“Rand Paul’s Unique Understanding Of Syria”: Strong Opinions About Another Subject He Doesn’t Really Understand
It wasn’t surprising to see Sen. Rand Paul (R-Ky.) on “Meet the Press” yesterday criticizing the idea of military intervention in Syria. It was, however, interesting to hear his rationale for what U.S. foreign policy should look like in this case.
“I think the failure of the Obama administration has been we haven’t engaged the Russians enough or the Chinese enough on this, and I think they were engaged. I think there’s a possibility Assad could already be gone. The Russians have every reason to want to keep their influence in Syria, and I think the only way they do is if there’s a change in government where Assad has gone but some of the same people remain stable.
“That would also be good for the Christians. I think the Islamic rebels winning is a bad idea for the Christians and all of a sudden we’ll have another Islamic state where Christians are persecuted.
“So I think really the best outcome for all the major powers would be a peaceful transition government, and Russia could influence that if they told Assad no more weapons.”
Paul seemed oddly preoccupied with Christians in Syria — a group he mentioned five times during the brief interview — to the point at which it seemed the senator may be confusing Syria with Egypt, where Coptic Christians have seen their churches burned.
But it was his rhetoric about Russia that was especially out of place.
About 13 years ago, then-Gov. George W. Bush and then-Vice President Al Gore met for the first of three debates, and Jim Lehrer asked about Slobodan Milosevic, who was threatening at the time to ignore his election results and leave office. Bush said it would be “a wonderful time for the Russians to step into the Balkans” and help lead diplomatic efforts.
Gore said that didn’t make any sense — Russia had largely sided with Milosevic and wasn’t prepared to accept the election results. Bush said, “Well obviously we wouldn’t use the Russians if they didn’t agree with our answer, Mr. Vice President.”
“They don’t,” Gore replied, making clear that only one candidate on the stage knew what he was talking about.
I thought about that 2000 debate watching Paul suggest the Obama administration should “engage” Russia to help create a “change in government” in Syria. Indeed, in Paul’s vision, Obama would convince Russia to deny military aid to the Assad government.
How would this happen, exactly? Does Rand Paul realize that Russia and the U.S. are on opposite sides of this, and “engaging” Russians to help oust Assad doesn’t really make any sense? Did the senator not fully prepare for questions about Syria before the interview?
Or is this just another issue in which the Kentucky Republican has strong opinions about a subject he doesn’t really understand?

“Patient Deliberation, Not Imperialism”: On Syria, President Obama Is More Like Woodrow Wilson Than George W. Bush
As President Obama moves toward launching military strikes against the Syrian regime, some have been quick to charge him with hypocritically following in the footsteps of the president he long sought to repudiate: George W. Bush.
Ron Paul kicked things off two months ago with a baseless charge of “fixing the intelligence and facts around the already determined policy.” More recently, a leading Russian legislator claimed Obama would be “Bush’s clone” because “just like in Iraq, this war won’t be legit.” Fox News columnist and strident U.N. critic Anne Bayefsky declared that Obama will be seen as a “hypocrite or a fraud” for not pursuing a U.N. Security Council resolution after “bashing” Bush on similar grounds.
The Bush swipe is a cheap shot. It also misses the far more relevant historical parallel. Obama is not walking in Bush’s footsteps, but Woodrow Wilson’s.
As World War I raged in Europe and civil war erupted in Mexico, Woodrow Wilson won re-election in 1916 on the slogan “He Kept Us Out Of War.” But Wilson’s slogan proved ephemeral, and his strategy of “armed neutrality” finally gave way in the face of German aggression.
Similarly, Obama won the presidency in no small part because of anti-Iraq War sentiment, and was re-elected at least in part for following through on withdrawal. Now Obama faces his own second-term Wilson moment, as Syria’s genocidal tactics severely test President Obama’s foreign policy goals of facilitating democracy, strengthening international institutions, and avoiding “dumb wars” that sap American lives, resources, and global influence.
The similarities do not end there. Both Wilson and Obama sought to turn away from the imperialism of their predecessors while embracing the use of American influence to spread the right of self-determination abroad. Both expressed restraint regarding the use of military force, yet both pushed back on pacifist constituencies in their political bases and kept their options open. Both were charged with vacillation, and both suffered the occasional rhetorical misstep, as they walked those fine lines in the run-up to military action.
