“An Unpleasant Day For Scott Walker”: In The Midst Of The Fallout Of Two Criminal Investigations

When it comes to ambitious Republican governors, gearing up for likely presidential campaigns, but burdened by scandals, we tend to think of a certain New Jersey official.

But as Rosalind Helderman reminds us this morning, Wisconsin Gov. Scott Walker (R) is “in the midst of dealing with the fallout of two criminal investigations,” one of which is of particular interest today.

That could begin as early as Wednesday with the release of more than 25,000 pages of e-mails from an ex-staffer that were gathered as part of the now-concluded investigation. The probe focused on Walker’s time as Milwaukee County executive before his 2010 election as governor and led to convictions of six former aides and allies.

Even if Walker escapes the e-mail release unscathed, he faces an additional inquiry from state prosecutors, who are believed to be looking into whether his successful 2012 recall campaign illegally coordinated with independent conservative groups.

The Walker stories haven’t generated nearly as much attention as some other recent political controversies, in large part because Wisconsin’s secrecy laws have kept a tight lid on information about the investigations.

But Lane Florsheim recently summarized matters nicely: “Charles P. Pierce at Esquire has a good rundown of the lurking scandals: Aides from Walker’s first campaign went to jail for using his Milwaukee County Executive office to campaign for him for governor, another former aide was convicted of stealing money from a fund for families of U.S. soldiers who fought in Iraq and Afghanistan, and Walker’s administration gave raises that skirted state limits after a series of phantom job transfers took place. Another corruption probe is ongoing.”

Well, when you put it that way, it seems troubling.

Helderman fleshed out the significance of today’s revelations, in particular.

The e-mails being released Wednesday come from the files of Kelly Rindfleisch, a former Walker deputy chief of staff who in 2012 pleaded guilty to a felony for performing political work for a Walker-backed lieutenant governor candidate during hours she was being paid by taxpayers to do county business. The e-mails are being unsealed as part of her appeal.

Prosecutors said she sent 1,400 e-mails on county time related to political fundraising. More than 2,200 e-mails, they said, went to Walker campaign officials.

Many were sent using a private e-mail address and an Internet router installed in the county executive office suite with the intention of shielding the work from public access, prosecutors said.

Walker was copied on a handful of e-mails, released by prosecutors during Rindfleisch’s sentencing, that showed county workers and campaign aides jointly coordinating strategy.

There’s nothing to suggest Walker has ever been a target of the investigation, even though two of his former aides were convicted. His Democratic critics are nevertheless eager to see if the new materials implicate the governor to an extent beyond what’s previously been reported.

American Bridge, a progressive super PAC, has created a website that’s collecting and posting the newly released materials as they’re available.

Also note, while Walker is clearly eyeing a national campaign in the near future, he’s also facing a competitive re-election bid this year.

“What Makes a Scandal Stick?”: Why Scott Walker’s Proponents Aren’t Paying Attention To His Misconduct

Scott Walker is one of the few GOP figures in a position to benefit from Chris Christie’s Bridgegate scandal. The Wisconsin governor is uniquely appealing as a potential presidential candidate to both the moderates in his party and its far-right members. Walker is also the first governor in United States history to win a recall election, so if he wins reelection this year, he will have won three times in five years.

But Walker’s prospects aren’t totally rosy. Charles P. Pierce at Esquire has a good rundown of the lurking scandals: Aides from Walker’s first campaign went to jail for using his Milwaukee County Executive office to campaign for him for governor, another former aide was convicted of stealing money from a fund for families of U.S. soldiers who fought in Iraq and Afghanistan, and Walker’s administration gave raises that skirted state limits after a series of phantom job transfers took place. Another corruption probe is ongoing.

For now, however, the myriad of corruption charges against his administration are being largely ignored by both the right-wing sites that love the Wisconsin governor and the mainstream media. Why hasn’t Walker’s questionable past been addressed in much of the national coverage he has received?

I put the question to Dr. Amelia Arsenault, Assistant Professor of Communication at Georgia State University and author of the article “Scandal Politics in the New Media Environment.” Arsenault told me that in cases like these, there are multiple explanations that often interact. For one thing, there’s what she calls “impact journalism”—a kind of domino effect in media coverage.  “If CNN is covering it, or if The New York Times is covering it, then they all pile on, and it becomes this cycle,” she said. “Some scandals are just sexier than others, and Christie is a huge personality. He has more charisma than Scott Walker in a lot of ways in terms of being a media personality.”

Apart from the personality factor, there’s also a more deliberate element at play. Lesser known right-wing news sites often serve as the springboard for determining which scandals will enter the mainstream, according to Arsenault. “Even though they don’t have high readership, sites like The Blaze and Breitbart.com really glom onto a particular scandal, and they’re very good at activating particular scandals and then pushing them forward, so they have to be covered by [outlets] like Fox News,” says Arsenault. “People on either side of the political spectrum are going after Christie, whereas Scott Walker has sort of been the darling of the online scandalmongers.”

