“A Nuclear End To Republican Denial”: Seeing The World As It Is Rather Than Pining For A World That No Longer Exists

Those who lament the Senate Democrats’ vote to end filibusters for presidential nominations say the move will escalate partisan warfare and destroy what comity is left in Congress. Some also charge hypocrisy, since Democrats once opposed the very step they took last week.

In fact, seeing the world as it is rather than pining for a world that no longer exists is a condition for reducing polarization down the road. With their dramatic decision, Senate Democrats have frankly acknowledged that the power struggle over the judiciary has reached a crisis point and that the nature of conservative opposition to President Obama is genuinely without precedent.

What happened on Nuclear Thursday has more to do with the rise of an activist conservative judiciary than with the norms of the Senate. From the moment that five conservative justices issued their ruling in Bush v. Gore, liberals and Democrats realized they were up against forces willing to achieve their purposes by using power at every level of government. When the Bush v. Gore majority insisted that the principles invoked to decide the 2000 election in George W. Bush’s favor could not be used in any other case, they effectively admitted their opportunism. Dec. 12, 2000, led inexorably to Nov. 21, 2013.

Bush v. Gore set in motion what liberals see as a pernicious feedback loop. By giving the presidency to a conservative, the five right-of-center justices guaranteed that for at least four years (and what turned out to be eight), the judiciary would be tilted even further in a conservative direction.

Bush was highly disciplined in naming as many conservative judges as he could. His appointments of Chief Justice John Roberts and Associate Justice Samuel Alito bolstered the Supreme Court’s conservative majority. The court later rendered such decisions as Citizens United, which tore down barriers to big money in politics, and Shelby County v. Holder, which gutted a key part of the Voting Rights Act. Both, in turn, had the effect of strengthening the electoral hand of conservatives and Republicans.

With the conservatives’ offensive as the backdrop, Senate Democrats and liberals on the outside revolted in 2005 against the Republican threat to use the nuclear option when the GOP controlled the Senate. Progressives felt they had no choice but to throw sand into the gears of a juggernaut.

Liberals said things eight years ago that are being used by conservatives to accuse them of hypocrisy now. I didn’t have to look far for an example of what they’re talking about.

In a column in March 2005, I called the GOP’s effort to speed the confirmation of conservative judges “a blatant effort to twist the rules” that ignored “the traditions of the Senate.” I might take back the “traditions of the Senate” line, a rhetorical attempt to call conservatism’s bluff. But what animated my argument then is the same concern I have now: This era’s conservatives will use any means at their disposal to win control of the courts. Their goal is to do all they can to limit Congress’s ability to enact social reforms. At the same time, they are pushing for measures — notably restrictions on the right to vote — that alter the electoral terrain in their favor.

And it is simply undeniable that in the Obama years, conservatives have abused the filibuster in ways that liberals never dreamed of. Senate Majority Leader Harry Reid cited the Congressional Research Service’s (CRS) finding that in our history, there have been 168 cloture motions filed on presidential nominations. Nearly half of them — 82 — happened under Obama. According to CRS, of the 67 cloture motions on judicial nominees since 1967, 31 occurred under Obama. Faced with this escalation, senators long opposed to going nuclear, among them Reid and California’s Dianne Feinstein, concluded it was the only alternative to surrender.

Republicans gave the game away when all but a few of them opposed Obama’s three most recent appointments to the Court of Appeals for the D.C. Circuit not on the merits but by accusing the president of trying to “pack the court.” In fact, Obama was simply making appointments he was constitutionally and legislatively authorized to make. His nominees were being filibustered because they might alter the circuit court’s philosophical balance. The GOP thus demonstrated beyond any doubt that it cares far more about maintaining conservative influence on the nation’s second most important judicial body than in observing the rules and customs of the Senate.

This is why the Senate Democrats’ action will, in the end, be constructive. The first step toward resolving a power struggle is to recognize it for what it is. The era of denial is finally over.

