“A Minimum Threshold For Competence”: The Republican House Of Representatives Is Still Terrible At Everything

Somehow or other, the U.S. government, for the first time in years, is close-ish to being functional. Don’t read too heavily into that word “functional.” The government is not and will not probably be moving on your pet issue any time soon, sorry. But the Senate is actually moving, on bipartisan pieces of legislation that are in the public spotlight: a farm bill, a comprehensive immigration bill. GOP senators who typically pretend to negotiate compromises and then run for the hills once they near a motion to proceed, like Lindsey Graham and Bob Corker, are suddenly seeing out those compromises. One of the two houses of Congress, in our lifetime, may well be nearing the minimum threshold for competence.

Now then, what’s the problem? Oh right, it’s the House of Representatives, which is terrible at everything, and offers no indication of being any other way until at least 2023. Let’s give some credit: They’re adept at passing go-nowhere bills to repeal Obamacare or ban abortion or tattoo the words “Under God” to every baby’s forehead. Great work there from the House Republican Party. On issues that might appeal to an even slightly broader cross-section of the country, though, they’ve got nothing. You know this. You’ve seen the same routine in nearly every important vote since 2009. Remember that time the government considered arbitrarily defaulting on the public debt and destroying the global economy forever? That was a head-scratcher for the House; took some real “working out” before they concluded it would best be averted, for now.

It always works out the same way, at the 11th hour. A Senate-originated compromise, after much pouting, is taken up by the House after several defeats of their own insane legislation. Maybe a tweak or two is offered. The House passes it. Conservatives serve up uncreative epithets for John Boehner for exercising the only decent option available to him. The next big piece of legislation comes up. And, at least as of yesterday’s farm bill flop, they begin this same fatal cycle of time wasting again.

The House leadership seemed to think, this time around, at least, that a combination of cheap tricks and a backup plan called “blaming Democrats” would change this deeply entrenched dynamic of incompetence that surrounds everything it tries to do.

The House didn’t even get to a vote on the farm bill last year, knowing it didn’t have enough votes. What could the leadership do differently this time to make sure that a bill hated by most Democrats and still too many Republicans, facing a certain Senate death and then if necessary a White House veto, could pass for no productive reason?

It could … put Iowa Rep. Steve King in charge of whipping? Yes. Yes! This would change the dynamic altogether. If a nutbird like Steve King was the one pushing for this bill then surely all conservatives would fall in line.

There’s little we enjoy more than watching a useless no-voting screecher in Congress suddenly realize he needs his goddamn corn money and then desperately try to persuade his comrades for their votes. And then when it fails, he is just so disappointed in their ability to see the bigger picture. Come on, guys, it’s about the long game here:

GOP leaders blamed Democrats and insisted their whip counts were accurate, even as Rep. Steve King (R-Iowa), who helped whip support for the bill, said he was surprised at the 62 GOP defections.

“I was surprised by about half of them,” he said. “I thought they would have taken more of a 10,000-foot view.”

Yes, show a little maturity for once, Steve King said, to other people.

Then the Republican leadership blames Minority Leader Nancy Pelosi for only bringing 24 Democratic “aye” votes to the table. Jesus. We’re not sure that Nancy Pelosi got 24 votes from the Republican Party on all major bills combined in the years 2009 and 2010. Also, there’s a reason that most Democrats didn’t vote for this farm bill, and that’s because they hate it, because it assaults the social safety net. But yeah, anyway, sure, this is Nancy Pelosi’s fault, boo, she’s evil and wears a lot of makeup, boo.

There’s only one way to a bill becoming a law in this government setup, which we’re stuck with for a while: The House has to work within the framework of a Senate-drafted compromise, and lean on Democratic votes. This is the only way things work right now, and no special guest whip or hollering at the mean San Francisco lady will change that.

And of course yesterday’s farm bill failure has implications on comprehensive immigration reform, which will most likely soon pass through the Senate. It’s hard to come to any other conclusion than Brian Beutler’s:

But more broadly, it’s tough to look at the farm bill fiasco and imagine the House passing an immigration reform bill that Dems don’t carry.

