Jeb Bush left Protestantism in his 40’s to convert to Roman Catholicism, and he’s widely perceived as the most moderate potential 2016 presidential contender.
So, at first blush, it may seem a little odd that Liberty University—the largest Christian (mostly evangelical) university in the country—gave him the honor of delivering its commencement address.
Liberty is nothing if not conservative. And conservatives hate the establishment. Right?
Wrong.
In fact, the Bush family and the Falwell family are a match made in heaven. And their bond is likely to be a boon to Jeb’s White House dreams.
Jerry Falwell, the single most influential conservative Christian power broker of the 20th century, founded Liberty in 1971 to foster evangelicals’ political and cultural clout.
Since then, the school has had some dramatic ups and downs, with the downs reaching their lowest in 1990 when the school faced $110 million in debt.
But Falwell died and God provided: Thanks in part to the pastor’s hefty life insurance policy, the school paid its dues, got in the black, and catapulted to a higher place than ever in the conservative firmament.
And even when it was short on money, it never lost its political cachet.
The histories of the university and the Bush dynasty are closely intertwined.
In 1980, former congressman and U.N. ambassador George H. W. Bush ran for the Republican presidential nomination with a less-than-red-meat record, and he was pro-choice as Reagan’s vice president. His beliefs could have permanently soured his reputation with evangelicals.
That’s where Falwell comes in: The reverend endorsed Bush in the 1988 Republican presidential primary, even though Pat Robertson—an evangelical televangelist whose ideological resume had much more overlap with Falwell’s—was also a contender.
This has often been chalked up to rivalry between the two preachers. But it was more than that.
“Establishment recognizes establishment,” said one prominent evangelical leader who was close with the late Falwell.
As he explained, Southern evangelicals have been part of their region’s cultural establishment for decades, and in a way that their Northern counterparts couldn’t have dreamed.
When it comes to said cultural establishments, Northern evangelicals have been on the outside looking in, while those from the South have been on the inside looking out. So Southern evangelicals are much more comfortable with the possession and the exercise of cultural and political power than Northern evangelicals are. And nobody possessed and exercised political power quite like the Bushes, including Bush 41, a literal senator’s son.
So Falwell had an immediate commonality with the Bushes that helped solidify their relationship. They may have differed in policy, theology, rhetoric and a host of other details. But in one key area, they had everything in common: In their respective spheres, they were boss.
“These two families have each played an iconic role in modern, American politics, and their influence has intersected on not a few occasions,” said Johnnie Moore, a former senior vice president of Liberty University.
“When it did intersect, it was a force to be reckoned with. There will be two political dynasties represented on that stage at Liberty University this weekend whose influence is not only undeniable, it’s incalculable.”
In 1990, Bush found himself at Liberty, standing shoulder-to-shoulder with the reverend and delivering the commencement address to a crowd of evangelical voters who had helped secure his predecessor’s legacy.
And Bush 43 wasn’t the only so-called establishment-type to win Falwell’s imprimatur.
A few years after Sen. John McCain put him on his list of “agents of intolerance,” the pastor invited him to deliver the university’s 2006 commencement address.
The two broke bread, a reconciliation that boosted McCain’s 2008 presidential efforts.
And Falwell’s son, Jerry Falwell Jr., invited Mitt Romney to give the school’s 2012 commencement address. His decision to give that platform to a Mormon enraged many conservative Christians. But Jerry Jr. and Mitt Romney had commonality where it counted: They were both the heirs of dynasts.
If George H. W. Bush had a good relationship with the evangelicals in Falwell’s orbit, George W. Bush had a magnificent one.
“In 41, they’d take our calls,” said the aforementioned evangelical leader. “In 43, they’d call us.”
And now it’s Jeb’s turn.
And Liberty’s protestants will likely make him feel right at home.
And even though he’s pledged allegiance to Rome, they still see him as one of their own: the kid brother of their favorite president ever and the unabashed social conservative icon who tried to keep Terri Schiavo alive.
And, per excerpts of his speech provided to reporters in advance, Jeb will speak their language.
“Whatever the need, the affliction, or the injustice,” he plans to say, “there is no more powerful or liberating influence on this earth than the Christian conscience in action.”
“Consider a whole alternative universe of power without restraint, conflict without reconciliation, oppression without deliverance, corruption without reformation, tragedy without renewal, achievement without grace,” he’ll add, “and it’s all just a glimpse of human experience without the Christian influence.”
Consider a country without Falwell’s influence, and you might be considering a country without the Bushes.