“Nobody Died”: No, Obamacare’s Flaws Are Not Like Hurricane Katrina

It’s one thing for former George W. Bush flack and Sarah Palin staffer Nicolle Wallace to make a silly and self-serving link between the troubled rollout of President Obama’s Affordable Care Act and her boss’s handling of, wait for it, Hurricane Katrina. It’s another for the New York Times to pick up the cudgel and seriously make a comparison between the Affordable Care Act’s acknowledged problems and the deadly 2005 tragedy.

But that’s what the paper did Friday morning, with Michael D. Shear’s “Health Law Rollout’s Stumbles Draw Comparisons to Bush’s Hurricane Response.” Other media are using the Times piece to make the same comparison. ABC’s “Good Morning America” did a whole segment on it; as I write, the chyron on MSNBC asks “Obama’s Katrina?”

Shear put it this way:

The disastrous rollout of [Obama’s} health care law not only threatens the rest of his agenda but also raises questions about his competence in the same way that the Bush administration’s botched response to Hurricane Katrina undermined any semblance of Republican efficiency….

“The echoes to the fall of 2005 are really eerie,” said Peter D. Feaver, a top national security official in Mr. Bush’s second term. “Katrina, which is shorthand for bungled administration policy, matches to the rollout of the website.”

No, Mr. Feaver, Katrina isn’t shorthand for “bungled administration policy.” It’s an actual tragedy in which at least 1,800 people lost their lives. Thousands of others were left stranded without food or water in their flooded neighborhoods, on freeway viaducts, in hospitals and nursing homes, and in the televised hell-hole of the Superdome. A million people were displaced, some of them permanently. Whole neighborhoods remain unrestored eight years later. There was at least $123 million in destruction, twice as much as in Hurricane Sandy.

In the ACA holocaust, by comparison, an undetermined number of people may lose health insurance policies they like. Many more, perhaps millions, have been frustrated by a kludgy website. On the other hand, at least 100,000 have signed up for insurance through the exchanges and another 500,000 or so have been newly covered by Medicaid expansion.

Oh, and there have been zero deaths as a result of the ACA woes — unless you count the death of credibility among journalists and pundits who would make such a lame and cruel comparison.

In Katrina, a toxic mix of indifference to the plight of poor, black New Orleans residents and genuine colorblind incompetence made a natural disaster worse. Bush, you’ll recall, threw a birthday party for Sen. John McCain, and then flew over the ravaged Gulf region without stopping. When he did visit, he praised his lame FEMA director Michael Brown – whose job as a commissioner of the International Arabian Horse Association had been great training for running the nation’s disaster preparedness agency – with the iconic “Heckuva job, Brownie.”

Obama, by contrast, stepped forward when the website troubles emerged. “Nobody is madder than me about the fact that the website isn’t working as well as it should, which means it’s going to get fixed,” he told a crowd Oct. 21. It’s still not fixed, although it’s working better, and the president has continued to push his staff for answers and apologize for the rollout woes, last week in an interview with NBC’s Chuck Todd; last night in a press conference. “There were times I thought we got slapped around unjustly,” the president said. “This one is deserved. It’s on us.” There has been nothing close to a “Heckuva job, Brownie” moment.

Finally, in Hurricane Katrina, most of the victims were poor African-Americans. In the current ACA controversy, the vast majority of people losing their private insurance policies are young and middle-aged white men who aren’t affluent, but are doing well enough that they don’t qualify for federal subsidies. That makes the Katrina-ACA comparison particularly outrageous, especially for journalists.

All that will ultimately matter is whether and when the site gets fixed, and the turmoil in the individual market, where some people are losing policies they want to keep, subsides. We still don’t know if the president’s proposed “fix,” which should let at least some of those folks hold onto their existing insurance, is meaningful enough to quell the political panic among some Democrats and people losing insurance, yet limited enough that it doesn’t undermine the goal of getting a bigger pool of people into the individual market for ACA-approved health insurance plans (rather than the junk insurance that currently dominates the individual market).

It’s clearly a mess, with genuine political and public policy implications. It’s fine for shrill Republicans to call it Obama’s Katrina, or his Iraq, or his Iran Contra – when it comes to this president, they have no credibility and they have no shame; they’ll say anything. But for the media to pick up on the GOP narrative and sincerely compare the ACA rollout stumble to a national tragedy like Hurricane Katrina?

