“Peter King For President?”: Republicans Had Better Hope Not

If U.S. Representative Peter King (R-NY) is serious about pursuing the Republican nomination for president in 2016, then the GOP will have a real problem on its hands.

Congressman King’s interest in a White House bid was first reported on Wednesday night by Newsmax. The next day, the Long Island Republican elaborated on his plans in an interview with ABC News.

“I’m going to certainly give it thought. I’m going to see where it goes,” King explained. “My concern right now is I don’t see anyone at the national level speaking enough on, to me, what’s important – national security, homeland security, counterterrorism.”

“The big debate that Republicans seem to have in the Senate on foreign policy is whether or not, you know, the CIA was going to use a drone to kill an American in Starbucks,” he added, in a shot at Kentucky senator Rand Paul. “To me, we should be going beyond that and we should go back to being a party – whether it’s Eisenhower, Reagan, Bush – of having a strong national defense, and that should be, to me, an essential part of the presidential debate. And so far, that’s missing.”

Of course, if national defense has been missing from the presidential debate, it’s probably just because said debate won’t begin for another two years. But if King does insist on bringing the issue to the forefront of the Republican presidential primaries, then that’s very bad news for the GOP.

King’s positions on homeland security and foreign policy line up rather neatly with those of the George W. Bush administration (notably, former attorney general and noted torture advocate Michael Mukasey was the first Republican to go on record in support of King’s hypothetical candidacy). In other words, they are ridiculously unpopular. If voters were clamoring for a return to the Bush era, then Mitt Romney — whose diplomatic and national security teams were stacked with Bush administration veterans — presumably would not have been the first Republican presidential candidate in three decades to lose to his opponent on questions of foreign policy and national security (President Obama trounced Romney 56 to 44 percent among voters focused on the subject, according to exit polls.)

Making matters worse is King’s apparent inability to advocate for these positions without invoking startling racism. If the Republican plan to appear less hostile to minorities isn’t already completely dead by 2016, then a presidential campaign by a man who has declared that “we have too many mosques in this country,” and that “85 percent of American Muslim community leaders are an enemy living amongst us” — among many other racist broadsides against the Muslim community — would certainly deliver the coup de grâce.

Furthermore, a King candidacy would be sure to bring out the worst in his fellow candidates. With a lifetime 75 percent rating from the American Conservative Union, King would draw attacks from the right throughout the primaries; it’s not hard to imagine a fierce argument over King’s support for closing the gun show loophole, for example, becoming the 2016 version of “let him die!

And none of these issues with a potential King candidacy even touch his decades-long support for a violent terrorist organization.

Happily for Republicans, King is likely just floating a presidential bid as a way to raise both his own profile and money for his congressional campaigns. But if he actually does enter the 2016 race, it would result in another huge blow to the Republican Party’s already tattered brand.

“Either Way, They Could Be Screwed”: The GOP Might Just Stick With This “Party Of White People” Thing

Since the 2012 election, most (not all, but most) Republicans have agreed that if they’re going to remain viable in presidential elections in coming years, the party will have to broaden its appeal, particularly to Latino voters. There has been plenty of disagreement about how to go about this task. Especially over comprehensive immigration reform, which many Republicans see as too high a policy price to pay to achieve some uncertain measure of good will from those voters. But outside of conservative talk radio, there weren’t many voices saying that they should junk the whole project. Every once in a while some voice from the past like Phyllis Schlafly would come out and bleat that the party should focus on the white folk who make up the party’s beating heart, but to many it seemed like the political equivalent of your racist great aunt saying at Thanksgiving that she doesn’t feel comfortable around those people.

But as immigration reform wends its tortured path through Congress, more mainstream Republicans are having second thoughts. In fact, significant backlash is brewing, not just to this bill but to the whole idea of Republicans working to appeal to minorities. Benjy Sarlin at MSNBC has an excellent article explaining how this backlash is spreading, noting that even some people who six months ago were blaming Mitt Romney’s position on immigration reform for his loss are now saying that the only viable path to victory is getting turnout up among white voters.

I’ll get to why this is a very bad idea in a moment, but the logic at work isn’t completely crazy. After all, by now the Republican party going after minority votes is like the fast-food joint that puts a salad on its menu amid all the bacon cheeseburgers and chili fries. It’s there so they can say they’re offering something for people with different tastes, but they don’t expect anyone to order it. And when Rush Limbaugh warns that a path to citizenship for undocumented immigrants will create millions of new Democratic voters, he’s probably right to a degree. Under the bill the Senate passed it would be 13 years before any undocumented immigrant could earn citizenship and vote, but as Sarlin discusses, the argument some Republicans make that Latinos are “natural conservatives” has always been weak.

