“A Government That Can’t Govern”: What Happens When One Party Is Perfectly Happy To Stay In The Minority
Over the weekend, our friend Jonathan Bernstein wrote an interesting post discussing the point, not uncommon on the left but nonetheless true, that the problem with our politics today isn’t “polarization” or “Washington” but the Republican Party. His argument is basically that the GOP is caught in a series of overlapping vicious cycles that not only make governing impossible for everyone, but become extraordinarily difficult to break out of. As the base grows more extreme, it demands more ideological purity from primary candidates, leading to more ideological officeholders for whom obstruction of governance is an end in itself, marginalizing moderates and leaving no one with clout in the party to argue for a more sensible course, and in each subsequent election those demanding more and more purity become the loudest voices, and on and on. John Hunstman would probably tell you that he would have had a better chance of beating Barack Obama than Mitt Romney (who spent so much time pandering to the right) did, but nobody in the GOP cares what John Huntsman thinks.
There’s one point Bernstein makes that shows just how serious this situation is: “Perhaps the biggest cause is the perverse incentives created by the conservative marketplace. Simply put, a large portion of the party, including the GOP-aligned partisan press and even many politicians, profit from having Democrats in office. Typically, democracies ‘work’ in part because political parties have strong incentives to hold office, which causes them once they win to try hard to enact public policy that keeps people satisfied with their government. That appears to be undermined for today’s Republicans.” It’s often noted that some people on each side benefit when the other side is in power. For instance, magazines like this one. When there’s a Republican in the White House, liberal magazines tend to get more subscribers, as liberals get angry at the President and become more interested in reading about everything he’s doing wrong. The same is true of conservative magazines when there’s a Democratic president. The boosting of certain people’s fortunes when the other side is in power stretches through ideological media to some political figures. For instance, Dennis Kucinich became a national figure not long after September 11 when he started giving speeches criticizing the War on Terror, tapping into the frustration many people on the left felt.
So George W. Bush was very good for Dennis Kucinich, and you’ll notice that once Barack Obama was elected, Kucinich faded from view. But Kucinich never had the ability to push the Democratic party along a particular path. The people on the right who benefit from being out of power, on the other hand, are much more influential within the party. And today, there are many people within the GOP who like the current situation pretty well. It isn’t that they have no governing agenda that they’d implement if given the chance, but just obstructing the Democratic agenda is going quite well for them. Rush Limbaugh and Rand Paul and even Mitch McConnell are perfectly happy with how things are going for them right now. The basic urge to get power runs up against all the incentives now built into the GOP that make getting power more difficult. Officeholders could change their tune a bit and make the Republican party more popular, but they’re not going to do it if it means they’re more likely to get booted in a primary.
So we could find ourselves endlessly trapped in the situation we’re in now. Democrats keep winning presidential elections because the Republican Party is repellent to a majority of Americans. The geographic distribution of the American population nevertheless makes it possible for Republicans to hold on to the House, and at least control enough of the Senate to grind things to a halt by filibustering everything (and Democrats are too frightened to change the filibuster rules). With the exception of the occasional bill here and there that Republicans get intimidated into letting go through, governing pretty much ceases, with the exception of whatever the President can accomplish via regulation and executive agency actions (those agencies that the Republicans don’t manage to hamstring, that is). And there you have it: a government that can’t govern.

“More Than A Mere Label”: A Victory Against The Language Of Bigotry
As one of the world’s largest news outlets, the Associated Press’s linguistic mandates significantly shape the broader vernacular. So when the organization this week decided to stop using the term “illegal immigrant,” it was a big victory for objectivity and against the propagandistic language of bigotry.
Cautious AP executives did not frame it exactly that way. Instead, editor Kathleen Carroll portrayed the decision as one in defense of grammar, saying that the term “illegal” properly “describe(s) only an action” and that it is not an appropriate label to describe a human being.
“Illegal,” of course, has been used as more than a mere label — it has for years been used as an outright epithet by xenophobes. They abhor the notion of America becoming more diverse — and specifically, more non-white — and so they have tried to convert “illegal” into a word that specifically dehumanizes Latinos. Thus, as any honest person can admit, when Republican politicians and media blowhards decry “illegals,” they are pretending to be for a race-blind enforcement of immigration laws, but they are really signaling their hatred of Latino culture.
