“The Similarities Are Pretty Uncanny”: Was Walker’s Secret E-mail System Shadier Than Clinton’s?

Every national politician in the country is going to be peppered with questions about what they think of Hillary Clinton’s e-mail controversy. This morning is Wisconsin Governor Scott Walker’s turn. Walker didn’t hold back–he told the Weekly Standard’s John McCormack:

“It’s a logical assumption that the secretary of state is talking about highly confidential classified information. How can she ensure that that information wasn’t compromised. I think that’s the bigger issue—is the audacity to think that someone would put their personal interest above classified, confidential, highly sensitive information that’s not only important to her but to the United States of America. I think is an outrage that Democrats as well as Republicans should be concerned about.”

As McCormack notes, Walker’s attack shows quite a bit of chutzpah, because he himself got caught running a secret e-mail network for his inner circle of advisers when he was Milwaukee County executive. In their illuminating book, More Than They Bargained For: Scott Walker, Unions, and the Fight for Wisconsin, Jason Stein and Patrick Marley, reporters for the Milwaukee Journal Sentinel, provide the details.

In May 2010, the Walker administration asked a constituent services coordinator named Darlene Wink to resign, after a Journal Sentinel columnist caught her posting online political comments supporting Walker while she was supposed to be working on the taxpayers’ dime. As Stein and Marley write,

When the Wink story broke, Walker’s deputy chief of staff, Kelly Rindfleisch, quickly dismantled a private Internet router set up in her office, which was twenty-five feet away from Walker’s. During her few months on the job, she had been using the secret router and a laptop—both separate from the regular county system—to trade electronic messages with Walker’s campaign staff and raise money for state Representative Brett Davis, a GOP candidate for lieutenant governor. With attention suddenly on Wink, who had also used the router, Rindfleisch stuffed the device into a credenza in her office. “I took the wireless down,” she wrote in an e-mail to Tim Russell, who had served as Walker’s deputy chief of staff before Rindfleisch. Russell, then working as Walker’s housing director, had initially set up the router for Wink and Rindfleisch to use, prosecutors alleged.

Walker e-mailed Russell that night, telling him he had talked to Wink and felt bad about what had happened. “We cannot afford another story like this one,” Walker wrote to Russell. “No one can give them any reason to do another story. That means no laptops, no websites, no time away during the work day, etc.”

As Walker emphasizes to McCormack, prosecutors never charged him with any wrongdoing, though two of his aides were convicted of doing political work while on the county payroll. And Walker obviously wasn’t privy to sensitive classified information, as Clinton was. Still, the similarities are pretty uncanny, and Walker’s willingness to attack Clinton anyway is a good illustration of his aggressive political style.

“This Time, They’ve Gone Too Far”: Republicans Are Beginning To Act As Though Barack Obama Isn’t Even The President

It’s safe to say that no president in modern times has had his legitimacy questioned by the opposition party as much as Barack Obama. But as his term in office enters its final phase, Republicans are embarking on an entirely new enterprise: They have decided that as long as he holds the office of the presidency, it’s no longer necessary to respect the office itself.

Is that a bit hyperbolic? Maybe. But this news is nothing short of stunning:

A group of 47 Republican senators has written an open letter to Iran’s leaders warning them that any nuclear deal they sign with President Barack Obama’s administration won’t last after Obama leaves office.

Organized by freshman Senator Tom Cotton and signed by the chamber’s entire party leadership as well as potential 2016 presidential contenders Marco Rubio, Ted Cruz and Rand Paul, the letter is meant not just to discourage the Iranian regime from signing a deal but also to pressure the White House into giving Congress some authority over the process.

“It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system … Anything not approved by Congress is a mere executive agreement,” the senators wrote. “The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.”

It’s one thing to criticize the administration’s actions, or try to impede them through the legislative process. But to directly communicate with a foreign power in order to undermine ongoing negotiations? That is appalling. And just imagine what those same Republicans would have said if Democratic senators had tried such a thing when George W. Bush was president.

The only direct precedent I can think of for this occurred in 1968, when as a presidential candidate Richard Nixon secretly communicated with the government of South Vietnam in an attempt to scuttle peace negotiations the Johnson administration was engaged in. It worked: those negotiations failed, and the war dragged on for another seven years. Many people are convinced that what Nixon did was an act of treason; at the very least it was a clear violation of the Logan Act, which prohibits American citizens from communicating with foreign governments to conduct their own foreign policy.

