“Pity The Poor Immigrant”: How Jeb Bush Prevented Deportation Of An Illegal Alien And Terrorist
Between today and the first Republican primary of 2016, Jeb Bush surely will tell America exactly how government should cope with undocumented workers and their families. The former Florida governor, whose wife was born in Mexico, prompted headlines this week when his new book, Immigration Wars, seemed to abandon his earlier support for a “path to citizenship” in immigration reform and to adopt a much harder line — which he promptly dropped as well.
Unsurprisingly, Bush’s opinions on immigration are confused and confusing, not to mention ill-informed, which probably makes him a perfect leader for his party. He favored a path to citizenship for the undocumented when most Republicans opposed it; then his book warned that such a provision would encourage a renewed wave of illegal immigration; and now, as Republicans complain that he is out of step with their effort to court Latino voters, he is squirming away from his own book’s argument.
But no matter which direction Bush ultimately takes in the immigration debate, he can cite at least one Latino immigrant whose deportation he strived successfully to prevent, almost a quarter-century ago, when his father was president. The only drawback to this heartwarming humanitarian story is that the man whose cause Bush advocated was a bloodthirsty terrorist who was almost certainly responsible for the brutal murder of scores of innocent victims
In 1989, the Justice Department was seeking to deport one Orlando Bosch, a Cuban exile and anti-Castro militant who was then imprisoned for entering the United States illegally. Leaders of the Cuban-American community were agitating for Bosch’s release, although US law enforcement and intelligence authorities held Bosch culpable in many acts of brazen terror. Along with his suspected (and sometimes confessed) responsibility for various bombings and attacks on civilian and diplomatic targets, Bosch was believed to have overseen the sabotage of a Cuban airliner. The resulting explosion killed all 76 civilians aboard, including all the young members of Cuba’s Olympic fencing team, several passengers from other countries, and a pregnant mother. Corrupt Venezuelan prosecutors had failed to convict Bosch of this crime, but he publicly sought to justify the airliner bombing, almost to boast of it, when he wasn’t proffering unpersuasive denials. (He was also strongly suspected of running the conspiracy that blew up a car in Washington, D.C. in 1976 — an incident that killed Chilean diplomat Orlando Letelier and his assistant, American citizen Ronni Moffitt, in perhaps the most infamous assassination carried out by foreigners on American soil.)
Miami’s Cuban leaders considered Bosch their greatest hero and turned to Jeb Bush, then a budding businessman seeking real estate deals in South Florida, to prevent his deportation.
The Bush Justice Department wanted to deport Bosch because, according to the FBI, he had “repeatedly expressed and demonstrated a willingness to cause indiscriminate injury and death.” Attorney General Richard Thornburgh, a Bush appointee, denounced Bosch as “an unrepentant terrorist.” None of this deterred Jeb Bush from lobbying against Bosch’s deportation – and in the end, from persuading his father to pardon Bosch, which meant he could live freely and comfortably in Miami until his death in 2011 at the age of 85.
Eight years later, with the help of the same wealthy Cuban-Americans who had implored him to help Bosch, Jeb Bush had become a wealthy man and newly elected governor of Florida.
Now Bush has adopted a hard line against those who have disobeyed America’s immigration statutes. But his outrage over the flouting of those laws seems extremely selective: For the ordinary worker with impoverished family, no mercy; for the demented terrorist with powerful friends, no effort spared.

“And The Beat Goes On”: Is Jeb Bush Trying To Scuttle Immigration Reform?
In what appears to be a remarkable about-face, former Florida Gov. Jeb Bush on Monday stepped back from his previous position on immigration reform, telling NBC’s Today that he does not support a path to citizenship for immigrants who entered the country illegally. “I think there has to be some difference between people who come here legally and illegally,” Bush said. “It is just a matter of common sense and a matter of the rule of law. If we’re not going to apply the law fairly and consistently, we’re going to have another wave of illegal immigrants coming into the country.”
