“High On Their Own Supply”: Republicans Marching Into One Well-Prepared Crossfire After Another
Jonathan Strong, writing at National Review Online, explains that the Republicans are wary of doing anything that might distract people from their campaign against the Affordable Care Act. Therefore, Mitch McConnell doesn’t intend to engage in any high-profile retaliatory procedural actions in the Senate. That’s fine with me, but it calls to mind McConnell’s immediate response to the invocation of the Nuclear Option. He took to the Senate floor and declared not that Harry Reid had just done something historical or significant or even abominable, but that Reid was merely trying to distract people from ObamaCare.
I thought that was the oddest response in the world. I expected fire and brimstone and steaming wrath and promises of vengeance, or even impeachment. And I got a mild complaint about Reid trying to change the narrative.
This makes me think that the Republicans are truly on another one of their Moby Dick adventures, like Whitewater, like the White House Travel Office, like Vince Foster, like l’affaire Lewinsky, like Saddam’s WMD, like Fast and Furious, like Solyndra, like the New Black Panther Party, like Benghazi, and like the most recent government shutdown. More than anything, it reminds me of when they convinced themselves not that the presidential polling numbers could be oversampling blacks, but that they were oversampling blacks. It’s like their theory that systematically trying to make it harder for blacks to vote would result in reduced black turnout rather than a black community more determined than ever to cast their ballots.
It’s some variation of stupidity and delusion, with a little evil sprinkled into the mix. And this really is the only area where I find the Republicans unpredictable. I know what they won’t agree to, which makes it easy to offer it to them without fear that they will accept it. “Have some Chained CPI, boys, really, all we need in return is some revenue.”
What I have trouble predicting is their next obsession, and how absurdly far they will take it. These people are still talking about Benghazi. As long as I’ve watched them, I still have to admit that I didn’t see that coming.
Still, their greatest weakness is their predictability. They do not know how to adapt to changing circumstances, nor how to trim their sails when it would be to their advantage. As a result, they march into one well-prepared crossfire after another.

“From The Party Of No To The Party Of Oops”: How Republican Intransigence Keeps Backfiring
Exasperated with repeated Republican stonewalling of President Obama’s executive and judicial nominees, Senate Democrats on Thursday went nuclear, striking down two centuries of precedent regarding the chamber’s arcane filibuster rules.
By a 52-48 vote, the Senate voted to allow confirmation of federal judge and Cabinet nominees with a simple majority vote. The move did not, however, change the filibuster rules regarding legislation and Supreme Court nominees.
For Republicans, it was the latest defeat to come as a result of the party’s refusal to engage with their Democratic colleagues on even minor issues. The GOP has earned a reputation under Obama as the “party of no” for its intransigence, which in recent months has proven self-defeating more than once.
Take the filibuster.
For a full year, Senate Majority Leader Harry Reid (D-Nev.) threatened the nuclear option to circumvent Republican inaction. Most recently, Republicans blocked three nominees to the powerful U.S. District Court of Appeals, not because of any qualms with the candidates’ credentials, but merely because they didn’t want Obama filling vacancies on an influential court that tilts conservative.
With the GOP refusing to back down, Reid finally dropped the bomb, ensuring Obama’s nominees could get an up-or-down vote — and, as a bonus, handing liberals a procedural reform they’ve long sought.
“The American people believe the Senate is broken,” Reid said on the Senate floor Thursday, “and I believe the American people are right.”
Outraged Republicans vowed retribution, saying they would use the process to stack future courts in their favor once they’re back in control. Except to do that, they would need to first retake the Senate and White House, which may not be so easy by 2016.
In the meantime, Democrats have a little extra muscle to help Obama staff his administration as he sees fit (which, let’s remember, used to be common practice). That could be immensely important, since House Republicans have shown no interest in dealing with the president on anything substantive like immigration reform.
As New York‘s Jonathan Chait detailed more thoroughly here, “Obama has no real legislative agenda that can pass Congress,” so his “second-term agenda runs not through Congress but through his own administrative agencies.”
