“Darrell Issa, GOP’s Resident Thug”: Contempt For Congressman Elijah Cummings, Contempt For The American People

The farce that is Rep. Darrell Issa continues. He put on an amazing spectacle shutting down the ranking member of the House Oversight Committee, Elijah Cummings, on Wednesday, repeatedly cutting off Cummings’ microphone and, finally, turning his back and walking away. I especially loved Issa’s little gesture pulling his finger across his throat like a knife, to cut the mic a second time. I called it “thuggish” on “Politics Nation” and folks on the right aren’t happy. That’s OK; it was thuggish.

Issa had once again called former IRS supervisor Lois Lerner to testify before the committee, knowing she was going to again use her Fifth Amendment right against self-incrimination. But what Issa didn’t reveal is that Lerner’s attorney had offered last month to share her answers to the committee’s questions via what’s called a “proffer.” That’s when the subject of an investigation reveals the rough outlines of what they know, which can also help determine whether they deserve immunity from prosecution (in order to get them to share more). But Issa rejected the proffer and staged a show trial designed to have Lerner take the Fifth again, in front of television cameras and a packed hearing room.

Cummings asked for time to make a statement, once Issa announced himself satisfied that Lerner wouldn’t testify Wednesday and tried to adjourn. That’s when Issa cut his mic.

“We’re adjourned. Close it down,” Issa said.

“I am a member of the Congress of the United States of America. I am tired of this!” Cummings replied, though his mic was off. “You cannot just have a one-sided investigation. There is something absolutely wrong with that. It is absolutely un-American … Chairman, what are you hiding?”

On “Politics Nation” Wednesday committee member Rep. Eleanor Holmes Norton explained Cummings was going to ask about Lerner’s attorney’s proffer, and that was why Issa shut him down. Issa was trying to “keep us from revealing that we could have learned exactly what [Lerner] would have said,” Norton explained. Cummings’ office confirmed her account.

So why would Issa reject that proffer if he was committed to learning the truth about the IRS “scandal”? Because from the beginning he’s known it wasn’t a scandal. From the beginning Issa has selectively leaked testimony and other evidence from his committee’s investigation to Fox News – which he treats as a fourth arm of government — consistently distorting the facts.

We now know that IRS staffers, overwhelmed by post-Citizens United political activism, used certain terms to screen groups on the right and the left to make sure they deserved tax-exempt status. Groups with “Tea Party” or “Patriots” in their names, as well as “Occupy” or “Blue,” were flagged for special scrutiny. So far the only known group to lose its tax exemption was a Democratic group, Emerge America, which works to elect Democratic women to public office.

But over and over again, Issa has leaked one-sided testimony designed to show a bias against conservatives. Over and over Cummings has asked him to make public all of the testimony and evidence gathered by their committee, only to have Issa refuse. A few times Cummings has himself released testimony, including that of a self-identified “conservative Republican” manager of an IRS screening group who said no one from the Obama administration had anything to do with the selection of Tea Party groups for scrutiny.

Issa showed remarkable contempt for Cummings on Wednesday, but he also showed contempt for the American people. Issa’s investigation has cost at least $14 million, and eaten up 97,542 hours of IRS staffers’ time. The agency has coughed up more than 500,000 pages of documents; 35 former and current IRS employees have sat for interviews. Treasury and IRS officials have testified at 15 separate congressional hearings. After all of that, a leader who wanted the truth would have listened to what Lerner had to say through her attorney. That’s not what Issa’s after. He’s trying to shame the White House, and Cummings makes a great stand-in.

“50th Time Is The Charm”: For House Republicans, The Affordable Care Act Is Not About Policy And Governing Isn’t Their Goal

Last week, after House Republicans announced an upcoming vote on undermining the Affordable Care Act, President Obama took some time to mock GOP lawmakers for their pointless hobby. “You know what they say: 50th time is the charm,” he joked at a DNC event. “Maybe when you hit your 50th repeal vote, you will win a prize. Maybe if you buy 50 repeal votes, you get one free. We get it. We understand. We get you don’t like it. I got it.”

But by all appearances, Republicans aren’t concerned about mockery. They’re proceeding today with their plan to go after the ACA’s individual mandate – again. By most counts, it will be the 50th time House Republicans have voted to gut some or all of the health care law since 2011, even though they fully realize their bill has no chance of being signed into law.

The House is set to vote Wednesday on a bill by Rep. Lynn Jenkins (R-KS) to effectively delay the individual mandate for one year by reducing the penalty in 2014 for not buying insurance from $95 to $0.

The Republican-led chamber passed a similar bill last July, capturing 22 Democratic votes. Now that it’s an election year, it’s plausible that a significant number of Democrats will defect, given the unpopularity of the individual mandate and the likelihood that Senate Democrats will throw the bill in the garbage once it arrives.