Someone might call it the media’s Katrina — if it was fair to use a tragedy in which thousands died as a metaphor for mere incompetence. So I’ll just call it incredibly lame.

“Thank You For Your Service, Or Not”: Republicans Thank Veterans By Cutting Food Stamps

The next time I hear a Republican member of the U.S. House of Representatives thank a veteran for his or her service, I’ll hurl.

Veterans Day is on Monday. This year the holiday will come 10 days after cuts in federal food aid demanded by House Republicans go into effect. The cuts mean that 47 million hungry Americans, including almost 1 million veterans, will be even hungrier and more malnourished than they were last Veterans Day.

Mother’s Day won’t be much better because 80 percent, or 37 million, of the food aid recipients are women and children. And for the record, 10 percent or almost 5 million of the recipients are senior citizens.

I hope the House Republican budget guru, Rep. Paul Ryan, R-Wis., is proud of his handiwork because it’s a callous way of thanking vets for their service. Before the cuts, the average veteran received a little more than $4 a day for food from the feds. Now vets will have to get by on even less. Don’t try this at home, because if you try to eat on $4 a day, you will be malnourished pretty quickly. The GOP went to the mat to get these cuts and now they want even more.

The Republican hostility towards vets is just the latest episode in the sad saga of vets under the GOP. George W. Bush and his vice president Dick Cheney both avoided serving in Vietnam when they were of draft age in the 1960’s. But that didn’t stop the deadly duo from sending more than 4,000 brave young Americans to their deaths in Iraq based on a lie about the existence of weapons of mass destruction there.

If wounded soldiers were lucky enough to make it out of Iraq alive, things didn’t get much better back home. During the Bush/Cheney administration, hospitals administered by the Veterans Administration were poorly staffed and inadequately equipped. The corridors of the “crown jewel” of the military hospital system, Walter Reed Hospital, were plagued with garbage and rats.

The tea party caucus in Congress forced $5 million a year in cuts for food aid. Why? Because the GOP shot down President Obama’s proposal to eliminate $6 billion in federal tax freebies to oil companies and firms that own corporate jets. While millionaires, billionaires and oil company executives fly the friendly federal skies, almost 1 million veterans are still in the desert, fighting hard. This time they struggle in a fight for food in the land of plenty.

“How’s About You And Him Fight?”: Get Ready For A Whole Lot Of Hillary Vs Barack Stories Based On Nothing

Hillary Clinton has about a year and a half before she needs to make the final decision on whether she’ll run for president in 2016. Between now and then, and after she becomes an actual candidate (if she does), we’re going to be seeing an awful lot of stories that read as though an editor said to a reporter, “Give me a story about Hillary turning her back on Barack, and the two camps sniping at each other,” and the reporter replied, “Well, I haven’t seen much evidence of that, but I’ll see what I can come up with.” That gets you stuff like a piece in today’s Washington Post, under the headline, “In the Clintons’ talk of brokering compromise, an implicit rebuke of Obama years.” Let’s get to the stinging barbs Hillary and Bill are aiming at the President:

In recent stump speeches and policy remarks, Bill and Hillary Clinton have offered sharp criticisms of the partisan gridlock paralyzing Washington, signaling a potential 2016 campaign theme if Hillary Clinton chooses to run for president.

The Clintons’ critiques in recent days have been explicitly aimed at congressional Republicans, who helped spur a 16-day government shutdown and potential debt default in October. But their remarks also seem to contain an implicit rebuke of President Obama’s failure to change Washington as he pledged when first running for the White House.

The arguments suggest a way that Hillary Clinton could attempt to run in 2016 as an agent of change — potentially putting her at odds with the two-term Democrat she would be seeking to replace.

So her “implicit rebuke of President Obama’s failure to change Washington” is … criticism of Republicans? And if Hillary Clinton says she wants to see everyone work across the aisle to solve problems, that’s some kind of slap in Obama’s face? Well that’s odd, since Obama ran for president saying he wanted to bring Democrats and Republicans together, just like George W. Bush did before him (remember “I’m a uniter, not a divider”?), and Bill Clinton did before him. It’s what every presidential candidate says, even the most partisan ones.

