“Your Tax Dollars At Work, Or Not”: Marco Rubio Wants To Amend The Constitution To Repeal Obamacare

Sen. Marco Rubio (R-FL) proposed a constitutional amendment Tuesday that, if approved, would nullify Obamacare’s individual mandate. The amendment is the latest in a string of failed GOP attempts to repeal Obamacare, which many Republicans still view as unconstitutional.

The “Right to Refuse” amendment would make any laws that tax Americans who fail to purchase goods or services unconstitutional, targeting the Affordable Care Act’s stipulation that nearly all Americans must purchase health insurance. The amendment was introduced by Rep. Steven Palazzo (R-MS) in the House in February.

In a press release, Rubio cited the recent Internal Revenue Service scandal as one of his reasons for introducing the bill:

“ObamaCare is a disastrous policy that is not only destructive to job creation, it will also unleash the corrupt and scandal-ridden IRS on taxpayers simply for not buying health insurance,” said Rubio. “We should put our faith in the American people to decide what goods and services they want to buy, not have Congress dictate it and have the IRS empowered to harass Americans to make sure they do it.”

The Supreme Court ruled in 2012 that Obamacare’s individual mandate could be considered a tax, and therefore was upheld under the constitution. But that hasn’t stopped many Republicans from claiming Obamacare is unconstitutional — the act has survived at least 37 repeal attempts since Republicans took control of the House in 2011, the most recent repeal vote occurring in mid-May. Since news broke in May that the IRS flagged certain conservative groups applying for tax-exempt status for additional scrutiny, several Republican leaders have used the scandal to question whether the IRS can be trusted to implement Obamacare.

Constitutional amendments are far more difficult to pass than bills — amendments proposed by Congress require a two-thirds majority vote in the House and Senate. With a Democrat-controlled Senate, Rubio and Palazzo’s amendment would have difficulty achieving even a simple majority. Rubio has been billed as a rising star in the Republican party and likely 2016 presidential candidate, but his fervent opposition to Obamacare — along with several other positions — show that his views don’t stray far from the status quo of the Republican party.

“Bob Woodward’s Credibility Is In Tatters”: From Impartial Reporter To Conservative Pundit

On Fox News Monday night, famed Washington Post reporter Bob Woodward and host Bill O’Reilly zeroed in on the latest twist in Washington scandalmania — why the White House is refusing to answer questions about the 157 times former IRS commission Doug Schulman allegedly visited the White House, a closeness that raises questions about presidential involvement in the agency’s controversial targeting of Tea Party tax-exempt groups.

“This fiction that somehow [the IRS is] totally an independent agency is absurd,” Woodward, who broke the Watergate scandal, said. “You say they aren’t answering this question about the 157 visits by the IRS commissioner. They should.”

“President Obama could easily come out through his spokesperson and say this is where Mr. Schulman was. And here are the dates. Here is who he met with,” O’Reilly said. “The fact that the President doesn’t do it, should raise the curiosity of every reporter, Mr. Woodward, every reporter. Yet, as I said, the major network news on television ignored the story last week in its totality. It’s amazing.”

This forces us to ask the uncomfortable question of whether O’Reilly and Woodward have access to Google. Because if they did, they would have the answers to all of these questions, and they may even find a statement from the president’s spokesperson that he is supposedly refusing to give.

“The IRS commissioner, in carrying out his duties, would of course have many reasons to have an appointment to visit the White House,” White House spokesperson Eric Schultz said.

That’s a bit vaguer than what O’Reilly and Woodward are looking for, but the White House doesn’t really have to say any more, considering that all the specifics are already online, available to anyone who looks for them.

The story of the 157 visits originated with the Daily Caller, based on a (sloppy) inspection of White House visitor logs. But as the Atlantic’s Garance Franke-Ruta reported, parsing those very same visitor logs a bit more closely, it turns out that while Schulman — a Bush appointee — was cleared to visit the White House 157 times, he appears to have actually visited only 11 times.

The vast majority of the cleared visits were related to the implementation of Obamacare, in which the IRS plays a key role, and include regularly scheduled weekly meetings with administration officials on the ongoing work. Meanwhile, many people seem to be conflating the presidential mansion itself with other executive office buildings that are organizationally under the “Executive Office of the President ” — all colloquially referred to as “The White House.” They’re all included in the Secret Services’ visitors logs, but it turns out Schulman was rarely cleared to visit the actual White House, more often having permission to go to the Executive Office Building.

Some Googling might also reveal a Politico story, which also cast doubt on the Daily Caller’s scoop, or plenty of others.

We expect it from O’Reilly, but it’s a bit disappointing from Woodward, who should know better. Still, he’s seemingly been making a subtle drift from impartial reporter to conservative pundit in recent years.

“Here’s To Honesty And Ethics”: Mr. Grand Theft Auto, Arsonist, And Hit And Run Driver Darrell Issa Gets A Brush-Back Pitch

House Oversight Committee Chairman Darrell Issa (R-Calif.), no doubt frustrated his efforts to manufacture White House scandals have faltered, started to lose his composure on CNN yesterday. Perhaps more interesting was the response from a close ally to President Obama.

