“Giving Republicans A Pass”: Media Mantra, It’s Congress That’s Historically Unproductive, Not The GOP

As the calendar races towards 2014, and Congressional members log their final few days in session while facing daunting deadlines for a long list of pressing and unfinished initiatives, the press has been busy chronicling the futility, assigning collective blame, and giving the president permanent failing marks.

According to historians, 2013 is on track to become the least productive single legislative year in modern American history. And it’s not even close. In 1995, 88 laws were passed, setting the previous low-water mark. This year, it’s doubtful 70 will make it to the president’s desk. (And lots of the bills that have passed are ceremonial or rather trivial in nature.) The press is not happy about the trend.

“The paltry number of bills Congress has passed into law this year paints a vivid picture of just how bad the gridlock has been for lawmakers,” announced NBC. The Wall Street Journal noted this year’s session has been “long on partisanship, indecision and brinkmanship.” USA Today bemoaned the inability “to find common ground.” And the Los Angeles Times pointed to “partisan dysfunction” as the main Congressional culprit.

See? “Congress” remains in the grips of “gridlock” and “brinkmanship.” Congress just can’t find “common ground” and suffers from serious “dysfunction.”

So that’s why immigration reform, the farm bill, a budget deal, unemployment benefit extensions, workplace discrimination legislation, and the defense spending bill haven’t been passed or dealt with yet? And that’s why the government was shutdown for 16 days in October?

Bipartisan gridlock!

Wrong. The current Congress obliterated all previous records for diminished output because the Republican Party, and especially those in the Republican-run House, purposefully bottled up as many initiatives as possible and unleashed “procedural sabotage.” (They even obstructed disaster relief aid for victim of Hurricane Sandy.)

Yet eager to maintain a political symmetry in which both sides are equally responsible for so little getting accomplished, the press gives Republicans a pass for their purposeful dysfunction.

By the way, are you also experiencing media flashbacks to the government shutdown, which the Republican Party proudly engineered by reneging on a budget deal they had agreed to with the last-minute demand that Obama essentially repeal his signature legislative accomplishment of his first term, the Affordable Care Act? Back then, the one-sided shutdown maneuver was nearly universally portrayed as bipartisan “Washington dysfunction at its absolute worst” (ABC News), a “partisan logjam” (Wall Street Journal), and a “fiscal stalemate” (The Hill).

Yet today, even as some Republican members brag about how little they’ve allowed Congress to accomplish, even as a plurality of voters says the GOP’s top priority is to cause trouble for the president, while a majority blame Republicans for the lack of productivity in Washington, the press still prefers to portray the Capitol Hill standstill as bipartisan “gridlock.”

Because, of course, both sides are always to blame.

But they’re not. Look at the Employment Non-Discrimination Act. In a rare example of fleeting bipartisanship, the bill to prohibit most employers from discriminating based on sexual orientation was approved by the Senate 64-32 last month. In the House, there are more than enough votes from both parties to pass ENDA into law, but Speaker of the House John Boehner will not allow a vote.

The same goes for immigration reform. It passed by an even larger margin in the Senate (68-32), and likely enjoys even more bipartisan support in the House. But again, Boehner won’t allow members to vote on the bill. He won’t even allow the House to enter into negotiations with the Senate to try to hammer out a final bill.

So how is it “gridlock” when a bipartisan, filibuster-proof majority in the Senate and a clear bipartisan majority in the House support a bill but aren’t allowed to vote on its final passage?

Politically, the sabotage strategy works for Republicans. At least in the short term. Note that Obama’s standing among Hispanic voters has dropped precipitously this year. Analysts assume that’s because Obama hasn’t delivered on his promise to pass immigration reform. That may also be because so little of the news coverage stresses the poignant fact that the bipartisan votes are there to pass immigration reform, it’s just that Republican leaders in the House won’t allow the “yes” vote to take place. They won’t allow Obama to take credit for passing a popular law.

And yes, it really did become a scorched-earth situation this year; a nearly across-the-board effort to sabotage Obama’s every move. Republicans aren’t just denying the president the ability to sign meaningful bills into law. The unprecedented minority strategy includes hardcore attempts to block his cabinet picks, executive branch appointments, and judicial nominees. And specifically, blocking judicial nominees who Republicans agree are completely qualified to sit on the federal bench.

