“Manifestly Immoral And Clearly Illegal”: Senate Report Shows That The U.S. Answered Evil With Evil

The “debate” over torture is almost as grotesque as torture itself. There can be no legitimate debate about the intentional infliction of pain upon captive and defenseless human beings. The torturers and their enablers may deny it, but they know — and knew from the beginning — that what they did was obscenely wrong.

We relied on legal advice , the torturers say. We were just following orders. We believed the ends justified the means. It is nauseating to hear such pathetic excuses from those who, in the name of the United States, sanctioned or committed acts that long have been recognized as war crimes.

According to the Senate intelligence committee report on the treatment of detainees after the 9/11 attacks, members of a CIA interrogation team were “profoundly affected . . . some to the point of tears and choking up” at the brutal treatment in 2002 of an important al-Qaeda detainee named Abu Zubaida.

Captured in Pakistan and whisked to a secret facility in Thailand, Zubaida was initially cooperative, willingly providing answers under normal, non-coercive questioning. But the CIA abruptly halted his interrogation, placed him in isolation for 47 days and then began a regime of astonishing and gratuitous cruelty.

Torturers slammed him against walls, confined him in coffin-size boxes for a total of nearly 300 hours and subjected him to 83 sessions of waterboarding, which simulates drowning — a practice for which Japanese war criminals were tried, convicted and harshly punished following World War II. After one waterboarding assault, according to the Senate report, Zubaida was “completely unresponsive, with bubbles rising through his open, full mouth.”

In all, 119 detainees were held in the CIA’s archipelago of secret prisons, according to the report; at least 26 of them were wrongfully detained and never should have been arrested in the first place.

The report says 39 prisoners were tortured with what the administration of George W. Bush and Dick Cheney called “enhanced interrogation techniques” — a chilling bit of Orwellian newspeak. They were kept awake for up to 180 hours, often standing, sometimes in “stress” positions designed to induce pain. Their arms were shackled above their heads. They were stripped naked and placed in ice baths. At least five prisoners were subjected to “rectal rehydration” or “rectal feeding.” While the CIA says only three detainees were waterboarded, Senate investigators found waterboarding equipment at a site where supposedly no such torture took place.

We know of two men who were tortured to death. One of them, Gul Rahman, was held at a facility in Afghanistan that the Senate report refers to as COBALT, described in a CIA memo as a “dungeon.” Rahman was put in a dank, frigid cell wearing only a shirt — no pants or underwear — and chained so that he had to sit or lie on a bare concrete floor. He was found dead the next morning, apparently of hypothermia. The other man, Manadel al-Jamadi, died in the notorious Abu Ghraib prison in Iraq after being beaten and shackled to a window.

The report seeks to demonstrate that the torture was useless because valuable information in the fight against al-Qaeda came from conventional interrogation methods, not the brutal treatment. Torture’s apologists — including Cheney, who says he’d “do it again in a minute” — claim otherwise. This dispute cannot be settled. No one can say that a name, date or phone number extracted by torture could never have been obtained by other means.

But efficacy is not the point. What matters is not whether torture produces more information or less. What matters is that torture is manifestly immoral — and clearly illegal under U.S. and international law.

The CIA says it relied on Bush administration legal opinions attesting that torture is not really torture. The Senate report shows, however, that the CIA was less than honest in its representations to the Justice Department lawyers about what was being done to the detainees. Again, this argument misses the big picture: Those who ordered and committed torture would not be so eager to hide behind a paper-thin legalistic veneer if they truly believed what they did was right.

Why would the CIA officer in charge of the program destroy all videotapes of waterboarding sessions? Why would the agency fight the Senate investigators so fiercely, at one point hacking into the committee’s computers? Why would there be such a coordinated attempt by torture’s apologists to steer the “debate” toward subsidiary questions and away from the central issue?

There is only one answer: They decided to answer evil with evil rather than with justice. And they knew it was wrong.

“Miscreants Escaping Accountability”: The Senate Torture Report; Crimes Without Punishment

With the release of the Senate Select Committee on Intelligence report on the use of torture by the Central Intelligence Agency after 9/11, the final defense of the indefensible by its perpetrators, advocates, and publicists is falling apart before our eyes.

Not only did “enhanced interrogation,” the Nazi euphemism adopted by the Bush-Cheney administration, employ methods outlawed and prosecuted by our country for more than a century, such as waterboarding; and not only did those “activities,” as Dick Cheney called them, violate American law, the Constitution, the Geneva Conventions, and the conventions on torture; but we now know with great certainty that the agency executed this secret program with horrific incompetence — and that it produced nothing of significant value.