With the filibuster tweak, Obama can now more readily advance his administrative agenda — and Republicans allowed that to happen by forcing Reid’s hand on the filibuster. At that point, he didn’t have much choice: Had he set the precedent of allowing the minority party to prevent judicial vacancies from being filled, Republicans would only have been encouraged to do it again.
“Eventually this escalation would have become untenable,” wrote Salon’s Brian Beutler, “and somebody would have had to go nuclear.”
That’s the same argument Democrats made during the government shutdown, another instance of GOP obstinacy backfiring spectacularly. Had Democrats and President Obama acceded to the GOP’s hostage-taking, it would have established a precedent that government shutdowns and threats of debt default were the norm for legislative negotiations.
And by letting Republicans dig in, Democrats reaped the political benefits of seeing the GOP’s approval ratings tank.
The same dynamic could soon play out on health care, too.
ObamaCare face-planted out of the gate, and Republicans have rightly criticized the administration’s extensive failings in implementing it. However, the GOP has yet to offer a credible alternative health-care plan. The party’s playbook for winning the PR battle over the law, outlined Thursday by the New York Times, is heavy on strategy but light on substance.
“Rather than get out of Obama’s path of self-destruction and focus energy on creating and promoting a positive, forward-looking health-care agenda” wrote National Journal’s Ron Fournier, “the GOP has chosen to cement its reputation as the obstructionist party.”
Republicans will keep stepping on rakes if they opt merely for “no” instead of “no, but instead.” And with ObamaCare possibly set to make something of a comeback in the coming weeks, the clock is ticking.

“They Had A Choice”: Did Frustrated Mainstream Republicans Help Pull The Nuclear Trigger?
The big mystery of today’s majority-imposed rules change in the Senate is: What happened to the deal-making Republicans?
There’s nothing much to figure out on the Democratic side. It was clear to most observers that the three-seat blockade of the D.C. Circuit Court was solidly over the line separating Democratic senators’ individual preference for maintaining the filibuster and their party interest in seating a Democratic president’s choices for the federal bench. Democrats believed that they had no choice but to proceed.
Republicans, however, certainly did have a choice. After all, in the short run, they’re clearly worse off by this change than they would be had they used the filibuster far more selectively. That was enough to get them to compromise the last time this happened. So why didn’t they hold back again?
One possibility is that they simply miscalculated, believing that Senate Majority Leader Harry Reid (D-Nev.) was bluffing. If that was the case, however, they could have backed off at the last second.
A second possibility is that they really wanted to eliminate the filibuster, and that they believed that the cost to the Democrats for pulling the trigger was great enough that it was worth the potential three years of majority-confirmed President Obama nominees. That’s possible, although it’s very hard to believe that voters will care at all, and Republican arguments (court-packing!) did not appear designed to appeal to those who might have been willing to condemn Democrats for a “power-grab.”
So here’s a third possibility. The problem with the summer compromise is that it was horrible for deal-making Republicans. The deal essentially said: Republicans will continue to filibuster nominations, but will supply enough votes for almost all of them so that the filibusters will be defeated. But that meant that in practice a handful of Republicans were forced to tag-team their votes, making sure that Democrats always had 60. What’s more, the shutdown fight — which began right after the Senate deal was struck — revealed that radical Republicans led by Sen. Ted Cruz (R-Tex.) were eager to scapegoat those same deal-making Republicans. That raised the cost of the executive branch nominations agreement for tag-teamers such as Sens. Lamar Alexander (R-Tenn.), Bob Corker (R-Tenn.) and John McCain (R-Ariz.). In other words, the summer deal might or might not have been stable, but it certainly couldn’t hold in a world in which the majority of Republican senators are looking for ways to separate themselves from mainstream conservatives, and then using that separation to attack them.