How can we be so sure that dog-whistle bigotry is the intent? It’s simple, really. Just listen to who is — and who is not — being called an “illegal.”
Almost nobody is uses the term to attack white immigrants from Europe or Canada who overstay their visas. Nobody uses the term to describe white people who break all sorts of criminal laws. Indeed, nobody called Louisiana Republican Sen. David Vitter an “illegal” upon revelations about his connection to a prostitution service, nor did anyone call Bernie Madoff an “illegal” for his Ponzi schemes.
Instead, the word is exclusively used to denigrate Latinos who entered the country without authorization. Coincidence? Hardly — especially because the term “illegal” is used to describe Latinos whose immigration status is not even a criminal matter.
Yes, as New Jersey Gov. Chris Christie noted back in 2008, though “the whole phrase of ‘illegal immigrant’ connotes that the person, by just being here, is committing a crime,” in fact “being in this country without proper documentation is not a crime.”
If Christie runs for president in 2016, he will likely get flak for that comment from anti-immigrant Republicans. But he was 100 percent correct.
“‘Illegal presence’ as the offense is called, is not a violation of the U.S. criminal code,” notes the Newark Star-Ledger, adding that while it is “a violation of civil immigration laws (and) the federal government can impose civil penalties” a person “cannot be sent to prison for being here without authorization from immigration authorities.”
Recognizing these facts is not to condone unauthorized entry into the United States. But it is to note a telling discrepancy: Latinos with non-criminal immigration status are called “illegals” but white people committing decidedly criminal acts are not called the same. Worse, the term is used so often and in such blanket fashion against Latinos that it ends up implying a description of all people of Hispanic heritage, regardless of their immigration status.
What’s amazing is that Republican media voices, which so often invoke such incendiary language, simultaneously wonder why the Republican Party is failing to win the votes of people of color and consequently losing so many elections. Somehow, the GOP doesn’t understand what the Associated Press realized: Organizations — whether political parties, media outlets or businesses – can no longer expect to insult and slander people of color and still have a viable audience.
Those that do not realize that truth will inevitably find themselves as lonely and as marginalized as today’s GOP.

“The GOP Trickle Down Effect”: Sequestration Takes A Toll On Cancer And Medicare Patients
A funny thing happened on Rush Limbaugh’s radio show yesterday. The Republican host was complaining about a Washington Post report on sequestration cuts hurting cancer patients in the Medicare program, and told his listeners to ignore the news. “All of this is manufactured and made up,” Limbaugh said. How does he know? Because the sequester didn’t include “any cuts in Medicare,” he added.
And then Limbaugh got a call from a conservative oncologist — in this case, a physician who apparently shares the host’s worldview and has no use for the Washington Post — who conceded that the report is, in fact, accurate, forcing Limbaugh to change the subject.
Sequestration cuts are affecting Medicare — though not as much as some other programs — and as Sarah Kliff explained, cancer clinics really are turning away thousands of patients as a result of the Republican spending cuts.
Oncologists say the reduced funding, which took effect for Medicare on April 1, makes it impossible to administer expensive chemotherapy drugs while staying afloat financially.
Patients at these clinics would need to seek treatment elsewhere, such as at hospitals that might not have the capacity to accommodate them.
Kliff talked to one Long Island oncologist who said he and his staff held an emergency meeting earlier this week and decided they would no longer see one-third of their 16,000 Medicare patients. “It’s a choice between seeing these patients and staying in business,” Jeff Vacirca, chief executive of North Shore Hematology Oncology Associates said.
But if Medicare was supposed to be shielded from the sequestration policy, how is this happening? It has to do with how medical offices are reimbursed for medications that need to be administered by a physician — such as those given to cancer patients.
The New York Daily News reported today:
The so-called sequester cuts will force three-quarters of the thousands of cancer clinics nationwide to start referring Medicare patients to hospitals, according to the American Society of Clinical Oncology and other cancer treatment groups, which have appealed to the White House and Congress for help.
Elderly cancer patients are being hit hard because their drugs are among the handful of pharmaceuticals that were affected by the sequester cuts.