If that’s the case, then the key to the whole immigration reform effort really is John Boehner accepting the internal consequences of just putting something similar to the gang of eight bill on the floor and getting out of the way.

You can watch the farm bill fail and reason that Boehner might think immigration reform isn’t worth it. Or you can watch the farm bill fail and reason that he might decide to dispense with all the member management theatrics and throw in with Democrats and GOP donors. But you can’t watch the farm bill fail and see the House GOP passing a Hastert-rule compliant immigration reform bill and going into conference with the Senate.

We’d say Boehner will go with option 2, bringing immigration to the floor and leaning on Democrats. There’s no mysterious character quirk specific to Boehner that always leads him to this conclusion, as conservatives seem to believe. His decisions follow a fairly simple weighing of the pros and cons, and anyone in his position would make the same ones. That’s why he still has his job: because there’s no other way to do it, and those who would hope to become speaker can see that.

“Clearly Moving Backwards”: For The GOP And Tea Partiers, It’s Like Deja Vu All Over Again

There was a certain irony to the timing. Yesterday, the House Republican leadership began a new outreach effort to leaders of the Latino community, trying to repair years of damage. And during their discussions, and assurances about the GOP’s sincerity, a far-right rally was underway on the national mall featuring anti-immigrant speeches from one Republican after another.

As Kate Nocera reported, Rep. Steve King’s (R-Iowa) “was prepared to talk about immigration for six hours all by himself if he had to,” but it didn’t come to that.

But King didn’t have to talk by himself. Crowds showed up in droves. One member of Congress after another showed up to give speeches. The Heritage Foundation’s Robert Rector dropped by to talk about his widely criticized study that the Senate’s immigration bill would cost $6 trillion (though there was no criticism from this crowd).

For King the outpouring of support from Tea Party groups and likeminded members of Congress was proof that his efforts to stall, and hopefully kill, the Senate’s immigration bill in the House were working. If party leaders had hoped King would sit this fight out, by day’s end on Wednesday he had made it abundantly clear he wasn’t going anywhere. […]

“This bill is at its core amnesty,” King said to cheers. “We’re here to today … to take this debate outside the halls of Congress. If it’s not going to be good enough inside, we’ll take it outside!”

To help underscore the larger problem, consider the fact that Rep. Mario Diaz-Balart (R-Fla.) appeared at the event, spoke briefly in Spanish, and was heckled.

It’s true that immigration wasn’t the only subject discussed yesterday — the legion of far-right lawmakers were also eager to talk about the IRS. Imagine that.

But the point of the gathering was to condemn the bipartisan immigration legislation pending in the Senate: “Protesters wore T-shirts emblazoned with American flags and tea party slogans, and they waved homemade signs that read, ‘John Boehner: no amnesty, get a backbone,’ ‘Boehner: go home,’ ‘exporting illegals = importing jobs for Americans, stop socialism,’ and ‘if we lose rule of law we become Mexico.'”

And for a moment, if you lost track of the calendar, you might even think it was 2010, which isn’t exactly the Republican Party’s goal right now.

Indeed, consider yesterday’s event in the larger context: what have Republicans shown the nation lately? There was a Tea Party rally this week, which followed a big fight over an anti-abortion bill that can’t pass. In the states, we see a focus on culture-war issues, including state-mandated, medically-unnecessary ultrasounds. On Capitol Hill, most Republican lawmakers are running around talking about “amnesty” and “illegals,” which is every bit as insulting as their rhetoric about women.

Yesterday, we even heard talk about “takers,” as if the “47 percent” video never happened.

And on the horizon, many in the GOP are already planning another debt-ceiling crisis.

I argued a week ago that the Republican Party’s “rebranding” effort had gone off the rails, but in retrospect, I probably understated matters. Party leaders hoped to apply some lessons from 2012 and move the party forward, but half-way through 2013, it’s clear Republicans are moving backwards.