Then there’s the matter of various incentives on either side of the political spectrum: Far-right conservatives don’t want a pro-gun control Northeasterner as their leading presidential hopeful; Democrats are similarly eager to discredit a compelling GOP candidate, and it may work in their favor for now to ignore Walker’s skeletons in order to keep the focus on Christie.

Should Walker decide to run, however, opposition researchers would have plenty to work with. What does it say about the GOP that their next-best potential contender has scandal aplenty of his own?

“A Governor And His Rogue Operation”: We’re Watching A Governor Who’s Slowly Losing Control Of His Own Enterprise

Last weekend, New Jersey Gov. Chris Christie’s (R) office went on the offensive, targeting former ally David Wildstein with a leaked attack memo a day after Wildstein’s attorney said “evidence exists” proving the governor lied about the bridge scandal. The move backfired: the memo highlighted, among other things, Wildstein’s high school record, making the pushback appear ridiculous.

Late on Friday afternoon, as Rachel noted on the show, Christie’s office tried to do damage control on their damage control with another leak.

The memo from Gov. Chris Christie’s office attacking former appointee David Wildstein’s credibility landed with a thud. It was a striking and deeply personal broadside coming from a chief executive of a state, and even his allies called it a mistake.

But one important person hadn’t seen the missive ahead of time: the governor himself.

Christie’s aides did not run the document – which took the extraordinary step of highlighting incidents from Wildstein’s high school days – by the governor before they sent it out, according to two people familiar with the matter. Instead, someone tucked the high school lines into a daily briefing email to the governor’s supporters, and blasted it out earlier than planned.

Whether or not one believes Christie, a notorious micro-manager, was actually out of the loop is a matter of perspective. Given that the attack memo made the governor’s operation look even worse, it stands to reason Christie aides have an incentive to tell Politico the governor wasn’t involved, though we may never know whether or not this is true.

But even giving Christie and his office the benefit of the doubt, this latest effort raises questions anew about what kind of operation, exactly, the governor is running in New Jersey.

Over the last month or so, the governor’s office has come up with a version of events it desperately hopes the public will believe. It goes like this:

Leading members of Team Christie went rogue last fall, using their power to cripple a community on purpose. As the scandal intensified, other leading members of Team Christie went rogue again last week, launching a misguided attack on a perceived foe. The governor who tends to oversee even the smallest details of his operation, we’re told, was blissfully unaware of what was going on around him in both instances.

This isn’t what the governor’s critics are saying; this is what Team Christie is saying. It’s their defense.

The governor hoped to cultivate an image of an effective manager who knows how to take control and lead, but by all appearances, we’re watching a governor who’s slowly losing control of his own enterprise.

“The GOP’s Immigration Conundrum”: A Perils-Of-Pauline Soap Opera

House Republicans’ latest revolt against immigration reform spells potential trouble for the party’s 2016 presidential candidates. The last thing the GOP needs in 2016 is another primary season marked by debate and dissension over the fraught issue.

The party’s handling of immigration-reform legislation since President Obama won reelection with 71 percent of the Hispanic vote reprises a decades-long pattern that has weakened the GOP in the competition for Hispanic votes. On the one hand, there is a recognition that the party needs to do more to attract Hispanic votes. On the other, there are repeated actions, both individual and collective, that send the opposite signal.

That is what has happened over the past few weeks. At one point, House leaders, led by Speaker John A. Boehner (R-Ohio), issued a list of principles for reform legislation that included a path to legal status but not to citizenship. That suggested a collective determination to pass something this year. Then, after a backlash from the outside groups that have long been Boehner’s nemeses, the speaker did an abrupt about-face, saying that a lack of trust that Obama would enforce the law made passage this year a heavy lift.

Perhaps the speaker is playing an exceedingly clever game to keep everyone guessing, a perils-of-Pauline soap opera in which he has already sketched out the scenario that ends with the passage of some notable piece of legislation this year. After all, he’s given every indication that immigration reform is something he wants to do, something he believes is good for the country and good for his party.

More likely, he is reflecting the views of the party’s most conservative members and those outside groups, who in turn reflect the views of many rank-and-file Republicans. Comprehensive reform, including a path to citizenship, enjoys majority support nationally. But conservative Republicans continue to oppose a bill that includes any path to citizenship.

Some Republicans are suggesting that they should not clutter up the midterm elections with an issue that divides their party and instead try to energize their voters by focusing on the issue that most unites Republicans, Obama’s Affordable Care Act. Many House Republicans hate the bipartisan bill that was passed by the Senate last year. If the GOP could win control of that chamber, it might be able to write legislation more to its liking and force the president to accept it.

There is no question that the politics of this are difficult for Boehner. Could he wait to push forward this year until it would be too late for conservative challengers to mount primary campaigns against incumbent House Republicans? Will there be a better opportunity next year? Will Republicans trust Obama more next year? What is the maximum Boehner can get now as opposed to then? Would support for legal status, rather than a path to citizenship, be enough to position Republicans better to start courting Hispanics on other issues?

