“From Dysfunction To Malfunction”: Mitch McConnell And The Limits Of Scorched-Earth Obstructionism
As the Senate Republicans’ leader, Mitch McConnell launched an experiment of sorts during the Obama era. It was a strategy without precedent in the American tradition, and it was arguably a historic gamble that wasn’t guaranteed to work. But the Kentucky Republican and his allies did it anyway.
And as the calendar turns from November to December, it’s worth appreciating that last month was arguably the most informative to date when it comes to the results of this experiment – it was a month that crystallized the ways in which the GOP gambit was an extraordinary success and the ways in which it failed in ways McConnell didn’t expect.
McConnell’s master strategy was elegant in its simplicity: after his party was soundly rejected by voters in 2006 and 2008, McConnell came to believe recovery was dependent on unprecedented obstructionism. Republicans, the GOP leader decided, would simply say no to everything – regardless of merit or consequence, even when Democrats agreed with them.
The point, as McConnell has acknowledged many times, was to deny President Obama and his allies the all-important cover of bipartisanship – when an idea enjoys support from both parties, it’s effectively the Good Housekeeping Seal of Approval for the American mainstream. But if Republicans embraced blanket opposition to literally every Democratic proposal, the public would assume Obama was failing to bring the parties together behind a sound, moderate agenda. The gridlock would be crushing, but McConnell assumed the media and much of the electorate would simply blame the White House, even if that didn’t make any factual sense.
It worked. The American legislative progress has turned from dysfunction to malfunction over the last four years, creating a Congress that fails to complete even routine tasks, and those responsible for creating the worst governing conditions since the Civil War were broadly rewarded by voters. Obama went being from the popular, post-partisan leader who would repair the nation’s ills – an FDR for the 21st century – to the president with a meager approval rating who hasn’t signed a major bill into law since 2010.
As the results came in on Election Night, Vox.com made a compelling case that described Mitch McConnell as “the greatest strategist in contemporary politics.”
It’s tough to disagree, right? Republicans intended to destroy the American legislative process, and they did. Republicans set out to exacerbate partisan tensions, and they did. Republicans hoped to make Obama less popular by making it vastly more difficult for him to get anything done, and they did. Republicans hoped to parlay public discontent into electoral victories, and they did. Republicans made a conscious decision to prevent the president from bringing the country together, and they successfully made the national chasm larger.
There’s just one thing McConnell & Co. forgot: a gamble like this can be a strategic success and a substantive failure at the same time.
Consider this report, which ran on Thanksgiving.
President Obama could leave office with the most aggressive, far-reaching environmental legacy of any occupant of the White House. Yet it is very possible that not a single major environmental law will have passed during his two terms in Washington.
Instead, Mr. Obama has turned to the vast reach of the Clean Air Act of 1970, which some legal experts call the most powerful environmental law in the world. Faced with a Congress that has shut down his attempts to push through an environmental agenda, Mr. Obama is using the authority of the act passed at the birth of the environmental movement to issue a series of landmark regulations on air pollution, from soot to smog, to mercury and planet-warming carbon dioxide.
It seems counterintuitive, but President Obama simply doesn’t need Congress to advance one of the most sweeping and ambitious environmental agendas in generations.
With this in mind, McConnell’s strategy worked exactly as intended, producing the precise results Republicans were counting on, but the plan failed to appreciate what an ambitious president can still do with the powers of the presidency.
It’s not just the environment, of course. McConnell’s plan was also intended to destroy immigration reform, which was effective right up until Obama identified a legal way around Congress, helping millions of families in the process. Jon Chait added:
The GOP has withheld cooperation from every major element of President Obama’s agenda, beginning with the stimulus, through health-care reform, financial regulation, the environment, long-term debt reduction, and so on. That stance has worked extremely well as a political strategy. […]
The formula only fails to work if the president happens to have an easy and legal way to act on the issue in question without Congress. Obama can’t do that on infrastructure, or the grand bargain, and he couldn’t do it on health care. But he could do it on immigration.
And the environment. And in addressing the Ebola threat. And in targeting ISIS.
The irony is, had McConnell pursued a different approach, he could have advanced more conservative policy goals. If Republicans had worked with Democrats on health care, the Affordable Care Act would have included provisions with the right. If McConnell were willing to deal on immigration, Obama would have endorsed a more conservative approach than the executive actions announced two weeks ago. If the GOP made an effort to work with the White House on energy, Obama’s environmental vision would almost certainly have more modest goals.
Republicans might have been better off – which is to say, they would have ended up with a more conservative outcome – if they’d actually compromised and taken governing seriously in some key areas.
But McConnell thought it’d be easier to win through scorched-earth obstructionism.
