“The Pipeline From Hell”: There’s No Good Reason To Build Keystone XL
The Senate will vote Tuesday on whether to authorize the construction of the Keystone XL Pipeline. The Republican-led House approved the initiative Friday by a wide margin. The Senate’s still-Democratic majority will bring the bill to the floor for the first time because of newfound support for the initiative within the party, mostly to boost Sen. Mary Landrieu’s bid for reelection in Louisiana as she heads into a runoff with Rep. Bill Cassidy, a Republican. Cassidy leads in every poll of likely voters in that race by an average of 5 percentage points.
Support for the pipeline has surged among Democratic legislators in the wake of the midterm elections, when Democratic senators in red states were swept out of office. Those that remain—among them Sens. Joe Manchin of West Virginia, Heidi Heitkamp of North Dakota, and Claire McCaskill of Missouri—are eager to boost their pro-energy, pro-business bona fides.
If Democratic support is new, Republicans’ enthusiasm for the project is not. Friday’s vote was the ninth time the House has approved the pipeline under a Republican majority. As soon as the midterm results had rolled in, the victorious party’s messaging shifted en masse. Republican National Committee Chairman Reince Priebus made the TV rounds on Election Night, and by the time he arrived on The Daily Show’s live edition, he had his message down to a T: “I think that what we’re going to see is that the president’s got to come to the table, and both parties are going to have to work together to get things done… It’s going to take the president saying ‘I want to work with you, I want to pass some of these jobs bills, I want to pass the Keystone Pipeline and get things done.”
It’s a well-worn, exceedingly vague message. From his phrasing, it seems that the pipeline is a no-brainer, a job-creation machine that enjoys support from Republicans and Democrats alike. Priebus mentioned it in seemingly every post-election appearance, references made their way into victory speeches from the GOP’s biggest power players, and they’ve since declared the project’s approval a top priority.
It seems America’s two major parties are finally coming together in favor of a significant legislative initiative. But should they be?
Keystone XL would be an addition to the existing Keystone Pipeline System. It would be built by TransCanada Corp. and would run from Alberta’s tar-sands fields through Montana and South Dakota to link up with the system in Steele City, Nebraska. It would transport bitumen and liquefied natural gas drawn from the tar sands to refineries on the Gulf Coast, mainly in Texas.
The XL addition was proposed in 2008, and studies on the project’s potential economic and environmental impact were commissioned in 2010 and 2011. President Obama rejected the project’s application in 2012 amid protests that it would hurt Nebraska’s Sand Hills region. An adjusted route through Nebraska has since been proposed, and a State Department report declared the project’s environmental effect was “not significant,” but the Obama administration announced in April 2014 that the review of the project has been extended indefinitely.
Why, if the project will create a lot of jobs and have little environmental impact, does it continue to be met with opposition? To begin with, it won’t actually create many jobs. According to a George Mason University study, via Bloomberg, the pipeline’s construction could create between 2,500 and 20,000 jobs. More likely (PDF), it’ll be between 2,500 and 4,650, assuming that a huge chunk (as much as 50 percent) of steel production will be outsourced to China, Canada, and India. Moreover, when construction ends, the number of permanent jobs could fall to 20. Yes, 20.
A rosier estimate, from the State Department’s report and Newsweek, puts the number of permanent jobs at 35. A study by Cornell’s Global Labor Institute claims that the project may actually kill more American jobs than it creates due to pipeline spills, additional fuel costs in the Midwest, and other factors. It also claims that 85-90 percent of people hired for the line’s construction will not be from the areas through which the pipeline is running.
So, it won’t create that many jobs. After all, it’s merely taking oil drilled in Canada to pre-existing refineries on the Gulf Coast. But it’s a $7 billion project, and the State Department has said it will have a minimal negative effect on the environment. Plus, it could increase America’s energy independence and strengthen our position in the Middle East and beyond. These are all good reasons to move ahead with the plan, but unfortunately, none of them are actually true.
The pipeline is a $7 billion project, but only $3 billion-$4 billion of that would be headed to the U.S. The rest is going to wherever that steel is getting outsourced. The claim of reduced dependence on foreign oil suppliers is also suspect. China has already invested billions in Canada’s oil sands, and Chinese corporations are upping their stakes all the time. Much of the oil transported by the pipeline will be refined in Port Arthur, Texas, where the main refinery is half-owned by the state-owned oil company of Saudi Arabia (PDF). The Keystone project is not an American one, but a global one, financed and favored by major multinational oil interests. Besides, real domestic oil production—oil drilled and refined in the U.S. by nominally American companies—has already increased 70 percent under the Obama administration.
