“Not So Easy Rider”: Marco Rubio, From GOP “Savior” To Tea Party Troll In 12 Months

You can understand why Senator Marco Rubio (R-FL) is bitter.

While Senators Rand Paul (R-KY) and Ted Cruz (R-TX) became Tea Party rock stars this year with high-profile but legislatively inconsequential filibusters, Rubio went from right-wing hero to RINO by risking his career to back a comprehensive immigration reform bill that actually passed the Senate.

Initially, Rep. Paul Ryan (R-WI) was supportive of “the Republican Savior” as he tried to accomplish the only policy recommendation Republicans gave themselves in their 2012 election “autopsy.” But the GOP base as represented by the Tea Partiers in the House refused to let Speaker John Boehner even consider letting the Senate bill come up for a vote.

As the far right organized against what they called his “shamnesty” bill, Rubio saw his dream of locking up the 2016 GOP nomination early suddenly replaced with billboards condemning the “Rubio-Obama immigration plan.”

To try to win back the base, Rubio joined with Cruz and Senator Mike Lee (R-UT) in the failed plot to defund Obamacare. When that wasn’t enough, he actually turned against his own bill.

So you can imagine how steamed Senator Rubio was when he heard Paul Ryan being praised as a “dealmaker” for putting together a budget deal that basically re-enforces the status quo.

Well, you don’t have to imagine. Rubio almost immediately went on the attack against the proposed legislation after it was announced, saying not only was he against it, he was pretty sure it would be responsible for destroying the American Dream.

Ryan heard that criticism Thursday morning on MSNBC’s Morning Joe and fired back with a deft response.

“Read the deal and get back to me,” he said. “People are going to do what they need to do. Look, in the minority you don’t have the burden of governing.”

Republicans have stopped trying to hide the fact that there is a civil war going on between the Tea Party and the establishment.

Both of the leaders in the Senate — Senate Minority Leader Mitch McConnell (R-KY) and Senate Minority Whip John Cornyn (R-TX) — are among the half-dozen Senate Republicans facing Tea Party primary challengers.

McConnell has been calling out the right-wing outside groups who are funding many of the challengers against him for weeks.

“I think, honestly, many of [the Tea Party] have been misled,” he told the Wall St. Journal’s Peggy Noonan in November. “They’ve been told the reason we can’t get to better outcomes than we’ve gotten is not because the Democrats control the Senate and the White House but because Republicans have been insufficiently feisty. Well, that’s just not true, and I think that the folks that I have difficulty with are the leaders of some of these groups who basically mislead them for profit… They raise money… take their cut and spend it.”

Boehner joined the fight this week by blasting the outside groups that he now says led to the shutdown.

“They’re using our members and they’re using the American people for their own goals,” Boehner said in a press conference on Thursday. “This is ridiculous. If you’re for more deficit reduction, you’re for this agreement.”

And Paul Ryan is making a case that being a conservative means accepting reality and actually governing.

Senator Rubio has given up on governance and moved as far to the right as he can go without falling off the game board. And he’s still being overshadowed by even more outlandish Tea Partiers.

That won’t stop him from trying to score points wherever he can. But even if he ends up opposing the immigration bills that will likely come out of the House now that the leadership has cut the Tea Party loose, chances are the only thing Marco Rubio will ever be president of is the Ted Cruz fan club.

“Boehner Might Be A Pragmatist, But He’s No Moderate”: The Budget Deal Has Passed, But Don’t Hold Your Breath For Bipartisanship

For the first time in months, Washington seems…optimistic. Not only did House Republicans pass the budget deal brokered by Budget Chairman Paul Ryan and his counterpart in the Senate, Senator Patty Murray, but Speaker John Boehner made news with a small Howard Beale moment:

“Frankly I think they’re misleading their followers. I think they’re pushing our members in places where they want to be. And frankly I just think they’ve lost all credibility,” he told reporters at his weekly press conference Thursday. “There comes a point when people step over the line. When you criticize something and you have no idea what you’re criticizing, it undermines your credibility.” […]

“You know, they pushed us into this fight to defund Obamacare and shut down the government,” he said. “It wasn’t exactly the strategy I had in mind. But if you recall, the day before the government re-opened, one of the people at one of these groups stood up and said, ‘well we never really thought it would work.’ Are you kidding me?”

