“Polarized Politics”: Syria Puts Our System On Trial

It was only a matter of time before our polarized politics threatened to destroy a president’s authority and call into question our country’s ability to act in the world. Will Congress let that happen?

To raise this question is not to denigrate those, left and right, who deeply believe that the United States should temper its international military role. Nor is it to claim that President Obama’s proposed strikes on Syria in response to Bashar ­al-Assad’s use of chemical weapons constitute some sort of “slam dunk” policy that should win automatic assent. But a bitter past hangs over this debate and could overwhelm a discussion of what’s actually at stake.

The wretched experience of Iraq is leading many Democrats to see Obama’s intervention in Syria as little different from what came before. Never mind that the evidence of Assad’s use of chemical weapons against his own people is far clearer than the evidence was about weapons of mass destruction in Iraq, or that Obama has been so reluctant to take military action up to now. He faces a peculiar problem: While hawks criticize Obama for not being willing to act boldly enough against Assad, doves criticize him for being too willing to risk a wider war. Members of Obama’s party have to understand the risks of forcing him to walk away from a red line that he drew for good reason.

At the same time, Democrats will never forget how their patriotism and fortitude were questioned when they challenged President George W. Bush on Iraq and other post-9/11 policies. Yes, Bush did sign a fundraising letter before the 2006 midterm election that spoke of Democrats “who will wave the white flag of surrender in the global war on terror and deny the tools needed to achieve victory.” At a campaign event that year, he said of Democrats: “It sounds like they think the best way to protect the American people is to wait until we’re attacked again.”

I bring this up only to remind Republicans opposing Obama on Syria — and I’m not talking about the consistent anti-interventionist libertarians — that some in their party are making arguments now that they condemned Democrats for making not very long ago. Can we ever break this cycle of recrimination?

Obama bears responsibility here, too. Precisely because he had been so unwilling to intervene in Syria, he has handed opponents of his policy some of the very arguments they are using against him. Until Obama decided that the chemical attacks required a strong response, he was wary of getting involved, because the United States has reason to fear victory by either side in Syria. His old view may have been reasonable, but it can easily be invoked to undercut his current one.

The question now is whether Congress really wants to incapacitate the president for three long years. My hunch is that it doesn’t. This is why Republicans such as John Boehner, Eric Cantor and John McCain and Democrats such as Nancy Pelosi, Chris Van Hollen and Gerry Connolly all find themselves battling to give Obama the authority to act. The inconsistency of some Republicans shouldn’t blind us to the fact that others in the GOP are taking courageous risks to avoid paralyzing the president.

They will not prevail, however, unless Obama makes an unabashedly moral case on Tuesday explaining why things are different than they were a few months ago while laying out a practical strategy beyond the strikes. He must do something very difficult: show that his approach could succeed, over time, in replacing Assad with a new government without enmeshing the United States in a land conflict involving troops on the ground.

The administration’s view is that only a negotiated settlement will produce anything like a decent and stable outcome in Syria — and that only forceful U.S. action now will put the United States in a position to get the parties to the table. It’s not tidy or an easy sell, but it’s a plausible path consistent with what the United States can and can’t do.

If Obama wins this fight, as he must, he should then set about restoring some consensus about the United States’ world role. He has to show how a priority on “nation-building at home” can be squared with our international responsibilities. The seriousness of this crisis should also push Republicans away from reflexive anti-Obamaism, Rush Limbaugh-style talk-show madness, extreme anti-government rhetoric and threats to shut Washington down.

If we want to avoid becoming a second-class nation, we have to stop behaving like one.

“When Liberals Enable Tyrants”: Can A Liberal Oppose Tyranny And Support Military Intervention At The Same Time?

What is liberalism supposed to be about on the world stage? What values and goals do American liberals wish to promote around the world? I’m pretty certain most would say free democratic societies; full political rights for ethnic minorities; equal rights for women and, with any luck, gay people; a free press; an independent judiciary; and so forth. And, where those cannot be achieved, at least a base-level opposition to tyranny, reaction, religious fundamentalism, and so on.