All of this means that the pipeline’s approval would essentially be a continuation of the status quo, with a few billion dollars kicked the U.S. economy’s way. Except that the project would, in spite of the State Department’s claims, have drastic effects on the environment on both local and global levels. That study published by the State Department was conducted by Environmental Resources Management (ERM), a firm that listed TransCanada, the would-be pipeline builder, as a client in its marketing materials a year before it began the Keystone contract.
Both ERM and TransCanada told the State Department at the time that they had not worked together for at least five years, a term of the contract meant to limit conflict of interest. Of course, any doubts about a conflict of interest evaporated when it emerged that up until the summer of 2013, a division of ERM had been “working alongside TransCanada on the Alaska Pipeline Project.” These are two in a laundry list of troubling connections between the two companies.
Considering, then, that the State Department study was conducted by TransCanada’s business partner, it’s little surprise that it failed to find any environmental consequences for the project. The reality is far different. On a local level, pipeline leaks and spills could have a number of drastic effects. Recent leaks from similar lines have been bad. Really bad. A New York Times article cites a 2010 leak of 840,000 gallons of bitumen into Michigan’s Kalamazoo River. The cleanup has cost $1 billion so far, and continues today.
It also mentions an Arkansas leak that sent 210,000 gallons of bitumen running through the streets of small-town Mayflower and left local residents with respiratory problems, nausea, and headaches. The proposed Keystone route would see it “pass over the Ogallala Aquifer, the lifeblood of Great Plains agriculture,” where the water table is close to the surface. A major leak could poison the water supply of large swaths of the Midwest that add up to one quarter of the nation’s farmland.
The pipeline also has environmental consequences on a larger scale. The pipeline would encourage accelerated extraction of Canada’s tar sands, which have greenhouse gas emissions 81 percent greater than those of conventional oil. By most measures, it is the dirtiest fossil fuel on the planet. James Hansen, formerly of NASA, claimed in a 2012 op-ed that the tar sands contain twice the amount of carbon dioxide emitted by global oil use in our entire history. If true, its exploitation along with our continued use of fossil fuels at present levels would bring carbon concentration in the atmosphere above the 500 parts per million threshold often discussed by climatologists as the point of no return. That would create an irreversible cycle wherein the climate is beyond our control. Hansen describes it as “game over for the environment.”
Even if that’s an alarmist prediction, and Canada will exploit their tar sands with or without the Keystone XL Pipeline, there is no question that its construction will not help with controlling emissions, boosting energy independence, or creating jobs. The only people it will benefit are TransCanada, the Canadian oil companies (many part-owned by Chinese and Mideast interests) working in the tar sands, the multinational oil companies who will refine what it brings to the Gulf Coast, and a few thousand workers. Temporarily.
So why, you might ask, are many of our leaders so eager to build it? The answer is straightforward: money and political gain. The Democrats, feeling vulnerable after a midterm rout, are eager to move to the pro-business center and push through a “jobs plan.” A Nov. 12 Pew Research poll shows 59 percent of Americans favor building the pipeline, which provides some political cover from the backlash Democrats will likely get from environmentalists and other sections of the party’s base.
It also conveniently caters to the interests of Big Energy, some of the biggest campaign donors to both parties. Republicans, in the House especially, have been pushing Keystone for some time and raking in donations in the process. Now, Blue Dog Democrats like Mary Landrieu are happy to hop on board. After all, some of the world’s biggest energy firms, like Exxon Mobil, have been paying her campaign bills for some time.
An initiative most thought would be pushed by the Republican majorities in the next Congress will come to the floor in the current lame-duck session. In a rather pathetic political maneuver, the Senate Democrats will try to force the president’s hand before the new Republican majority gets the chance, apparently to help in a single Senate runoff election that will not in any way alter the upper chamber’s political landscape. After all, the Democrats have no chance of keeping their majority even if Landrieu wins.
For his part, Obama has said he will veto the measure. Pundits widely expected that he would insist on the need to wait for the results of further studies and the Supreme Court ruling on land use in Nebraska. Instead, he came out Thursday with an unequivocal rejection of the premise on which the argument for the pipeline is built: “Understand what this project is: It is providing the ability of Canada to pump their oil, send it through our land, down to the Gulf, where it will be sold everywhere else. It doesn’t have an impact on U.S. gas prices. If my Republican friends really want to focus on what’s good for the American people in terms of job creation and lower energy costs, we should be engaging in a conversation about what we are doing to produce more homegrown energy.”