But another question that Republicans should be asking is: What are the consequences of inaction? Can they afford another presidential nomination contest in which immigration reform plays a central role, as it did in 2012? There is debate inside the party over how much immigration hurt Mitt Romney in the general election. But no one is arguing that it helped him, and few would say a fresh debate in 2016 would be a net plus for their nominee, unless that nominee had run forcefully in favor of comprehensive reform.

A year ago, it looked as if most of the likely GOP presidential candidates in 2016 would be advocates of comprehensive reform. The task force created by Republican National Committee Chairman Reince Priebus — a group that was weighted toward the establishment wing of the party — recommended support for such a measure. Sen. Marco Rubio (R-Fla.) took a lead role in helping produce a bipartisan Senate bill. Others who are considering running in 2016 made statements indicating at least some level of support for comprehensive legislation.

Today, that support is far more muted, if it exists at all. The conservative intelligentsia is split on what to do. The base is clearly opposed to comprehensive reform. Given the prospective field of candidates for 2016, it’s likely that those running will include outright opponents of a path to citizenship. Whoever becomes the nominee will risk having been pushed further to the right than is politically safe for a general election.

Romney said after the 2012 election that he had recognized the potentially debilitating impact an intraparty debate on immigration could have on the nominating process. He had hoped there was a way for the party to come together on some set of principles to at least prevent the issue from being front-and-center during the primaries, he said, but that didn’t happen. Romney then mishandled immigration during the GOP primaries, as his advisers later admitted (though he had a different, somewhat contrarian view of that).

Romney’s advisers discovered that, whatever problems were caused by the former governor’s talk of self-deportation and the hard line he took on immigration reform, their biggest obstacle to reaching Hispanic voters in the general election was health care. Hispanics strongly supported Obama’s health-care initiative.

That points to another problem. Republicans have long argued that they can appeal to Hispanics on issues other than immigration. So far, they have yet to prove it. Appeals to the patriotism of the Hispanic community have not worked consistently. Appeals to Hispanic small-business owners haven’t done it. Efforts to reach socially conservative Hispanics on issues such as abortion have produced few dividends. The party is still looking for an effective message for Hispanics.

Immigration remains a gateway issue. Passage of immigration reform won’t necessarily win the next presidential nominee significantly more Hispanic votes. But its absence as a divisive issue in the nomination contest would give Republican candidates an opportunity to talk to Hispanic voters about new ideas or issues.

Republicans already face significant problems winning the Rocky Mountain states in a presidential election. Growing Hispanic populations in Nevada and New Mexico have made those two states major challenges for the party. Colorado is still competitive but could become more difficult for the GOP in future elections. Arizona, which has remained in the Republican column, could become a competitive state because of Hispanic population growth.

Perhaps an immigration reform bill will be enacted before the presidential primaries begin in 2016. What Boehner did this week in bowing to pressures from the right was to underscore that Republicans continue to think more like a congressional party than a presidential party. It will be interesting to see whether any of the prospective presidential candidates is ready to challenge that orthodoxy.

“Chris Christie’s Hypocritical Transformation”: Hypocrisy Is Very Political And The Antithesis Of His Waning Brand Strength

Revisionism, which takes at least a generation in the study of history, is much more rapid in politics. It’s fast, sometimes in the same news cycle. Consider New Jersey Gov. Chris Christie. His bridge follies were considered his comeuppance, justice for his arrogance and a sign that his team lacked the experience necessary for his stature as the Republican candidate for president. In other words, overnight Christie transformed from post-partisan icon to typical Jersey pol. But that story-line was just settling in when a new one has emerged: Christie’s troubles with the bridge are not (insert traffic metaphor here) a detour in his political rise, but rather an opportunity to burnish his suspect conservative credentials.

Chris Cillizza and Roger Simon argue that Christie is cleverly using the scandal to show conservatives he is firmly in their camp. Christie’s approach, according to these observers: attack the “liberal media” (in this case, MSNBC) and point out that he is a victim of a partisan witch hunt. While it is certainly a familiar conservative tactic, it won’t work. Chris Christie’s brand, before it hit (insert traffic metaphor here) a speed bump was about being a different kind of Republican. Yes, that may have made his road to the nomination rocky, but he need only look at Mitt Romney to see what happens when a moderate tries to reinvent himself as an arch-conservative to kow-tow to the Republican right. Indeed, not only was Christie smart not to reinvent himself, he realized that being a post-partisan figure was the key to his success. He wanted to be seen as someone who put the job before politics, who could work with others, who was practical. Not only would this image help him in the general election, where he would be seen as a different kind of Republican, but it could even help in the primaries where he would get credit for standing for his beliefs. Moreover, the fundraising base in the Republican Party, at least the less ideological part of it, knows it can’t nominate a right-wing candidate and/or a lightweight. Candidates such as Ted Cruz and Rick Santorum are too extreme; Marco Rubio, too light; and Rand Paul, a little too out-there. Thus, Christie’s front-runner status. Cross-over appeal is the heart of Christie’s allure. This explains why Christie, unlike most Republicans, appeared regularly on MSNBC, the network his office now decries. Whoops! Hypocrisy is very political and the antithesis of Christie’s waning brand strength.
