“Bill O’Reilly And White Privilege”: Race Hustler, Bathing In Privilege
Is white privilege real? Not according to Fox News’s Bill O’Reilly.
This week O’Reilly debated the issue of white privilege with a fellow host and then returned to the topic the next day with this doozy of a statement:
“Last night on ‘The Factor,’ Megyn Kelly and I debated the concept of white privilege whereby some believe that if you are Caucasian you have inherent advantages in America. ‘Talking Points’ does not, does not believe in white privilege. However, there is no question that African-Americans have a much harder time succeeding in our society than whites do.”
It is difficult to believe that those three sentences came in that order from the same mouth. Why would it be harder for blacks to succeed? Could interpersonal and, more important, systemic bias play a role? And, once one acknowledges the presence of bias as an impediment, one must by extension concede that being allowed to navigate the world without such biases is a form of privilege.
That privilege can be gendered, sexual identity based, religious and, yes, racial.
When one has the luxury of not being forced to compensate for societal oppression based on basic identity, one is in fact privileged in that society.
O’Reilly even trotted out the Asian “model minority” trope to buttress his argument, citing low unemployment rates and high levels of income and educational attainment for Asians compared not only to blacks but to whites.
Whenever people use racial differences as an argument to downplay racial discrimination, context is always called for.
What O’Reilly — like many others who use this line of logic — fails to mention (out of either ignorance or rhetorical sleight of hand) is the extent to which immigration policy has informed those statistics and the extent to which many Asian-Americans resent the stereotype as an oversimplification of the diversity of the Asian experience.
A 2012 Pew Research report entitled “The Rise of Asian Americans” found:
“Large-scale immigration from Asia did not take off until the passage of the landmark Immigration and Nationality Act of 1965. Over the decades, this modern wave of immigrants from Asia has increasingly become more skilled and educated. Today, recent arrivals from Asia are nearly twice as likely as those who came three decades ago to have a college degree, and many go into high-paying fields such as science, engineering, medicine and finance. This evolution has been spurred by changes in U.S. immigration policies and labor markets; by political liberalization and economic growth in the sending countries; and by the forces of globalization in an ever-more digitally interconnected world.”
Following the publication of the Pew report, the news site Colorlines spoke with Dan Ichinose, director of the Asian Pacific American Legal Center’s Demographic Research Project, who was critical of some parts of the Pew report, but seemed to echo the role immigration had played. Colorlines put his response this way:
“The more complex and far less exciting explanation for Asian Americans’ relatively high rates of education has more to do with immigration policy, which has driven selectivity about who gets to come to the U.S. and who doesn’t, said Ichinose.”
Much of the African-American immigration policy came in the form of centuries of bondage, dehumanization and unimaginable savagery visited on their bodies. And that legacy is long and the scars deep.
O’Reilly mentions this in his rant, as a caveat:
“One caveat, the Asian-American experience historically has not been nearly as tough as the African-American experience. Slavery is unique and it has harmed black Americans to a degree that is still being felt today, but in order to succeed in our competitive society, every American has to overcome the obstacles they face.”
But this whole juxtaposition, the pitting of one minority group against another, is just a way of distracting from the central question: Is white privilege real?
In arguing that it isn’t, O’Reilly goes on to raise the seemingly obligatory “respectability” point, saying:
“American children must learn not only academics but also civil behavior, right from wrong, as well as how to speak properly and how to act respectfully in public.”
Then he falls back on the crux of his argument:
“Instead of preaching a cultural revolution, the leadership provides excuses for failure. The race hustlers blame white privilege, an unfair society, a terrible country. So the message is, it’s not your fault if you abandon your children, if you become a substance abuser, if you are a criminal. No, it’s not your fault; it’s society’s fault. That is the big lie that is keeping some African-Americans from reaching their full potential. Until personal responsibility and a cultural change takes place, millions of African-Americans will struggle.”
No, Mr. O’Reilly, it is statements like this one that make you the race hustler. The underlying logic is that blacks are possessed of some form of racial pathology or self-destructive racial impulses, that personal responsibility and systemic inequity are separate issues and not intersecting ones.
This is the false dichotomy that chokes to death any real accountability and honesty. Systemic anti-black bias doesn’t dictate personal behavior, but it can certainly influence and inform it. And personal behavior can reinforce people’s belief that their biases are justified. So goes the cycle.
But at the root of it, we can’t expect equality of outcome while acknowledging inequality of environments.
Only a man bathing in privilege would be blind to that.