“The Clueless Caucus”: The GOP Rebranding Is Doomed

When a company or an organization decides to do a rebranding, it does some research, maybe hires consultants, gets input from key employees, and then makes decisions about what the rebranding is going to consist of. This process can at times be excruciating, all the more so if the organization has some commitment to consensus; if you’ve ever suffered through a web redesign, you’ve probably had the experience of wondering, as the debate over the difference between particular shades of blue stretches into its third hour, just how much it would hurt if you plunged a pen through your ear into your brain. But at the end of the process, there’s someone in charge who will have the final say.

But when a political party decides to do a rebranding, things are a lot more difficult. In fact, it may not even be possible to get everyone to agree that the rebranding will actually take place. And once it begins, it can just go on forever, because the influence over the party’s brand is so widely distributed. Even after it’s over, you can’t just say to everyone, “Here’s the new stationary, and this is our new slogan; make sure you use it.” Because if they don’t like it, they won’t.

This is the problem the Republican party now faces. Many people within the party think a rebranding is in order, to cast off the party’s image as a bunch of nativist, misogynistic, rich old white guys and make itself more palatable to young people, women, and minorities. But the party is full of people who have troubling ideas about how a rebranding ought to take place, and people who don’t think there needs to be any rebranding at all. There are so many that Ed Kilgore was able to come up with ten different kinds of Republicans who can sabotage the rebranding effort.

So various members of the party keep causing problems by saying what they think, particularly when it comes to topics like rape, or reproduction, or really anything involving, you know, women. The latest, as you probably heard, was Congressman Michael Burgess, who, in support of a bill outlawing abortion after 20 weeks on the unsupported hypothesis that fetuses at that stage can feel pain, offered his hilarious belief that 15 week-old fetuses must be able to feel pain, since they’re already engaged in a pre-natal festival of onanism. “If they’re a male baby, they may have their hand between their legs,” he said, wistfully recalling sonograms he had seen. “If they feel pleasure, why is it so hard to believe that they could feel pain?” The punch line is that before Burgess became a congressman, you know what he did for a living? He was an OB-GYN.

One way to look at this is, as Politico does, that the rebranding is being undercut by “the clueless caucus of the Republican Party.” But these kinds of things aren’t just coming from the same two or three people. Almost every time we hear some new outrageous statement from a GOP congressman, it’s someone entirely new. That’s because those beliefs are actually held quite widely within the party. There’s an almost endless supply of yahoo congressmen with retrograde beliefs, just waiting to make their dunderheaded debut on the national news.

John Boehner can’t stop these outbursts, because he’s not that kind of boss. This gets back to the difference between politics and other endeavors. Corporate CEOs and generals usually do poorly in politics because the hierarchical environments in which they flourished are so different from electoral campaigns and elected office. When you’re the boss, you can issue orders. That new electric nose-picker we’re releasing next month? The box is going to be blue, and if you’d prefer it to be red, you’re welcome to go find another job. You’ll be taking your unit up that hill, captain, whether you like it or not. But Boehner can’t fire the wingnuts in his caucus. What’s worse, they can fire him, by getting a different Speaker. Even when someone hasn’t been elected yet, it’s extremely hard to push them out of a race; don’t forget, they tried to do that with Todd Akin, and he just decided he didn’t want to leave.

And because the clueless caucus probably encompasses a majority of the party, the rebranding may well be doomed, unless somebody can rebrand the party by force. And the only one who can do that is a presidential candidate. So it may have to wait until 2016.

“The Future Is Now”: It’s Time For Republicans To Choose Sides On Immigration Reform

The future of immigration reform is, for now at least, not up to House Speaker John Boehner. It is in the hands of a group of moderately conservative Republican senators who have to decide whether their desire to solve a decades-old problem outweighs their fears of retaliation from the party’s right wing.

These senators are clearly looking for a way to vote for a bill that is the product of excruciating but largely amicable negotiations across partisan and ideological barriers. But these Republicans — they include Bob Corker, John Hoeven, Susan Collins, Dean Heller and Rob Portman — want enough changes in the measure’s border security provisions so they can tell Tea Party constituents that they didn’t just go along with a middle-of-the-road consensus.