House Republicans are under no illusions about the legislation’s prospects, but governing isn’t the goal. This is about an election-year stunt intended to help GOP lawmakers feel better, maybe motivate the base a bit, and create the basis for some new attack ads against Democrats.

Whether or not one approves of this waste of time, it remains a ridiculous display.

For one thing, the effort itself would be a substantive disaster if the bill actually became law. Clearly the GOP is in its post-policy phase, so real-world implications are no longer considered before bills receive votes, but the Center on Budget and Policy Priorities published an analysis yesterday and found that the House’s proposal would increase the number of Americans without insurance and lead to higher health care premiums in the individual market. How do Republican leaders respond to revelations like these? They don’t – this isn’t about policy, so the implications are deemed irrelevant.

For another, this is quite a bit of effort over a policy Republicans supported up until a few years ago – the mandate used to be a key feature of GOP health care plans.

House Republicans could be using their time wisely right now. Maybe they could work on real legislation; maybe they could present their “Obamacare” alternative they’ve been promising for years.

But that just doesn’t seem to interest them. Americans are instead stuck watching their House of Representatives spin its wheels, picking up self-satisfying “message” bills.

“Warmed Over Reaganism”: Paul Ryan’s Poverty Trap; Stop Taking These Lame Makeovers Seriously!

McKay Coppins already told us that there’s a new Paul Ryan who really cares about poverty and the poor. Now Robert Costa has the details on the newest new Paul Ryan, who just released a report on poverty that is 204 pages long, which proves that he really cares about the poor, because when was the last time a Republican wrote that many words and sentences about them?

Last seen handing out neckties to poor kids, Ryan is now talking up his report, “The War on Poverty: 50 Years Later,” which enumerates roughly 100 federal anti-poverty programs that Ryan tells Costa “have actually created a poverty trap.”

Now, Ryan’s plan does one positive thing: It makes Sen. Marco Rubio look kind of lazy and insincere. Because Rubio gave a much-heralded speech on the anniversary of Lyndon Johnson’s declaring a War on Poverty, but it was only a few thousand words, it wasn’t 204 pages, and since then, he basically dropped the issue. Ryan says his report will provide the basis of his next budget. But the basic Ryan-Rubio message is the same warmed-over Reaganism: We fought a war on poverty and poverty won, so let’s give up.

But seriously, how many times are we going to be told that there’s a “new” Paul Ryan who really, really, really cares about the poor – and whose budget proposals consistently slash programs designed to help them. All that’s different about Ryan’s approach now is he’s telling the poor that cutting their programs is good for them, because it will free them from “the poverty trap.”

Also, how many generations of Republicans are going to rely on Bob Woodson’s self-promotion? Like Coppins, Costa tells us Ryan is looking to Woodson’s Center for Neighborhood Enterprise for new ideas about fighting poverty. But it’s been generations now that Woodson has been reassuring Republicans, with zero evidence, that unfettered capitalism can heal the inner city. Can’t they even trouble themselves to find a new Bob Woodson?

In fact, Think Progress found that buried in Ryan’s report, beneath the dark warnings about a “poverty trap,” are findings that actually, even by GOP standards, a lot of anti-poverty programs are doing a lot of good. From the Veterans’ Health Administration to the Earned Income Tax Credit, Ryan’s report identifies at least 16 major programs that in fact help the poor and are a good bet for government. You wonder whether he even read his own report.

And in several of the areas where Ryan found fault with programs, the Fiscal Times found that the economists behind the studies Ryan cited say he misrepresented their data.

To be fair, Ryan actually makes three good points. One, he supports the once-bipartisan, now-GOP-questioned Earned Income Tax Credit, which helps low-wage families out of poverty (but even better would be if he called for a major expansion). The EITC is actually a huge part of the story behind the “47 percent” Ryan’s running mate Mitt Romney slurred in 2012. Ryan doesn’t acknowledge the dissonance, but his EITC support is welcome.

Ryan’s second fair point is that federal anti-poverty programs are a sketchy patchwork of mostly uncoordinated initiatives that would certainly work better if anyone put time into pulling them together. But Ryan merely criticizes that patchwork in order to rip it apart, proposing to slash rather than coordinate the services that help poor people, admittedly inadequately.

The third is more complicated, and if taken seriously, subverts Ryan’s entire message. He complains, correctly, that too many anti-poverty programs are “means-tested — meaning that benefits decline as recipients make more money — [so] poor families face very high implicit marginal tax rates. The federal government effectively discourages them from making more money.”

Of course, the alternative to means-tested programs in other industrialized nations is universal programs that essentially set a floor for income, nutrition and health below which families can’t drop. Social Security and Medicare are rare American examples of universal program – ones that Ryan has repeatedly tried to gut (while most Republicans and even some conservative Democrats endorse “means testing” them). A guaranteed family income and a genuine national health insurance program could eliminate means-tested programs like Temporary Assistance for Needy Families and Medicaid – but Ryan and his GOP allies (and lots of Republicans) would never consider those notions.