Those deal-making Republicans did have another option; They could have just abandoned the radicals. But over what principle? After all, the situation here is that it’s the radicals, not the mainstream conservatives, who want to hold up all these nominations. One way to look at what happened today is that the deal-makers were getting out of the way and allowing the radicals to lose. If the outcome is the same — Obama’s judicial picks get confirmed — then why should the deal-makers ask for the blame for it?
We don’t know yet, and perhaps we won’t, but my guess is that the way Cruz and other Republican radicals acted during the shutdown is what explains the difference between a successful deal in the summer and today’s nuclear action.

“Norms And Rules Are For Suckers”: Don’t Believe The Republican Cries Of Vengeance
So now the Democrats have exercised the “nuclear option,” which is not particularly nuclear. They’ve changed existing Senate rules so that judicial nominations can not be filibustered, but can pass with a majority vote. Over the next couple of days you’ll hear Republicans say that this is the most horrifying power grab since the February Revolution of 1917. They will weep and beat their breasts, lamenting the death of fairness and democracy, predicting all manner of horrors, perhaps culminating in a zombie apocalypse, now that a judge nominated by the president can be confirmed with a vote of a majority of senators. But then, their grief will turn to steely determination. “You shall rue this day!”, they will cry. “Revenge shall be ours!”
And that might sound like a reasonable argument for why this rule change was ill-advised. After all, as Iowa senator Chuck Grassley recently threatened, “So if the Democrats are bent on changing the rules, then I say go ahead. There are a lot more Scalias and Thomases that we’d love to put on the bench.” In other words, without the restraint of the filibuster, the next time Republicans have the White House and the Senate, which will happen eventually, they’ll go hog-wild, appointing the most radical conservatives they can find. But there’s one big reason that argument fails: They would have done it anyway.
Let’s not be naive here. The Republican party of today is not only ideologically radical but procedurally radical as well. They’ve taken virtually every opportunity they could to upend whatever rules and norms stood in the way of them getting what they want. Let’s say that it’s 2017 or 2021, and they’ve won the presidency and the Senate. Can anyone believe that if on this day in 2013 the Democrats decided to keep the filibuster for judicial nominations, Republicans would then do the same out of a sense of fair play? This is the party that over the last five years has filibustered literally every bill of greater consequence than renaming a post office. This is the party that got conservatives on the Supreme Court to upend the Voting Rights Act, then literally within days began passing one law after another to make it as hard as possible for minorities, students, and anyone else likely to vote Democratic to cast their ballots. This is the party that shut down the government in its endless quest to repeal the Affordable Care Act. This is the party that sincerely believes that its opponents are attempting to destroy America, and therefore any tactics are justified in order to stop them.
You can put the start date of this procedural radicalism at the inauguration of Barack Obama, but I’d date it back to the Florida mess in the 2000 election. In case your memory of that episode has faded, the whole election came down to a series of counts and recounts in a state in which the Republican candidate’s brother was the governor and his campaign co-chair was the state’s chief election official. Throughout the weeks that followed, Republicans did things like organize a small riot to intimidate election officials into not counting ballots, and the election was ultimately decided by five members of the Supreme Court who were so shamelessly partisan that they included in their decision an instruction that it could never be used as precedent in a subsequent case. And you know what price the Republicans paid for their ruthlessness? None.
It was then that Republicans realized once and for all that norms and rules are for suckers, and at the end of the day, the only thing that matters is whether or not you win. That belief hasn’t changed, even as the party has grown more ideologically extreme over the last five years. You can make an argument that Democrats should have taken the high road and not changed the filibuster rule today. But if you think Republicans wouldn’t have changed the rule to benefit themselves at the first chance they got—no matter what Democrats did—then you haven’t been paying attention.

“Everyone Just Chill Out”: Memo To Democratic Chicken Littles, The Sky Is Not Falling
Ah, now this is what politics is supposed to be like: Ruthless Republicans, gleeful at the prospect that they might increase the net total of human suffering. Timorous Democrats, panicking at the first hint of political difficulty and rushing to assemble a circular firing squad. And the news media bringing out the “Dems In Disarray!” headlines they keep in storage for just this purpose.