Obama was knocked for drawing a “red line” against the use of chemical weapons without being prepared to follow through, arguably giving Syria license to go farther. Wilson quickly regretted saying America was “too proud to fight” in May 1915, three days after Germany sunk the Lusitania and killed 1,198 people, including 128 Americans. Seven months later, Wilson recalibrated. During a speaking tour promoting a new policy of military preparedness, Wilson made a clear break with his party’s pacifist wing: “There is a price which is too great to pay for peace, and that price can be put in one word. One cannot pay the price of self-respect.”
Still, Wilson’s restraint continued through the 1916 re-election campaign. Then less than three months after Election Day, Germany secretly cabled Mexico, proposing an alliance and offering three American states upon victory. Britain intercepted the code and fed it to Wilson, who publicized it and then took another two months before concluding it was time to enter the war.
Wilson risked being portrayed as a hypocrite, or even an outright liar, considering his campaign slogan. But as it turned out, his patient deliberation and clear reluctance for war buttressed his credibility when the moment for intervention came, helping to bring along a reluctant public.
Most importantly, Wilson did not betray his core principles. He did not flip from isolationism to imperialism. He had been seeking to play the role of peace broker, and end the war in a fashion that would move the world away from colonization and toward self-determination.
Shortly before he knew of Germany’s Mexican machinations, he laid out his vision in his “Peace Without Victory” address. Instead of a harsh peace in which the victor punishes the defeated, claims new territory, and sows the seeds of future conflict, Wilson saw a compromise settlement between belligerents, moving the world towards democratic governance and establishing a new “League of Nations” international body to prevent future world wars.
Wilson stuck by this vision even after he picked a side in the war, rejecting calls from both allies abroad and Republicans at home for an “unconditional surrender.”
Here too does Obama overlap with Wilson. Military action in Syria is not a betrayal of Obama’s foreign policy principles.
This is not a repeat of Bush-style neo-conservatism. There is nothing from the Obama White House that suggests a desire to handpick Syria’s leaders, establish permanent military bases, or claim natural resources. While Obama may not seek a U.N. Security Council resolution as he did to oust Libya’s Moammar Gadhafi, he is also not suddenly snubbing international law, as he reportedly sees justification in existing treaties such as the Geneva Conventions and the Chemical Weapons Conventions.
The administration’s emphasis on limited strikes makes clear that President Obama still wants to do all he can to avoid ending his presidency with a “dumb war” that would mire the United States in a hopeless quagmire.
The White House has even stated that the military strikes will not be designed to spark “regime change,” instead stressing that “resolution of this conflict has to come through political negotiation and settlement.” In other words, it anticipates some sort of power-sharing agreement between Syrian factions, leading to a government that is fully representative of all Syrian people. This policy objective harkens back to Wilson’s “Peace Without Victory.”
Of course, none of the above guarantees that Obama’s vision will triumph. Wilson learned that the hard way.
Wilson did succeed in accelerating the end of the war and jump-starting a negotiated settlement. But after long multi-party negotiations that he personally undertook, Wilson reluctantly accepted harsher terms for Germany’s surrender than he deemed fair. And a debilitating stroke in 1919 muddled his thinking and warped his ability to compromise with the Republican-led Senate, dooming ratification of the treaty and America’s entry into the League of Nations.
But Wilson’s inability to close the deal doesn’t mean he was foolish to try. He came pretty close, and a healthier Wilson with a stronger foreign policy team could well have pulled it off. In fact, President Franklin Roosevelt’s team did just that, proving Wilson’s wisdom correct with the founding of the U.N. after World War II. We have not suffered world wars since.
Obama may be taking a mighty gamble, but it is in pursuit of self-determination and an international order intolerant of genocide, not an ignoble quest for empire.

“What Neocon Revival?”: The Illusion Of GOP Ideological Diversity
It’s a bit startling to see the New York Times‘ David Brooks pen a column headlined “The Neocon Revival,” which speaks confidently about “neoconservatism” as an internally consistent perspective on public life that once dominated the conservative movement and the Republican Party (and apparently should again!). In 2004, the self-same David Brooks contributed an essay to a book entitled The Neocon Reader that suggested the very label was more or less an anti-Semitic slur (“If you ever read a sentence that starts with ‘Neocons believe,’ there is a 99.44 per cent chance everything else in that sentence will be untrue.”).