Here’s their problem: Changes that so complicate a path to citizenship for illegal immigrants as to render it meaningless are (and should be) unacceptable to supporters of reform, including most Democrats. But if the GOP senators accept something short of this, they will face furious attacks from the hardcore opponents of any move toward large-scale naturalization of those who came here illegally.

In the end, there is no way around their dilemma. If they want a bill, they will have to take political risks.

Boehner got a lot of attention the other day for what appeared to be a firm statement that he would not let an immigration bill through the House without majority support from Republicans. On its face, his statement would seem to doom reform, given where that majority now seems to stand.

But as he typically (and, in his partial defense, perhaps necessarily) does, Boehner left himself wiggle room. “I have no intention of putting a bill on the floor that will violate the principles of our majority and divide our conference,” he said.

Ah, yes, and let’s remember that this week’s “intention” does not necessarily determine tomorrow’s strategy. It’s in Boehner’s interest to keep the large right end of his caucus at bay and to stake out a hard line to extract as many concessions from the Senate as he can. In the House at the moment, tomorrow is always another day.

What may matter is not how many Republican votes he gets but whether a majority of his caucus quietly decides that passing immigration reform is better for the party than blocking it. Many in such a majority might actually vote against a bill they privately want to see enacted. By doing so, they could satisfy their base voters back home while getting the immigration issue off the political agenda and ending the GOP’s cold war with Latino voters.

This is not unduly cynical. Many essential laws have passed because legislators found a way to balance their political needs with their convictions. The movie Lincoln is instructive on the matter.

Such calculations explain the tensions among Senate Democrats over the best way forward. Politico recently reported on differences between Sen. Charles Schumer, the leading architect of the compromise bill, and Sens. Dick Durbin and Harry Reid, the majority leader.

Schumer is more willing to accept further compromises in order to get broad Republican support. He wants 70 votes for a bill, believing that a big margin would increase pressure on the House to act. He also wants to deprive Republicans of the chance to use procedural complaints as an excuse for voting no.

Durbin and Reid are wary of giving any more ground. They want to preserve negotiating space with the House and believe enough Republicans already know they have to support reform. They see the House as so unpredictable that watering down the bill may not, in any event, be very helpful.

Here’s the potential positive news for immigration reformers: This difference may produce, if unintentionally, a good cop/bad cop dynamic that could keep the key group of Senate Republicans from undercutting the bill. Schumer can be open to a variety of border security changes, as long as they don’t disrupt the path to citizenship. He can also be clear that there are limits on how far his party can go in providing the swing Republicans with political cover.

Which brings it all back to Corker and his allies. A Congressional Budget Office report on Tuesday showing that immigration reform could cut some $900 billion from the deficit over the next two decades should make it easier for them to make a deal. But in the end, they have to choose: Which side are they on?

“The Farce That Is Darrell Issa”: Just Another Symbol Of Today’s GOP

The only thing that makes Rep. Darrell Issa remotely qualified to chair the House Oversight Committee is his personal familiarity with the investigative process – on the receiving end. The man Republican House Speaker John Boehner put in charge of investigating government wrongdoing was himself indicted for stealing a car, accused of stealing at least one other car, arrested for carrying a concealed weapon, and twice suspected of insurance fraud – and once extensively investigated by authorities for arson, because his former business associates accused him, on the record, of burning down a building to collect the insurance payout.

Democrats love to hate the silly, camera-chasing Issa, who came to power in 2011 promising to put the White House under generalized investigation. But now even some Republicans are happy to criticize Issa too. It’s easy for them to denounce his calling Jay Carney a “paid liar,” as well as his evidence-free claim that the IRS mess was directed from Washington, D.C., while they continue to participate in smearing the White House with non-scandals themselves, nonetheless.

Issa’s extremist idiocy lets “reasonable” Republicans denounce him and/or his rhetoric, while they continue their own ethically, intellectually and politically blinkered crusades against President Obama. Sure, Sen. John McCain says it was wrong to call Carney a “paid liar” – but also on MSNBC’s “Morning Joe,” he compared the IRS mess to Ronald Reagan’s deadly Iran-Contra scandal. Um, no.