Asked if he thinks the groups should “stand down,” Boehner said, “I don’t care what they do.”

This looks like the establishment backlash we expected during the shutdown fight, or—as Molly Ball put it for The Atlantic—“House leaders stopped trying to get along with the enforcers of an impossible conservative standard and started fighting back.”

Now, the speculation is that, perhaps, Boehner is prepared to buck Tea Party Republicans on other issues. Immigration activists, for example, are hopeful that this development could change the calculus for reform, and give Boehner the room he needs to pass a bill with votes from pragmatic Republicans—who have an agenda they want to accomplish—and Democrats. Indeed, there’s the potential for a whole rush of activity around issues where Democrats and Republicans can come to narrow agreement, from an extension of unemployment insurance to the Employee Non-Discrimination Act.

The problem is that, aside from this budget deal, it doesn’t look like Boehner has broken from conservatives on much at all. In that same press conference, for instance, he repeated conservative boilerplate on repealing the Affordable Care Act. And afterwards he went to the House floor and blocked a vote on extending emergency unemployment benefits. Likewise, there’s no real indication that he’s changed his mind on the EDNA or unemployment insurance. The House Speaker might be a pragmatist, but he isn’t a moderate.

Earlier this year, Boehner bucked conservatives by violating the “Hastert rule”—the faux requirement that all legislation passed by the House have support by a majority of the majority—to pass a deal on the fiscal cliff, authorize aid for Hurricane Sandy, and renew the Violence Against Women Act. The prediction was that this could be the new normal, and that Boehner could restore a modicum of sanity to the House by refusing to rely on Republican votes for legislation.

What followed, instead, was a year of inaction, culminating in a government shutdown and a stand-off over the fiscal cliff.

All of this is to say that we shouldn’t hold our breath about Boehner and his “new” approach. The Ryan-Murray deal was a necessity: Not only does it preclude Tea Party conservatives from forcing another shutdown, but it preserves most of the sequester and hands Republicans a solid victory.

As for the other agenda items? Most Republicans don’t want them and there’s no reason for Boehner to go against the tide.

“Giving Republicans A Pass”: Media Mantra, It’s Congress That’s Historically Unproductive, Not The GOP

As the calendar races towards 2014, and Congressional members log their final few days in session while facing daunting deadlines for a long list of pressing and unfinished initiatives, the press has been busy chronicling the futility, assigning collective blame, and giving the president permanent failing marks.

According to historians, 2013 is on track to become the least productive single legislative year in modern American history. And it’s not even close. In 1995, 88 laws were passed, setting the previous low-water mark. This year, it’s doubtful 70 will make it to the president’s desk. (And lots of the bills that have passed are ceremonial or rather trivial in nature.) The press is not happy about the trend.

“The paltry number of bills Congress has passed into law this year paints a vivid picture of just how bad the gridlock has been for lawmakers,” announced NBC. The Wall Street Journal noted this year’s session has been “long on partisanship, indecision and brinkmanship.” USA Today bemoaned the inability “to find common ground.” And the Los Angeles Times pointed to “partisan dysfunction” as the main Congressional culprit.

See? “Congress” remains in the grips of “gridlock” and “brinkmanship.” Congress just can’t find “common ground” and suffers from serious “dysfunction.”

So that’s why immigration reform, the farm bill, a budget deal, unemployment benefit extensions, workplace discrimination legislation, and the defense spending bill haven’t been passed or dealt with yet? And that’s why the government was shutdown for 16 days in October?

