“Outsourcing Constitutional Responsibilities”: Senate Republicans Will Ignore Court Nominee, But RNC Won’t
Any day now, President Obama is expected to announce his nominee to fill the vacancy on the Supreme Court, and the political battle lines have already been drawn. On Capitol Hill, Senate Republicans remain committed to a partisan blockade, unlike anything ever seen in American history, that calls for the rejection of any presidential nominee, regardless of qualifications or merit.
But while the Senate’s Republican majority intends to ignore the White House’s choice, the Republican National Committee intends to do the opposite. The Associated Press reported this morning:
The Republican Party is launching a campaign to try to derail President Barack Obama’s nominee to the Supreme Court, teaming up with a conservative opposition research group to target vulnerable Democrats and impugn whomever Obama picks.
A task force housed within the Republican National Committee will orchestrate attack ads, petitions and media outreach…. The RNC will contract with America Rising Squared, an outside group targeting Democrats that’s run by a longtime aide to GOP Sen. John McCain.
RNC Chairman Reince Priebus said his attack operation would “make sure Democrats have to answer to the American people for why they don’t want voters to have a say in this process.” Priebus added that the White House is poised to “break with decades of precedent.”
Republicans, the RNC chair went on to say, are “going to vet that person and put their real record on display.”
At face value, most of the RNC’s rhetoric is plainly laughable. Obviously, no one is trying to deny voters a role in the process – voters are the ones who elected President Obama (twice), giving him the authority to act. It’s equally obvious that the “decades of precedent” talking point is brazenly untrue, as even some Senate Republicans have been willing to acknowledge.
But just below the surface, there’s something even more ridiculous going on.
For example, the RNC is going to have a tough time pitching their opposition to the unnamed nominee as sincere and principled if the party launches its partisan war against him or her before knowing who the nominee is. There’s an important difference between, “This is a horrible choice,” and “We have no idea who the choice will be, but we’re sure it’ll be horrible.”
It’s the sort of posture that leads more to eye-rolling than meaningful debate.
Perhaps more importantly, the Washington Post’s Greg Sargent raised an overlooked detail.
Ideally, of course, [the vetting of the nominee] is what would happen if the Senate were to hold hearings on that person. But that might afford the nominee a chance to directly respond to his or her Republican cross-examiners in a high profile setting (as opposed to only having Democratic groups mounting all the pushback, which of course they will also do, once there is a nominee). Direct exchanges between the nominee and Republican Senators, alas, might reflect well on that person. And so the only “vetting” and examination of the nominee’s “real record” will be undertaken through the RNC and associated GOP-aligned groups.
That’s not meant as sarcasm. It’s the actual Republican party-wide position right now.
Quite right. Under the American political process, the Senate is supposed to oversee the formal vetting of a Supreme Court nominee. In 2016, however, Senate Republicans don’t want to – so they’re outsourcing the vetting to the Republican National Committee.
What should be done by senators and officials – people who are ultimately accountable to the public – will instead be done by partisan operatives.
There is no precedent for anything like this in the American tradition. Senate Republicans and the RNC evidently don’t care.

“An Albatross Around The Down-Ballot Races”: Could Donald Trump Deliver Congress To The Democrats?
With each preposterous new turn in the GOP presidential primary campaign, the chances of Hillary Clinton becoming president of the United States increase. The trouble is that a Clinton presidency has always promised to be largely an exercise in frustration. That’s not because she’s an incrementalist (true though that may be), but because she’ll likely be confronted with a Republican Congress—and one no more inclined toward compromise and pragmatism than the one Barack Obama faces.
But what if that weren’t true? Is there any chance Democrats might actually win back control of Capitol Hill and at least let a President Clinton (or a President Sanders, a possibility that remains real, if dwindling) do something that resembles governing?
The answer is yes, there is such a chance. And the reason is simple: Donald Trump.
We don’t yet know whether Trump will be the Republican nominee. But at the moment that’s the likeliest of all the possibilities for Republicans. And it also seems that having Trump as their leader will tear the party apart. Which could give Clinton not only the White House, but a chance for a presidency that accomplishes something.