“The True Bounds Of Executive Authority”: The Possession Of Great Power Necessarily Implies Great Responsibility
With Congress mired in gridlock, President Obama has vowed to use “a pen and a phone” to accomplish some of his policy goals. Last week, he doubled down by promising to act on one of the nation’s most divisive and important issues — immigration — before the rapidly approaching end of summer. Such executive action has outraged his political foes. To be sure, any ambitious path of executive action must be conducted in a manner consistent with the law and the appropriate role of coordinate branches. But should we snap to attention when we hear hyperventilating about his supposed abuse of power? At least so far, hardly.
All presidents have significant power to advance policy goals through executive action. That power is limited by the Constitution, above all else. The Supreme Court has made it clear that when Congress has not acted, and no federal law blocks it, the president has considerable leeway to act. Through the years, presidents of both parties have used the tools at hand. Ronald Reagan reined in regulatory agencies. Bill Clinton declared major swaths of land off limits for development, and cracked down on tobacco. George W. Bush made major moves to limit stem cell research. And presidents (including this one) have used, and often abused, executive authority when it comes to national security, often moving in secret.
Where does President Obama stack up in this hall of presidents? In fact, so far, he has not been especially more aggressive than his predecessors. He issued executive orders at a slower pace than any president since Grover Cleveland. Quantity is not quality, but the orders he has issued have not been particularly bold — no seizing steel mills (as Harry Truman did) or sending the National Guard to Little Rock (as Dwight Eisenhower did). One unilateral power clearly given to the president by the Constitution is the pardon power. Here, too, Obama has issued fewer pardons and grants of clemency to prisoners serving unjust sentences than most presidents.
This has not stopped his political opponents from screaming that he is abusing his power. The House of Representatives recently voted to sue him for one act of supposed overreaching: delays in implementing the employer mandate and other parts of the Affordable Care Act. Set aside the weirdness of such a claim (this is the same House that wants to repeal the same law). Once a bill is passed by Congress, the executive branch has the authority to execute it. Realistically, putting complex statutes such as the ACA into place will have bumps in the road. In this case, it turned out that the ACA could not be accomplished as quickly as hoped — in part because several states refused to cooperate. But presidents have delayed implementation of laws in the past without arousing ire. George W. Bush used his executive authority in 2004 to waive penalty fees for seniors who signed up late for Medicare Part D, another contentious health care law.
Will the president’s use of executive power to advance his goals on immigration reform be constitutional? Depends. No president has authority to do a complete immigration overhaul by fiat. And we don’t fully know what is contemplated, which must of course meet the test of legality. But this president, as any president, has ample room for action. He has asked for a set of formal recommendations from Homeland Security Secretary Jeh Johnson, and has looked at expanding the Deferred Action for Childhood Arrivals (DACA) program to allow for deferred deportations, at the discretion of federal prosecutors. It makes perfect sense for the president to use his finite resources in a way that is fiscally responsible and protects the public interest. Indeed, he has already done so on a smaller scale two years ago when he created DACA to ceased deportation of young immigrants who met certain criteria.
The government cannot deport everyone; it simply doesn’t have the capacity. Prioritizing deporting violent criminals is hardly earth-shattering, or Constitution-shattering. Law enforcement and prosecutors exercise discretion all the time in determining which cases to investigate and prosecute. In the real world of an “under-resourced” system, choosing how to allocate the resources that Congress does give him is clearly within the president’s purview.
Our government functions on a system of checks and balances. It’s true that the Constitution grants Congress more powers than the president. But, as William Lamb, 2nd Viscount Melbourne, said during a debate in Parliament in 1817, “the possession of great power necessarily implies great responsibility” (150 years later, Spider-Man agreed). A paralyzed Congress has abdicated its responsibility and spurred the president to act. President Obama is simply is doing what he must do to keep the United States running.

“Leading From Behind, And Proud Of It”: America May Just Need To Get Over Its Own Sense Of Paternalism
Egypt and the UAE went forward with air strikes against Islamists in Libya without informing the United States. They did this presumably because they are concerned with the growing influence of Islamist extremists in their region of the world. No doubt their concerns don’t exist in a vacuum; the whole world is watching as Islamists garner more control in Iraq and Syria. Apparently America is supposed to be upset about the move because we should have been informed. The thought is that we’ve provided some of the weaponry, so we should have a say. There’s also the uncomfortable truth that America may just need to get over its own sense of paternalism if we really want to stay out of conflict.
