“Ted Cruz, House Republicans, And Their Many Secret Meetings”: House GOP Members Don’t Much Care For Their Own Leaders
It’s not too uncommon for Republican leaders from the House and Senate to occasionally meet, trade notes, and work out bicameral strategies, but as a rule, rank-and-file members tend to stick with colleagues from the same chamber. When they have ideas or grand plans, GOP lawmakers usually turn to their chamber’s leadership or committee chairs.
Which is why it’s odd to see House Republicans huddle so frequently with Sen. Ted Cruz (R-Texas).
Last September, House Speaker John Boehner (R-Ohio) presented a plan to avoid a government shutdown. Cruz met directly with House Republicans, urged them to ignore their own leader’s plan, and GOP House members followed his advice. The result was an embarrassing and unnecessary shutdown.
A month later, Cruz held another meeting with House Republicans, this time in a private room at a Capitol Hill restaurant. In April, the Texas senator again gathered House Republicans, this time for a private meeting in his office. Cruz’s office shared very few details with reporters, except to note that the 90-minute session “included candy bars, crackers and soda.”
And then last week, less than an hour after House Republicans elected a new leadership team, guess who had an invitation for them?
At 4 p.m., immediately following the leadership elections, Sen. Ted Cruz (R-Tex.) – who has repeatedly encouraged House conservatives to defy their leaders – sent an e-mail to a large group of conservative House Republicans.
Cruz invited them to meet with him June 24 for an “off-the-record gathering” and “an evening of discussion and fellowship.”
Pizza, Cruz told them, will be served.
I’m sure it was delightful, but I can’t help but wonder about the purpose of all of these meetings.
Some of this, I suspect, is the result of an unusual leadership dynamic. Cruz can’t do much in his chamber – Senate Republicans don’t seem to like him, and Senate Democrats consider him a dangerous demagogue – so he’s reaching out to House Republicans, who at least have a majority. GOP House members, meanwhile, don’t much care for their own leaders, and they apparently find value in Cruz’s counsel.
It’s a match made in … somewhere unpleasant.
But since Congress can no longer pass meaningful legislation of any kind, what is it, exactly, that these far-right lawmakers are talking about? We can only speculate, of course, but maybe it’s ideas like these.
Sen. Ted Cruz (R-TX) introduced a resolution on Thursday calling for Attorney General Eric Holder to appoint a special prosecutor to investigate the IRS scandal – and if he doesn’t do so, Cruz thinks he should be impeached.
“If attorney general Eric Holder continues to refuse to appoint a special prosecutor, he should be impeached,” Cruz said on the Senate floor.
Let’s put aside for now the fact that there is no IRS “scandal” and the idea of appointing a special prosecutor for no reason is quite dumb. Instead, let’s note that even if Senate Republicans decided they love the idea of impeaching the Attorney General, it’s not their call – impeachment proceedings must begin in the House, not the Senate.
Maybe this is what Cruz mentions over pizza and candy bars?

“A Galloping Conservative Radicalism”: If Republicans Want Respect, They Need To Stop Using The Budget As A Weapon
One of the central provisions of the Dodd-Frank financial reform package was the creation of the Consumer Financial Protection Bureau, which is charged with preventing banks and other financial institutions from preying on vulnerable consumers. Republicans hate the CFPB, and have taken to complaining about its funding stream, which comes from the Federal Reserve rather than the normal budgeting process.
They have a point, but they have only themselves to blame, since the GOP has all but relinquished its claim to responsible oversight by using the budget to cripple laws it doesn’t like.
This steaming Washington Examiner editorial lambasting Reps. Maxine Waters (D-Calif.) and Al Green (D-Texas) is a helpful distillation of the GOP position:
Simply put, Waters and Green view the congressional appropriations process as an obstacle to doing things they judge to be good, rather than as a tool by which the American people make sure the executive branch properly enforces the laws they instructed Congress to approve. This is how a democratic republic functions. Do Waters and Green think other agencies — say, the IRS, NSA, the Department of Homeland Security or perhaps the FBI — should be similarly unaccountable to the people’s representatives?