After lashing out at White House Press Secretary Jay Carney as a “paid liar” — an attack seemingly based on nothing — the California Republican argued without proof that top Obama administration officials were responsible for the IRS controversy. Under scrutiny, however, Issa’s argument quickly crumbled, relying on out-of-context quotes.

It was, however, this reaction from David Plouffe that caught my eye. In President Obama’s inner circle, few are as influential as Plouffe, who ran the Obama campaign in 2008 and served as a White House Senior Adviser to the president up until late January of this year. So when he’s calling the chairman on the House Oversight Committee “Mr. Grand Theft Auto” and a “suspected arsonist/insurance swindler,” it reflects a striking escalation.

Unlike Issa’s rhetorical jabs, Plouffe’s brush-back pitch at least has the benefit of accuracy. As we discussed a few weeks ago, Issa, the man Republicans have tasked with leading investigations into alleged administration misdeeds, really has spent a fair amount of his adult life as a suspected criminal. This Ryan Lizza piece in the New Yorker from a couple of years ago remains relevant.

“Many politicians have committed indiscretions in earlier years: maybe they had an affair or hired an illegal immigrant as a nanny. Issa, it turned out, had, among other things, been indicted for stealing a car, arrested for carrying a concealed weapon, and accused by former associates of burning down a building.”

This is generally one of those truths the political world knows, but chooses not to talk about. It’s not a secret — Issa’s background is the subject of insider jokes and private chatter — but it’s considered impolite to broach the subject publicly.

Which makes Plouffe’s rhetorical shot all the more interesting.

For the record, Lizza’s report on Issa highlighted one run-in with the law after another, including arrests and indictments. There are also many suspected crimes — he’s accused of deliberately burning down a building and threatening a former employee with a gun — which did not lead to formal charges, but which nevertheless cast the congressman in a less-than-flattering light.

The New Yorker report also noted an incident in which Issa was in a car accident with a woman who needed to be hospitalized. He drove away before the police could arrive because, as he told the person he hit, he didn’t have time to wait. Issa didn’t face charges, but he was sued over the matter, and agreed to an out-of-court settlement.

And in case those angles weren’t quite enough, the same article also noted instances in which Issa appears to have lied about his background.

The congressman, for example, claimed to receive the “highest possible” ratings during his Army career, despite the fact that at one point he “received unsatisfactory conduct and efficiency ratings and was transferred to a supply depot.” Issa also claimed to have provided security for President Nixon in 1971, which wasn’t true, and said he won a national Entrepreneur of the Year award, but didn’t.

Perhaps he’s not the kind of guy who should casually throw around words like “liar.”

But the key takeaway here is the fact that Plouffe was willing to go there in the first place, as if to say to Issa, “You want a fight over honesty and ethics? That’s a great idea.” What’s more, also keep in mind that if Democrats seriously pursue this as a line of criticism, Issa and his allies will be cautious in pushing back because they’d prefer not to have this conversation at all — the last thing Republicans want now is a discussion about Issa’s scandalous background and whether he’s the best person available to lead investigations into others’ suspected wrongdoing.

“Full Speed Ahead”: Republican Overreach Is Coming Soon

A number of people have asked whether the Republicans will overreach in their reaction to the current collection of scandal-ish controversies (by the way, someone really needs to come up with a name that encompasses them all). The answer to that question is, of course they will. Try to remember who we’re talking about here. Overreaching is their thing. Congress will be going home this weekend, and I’ll bet the Republicans are going to come back from their recess reassured that their constituents really, really want them to pursue Barack Obama to the ends of the earth. I’ll explain why in a moment, but in the meantime the National Journal has details on their strategy:

Congressional Republicans head into next week’s Memorial Day recess armed with a strategy designed to keep the controversies that have consumed Washington in the news back home.

Both House and Senate Republicans will focus on the Internal Revenue Service targeting conservative groups for extra scrutiny as well as the still-open questions about Benghazi. And more and more, they’ll try to tie them together into a made-for-2014 narrative of an unaccountable and out-of-control government.

In interviews on local television and radio programs and with newspapers, Senate Republicans plan to talk about the Obama administration’s “credibility gap.” They’ll throw into the mix Health and Human Services Secretary Kathleen Sebelius’s request that health industry officials help fund “Obamacare,” a move Republicans call a “shakedown” of the companies she regulates, according to a Senate GOP leadership aide.

Lawmakers will argue that a “lack of details, stonewalling,” and what they call an “ever-changing White House narrative” on both Benghazi and the IRS have led to a trust deficit with the public, a sentiment reflected in recent polls, the aide said.

Part of the aim is to get voters to question how they can trust the administration, and the IRS more specifically, to enforce key provisions of Obama’s health care law after improperly targeting Americans.