Bipartisan gridlock!

Wrong. The current Congress obliterated all previous records for diminished output because the Republican Party, and especially those in the Republican-run House, purposefully bottled up as many initiatives as possible and unleashed “procedural sabotage.” (They even obstructed disaster relief aid for victim of Hurricane Sandy.)

Yet eager to maintain a political symmetry in which both sides are equally responsible for so little getting accomplished, the press gives Republicans a pass for their purposeful dysfunction.

By the way, are you also experiencing media flashbacks to the government shutdown, which the Republican Party proudly engineered by reneging on a budget deal they had agreed to with the last-minute demand that Obama essentially repeal his signature legislative accomplishment of his first term, the Affordable Care Act? Back then, the one-sided shutdown maneuver was nearly universally portrayed as bipartisan “Washington dysfunction at its absolute worst” (ABC News), a “partisan logjam” (Wall Street Journal), and a “fiscal stalemate” (The Hill).

Yet today, even as some Republican members brag about how little they’ve allowed Congress to accomplish, even as a plurality of voters says the GOP’s top priority is to cause trouble for the president, while a majority blame Republicans for the lack of productivity in Washington, the press still prefers to portray the Capitol Hill standstill as bipartisan “gridlock.”

Because, of course, both sides are always to blame.

But they’re not. Look at the Employment Non-Discrimination Act. In a rare example of fleeting bipartisanship, the bill to prohibit most employers from discriminating based on sexual orientation was approved by the Senate 64-32 last month. In the House, there are more than enough votes from both parties to pass ENDA into law, but Speaker of the House John Boehner will not allow a vote.

The same goes for immigration reform. It passed by an even larger margin in the Senate (68-32), and likely enjoys even more bipartisan support in the House. But again, Boehner won’t allow members to vote on the bill. He won’t even allow the House to enter into negotiations with the Senate to try to hammer out a final bill.

So how is it “gridlock” when a bipartisan, filibuster-proof majority in the Senate and a clear bipartisan majority in the House support a bill but aren’t allowed to vote on its final passage?

Politically, the sabotage strategy works for Republicans. At least in the short term. Note that Obama’s standing among Hispanic voters has dropped precipitously this year. Analysts assume that’s because Obama hasn’t delivered on his promise to pass immigration reform. That may also be because so little of the news coverage stresses the poignant fact that the bipartisan votes are there to pass immigration reform, it’s just that Republican leaders in the House won’t allow the “yes” vote to take place. They won’t allow Obama to take credit for passing a popular law.

And yes, it really did become a scorched-earth situation this year; a nearly across-the-board effort to sabotage Obama’s every move. Republicans aren’t just denying the president the ability to sign meaningful bills into law. The unprecedented minority strategy includes hardcore attempts to block his cabinet picks, executive branch appointments, and judicial nominees. And specifically, blocking judicial nominees who Republicans agree are completely qualified to sit on the federal bench.

But still unsure what to call the Republican brand of anarchy, the press continues to play dumb about the magnitude of the planned interference. For instance, amidst the sabotage, the New York Times reported that while judicial nominations remain an issue of deep contention, “Among senators of both parties, there is agreement that a president should be granted deference in picking members of his cabinet and top executive branch positions.”

False.

Last November, Republicans launched an unprecedented, preemptive campaign to make sure Susan Rice was not picked as Obama’s next Secretary of State. Then they engineered an unprecedented campaign to try to stop Republican Chuck Hagel from becoming Secretary of Defense. And as late as July, two of Obama’s nominated cabinet picks still hadn’t received votes in the Senate, thanks to determined obstruction.

So no, contrary to the Times reporting there is no widespread agreement that presidents should be able to pick their cabinet members and top executive branch positions. There used to be. Then Republicans ripped up that pact. The Times and others just won’t say so as they blame both sides for a do-nothing Congress.