This move by Republicans is not quite at that level. As Dan Drezner wrote, “I don’t think an open letter from members of the legislative branch quite rises to Logan Act violations, but if there’s ever a trolling amendment to the Logan Act, this would qualify,” and at least it’s out in the open. But it makes clear that they believe that when they disagree with an administration policy, they can act as though Barack Obama isn’t even the president of the United States.

And it isn’t just in foreign affairs. In an op-ed last week in the Lexington Herald-Leader, Mitch McConnell urged states to refuse to comply with proposed rules on greenhouse gas emissions from the Environmental Protection Agency. Never mind that agency regulations like these have the force of law, and the Supreme Court has upheld the EPA’s responsibility under the Clean Air Act to regulate carbon emissions — if you don’t like the law, just act as though it doesn’t apply to you. “I can’t recall a majority leader calling on states to disobey the law,” said Barbara Boxer, the ranking Democrat on the Senate Environment and Public Works Committee, “and I’ve been here almost 24 years.”

The American political system runs according to a whole series of norms, many of which we don’t notice until they’re violated. For instance, the Speaker of the House can invite a foreign leader to address Congress for the sole purpose of criticizing the administration, and he can even do it without letting the White House know in advance. There’s no law against it. But doing so violates a norm not only of simple respect and courtesy, but one that says that the exercise of foreign policy belongs to the administration. Congress can advise, criticize, and legislate to shape it, but if they simply take it upon themselves to make their own foreign policy, they’ve gone too far.

But as has happened so many times before, Republicans seem to have concluded that there is one set of rules and norms that apply in ordinary times, and an entirely different set that applies when Barack Obama is the president. You no longer need to show the president even a modicum of respect. You can tell states to ignore the law. You can sabotage delicate negotiations with a hostile foreign power by communicating directly with that power.

I wonder what they’d say if you asked them whether it would be acceptable for Democrats to treat the next Republican president that way. My guess is that the question wouldn’t even make sense to them. After all, that person would be a Republican. So how could anyone even think of such a thing?

“GOP Lawmakers Are Violating The Logan Act”: Playing With Fire; Senate GOP Tries To Sabotage Nuclear Talks

In a practical sense, when congressional Republicans invited Israeli Prime Minister Benjamin Netanyahu to deliver a joint-session address, it was part of a larger sabotage campaign. GOP lawmakers, without so much as a hint of embarrassment, are openly trying to derail international diplomatic talks with Iran, and Republicans had no qualms about partnering with a foreign government to undermine American foreign policy.

The GOP gambit arguably marked a new low. But after hitting the bottom of the barrel, Republicans dug a hole and fell just a little further.

Josh Rogin’s report makes clear that the signatories “hope that by pointing out the long-term fragility of a deal with no congressional approval … the Iranian regime might be convinced to think twice” about striking a deal with Americans and our negotiating partners.

The letter was organized by Sen. Tom Cotton (R-Ark.), a right-wing freshman who has spent months bragging about his hopes of destroying any diplomatic agreement intended to stop Iran’s nuclear ambitions.

The list of the 47 GOP senators who signed on to the letter is online here. Note, that list features several presidential hopefuls, including Ted Cruz, Rand Paul, and Marco Rubio. (Only seven Senate Republicans decided not to endorse the letter: Lamar Alexander, Dan Coats, Thad Cochran, Susan Collins, Bob Corker, Jeff Flake, and Lisa Murkowski.)

Norm Ornstein noted this morning that he’s “flabbergasted” by the “astonishing breach of conduct.” That’s clearly the appropriate response. But I’m also struck by how dangerous the Republicans’ conduct is.

As we discussed back in January, when the broader sabotage campaign came into focus, there is no real precedent for this in the American tradition. The U.S. system just isn’t supposed to work this way – because it can’t. Max Fisher explained that we’re looking at “a very real problem for American foreign policy.”

The Supreme Court has codified into law the idea that only the president is allowed to make foreign policy, and not Congress, because if there are two branches of government setting foreign policy then America effectively has two foreign policies.

The idea is that the US government needs to be a single unified entity on the world stage in order to conduct effective foreign policy. Letting the president and Congress independently set their own foreign policies would lead to chaos. It would be extremely confusing for foreign leaders, and foreign publics, who don’t always understand how domestic American politics work, and could very easily misread which of the two branches is actually setting the agenda.

The United States and our allies have reached a delicate stage of diplomacy on a key issue, but as far as congressional Republicans are concerned, the United States isn’t really at the negotiating table at all – the Obama administration is. Republican lawmakers not only disapprove of the process, they also feel justified conducting their own parallel, freelance foreign policy, which includes partnering with foreign governments and sending a message to the very rival the United States and our allies are negotiating with.

In other words, for the first time anyone can remember, we’re watching American elected officials brazenly trying to sabotage American foreign policy.