Jeb Bush, you may or may not be aware, spent much of his adult life as a “businessman.” I put that word in quotes because from what we’ve learned so far Bush doesn’t seem to have risen in the business world the way we normally think of people doing, by creating some kind of product or service that can be sold to people, by managing a growing operation, and so on. Instead, his work, such as it was, consisted of opening doors and making deals, something a succession of partners brought him in to do because of his name.
Which isn’t in itself a sin. I’ll get to that in a minute, but first, an article in today’s Times discusses some of Bush’s deals that didn’t turn out so well, and how he reacted:
Yet a number of his ventures before he entered politics have invited criticism that Mr. Bush traded on his family’s name and crossed ethical lines. His business involvement, as the son of a president, was inevitably vetted in public view, subjecting Mr. Bush to so many questions that he angrily accused the news media of treating him unfairly.
“By definition, every single business transaction I am involved with may give the appearance that I am trading on my name,” Mr. Bush wrote in The Wall Street Journal during the final days of his father’s re-election campaign in 1992, responding specifically to stories about his involvement with the sale of M.W.I.’s water pumps. “I cannot change who I am.”
Months earlier, he had written a 1,400-word defense of his business dealings in The Miami Herald in which he condemned reporters for having “gone too far in delving into the private lives of the families of public figures.”
“Being part of America’s ‘First Family’ is both wondrous and challenging,” he wrote in the newspaper, adding that he desired to have his successes or failures “measured by his own performance and behavior, not those of his parents.”
There isn’t necessarily anything wrong with making money the way Bush did. He had a famous name and connections that that name produced, and people were willing to give him large quantities of money to use it to their advantage. Every once in a while we hear of some wealthy heir who gives away all their inheritance and makes a fresh start with nothing, but most of us wouldn’t have the guts to do that. Connections and renown were Bush’s inheritance, an invaluable currency that could be traded for riches and power. He accepted that inheritance, like most people would.
But what I’d like to know is how Bush himself thinks of his career, and how self-aware he is today. At the 1988 Democratic convention, Jim Hightower said of Jeb’s father that he “was born on third base and thinks he hit a triple.” What does Jeb think he hit?
I’m sure he would like to believe that every dollar he ever made came because of his skills, smarts, and hard work. But it didn’t. Like his brother George (who had a similar business career in which people lined up to give him money), Jeb had opportunities that are available to almost no one else in America.
So imagine if he said, “Look, I know that my career has been different from most people’s. My grandfather was a senator and my father was the president. Did that ease my way? Of course. It would be ridiculous of me to claim otherwise. But I tried to operate as honestly as I could, work hard, and learn as much as possible in the business world.” If Bush said that, he could earn a lot of respect, even from his political opponents.
When he was born, Jeb Bush won the lottery. We don’t condemn anyone for winning the lottery, but we do judge what they do afterward. Some people win it, buy a nice house, and then set up a foundation to help other people. Other people win the lottery and blow the whole thing on hookers and cocaine. Bush’s history seems to be somewhere in between.
Most of the people Bush is running against in the primaries are the dreaded “career politicians,” and those who have made their careers outside of business (Ted Cruz was a lawyer, Rand Paul and Ben Carson were doctors). Since Republican ideology has it that businesspeople are the most noble and heroic among us, it will be tempting for Bush to tout his business experience as a key credential during the primaries. It will also be tempting for his opponents to criticize him as a scion of the elite, particularly since it fits well into the narrative that he’s the “establishment” candidate while they’re representatives of the grassroots. The question is whether Bush will deny that he’s any different from any other successful businessman.

For a number of reasons, it has proven extremely difficult in recent history for a presidential candidate to win after eight years in which his party controlled the White House. Only one candidate has done it since 1948—George H.W. Bush in 1988. This fact would make a Hillary Clinton victory next year an unusual event, and there will be lots and lots of discussion between now and next November about how her candidacy is affected by the complex legacy of the Obama administration. The early form that discussion is taking seems to be that Clinton’s essential challenge is to “distance” herself from Barack Obama, which will be difficult because she served in his administration for four years. Comparisons are being made to John McCain, who was dragged down by George W. Bush in 2008 despite the fact that McCain hadn’t actually worked for Bush, but was just a senator (and a “maverick” at that, an idea that was essentially bogus but ubiquitous), as well as to Al Gore, who never found quite the right way to describe how his candidacy related to the administration in which he served.
This is a topic that I’m sure I’ll be returning to, because how the electorate thinks about Barack Obama and feels about the last eight years is going to be a central theme of the campaign. But my feeling right now is that it might not be as much of a problem for Clinton as so many people seem to think.