“From The Party Of No To The Party Of Oops”: How Republican Intransigence Keeps Backfiring

Exasperated with repeated Republican stonewalling of President Obama’s executive and judicial nominees, Senate Democrats on Thursday went nuclear, striking down two centuries of precedent regarding the chamber’s arcane filibuster rules.

By a 52-48 vote, the Senate voted to allow confirmation of federal judge and Cabinet nominees with a simple majority vote. The move did not, however, change the filibuster rules regarding legislation and Supreme Court nominees.

For Republicans, it was the latest defeat to come as a result of the party’s refusal to engage with their Democratic colleagues on even minor issues. The GOP has earned a reputation under Obama as the “party of no” for its intransigence, which in recent months has proven self-defeating more than once.

Take the filibuster.

For a full year, Senate Majority Leader Harry Reid (D-Nev.) threatened the nuclear option to circumvent Republican inaction. Most recently, Republicans blocked three nominees to the powerful U.S. District Court of Appeals, not because of any qualms with the candidates’ credentials, but merely because they didn’t want Obama filling vacancies on an influential court that tilts conservative.

With the GOP refusing to back down, Reid finally dropped the bomb, ensuring Obama’s nominees could get an up-or-down vote — and, as a bonus, handing liberals a procedural reform they’ve long sought.

“The American people believe the Senate is broken,” Reid said on the Senate floor Thursday, “and I believe the American people are right.”

Outraged Republicans vowed retribution, saying they would use the process to stack future courts in their favor once they’re back in control. Except to do that, they would need to first retake the Senate and White House, which may not be so easy by 2016.

In the meantime, Democrats have a little extra muscle to help Obama staff his administration as he sees fit (which, let’s remember, used to be common practice). That could be immensely important, since House Republicans have shown no interest in dealing with the president on anything substantive like immigration reform.

As New York‘s Jonathan Chait detailed more thoroughly here, “Obama has no real legislative agenda that can pass Congress,” so his “second-term agenda runs not through Congress but through his own administrative agencies.”

With the filibuster tweak, Obama can now more readily advance his administrative agenda — and Republicans allowed that to happen by forcing Reid’s hand on the filibuster. At that point, he didn’t have much choice: Had he set the precedent of allowing the minority party to prevent judicial vacancies from being filled, Republicans would only have been encouraged to do it again.

“Eventually this escalation would have become untenable,” wrote Salon’s Brian Beutler, “and somebody would have had to go nuclear.”

That’s the same argument Democrats made during the government shutdown, another instance of GOP obstinacy backfiring spectacularly. Had Democrats and President Obama acceded to the GOP’s hostage-taking, it would have established a precedent that government shutdowns and threats of debt default were the norm for legislative negotiations.

And by letting Republicans dig in, Democrats reaped the political benefits of seeing the GOP’s approval ratings tank.

The same dynamic could soon play out on health care, too.

ObamaCare face-planted out of the gate, and Republicans have rightly criticized the administration’s extensive failings in implementing it. However, the GOP has yet to offer a credible alternative health-care plan. The party’s playbook for winning the PR battle over the law, outlined Thursday by the New York Times, is heavy on strategy but light on substance.

“Rather than get out of Obama’s path of self-destruction and focus energy on creating and promoting a positive, forward-looking health-care agenda” wrote National Journal’s Ron Fournier, “the GOP has chosen to cement its reputation as the obstructionist party.”

Republicans will keep stepping on rakes if they opt merely for “no” instead of “no, but instead.” And with ObamaCare possibly set to make something of a comeback in the coming weeks, the clock is ticking.

“The Party Of Zilch”: The GOP Is Out To Destroy The Country

Yes, the headline is rather hyperbolic. It’s as over-the-top as some of President Obama’s most unhinged critics, who believe he is running the nation without care or concern for the Constitution. But when you look at the actions of the Republican Party, particularly its members in Congress, my headline seems appropriate.