Medicare reimbursed oncologists for the cost of chemo drugs, plus 6%. But under the sequester, the federal government is now providing only 4% on top of the drugs’ cost, which can run $900 to $15,000 for a full course, depending on the cancer.
That 2% difference may not sound like much, but given the costs involved, it’s an enormous pay cut for the cancer clinics, which some are now saying is a prohibitive new expense they can’t afford.
Ted Okon, director of the Community Oncology Alliance, told Kliff, “If you get cut on the service side, you can either absorb it or make do with fewer nurses. This is a drug that we’re purchasing. The costs don’t change and you can’t do without it. There isn’t really wiggle room.”
Note, this doesn’t mean the sequester is necessarily cutting off cancer patients, but rather, it means these patients are being told by their local oncology clinics that they’ll have to seek care at hospitals — where the care will be less efficient and more expensive.
In case anyone’s forgotten, it’s within Congress’ power to simply turn the sequester off. The whole thing could take five minutes. But for now, congressional Republicans have ruled out the possibility of turning it off, and have also ruled out the possibility of a compromise to replace these brutal spending cuts.
With each passing day, we learn of increasingly drastic consequences associated with the policy.

“Exposing Republican Intransigence”: John Boehner Rejects Obama’s Offer To Cut Social Security
House Speaker John Boehner (R-OH) preemptively rejected President Barack Obama’s upcoming budget proposal Friday, slamming the president’s offer to cut Social Security as “only modest entitlement savings.”
President Obama’s budget plan, which he will send to Capitol Hill on Wednesday, will reportedly seek $1.8 trillion in deficit reduction through a combination of new revenues and spending cuts. The most controversial cut is the move to the chained consumer price index (“chained CPI”) for Social Security, which would significantly reduce annual cost-of-living adjustments for Social Security beneficiaries. President Obama has long suggested that he could support the measure, which would cut federal spending by about $130 billion over the next decade, only if Republicans agree to raise new tax revenues.
To many of the president’s liberal allies, such a proposal has been a non-starter. When he floated the idea in late 2012, many House Democrats warned that they would rather go over the “fiscal cliff” than accept the cut. Similarly, in an exclusive interview with The National Memo in March, AFL-CIO president Richard Trumka vowed that America’s largest labor federation would oppose any budget deal that included chained CPI, saying the index is “another example of how Washington creates fancy-sounding phrases to mask stupid policies that only work for the rich.”
The public seems to stand with Trumka; recent polling suggests that Americans strongly oppose any Social Security cuts.
The budget reportedly includes several other cuts, such as $400 billion in health care savings (including additional means-testing for Medicare,) and $200 billion in cuts to farm subsidies, federal employee retirement programs, and unemployment compensation. Obama’s budget also aims to raise $600 billion in new revenues, including an increased cigarette tax, which would be used to finance the president’s proposal for universal pre-K.
“While this is not the president’s ideal deficit-reduction plan, and there are particular proposals in this plan like the CPI change that were key Republican requests and not the president’s preferred approach, this is a compromise proposal built on common ground, and the president felt it was important to make it clear that the offer still stands,” a senior Obama administration official told The Hill.
Obama’s offer to meet in the middle has already failed to move House Republicans, however. Not waiting for the full proposal to be released, House Speaker John Boehner quickly released a statement Friday blasting Obama’s plan.
“Despite talk about so-called balance, the president’s last offer was significantly skewed in favor of higher taxes and included only modest entitlement savings,” Boehner said. “In the end, the president got his tax hikes on the wealthy with no corresponding spending cuts. At some point we need to solve our spending problem, and what the president has offered would leave us with a budget that never balances.”
“If the president believes these modest entitlement savings are needed to help shore up these programs, there’s no reason they should be held hostage for more tax hikes,” Boehner added.
Although Boehner’s statement still completely ignores the $2.5 trillion in deficit reductions to which the White House has agreed since 2010, it does at least acknowledge that Obama is offering “entitlement savings” — even if Boehner rejects the compromise out of hand. This is a modest step in the right direction, considering that until this budget, Republicans have consistently denied that Obama has offered them anything at all.
In the end, that subtle shift may end up as the most significant result of Obama’s budget deal. Although the proposal has no real chance of becoming law — as evidenced by Boehner’s immediate rejection — making a highly publicized compromise offer will further expose the Republicans’ intransigence.