Indeed, the Senate Intelligence report concludes, contrary to the boasting of Cheney and many others, that torture was proved “not an effective means of gathering intelligence,” let alone saving millions of Americans from jihadi plots, and actually “complicated and in some cases impeded the national security missions.” The overseers of the torture program, themselves of dubious competence, were unable even to assess the impact or effectiveness of their orders.

As Micah Zenko of the Council on Foreign Relations points out, the CIA itself has admitted, in its otherwise aggressive response to the SSCI, that it lacked the “structure, expertise, and methodologies” to “systematically evaluate the effectiveness of our covert programs. They literally didn’t know what they were doing. But they were doing grave damage to themselves and to us.

Unavoidably, the Senate Intelligence report dwells on the details of these true nightmares, revealing facts that anyone would regret learning: the “rectal rehydration” of detainees by shoving food up the wrong way, with the infliction of excruciating pain; the “black sites” where detainees were held for months in total darkness, loud music constantly playing, and only a bucket for their waste; the cells where detainees suffered such freezing temperatures that at least one died of hypothermia overnight; the beatings, the near-drownings, the constant infliction of pain, hunger, and threats of rape and murder.

According to the report, some episodes of interrogation were so blatantly sadistic and so obviously criminal that the men who witnessed them actually wept. More than one officer broke down and fled, through retirement or transfer, while the White House and the Pentagon continued to lie about the extent – and the supposed necessity – of these unprecedented crimes. Those lies were designed to prevent investigations or oversight from revealing the horrific facts that are now emerging.

Yet despite a long and ongoing cover-up –and notwithstanding the specific revelations highlighted in the report – the basic outline has been known since 2009, when portions of the CIA inspector general’s report on torture were released by the Obama Justice Department in 2009.

Back then, the spy agency’s own investigation – in the words of a Bush appointee and torture enthusiast — “[found it] difficult to determine conclusively whether interrogations have provided information critical to interdicting specific imminent attacks.” In other words, the agency could never prove any instance when the sole justification for these gross violations of US and international law – breaking up a plot targeting American lives – had been fulfilled since 9/11. And unsurprisingly, that is still the case.

The searing issue we now confront, as a society governed by law, is that these lawbreakers will not be prosecuted or even required to testify publicly about their grave offenses. The Obama administration is apparently willing to expose their lawlessness, but unable to do anything to punish it. Even the executive director of the American Civil Liberties Union, Anthony Romero, has abandoned any hope of prosecutions, noting that the torturers have in effect been pardoned. Romero has urged President Obama to make those pardons official – which would at least stamp the actions of the torturers and their accomplices as crimes.

What we have needed for years, but evidently will never get, is a truth and reconciliation process that might have granted freedom from prosecution to witnesses who testified publicly, honestly, and completely about the crimes of the Bush administration. Instead, those miscreants will escape accountability altogether – except in the pages of history, where the Senate Intelligence report will indict them over and over again.

“Getting In Touch With His Inner Dick Cheney”: Can Marco Rubio Bomb His Way Back Into The Right’s Good Graces?

Yes, it’s suddenly a fine time once again to be a Republican super-hawk, what with the GOP rank-and-file getting back in touch with their inner Dick Cheney, and even Rand Paul getting all macho about “destroying” IS. At that neocon fortress, the Weekly Standard, Stephen Hayes can’t help but gloat.

The Republican flirtation with dovish noninterventionism is over. It wasn’t much of a fling.

No, it wasn’t.

Hayes quickly warms to the idea that this new mood of joy in blowing things up overseas as well as at home will be a big factor in 2016. And though he mentions Paul’s back-tracking and some upcoming “big” speech by Bobby Jindal on defense (presumably because his effort to be the most ferocious Christian Right figure in the campaign hasn’t much worked), Hayes has no doubt who the biggest beneficiary will be:

Among the most-discussed prospective candidates, the reemergence of these issues probably benefits Marco Rubio as much as anyone. Rubio, who serves on both the Senate Foreign Relations and Intelligence committees, has made a priority of national security since his arrival in Washington in January 2011. And it was a point of emphasis for him in the 2010 campaign that sent him to Congress.

According to several people close to Rubio, the senator has not made a final decision about whether he’ll run for president in 2016. But a recent interview made clear that if he does run, he will do so as a proponent of U.S. global leadership and military dominance.

Not immigration reform? Just kidding.

Rubio called for dramatic increases in defense spending. He said the United States should be prepared to send ground troops to Iraq if necessary to defeat ISIS. He argued that the United States must “be able to project power into multiple theaters in the world.” He said that the United States should embrace its role as a superpower and “conduct a multifaceted foreign policy.”