Nor will they consider the other guaranteed anti-poverty program: a hike in the minimum wage. Raising the minimum wage to $10.10 an hour would lift almost a million Americans out of poverty immediately – but Ryan’s party is opposed to it. Indeed, more Republicans are coming out every day saying there should be no minimum wage at all.

There is, indeed, a poverty trap in the U.S., and the media fall into it again and again: taking seriously the warmed over Reaganism of conservatives like Paul Ryan, and pretending there’s something in it that will help the poor.

“Rallying Around The Wrong President”: Blinded By Hatred, Republicans Just Can’t Seem To Make Up Their Minds

I’ve been fascinated of late by Republican praise of Russian President Vladimir Putin, but as Rachel noted on the show last night, Rudy Giuliani appears to have taken this affection to a new level. For those who can’t watch clips online, here’s the former mayor talking to Fox’s Neil Cavuto yesterday.

GIULIANI: Putin decides what he wants to do and he does it in half a day, right? He decided he had to go to their parliament. He went to their parliament. He got permission in 15 minutes.

 CAVUTO: Well, that was kind of like perfunctory.

 GIULIANI: But he makes a decision and he executes it, quickly. Then everybody reacts. That’s what you call a leader. President Obama, he’s got to think about it. He’s got to go over it again. He’s got to talk to more people about it.

It’s not unusual, during a time of crisis, for Americans to rally behind a president. In Giuliani’s case, the trouble is the New York Republican appears to be rallying behind the wrong president.

That said, it’s nevertheless important to appreciate the fact that, in Giuliani’s mind, the mark of an effective leader is seen in someone who acts unilaterally, invades a country, and doesn’t stop to think too much about it. Real leaders, the argument goes, simply act – then watch as “everybody reacts.”

But here’s the follow-up question for Giuliani and other conservatives swooning over Putin: if President Obama did act that way, wouldn’t you be calling him a lawless, out-of-control tyrant?

We’ve talked many times about the underlying contradictions embraced by Obama’s detractors. The president’s critics have presented two competing caricatures, both of which are wrong, but more importantly, both of which are incongruous.

Dana Milbank picked up on the theme today.

President Obama is such a weak strongman. What’s more, he is a feeble dictator and a timid tyrant.

That, at any rate, is Republicans’ critique of him. With Russia’s invasion of Ukraine, Obama’s critics pivoted seamlessly from complaining about his overreach to fretting that he is being too cautious. Call it Operation Oxymoron.

Last Wednesday, I sat in a House hearing and listened to Republicans describe Obama exercising “unparalleled use of executive power” and operating an “uber-presidency.” They accused him of acting like a “king” and a “monarch,” of making the United States like a “dictatorship” or a “totalitarian government” by exercising “imperial” and “magisterial power.”

But after events in Ukraine, this very tyrant was said to be so weak that it’s “shocking.”

Once again, the right is going to have to pick a caricature and go with it. Obama can be a power-hungry dictator, ruthlessly wielding power, or he can be a weak pushover, afraid to act. He can’t be both.

For that matter, Republicans can long for an authoritarian leader, who acts without thinking or regard for consensus, or they can embrace a more deliberative style of leadership that cares about partnerships and checks and balances.

At this point, the right can’t seem to make up its mind.

“Scott Walker’s Little-Known Scandal”: When He Treated Welfare Recipients Like Dogs

Among the racist jokes and emails found in recently released documents connected to the criminal probe of Gov. Scott Walker’s 2010 campaign, one stood out: A “joke” about a woman trying to sign up her dogs for welfare, because “my Dogs are mixed in color, unemployed, lazy, can’t speak English and have no frigging clue who their Daddys are. They expect me to feed them, provide them with housing and medical care, and feel guilty.” The punch line: “My Dogs get their first checks Friday.”

Walker’s deputy chief of staff Kelly Rindfleisch replied: “That is hilarious. And so true.”

The joke is bad enough on its own, but it’s also worth noting: Back when Walker was Milwaukee county executive, and Rindfleisch was a top aide, he managed the county’s welfare programs so abysmally that after lawsuits by local clients, the state was forced to take them over. “They didn’t just call people dogs, they treated them like dogs,” one Milwaukee elected official recalled angrily.

“Milwaukee County has demonstrated a sustained inability to successfully provide services to its (poor) customers,” state health services director Karen Timberlake wrote in a February 2009 letter to Walker announcing the state takeover. Milwaukee became only one of 72 Wisconsin counties to wind up with its programs for poor people under state control.