This fits into Republicans’ emerging scandal-riding midterm election strategy—one that the GOP’s congressional campaign committees think can blend easily into their anti-Obamacare message to help the party take the Senate in 2014.

When they return from this recess, Republicans are going to be more sure than ever that they’re doing the right thing. Think about what a member of Congress does when he’s home. He’ll be doing those media interviews with friendly talk-radio hosts, for whom outrage is the bread and butter of their programming. He might do a couple of town meetings, and who comes to those? People who like him already (i.e. the Republican base, who will tell him to keep up the scandal-mongering) and people who are pissed off about something. But right now, the people who think the scandal thing is going too far aren’t really pissed off, they’re just kind of disappointed. So they won’t be so inclined to show up. And then the representative will just go around town talking to folks, and once again the ones he’s most likely to hear from are his supporters who want to tell him to stick it to that no-good socialist in the White House.

After a few days of that, he’ll come back to Washington thinking, “Wow, my constituents are really fired up about this stuff. Full speed ahead!”

“Why Scandal Politics Don’t Work”: Perhaps Republicans Should Focus On A More Effective Use Of Their Time

A president’s critics can’t help themselves when the whiff of scandal is in the air. Yet more often than not, the obsessive pursuit of scandal fails to lift the political prospects of the opposition party.

Republicans might want to pause and ask themselves: Is flogging Benghazi, the IRS, and the Associated Press really the best way to get the majority back?

Every party on the outside of the White House envisions replicating Watergate — forcing a president out of office and riding the aftermath to an Election Day triumph. But the post-Watergate scandal-mongering record falls far short of that holy political grail.

The Iran-Contra affair may be a blot on the Reagan record, but it didn’t propel Democratic Gov. Michael Dukakis into the White House. During his convention speech, he tried to tar then-Vice-President George H. W. Bush for “sit[ting] silently by when somebody at the National Security Council comes up with the cockamamie idea that we should trade arms to the Ayatollah for hostages.” A few days later, Dukakis also tried to make hay with a less-remembered scandal involving fraudulent procurement in the Pentagon. “A fish rots from the head first,” said Dukakis, in some of his harshest words of the campaign. His emphasis on ethics were soon drowned out with a barrage of attacks regarding his views on national security and crime.

Ten years later, with Bill Clinton in the Oval Office, Republicans took scandal-mongering to new heights. Charging the president with perjury and obstruction of justice to cover up his extramarital affair, the House Judiciary Committee advanced articles of impeachment one month before the 1998 congressional midterm elections. The opposition party historically gains seats at the “six-year itch” point of a president’s tenure. But the backlash from the impeachment obsession allowed Democrats to pick up five House seats. Speaker Newt Gingrich was compelled to quit Congress. House Republicans barreled ahead and formally impeached Clinton anyway. Clinton’s approval rating then spiked above 70 percent.

During George W. Bush’s first term, Democrats sought to drive outrage surrounding the Abu Gharib torture scandal and, to a lesser extent, the outing of undercover CIA agent Valerie Plame. Michael Moore sought to spark a scandal with his documentary Fahrenheit 9/11, which characterized Bush’s foreign policy and energy policy as flowing from a scandalous relationship with Saudi Arabia. John Kerry’s acceptance speech, delivered one month after the movie was released, called for “an America that relies on its ingenuity and innovation, not the Saudi royal family.” A well-financed independent group, The Media Fund, aired a series of ads criticizing Bush’s Saudi ties. Bush ended up winning the popular vote (unlike 2000).

As for President Obama — the conservative cries of “Solyndra” and “Fast and Furious” failed to interrupt his march to a second term.

Why do scandal politics usually fail? Of course, some scandals fizzle out because the charges lack merit or import. But as you see above, even more significant scandals can lack political punch. Perhaps that is because by attempting to quickly topple the president and short-cut a path the White House, the attackers end up distracting themselves from their own primary mission: discrediting the president’s ideology and substantive agenda in the eyes of the public, and elevating their own.

A more plausible objective, short of impeachment or electoral gains, would be to consume a White House with scandal management and distract the administration from executing the president’s agenda. But for today’s Republicans, that objective doesn’t make much sense. Obama’s main legislative goal this year is shared by leading Republicans: immigration reform.

In fact, pro-immigration Republicans may be stoking the fires about Benghazi, the IRS and the AP not to distract the president, but to distract fellow conservatives who otherwise would rally the Tea Party base to pressure Congress and undermine the bipartisan Senate bill. As the Daily Caller’s Mickey Kaus told BuzzFeed: “I think these distracting scandals actually help its chances of passing. Every time [the bill] is at center stage, its chances of passing go down.”

And note that some of Obama’s chief antagonists on Benghazi — Sens. John McCain and Lindsey Graham — are also Obama’s key shepherds of immigration reform.

For those conservatives more deeply opposed to President Obama’s agenda, they should ask themselves: Do we really think any of these “scandals” seriously threaten President Obama’s hold on the Oval Office? And if they don’t, might there be a better use of our time?