Bush is even more explicit in a forthcoming book called Immigration Wars: Forging an American Solution that he co-authored with lawyer Clint Bolick. According to Elise Foley at The Huffington Post, who nabbed a copy of the book before its official publication date, Bush and Bolick write, “It is absolutely vital to the integrity of our immigration system that actions have consequences — in this case, that those who violated the law can remain but cannot obtain the cherished fruits of citizenship.” They continue: “To do otherwise would signal once again that people who circumvent the system can still obtain the full benefits of American citizenship.”
Technically, Bush says he does support a path to citizenship, but only if undocumented immigrants return to their home countries and apply through legal channels. That is miles away from his previous stance on the issue. As recently as January, Bush and Book wrote the following in an op-ed for The Wall Street Journal (emphasis added):
A practicable system of work-based immigration for both high-skilled and low-skilled immigrants — a system that will include a path to citizenship — will help us meet workforce needs, prevent exportation of jobs to foreign countries and protect against the exploitation of workers…
America’s immigration system should provide opportunities for people who share the country’s core values to become citizens, thereby strengthening the nation as have countless immigrants have before them. [The Wall Street Journal]
In addition, Bush spent much of the 2012 presidential campaign criticizing Republicans — and by implication, standard-bearer Mitt Romney — for taking a hard-line stance on immigration. Bush’s new position has angered at least one member of the Romney campaign, according to The Miami Herald:
“Where the hell was this Jeb Bush during the campaign?” said one advisor. “He spent all this time criticizing Romney and it turns out he has basically the same position. So he wants people to go back to their country and apply for citizenship? Well, that’s self deportation. We got creamed for talking about that. And now Jeb is saying the same thing.”
Asked to respond, Bush said by email: “I am not advocating self deportation. Read the book.” [The Miami Herald]
What is the former Florida governor hoping to accomplish? There was immediate speculation that Bush, who is considered a possible presidential contender in 2016, is seeking to place himself to the right of Sen. Marco Rubio, a fellow Floridian who is leading a bipartisan effort to pass a comprehensive immigration reform bill that would likely include a pathway to citizenship for undocumented workers. When asked by NBC whether he was running for president, Bush left the door wide open. “I have a voice,” he said. “I want to share my beliefs about how the conservative movement and the Republican Party can regain its footing, because we’ve lost our way.” When pressed, he refused to rule out a run. “I won’t,” he said, “but I’m not going to declare today either.”
Others say that Bush’s shift reflects the stubborn fact that the GOP is not serious about comprehensive reform, despite Rubio’s efforts and the appeals of party leaders (one of whom used to be Bush himself). “If I had to hazard a guess,” writes Jamelle Bouie at The American Prospect, “this is another sign Republicans are moving away from comprehensive immigration reform, and towards something more piecemeal and less effective.”
And where does that leave Rubio’s proposal? According to Benjy Sarlin at Talking Points Memo:
“Wow,” Marshall Fitz, director of immigration policy at the liberal Center For American Progress, told TPM in an email. “For a guy who has been a luminary on this issue for the GOP, his endorsement of such a regressive policy is deeply troubling.”
The big question going forward, Fitz said, is “whether it cuts Rubio’s legs out from under him” by pressuring his right flank, or merely gives Rubio more power within the bipartisan gang negotiating a bill by demonstrating that conservative concerns about a bill are still a major hurdle that only he can address. “Mooching Off Medicaid”: Conservatives Like Big Government Just Fine When It Lines Their Pockets
Conservatives like to say that their position is all about economic freedom, and hence making government’s role in general, and government spending in particular, as small as possible. And no doubt there are individual conservatives who really have such idealistic motives.
When it comes to conservatives with actual power, however, there’s an alternative, more cynical view of their motivations — namely, that it’s all about comforting the comfortable and afflicting the afflicted, about giving more to those who already have a lot. And if you want a strong piece of evidence in favor of that cynical view, look at the current state of play over Medicaid.