Three different pieces highlighted how the GOP is grinding just about every sector of the federal government to a halt. And it is doing it through a cynical combination of obstruction, saying no and failing to have viable alternative proposals worthy of national debate. Whatever political gains Republicans achieve in the short-term come at the long-term expense of the country. That’s simply unacceptable.

Even though the Affordable Care Act (a.k.a. Obamacare) is much more than a Web site, the disastrous roll out of Healthcare.gov has done a number on the president’s standing with the American people. According to the latest Post-ABC News poll, Obama’s overall approval rating sits at 42 percent. His 55 percent disapproval rating is the highest of his presidency. This would be the perfect time for the opposition to step forward with those alternative proposals. But the GOP is “The Party of Zilch,” as Ron Fournier so accurately described.

Rather than be the party of solutions in a gridlocked capital, appealing to a leadership-starved public, the GOP is the party of obstruction, ensuring that its putrid approval ratings nose dive apace with Obama’s.

The country needs sensible immigration reform that brings 11 million or so undocumented residents out of the shadows. No, says the GOP

The country needs to tame a massive debt that will be 100 percent of the gross domestic product by 2038 unless Congress raises revenue and trims entitlements. No, says the GOP.

The country needs fair debate and compromise around existential issues such as climate change, income inequality, and a deteriorating 20th century infrastructure. No, says the GOP.

“Other than hard partisans on the left and right, the majority of the public—moderate, fix-it Americans who simply want a sensible government—now have nowhere to turn, because the GOP is the party of nothing,” Fournier correctly concludes.

The New York Times editorial board delivered its own party-of-zilch disquisition using opposition to the ACA as the jumping off point.

What is the Republican alternative to this government program, flawed as it is right now? There is none. Party members simply want to repeal the health law and let insurers go back to canceling policies at the first sign of a shadow on an X-ray. They have no immigration policy of their own. They have no plan that will stimulate job growth. They are in favor only of shutdowns and sequesters and repeals, giving the public no reason to believe they have a governing vision or even a legislative agenda.

That congressional Republicans have no “governing vision or even a legislative agenda” was proven in a Politico story on Sunday. The headline said it all: “House GOP 2014 agenda starts with blank slate.”

Last Thursday, a group of House Republicans filed into Majority Leader Eric Cantor’s Capitol office suite and received a blank piece of paper labeled “Agenda 2014.”

The blank slate just about sums up where Republicans find themselves after a year marked by the first government shutdown in 17 years, futile efforts to repeal Obamacare and the inability to pass spending bills at the levels set by Republican leaders.

As bad as that is, what a Republican aide said is worse. “What we have done so far this year clearly hasn’t worked,” the GOP aide involved in the planning sessions told the Politico reporters. “Cantor wants to take us in a new direction, which is good. The problem is we don’t know where we are headed, and we don’t know what we can sell to our members.” This no way to run an enterprise as large and as important as the United States.

The judicial branch is crippled as qualified nominees go unconfirmed due to “unfair hurdles in the Senate.” As a result, the U.S. Court of Appeals for the District of Columbia, the nation’s second-highest court, has three vacancies on the 11-seat court that handles cases involving federal regulations and national security. Half of the legislative branch is in thrall to a band of right-wing zealots unmoved by facts as much as they are motivated by hatred of the president. As a result, the threat of government shutdowns and default is constant. Inaction on pressing issues is now routine. And the executive branch finds its agenda held hostage by an opposition that schemed against it since before its inauguration in 2009, even though said agenda was approved by the American people — twice.

That the Obama administration has been able to get as much done as it has speaks to the president’s determination to move this nation forward. Yet it’s not enough. Ours is a government that requires two functioning parties that produce good public policy through the necessary friction of governing. Neither party is perfect nor has all the ideas or the answers. But no good comes from a party that gives up completely on governing.

At the end of its editorial, the Times noted, “Democrats may be stumbling right now, but at least they are trying.” Would that Republicans did the same. It is long past time they did.