Let’s start by considering the Senate, where Republicans currently enjoy a 54-46 majority. Because the senators running for re-election this year are the ones who got elected in the Republican sweep of 2010, they are defending many more seats—24, while Democrats are defending only 10. Most of those seats, however, are safely in Republican hands. They could nominate Martin Shkreli for president and they’d be unlikely to lose Senate races in Oklahoma or South Carolina. But they are vulnerable in other places like Illinois, Wisconsin, and New Hampshire, where Democrats have fielded strong candidates in states already leaning left.
Most forecasters have predicted that Democrats would net a few seats, but winning the four they need to push the Senate to 50-50 is a tough proposition. Until now, that is.
With Trump poised to win the nomination, some races that hadn’t previously been seen as competitive are beginning to look that way. Consider Iowa, where the curmudgeonly Chuck Grassley is running for his seventh term. No one thought Grassley would face a serious challenge this year, but then came Trump, and the death of Antonin Scalia—which resulted in a wave of stories about how Grassley, the chairman of the Judiciary Committee, refuses to hold confirmation hearings on anyone President Obama nominates to the Supreme Court. Last week, Democrats got their wish when Patty Judge, a former lieutenant governor and state agriculture secretary, announced that she’ll run for the seat. Grassley may still be reasonably popular, but if turnout is high in a state that voted for Barack Obama twice, Judge has a strong chance to win.
Something similar could happen in other states: What had looked like seats where Republicans had a clear advantage could be up for grabs, particularly if Democrats come out in force, moved to the polls by the ghastly prospect of Donald Trump becoming president. Combine that with a potentially dispirited Republican electorate, and Democrats could win more seats than anyone predicted. “We can’t have a nominee be an albatross around the down-ballot races,” Senator John Cornyn recently told CNN. “That’s a concern of mine.”
That brings us to the House. Democrats need a net gain of 30 seats to take it back, which has looked all but impossible until now. And it’s still extremely difficult. But could it happen? It’s hard to tell from our vantage point today. We don’t know what kind of general election candidate Donald Trump would make, but the key to the outcome in the House could be how his candidacy affects turnout. If the #NeverTrump movement doesn’t lose steam and lots of prominent Republicans distance themselves from their party’s nominee, it could mean Republican voters staying home in large numbers, which would make it possible for Democrats to win back the seats they need to take control.
If Democrats take back both bodies, a Democratic president could actually have the chance to govern, including through passing legislation—imagine that. But even if Democrats took only the Senate, it would make a huge difference.
Back in 2013, Democrats then controlling the Senate got so frustrated with Republican obstructionism that they changed the body’s rules on confirmation of executive branch appointments and those of judges serving on lower courts, allowing those nominations to be confirmed with a simple majority vote and disallowing filibusters. The rule change didn’t apply to legislation or to Supreme Court nominees, and senators are still allowed to do talking filibusters, where they hold the floor for as long as they can (so Ted Cruz will still have something to do when he returns to the Senate next year).
So a President Clinton could continue to transform the federal courts simply by virtue of filling openings as they come up. There’s a bottleneck right now as Republicans refuse to confirm more of Obama’s judicial nominees, but if that were broken, after 12 or even 16 years of Democratic appointments, the lower courts would be firmly in liberal hands.
And what about the Supreme Court? Not only is there the matter of Scalia’s seat to deal with, but it’s almost certain that more seats will become vacant in the next president’s first term. On Inauguration Day, Ruth Bader Ginsburg will be 83, Anthony Kennedy will be 80, and Stephen Breyer will be 78. If and when Republicans decide to filibuster any Democratic nominee, you can bet that Senate Democrats will make another rule change to disallow filibusters of Supreme Court nominees. Republicans will decry it as a terrible power grab, but it will be exactly what they earned with their obstructionism.
This all may not sound like a recipe for an era of excellence in government. It will be terribly partisan, and if Republicans hold on to the House, it will mean almost no meaningful legislation outside of continuing resolutions funding the government to avoid shutdowns. But between the executive and judicial branches, you can accomplish quite a bit. Hillary Clinton would certainly hope for more, but it’s what she may have to settle for. And it could be a lot worse.