First, let’s dispense with the two main comparisons everyone is making: 2008 and 2000. Barack Obama’s popularity right now is pretty middling, in the high 40s. Would it be better for Clinton if it were higher? Sure. But it’s still worlds away from where George W. Bush was in 2008. In Gallup’s last poll before the 2008 election, Bush’s approval was at 25 percent. His administration was judged by Democrats, independents, and even many Republicans as an abysmal failure, because of both the disaster in Iraq and the financial cataclysm that had just hit. McCain was one of the war’s biggest supporters, and was offering essentially the same economic policies as Bush. That’s why it was easy for Obama to say that McCain offered more of the same, while he offered change—not only was there substance to the charge, but “more of the same” was something almost everyone agreed they wanted to avoid.
Today, people are less than satisfied with the way many things are going, but we aren’t in the throes of a disaster. The economy is recovering rather nicely, and attention has turned to long-standing problems like inequality and wage stagnation. Republicans can say that Obama didn’t fix these problems and Clinton won’t either, but they’ll have much more trouble saying that their remedy—essentially a return to George W. Bush’s economic policies—will produce something better.
As for 2000, the comparison is even less apt. Al Gore struggled to get out of Bill Clinton’s shadow and prove he was his own man, and because of the Lewinsky scandal he had a certain reluctance to embrace the successes of the administration. But nobody is going to plausibly say that Hillary Clinton isn’t her own woman or would just reproduce everything about the Obama years.
Nevertheless, in many ways, a Hillary Clinton presidency would probably look like a combination of her husband’s and the one she worked in. If you’re a Republican you think that sounds dreadful, if you’re a Democrat you think it sounds great, and if you’re an independent there are probably some things you’d like about it and some you wouldn’t. But it isn’t some nebulous mystery onto which Republicans can project a bunch of fears. A Hillary Clinton presidency is, as Donald Rumsfeld would say, a known known.
Things can change, of course—maybe there will be another recession, or some huge scandal that covers Obama in eternal shame. But if we proceed along as we’re going now, I doubt the Obama legacy is going to prove much of a problem for Clinton. It may even help her.

Do we really need the Israeli prime minister to appear before Congress to explain the dangers and pitfalls of certain prospective deals on Iran’s nuclear weapons programs? Would we not know otherwise? Have the U.S. critics of those prospective deals lost their voice? Are they shy about expressing their concerns? Are they inarticulate or incompetent? Do they lack the wherewithal to get their message out?
Not exactly. Every day a new report or analysis warns of the consequences of various concessions that the Obama administration may or may not be making. Some think tanks in Washington devote themselves almost entirely to the subject of Iran’s nuclear program. Congress has held numerous hearings on the subject. Every week, perhaps every day, high-ranking members of the House and Senate, from both parties, lay out the dangers they see. The Post, the New York Times, the Wall Street Journal and others publish countless stories on the talks in which experts weigh in to express their doubts. If all the articles, statements and analyses produced in the United States on this subject could be traded for centrifuges, the Iranian nuclear program would be eliminated in a week.
Nor can it be said that we are somehow unaware of Israel’s views on this deal. It is not as if our news media will not report Israeli concerns and complaints. The statements and opinions of the Israeli prime minister, of members of his government and of the military and intelligence services are amply covered in the United States. Israeli officials — including the prime minister — can and do travel to the United States to express their concerns, with or without presidential invitations. They give speeches at the United Nations. They go on Sunday morning television programs and voice their opinions before millions of American viewers. They can even meet with members of Congress in both parties if they choose to.
Given all this, can it really be the case that the American people will not know what to think about any prospective Iran deal until one man, and only one man, gets up to speak in one venue, and only one venue, and does so in the first week of March, and only in that week? That is what those who insist it is vital that Israeli Prime Minister Benjamin Netanyahu speak before a joint meeting of Congress next week would have us believe.
Even the most eloquent speech by Netanyahu will not add more than marginally to what has already been said and heard. But even if the drama of the situation and the prime minister’s eloquence were to highlight the already well-articulated case against a bad deal, the question is: at what price?
For there is a price. I will leave it to the Israeli government and people to worry about what damage the prime minister’s decision could have on U.S.-Israeli relations going forward, and not just under this administration. Those Americans who care most about that relationship will also have to weigh whether the short-term benefits of having Netanyahu speak will outweigh potential long-term costs. Looking back on it from years hence, will the spectacle of an Israeli prime minister coming to Washington to do battle with an American president wear well or poorly?
For the United States, however, there is no doubt that the precedent being set is a bad one. This is not the first time that a U.S. administration and an Israeli prime minister have been at loggerheads. President George H.W. Bush and his secretary of state, James Baker, reportedly detested then-prime minister Yitzhak Shamir and did their best to help him lose his next election. Baker even had a few choice words for the American Jews who tried to come to the Israeli government’s defense. Did anyone at the time think of inviting Shamir to address Congress? The very idea would have been regarded as laughable. Now, we’re supposed to believe that it’s perfectly reasonable.