But still unsure what to call the Republican brand of anarchy, the press continues to play dumb about the magnitude of the planned interference. For instance, amidst the sabotage, the New York Times reported that while judicial nominations remain an issue of deep contention, “Among senators of both parties, there is agreement that a president should be granted deference in picking members of his cabinet and top executive branch positions.”

False.

Last November, Republicans launched an unprecedented, preemptive campaign to make sure Susan Rice was not picked as Obama’s next Secretary of State. Then they engineered an unprecedented campaign to try to stop Republican Chuck Hagel from becoming Secretary of Defense. And as late as July, two of Obama’s nominated cabinet picks still hadn’t received votes in the Senate, thanks to determined obstruction.

So no, contrary to the Times reporting there is no widespread agreement that presidents should be able to pick their cabinet members and top executive branch positions. There used to be. Then Republicans ripped up that pact. The Times and others just won’t say so as they blame both sides for a do-nothing Congress.

“Five Days Of Togetherness”: Congress’ Holiday To-Do List Will Never Be Finished

The House of Representatives is back in session this week and facing a laundry list of issues that were not dealt with in the first 11 months of the year. The House plans to be in session for two weeks, sending members home for the rest of the year on Friday, Dec. 13. Friday the 13th; that seems like a bad omen. And it may, indeed, be a very unlucky day for the nation if the House really does adjourn for the year.

The Senate, on the other hand, is not back in session until Dec. 9 and plans to stay in town until Dec. 20. For everyone keeping track, that means the two chambers will only be in town at the same time for five “working” days.

If the Congress had been doing its job all year, this scheduling mismatch might not be such a problem. But it hasn’t. Not a single regular appropriations bill funding a government department or agency for the coming fiscal year has passed the Senate. The House has passed four of 12 required spending bills. Even if there was no other business to do, Congress could not complete the remaining work to fund government for the rest of fiscal year 2014 in a single week of “togetherness” in Washington.

And there is other business to do. The conference of the House and Senate Budget Committees, the result of the deal that ended the government shutdown, has apparently made progress in the last week, but hopes are not high for any real solution to the long-term budget problems facing the nation. A narrow agreement to set spending limits that will replace sequestration with other revenue or cuts for the next two years may be better than nothing … or it may not. The devil is always in the details and we don’t know the details yet. The deadline for those negotiations to conclude is also Friday the 13th, but that deadline has no real teeth since the current continuing resolution to keep the government funded doesn’t expire until Jan. 15 of next year.

The bill setting policy for the Department of Defense, a bill that has been successfully passed and signed into law every year for more than 50 years, has not been passed by the Senate. The House finished its work in June. This bill was on the Senate floor when Majority Leader Harry Reid, D-Nev., brought up the resolution that finally granted the Senate majority the so-called “nuclear option,” changing Senate procedure to allow most executive branch and judicial nominations to be resolved with a simple majority vote.

And speaking of confirmations, that brings up another deadline. The Senate needs to confirm a new chairman of the Board of Governors of the Federal Reserve System by Jan. 31, 2014, the expiration of Chairman Ben Bernanke’s term.

But that’s not all Congress has on its “must pass” list. The current farm bill extension expired on Sept. 30, but that doesn’t have much impact. Nutrition programs continue, crop insurance never expires. But on Jan. 1, taxpayers meet the dreaded “dairy cliff.” This is when the administration, because of 60-year old laws aggies refuse to repeal, will have to take us back to 1950s era dairy policy and guarantee milk producers artificially high prices resulting in as much as $8 per gallon milk on a grocery store shelf near you. (Of course, another alternative is that Congress could simply repeal the outdated law and allow the market to set milk prices. But we know that is too logical of an action for this Congress to take).

The fiscal cliff deal made a permanent fix for the encroaching alternative minimum tax, but another hardy perennial, the Medicare doctor payment fix, was left out. This would reduce the payments to doctors under Medicare. While it was adopted as a budget control measure, it’s been legislatively “fixed” each year. That issue looms.

Also, there’s the tax extenders package. That’s the cat and dog mix of various special interest tax breaks benefitting everyone from NASCAR track owners to liquor distillers that gets tacked on to moving pieces of legislation every year. Except this year there doesn’t seem to be moving legislation to hitch the caboose to.