I don’t imagine that Clinton thinks Obama has been a perfect president, and I’m sure there are things she thinks she could have done better than him. But there is going to be an endless stream of stories like this one, trying to gin up some kind of dramatic struggle between the two, full of anger and recrimination and Machiavellian machinations, all based on nothing but the barest wisps of evidence. It’s driven by the journalist’s endless need to frame stories around conflict, their preference for writing about personality, and the fact that if you’re going to write a story about the 2016 campaign three years before the actual election, you don’t have a lot of material to work with. But give me a break.

“A Major League Asshole”: Ted Cruz Is Not Well-Liked And The Knives Are Coming Out For Him

“Be liked and you will never want,” said Willy Loman, the protagonist of Arthur Miller’s Death of a Salesman. “That’s the wonder, the wonder of this country, that a man can end with diamonds here on the basis of being liked!” Of course, the great tragic figure of the American theater was terribly wrong about that. But in politics, personal relationships still matter, even if the days when Lyndon Johnson would call up a senator and sweet-talk him into changing his vote on a bill are long gone.

I’m thinking about this because Ted Cruz—Tea Party hero, up-and-comer, future presidential candidate—is suddenly finding himself on the receiving end of a whole lot of hostility from House Republicans. By way of context, there’s a broad consensus that Cruz is, as George W. Bush would put it, a major-league asshole. He’s not someone who wastes time and energy being nice to people or cultivating relationships that could be useful down the road. He’s pretty sure he’s smarter than everyone, and doesn’t mind making it clear that’s how he feels. People consider him rude and condescending. This was apparent from the moment he got to Washington, and it was true back in Texas as well. But if you agree with his politics, then does that matter?

It sure seems to matter today. On the surface, there’s a tactical dispute about whether Cruz is working hard enough to get the Senate to defund Obamacare now that the House is about to do its part by passing a continuing resolution that does the defunding deed. Because he expressed some resignation about the CR’s prospects in the Senate—which is tantamount to admitting that Republicans will not be able to flap their arms and fly to the moon, no matter how hard they try—Cruz is being hit left and right, or more properly, right. House Republicans feel that Cruz encouraged them to force a government shutdown over defunding, and now that they’re doing their part, he doesn’t seem to be doing enough on his end. Republican Rep. Sean Duffy fumed that Cruz had “abused” and “bullied” House Republicans. His colleague Peter King said, “If he can deliver on this, fine. If he can’t, he should keep quiet from now on and we shouldn’t listen to him,” which is actually strong words from a congressman to a senator. And check out this, from the National Review:

House insiders say a handful of House Republicans cursed Cruz in the cloakroom on Wednesday, and a leadership source says angry e-mails were exchanged among GOP staffers who consider Cruz to be a charlatan. “Cruz keeps raising conservatives’ hopes, and then, when we give him what he wants, he doesn’t have a plan to follow through,” an aide fumes. “He’s an amateur.” Another aide says, “Nancy Pelosi is more well-liked around here.”

Holy cow. That’s like somebody on the Red Sox saying that Alex Rodriguez is more well-liked in the Sox clubhouse than one of his teammates. So would this have happened if Cruz was a nicer guy? My guess is that there would be far less of this open antagonism.

And this tells us something about Cruz’s long-term prospects. He got where he is by being smart and aggressive, and having the good fortune to be in Texas at a time when the Tea Party was ascendant. In high school and college he was a champion debater, an activity in which winning means getting in front of people and talking your opponents into submission. But running for president (which Cruz would plainly like to do one day) means getting a whole lot of people to like you. Fundraisers, reporters, other politicians who might endorse you, power brokers from the highest party pooh-bah down to every block captain in Des Moines—you’ve got to court them and make them love you so they’ll work their hearts out. Politicians like Bill Clinton and George W. Bush who excel at that personal side of politics have an immense leg up.

It’s one thing to be personally awkward, like Al Gore or Mitt Romney—that makes it harder, but not impossible. But if you’re someone who inspires this kind of venom, that’s another matter entirely.
