“Caving To Fear”: The Senate Fails America
For 45 senators, the carnage at Sandy Hook Elementary School is a forgotten tragedy. The toll of 270 Americans who are shot every day is not a problem requiring action. The easy access to guns on the Internet, and the inevitability of the next massacre, is not worth preventing.
Those senators, 41 Republicans and four Democrats, killed a bill on Wednesday to expand background checks for gun buyers. It was the last, best hope for meaningful legislation to reduce gun violence after a deranged man used semiautomatic weapons to kill 20 children and six adults at the school in Newtown, Conn., 18 weeks ago. A ban on assault weapons was voted down by 60 senators; 54 voted against a limit on bullet magazines.
Patricia Maisch, who survived a mass shooting in Tucson in 2011, spoke for many in the country when she shouted from the Senate gallery: “Shame on you.”
Newtown, in the end, changed nothing; the overwhelming national consensus to tighten a ridiculously lax set of gun laws was stopped cold. That’s because the only thing that mattered to these lawmakers was a blind and unthinking fealty to the whims of the gun lobby.
The National Rifle Association once supported the expansion of background checks, but it decided this time that President Obama and gun-control advocates could not be allowed even a scintilla of a victory, no matter how sensible. That group, and others even more militant, wanted to make sure not one bill emerged from the Newtown shooting, and they got their way. A vast majority of Republicans meekly followed along, joined by a few nervous red-state Democrats, giving far more weight to a small, shrill and largely rural faction than to the country’s overwhelming need for safety and sanity.
Guns had not been on the president’s campaign agenda, but, to his credit, he and Vice President Joseph Biden Jr. came up with a solid package of proposals after Newtown that would have reduced the number of dangerous weapons on the street and in the hands of criminals. Mr. Obama traveled the country to promote it in 13 speeches, and he has spent the last weeks unsuccessfully trying to pry senators out of the pocket of the gun lobby.
The most important aspect of his proposal, in the eyes of many gun-control advocates, was the expansion of background checks, both because it closed an important loophole and because it seemed the easiest to pass. From 20 percent to 40 percent of all gun sales now take place without a background check, and the bill rejected on Wednesday would have required the check for buyers at gun shows, on the Internet and at other commercially advertised sales. It was sponsored by two pro-gun senators with the courage to buck the lobby, Joe Manchin III, a Democrat of West Virginia, and Patrick Toomey, a Republican of Pennsylvania.
The critical need for this measure was illustrated by a report in The Times on Wednesday that showed how easy it is for criminals to buy weapons on the Internet without a look at their backgrounds. One widely popular Web site contains tens of thousands of private postings of gun sales, and The Times’s investigation found that many buyers and sellers were criminals. Some of the guns have been used to kill.
A vote to continue this practice would be hard to explain to constituents, so lawmakers simply invented reasons to oppose background checks. Some insisted it would lead to a national gun registry, though the plain language of the bill prohibited that. Senator Tom Coburn of Oklahoma said it would raise taxes. Senator Jeff Flake of Arizona said it would require checks even when a gun sale is posted on an office bulletin board. (There’s nothing wrong with that, but it wouldn’t.) Mr. Obama, after the vote, said those who made these arguments had “willfully lied.”
It’s now up to voters to exact a political price from those who defied the public’s demand, and Mr. Obama was forceful in promising to lead that effort. Wednesday was just Round 1, he said; the next step is to replace those whose loyalty is given to a lobby rather than the people.
“Sooner or later, we are going to get this right,” he said. “The memories of these children demand it, and so do the American people.”

“Soft On Crime”: The NRA And Republicans Protecting The “Second Amendment Rights” Of Thugs And Terrorists
What can Americans learn from the bitter debate over the gun reform bill? Perhaps the most obvious lesson is that the leadership of the National Rifle Association, the Gun Owners of America, and their tame Republican politicians have all earned an epithet of derision they used to hurl regularly at liberals.
Yes, the gun lobby and its legislative servants are “soft on crime” — although they routinely pretend to be tough on criminals.