Is anyone thinking about the future? From now on, whenever the opposition party happens to control Congress — a common enough occurrence — it may call in a foreign leader to speak to a joint meeting of Congress against a president and his policies. Think of how this might have played out in the past. A Democratic-controlled Congress in the 1980s might, for instance, have called the Nobel Prize-winning Costa Rican President Oscar Arias to denounce President Ronald Reagan’s policies in Central America. A Democratic-controlled Congress in 2003 might have called French President Jacques Chirac to oppose President George W. Bush’s impending war in Iraq.
Does that sound implausible? Yes, it was implausible — until now. Now we are sailing into uncharted waters. Those who favor having Netanyahu speak may imagine this is an extraordinary situation requiring extraordinary measures, that one side is so clearly right, the other so clearly wrong. Yet that is often how people feel about the crisis of their time. We can be sure that in the future the urgency will seem just as great. The only difference between then and now is that today, bringing a foreign leader before Congress to challenge a U.S. president’s policies is unprecedented. After next week, it will be just another weapon in our bitter partisan struggle.

U.S. District Judge Andrew S. Hanen’s decision to block the Obama plan to defer deportation for about 5 million immigrants here illegally ignores a basic principle of government: For better or worse, the executive branch of government always has discretion as to whether and how to enforce the law.
The judge’s lengthy opinion is wrong as a matter of law and, worse, is based on xenophobia and stereotypes about immigrants. It is very likely to be overturned by the U.S. 5th Circuit Court of Appeals, and, if necessary, the Supreme Court.
Every president must set enforcement priorities on immigration, choosing whom to prosecute or whom to deport. No administration brings prosecutions against all who violate the law. Resources make that impossible, and there are laws on the books that should not be enforced.
Nor has any administration, Democratic or Republican, sought to deport every person who is illegally in the United States. For humanitarian reasons or because of foreign policy considerations or for lack of resources, the government often chooses not to bring deportation actions. In fact, as recently as three years ago, the Supreme Court in United States vs. Arizona recognized that an inherent part of executive control over foreign policy is the ability of the president to choose whether to bring deportation proceedings.
That is exactly what President Obama’s executive orders on immigration have done. He has announced that the federal government will not seek to deport 600,000 young people who were illegally brought to the U.S. as children, or the undocumented parents of U.S. citizens and permanent residents who have resided in the country for at least five years. Millions of parents would be able to remain with their children because of this order and not need to live every day in fear of deportation.
The judge’s order makes several basic legal mistakes. For example, the law is clear that a federal court has jurisdiction to hear a matter only if the federal court’s decision would solve the problem. If the court’s decision would have no effect, it would be nothing but an advisory opinion, which is prohibited by the Constitution. Thus, the Supreme Court long has held that a party has standing to sue in federal court only if a favorable decision would “redress” its injury.
The lawsuit in Hanen’s court was brought by state governments that object to the Obama orders, claiming injury by the presence of immigrants here illegally. But the federal government deports only about 400,000 such immigrants a year. It is entirely speculative that stopping the executive orders would have any effect on the states that brought the suit. In fact, it is unclear what the judge’s order will mean. He cannot force the Department of Homeland Security to deport anyone.
The central argument in Hanen’s ruling is that the executive branch must promulgate a formal rule to defer deportation of these individuals. But the federal government constantly sets enforcement priorities without a formal rule. The Justice Department’s policies to not prosecute possession of small amounts of marijuana or credit card fraud below a designated dollar level, for example, were not adopted by formal rules.
In fact, recent presidents, including Republican ones, have deferred deportations without formal rules. In 1987, in response to political turmoil in El Salvador and Nicaragua, the Reagan administration took executive action to stop deportations for 200,000 Nicaraguan exiles. In 1990, President George H.W. Bush, post-Tiananmen, stopped deportations of Chinese students. He kept hundreds of Kuwaiti citizens who were illegally in the United States from being deported after Saddam Hussein invaded their nation. In 2001, President George W. Bush limited deportation of Salvadoran citizens at the request of El Salvador’s president, and ordered that deportation decisions include consideration of factors such as whether a mother was nursing or whether the person in question was a U.S. military veteran.
Judge Hanen, appointed to the federal bench by George W. Bush, has the reputation of being especially conservative on immigration issues. That tone underlies his opinion, especially as he spoke of immigrants being “terrorists” and “criminals.” What he misses, though, is that the point of Obama’s executive orders was to set enforcement priorities to focus deportations on terrorists and criminals and not on breaking up families.
It is not surprising that a conservative Republican judge would try to stop the Obama immigration policy. But it is just the first word and one unlikely to be sustained on appeal.