It’s a chapter in Walker’s career that shows why, to many in Milwaukee, his staff’s racist jokes aren’t funny.

At the height of the recession, in 2008 and 2009, requests for aid in Wisconsin, and throughout the country, soared. But in Milwaukee, where 41 percent of African-Americans live below the poverty line, people had trouble getting help. Roughly 95 percent of calls to the county’s client-intake call center went unanswered in 2008, a state probe later found.

The social services department budget funded 25 positions at the intake center, but a Milwaukee Journal-Sentinel reporter found only seven staffers working among empty cubicles when he visited. Advocates and the county workers’ union complained, but Walker stonewalled. Aided by the outcry, Walker began arguing for privatizing the social services intake unit. “He was managing it to fail,” charges AFSCME contract administrator Dave Eisner.

In June 2008, Legal Action of Wisconsin sued on behalf of thousands of needy people who couldn’t get benefits even though they qualified, because they couldn’t get their eligibility verified.

“Milwaukee County has reached a low point in its [welfare] delivery service,” Legal Action lawyer Pat DeLessio wrote in a letter to the County Board. “It is almost impossible to get through to anyone on the phone” to apply for or verify benefits.

But the problems weren’t just at the call center. In 2008, one out of five food stamp recipients dropped for ineligibility were in fact eligible, and wrongly cut from the program. In 2007, 60 percent of county decisions to cut food or other aid were overturned on appeal within two months. Roughly 30 percent of needy applicants were waiting more than two weeks for aid. Two-thirds of all complaints received by state welfare agencies involved Milwaukee County residents having problems obtaining Medicaid, food aid and child care services. And while the state paid a higher share of Milwaukee’s income-maintenance program costs than in other counties, Walker complained that state funding was inadequate.

With the call center problems and need rising, clients took to lining up at county offices for services before they even opened, DeLessio recalled, because by midday workers would declare the building was full, and turn away new applicants. In June 2008 at least 3,000 people showed up before dawn seeking food vouchers in what was later called a “food riot.”

“The food crisis in Milwaukee and throughout the United States is worse than many of us have realized,” said Milwaukee Common Council president Willie Hines. “We expect long lines for free food in third-world countries.”

Walker’s answer was to privatize the intake unit and other services. His proposed September 2008 budget featured his privatization proposals, but the county board blocked him. “It was clearly a game – he didn’t give a damn about poor people,” Eisner charges.

State officials repeatedly complained about the service inadequacies, and eventually threatened to take the programs away from the county. Politics clearly played a role in the conflict; in 2006 Walker had planned to run for governor against incumbent Democrat Jim Doyle, but soon dropped out of the Republican primary. “I believe that it was God’s will for me to run,” Walker said at the time. “After a great deal of prayer during the last week, it is clear that it is God’s will for me to step out of the race.” It was an open secret that Walker was planning another run for governor in 2010, and if his skirmishes with the Doyle administration hurt Milwaukee’s poor, they helped its county executive with the state’s conservative GOP primary voters.

After a series of tense meetings between county and state administrators, when it was clear the state was going to take over the anti-poverty programs, Walker made a brazen move. He wrote to state social services director Karen Timberlake and invited the state to take over the county’s income maintenance program.

“This is a state mandate,” Walker wrote, in a letter he immediately released to the media. “It’s amazing state government has been such a lousy partner on this.”

County board chair Lee Holloway told the Milwaukee Journal-Sentinel that Walker invited the state in, over his and the board-majority’s objection, to preempt the state’s embarrassing announcement that it was taking over Milwaukee’s programs. “Holloway said he thought Walker’s letter was meant to upstage state officials ‘before they make a move on him,’” the paper reported.

“The county board didn’t want the takeover,” recalls Legal Action’s Pat DeLessio. “There’s a strong system of county control in Wisconsin. But Walker just gave up.”

No one was fooled by Walker’s letter. A day after he released it, the state announced its takeover. In her letter to Walker explaining the move, Timberlake wrote that Wisconsin state government “has in fact expended millions of additional dollars and thousands of hours of staff resources to assist your county over a period of years. Despite these efforts, Milwaukee County’s performance fails national and state standards and is failing the people of the county.” Yet two years after the state took over his social service programs, Walker took over the state as governor.

Kelly Rindfleisch, who found the joke about welfare-receiving dogs “hilarious” and “so true,” was Walker’s deputy chief of staff while he was mismanaging the county’s welfare programs. Her boss, chief of staff Tom Nardelli, himself circulated a racist joke about the “nightmare” of waking up black, gay, disabled and HIV-positive while working for Milwaukee County. Against the backdrop of the way Walker treated welfare recipients, their joking is even less funny.

Rindfleisch was eventually convicted of illegal campaign activity on public time, a felony conviction that she is appealing. She and Nardelli paid no penalty for enjoying racist jokes on public time.