The president is right in his criticisms, but wrong to reserve them only for the Republican Party. Many from his side of the aisle are now just as wrong on this issue as his opponents are.

“Theatrical Posturing, Not Much Lawmaking”: What We Talk About When We Talk About A Republican Senate
Presuming we have a Republican Congress next year, there’s going to be a lot of talk right after the election about what that will change 1) politically and 2) substantively. While I’m ordinarily an advocate of more substantive discussion and less political discussion (not that I have a problem with political discussion, since I do plenty of it myself, it’s just that it should be leavened with consideration of the things that actually matter), there’s a potential problem in the substantive discussion that I think we should be on the lookout for.
For instance, this morning on the radio I heard some energy expert whose name I didn’t catch say that if Republicans take over the Senate, we’re likely to see the government shift its focus toward fossil fuels and away from renewables. Which sounds perfectly logical until you ask how such a shift is supposed to take place.
This is what is often missing from policy discussion: enough acknowledgment of the institutional processes that determine how policies actually get set and altered. If you’re going to say that a Republican Congress is going to produce a particular policy change, you have to be clear that you’re saying the following events will occur:
1. Republicans will write a bill to do the thing.
2. The bill to do the thing will not only pass the House but more importantly garner 60 votes in the Senate, which means it will get the votes not only of Republicans but also of some Democrats, thereby overcoming a Democratic filibuster.
3. President Obama will sign the bill to do the thing.
It’s possible that that sequence of events could occur in some cases. For instance, Republicans have had a feverish desire to build the Keystone XL pipeline for some time, and they’ve come to attach an importance to it that’s way out of proportion to its actual impact. They seem to say with all sincerity that building the pipeline is a key to American prosperity, which is beyond absurd—building the pipeline would create a few thousand temporary jobs, and the number of permanent jobs maintaining it would literally be in the dozens. But President Obama never seemed adamantly opposed to the pipeline, and one could imagine him signing on if he got something in return. You could also see the pipeline getting a few Democratic votes from red state Democrats who want to show that they love the world’s dirtiest fuel (tar sands oil) and are therefore not hippies, so it could get 60 votes.
That might or might not happen, but it’s at least conceivable. It wouldn’t, however, represent some massive shift in our nation’s energy policy, whatever else you might think about it. And it’s an extremely unusual case.
On almost everything else Republicans want to do, either the bills they write won’t overcome Democratic filibusters, or they’ll be vetoed by the President. Much of the time, that will be because instead of embarking on a good-faith effort to find some accommodation with Democrats, they’ll just propose the thing they really want. It might be possible to forge a compromise on tax reform, but that would be a lengthy and involved process, so Republicans will just try to pass a bill slashing corporate tax rates, which won’t become law. There are ways the Affordable Care Act could be improved, but instead of working with Democrats to find them, they’ll be much more inclined to just pass repeal votes, whether it’s repeal of the entire law or repeal of individual provisions one by one (or, more likely, both).
In other words, we’re going to get an awful lot of theatrical posturing, and not very much lawmaking. We shouldn’t mistake the latter for the former.

“How Can Dems Be Losing To These Idiots?”: The Most Anti-Idea Party In The History Of Parties
Back in February, I wrote a column arguing that the Democrats would need a strong, base-motivating message this year. By which I did not mean happy talk about jobs or the minimum wage. I meant the age-old motivator, fear—stoking fear in their base of what a Republican Senate would look like.
Well, here we are eight months later and less than a week out from the voting, and they haven’t done it. They’ve done a little of it. They push the “war on women” button, and a couple of others, like Social Security, which I discussed yesterday. But it just amazes me. They are running against a party that is as intellectually dishonest and bankrupt and just plain old willfully stupid as a political party can possibly be, and they have developed no language for communicating that to voters.
I mean it is truly admirable, in its perverse way, how anti-idea this party is. It has no economic plans. Did you see this Times article last week called “Economists See Limited Gains in G.O.P. Plan”? I trust that you understand the world of newspaper euphemism enough to know that “limited gains” basically means “jack shit.” It’s all tax cuts and fracking and the wildly overhyped (in jobs terms (PDF)) Keystone pipeline.