Remember, the House and the Senate currently plan to be together in Washington for only five days in December. Perhaps they will have a burst of efficiency and effectiveness by Dec. 20, but I’m not holding my breath.

“Prudence Or Cruelty?”: Slashing Food Stamps Is A Mark Of Shortsighted Cruelty

When members of Congress debate whether to slash the food stamp program, they should ask if they really want more small children arriving at school having skipped breakfast.

As it is, in the last few days of the month before food stamps are distributed, some children often eat less and have trouble focusing, says Kisha Hill, a teacher in a high-poverty prekindergarten school in North Tulsa, Okla.

“Kids can’t focus on studying when their stomachs are grumbling,” Hill told me.

Some 47 million Americans receive food stamps, including some who would otherwise go hungry — or hungrier. A recent government study found that about 5 percent of American households have “very low food security,” which means that food can run out before the end of the month. In almost a third of those households, an adult reported not eating for an entire day because there wasn’t money for food.

Meanwhile, 14 percent of American toddlers suffer iron deficiency. Malnutrition isn’t the only cause, but it’s an important one — and these children may suffer impaired brain development as a result. This kind of malnutrition in America is tough to measure, because some children are simultaneously malnourished and overweight, but experts agree it’s a problem. We expect to find malnourished or anemic children in Africa and Asia, but it’s dispiriting to see this in a country as wealthy as our own.

Let me take that back. It’s not just dispiriting. It’s also infuriating.

“The cutback in food stamps represents a clear threat to the nutritional status and health of America’s children,” says Dr. Irwin Redlener, the president of the Children’s Health Fund and a professor of pediatrics at Columbia University. Dr. Redlener said that one result of cutbacks will be more kids with anemia and educational difficulties.

Food stamp recipients already took a cut in benefits this month, and they may face more. The Senate Democratic version of the farm bill would cut food stamps by $4 billion over 10 years, while the House Republican version would slash them by $40 billion.

More than 90 percent of benefits go to families living below the poverty line, according to federal government data, and nearly two-thirds of the recipients are children, elderly or disabled.

Let’s remember that the government already subsidizes lots of food. When wealthy executives dine at fancy French restaurants, part of the bill is likely to be deducted from taxes, which amounts to a subsidy from taxpayers. How is it that food subsidies to anemic children are more controversial than food subsidies to executives enjoying coq au vin?

Meanwhile, the same farm bill that is hotly debated because of food stamps includes agricultural subsidies that don’t go just to struggling farmers but also, in recent years, to 50 billionaires or companies they are involved in, according to the Environmental Working Group, a Washington research group.

Among the undeserving people receiving farm subsidies has been a New York Times columnist. Yes, I have been paid $588 a year not to grow crops on wooded land I own in Oregon (I then forward the money to a maternity hospital in Somaliland). When our country pays a New York journalist not to grow crops in an Oregon forest, there’s a problem with the farm bill — but it’s not food stamps.

Granted, safety-net spending is more about treating symptoms of poverty than causes, and we may get more bang for the buck when we chip away at long-term poverty through early education, home visitation for infants, job training and helping teenagers avoid unwanted pregnancies.

That said, food stamps do work in important ways. For starters, they effectively reduce the number of children living in extreme poverty by half, according to the Center on Budget and Policy Priorities in Washington.

By improving nutrition of young children, food stamps also improve long-term outcomes. In recent years, mounting scholarship has found that malnutrition in utero or in small children has lasting consequences. One reason seems to be that when a fetus or small child is undernourished, it is programmed to anticipate food shortages for the remainder of its life. If food later becomes plentiful, the metabolic mismatch can lead to diabetes, obesity and heart disease.

An excellent study last year from the National Bureau of Economic Research followed up on the rollout of food stamps, county by county, between 1961 and 1975. It found that those who began receiving food stamps by the age of 5 had better health as adults. Women who as small children had benefited from food stamps were more likely to go farther in school, earn more money and stay off welfare.

So slashing food stamp benefits — overwhelmingly for children, the disabled and the elderly — wouldn’t be a sign of prudent fiscal management by Congress. It would be a mark of shortsighted cruelty.