During the Clinton presidency, NRA president-for-life Wayne LaPierre raised vast amounts of money with direct-mail campaigns against both Bill and Hillary Clinton for supposedly coddling criminals. Dubbed “Crimestrike,” the NRA crusade pushed prison construction, mandatory minimum sentencing, and sundry other panaceas designed to position the NRA as the bane of muggers, rapists, and murderers. Those themes echoed traditional Republican propaganda messages dating back to the Nixon era, when the presidential crook himself often derided judicial concerns about civil liberties and promised to restore “law and order.” (When Nixon henchmen like the late Chuck Colson went to prison themselves, they often emerged as prison reformers and civil libertarians, of course.)
But in the aftermath of the Newtown massacre, with the NRA angrily opposing any measure designed to hinder criminals from acquiring firearms, the public is learning who is really soft on crime.
Police officials across the country want universal background checks, magazine limits, and stronger enforcement against illegal weapons sales, but the NRA and its Republican allies insist that such changes will penalize legitimate gun owners. Or they complain that criminals mainly obtain weapons by stealing them, so restrictions on sales won’t make any difference.
Even a cursory examination of the facts demonstrates those claims are false. Gun trafficking experts at the Bureau of Alcohol, Tobacco and Firearms have long known that less than 15 percent of all crime guns are stolen from their original owners. Much more common sources of guns used by criminals are so-called “straw purchases,” where a person with a clean record buys a gun on behalf of a criminal, and corrupt purchases, where a licensed gun dealer knowingly sells to a criminal. Bipartisan gun legislation now before the Senate would crack down on these sales, by increasing penalties for straw purchasers who willfully help criminals buy guns. The NRA has offered tepid support for that provision — but it is virtually meaningless without universal background checks, which the gun lobby opposes.
As Will Saletan pointed out in Slate last January, the NRA has consistently (and successfully) sought to kill the most basic efforts to keep guns away from convicted criminals and other dangerous characters — including abusive spouses under court protection orders, drug dealers, and even individuals listed on the Justice Department’s terrorist watch list.
In the wake of the Boston bombing, as the nation ponders how to bolster its security, the gun lobby’s tender concern for the Second Amendment “rights” of terrorists and thugs ought to permanently discredit them and their political servants. Instead they have achieved another bloody victory in Washington.

“A Political Price To Pay”: Obstruction Of The Gun Violence Bill Will Further Damage The GOP
On Wednesday, supporters of legislation to limit gun violence failed to muster the sixty votes necessary to stop a Republican filibuster of the Toomey-Manchin compromise that would expand background checks to include all commercial gun sales in the United States.
Polls show that universal background checks are supported by 90% of Americans – including a vast majority of gun owners and Republicans. A clear majority of Senators are fully prepared to pass a background check measure. But no matter – the Republican Leadership decided to obstruct the democratic process in the Senate to prevent an up or down vote on the measure.
Conventional wisdom continues to hold that, while the vast majority of Americans support universal background checks, in many areas it is still smart politics not to antagonize the NRA and their relatively small number of very active – very passionate – supporters. Conventional wisdom is wrong. Here’s why:
1). Wednesday’s Washington Post poll shows that 70% of all voters and nearly half of Republicans already think the GOP is out of touch with the needs and interests of the majority of Americans. By opposing a common sense measure like universal background checks, that is supported by nine of out ten Americans, the GOP leadership threatens to further tarnish the GOP brand by appearing to be way out of the mainstream and not on the side of ordinary voters.
2). It is no longer true that large number of voters who favor measures to limit gun violence are less “passionate” about their views. It is also no longer the case that those views will be less likely to affect their voting than opponents of restrictions on guns.
In a poll released Wednesday by Project New America, over 60% of voters in Arkansas, Illinois, Maine, Nevada, New Hampshire, North Carolina, and Ohio said they strongly support background checks for gun purchasers.
And an overwhelming number of voters said they would be more likely to support candidates for Senate that supported background checks – 70% in Maine, 65% in North Carolina, 64% in Illinois, 64% in New Hampshire, 62% in Nevada, and 56% in Arkansas.
3). The GOP lost women 55% to 44% in the last election. Republican obstruction of gun violence legislation will only make their problem with women voters worse, since they are particularly passionate supporters of legislation to stem gun violence. The same goes for Millennial voters who overwhelmingly support gun violence legislation.