Republicans know the truth about these proposals deep down, or I think most do (I suppose some actually are that dumb). But they keep peddling them like a costermonger selling rotten fruit. Why? At least in part because they also know deep down that things like an infrastructure bank are what will really create jobs. I mean, it’s the very definition of creating jobs. But they can’t be for that, because it would be a vote for Obama, and Party Chairman Limbaugh would call them mean names.
Not a single constructive idea. Oh, they put out these things they call “ideas,” so they can sound like they have ideas, but they’re not meant for actual implementation. They’re just meant to exist so candidates can campaign saying, “See? I have ideas!”
And then, of course, there are a few actual ideas they do have, like the Ryan Budget, but those are deep-sixed at campaign time, because the Republicans know that it would indeed force seniors to pay more out-of-pocket for their Medicare—I mean, as far as Paul Ryan is concerned, that’s the point!—and they’d much sooner not have to answer such questions at election time.
So they’ve got nothing. Not on the economy. Not on immigration reform. Not on health care—ah, health care. Think back with me now. In the first half of this year, there were a lot of news stories that got pumped out through Speaker John Boehner’s office about the Republicans working on a plan to replace Obamacare. Oh, it’s coming along, he said in summer. And the media scribbled down stories: Lookout, Obama! Republicans coming with alternative proposal!
Well, try Googling it now. You won’t find a word. They have no intention of “replacing” Obamacare with anything, and they never did. It was just something they knew they had to say for a while to sound responsible in Beltway land. Oh and by the way, that celebrated House lawsuit against Obamacare—remember that one, announced back in June? It turns out they haven’t even filed it! How empty can you get? Even their smoke and mirrors is smoke and mirrors.
On foreign policy, which is to say on the question of a world that is clearly in a deep crisis that the United States must perforce play a central solve in trying to solve, Republicans again have nothing meaningful to say. And please, don’t tell me “but Rand Paul!” His speech laid out some decent notions as far as they went, but how can a person support the war against ISIS while opposing the arming of the Syrian rebels? That’s like supporting a crackdown on bank robbery while advocating that banks keep the safes unlocked. And Paul, probably, is the closest thing the party has to a responsible voice on foreign policy.
I could go on, but you follow me. The GOP has absolutely nothing of substance to say to the American people, on any topic. The Republicans’ great triumph of this election season is their gains among women, which have happened because (mirabile dictu!) they’ve managed to make it through the campaign (so far) without any of their candidates asserting that rape is the will of God. All these extremists who may be about to win Senate seats are winning them basically by saying opponent, opponent, opponent, Obama, Obama, Obama.
And the Democrats can’t beat these guys? This should not be hard. But it is hard. Why? There’s the “who votes” question. There’s money, especially the outside dark money I wrote about last week. And there’s the GOP skill at pushing the right fear buttons. And there’s the fact that the president happens to be, well, you know.
But the underlying reason is this: The Democrats don’t have the right words for attacking the Republicans’ core essence and putting Republican candidates on the defensive. When Republicans attack Democrats, the attacks quite often go right to the heart of Democratic essence, and philosophy. “My opponent is a big-government, big-spending, high-taxing” etc. That gets it all in there in a few short words. Every Republican says it, and the fact is that it’s typically at least sort of true, because Democrats do believe in government and spending and taxes.
As a result, in almost every American election, the Democrat is instantly put on the defensive, while the Republican is playing offense. Of course that’s going to be truer in a sixth-year election of an incumbent Democratic president. But it’s usually more true than not. The Democrat, who is for things, who wants to do things besides cut budgets and taxes, carries the burden of explaining why those things will be good.
In fairness to the Democrats, they’re a little boxed in, because they can’t respond to the above attack by saying, “Well, my opponent is a small-government, low-spending, low-taxing” etc., which wouldn’t sound like much of an attack to most people.
So what they have to do instead is find a way to talk about this policy bankruptcy and duplicity of the GOP that I describe above, the party’s essential anti-idea-ness, because it’s through that bankruptcy and duplicity that the Republican Party manages to conceal from voters its actual agenda, which is to slash regulations and taxes and let energy companies and megabanks and multinational corporations do whatever it is they wish to do. Most Americans may be for limited government and lower taxes, but they sure aren’t for that.
In my experience, Democrats seem kind of afraid to do this. Partly afraid of the Republicans, and partly afraid of the conglomerates (they seek campaign contributions from Citibank too). And maybe my suggested way isn’t the only way to do it.