“Casting Aside The Weak And Fragile”: Cuts To Food Stamp Program Reveal Congressional Hypocrisy

For decades, I’ve proudly asserted that “nobody starves to death in America.” The comment has been addressed to acerbic critics of the American government, often foreign visitors, who insist that the United States is a mean-spirited place that casts aside its weak and fragile citizens.

I still contend that nobody starves to death here, but I’ve had to modify my claims about the country’s social safety net. Even if no one dies for lack of basic nutrition, plenty of people go to bed hungry every night. And if Congress’ harsh Republican caucus has its way, some may starve.

That’s because the band of ultraconservatives who control the House are bent on deep cuts to the Supplemental Nutrition Assistance Program (SNAP), otherwise known as food stamps. They passed a farm bill laden with welfare for farmers, but they left out one of its biggest traditional components: food stamps. It was the first time since 1973 that the nutrition program had been left out of the farm bill.

Now, negotiations have started between the Senate and the House to try to reconcile the upper chamber’s more charitable version with the one the lower chamber put together. It will be a tough slog since the two bills are billions of dollars apart. The Senate wants to cut $4 billion from SNAP over 10 years, while the House wants to cut nearly $40 billion.

Perhaps the most appalling thing about the farm bill presented by the ultraconservatives in the House is that it makes little pretense of cutting spending by ferreting out wastefulness or fraud, no feint at an all-out assault on the deficit. Instead, this is just a base and ugly assault on the working poor.

Oh, conservatives claimed that their cuts to food stamps were in response to fraud, as their claque filled the airwaves with the same example of a carefree California surfer enjoying his “wonderful” life on food stamps. They neglected to point to government data which show that SNAP is among the most efficient of government programs, with fraudulent spending restricted to about 2 percent of its budget.

Meanwhile, the same conservatives have said nothing — nothing — about the millions of dollars in fraud related to farm subsidies. A June audit by the Government Accountability Office found that millions of dollars in subsidies have been sent to farmers who’ve been dead for at least a year. That’s just the illegal stuff.

That doesn’t touch the entirely legal fraud: The entire network of agricultural subsidies is a massive boondoggle, welfare to people who hardly need it. While conservatives hector the working poor about their alleged laziness, some agricultural programs pay farmers not to plant. Why don’t Fox News and Rush Limbaugh ever talk about that?

Farmers hardly need the money. (Forget about the struggling family farmer of lore. He has largely disappeared.) Earlier this year, the Agriculture Department projected that farm income in 2013 would be $128.2 billion, the highest since 1973.

One of the more egregious examples of the sheer hypocrisy surrounding the debate over the farm bill was revealed by The New York Times, which wrote about U.S. Rep. Stephen Fincher (R-TN). He voted for the bill that eviscerates SNAP, but he received nearly $3.5 million in farm subsidies from the government between 1999 and 2012, according to the Times.

“We have to remember there is not a big printing press in Washington that continually prints money over and over,” he said, apparently without irony.

Conservatives claim to be alarmed by the dramatic increase in food stamp outlays, up 77 percent since 2007 to a record high of $78.5 billion in fiscal year 2012. (The SNAP program is already scheduled for a 5 percent cut as a provision related to the 2009 stimulus bill lapses.) But that’s because so many more people are struggling to make ends meet.

The Great Recession accelerated a trend that has hollowed out the middle class, leaving many Americans without college degrees in a downward spiral. The U.S. Department of Agriculture estimates that nearly 49 million Americans are “food insecure” — bureaucratese that means they don’t have enough to eat.

If we aren’t willing to see to it that they have basic nutrition, I’ll have to reconsider what I believe about my country.

“The Republicans’ Food Stamp Fraud”: Telling Poor Children The Fourth Box Of Macaroni And Cheese Is Excessive Is Indecent

What’s the single worst thing the Obama-era Republicans have done? Tough one, I know.

But spare me a moment here—plus a thousand words down the page—and I think maybe you’ll agree with me that the single worst thing the Obama-era Republicans have done is try to push through a $40 billion cut to the food-stamps program. It’s just unspeakably cruel. They usually say publicly that it’s about saving money. But sometimes someone—one congressman in particular—lets slip the real reason: They want to punish poor people. The farm bill, which includes the food-stamp program, goes to conference committee next week. That’s where, the cliché has it, the two sides are supposed to “iron out their differences.” The only thing the Democrats on this committee should do with an iron is run it across the Republicans’ scowling faces.