“Republicans Could Not Have Done Anything Wrong”: Rubio Inexplicably Applauds Snyder’s Handling Of Flint Scandal
In recent months, the Republican presidential field hasn’t paid a whole of attention to the crisis in Flint, Michigan. In mid-January, with the national spotlight shining on the man-made disaster, Marco Rubio was asked for his perspective – and he had no idea what the reporter was talking about.
Six weeks later, the topic came up in last night’s debate, held in Detroit, where Fox News’ Bret Baier reminded the GOP candidates that Bernie Sanders and Hillary Clinton “have both been to Flint. They are both running ads in this state focusing on that, focusing on supporting Flint and fixing the problems, showing images of people in Flint thankful that they’re there.”
The co-moderator asked Rubio, “Without getting into the political blame game here, where are the national Republicans’ plans on infrastructure and solving problems like this? If you talk to people in this state, they are really concerned about Flint on both sides of the aisle. So why haven’t GOP candidates done more or talked more about this?”
The Florida senator’s response was one of the evening’s more unsettling answers. Here’s his answer in its entirety.
“Well, I know I’ve talked about it, and others in our campaign have talked about it, and other candidates have talked about it, as well. What happened in Flint was a terrible thing. It was systemic breakdown at every level of government, at both the federal and partially the – both the state and partially at the federal level, as well.
“And by the way, the politicizing of it I think is unfair, because I don’t think that someone woke up one morning and said, ‘Let’s figure out how to poison the water system to hurt someone.’
“But accountability is important. I will say, I give the governor credit. He took responsibility for what happened. And he’s talked about people being held accountable and the need for change, with Governor Snyder.
“But here’s the point: This should not be a partisan issue. The way the Democrats have tried to turn this into a partisan issue, that somehow Republicans woke up in the morning and decided, ‘Oh, it’s a good idea to poison some kids with lead.’ It’s absurd. It’s outrageous. It isn’t true. All of us are outraged by what happened. And we should work together to solve it. And there is a proper role for the government to play at the federal level, in helping local communities to respond to a catastrophe of this kind, not just to deal with the people that have been impacted by it, but to ensure that something like this never happens again.”
Hmm. So, Flint was an accident; Rick Snyder deserves credit for his handling of the crisis; let’s be sure to blame the feds; and Democratic rhetoric is even more upsetting than the disaster itself. Got it.
New York’s Jon Chait wrote an important rejoinder: “Asked to avoid the blame game and offer specific solutions to urban-infrastructure problems, Rubio is unable. He conceives of the question entirely in partisan terms. He attacks the notion that Republicans consciously decided to poison children, thereby ruling out any possibility of government negligence as self-evidently preposterous. He has nothing resembling a specific idea on the issue, only the firm conviction that Republicans could not have done anything wrong.”
As unsettling as the debate exchange was, it offered real insights into how Rubio sees the world. Six weeks ago, the senator couldn’t be bothered to know what the Flint scandal was. Last night, he recognized the crisis, but only through an electoral prism. Rubio starts with the premise he finds ideologically satisfying – Republicans are correct and free of wrongdoing – and then works backwards … until he can find a way to condemn Democrats.
Rubio simply cannot stop thinking in partisan political terms. By all appearance, he doesn’t even know how. For all of the media’s assurances about Rubio being “whip smart,” the young senator simply lacks the wherewithal to consider policy questions in substantive ways.
The Republican was asked, “[W]here are the national Republicans’ plans on infrastructure and solving problems like this?” This prompts Rubio to reference the agreed-upon talking points; (1) Flint, sad; (2) Snyder, good; (3) Democrats, bad. The growing evidence of neglect, incompetence, and possibly criminal misdeeds surrounding the governor’s office? For Rubio, none of this matters.
The assembled audience applauded, but given the reality, they should have cringed.

“Racism By Region”: Donald Trump And The Rise Of The New Dixiecrats
There is one man who might be able to beat Donald Trump. But it would involve amending the Constitution, exhuming former Alabama governor George Wallace and re-constituting his ashes.
The current Republican frontrunner has been able to accomplish something that Wallace, in his living days, could not. In the months since Trump announced his candidacy for the GOP presidential nomination, he has singlehandedly built a bipartisan, largely white coalition of conservatives who are attracted to his nativist brand of economic populism. For them, the fine details of actual policy proposals appear to be less important than the notion that Trump is the one who can take their country back.
