealing ObamaCare in 2017 by a not insignificant margin.” On a similar note, Bill Kristol tweeted, “Repeal of ObamaCare and replacement with limited-government alternative in 2017 will be one of modern conservatism’s finest hours.”

That presumes that the Republican nominee will win, of course. But it also presumes that he would have the ability and willingness to repeal the ACA upon taking office.

There’s no question that the Republican presidential candidates will continue to express their eagerness to do so, at least until we get to the general election. Though none of them has anything resembling a fully-formed plan for the “replace” part of “repeal and replace” that Republicans have been advocating for years, they still have to pay lip service to the idea that the consensus conservative health care plan is coming any day now. When you’ve spent the last five years arguing that this law is a poison-tipped dagger plunging into liberty’s heart, you can’t just say, “Eh, looks like we’ll live with it,” no matter what the practical reality might be.

The practical reality is that whatever public opinion may be about this large abstraction called “ObamaCare,” the law is delivering particular benefits of which Americans are quite fond and that they don’t want to lose. Taking away those subsidies through a lawsuit would have been a political disaster for Republicans, and that would have affected only a portion of the public. What if Republicans were to take away subsidies from people in all 50 states, and toss millions more off Medicaid, and make it so that now insurance companies can deny you coverage because of a pre-existing condition again? That’s what repealing the ACA would mean. Republicans may not be able to admit it, as they promise that their phantom alternative plan would take care of all that, but they know that just undoing the ACA would be a disaster.

They can’t acknowledge that fact, because they have a constituency that has been fed heaping plates of apocalyptic rhetoric on this issue ever since the ACA became law. Those Republican base voters need to be told that, though they’ve suffered a loss, the fight is not over. As Ted Kennedy said 35 years ago in what may be the prototypical example of that losing candidate’s speech to his dismayed supporters, “the work goes on, the cause endures, the hope still lives, and the dream shall never die.”

“House Republicans’ Safety Plan For Amtrak”: Videotape The Next Derailment Rather Than Prevent It

Last month, following the derailment of a train in Philadelphia that killed eight people and injured hundreds, Amtrak ordered the installation of inward-facing cameras on locomotives that serve the Northeast Corridor. And on Tuesday, the GOP-controlled House passed a transportation spending bill that provides $9 million for inward-facing cameras in all cabs to record engineers on the job. The funding was added without objection from anyone in either party.

The cameras might have bipartisan support, but what they won’t do is prevent the next train accident. They are only useful when a crash has already happened. “Inward-facing cameras are very important for determining the reason for a crash afterwards,” Tho “Bella” Dinh-Zarr, the vice chairwoman of the National Transportation Safety Board, told a Senate committee Wednesday. And in the meantime, for all the Republican protests that money for rail safety wasn’t an issue in the May derailment, the House’s spending bill denies funding that very well could avert the next disaster.

In all, the transportation funding measure cuts Amtrak’s budget by $242 million from the last fiscal year, and gives Obama $1.3 billion less than he sought for Amtrak grants. By keeping the Federal Railroad Administration’s safety and operations account flat, the bill is “denying resources for additional safety inspectors and other improvements,” according to the administration. “The requested funding for passenger rail service would help bring Amtrak’s Northeast Corridor infrastructure and equipment into a state of good repair.”

David Price, the top Democrat on the House subcommittee that sets annual transportation funding, has also criticized the bill’s cuts: “As we learned from the Amtrak derailment last month in Philadelphia, these cuts can have clear, direct consequences for the safety of our transportation system. … [C]utting funding certainly isn’t making our transportation system safer. How many train derailments or bridge collapses will it take before the majority agrees that we must invest in our crumbling transportation infrastructure?”

Shoddy infrastructure isn’t specifically to blame for the May derailment, but shoddy infrastructure still might be the reason for the next derailment. As industry experts note, U.S. rail has one of the worst safety records in the world because of how little it spends on its rail networks.

When a reporter asked House Speaker John Boehner about Democratic protests over Amtrak funding cuts, he called it a “stupid question.”

“Listen, they started this yesterday: ‘It’s all about funding.’ Well, obviously it’s not about funding—the train was going twice the speed limit,” Boehner said.

But it is about funding.

One concrete way for the government to help improve rail safety with spending would be to provide funding for Postive Train Control—which very well could have prevented the May derailment, as the technology can automatically slow or stop a train in the event of human error. Full implementation of PTC has been delayed for a host of reasons, including the complexity of the technology and syncing it with existing infrastructure. But money has also been an issue, especially for the cash-strapped public commuter agencies that are charged with funding and implementing the system. In their statements, both Obama and Price criticized the GOP for denying federal funding to implement Positive Train Control.

And Robert Lauby, the associate administrator for safety and chief safety officer for the Federal Railroad Administration, said “cost is certainly a factor” during Wednesday’s Senate hearing. “We feel that the federal government has a role in funding this PTC improvement.”

If the funding levels in the House bill become law, that won’t happen for at least another fiscal year. But at least we’ll have the next crash on videotape.