Some background: Medicaid, which provides health insurance to lower-income Americans, is a highly successful program that’s about to get bigger, because an expansion of Medicaid is one key piece of the Affordable Care Act, a k a Obamacare.
There is, however, a catch. Last year’s Supreme Court decision upholding Obamacare also opened a loophole that lets states turn down the Medicaid expansion if they choose. And there has been a lot of tough talk from Republican governors about standing firm against the terrible, tyrannical notion of helping the uninsured.
Now, in the end most states will probably go along with the expansion because of the huge financial incentives: the federal government will pay the full cost of the expansion for the first three years, and the additional spending will benefit hospitals and doctors as well as patients. Still, some of the states grudgingly allowing the federal government to help their neediest citizens are placing a condition on this aid, insisting that it must be run through private insurance companies. And that tells you a lot about what conservative politicians really want.
Consider the case of Florida, whose governor, Rick Scott, made his personal fortune in the health industry. At one point, by the way, the company he built pleaded guilty to criminal charges, and paid $1.7 billion in fines related to Medicare fraud. Anyway, Mr. Scott got elected as a fierce opponent of Obamacare, and Florida participated in the suit asking the Supreme Court to declare the whole plan unconstitutional. Nonetheless, Mr. Scott recently shocked Tea Party activists by announcing his support for the Medicaid expansion.
But his support came with a condition: he was willing to cover more of the uninsured only after receiving a waiver that would let him run Medicaid through private insurance companies. Now, why would he want to do that?
Don’t tell me about free markets. This is all about spending taxpayer money, and the question is whether that money should be spent directly to help people or run through a set of private middlemen.
And despite some feeble claims to the contrary, privatizing Medicaid will end up requiring more, not less, government spending, because there’s overwhelming evidence that Medicaid is much cheaper than private insurance. Partly this reflects lower administrative costs, because Medicaid neither advertises nor spends money trying to avoid covering people. But a lot of it reflects the government’s bargaining power, its ability to prevent price gouging by hospitals, drug companies and other parts of the medical-industrial complex.
For there is a lot of price-gouging in health care — a fact long known to health care economists but documented especially graphically in a recent article in Time magazine. As Steven Brill, the article’s author, points out, individuals seeking health care can face incredible costs, and even large private insurance companies have limited ability to control profiteering by providers. Medicare does much better, and although Mr. Brill doesn’t point this out, Medicaid — which has greater ability to say no — seems to do better still.
You might ask why, in that case, much of Obamacare will run through private insurers. The answer is, raw political power. Letting the medical-industrial complex continue to get away with a lot of overcharging was, in effect, a price President Obama had to pay to get health reform passed. And since the reward was that tens of millions more Americans would gain insurance, it was a price worth paying.
But why would you insist on privatizing a health program that is already public, and that does a much better job than the private sector of controlling costs? The answer is pretty obvious: the flip side of higher taxpayer costs is higher medical-industry profits.
So ignore all the talk about too much government spending and too much aid to moochers who don’t deserve it. As long as the spending ends up lining the right pockets, and the undeserving beneficiaries of public largess are politically connected corporations, conservatives with actual power seem to like Big Government just fine.

“Scottie’s Star Trek Tricks”: Rick Scott’s Parallel Universe Of Ideological “Facts”
Via Think Progress, another item from the ever-increasing database of “facts” Republicans use to buttress ideologically dictated positions comes from everybody’s favorite health care expert, Florida Gov. Rick Scott.
Scott has been bruiting it about that his refusal to implement the Medicaid expansion provided for in the Affordable Care Act, which would have supplied health insurance to a cool million residents of that steamy state, was based on its vast cost: $26 billion over ten years in new state costs!