Much like Wallace—who was a Democrat—and despite his inconsistencies on the issues, Trump has tapped into a reservoir of resentment. He gives voice to the grievances of his supporters in a way that no other viable candidate for national office arguably has or can. As Trump continues to intensify his rhetoric, he has revealed deep fissures between the Republican establishment and the party’s grassroots. But his support does not stop at the water’s edge.
Those measuring Trump’s electoral “ceiling” should look again. There was certainly a ceiling on how much support Wallace received nationally. And, without a doubt, there is a cap on how high Trump’s stock will rise. But Trump is getting some unanticipated help—from Democrats.
Feasting on a public mood that is strikingly similar to what fueled Wallace, backing for the billionaire businessman has crossed the partisan aisle. The Trump voter is buoyed by his proclamations that he can “make America great again.” One constant refrain is that he “tells it like it is,” a thinly veiled reference to the way Trump eschews politically correct speech and frequently deploys bigoted, divisive language.
Among his electoral strongholds are so-called “blue dogs.” According to The New York Times, Trump carries a full 43 percent of voters who are registered Democrats, but who lean to the right. In the mold of Wallace, Trump has given rise to a modern-day Dixiecrat—only this one is not contained to the American South.
Up North, he is drawing support from “Reagan Democrats”—those who are disaffected by the broadening diversity of the Democratic Party. Reminiscent of Reagan, at least one poll shows that 20 percent of Democrats would defect and pull the lever for Trump this November.
His promises to rebuild the nation’s manufacturing base, hunt down Muslim terrorists and stop “illegal aliens” at the border have earned him deep support across the South, in rural areas in the country’s mid-section and in rusting smoke-stack cities in the North and upper Midwest. Never mind the fact that many of his proposals are unworkable and others would bust the national bank or qualify as war crimes. Trump’s “us versus them” mentality has attracted substantial support from white evangelicals and catapulted him into what is likely an insurmountable lead.
Without question, Trump has shocked the chattering class, energized his base and driven up turnout numbers in Republican primaries and caucuses. As the real estate denizen steamrolls through states like Georgia, Alabama, and Tennessee on Super Tuesday, it is worth noting that he polls strongest among working class-whites who are less educated and who were the least likely to vote. His reach also extends to north to Massachusettes and his home state of New York.
Nate Cohn says it is a “familiar pattern.”
“It is similar to a map of the tendency toward racism by region, according to measures like the prevalence of Google searches for racial slurs and racist jokes, or scores on implicit association tests,” Cohn writes for The New York Times.
Trump may also be benefitting from the election of the country’s first African-American president. Once thought to be an augur of a post-racial America, the 2008 election instead gave rise to tensions thought by some to be already resolved. For some people, that clear demonstration of black voting power within the highly diverse Obama Coalition was something to be feared rather than embraced.
Wallace, a segregationist who is perhaps most famous for the assertion, “Segregation now, segregation tomorrow, segregation forever,” would later come to rebuke that ugly ideology, but he never let go of economic populism.
However, what some political prognosticators miss about Wallace is the way in which he and his contemporaries used racial animus and economic fears to destabilize the Democratic base after the passage of the Civil Rights Acts. While Wallace never actually became a Republican himself, he helped to inspire the party re-alignment that would last for generations. That schism would become the precursor to the “Southern Strategy” adopted by Republicans to maintain national political power.
Trump appears to have taken up the mantle in a way that separates him from Senators Ted Cruz and Marco Rubio, who continue to trail him in the polls. But even as he benefits from the old Southern Strategy built by Republicans, Trump is remaking the tactical approach in his own image. He has rejected critical elements of the modern-day conservative doctrine.
“Trump has called for abolishing the carried-interest tax loophole for hedge-fund and private-equity managers,” writes James Surowiecki for The New Yorker. “He’s vowed to protect Social Security. He’s called for restrictions on highly skilled immigrants. Most important, he’s rejected free-trade ideology, suggesting that the U.S. may need to slap tariffs on Chinese goods to protect American jobs.”
Trump’s impact on party alignment is unknowable today. But Democrats and Republicans are right to fear the result. Like Wallace, Trump is shaking the table and there is no telling where the pieces might fall.