Scandal-drunk Sen. Lindsey Graham says Issa went too far when he said the IRS agents who keyword-targeted Tea Party groups “were directly being ordered from Washington.” But he continued to hype the IRS story. “At the end of the day, the IRS scandal really is scary,” he told Fox’s Brian Kilmeade. “How would you like your own government to turn on you?” Is that really what happened, Lindsey Graham? And if so, it happened most brutally to a Democratic group, Emerge America, which had its tax-exempt status revoked.

Of course, McCain and Graham are also the guys who brought us the ultimate non-scandal: Benghazi. Issa’s idiocy lets them retain their role as “statesmen,” gets them invited back on the Sunday shows, and gives the media an excuse to consider them arbiters of what’s politically acceptable – while they’re themselves on the right fringe. Of course it’s guys like Issa who constantly move that standard of what’s politically acceptable to the right.

Honestly, when David Plouffe started raising Issa’s past on ABC’s “This Week,” and then on Twitter, part of me winced. But that’s because I didn’t completely remember Ryan Lizza’s amazing Issa profile in the New Yorker – which was respectful while also documenting Issa’s troubling history with law enforcement – as well as my own life in California during the surreal 2003 recall of Gray Davis (another example of GOP nullification of election results, by any means necessary, usually big money).

Issa financed the recall, and hoped to run for governor himself, but then the Los Angeles Times and other California papers began reporting on his earlier legal troubles. There was particular attention to his indictment for grand theft when he reported his Mercedes stolen after his brother William sold it; William had earlier obtained the right to do so from his brother. The two men had different stories for a while, and authorities believed they’d conspired to sell the car, report a “theft” and collect insurance on it.

(I personally think the arson investigation was even more damning: An Issa colleague gave investigators vivid detail that indicated his car-alarm factory had been intentionally torched, after Issa increased his insurance from $100,000 to $462,000. “Quite frankly,” Joey Adkins told authorities, “I feel the man set the fire.” But the local fire marshal never determined the fire’s cause.)

In the end, the scrutiny doomed Issa’s chance to run for governor – but his wealth funded the successful recall of Davis. Sure, Issa could continue to hold his House seat in his conservative San Diego district, but a guy as ethically compromised (and as blinkered ideologically) as Issa could never win a statewide election in California – let alone a national one. So he tearfully stepped aside for Arnold Schwarzenegger.

So that’s the guy who’s heading up the House GOP’s investigation into alleged Obama White House “scandals.”

Sen. Chuck Schumer got a lot of attention Monday for telling “Meet the Press’s” David Gregory that Issa’s overreach is setting up a GOP loss in 2014 – just like the impeachment witch hunt against President Clinton set up his party’s historic gain of seats in the 1998 midterms. I hope Schumer’s right. But I find myself taking little comfort even in that uncertain outcome.

Democrats, including myself, like to declare that impeachment didn’t resonate with the American people, who gave Clinton ever-higher approval ratings as the witch hunt continued. And yes, Clinton’s party won seats in the ’98 midterm. But impeachment, and the myriad baseless investigations that preceded it, from Whitewater to Travelgate to alleged Chinese fundraising scandals, preoccupied both the White House and the media, to the detriment of Clinton’s agenda, particularly in his second term. They certainly didn’t help Vice President Al Gore in his campaign to win the presidency.

While I’ve always rejected the claims of some anti-Clinton centrist Democrats that Clinton’s philandering cost Gore the election, there was at least some polling that suggested it hurt Gore with suburban women. Certainly the cloud of scandal – and the stalling of the Clinton-Gore agenda – couldn’t have helped Gore, who won the popular vote and by reliable accounts the electoral vote in a race that shouldn’t have even been as close as it was, given the strength of the economy and the deficits of George W. Bush. I would argue that Clinton’s experience proves GOP scandal-mongering works – and once again, the media let the party get away with it.

I’m happy even some mainstream media pundits are warning that Issa’s overreach could hurt the GOP in 2014. And yet that new rhetorical twist puts the focus on horse race politics, where all of journalism appears most comfortable today. Issa’s extremism may or may not hurt his party at the polls. All I know is it should be hurting him, and the GOP, more with the American people, when they think about what they want in their leaders.