Most would name these things. But, I have to say, most rank-and-file liberals don’t seem to me to be very passionate about them. What most liberals are passionate about is one thing: opposition to U.S. militarism. That’s what really roils the loins. Ever since Vietnam, there’s been this template, this governing notion that every military action the United States undertakes is by definition both immoral and bound inevitably to lead to a quagmire; that the U.S. military can do only bad in the world. Lord knows, there’s plenty of evidence to back up the claim, and a posture of deep skepticism about all military plans and promises is the only serious posture (abandoned by most of the “serious” people back in 2003).

I’ve described here two impulses: the desire to do good in the world, or at least to prevent the bad; and opposition to American force. Often these desires can exist in harmony. But what if they conflict? Why is opposition to any projection of force always the deciding factor? At times it can lead people into some very illiberal little corners.

I say this is one of those times. Taking no action now, after what Assad did, strengthens the hand of murderers, theocrats, and some of the most illiberal people on the planet. Yes, I have concerns about what might happen. You’ve read many columns, I’m sure, and heard many Democratic members of Congress on cable television talking about the potential catastrophic effects of a strike. I don’t deny them. I worry about them daily.

But I bet you haven’t heard many people talk about the potential harmful effects in the region of not striking the Assad regime. Yes, you probably saw Lindsey Graham and John McCain talk about how Iran would be emboldened in its nuclear ambitions, but that’s not even the half of it. Here are six consequences of not launching a strike against Syria, all of which could harm small-d democratic hopes in the region and, indeed, potentially increase the carnage.

(1) An Emboldened Assad

If the U.S. doesn’t strike, Assad would be emboldened to intensify the fighting in rebel-held areas. Rebel groups of different kinds hold a large number of cities and towns, as this map will show you. What if, concluding that the war-weary West doesn’t really care what he does and isn’t going to lift a finger to stop him, Assad (with Iran’s help) launches savage campaigns in these areas?

No strike is a green light for Assad to take over all the liberated areas by any means necessary, maybe including, again, chemical weapons. The CWs weren’t used last month just because he’s a big meanie. They were used to ferret rebel fighters out of their strongholds. Why wouldn’t he do it again if no one does a thing to stop him? And again?

(2) More Radicalized Rebels

Also within Syria itself, it’s possible that a failure to strike will radicalize more rebels and turn more of them against the United States and send them into the waiting arms of ISIS and al-Nusra, the al Qaeda affiliates. It certainly seems safe to say that the “good” elements of the anti-regime forces, the people looking to the West for help, would be the losers if we don’t strike. Both the regime and the rebel Islamists have been killing members of the better rebel factions, and both groups would get the message from no U.S. strike that those factions have no protector.

(3) A Win for Hezbollah

Hezbollah, Assad’s ally and Iran’s terrorist proxy army, could more easily take over in Lebanon if the U.S. holds back. Right now in Lebanon, there is no government. I don’t want to drag you too deeply into Lebanese politics, but Hezbollah wants one of two things: either to be in the government, or at least to have what is called the “obstructing third” privilege that permitted it in the last government to block anything the government wants to do. On the other side are pro-Western politicians who have sought to reduce Hezbollah’s influence. No strike would only embolden Hezbollah, which could then decide on key military and security appointments in the next government.

(4) A Strengthened Iran in Iraq

Why? Because of the ongoing competition between Iran and Saudi Arabia for Iraqi influence, no strike would probably make Prime Minister Nuri al-Maliki tilt more toward Iran (Saudi Arabia supports a U.S. strike, albeit not quite openly). Lately, according to Ken Pollack, Washington and Tehran have been in a kind of unexpected entente in Iraq. And Tehran probably has enough on its plate in Syria to prevent it from starting to make power moves in Iraq. But it’s possible, if the U.S. stands down over Syria, that Iran could start doing just that in Iraq, even as the country seems to be sliding back into civil war.

(5) A Blow to Israel

And there’s Israel to think about it. If Nos. 2 and 3 above come to pass—a strengthened al Qaeda and Hezbollah—well, that can’t be very good news for Israel. There are now “resistance brigades” affiliated with the Syrian regime operating in the long-disputed Golan. These brigades, too, will take note if the United States does nothing here.