And what will they do when, having freed the bureaucrats of congressional shackles, they find a Republican president using the CFPB in nefarious ways, with Congress powerless to intervene? [Washington Examiner]
I have some sympathy with this perspective. Putting the CFPB outside the normal budget does reduce its democratic accountability. And the agency hasn’t been covering itself with glory of late; a recent report from American Banker found systematic discrimination in hiring and promotion. It’s plausible that more oversight could have prevented that.
But the problem is that conservatives obviously aren’t concerned about whether taxpayers are getting a good deal. They want to cut the bejesus out of the agency’s funding, even if it means inviting another financial crisis. The GOP budget from earlier this year zeroed out CFPB funding after 2016. Republicans claimed they wouldn’t get rid of it altogether, but given the GOP’s animosity toward pro-consumer regulations, or any programs that benefit the non-rich, it’s easy to suspect that they are trying to quietly axe the agency.
The truth is that the strongest possible oversight authority over the CFPB — the power of life and death — is still firmly in Congress’ hands. The legislature created the agency, and it may destroy it. The trouble is that Republicans don’t have enough votes to destroy the CFPB. They don’t even have a majority in the Senate, never mind enough votes to override a guaranteed veto from President Obama.
By dividing government, the Constitution forces parties into compromise. For a normal partisan with a basic commitment to the norms of American democracy, the idea is to hammer out compromises with the other side until you are in a position to enact a suite of policies. You can’t get everything, but you can get half a loaf here and there. Then, when you get the rare chance at controlling both Congress and the presidency, you pass a big policy suite, and hope people like it enough that it sticks.
That’s a reasonably fair description of how Democrats behaved from 2006 to 2010.
But Republicans have abandoned this set of norms in favor of an enraged constitutional hardball. Under this model, when you don’t have enough votes to pass your agenda, you use every procedural tactic at your disposal to force the other side to embrace it. At the extreme, this includes threatening grievous damage to the nation, by deliberately defaulting on the debt or shutting down the government. Additionally, since what passes for Republican policy is simply repealing laws or privatizing huge swathes of the government, starving agencies for funds is a nice way to accomplish that goal on the sly.
Republicans have eased up on the government-by-hostage-crisis of late, but this behavior is what inspires Democrats to do an end-run around the budget process. Since they can’t trust Republicans to not use the budget process as part of the policy proxy war, there’s a constant search for ways to protect critical agencies from procedural extremism.
It’s not a great situation. But because our poorly designed institutions have collided with a galloping conservative radicalism, it is going to be a more common one.

“Uniformly Angry And Outraged”: Meet Trey Gowdy, GOP Benghazi Attack Dog
Since House Speaker John Boehner announced the creation of a select committee to investigate the Benghazi affair, Republicans have been saying it will be a serious investigation, while Democrats have been saying it will be a partisan circus. To get a sense of who might be right, I spent some time watching YouTube videos of Rep. Trey Gowdy, the heretofore obscure second-term Tea Party congressman from South Carolina whom Boehner named to lead the committee.
There are a lot of these videos of Gowdy in congressional hearings, posted by conservatives, with titles like “Gowdy DESTROYS Obama Admin Stooge!” He’s obviously very popular among the base. To call Gowdy prosecutorial would be an understatement. Uniformly angry and outraged, these videos show Gowdy always seemingly on the verge of shouting, he’s so damn mad. Like any good lawyer, he never asks a question to which he doesn’t already know the answer. But when a witness gives him an answer other than the one he expects, he repeats his question at a slightly louder volume and angrier pitch, as though the question hadn’t actually been answered.