Again, as of next month, he’ll be the Senate Majority Leader, so maybe he doesn’t care about the substantive setbacks. But for all the GOP gains at the ballot box, it’s Obama, not Republicans, moving a policy agenda forward.

“Voters Remorse”: The New GOP Congress Americans Do Not ‘Wish They Had’
The man who lost the last (presidential) election round and who goes around talk shows trying to pretend he did not, has some advice for the man who beat him in 2012.
Appearing on Sunday’s CBS Face the Nation, failed presidential candidate Mitt Romney told Bob Schieffer, when asked about the possibility of “Obama taking executive action to overhaul immigration policy,” “The president has got to learn that he lost this last election round.”
The man who lost the last (presidential) election round said so after lecturing his nemesis about how to fight ISIL (“what we should have done by now is have — is have American troops staying by in — in Iraq”) and after implying that perhaps the President should just curl up in a fetal position, contrary to David Axelrod’s and most Americans’ expectations. “The President ought to let the Republican Congress, the Republican House and the Republican Senate come together with legislation that they put on his desk which relates to immigration,” the man who lost the last (presidential) election round told Bob Schieffer.
This latest bit of GOP arrogance is very similar to Mitch McConnell’s recent hubris: “We’d like for the president to recognize the reality that he has the government that he has, not the one that he wishes he had, and work with us,” when a “very disturbed” incoming Senate Majority Leader lamented that the president was still the President and was still intending to use his executive powers.
Which, in turn, is very reminiscent of the effrontery of former Defense Secretary Donald Rumsfeld whose callous response to a soldier asking for better protection for our troops in Iraq was: “You go to war with the army you have, not the army you might want or wish to have at a later time.”
Memo to Messrs. Romney and McConnell — and to the GOP:
Midterm elections are not intended to neuter a president. They are midcourse corrections intended to make government work better for the people who elect their representatives; to — in fact — transform the government we have into the government the people wish they have. On November 4, 2014, the American people gave Republicans another chance to stop the obstruction, stop the obfuscation, stop the gridlock, stop the arrogance, stop the raw partisanship and work with a man who is still President of the United States for the common good of all Americans, not just a few.
To do all this, congressional Republicans must disprove the disturbing allegation that they “have been sent to Washington with a mandate not so much to conduct business but rather to collect a bounty, to do what they promised and what their supporters expect: Stop Obama at any cost and at every turn, to erase his name or at least put an asterisk by it.”
Or will they?

“A Tired, Old And Wrong Cliche”: President Obama Is No ‘Bystander’
New Jersey Gov. Chris Christie (R) delivered a widely noticed speech in September 2011, condemning President Obama, not just on policy grounds, but specifically on the issue of leadership. “We continue to wait and hope that our president will finally stop being a bystander in the Oval Office,” the governor said. “We hope that he will shake off the paralysis that has made it impossible for him to take on the really big things.”
Much of the political media agreed and echoed the assessment. Pundits crying, “Why won’t Obama lead?” became so common, a tired cliche was born. The president may have run as a young, ambitious leader, eager to change the world, but the Beltway was increasingly convinced: Obama is an overly cautious, overly cerebral president who would rather talk than act.
Two weeks ago, Dana Milbank went so far as to endorse Charles Krauthammer’s thesis of Obama as a “passive bystander.”
The real problem with Obama is not overreach but his tendency to be hands-off.
Since the second year of Obama’s presidency, I have been lamenting the lack of strong leadership coming from the White House, describing Obama in June, 2010, as a “hapless bystander … as the crises cancel his agenda and weaken his presidency.” I’ve since described him over the years as “oddly like a spectator” and as “President Passerby.”
Let’s put aside, for now, the fact that the bystander thesis completely contradicts the other common anti-Obama condemnation: he’s a tyrannical dictator whose radical agenda is destroying the very fabric of America.
Instead, let’s focus on why the bystander thesis appears to be outrageously wrong – especially today.
Faced with an intensifying climate crisis, a hapless bystander, content to watch challenges pass him by, might have decided to do nothing. Maybe he’d call for action in a State of the Union address or issue a white paper, but President Spectator would struggle to shake off the paralysis that makes it impossible to take on the really big things.
Except Obama’s done the opposite, unveiling an ambitious domestic agenda, striking a deal with China that few thought possible, and challenging the rest of the world to follow his lead. It’s an effort wrought with political and policy pitfalls, but Obama’s doing it anyway because he sees this as an effort worth making.
As we discussed back in February, there’s a group of pundits who’ve invested almost comical amounts of time urging Obama to “lead more.” It’s never been entirely clear what, specifically, these pundits expect the president to do, especially in the face of unyielding and reflexive opposition from Congress, but the complaints have been constant for years.