If Brooks is now giving us all permission to talk about neoconservatism without raising a presumption of ethnic or partisan poison, I’d argue that his brief manifesto is curiously detached from both the historical and contemporary realities of conservatism and of the Republican Party. Brooks is right that “neoconservatism” (a term actually popularized by democratic socialist Michael Harrington to refer to thinkers and doers who were largely still on the ideological Left and/or affiliated with the Democratic Party) was originally “about” domestic as much as international policy. Its most recent identification with George W. Bush’s foreign policies, or with post-Bush advocates of an aggressive internationalism and often of Islamophobia, is hardly an accident, but also isn’t the whole story.
Having said that, Brooks commits an act of grand larceny in claiming for neoconservatism the legacy of Ronald Reagan, not to mention that of Teddy and Franklin Roosevelt, with whom he shoehorns RR in an unlikely triptych. At least that seems to be what he is doing; the column constantly shifts from politicians to writers ranging from Irving Kristol to Richard John Neuhaus and even George Will in defining the kind of conservatism Brooks identifies with “neoconservatism” and with the successful GOP of the 1980s, which happily accepted the modern welfare state and simply wanted to harness it to conservative social goals and to national greatness.
Reading this piece, you might well forget about Ronald Reagan’s deep roots in conservative rejection of the New Deal and Great Society (he opposed both Medicare and the Civil Rights Act), or his administration’s efforts (not ultimately very successful) to use the budget process and executive powers to unravel the social safety net. You might also skip over, as Brooks does, the conservatism of the 1990s (which is interesting insofar as Brooks cut his teeth at The Weekly Standard–itself often associated with “neoconservatism”–which proclaimed itself the tribune of a “Republican Revolution” that would roll back liberalism’s accomplishments in every direction). And only someone with a wildly exaggerated idea of “compassionate conservatism” would conclude that the George W. Bush era of the GOP was characterized by happy acceptance of the welfare state.
But the oddest thing about Brooks’ column is its headline, to which he should have objected violently if he did not suggest it himself. If “neocons,” defined as people who look fondly on TR and FDR as well as that sunny welfare state advocate Ronald Reagan, are enjoying some sort of “revival,” where is it? Brooks himself says “[t]he Republican Party is drifting back to a place where it appears hostile to the basic pillars of the welfare state: to food stamps, for example.” It’s pretty hilarious to call that a “drift,” or to attribute it to some long-lost pre-Reagan impulse. The Reagan administration tried to dump the food stamp program on the states as a way station to its elimination, even as it sought to “cap” federal responsibility for Medicaid, much as Paul Ryan is trying to do today. Beyond that, who among major Republican politicians is resisting this supposed “drift,” and where is the “revival” of a tradition opposing it?
In this as in other respects, Brooks resembles other “conservative reformers” (notably his New York Times colleague Ross Douthat) who regularly lay out policy prescriptions that would get them tarred and feathered in any gathering of rank-and-file Republicans, but then more or less loyally follow the party line anyway, creating the illusion of ideological diversity. Douthat and Reihen Salam wrote an interesting book in 2009 prescribing the same sort of welfare-state-accomodation strategy that Brooks seems to be endorsing. It became associated by rhetorical osmosis with Tim Pawlenty, because they used his motto of “Sam’s Club Republicanism.” T-Paw promptly ran for president in 2012 and staked his candidacy to a failed effort to become an electable right-wing alternative to Mitt Romney. Was he a “Sam’s Club Republican” happily arguing for a more family-friendly welfare state? Probably not on the day that he signed onto the vicious “Cut, Cap, Balance” pledge that represents a death sentence for the New Deal and Great Society.
The trouble is that the conservative movement and Republican Party that Brooks and Douthat like to talk about has never existed in living memory, and isn’t likely to exist in the foreseeable future. Perhaps they have other reasons for affiliating with a political movement that so routinely ignores their advice (in Douthat’s case, I suspect his RTL self-identification is the crucial factor).
With respect to the column at hand, the very slim case for a “neocon revival” now depends on politicians like Chris Christie and Marco Rubio who are almost certainly about to spend the next couple of years snuggling up to the Tea Folk and disagreeing with Rand Paul or Ted Cruz mainly on the foreign policy grounds Brooks tells us don’t actually define neoconservatism. But by 2016, I’m reasonably sure David will have found in Christie or Rubio or someone else the flickering flame of an ideology that he mistakenly remembers as Ronald Reagan’s and mistakenly projects as the wave of the future.