This is a good example, in which Gowdy blasts the director of the National Park Service for closing national memorials during the government shutdown, thereby allowing Republicans to stage a photo op in which they proclaimed their solidarity with veterans wanting to go to the memorials. You’ll recall that it was Tea Partiers like Gowdy who pushed for the government shutdown in the first place; this was a lame attempt to somehow shift blame onto the Obama administration for the shutdown, one that didn’t work. Instead of thanking the director for making their photo op possible, Gowdy angrily demands that the director tell him the statute that allows him to put barricades around the memorials and prevent our fine veterans from entering them. The director cites the statute that covers the procedures the Park Service is supposed to follow during a shutdown. Gowdy was apparently expecting the director to say, “I have no idea” or evade the question, so he asks the question a couple more times as though it were being evaded. Which tells you why Gowdy got picked for this job. John Boehner is doing this for the base, and the base wants someone who will channel the anger and contempt they feel for Barack Obama, Hillary Clinton, and the rest of the administration. Gowdy, a former prosecutor, is already referring to this enterprise not as an investigation but as a “trial,” making clear that he sees his job not as finding the truth but as convicting the accused. And for someone who has supposedly been obsessed with Benghazi, he doesn’t seem to have much of a grasp on what the multiple investigations of the issue have already revealed. So what we’re likely to see is a lot of desk-pounding, a lot of “Answer the damn question!”, and not much (or any) wrongdoing actually uncovered.
Of course, I’m assuming that there isn’t actually some bombshell revelation just waiting to be discovered. I’m pretty sure I’m on firm ground on that one, though. And it’s possible that Gowdy will lead a professional, sober, thorough investigation that will win him kudos from all observers, regardless of their ideology. But a professional, sober, thorough investigation isn’t what his party’s base really wants. They want to see members of the Obama administration squirm in the witness chair. They want some fireworks. And Trey Gowdy is just the man to give it to them.

“Bringing The Shutdown Logic Home”: The Government Shutdown Crowd Has A New Target, John Boehner
The long knives are out for John Boehner on the right – again. National Journal’s Tim Alberta has a must-read today on a conservative plot to oust the House speaker next year … or put the squeeze on House Majority Leader Eric Cantor … or something.
According to Alberta, the frustrated right numbers in the “several dozen,” with the ringleaders all hailing from the House Liberty Caucus, from which came the core of the dozen GOP’ers who voted against Boehner for speaker last year. Alberta writes:
The conservatives’ exasperation with leadership is well known. And now, in discreet dinners at the Capitol Hill Club and in winding, hypothetical-laced email chains, they’re trying to figure out what to do about it. Some say it’s enough to coalesce behind — and start whipping votes for — a single conservative leadership candidate. Others want to cut a deal with Majority Leader Eric Cantor: We’ll back you for speaker if you promise to bring aboard a conservative lieutenant.
But there’s a more audacious option on the table, according to conservatives involved in the deliberations. They say between 40 and 50 members have already committed verbally to electing a new speaker. If those numbers hold, organizers say, they could force Boehner to step aside as speaker in late November, when the incoming GOP conference meets for the first time, by showing him that he won’t have the votes to be reelected in January.
They’re not gunning for Boehner alone. They’re pissed at Eric Cantor because he moved the Medicare “doc fix” through on a voice vote a few weeks back, a move which had the pragmatic virtue of passing needed legislation without forcing members to go on the record casting a vote which could have proved potentially troublesome in a primary. In short, Alberta writes, “conservatives find fault with the entire leadership team.”
So what’s the plan? They haven’t found someone to run against Boehner yet (conservatives like Texas Rep. Jeb Hensarling and Ohio Rep. Steve Scalise aren’t interested, Alberta reports) and while “privately they define success as vaulting one of their own into any of the top three leadership spots,” they also tell Alberta that scenarios like Republican Study Committee Chairman Steve Scalise running for whip – which is, you know, one of the top three leadership spots – “would hardly qualify as the splash conservatives are determined to make.”
In short conservatives are all riled up and determined to make a splash; they’re eyeing a nuclear option – blocking Boehner from another term as speaker – but don’t have a clear end-game beyond that. But they’re pretty sure one will materialize when their opponents inevitably fold in the face of their show of will. They’re definitely going to make a splash because they’re really, really determined.