The basic facts on the program. Its size fluctuates with the economy—when more people are working, the number of those on food stamps goes down. This, of course, isn’t one of those times. So right now the SNAP program, as it’s called, is serving nearly 48 million people in 23 million households. The average monthly individual benefit is $133, or about $4.50 a day. In 2011, 45 percent of recipients were children. Forty-one percent live in households where at least one person works. More than 900,000 are veterans. Large numbers are elderly or disabled or both.

It’s costing about $80 billion a year. Senate Democrats proposed a cut to the program. A small cut, but a cut all the same: $4 billion over 10 years. The Republicans in the House sought a cut of $20.5 billion over 10 years. But then the farm bill failed to pass. Remember that? When John Boehner didn’t have enough votes to pass his own bill?  After that debacle, the House took the farm bill and split it into two parts—the subsidies for the large growers of rice and cotton and so forth, and the food-stamp program. Two separate bills. And this time, Eric Cantor doubled the cut: $40 billion over 10 years. This number, if it became law, would boot 3.8 million people—presumably, nearly half of them children—off the program in 2014, according to the Congressional Budget Office.

These would come on top of cuts to the program that kick in Nov. 1. The 2009 stimulus bill included extra food-stamp money because unemployment was so high after the financial meltdown that legislators knew more people would be applying for SNAP assistance. So there was a “stimulus bump” in food-stamp spending, but that is now ending. A family of four would see a $46 cut each month.

The proposed GOP cut is such a piddling amount of money, in terms of the whole federal budget and especially when spread out over 10 years. But nearly half of it is quite literally taking food out of the mouths of children. What’s the point? The point really is that Tea Party Republicans think these people don’t deserve the help. That’s some fascinating logic. The economy melts down because of something a bunch of crooked bankers do. The people at the bottom quarter of the economy, who’ve been getting jobbed for 30 years anyway and who always suffer the most in a downturn, start getting laid off in huge numbers. They have children to feed. Probably with no small amount of shame, they go in and sign up for food stamps.

And what do they get? Lectures about being lazy. You may have seen the now-infamous video of Tennessee Congressman Steve Fincher, who told a crowd over the summer that “the Bible says ‘If you don’t work, you don’t eat.’” This while Fincher, a cotton farmer, has enjoyed $3.5 million in federal farm subsidies. This year’s House bill ends “direct payments” to farmers whether they grow any crops or not—except for one kind: cotton farmers.

Religious bloggers have noted that Fincher got his theology wrong and that the relevant passage, from Paul’s Second Epistle to the Thessalonians, wasn’t remotely about punishing people too lazy to work. It was about punishing people who’d stopped working because they thought Jesus was returning any day now. So: mean bastard, hypocrite, and Scripture-mangling idiot to boot. Nice trifecta.

The other argument one sometimes hears concerns the dreadful curse of food-stamp fraud. The actual rate of food-stamp fraud—people selling their coupons for cash—is 1.3 percent, but this of course doesn’t prevent the right from finding a couple of garish anecdotes and making it seem as if they’re the norm. Voter fraud, Medicaid fraud, food-stamp fraud…Somehow, in Republican America, only poor people and blacks commit fraud.

This cut is the fraud, because it’s not really about fraud or austerity. It’s entirely about punishing the alleged 47 percent. The bottom half or third of the alleged 47 percent. It’s absolutely appalling. These folks have done a lot of miserable things in the past four years. But this—the morality of this is so repulsively backward, the indecency so operatically and ostentatiously broadcast, I think it takes the gold going away.

The conference process starts next Wednesday and is going to take maybe a few months. Michigan Senator Debbie Stabenow has taken the lead on this issue and has been terrific. Ditto Pat Leahy. Max Baucus, I’m told, is a good get to go a little wobbly (surprise). But this is one where the Democrats have to say this won’t stand. It’s one thing to shut down the government for two weeks and take quixotic stabs at Obamacare. Telling poor children that that fourth box of macaroni and cheese is excessive is something very different.