“Beneath Any Reasonable Standards Of Elected Officials”: The Unprecedented And Contemptible Attempts To Sabotage Obamacare
When Mike Lee pledges to try to shut down the government unless President Obama knuckles under and defunds Obamacare entirely, it is not news—it is par for the course for the take-no-prisoners extremist senator from Utah. When the Senate Republicans’ No. 2 and No. 3 leaders, John Cornyn and John Thune, sign on to the blackmail plan, it is news—of the most depressing variety.
I am not the only one who has written about House and Senate Republicans’ monomaniacal focus on sabotaging the implementation of Obamacare—Greg Sargent, Steve Benen, Jon Chait, Jon Bernstein, Ezra Klein, and many others have written powerful pieces. But it is now spinning out of control.
It is important to emphasize that this set of moves is simply unprecedented. The clear comparison is the Medicare prescription drug plan. When it passed Congress in 2003, Democrats had many reasons to be furious. The initial partnership between President Bush and Sen. Edward Kennedy had resulted in an admirably bipartisan bill—it passed the Senate with 74 votes. Republicans then pulled a bait and switch, taking out all of the provisions that Kennedy had put in to bring along Senate Democrats, jamming the resulting bill through the House in a three-hour late-night vote marathon that blatantly violated House rules and included something close to outright bribery on the House floor, and then passing the bill through the Senate with just 54 votes—while along the way excluding the duly elected conferees, Tom Daschle (the Democratic leader!) and Jay Rockefeller, from the conference committee deliberations.
The implementation of that bill was a huge challenge, and had many rocky moments. It required educating millions of seniors, most not computer-literate, about the often complicated choices they had to create or change their prescription coverage. Imagine if Democrats had gone all out to block or disrupt the implementation—using filibusters to deny funding, sending threatening letters to companies or outside interests who mobilized to educate Medicare recipients, putting on major campaigns to convince seniors that this was a plot to deny them Medicare, comparing it to the ill-fated Medicare reform plan that passed in 1989 and, after a revolt by seniors, was repealed the next year.
Almost certainly, Democrats could have tarnished one of George W. Bush’s signature achievements, causing Republicans major heartburn in the 2004 presidential and congressional elections—and in the process hurting millions of Medicare recipients and their families. Instead, Democrats worked with Republicans, and with Mark McClellan, the Bush administration official in charge of implementation, to smooth out the process and make it work—and it has been a smashing success.
Contrast that with Obamacare. For three years, Republicans in the Senate refused to confirm anybody to head the Centers for Medicare and Medicaid Services, the post that McClellan had held in 2003-04—in order to damage the possibility of a smooth rollout of the health reform plan. Guerrilla efforts to cut off funding, dozens of votes to repeal, abusive comments by leaders, attempts to discourage states from participating in Medicaid expansion or crafting exchanges, threatening letters to associations that might publicize the availability of insurance on exchanges, and now a new set of threats—to have a government shutdown, or to refuse to raise the debt ceiling, unless the president agrees to stop all funding for implementation of the plan.
I remember being shocked when some congressional Democrats appeared to be rooting for the surge in troops in Iraq to fail—which would mean more casualties among Americans and Iraqis, but a huge embarrassment for Bush, and vindication of their skepticism. But of course they did not try to sabotage the surge by disrupting funding or interfering in the negotiations in Iraq with competing Shiite, Sunni, and Kurdish power centers. To do so would have been close to treasonous.
What is going on now to sabotage Obamacare is not treasonous—just sharply beneath any reasonable standards of elected officials with the fiduciary responsibility of governing. A good example is the letter Senate Republican Leaders Mitch McConnell and Cornyn sent to the NFL, demanding that it not cooperate with the Obama administration in a public-education campaign to tell their fans about what benefits would be available to them and how the plan would work—a letter that clearly implied deleterious consequences if the league went ahead anyhow. McConnell and Cornyn got their desired result. NFL Commissioner Roger Goodell quickly capitulated. (When I came to Washington in 1969-70, one of my great pleasures was meeting and getting to know Charles Goodell, the courageous Republican senator from New York who took on his own president on Vietnam and was quietly courageous on many other controversial issues. Roger Goodell is his son—although you would not know it from this craven action.)
When a law is enacted, representatives who opposed it have some choices (which are not mutually exclusive). They can try to repeal it, which is perfectly acceptable—unless it becomes an effort at grandstanding so overdone that it detracts from other basic responsibilities of governing. They can try to amend it to make it work better—not just perfectly acceptable but desirable, if the goal is to improve a cumbersome law to work better for the betterment of the society and its people. They can strive to make sure that the law does the most for Americans it is intended to serve, including their own constituents, while doing the least damage to the society and the economy. Or they can step aside and leave the burden of implementation to those who supported the law and got it enacted in the first place.