4). Some pundits will say that Democratic Senators contributed to the failure to muster 60 votes to end the Republican filibuster by refusing to vote to cut off debate. Forty-one of forty-five Republican Senators voted against background checks. Over 90% of Democratic Senators voted to support the background check legislation and there would have been no need for 60 votes in the first place if the Republican leadership had not decided to filibuster the bill.
The fact is that everyone in America knows that the President and Democratic Leadership strongly favor background checks, and the Republican Leadership – as well as most Republican Senators – opposed them. That is what will create a lasting impression among voters.
5). Many Republicans and some Democratic Senators have made the judgment that the money and energy of the NRA and weapons industry are more potent politically than the forces who promote legislation to curb gun violence. That may have been true in the past — no longer.
The fact is that in the last election the major NRA PAC had a .083% success rate. And now Mayor Bloomberg, the Giffords/Kelly organizations and many others are amassing substantial resources to target against the enemies of legislation to stop gun violence.
Bloomberg already showed the potency of these efforts by investing $2 million in the Illinois 2nd District Congressional District and virtually sinking pro-NRA candidates who had otherwise been strong contenders in this spring’s special election. There will be more of that to come.
6). On a press conference call Wednesday, Democratic pollster Geoff Garin pointed out that Republican opposition to legislation to limit gun violence, further shrinks the playing field where they will be competitive – both in 2014 and the next Presidential race. The Democratic Congressional Campaign Committee has a list of 27 Republican incumbents who represent swing districts where voters are supportive of anti-gun violence legislation.
Already Republicans have a very narrow, difficult path to 270 electoral votes in the Presidential map. They need to broaden their electoral playing field. But their opposition to gun violence legislation will make their path to victory in states like Pennsylvania, Florida, Ohio, Virginia, Colorado, Washington, and Oregon even more difficult.
What does all of this add up to?
The fact is that Democrats and supporters of strong legislation to curb gun violence have the high moral and political ground in this debate — and the issue is not going away. This is, after all, a 90%-10% issue.
The background check bill would have won by five votes. Instead, Republican abuse of arcane Senate rules required that it receive a super majority of sixty votes to pass. This, by the way, is yet another excellent reason to change those Senate rules to end the misuse of the filibuster.
Over the next weeks, it is up to those who support common sense gun violence legislation to come down on those who voted no like an avalanche.
There is simply no excuse for their failure to pass legislation that is supported by 90% of the American people.
Simply put, we cannot let that stand – and those who opposed the measure must be made to pay the political price.
There continues to be a perceived “passion gap” on the gun issue. Members of Congress still believe that while the majority of Americans support legislation to curb gun violence, they lack the passion of opponents. As we have seen, this is no longer true.
Now it is up to us to demonstrate that it is not true to the Senators who are more concerned about contributions and support from the weapons industry than they are about the lives of the 26 people who died at Newtown – and the thousands of others who have died since.

“Before A Rooster Crows, Will They Be Denied?”: Newtown Families Ask For Meeting With Mitch McConnell
A representative for families of the Newtown shooting victims has asked Senator Mitch McConnell to hold a meeting with them, according to sources familiar with the request. McConnell’s office initially declined the request on the basis of scheduling, a source says — and now family members are set to call McConnell and reiterate the request personally.
How will McConnell respond?
The request – if granted — would allow the families to come face to face with the primary architect of the GOP’s strategy of blocking everything Dems propose to slow the tide of gun violence. If it is denied, it would be a big story, and could lend support to the argument that Republicans are callously rebuffing the families — and prioritizing the gun lobby over them – in the wake of a massacre that claimed the lives of 20 Newtown children.
The request — which was made by a representative of Sandy Hook Promise, a group that includes around a dozen family members who are lobbying Washington lawmakers – represents something of a shift in strategy by the families, and carries interesting implications for later stages in this battle. Previously, the families, who had met with many Democratic and Republican Senators, had shied away from asking for a meeting with McConnell, on the theory that they should focus their energy on Senators they deemed persuadable. This irritated Democrats who wanted to see more public pressure put on their GOP counterparts.