After every election, a significant number of people within the losing party argue that the problem wasn’t one of persuasion but one of turnout. They just didn’t get enough of their voters to the polls, so they don’t have to change what they’re arguing. There’s often some truth to it; when only 50 to 60 percent of eligible voters are coming to the polls, turnout on your side could always be higher. But the problem the GOP now faces is that the way you relate to one group of voters affects how other voters perceive you.

This was something George W. Bush and Karl Rove understood well when they built his 2000 campaign. Bush’s “compassionate conservatism” consisted mostly of things like pulling African-Americans on stage with him and putting lots of pictures of Latinos on his web sites. It got him a few extra votes among minorities, but that was always just a bonus. The real target was moderate white voters, who saw it and learned, in the phrase reporters repeated over and over, that Bush was “a different kind of Republican.” He wasn’t like those mean-spirited old white guys who seemed to dominate the GOP, and they’d be comfortable voting for him.

By the same token, if you decide that you’re going to focus your efforts on turning out the white vote, you won’t only be sending a message to Latinos (and African Americans, and the fast-growing Asian American population) that you’re not interested in them, you’ll also be sending a message to moderate whites that your party might not be the kind of place they’d feel comfortable. This goes double for young white voters, who have grown up in a much more diverse culture than their parents and grandparents, and aren’t going to be so hot on joining the Party of White People.

This is a dilemma for Republicans. Both paths are strewn with obstacles and dangers. Whichever one they choose, there’s likely to be trouble.

“Not All Interventions Are Imperialist”: On Syria, The Left Should Not Forget History

The most vocal opposition to President Barack Obama’s promise to send arms to the Syrian rebels is coming from the political left—to which I normally would consider myself allied. Writing in the Huffington Post, M. J. Rosenberg calls it a return to “19th century imperialism.” John Nichols writes in The Nation that “the notion that the Syrian mess is an American problem, or that the United States can or should choose a favorite in the fight, is highly debatable.” Similar statements can be found in Mother Jones and In These Times.

The left’s opposition to American intervention is Syria is not tactical or prudential. These authors are not arguing that intervention is futile because the rebels have already lost or because al Qaeda has penetrated the opposition or because the war has become a proxy contest in the Middle East. These are legitimate tactical concerns, but the left’s opposition is based on principle, not tactics. It says that the United States should not engage in interventions at all. The most common reference point is George W. Bush’s invasion of Iraq. But Rosenberg also groups Obama’s intervention in Syria with the interventions in the Dominican Republic, Grenada, Panama, Lebanon, the Persian Gulf, the former Yugoslavia, Somalia, Afghanistan (in the early 1980s and after September 11), and Libya.

I think this position is wrong.  By identifying Obama’s impulse in Syria with Ronald Reagan’s invasion of Grenada or Bush’s invasion of Iraq, the left rules out any possibility of a benign intervention for humanitarian or for worthy geopolitical ends. I also think this position is contrary to the traditional stance of the American and European lefts toward foreign civil wars or wars of independence. That, of course, doesn’t show the position is wrong; but it does suggest that these leftists are betraying their own, and my, historical ideals.

What is happening in Syria is different from, say, what was happening in Iraq in early 2003, the Dominican Republic in 1965, or Grenada in 1983. The Obama administration is not using a supposed threat to American interests to intervene unilaterally and impose its will on a country that is relatively at peace, nor is it intervening (as it did in Guatemala or Vietnam) to back an unpopular regime against a rebellion. American intervention in Syria most closely resembles intervention in the former Yugoslavia in the 1990s. The U.S. is acting with other countries, and it is not trying to impose its own rule or to prop up a client regime.

In Syria, there is a civil war going on, and there is a reasonable moral case for backing the rebels against the government. The war began with the Assad regime brutally suppressing peaceful democratic reform protests. The war has already taken as many as 120,000 lives. Assad forces have laid waste to major cities.  Some dictators retain a lingering loyalty to their nation and its people, but Bashar Al Assad appears engaged in a war of personal survival. It’s not genocide, but a patria-cide—and belongs on the list of crimes against humanity that other nations should not tolerate.

My own position reflects the historical stance of the American and European left going back to the American and French revolutions. The left in the United States and Europe repeatedly pressured sympathetic governments to defend liberty and independence internationally. Nichols, following the lead of other anti-interventionists on the left and right, quotes John Quincy Adams from 1821 saying that America “goes not abroad in search of monsters to destroy.” But it’s worth looking at the context in which Adams made that statement. A whole variety of movements, editorial pages, and politicians, including Thomas Jefferson and James Madison, were urging Adams to back the Greek struggle for independence against the Turks and Latin American countries’ struggles against Spanish rule. There were a few hotheads calling for the U.S. Navy to steam into the Aegean, but the bulk of proposals, and the ones that concerned Adams, were for recognition or for sending emissaries to the Greeks or Latin Americans. But Adams rejected any initiative.