But high-ranking Democrats collectively need to perform the following exercise. Sit down together in a room. Distribute index cards. Let each of them write down five adjectives they associate with the GOP, adjectives they not only believe themselves but hear from constituents. Because the crowd has wisdom that the individual does not, take those that get the most mentions and turn them into attack on the GOP’s essence that will put Republican candidates on the defensive. Maybe that’s when our campaigns will change.

“And There You Have It”: Walker On Minimum Wage; ‘I Don’t Think It Serves A Purpose’
Wisconsin Gov. Scott Walker (R) debated challenger Mary Burke (D) on Friday, and the issue of the minimum wage offered the candidates a chance to highlight their differences. The question posed summarized the situation nicely: can a full-time worker live on $7.25 an hour? And does the state have a responsibility to even set a minimum wage?
Burke “strongly” endorsed a higher legal minimum, but the Republican incumbent largely dodged the question, though he seemed to express opposition to the law itself. “I want jobs that pay two or three times the minimum wage,” Walker said, adding, “The way that you do that is not by an arbitrary level of a state.”
Daniel Bice at the Milwaukee Journal Sentinel followed up on that point in an interview with the governor today, asking Walker whether he believes the law should exist. The governor replied:
“Well, I’m not going to repeal it but I don’t think it’s, I don’t think it serves a purpose. Because we’re debating then about what the lowest levels are at. I want people to make, like I said the other night, two or three times that.”
It’s a striking thing for a governor to say during a tough re-election campaign, especially given his economic record – Walker promised Wisconsin voters four years ago that he’d create 250,000 jobs in his first term, and he’s struggling to get to Election Day with roughly half that total.
Indeed, if the governor doesn’t think the minimum wage “serves a purpose,” it’s not too late for Walker to ask someone to explain the law’s rationale.
Establishing a minimum wage is not about creating a target income for an entire population – it’s about creating a floor so that full-time workers don’t have to live in poverty.
Walker’s comments are rather bewildering. When Democrats created the federal minimum wage – after Henry Ford helped prove its value – the point wasn’t to “debate what the lowest levels” would be for most people, but rather, the law was created as a protection against abuse. Its existence did not prevent U.S. workers from creating the world’s most dynamic middle class.
How an incumbent governor of a Midwestern state can still find this confusing is a bit of a mystery.
For that matter, we can look around the country and see plenty of states doing quite well after raising their minimum wage, which makes sense – when more workers have more money in their pockets, they’ll spend more, which creates more economic activity and more jobs.
It’s one of the reasons a higher minimum wage is so popular with so much of the country.
It’s heartening, I guess, that Scott Walker isn’t pushing for the repeal of the wage law, but the fact that he doesn’t see its “purpose” seems like the sort of thing Wisconsin voters will be hearing again in the campaign’s final three weeks.

“Money Grab”: It Gets Worse For David Perdue
Speaking of politically damaging material the New York Times is looking into, Jonathan Weisman today notes the bankruptcy deposition that revealed Georgia GOP Senate candidate David Perdue’s bland revelations of a long career in outsourcing contains some other interesting stuff:
A bankruptcy court document that surfaced last week has roiled the Georgia race for retiring Senator Saxby Chambliss’s seat and put the Republican David Perdue on the defensive over his record as a business executive and his role sending jobs to low-wage countries.
Though most of the attention — and the attacks from his opponent, Michelle Nunn — have focused on comments he made about outsourcing, a close reading of the 186-page deposition, first disclosed last week by Politico, paints Mr. Perdue as a hard-charging hired gun who was so aggressive in claiming his compensation perks from his failing textile company that other executives accused him of a “money grab,” a characterization he hotly denied.
In page after page, Mr. Perdue, who had come from a lucrative post at Reebok, expresses more concern with his own financial security than with the tanking business and the 7,600 jobs that were going down with it….
As his company was heading toward bankruptcy, Mr. Perdue pressed the board for a $700,000 payout to cover taxes he owed on a signing bonus and $100,000 for a relocation he never actually took. He received both, as well as a $500,000 stipend to stay on during final, failed takeover negotiations that could have rescued Pillowtex. He announced his resignation that spring, effective after a two-week paid vacation.
Sounds like we’re about one juicy quote away from the text of another Michelle Nunn or Super-PAC ad. And given Perdue’s penchant for gaffes, he might well just serve it up in the present tense.
The lessen here is that if you’re going to run one of those CEO/outsider campaigns, you should probably have a business career that doesn’t sound as damaging to regular folks–or as self-serving–as a political career.