Does any of this sound familiar? It should – it’s the government shutdown logic transferred to the Republican civil war. The right wound itself up about Obamacare and then shuttered the government without a clear plan other than that Obama was going to inevitably fold in the face of their Keyzer Soze-like superior show of will. However it turned out, they were going to get something big out of the whole affair because they’d tried really, really hard. (“I don’t think our conference will be amenable for settling for a colletion of things after we’ve fought so hard,” New Jersey GOP Rep. Scott Garrett said at the time.) How’d all that turn out?
The tea party right’s problem here is that they echo chamber themselves into badly overestimating their leverage and end up with little more than egg on their collective faces. See the paltry dozen votes they managed against Boehner last time, for example, or the outcome of the government shutdown.
We’ll see. Maybe the wingers really will be able to produce 50 anti-Boehner votes and shut down the House. Or maybe they’re basting too long in their own tough and angry talk. Again.

“Lacking The Will, Not The Votes”: Yet Another Year Of A Do-Nothing Republican Congress
Election Day 2014 is 258 days away, which in political terms, is an extraordinarily long time. In theory, in 258 days, policymakers in Washington could identify several national priorities, consider worthwhile legislation, and pass meaningful bills into law.
But Robert Costa makes clear in a new report that for House Republicans, the year that is just now getting underway is already effectively over. Three weeks after President Obama presented a fairly ambitious agenda to Congress in a State of the Union address, the GOP House majority fully expects to get nothing done between now and November.
After a tumultuous week of party infighting and leadership stumbles, congressional Republicans are focused on calming their divided ranks in the months ahead, mostly by touting proposals that have wide backing within the GOP and shelving any big-ticket legislation for the rest of the year.
Comprehensive immigration reform, tax reform, tweaks to the federal health-care law – bipartisan deals on each are probably dead in the water for the rest of this Congress.
“We don’t have 218 votes in the House for the big issues, so what else are we going to do?” said Rep. Devin Nunes (Calif.), an ally of House Speaker John A. Boehner (Ohio).
I feel like this assumption – legislating simply isn’t feasible because major bills can’t get 218 votes in the lower chamber – comes up quite a bit. Note that Boehner recently told Jay Leno, “I like to describe my job as trying to get 218 frogs in a wheelbarrow long enough to pass a bill. It’s hard to do.”
Except, it’s not that hard to do.
What we’re hearing isn’t an explanation for inaction and passive indifference towards governing, but rather, an excuse. GOP leaders look at their to-do list and wistfully imagine how nice it would be to tackle priorities like immigration and tax reform, but they quickly do imaginary head-counts and throw up their arms in disgust. As Nunes put it, “We don’t have 218 votes in the House for the big issues, so what else are we going to do?”
It doesn’t have to be this way.
If House Republican leaders brought the popular, bipartisan immigration reform bill to the floor, it’d likely get 218 votes. If they brought the Employment Non-Discrimination Act to the floor, it’d have a decent shot at 218, too. The same goes for a minimum-wage increase and a variety of other measures that the public would be glad to see.
The missing ingredient isn’t votes. It’s political will.
It’s precisely why House Democrats are increasingly invested in discharge petitions – if only a sliver of House Republicans agreed to help bring popular bills to the floor for an up-or-down vote, Dems believe Congress can do more than spin its wheels for the next 258 days.
It is, to be sure, a longshot, and discharge petitions very rarely work. But the alternative is yet another year of a do-nothing Congress.
Postscript: Costa’s piece also quoted former Rep. Vin Weber (R-Minn.), who said, “If you’re a Republican in Congress, you’ve learned that when we shut down the government, we lose. Now that we’ve had some success in avoiding another shutdown, our fortunes seem to be rising, so maybe we don’t want big things to happen.”
That’s quite an inspiring message: “Vote GOP 2014: We only shut down the government once, not twice.”