Under the circumstances, it’s no longer ridiculous to wonder whether GOP lawmakers are violating the Logan Act.

As for the GOP’s legal argument to Tehran, Jack Goldsmith added, “It appears from the letter that the Senators do not understand our constitutional system or the power to make binding agreements.”

Unfortunately, that’s not the only thing they fail to understand. They seem equally confused about propriety, U.S. protocols, and how American foreign policy is supposed to work.

“A Contest Of Anti-Tax Purity”: The Fight For The Soul Of The Republican Party Is Over: The Rich Won Again

It was just eight months ago that a New York Times Magazine profile giddily described the rise of “a small band of reform conservatives, sometimes called reformicons, who believe the health of the G.O.P. hinges on jettisoning its age-old doctrine — orgiastic tax-cutting, the slashing of government programs, the championing of Wall Street — and using an altogether different vocabulary, backed by specific proposals, that will reconnect the party to middle-class and low-income voters.”

After the Republican Party had turned itself into a machine committed relentlessly to the singular goal of cutting taxes for the rich, the reformicons seemed to be poised to take control of the party’s intellectual apparatus.

The reformicons always assumed they could bypass Congress and focus all their attention on developing an innovative platform for a presidential candidate. (This was a shaky plan to begin with, as a prospective Republican president would need to sign something passed by Congress.) But as the Republican candidates have formulated their early platforms, the party’s center of gravity, rather than jettisoning its hoary policy of orgiastic tax-cutting, has instead continued and even deepened its fervor.

The Republican Party’s determination to cut taxes for the rich was never rooted in electoral calculation. (Indeed, this has always been a handicap for the party to overcome.) It arose from the fact that extremely powerful forces within the party, including but not limited to its funders, believed in it as a matter of ideology as well as self-interest. The plutocrats initially held back in the face of the reformicon movement, perhaps unaccustomed to facing any challenge within the party, which for decades has treated their doctrine as holy writ revealed to the world by Reagan himself.

They were never going to yield control of the party without a fight. The disintegration of campaign-finance restrictions has given the funding class greater leverage over the nomination, and as the presidential field has formed its domestic-policy platforms, its influence has been evident. Jeb Bush is wooing the fanatically anti-tax Club for Growth. Scott Walker has firmly allied himself with the party’s most unreconstructed supply-siders. Rand Paul is promising “the largest tax cut in American history.” Ted Cruz is, well, Ted Cruz. The Republican primary has turned into a contest of anti-tax purity. “We’ve got maybe an embarrassment of riches here in that we’ve never been able to support somebody before, and now we may get overwhelmed with people we think are worthy of support,” gloats recently departed Club for Growth president Chris Chocola.

Nowhere is the triumph of the supply-siders more evident than in the progress of Marco Rubio and Mike Lee. Rubio and Lee are the paradigmatic spokesmen for the reformicon platform — Lee as an ideas pitchman, Rubio as a candidate.

Last year, Rubio and Lee unveiled a tax-reform plan that their allies touted as a manifesto of reform conservatism, positioning the Republican Party on the side of hard-press working families rather than the rich. Lee’s plan “actually help[s] middle-class families rather than mostly cut taxes on the investor class,” gushed Ross Douthat, one of the most fervent and optimistic advocates of the reform-conservative faction.

Eventually, the Tax Policy Center crunched the numbers on Lee’s plan and found that it did nothing of the sort. Its provisions to benefit hard-pressed low-income workers turned out to be wildly oversold. Brookings economist Isabel Sawhill concluded, “very few if any low income families with children would benefit from the plan.” And, far from being the “tax reform” it claimed to be, Rubio and Lee had merely constructed a gigantic tax-cut plan that would reduce federal revenue by $2.4 trillion over a decade, a larger tax cut than George W. Bush passed in 2001. What’s more, the Lee-Rubio plan lavished far more benefits on the rich. The average earner in the lowest income quintile would save on average $79 a year, or 0.5 percent of her income, from the plan. An earner in the second-lowest quintile, the heart of the working class, would save $338 a year, or one percent of her income. The top one percent earner would see its income boosted by 2.8 percent on average, or more than $40,000 a year. The plan was simply a reprise of Bush-era debt-financed regressive tax cuts.

Reform conservatives took the setback in stride. Perhaps this was just an oversight or a mild computational error. Douthat hopefully suggested that Rubio and Lee would take a second pass at the issue and rectify the problem:

The liberal response to the Lee plan’s disappointing score, from Chait and others, has been to suggest that it illustrates the continuing unrealism of G.O.P. proposals. But notably, Lee himself didn’t respond by, say, denouncing TPC and insisting that some version of dynamic scoring would make the deficit numbers come out right; he responded by announcing that he was partnering with Marco Rubio (cough, 2016, cough) to develop a revised family-friendly proposal.