Over the next 150 years, the left in the U.S. and Europe has urged support for the Russian Revolution of 1917, the Spanish Republicans in the Civil War, the African National Congress in apartheid-era South Africa, and independence for Algeria, Vietnam, and the Portuguese colonies in Africa.  Henry Wallace—recently held up by Oliver Stone as a paragon of the left—supported American intervention in the Korean peninsula in 1950. Until recently, the left has always drawn a distinction between these kind of interventions and interventions aimed at buttressing imperial or neo-imperial rule. So the left opposed intervention in Vietnam, the Dominican Republic, and Iraq. But operating in the shadow of these fiascos, much of the left today has refused to back any intervention. That has included Syria today, the Balkans in the mid-1990s, and, incredibly, the attempt to drive Iraq out of Kuwait in 1991.

I remain perplexed about what the United States can do to help the Syrian rebels. I am not a military expert, and I don’t know what is involved in setting up a no-fly zone. I think that whatever we do, we have to do with other countries. And I believe that we have to avoid any commitment to policing a post-Assad Syria. These are reservations that the Obama administration seems to share. But I have no doubt that we should try to do something to rid the world of the Assad regime. And I say that as a card-carrying member of the American left.

“Little Evidence”: On Civil Liberties, Comparing Obama With Bush Is Easy, And Mostly Wrong

Nearly a dozen years after the passage of the PATRIOT Act — rushed through Congress in an atmosphere of fear and intimidation — informed debate over the balance between liberty and security is long overdue.  That includes a public examination of how widely and deeply the National Security Agency (and other elements of the “intelligence community”) may monitor Americans’ telecommunications without violating the Bill of Rights.

But that needed discussion isn’t enhanced by hysteria or the partisan opportunism it encourages.  As others have noted already, the supposed revelation that the NSA is collecting metadata on telephone use in this country isn’t exactly startling news. The fugitive ex-CIA contractor Edward Snowden, who leaked documents concerning that program to the London Guardian and the Washington Post, may yet unveil more startling revelations from his peculiar refuge in China. But anyone paying attention has known about this program since 2006, when USA Today first disclosed its existence.

The most important difference today is that Americans are no longer too frightened by the constant “terror alerts” of the Bush administration to consider the boundaries of surveillance and security.  Rather than hyping the terrorist threat, like George W. Bush and Dick Cheney, President Obama has repeatedly framed a calmer — if equally resolute — attitude toward Islamist extremism.

So while facile comparisons between the Obama and Bush administrations now appear every day in the media, they are quite misleading. Uttered by Republicans and their mouthpieces on Fox News, such arguments are hypocritical as well.

Consider the single most important surveillance controversy of the Bush era, namely the warrantless wiretapping undertaken on the president’s orders. In December 2005, the New York Times revealed that Bush had authorized the NSA to monitor phone calls and emails originating in U.S. territory, without obtaining warrants as required by the Foreign Intelligence Surveillance Act, or FISA. (That’s why it was called “warrantless.”) For the first time since Watergate – and the intelligence reforms resulting from that true scandal — the U.S. government had eavesdropped on Americans’ conversations without seeking the permission of a judge.

Only months before, Bush had claimed publicly that he was a steward of civil liberties and that his agents always got a court order before implementing a wiretap. But his administration had been using warrantless wiretaps ever since the 9/11 attacks.

Those trespasses against liberty went considerably further than the collection of metadata by the NSA.  No reports indicate that the Obama administration violated existing law to eavesdrop on any American — or listened to any calls without the sanction of the special FISA court.

Yet reaction to the recent stories about the NSA’s policies has been far more intense than eight years ago. Pundits and politicians have compared Obama unfavorably with Richard Nixon, berating him as a tyrannical betrayer of civil liberties. A few prominent Republicans even seem determined to ruin the NSA, solely because they wish to embarrass the president – a motive that other Republicans attribute to Snowden, whom they vilify as a traitor.

Not a peep was heard from Republicans on Capitol Hill when Bush, his vice president Dick Cheney, and their lawyers were practicing and promoting the theory of the “unitary executive,” under which any act ordered by the president in wartime, including warrantless wiretapping, is deemed inherently legal and exempt from judicial review. What exercised the Republicans in those days was the temerity of the Times in revealing what Bush had done.

As for Obama, the complicated truth is a mixed record on civil liberties. He tried and failed to close the prison at Guantánamo Bay, and he supported the renewal of the PATRIOT Act without changes. But he also substantially reformed the use of military commissions and abolished the use of torture, renditions, and secret prisons. In ending the wars in Iraq and Afghanistan, he has rejected the “permanent war” ideology, which the Bush regime deployed as a political weapon against dissent.