(6) A Nuclear-Trigger-Happy Iran

There is, yes, the ultimate question of Iran’s nuclear ambitions. I think it’s hard to argue that a U.S. strike would delay those ambitions. But it is not hard to argue the opposite—that the lack of American action against Syria would make Tehran feel that much freer to proceed with that much more impunity.

Looking back over my list, who could benefit from the U.S. not taking action here? Assad, the dictator with the blood of 100,000 on his hands. Iran, one of the world’s most reactionary regimes. Hezbollah, a terrorist force that crushes the democratic aspirations of the Lebanese people. And al Qaeda, the extremist fanatics behind 9/11. Are those the kinds of people liberals want to help? I’m sure liberal members of Congress who’ve announced they’re voting no—Raúl Grijalva, Alan Grayson, Charlie Rangel, Barbara Lee, and about 17 others—have spent a heck of a lot of time thinking about what could go wrong if we do strike. I bet they haven’t given a moment’s thought to what could go wrong if we don’t.

I say that’s worth thinking about. Also worth thinking about is the fact that many liberal-minded people from the region, and certainly many or virtually all of the nonextremist rebels, want the United States to act. From their point of view, without the United States’ engagement, the region is buried in slaughter, theocracy, and darkness. I would expect American liberals at least to stop and think about that.

Again, no one is talking about 130,000 ground troops. That was a qualitatively different thing, and I opposed it from the start. Yes, an American attack might escalate matters. But it also might not. We got in and out of Libya. It’s not clear what that one accomplished yet, although we did presumably prevent a slaughter of many thousands in Benghazi. It is clear what we accomplished in Kosovo, where another murderer was removed from office and hauled to the Hague (without one American life lost). So it doesn’t always end badly. And it isn’t always immoral. This is one of those cases where, if the scale of the action is appropriate and if it works, a military incursion can actually serve liberal ends. No, that’s not for sure. But it is for sure that doing nothing helps the reactionaries.

“We’re Done Getting Mugged”: Hey Republicans, Obamacare Is Off The Table!

There’s an increasingly obvious problem with the efforts of GOP congressional leaders to tamp down “base” support for a “defunding Obamacare” drive linked to a continuing resolution to keep the federal government operating this fall: they’re talking about other measures to cripple Obamacare–e.g., a delay in key provisions like the individual mandate–perhaps linked to other “hostages” like the debit limit, instead of talking about using whatever leverage they have to achieve other Republican objectives.

On Wednesday I compared these leaders to a parent trying to bribe an unruly child demanding ice cream with a double scoop sometime later. But what if ice cream production has come to a halt? Can the kids be talked into gorging themselves on some other kind of sugary treat?

I don’t know, but at Salon, the exceptionally well plugged-in Brian Beutler thinks it’s time for Republicans to stop talking about ice cream:

Even in the dour days of 2011, when Dems were defeated, morose, and willing to negotiate away almost anything, major provisions of Obamacare were off the table. In 2013, almost everything is off the table. They’re done getting mugged by the GOP. Funding the government and increasing the debt limit are fundamental responsibilities of Congress, and Republicans won’t get more than a couple fig leafs for marshalling enough votes to accomplish them….

I can imagine Democrats putting something genuinely marginal to the ACA on the table. Like I said, a fig leaf. But not the individual mandate. Getting many people into the insurance exchanges, and particularly young healthy people, is crucial to the law’s success, and the mandate is the only stick they have (and it’s a pretty flimsy one) to prod them in there. Everything else is carrots. It’s conceivable to me that the inducements, and the national enrollment outreach effort, will be successful enough on their own to render the mandate ancillary in 2014. But postponing it is too big of a risk.

Republicans should know this. I think GOP leaders do know it, and for the sake of stability and a calming autumn, I sure hope they do. If they don’t, they’ll blunder into these discussions completely blind to how empty they’re about to come up. They’ll feel like they got rolled, when in reality they’ll have simply been mistaken about the terms of the negotiation. And that’s the only way I can imagine these crazed theatrics transforming into a genuine crisis.