Them’s a lot of dollars, to be sure. But turns out Scott just kinda made the number up, or more accurately, didn’t bother to share the preposterous assumptions needed to generate it. Health News Florida explains:
The state’s chief economist has warned the staff of Gov. Rick Scott that his Medicaid cost estimates are wrong, but Scott keeps using them anyway, according to a series of e-mails obtained by Health News Florida.
Scott says he opposes expanding Florida Medicaid because it would cost too much: $63 billion over 10 years, he says, with the state paying $26 billion of that.
But those numbers are based on a flawed report, according to a legislative budget analyst and State Economist Amy Baker. A series of e-mails obtained by Health News Florida shows the analysts warned Scott’s office the numbers were wrong weeks ago, but he is still using them. He cited them in a Tampa Bay Times op-ed on Sunday and at at a Washington press conference on Monday.
The trumped-up number, it seems, comes from assuming the federal super-match for the expanded Medicaid coverage provided for in the ACA will never actually materialize. Why? Here’s the response from Scott’s “health policy coordinator,” Michael Anway:
Anway said he doesn’t believe the federal funds will come through. “The federal government has a $16 trillion national debt, must borrow 46 cents of every dollar it spends, and in 2011 had its credit rating downgraded for the first time in history,” he wrote in explanation.
So Scott is assuming the feds will renege on their statutory obligation to provide the Medicaid match. That’s a new one, and is particularly ironic since the only threat to the federal government defaulting on its spending obligations comes from Scott’s conservative buddies in Congress.
Truth is, the most authoritative estimate of state costs associated with the Medicaid expansion, from the Kaiser Family Foundation, put Florida’s costs at $1 billion over ten years, and that doesn’t even include potential savings from costs currently incurred by the state in uncompensated care for the uninsured.
So Scott’s costs estimates are off a mere 96%, at least. But what are facts when it comes to the ontological necessity of thwarting Obamacare and saving a million Floridians from the slavery of dependence on government?

“Incentivizing Incarceration”: Court Again Strikes Down Florida Attempt To Privatize Prison Health Care
A Florida court has ruled for the second time that the state Department of Corrections improperly circumvented the legislative process to privatize prison health care. Last October, some state legislators had attempted to privatize the state’s prison health care by folding the funding into budget proviso language. That attempt was held unconstitutional by a Florida judge, who said the legislature could only do so through a separate bill. The legislature then proposed a separate bill in February 2012 that, unsurprisingly, could not garner enough votes to pass.
But that failure wouldn’t satisfy legislators bent on outsourcing the state’s prison health care to private corporations. This time, they were able to include in the legislature-reviewed appropriations bill funding for private prisons in one South Florida region. Seeking to also privatize prison health care in three other regions, the Department of Corrections sought additional funding from the state’s Legislative Budget Commission rather than the full legislature. The LBC granted funds for all four regions and increased the budget from 41 million to 58 million — a move also struck down by Leon County Judge Jackie Fulford:
Whether to privatize some or all of the state’s prison operations is a significant policy decision. Under existing law, the legislature weighs in on this policy decision through its appropriations power. Where, as here, there is no specific appropriation for privatizing health services in Regions I, II or III, it cannot be said that such a significant action has been approved or authorized. […]
Authorizing and funding privatizing health care services in Florida’s prisons is the prerogative of the full legislature and not that of the Legislative Budget Commission.
Even at the time of the vote, some members of the Legislative Budget Commission questioned the legality of expanding funding for private prison health care. But the state nonetheless entered into a contract with Corizon Healthcare to serve those three regions, and forged ahead with notices to nearly 2,000 state workers who would be laid off as a result of the move.
Privatization of health care for nearly 100,000 inmates was billed as a way to cut costs, in part because prison officials anticipated the private companies would offer less benefits to their workers. But studies in other states have shown that private prisons actually cost the state more, while enabling “inhumane” conditions and prompting allegations of preventable deaths. Privatization of the prison system has also incentivized private corporations to lobby for policies that incarcerate more Americans. The United States already has the world’s highest incarceration rate.