The problems of the last couple weeks “could threaten Democratic priorities for years,” says Ron Brownstein. It’s just like Hurricane Katrina, says The New York Times (minus the 1,500 dead people, I guess they mean, though they don’t say so). “On the broader question of whether Obama can rebuild an effective presidency after this debacle,” says Dana Milbank, “it’s starting to look as if it may be game over.” Ruth Marcus also declares this presidency all but dead: “Can he recover? I’m sorry to say: I’m not at all confident.”
Oh please. Everyone just chill out.
It’s incredible how often reporters and pundits proclaim that what’s happening this week is the most important political development in years, and the balance of political advantage today will remain just as it is indefinitely into the future. Then a few weeks or months later things change, and they forget about what they said before, declaring once again that today’s situation is how things will be forevermore. Not long ago, people were saying that the fact that Obama couldn’t get a congressional vote authorizing a bombing campaign in Syria had crippled his presidency. Then the Republicans shut down the government, and people were saying they wouldn’t win another election in our lifetimes. That’s just in the last few months. And now people are saying that Obama’s second term, which has three years left to go, is an unrecoverable disaster.
So let’s try to see things from a less panicky perspective. The rollout has been a mess, but it’s important to remember that this period is all a preparation for the actual implementation of the law. Nothing that’s happening now is permanent. People have gotten cancellation notices, but no one has lost their coverage. The website sucked when it debuted, it sucks slightly less now, but there’s still lots of time for people to sign up for plans that take effect next year. And if things aren’t working properly by December, they’ll probably extend the open enrollment period to a point at which everything’s working. That’s a hassle, sure. But you can’t call the Affordable Care Act a failure until it takes effect and does or does not achieve its goals. That would be like calling your team’s season a failure because they lost a couple of pre-season games.
A few Democrats will probably vote today for the Republican bill that purports to address the problem of cancellations but it’s an attempt to gut the entire ACA. That’s because they’re cowards and fools, who think that they can protect themselves from a momentary political headwind by rushing into the Republicans’ arms. And you know what will happen? Nothing. You can just add this vote to the 47 prior ones repealing the law; it’ll have the same impact. It won’t ever get to the Senate, and even if it did it wouldn’t ever be signed by the President. It isn’t even worth paying attention to.
Here’s what’s going to happen. The administrative fix Obama announced yesterday will temporarily staunch the political bleeding. But it will have very little effect on the actual insurance market, which is a good thing. In some states, insurance commissioners won’t let the insurance companies continue to sell the junk plans we’ve been talking about. In others, insurers won’t want to go back and re-offer the plans they cancelled. Some of the people with the junk plans will end up keeping them, but most of them will end up going to the exchanges. Many will find that they can get subsidies, or even without them find an affordable plan. Some may find that they’re paying more for a plan that offers real insurance. Those in the latter group will grumble, but it won’t be front-page news anymore, because the media are extraordinarily fickle, and they’ve already told that story.
Over the next year, the rest of the law will be implemented. There may be problems here and there, but overall it will probably go reasonably well. There will be plenty of things Democrats can point to in order to convince people that it was a good idea, like the fact that now nobody can be denied coverage because of a pre-existing condition, or the fact that millions of people who couldn’t afford coverage or were denied before now have it. There will also be things Republicans will say to try to convince people it was a terrible idea, like the fact that premiums didn’t plummet, and health care is still expensive, and Obamacare didn’t give every little girl a pony.
And what else will happen in the next year? Other things. The economy may get worse, or it may get better. There may be a foreign crisis. Controversies we can’t yet anticipate will emerge, explode, then disappear. A young singer may move her posterior about in a suggestive manner, causing a nation to drop everything and talk about nothing else for a week. We might start talking about immigration reform again. There’s going to be another budget battle. In other words, all sorts of things could affect the next election, and the election after that.
So yes, this is a difficult period for President Obama, and for the Affordable Care Act. But everyone needs to take a deep breath and remember that things will change. They always do.