If, of course, GOP leaders talk their firebrands out of a frontal assault on Obamacare that they really, really want to undertake on grounds that it’s more realistic to pursue delays that Democrats won’t agree to under any circumstances, then the consequences will go beyond a turbulent autumn in Washington. The GOP congressional leadership really will suffer a massive loss of grassroots conservative confidence, and you could be looking at a national party unmistakably under the heel of Ted Cruz.

“Times Are A Changin”: Once Upon A Time, Everybody Wanted To Be “Tough on Crime”

Yesterday, Attorney General Eric Holder announced some policy changes meant to reduce the number of drug offenders subject to mandatory minimum sentences. Across the political spectrum, people have come to view mandatory minimums as a disaster from almost any standpoint, and as some people have pointed out, mandatory minimums were originally a Democratic idea. Those of you who are too young to remember the early 1990s might not appreciate the raw terror that gripped Democrats in those days. People regularly lost elections when their opponent’s opposition researchers found some obscure vote that could be twisted into a direct mail piece saying, “Congressman Smith voted to let violent criminals out of jail—so they could rape and murder their way through our community. Is that the kind of man we want in Washington?”

As it happens, at the time I was working for a political-consulting firm that created some of those mail pieces. Our clients were all Democrats, and we produced crime attacks for both primary and general elections, targeting other Democrats and Republicans alike. In 1994, it reached an absolute fever pitch. My firm had about 30 clients, all Democrats, and we did tough-on-crime pieces for every single one. In many cases, we’d make ten or so different mail pieces for a client, and eight of them would be about crime. In other words, in every last race we worked on, every candidate was accusing every other candidate of being soft on crime. The highlight of my consulting career was when I lay down on a sidewalk so our photographer could trace around my body with chalk for a murder aftermath scene we staged.

Of course, it was all tinged with the inescapable whiff of race—the most famous soft-on-crime attack from the era was George H.W. Bush’s 1988 assault on Michael Dukakis over the “Willie Horton” case.  These days we look at the elder Bush as a kindly old man who does things like wear silly socks and shave his head in solidarity with a young cancer patient, and his place in history has been immeasurably aided by the fact that his presidency was nothing like the spectacular disaster of his son’s. But we shouldn’t forget that in order to reach the White House, H.W. enthusiastically led one of the most despicable campaigns of racist fear-mongering in the history of American politics. It isn’t that crime wasn’t genuinely high in those days, because it was. But the media took people’s real concerns and whipped them into a frenzy of fear, talking about crack babies condemned to lifetimes of mental retardation (which turned out to be completely bogus) and terrifying young black male “superpredators” (ditto), turning individual horror stories into lightning-fast policy changes, like the abduction and murder of 12-year-old Polly Klass, which produced a local-media frenzy the likes of which I’ve never witnessed before or since and led directly to California’s “three strikes” law.

At the time, the question was never, “Is this proposed measure to increase prison sentences a good idea?” The only question, asked by politicians from both parties, was whether it couldn’t be made much tougher. If you suggested that “tough” might not be the best standard by which a policy should be judged, you were risking your political career. Republicans embraced this zeitgeist with glee, and Democrats embraced it out of abject fear.

Fortunately, times have changed, and it’s now possible to have a rational discussion about crime. That simple fact—that politicians can support a variety of proposals on crime and punishment without worrying that their careers will be over as soon as somebody utters the phrase “soft on crime”—is something for which we should be enormously thankful, as much work remains to be done. As Greg Sargent pointed out, “this is an issue around which Dems concerned about racial justice, and conservative libertarians (such as Senator Paul) who share race-based concerns in their better moments, and conservatives who see the issue more through the prism of their opposition to government overreach and ‘one size fits all’ solutions, should theoretically be able to find common ground.”

The most important change in the last 20 years is that crime has fallen so dramatically (see here for instance), and in response we’ve seen a real cultural shift. I’m sure there are still politicians who’d love to tar their opponents as soft on crime. But they know it probably wouldn’t work. And that means there’s at least a chance we can make real policy change.