For the first time, I’m seeing a glimmer of how Rubio might be able to overcome the horrendous damage he suffered among conservative activists with his advocacy of comprehensive immigration reform. His frantic back-tracking on that subject has simply reinforced the impression that he can’t be trusted. But being the chief bomb-thrower in the field–literally, not figuratively–could covereth a multitude of sins. From the emotional point of view of “the base,” wanting to kill a lot of dusky people is a decent substitute for wanting to keep a lot of dusky people from entering the country and going on welfare.

Hayes does go too far in suggesting that the militaristic mood in the GOP could go so far as to lure still another candidate in the race–one whose name would normally arouse widespread hoots of derision:

In a recent, hour-long interview, Lindsey Graham said if he is reelected to the Senate in November, he will begin exploring a bid for the presidency.

Be still, my heart. The prospect of a 2016 presidential cycle played out against the background of Lindsey Graham squawking hysterically about terrorist threats is almost too much to bear.

“de-Baathification Program”: Bush/Cheney Created Conditions That Led Directly To ISIL

It takes a lot of gall for people like Dick Cheney to utter even one critical word about President Obama’s strategy to eliminate the threat of ISIL in the Middle East.

In fact, it was the unnecessary Bush/Cheney Iraq War that created the conditions that led directly to the rise of the “Islamic State in Iraq and the Levant” (ISIL).

Former George H.W. Bush Secretary of State James Baker said as much on this week’s edition of “Meet the Press.” He noted that after the first President Bush had ousted Saddam Hussein from Kuwait in 1991, the U.S. had refrained from marching on Baghdad precisely to avoid kicking over the sectarian hornet’s nest that was subsequently unleashed by the Bush/Cheney attack on Iraq in 2003.

But it wasn’t just the War in Iraq itself that set the stage for the subsequent 12 years of renewed, high-intensity sectarian strife between Sunni’s and Shiites in the Middle East. It was also what came after.

Bush’s “de-Baathification program” eliminated all vestiges of Sunni power in Iraqi society and set the stage for the Sunni insurrection against American occupation and the new Shiite-led government. Bush disbanded the entire Sunni-dominated Iraqi Army and bureaucracy. He didn’t change it. He didn’t make it more inclusive of Shiites and Kurds. He just disbanded it. It is no accident that two of the top commanders of today’s ISIL are former commanders in the Saddam-era Iraqi military.

General Petraeus took steps to reverse these policies with his “Sunni Awakening” programs that engaged the Sunni tribes against what was then known as Al Qaeda in Iraq. But the progress he made ultimately collapsed because the Bush/Cheney regime helped install Nouri Al-Maliki as Prime Minister who systematically disenfranchised Sunnis throughout Iraq.

And that’s not all. The War in Iraq — which had nothing whatsoever to do with “terrorism” when it was launched — created massive numbers of terrorists that otherwise would not have dreamed of joining extremist organizations. It did so by killing massive numbers of Iraqis, creating hundreds of thousands of refugees, imprisoning thousands, and convincing many residents of the Middle East that the terrorist narrative was correct: that the U.S. and the West were really about taking Muslim lands.

And after all, contrary to Dick Cheney’s absurd assertion that U.S. forces would be greeted in Iraq as “liberators,” no one likes a foreign nation to occupy their country.

The War did more than any propagandist could possibly do to radicalize vulnerable young people. And by setting off wave after wave of sectarian slaughter it created blood feuds that will never be forgiven.

The Iraq War — and the Sunni power vacuum caused first by U.S. policies and then Al Maliki — created the perfect conditions that allowed a vicious band of extremists to take huge swaths of territory.

And now many of the same people who caused this foreign policy disaster have the audacity to criticize President Obama’s measured efforts to clean up the mess they created. And they do so often without ever saying what they themselves would do to solve the horrific problems that they created.

It reminds you of a bunch of arsonists standing at the scene of a fire criticizing the techniques used by the firefighters who are trying to extinguish the blaze they themselves have set.

Oh, they say: “If you had just left a residual force after the withdrawal of U.S. troops everything would be hunky dory.”

Do they really think that several thousand U.S. troops would have solved Iraq’s problems when hundreds of thousands failed to do so?

And of course they conveniently forget to mention that neither the Iraqi’s nor the U.S. voters wanted a “residual” force to remain in Iraq. And they forget that the Iraqi government would not agree to conditions that would allow a “residual” force to be stationed in Iraq.

Or perhaps they wish U.S. troops were now going door to door in Iraq cities rooting out adherents to ISIL? Only a few neo-con die-hards want more U.S. troops on the ground in the Middle East.

Or then there is the refrain that President Obama should have helped “arm” the moderate Syrian opposition earlier. Let’s remember that had he acted at an earlier point it is entirely likely that many of those arms would now be in ISIL hands — and we must be extremely careful even now to avoid precisely that problem in the days ahead.