As the argument goes, if only the president were willing to lead – louder, harder, and bigger – he could somehow advance his agenda through sheer force of will, institutional constraints be damned. And if Congress resists, it’s necessarily evidence that Obama is leading poorly – after all, if only he were a more leading leader, Congress would … follow his lead. The line of criticism became so tiresome and so common that Greg Sargent began mocking it with a convenient label: the Green Lantern Theory of Presidential Power.
What seems obvious now, however, is the need for these pundits to reconsider the thesis.
Obama saw a worsening climate crisis, so he decided to take the lead. Obama is tired of waiting for a hapless Congress to act on immigration, so he’s leading here, too. Obama saw an Ebola threat, and he’s leading a global effort to save lives. Obama sees an ISIS threat, so he’s leading an international campaign to confront the militants.
The president showed leadership when disarming Syria of its chemical weapons. He’s showing leadership in trying to strike a nuclear deal with Iran. He showed leadership on the minimum wage, raising it for federal contractors while Congress sat on its hands. He’s showed leadership on health care, rescuing the auto industry, and advancing the cause of civil rights. [Update: several readers reminded me he’s leading on net neutrality, too.]
The policymaking process is filled with choke points, but when the president has his eyes on a priority, he doesn’t just throw up his arms in despair when one door closes; he looks for a new route to his destination.
Now, if Obama’s critics want to question whether he’s leading the country in the right direction, that’s obviously grounds for a spirited debate – each of the president’s decisions can and should be evaluated closely on the merits. “Leadership” is not an a priori good. Obama can take the lead on a given issue, but that doesn’t necessarily mean he’s right.
But if Obama’s detractors would have Americans believe he’s not leading at all, I haven’t the foggiest idea what they’re talking about.

“The Fable Of Rand Paul”: Less Of A Thoroughbred With Stamina Than A One-Adjective Pony
“The most interesting man in politics” is what Politico Magazine crowned Rand Paul in September, when it placed him at the top of a list of 50 people to keep an eye on. And Time magazine used those exact six words, in that exact order, next to a photograph of Paul on its cover last month.
The adjective bears notice. Interesting. Not powerful. Not popular. Not even influential.
They’re saying that he’s a great character.
And that’s not the same as a great candidate.
You could easily lose sight of that, given the bonanza of media coverage that he has received, much of it over the past week and a half, as journalists eagerly slough off the midterms, exuberantly handicap the coming presidential race and no longer digress to apologize for getting into the game too soon. The game’s on, folks. From here forward, it’s all 2016 all the time.
And in order to keep the story varied and vivid, those of us chronicling it will insist on stocking it with players who break the rules and the mold, who present the possibility of twists and surprises, whose surnames aren’t Bush or Clinton, whose faces are somewhat fresh.
Cue Rand Paul. He gives good narrative.
He’s an ophthalmologist who never held office before his successful 2010 Senate race. He’s got that sporadically kooky dad. He’s a dove in a party aflutter with hawks. And he’s a gleeful nuisance, which he demonstrated when he commandeered the Senate floor for nearly 13 hours and filled Ted Cruz with filibuster envy.
All of that has made him a media sensation. But none of it would necessarily serve a quest for the Republican presidential nomination. At this point Paul is as much a political fable as a political reality, and his supposed strengths — a libertarian streak that appeals to some young people, an apparent comfort with reaching out to minorities and expanding the Republican base — pale beside his weaknesses. They’re many.
And they’re potentially ruinous.
The dovish statements and reputation are no small hurdle. No Republican nominee in recent decades has had a perspective on foreign policy and military intervention quite like Paul’s, and there’s little evidence that the party’s establishment or a majority of its voters would endorse it.
Nor is there any compelling sign that the party is moving in his direction. In the wake of Russia’s provocations and Islamic militants’ butchery, Americans just elected a raft of new Republican senators — including the military veterans Tom Cotton in Arkansas, Joni Ernst in Iowa and Dan Sullivan in Alaska — who are more aligned with John McCain’s worldview than with Paul’s, and that raises serious questions about the currency of his ideas and his ability to promote them. He gets attention. But does he have any real sway?
He himself seems to doubt some of his positions and has managed in his four short years in the Senate to flip and flop enough to give opponents a storehouse of ammunition.
Adopting a stark, absolutist stance, he initially said that he opposed all foreign aid. Then he carved out an exception for Israel.
First he expressed grave skepticism about taking on the Islamic State. Then he blasted President Obama for not taking it on forcefully enough.
His language about Russia went from pacific to truculent. His distaste for Medicare went from robust to tentative.
These adjustments suggest not just political calculation but, in some instances, amateurism. He’s a work in remarkably clumsy progress, with glimmers of recklessness and arrogance, and he often seems woefully unprepared for the national stage.