But now the families are asking McConnell for a meeting. The families are not optimistic that the meeting will move McConnell, a source familiar with their thinking says, but this will placate Dems who want public pressure put on the leader of Senate Republicans. What’s more, if the legislation fails, the families don’t want to be in the position of retrospectively wondering if they had done all they could to get it passed, particularly since a round of bitter finger-pointing would be all but inevitable. And finally, the source says, the families are hoping to initiate a longer term conversation — one beyond the current battle – with even hostile lawmakers about other ways of combatting gun violence, such as school safety and addressing mental illness.
Asked for comment, McConnell spokesman John Ashbrook emailed me this:
Our office recently sat down with folks from Newtown for a lengthy discussion and we’re certainly open to doing it again. We actually offered another meeting and are waiting to hear back.
It’s unclear which Newtown residents this refers to or whether McConnell is willing to meet personally with families.
There’s another angle worth considering here, too. While McConnell obviously wants to sink the Manchin-Toomey background check proposal via procedural means — whether by filibuster or by voting it down as an amendment, which would require 60 votes to pass – Democrats and gun control advocates believe he wants a few red state Dems to oppose it in the procedural vote, too. That would mean that the proposal was blocked by a bipartisan group of Senators — insulating the GOP from some blame — as opposed to meaning it was defeated solely by Republicans who were determined to avoid allowing it come to a simple majority vote.
If the families put more pressure on McConnell, it won’t move him, but it could perhaps make it tougher politically for the GOP alone to sink the proposal. And so, if the remaining hold out red state Dems ultimately do support moving the bill forward past the next supermajority procedural vote, it would then become harder for the remaining Republican holdouts — Kelly Ayotte and Dean Heller — to vote No, because then the blame for killing the whole proposal by procedural means would fall on the GOP.

“We Snookered The Other Side”: Proof That Congress Is A Captive Of The Extremists
Senators Joe Manchin (D-WV) and Pat Toomey’s (R-PA) bipartisan compromise on expanding gun sale background checks was widely praised by gun safety advocates as an important reform, and slammed by the National Rifle Association as a step in the wrong direction. But at least one major gun group thinks that the conventional wisdom has it backwards.
Daylight Disinfectant has obtained video of Alan Gottlieb, founder and executive vice president of the Second Amendment Foundation, bragging that “we snookered the other side” by loading the Manchin-Toomey bill with pro-gun amendments.
“It’s a Christmas tree,” Gottlieb said to a Portland, OR crowd on Friday. “We just hung a million ornaments on it.”
“We’re taking the background check and making it a pro-gun bill,” he continued. “Unfortunately, some of my colleagues haven’t quite figured it out yet because they weren’t sitting in the room writing it. My staff was.”
“If you really read what’s in the Manchin-Toomey bill — man, it’s a godsend. We win rights back like crazy,” he later added. “I think we snookered the other side. They haven’t figured it out yet.”
Gottlieb also suggested that maybe he should have kept his opinion to himself, noting, “If we talk about it too much, the other side’s gonna find out about it and they’re gonna realize we’re gonna win off of this thing.” Video of the speech via Daylight Disinfectant:: http://youtu.be/E9UMox1WoTw
Indeed, although the Manchin-Toomey compromise would represent the most significant gun reform in two decades, it contains many elements that should please the “gun rights” crowd. The bill exempts private, not-for-profit sales from background checks (falling far short of the universal standard sought by many Democrats), allows concealed-carry permits to transfer across state lines, and explicitly bans the creation of a national gun registry, among other provisions. The compromises were enough to lead New York governor Andrew Cuomo, a prominent gun reform advocate, to lament, “This is a Congress that is captive of the extremists and there is no clearer proof of that than this.”
In addition to the Second Amendment Foundation, the Citizens’ Committee for the Right to Keep and Bear Arms — which claims to be the nation’s second-largest “gun rights” group, and with which Gottlieb is also closely associated — has also publicly endorsed the bill.
Still, it’s unclear whether this push from gun interest groups will actually make a difference in the final vote. As of now, just four Republican senators — Toomey, Susan Collins (R-ME), John McCain (R-AZ), and Mark Kirk (R-IL) — have signaled their intention to vote for the bill. Several red-state Democrats have also suggested that they will oppose the bill, despite the political cover provided by the gun interest groups. If a bipartisan bill that is so tame that “gun rights” groups hail it as a major victory cannot move through the Senate, then it would be safe to question whether any reform is truly possible.