In March, President Obama reportedly offered congressional Republicans a choice: accept a deal that raised revenue in exchange for chained CPI and means-testing of Medicare, or walk away with no budget deal at all. In April, it appears that Boehner has made his decision.

“Remembering The Affair To Remember”: In New Bipartisan Spirit, Have Members Of Congress Tell Each Other About Their Affairs
It’s kind of nice to have Mark Sanford back.
Perhaps not if you’re from South Carolina. It is my strong impression that many South Carolinians are tired of their former governor, who so famously snuck off to Argentina for some extramarital recreation while his aides claimed he was camping on a national hiking path. A resident of Columbia, the state capital, told me that he had been in Peru, on a train to the legendary ruins of Machu Picchu, when a local resident asked him where he hailed from.
At the mention of the words “South Carolina,” the Peruvian nodded happily. “Appalachian Trail!” he cried.
After skulking around in political exile for several years, Sanford staged a sort of a comeback on Tuesday, winning the Republican nomination for his old House seat. It was a triumph of sorts, although one that only required defeating a former county legislator who did not live in the district, in a race that attracted the excited participation of about 10 percent of eligible citizens.
At his victory party, Sanford said the campaign had been “an amazing journey.” Since the great disaster of 2009, Sanford has taken to mentioning “this journey called life” rather frequently. Perhaps, in a perfect world, a guy who got in trouble for jetting off to assignations on the taxpayers’ dime would not focus quite so much on travel metaphors.
Sanford will now run against Democrat Elizabeth Colbert Busch, a local businesswoman and sister of the comedian Stephen Colbert. She seems to be planning a deeply noncomedic campaign. But, still, hosting this race would be way more fun than being in Texas, wondering whether Rick Perry is going to run for a fourth — or is it fifth? — term.
Or in Tennessee, where lawmakers have just introduced bills to eliminate U.S. Senate primaries and let the state legislators pick the nominees. These new decision-makers would presumably include the members who recently expressed concern that the mop sink in a newly renovated Capitol men’s lavatory might actually be a special foot-washing facility for Muslims.
Or New York City, where a Democratic state senator has just been indicted on a charge of trying to bribe his way into the Republican nomination for mayor. Through the alleged services of a Republican city councilman, who has represented himself as a member of both the Tea Party and a tribe of Theodish pagans, making him what The Village Voice called “the first openly elected heathen in the nation.”
O.K., the heathen part was pretty good. However, dwelling on this story will only cause New Yorkers to revisit the fact that three of the last four full-time majority leaders of the New York State Senate have wound up under felony indictment.
I’d rather keep track of Mark Sanford’s evolution. So far, his spin strategy has been all about empathy and forgiveness. (“It’s only really in our brokenness that we really begin to understand each other.”) By the end of the primary, you had the impression that the key to a new bipartisan spirit in Washington would be having all the members of Congress tell each other about their affairs.
“There are too many people in politics who think that they know it all. And I think that they project this whole image of perfection,” he told Jake Tapper on CNN.
Not a problem here.
Since we last had Sanford to kick around, he’s been divorced and gotten engaged to the Argentinian squeeze. He virtually never mentions her and she barely got a shout-out on primary victory night. (“She completely surprised me,” claimed Sanford, who told Tapper that he just turned the corner on his way into the ballroom and there she was.)
His ex-wife, Jenny, has written a book about her marriage, and now South Carolinians know that Sanford is not just fiscally conservative; he’s also so personally cheap that he once gave his spouse a $25 used bicycle as a combined birthday-Christmas present. Also, there’s the revelation that he excused some of his mysterious absences from home by saying he needed to go off and relieve the stress he felt due to thinning hair.
Sanford has always had a terrible case of chronic self-absorption. Now that he’s talking about his feelings so much, it’s turned into a creepy New Age egomania. It began with his post-Appalachian-Trail press conference, when he rambled on and on about his love life as if the assembled reporters were best pals who’d invited him out for a drink. (“It was interesting how this thing has gone down. …”) More recently, according to New York magazine, he went to visit Jenny, who used to run his campaigns, and asked his still deeply estranged ex-spouse if she’d do another. “I could pay you this time,” he added empathetically.
Her refusal was probably a surprise. Like the victory night fiancée.