The most striking example was his assertion in an interview with Olivia Nuzzi of The Daily Beast in September that John McCain had met and been photographed with members of the Islamic State. Paul was parroting a patently suspicious story that had pinged around the Internet, and the problem wasn’t simply that he accepted it at face value. He failed to notice that it had been thoroughly debunked, including in The Times.
At best he looked foolish. At worst he looked like someone “too easily captivated by the kinds of outlandish conspiracy theories that excite many of his and his father’s supporters,” as Mark Salter, a longtime McCain aide, wrote on the Real Clear Politics website.
Paul can be prickly and defensive to an inappropriate, counterproductive degree, as he was when dealing with accusations last year that he had used plagiarized material in speeches, an opinion article and a book.
In a story in The Times by Jim Rutenberg and Ashley Parker, Paul conceded “mistakes” of inadequate attribution. But he hardly sounded contrite. He lashed out at the people who had exposed the problem, grousing, “This is coming from haters.” And in promising to have his aides use footnotes in future materials, he said, “What we are going to do from here forward, if it will make people leave me the hell alone, is we’re going to do them like college papers.”
People are not going to leave him the hell alone, not when he’s being tagged in some quarters as the Republican front-runner, and his struggle to make peace with that is another liability.
But why the front-runner designation in the first place?
In an ABC News/Washington Post poll last month, 21 percent of voters who lean Republican named Mitt Romney as their preferred candidate in a primary or caucus, while 11 percent named Jeb Bush, 9 percent Mike Huckabee and 9 percent Paul. Two other national polls don’t show any growth in support for Paul over the course of 2014, despite all the coverage of him.
In one survey of Iowa Republicans in October, he trailed not only Huckabee and Paul Ryan but also Ben Carson, the neurosurgeon. And in a survey of New Hampshire Republicans, he trailed not only Huckabee and Bush but also Chris Christie.
What really distinguishes him, apart from some contrarian positions that are red meat for ravenous journalists, is that he’s been so obvious and unabashed about his potential interest in the presidency. He’s taken more pains than perhaps anyone other than Ted Cruz to get publicity. He’s had less competition for the Republican spotlight than he’ll have in the months to come.
And that’s given him a stature disproportionate to his likely fate. It has made him, in the words of a Washington Post headline last June, “the most interesting man in the (political) world.” There it is again, that one overused superlative. Makes you wonder if he’s less a thoroughbred with stamina than a one-adjective pony.

“Evangelical Myth Won. Wall Street Won. The Banks Won. America Lost”: Since Lies Worked So Well For Republicans, We’ll Have More
The Republican Party base is white evangelicals. So no wonder the GOP lies about the country, the economy and the president worked. The folks who base their lives on religious mythology have spent lifetimes being trained to believe lies. And if you point that out then they kick into victim mode and denounce people who question them as persecutors. Last night they won. Lies won.
As the New York Times noted:
“Republican candidates campaigned on only one thing: what they called the failure of President Obama. In speech after speech, ad after ad, they relentlessly linked their Democratic opponent to the president and vowed that they would put an end to everything they say the public hates about his administration. On Tuesday morning, the Republican National Committee released a series of get-out-the-vote images showing Mr. Obama and Democratic Senate candidates next to this message: ‘If you’re not a voter, you can’t stop Obama.’ The most important promises that winning Republicans made were negative in nature. They will repeal health care reform. They will roll back new regulations on banks and Wall Street. They will stop the Obama administration’s plans to curb coal emissions and reform immigration and invest in education.”
Since the economy has rebounded, health care reform has worked, all that remained for the GOP was to lie. And since the base of the GOP is white aging southern evangelicals the GOP was in luck. These are easy folks to lie to. That’s because they already accept an alternative version of reality. Also, of course since the lies are about a black man, that doesn’t hurt. Yes, race is “still” an issue.
The midterm election boiled down to xenophobia about the “Other.” Ebola was the president’s fault! ISIS was coming to get us! We aren’t safe!
None of this is true, but no matter. In fact judging by actual facts the Obama presidency has been successful in spite of the GOP obstruction. The economy is back. Jobs are up. Health care reform is working. We’ve been kept safe from terror attacks. America is strong.
What we’ll now see is a reinvigorated religious right. And since lies worked so well we’ll have more. Creationism, anti-gay initiatives, anti-choice initiatives, and of course pro-Koch-Brother-Financed lies upon lies to bury climate change debate is on the way.
The Republican-dominated Supreme Court stands ready to back corporate and religious right-financed attacks of the environment, pro-Wall Street laws and all the rest.
Racism won. Evangelical myth won. Wall Street won. The banks won. America lost.