Poll after poll shows an American populace that does not favor intervention overseas. It’s become quite clear since the downturn of the economy that we have enough to work on here at home without getting into multibillion-dollar conflicts. So we don’t want to intervene, but we don’t want to be left out either. The favorite saying of what I would call war hawks is that this is what happens when America “leads from behind.”
Well, here’s my question: Why do we have to lead at all?
I would argue that at this point and time we are in no position to lead anyone. We have record -low unemployment, the middle class that once defined the American dream is dissipating, and we have social issues bubbling under the surface that we should probably start to address. We have serious infrastructure needs that need to be met, and plenty of ingrown homeland-security challenges I’m positive our military could focus on (not to mention millions of families who would be grateful not to send off their loved ones into dubious wars).
I understand that America has serious political interests in the Middle East beyond oil. I understand that leaving the area completely is a pipe dream, largely because leaving Israel to its own devices at this point would be like leaving a kid in the desert to fend for herself. That said, isn’t that kind of what Americans did when we declared independence? Or when we fought our incredibly deadly civil war? What if the superpower of the time got involved in our own now-infamous civil conflict? What if we were not allowed to fight it out but were forced to form ourselves under the influence of a foreign culture that no one understood?
That is what we have been doing in the Middle East, and it is time to stop. It is time to let regional powers figure out their own regional conflicts, and it is time for America to begin addressing our own. We have thousands of people trying to get into our country because the situation below our border is so dire, partially for reasons that are well within our control (e.g., the drug war). Maybe we don’t see that problem as just as much of a threat as those in the Middle East, but we should. As we have seen with the latest incident at the Texas border, we can only ignore our neighbors for so long as we toil along overseas.
The interests are strong, and the history is thick, but I, for one, am happy that Egypt and the UAE made a unilateral decision without us. I am happy that Egypt orchestrated the Israeli/Palestinian ceasefire. I am glad that we are starting to “lead from behind” in the rest of the world, because maybe that means we can lead our own country.

“The White Whale”: Empowering Captain Ahab To Shut Down The Federal Government
Maybe it’s just a coincidence, but yesterday, as part of his 180 degree turn on the topic, Sen. Marco Rubio was said to be “hinting” that Republicans might just, oh, shut down the government or something if Barack Obama took major executive action to expand (or even maintain) DACA. Today Rubio’s new ally on immigration policy, Steve King of Iowa, was more explicit, per a report from the Des Moines Register‘s Kathie Obradovich:
Congressman Steve King said today the threat of another government shutdown could be Republicans’ leverage to pass border security and immigration legislation this fall.
Congress must act before the end of September to either approve a budget or continue spending at current levels to avoid a government shutdown. House Speaker John Boehner has said he expects action on a short-term continuing resolution next month.
King, R-Kiron, said “all bets are off” on a continuing resolution if President Barack Obama follows through with reported plans to deal with immigration issues without Congress.
“If the president wields his pen and commits that unconstitutional act to legalize millions, I think that becomes something that is nearly political nuclear …,” King said. “I think the public would be mobilized and galvanized and that changes the dynamic of any continuing resolution and how we might deal with that….”
Even if Obama does not act unilaterally on immigration reform, King says he believes the continuing resolution is still a bargaining chip for GOP priorities. “When we hear some of our leaders say there will be no government shutdown, that’s the political equivalent of saying there will be no boots on the ground,” he said.
Now the congressional leadership probably won’t like this kind of talk. But like Rubio himself, they’ve pretty much delegated immigration policy to Steve King. So they can’t really complain if Captain Ahab thinks every conceivable issue in Washington is subordinate to bringing down the white whale.

“A Good Deal For Him”: Rick Perry Is Basically Charging Texas Taxpayers $4 Million A Week For His Presidential Ambitions
On Thursday, the first Texas National Guard troops arrived at the U.S. border as part of Operation Strong Safety, Gov. Rick Perry’s (R) unilateral border-security mission. And before rallying the border-bound troops at Camp Swift outside Austin on Wednesday, Perry had spent part of the week in Iowa, making not-so-subtle intimations that he will be coming back a lot before the first-in-the-nation presidential caucuses in 2016.
It’s hard not to see those events as intimately connected. And sure, sending the National Guard to the border will probably get Perry some extra votes in the Iowa caucuses. But Iowa won’t be footing the bill.