The president’s response to ISIL is supported by almost two-thirds of Americans because it seems to be the only reasonable response where the cure is not worse than the disease.

It recognizes that the problem posed by ISIL must first and foremost be dealt with by other Sunni’s in the region. It is aimed at building an international coalition to degrade and ultimately destroy the ability of this vicious organization to threaten people in the Middle East or elsewhere. And it relies on American airpower to bolster the abilities of other Sunni forces to accomplish this goal.

But most Americans also realize this will not be easy — and they’re right. It won’t be easy to clean up the horrific mess created by the Bush/Cheney policies in the Middle East.

Frankly, I don’t think that any of the architects of the Iraq War should ever be invited on TV to say one word about foreign policy — and especially the Middle East. They have zero credibility to comment. They have been wrong over and over again and created the conditions that spawned the problems we face today.

But if they are invited to act as “talking heads,” interviewers must at least have the common decency to point out their failed track record — and to demand that they do more than criticize the president’s efforts to clean up their mistakes. They must also be required to tell us exactly what they would do to fix it.

And if any of them actually do propose a course of action, you can pretty much be sure that based on their past track records, that course of action is wrong.

“More, More, More!”: If Republicans Want Full-Scale War, They Should Say So

While there were a few Republicans who reacted favorably to President Obama’s speech last night describing what we will be doing to combat ISIS, the reaction from most on the right was predictably negative. Which is fine — it’s the opposition’s job to oppose, after all. But when you hear what they have to say, you notice a yawning gap in their criticisms: They were missing clear articulation of what exactly Republicans would prefer that we do.

After Obama spoke, John McCain shouted at Jay Carney that everything would have been fine if we had never removed troops from Iraq, saying “the president really doesn’t have a grasp for how serious the threat from ISIS is.” He and Lindsey Graham later released a statement advocating a bunch of stuff we’re already doing, along with some language that sounded like they might be advocating waging war on the Syrian government, but it’s hard to be sure. Ted Cruz said Obama’s speech was “fundamentally unserious” because it was insufficiently belligerent and fear-mongering.

Sarah Palin wrote on her Facebook page: “War is hell. So go big or go home, Mr. President. Big means bold, confident, wise assurance from a trustworthy Commander-in-Chief that it shall all be worth it. Charge in, strike hard, get out. Win.” Which is about the “strategy” you’d get for defeating ISIS if you asked a third-grader.

The only one who was clear on what they would do instead, oddly enough, was Dick Cheney. He pronounced Obama’s strategy insufficient in a speech bordering on the insane, in which he essentially advocated waging war in every corner of the earth.

At least we know where he stands. But other Republican critics have to get more specific if they’re going to present a credible case against the President’s plan. You can claim that Obama should never have ended George W. Bush’s war, but what is it that they support doing now? If they believe we have to re-invade Iraq with a force of tens or hundreds of thousands of American troops, they ought to say so. If that’s not what they support, then what is it? The hints we’ve gotten sound a lot like, “Pretty much exactly what Obama is proposing, just, you know, more.” He’s using air power, so more air power. He’s saying we’ll be bombing not just in Iraq but in Syria, so they want that, but more. He says we’ll be training and supporting Syrian rebel groups to act as a counterweight to ISIS, which Republicans like, but they want more.

All that sounds like they’re caught between two unacceptable options. They can’t say they support what the administration will be doing, because whatever Obama does is wrong by definition. But they know that advocating another full-scale ground invasion would be met with horror from the public, so they can’t advocate that either. The only option left is to just react to whatever Obama proposes by saying it’s insufficient.

There are two competing visions of the problem at hand. One says ISIS poses a dramatic threat not just to the people it is currently oppressing or those who might wind up in its path, but to the entire world, including United States. The other says that while the group is certainly barbaric, its threat is limited to the Middle East.

And despite some of the dramatic proclamations we’ve been hearing, there are now voices emerging to say that the threat may be overblown. Today’s New York Times quotes experts suggesting ISIS may not be quite as dangerous to us as we keep being told. There are other experts making similar arguments, but as Ryan Cooper explained, they’re getting drowned out by sensationalist media coverage.

In this context, if you look carefully at what Obama said last night, you can see that he was trying to put this conflict in a more sober context. There was no talk of “existential threats,” or American cities engulfed in flames. He spoke about both the danger, and the action we’ll be taking, in limited terms. After September 11, George W. Bush ramped up the fear we were supposed to feel and promised a grand victory. Obama is doing neither.

That in itself no doubt infuriates many Republicans. But if what they’re after is a full-scale war, they ought to have the courage to say so.