“Pleading Ignorance”: Congress Can’t Pretend It Didn’t Know About NSA Surveillance

Having been, at one place or another in my career, on each side of the perennial debate in Washington about “who knew what and when,” I knew it was a matter of time before we started hearing it about the leaked NSA operations.

Since leaving government, I have written before about the weird dynamics of “briefing” Congress on sensitive operations, e.g., Nancy Pelosi’s claim that she didn’t know about CIA’s program of “enhanced interrogations” during the Bush Administration. Now, and perhaps ironically, we have a spate of Republicans saying they knew little or nothing of the NSA operations

So, what’s the real story behind this typical Washington play to the media?

The media, of course, has a field day because on any day, they can get someone in Congress who wants to get their face on TV to say most anything – this whips up the hysteria that gives the story legs.To them, it’s media Nirvana – it’s the Trayvon Martin case of national security, and the best thing since the “torture” scandal.

Here is what’s behind all this political smoke:

There are some traditional Republican vs. Democrat tensions at work, in that it’s an opportunity for Republicans to criticize a Democratic President.

The NSA operations are very awkward for many Democrats to support (and many don’t) because of their liberal views on personal liberties and conciliatory approaches to national security.

Likewise, Republicans – who traditionally are more aggressive in national security matters – are also reluctant to support a Democratic administration, even though they may agree with the NSA operations.

The “tea party” faction of the Republican Party opposes the NSA operations – and as such is aligned with the most liberal Democrats on the issue. Strange bedfellows indeed.

Members of the two intelligence committees, Republican and Democrat, seem generally to support the NSA operations – and they also seem to know the most about them. They should.

However, complaints that “we didn’t know about this” are now being heard from both congressional Republicans and Democrats who are not on the intelligence committees.

Coming, perhaps, are internal divisions within the intelligence committees, some Republican-Democrat spats and some between the committee leaderships and rank and file committee members. This is awkward for the intelligence committee leaderships.

The lawyers at the Department of Justice, are – uncomfortably perhaps – in bed with each other on the NSA ops, because the programs were started in the Bush administration and continued into the Obama administration. And the president himself has supported the programs in every opportunity he has had to talk about them. He clearly believes that privacy and security are in proper balance with the NSA operations – or at least not out of balance.

So, who (probably) knew what and when about the compromised NSA program?

Some relevant background: Ever since Watergate, the Church and Pike Committees, the creation of the intelligence committees and the enactment of the Foreign Intelligence Surveillance Act (by the Democrats, FYI) in the 70’s, there have been various legal requirements for the intelligence community to keep the Congress informed about what they are doing. And the Congressional Seniors, often called the “Gang of Eight” (majority and minority leaders of each house and majority and minority members of the intelligence committees), get briefed in more detail on the most sensitive intelligence activities and operations.

Now, put yourself in the place of the directors of the various intelligence agencies. If you have any political sense at all (and you wouldn’t be a director if you didn’t), you are going to tell all about your agency’s various activities and operations, including all the risks – at least to the gang of eight. This way no one can later accuse you of withholding information when one of these sensitive programs goes south or is compromised. And, because the most sensitive activities and operations are often the most risky, the odds of failure or compromise are correspondingly high.

So, we can assume that – at the very least – the gang of eight was fully briefed on the NSA operations. And we can also assume that any other member of the intelligence committees who expressed interest in the programs would have likewise had a complete briefing, including on-site briefings by agency technicians, if such were requested.

How about an  ordinary member of Congress who was interested in these programs? They can also get briefings if they request them, and should approach their own party leaderships if they want additional information, or go to the leaderships of their house’s intelligence committee. Are these briefings often complex, technical and time consuming? Yes, for sure.

However, the suggestion that information is somehow being withheld from them is, frankly, silly, just as it was for Pelosi, a 10-plus year member of the gang of eight and a former chairman of the House Permanent Select Committee on Intelligence, to say that she didn’t know about the CIA’s enhanced interrogation program.

They know. They may wish they didn’t when the story hits the news, but they know. In fact, it’s to the administration’s advantage – whether Republican or Democrat – that they know all the details. In short, they are all in this boat together, whether they like it or not.