So far there is little evidence that Obama shares the dangerous theories of Bush and Cheney – but no president should enjoy the kind of exemption from congressional scrutiny that his predecessors exploited. Whatever Snowden’s intentions may be, he has inspired members of Congress to provide stricter oversight of the government’s gargantuan data-gathering efforts, which are inherently prone to overreach even under the most responsible supervision. At the very least, Congress and the public need to know how the government wields its powers under the PATRIOT Act – an interpretation that remains classified and thus precludes democratic oversight.

The president’s response to that question will test his commitment to the Constitution he swore to uphold.

“The Scandal Is In What’s Legal”: Holding Congress Accountable For National Security Agency Excesses

It didn’t generate much attention at the time, but in the closing days of 2012, while most of the political world was focused on the so-called “fiscal cliff,” Congress also had to take the time to reauthorize the government’s warrantless surveillance program. A handful of senators — Ron Wyden (D-Ore.), Jeff Merkley (D-Ore.), Pat Leahy (D-Vt.), Rand Paul (R-Ky.) — proposed straightforward amendments to promote NSA disclosure and add layers of accountability, but as Adam Serwer reported at the time, bipartisan majorities rejected each of their ideas.

In effect, every senator was aware of dubious NSA surveillance — some had been briefed on the programs in great detail — but a bipartisan majority was comfortable with an enormous amount of secrecy and minimal oversight. Even the most basic of proposed reforms — having the NSA explain how surveillance works in practice — were seen as overly intrusive. The vast majority of Congress was comfortable with NSA operating under what are effectively secret laws.

With this in mind, Jonathan Bernstein asked a compelling question over the weekend and provided a persuasive answer: “If you don’t like the revelations this week about what the NSA has been up to regarding your phone and Internet data, whom should you blame?”

There is, to be sure, plenty of blame to go around. The NSA has pushed the limits; federal courts approved the surveillance programs; George W. Bush got this ball rolling; President Obama kept this ball rolling; and telecoms have clearly participated in the efforts.

But save plenty of your blame — perhaps most of your blame — for Congress.

Did you notice the word I used in each of the other cases? The key word: law. As far as we know, everything that happened here was fully within the law. So if something was allowed that shouldn’t have been allowed, the problem is, in the first place, the laws. And that means Congress.

It’s worth pausing to note that there is some debate about the legality of the exposed surveillance programs. Based on what we know at this point, most of the legal analyses I’ve seen suggest the NSA’s actions were within the law, though we’re still dealing with an incomplete picture, and there are certainly some legal experts who question whether the NSA crossed legal lines.

But if the preliminary information is accurate, it’s hard to overstate how correct Bernstein is about congressional culpability.

Towards the end of the Bush/Cheney era, there was a two-pronged debate about surveillance. On the one hand, there were questions about warrantless wiretaps and NSA data mining. On the other, there was the issue of the law: the original FISA law approved in 1978 was deemed by the Bush administration to be out of date, so officials chose to circumvent it, on purpose, to meet their perceived counter-terrorism needs.

In time, bipartisan majorities in Congress decided not to hold Bush/Cheney accountable, and ultimately expanded the law to give the executive branch extraordinary and unprecedented surveillance powers.

In theory, Obama could have chosen a different path after taking office in 2009, but the historical pattern is clear: if Congress gives a war-time president vast powers related to national security, that president is going to use those powers. The wiser course of action would be the legislative branch acting to keep those powers in check — limiting how far a White House can go — but our contemporary Congress has chosen to do the opposite.

This is, by the way, a bipartisan phenomenon — lawmakers in both parties gave Bush expansive authority in this area, and lawmakers in both parties agreed to keep these powers in Obama’s hands. What’s more, they not only passed these measures into law, they chose not to do much in the way of oversight as the surveillance programs grew.

OK, but now that the NSA programs are causing national controversies again, perhaps Congress will reconsider these expansive presidential powers? Probably not — on the Sunday shows, we heard from a variety of lawmakers, some of whom expressed concern about the surveillance, but most of whom are prepared to allow the programs continue untouched.

Indeed, for many lawmakers on the right, the intended focus going forward won’t be on scaling back NSA efforts, but rather, will be on targeting the leaks that exposed the NSA efforts.

Conservatives, in particular, seem especially eager to leave these powers in the president’s hands — even though they have nothing but disdain for this particular president. And as Jon Chait explained, support for the NSA programs from the right will matter a great deal: “The Republican response is crucial, because it determines whether the news media treats the story as a ‘scandal’ or as a ‘policy dispute.'”

Michael Kinsley, referencing campaign-finance laws, once argued that in Washington, the scandal isn’t what’s illegal; the scandal is what’s legal. I’ve been thinking a lot about this adage in recent days.

If the reports are accurate and the NSA is acting within the law, but you nevertheless consider the surveillance programs outrageous, there is one remedy: Congress needs to redraw the legal lines. At least for now, the appetite for changes among lawmakers appears limited, which only helps reinforce the thesis about who’s ultimately responsible for this mess.