And, indeed, Rubio and Lee have come out with a revised version of their plan. But it didn’t get better. It got much, much, much worse. The new Rubio-Lee plan keeps most of its old structure, with its stingy treatment of low-income workers. It layers on top of that two changes: a far more generous treatment of business income, and a complete elimination of all taxes on capital gains and dividends. [Update: The plan would also, unbelievably, completely eliminate the tax on inherited estates, which for a married couple only begins to apply to inheritances above $10 million.] Both of these new features would lavish massive additional tax cuts on the rich, in addition to those already in the original version. The new Rubio-Lee plan would surpass anything George W. Bush or Mitt Romney ever proposed to do in its ambitions to relieve the richest Americans of their tax burdens.

Perhaps the fullest measure of the supply-siders’ triumph can be seen in the acquiescence of many of the reformicons themselves. Ramesh Ponnuru and Yuval Levin, both reform conservatives featured prominently in the Times story, responded to the new Lee-Rubio plan with fawning praise. James Pethokoukis, a reformist conservative, calls the plan “a big step toward persuading middle-income America that Republicans care about more than just the richest 1 percent.” (If this is a big step toward persuading America that Republicans care about more than the rich, what would the next step be? Legalizing servant-flogging?)

Perhaps the reform conservatives have capitulated completely in the name of party unity. Or maybe they were misunderstood from the beginning and never proposed to deviate in any substantive way from the traditional platform of massively regressive, debt-financed tax-cutting. Either way, the movement has, for now, accomplished less than nothing.

“Contempt For The People”: The Real Problem With What Scott Walker Said About ISIS

Scott Walker is learning that when you want to play in the big leagues, things move pretty fast. And when you’re a governor without foreign policy experience, sometimes you can get a little tripped up trying to show how what you’ve done in your state prepares you for dealing with international challenges. So today Walker getting criticism for saying, in his speech to CPAC yesterday (it was actually in the Q&A session) that he can handle terrorists the same way he handled public sector unions in Wisconsin. Even some conservatives criticized him for it, but what’s alarming isn’t that he “compared” a bunch of Wisconsinites to ISIS, which of course he wasn’t trying to do. What’s alarming is that he thinks that you need the same skills and approach to dealing with unhappy constituents as you do with terrorists.

Here’s what he actually said:

“I want a commander-in-chief who will do everything in their power to ensure that the threat from radical Islamic terrorists do not wash up on American soil. We will have someone who leads and ultimately will send a message not only that we will protect American soil but do not take this upon freedom-loving people anywhere else in the world. We need a leader with that kind of confidence. If I can take on a 100,000 protesters, I can do the same across the world.”

Then later he tried to walk it back:

“Let me be perfectly clear: I’m just pointing out the closest thing I have to handling this difficult situation is the 100,000 protesters I had to deal with,” Walker told reporters. Asked if he regretted the statement, he said, “No.”

“You all will misconstrue things the way you see fit,” he said. “That’s the closest thing I have in terms of handling a difficult situation, not that there’s any parallel between the two.”

I doubt there are many limits to Walker’s contempt for people who want to bargain collectively, but obviously he didn’t mean to say they’re like terrorists. What he did mean to say, I’m fairly certain, is that he can bring the same kind of uncompromising toughness to combatting ISIS that he brought to his successful attempt to crush the public sector unions. The unions were his enemy then; ISIS will be his enemy if he gets to be president.

And this is what we need to explore, not only with Walker but with all the Republican candidates. They’ll all be eager to tell you that on this problem, Barack Obama is weak and indecisive, whereas if you’re sufficiently tough, the problem can be solved. But you know who was tough, uncompromising, and brimming with the “confidence” Walker cites? George W. Bush. When it came to terrorists, you couldn’t get much tougher than that guy. Heck, not only did he invade two countries, he even started a program to torture prisoners. Super-tough, am I right?

But you may have noticed that when Bush left office, there were still terrorists. Al-Qaeda had been transformed from a centrally-run organization into a network of franchises, all of which are potentially dangerous. And then out of the ashes of the Iraq War grew ISIS. For some unfathomable reason, toughness wasn’t quite enough to solve the problem.

So that’s how I’d pose the question to these candidates if I had the chance: You talk a lot about being strong and tough and showing resolve, and “sending messages” of strength and toughness and resolve, but George W. Bush did all those things, and yet the problem remains. So what do we do now?