But to do everything possible to undercut and destroy its implementation—which in this case means finding ways to deny coverage to many who lack any health insurance; to keep millions who might be able to get better and cheaper coverage in the dark about their new options; to create disruption for the health providers who are trying to implement the law, including insurers, hospitals, and physicians; to threaten the even greater disruption via a government shutdown or breach of the debt limit in order to blackmail the president into abandoning the law; and to hope to benefit politically from all the resulting turmoil—is simply unacceptable, even contemptible. One might expect this kind of behavior from a few grenade-throwing firebrands. That the effort is spearheaded by the Republican leaders of the House and Senate—even if Speaker John Boehner is motivated by fear of his caucus, and McConnell and Cornyn by fear of Kentucky and Texas Republican activists—takes one’s breath away.

“So Much For The Fabric Of Freedom”: When Republicans Thought It Was Okay For Judicial Nominees To Have Opinions
Republicans on the Senate Judiciary Committee spent yesterday’s confirmation hearing on D.C. Circuit Court of Appeals nominee Nina Pillard harping on two points: first, that they think the D.C. Circuit doesn’t need its three vacancies filled, and second, that they think Pillard’s arguments as an academic mean she would disregard the law as a judge.
As it happens, when George W. Bush was the one nominating federal judges, the very same senators held the exact opposite view on both of these issues.
As People For the American Way has extensively shown, the argument that the D.C. Circuit doesn’t need judges holds no water – in fact, Bush nominees Thomas Griffith and John Roberts (now Chief Justice) were confirmed to the D.C. Circuit when each active judge’s caseload was significantly lower than it is today.
And Republican attacks on Pillard’s academic writings also directly contradict their previous statements on Bush nominees with academic records. As Pillard noted in her hearing, “Academics are paid to test the boundaries and look at the implications of things. As a judge, I would apply established law of the U.S. Supreme Court and the D.C. Circuit.”
Just a few years ago, Republican senators agreed. On the nomination of Tenth Circuit judge Michael McConnell, who took a number of far-right stands as an academic, including disagreeing with a Supreme Court decision declaring that a university ban on interracial dating constituted racial discrimination, Utah Sen. Orrin Hatch said, “The diversity of backgrounds and points of view are often the stitches holding together the fabric of our freedoms.”
“Surely, we can’t vote for or against a nominee on whether they agree with us on any number of a host of moral and religious issues, ” Alabama Sen. Jeff Sessions said of Eleventh Circuit nominee William Pryor, a far-right culture warrior who was outspoken in opposition to gay rights, women’s rights and the separation of church and state.
Then-Sen. Jim Demint defended D.C. Circuit Judge Janice Rogers Brown, one of the most outspoken conservative ideologues on the federal bench today, by saying, “A person with strong beliefs and personal convictions should not be barred from being a judge. In fact, I would rather have an honest liberal serve as a judge than one who has been neutered by fear of public opinion.”
And before the Senate confirmed Arkansas District Court Judge J. Leon Holmes, who used Todd Akin’s line about pregnancy from rape before Todd Akin did, Hatch told concerned colleagues, “This man is a very religious man who has made it more than clear that he will abide by the law even when he differs with it.”
These Bush nominees held positions that were clearly far out of the mainstream, yet Senate Republicans demanded and got yes-or-no confirmation votes on them, helping Bush to shift the federal judiciary far to the right.
What some Judiciary Committee Republicans objected to at yesterday’s hearings is what they apparently see as Pillard’s excessive support for women’s equality, both as an attorney and an academic. Pillard won the Supreme Court case opening the Virginia Military Institute to women and worked with Bush administration officials to successfully defend the Family and Medical Leave Act. She has strongly defended reproductive rights and criticized abstinence-only education that sends different messages to boys and girls. It’s this record that her Republican opponents have distorted beyond recognition.
By any measure, Pillard is well within the mainstream, and has made it very clear that she understands that the role of a judge is to apply existing law regardless of one’s personal views. But while Senate Republicans made plenty of excuses for Bush nominees who were far outside the mainstream, they are accusing Pillard of being just too much of a women’s rights supporter to fairly apply the law.