Perry says that he had to send 1,000 National Guard troops to the Rio Grande Valley because the federal government isn’t doing enough to keep out “narco-terrorists” and illegal immigrants. The influx of 63,000 unaccompanied children since October, which has slowed significantly in the past few months, is a “side issue,” Perry said on Wednesday. “You now are the tip of the spear protecting Americans from these cartels” and “their tentacles of crime, of fear,” he told about 90 National Guard members, specifically mentioning the danger drug traffickers posed to Iowa, South Carolina, and a state that doesn’t have an early presidential caucus or primary, North Carolina.
Democrats are openly and directly accusing Perry of sending down the National Guard for no other reason than his presidential ambitions. Perry took umbrage at that suggestion: “The idea that what we’re doing is politics versus protecting the people of Texas, the people of this country is just false on its face.”
But what other explanation is there, really? The border crisis that has grabbed everyone’s attention is a “side issue” that Perry insists he isn’t sending the troops to address. And the 63,000 young, mostly Central American migrants really are a problem for Texas — but a humanitarian problem, not a military one. The U.S. Border Patrol is struggling to house and care for these children, and some number of them will surely end up in Texas schools and social services programs.
The $17 million to $18 million a month that Perry is spending to fund his open-ended border operation looks shakier when you consider what the National Guard will be doing: Watching. The troops will have the authority to detain, but not arrest, immigrants. But mostly they are going to be manning watchtowers and truck-mounted surveillance equipment.
The Associated Press spoke with Rodolfo Espinoza, the police chief of Hidalgo, a Texas town a mile from the border where the first wave of National Guard troops landed. The two police towers that the troops took up watch in Thursday “have cameras that can pan the area and record activity,” the AP‘s Christopher Sherman noted, though Espinoza said it’s more useful to have people in the towers. “It is good to have them,” Espinoza said, adding, “I think the only way you could secure the river is if every 10 yards you had someone standing there. It’s impossible.”
So who was crying for military reinforcements? The border-county sheriffs wanted more money, not National Guard troops. And at a July 29 hearing on the cost of Perry’s operation, the heads of the Texas Department of Public Safety (DPS) and Texas National Guard — Steve McCraw and Maj. Gen. John Nichols, respectively — said they had not recommended that the governor deploy the National Guard, though, as the Houston Chronicle puts it, they were “appreciative of his idea.”
Now, that’s not to say nobody wants the National Guard at the border. The idea is very popular among Republicans nationwide, especially conservative and Tea Party–aligned Republicans who vote in primary elections. In a mid-July CNN/ORC poll, for example, 76 percent of Republicans said the main focus of U.S. immigration policy should be “stopping the flow of illegal immigrants into the U.S. and for deporting those already here,” versus 49 percent of independents and 35 percent of Democrats.
In fact, a few days before Perry announced his National Guard deployment, a group of conservative and Tea Party activists met in Austin and publicly criticized him for his inaction, specifically urging the governor to send troops to the border. It’s easy to see how a politician with his eye on 2016 might leap at the opportunity to please this group, even if his “solution” actually does nothing to truly address America’s immigration problem. It’s the optics that matter.
But back home, Texas Republicans are concerned about how Perry is paying for this. The governor redirected $38 million from a DPS allocation for radio equipment to finance the operation; $7 million of that is to pay for the beefed-up DPS presence in the valley and $31 million is for the National Guard deployment.
That money is expected to run out sometime in October, and Perry’s plan to get the federal government to pay for his operation seems a little quixotic, given that Congress is doing almost nothing these days, and will probably do even less in the run-up to the crucial midterm elections in November. That means Texas taxpayers are on the hook.
“The border has got to be secured — we’ve got to stop this,” said state Sen. Jane Nelson (R), the chairwoman of the Senate Finance Committee, who doesn’t oppose the deployment. But “month by month, we’re draining state resources that should go to education, should go to highways, should go to water, and we can’t do it forever.”
It should be noted that Texas taxpayers also pay for Perry’s trips to Iowa (and Israel, and the Bahamas), but even at the height of his last run for president, in 2011 and early 2012, the bill for his security detail was only $400,000 a month. (A ruling this week by state Attorney General Greg Abbott — the GOP nominee to replace Perry as governor — means Texans will no longer get a detailed accounting of Perry’s security expenses, despite a 2011 state law mandating their release.)
Look, $18 million a month — or $216 million a year, if extended — is a small slice of the state’s $100 billion annual budget. But if Rick Perry’s low-tax, low-service Texas is so frugal that it can’t find enough money for things like transportation infrastructure and education — things that are important to the state’s continuing economic growth — it’s hard to argue that Operation Strong Safety is much of a good deal for anybody but Rick Perry.
