“A Resettling Of The Hostages”: What The Tea Folk Want In The Fiscal Talks

To properly assess the lay of the land for the continuing fiscal negotiations in Washington, it’s kind of important to understand what those conservative Tea types fighting John Boehner actually want. You get the general impression they just want less compromise than Boehner. But the reality is quite different. Here’s an appropriate reminder from Breitbart’s Joel Pollak:

The present Tea Party dilemma did not begin in November 2012 but in January 2011, when the new Republican leadership in the House of Representatives excluded Tea Party members from the highest leadership positions. The Tea Party, used to opposing but not to governing, acquiesced in a faulty arrangement that allowed the Republican establishment to lead the legislative agenda, and to blame the Tea Party when it failed.

That is exactly what happened in the summer of 2011, when Speaker of the House John Boehner quashed efforts by Rep. Jim Jordan to rally support around the Tea Party’s preferred “Cut, Cap and Balance” proposal in the debt ceiling debate. Boehner then signed onto an ill-fated deal that led to the present “fiscal cliff” impasse–while the Tea Party, slandered by the mainstream media as “terrorists,” bore the burden of blame.

Sounds semi-reasonable until you focus on what the “Cut, Cap and Balance” proposal involves. Here’s a description from June of 2011:

1. Cut – We must make discretionary and mandatory spending reductions that would cut the deficit in half next year.

2. Cap – We need statutory, enforceable caps to align federal spending with average revenues at 18% of Gross Domestic Product (GDP), with automatic spending reductions if the caps are breached.

3. Balance – We must send to the states a Balanced Budget Amendment (BBA) with strong protections against federal tax increases and a Spending Limitation Amendment (SLA) that aligns spending with average revenues as described above.

The “Cut, Cap and Balance” Pledge that was signed by 12 senators and endorsed by every one of the viable GOP presidential candidates (including Mitt Romney) made all three elements a condition precedent to support for any debt limit increase.

Since constitutional amendments require passage in both Houses of Congress by a two-thirds vote, and the version being promoted by conservatives involves a radical and permanent reduction in federal spending, it ain’t happening unless and until vast changes in the composition of Congress occur–maybe on the order of four or five straight 2010-style GOP landslides. So we’re not talking about some temporary “hostage-taking” involving the debt limit, but the kind where the hostage is resettled in another country under armed guard for years.

It is rather important that the media and Democrats understand where the Tea Folk are coming from. They aren’t just trying to push the country towards their policy priorities. The whole idea, and the rationale for all the revolutionary trappings, rhetoric and other folderol, is permanent repeal of much of the domestic policy legacy of the twentieth century–back towards what they imagine the Founders (and for many of them, Almighty God) intended. For the most part, they have little to fear from voters back home. There is no price to be paid for craziness and intransigence, though in most cases there is decidedly a big risk in exhibiting reasonableness.

So that’s who we are dealing with, and best we can tell, there are enough of them in the House to keep Boehner from showing much reasonableness as well.

“Rejecting Their Own Ideas”: Republicans Are Creating Needless Difficulties For Themselves And The Country

We know that the House of Representatives has been unable to reach a sensible deal to avoid unnecessary fiscal trouble at the first of the year because of right-wing Republicans’ aversion to tax increases.

But there is another issue on which conservatives are creating needless difficulties for themselves and the country: It’s harder and harder for politicians on the right to think straight about health care.

Conservatives once genuinely interested in finding market-based ways for the government to expand health insurance coverage have, since the rise of Obamacare, made choices that are dysfunctional, even from their own perspective.

Start with the decision of the vast majority of Republican governors to refuse to set up the state insurance exchanges required under the law. The mechanisms would allow more than 20 million Americans to buy coverage. They were originally a conservative idea for large, trustworthy marketplaces where individuals and families could buy plans of their choice.

Many liberals preferred a national exchange, in which the federal government could institute strong rules to protect consumers and offer broader options. This was the path the House took, but the final Senate-passed law went with state-level exchanges in deference to Republican sensibilities.

To ensure that governors could not just prevent their residents from having access to the new marketplaces, the bill required the federal government to run them if states defaulted. So, irony of ironies, in declining to set up state exchanges, conservative governors are undermining states’ rights and giving liberals something far closer to the national system they hoped for. As Robert Laszewski, an industry critic of Obamacare, told The Post’s N.C. Aizenman, conservative governors are engaging in “cut-off-your-nose-to-spite-your-face” behavior.

This is one of many forms of conservative health-care unreason. The “fiscal cliff” debate has been distorted because the problems confronting federal finances are consistently misdescribed. We do not have “an entitlement problem.” We have a giant health-care cost problem.

Our major non-military fiscal challenges lie in Medicare and Medicaid. In principle, conservatives should seek to find ways of holding down health-care inflation in both the private and public sectors. In practice, they see most efforts to take on this issue system-wide as examples of big government run wild. They seem to have a vague idea that markets can yet solve a problem that markets have not been very good at solving.

The result is that conservatives would either let government get bigger, or they’d save money by throwing ever more risk onto individuals by undercutting core government guarantees.

Their most outrageous move was the big lie that the original health-care bill included “death panels.” This would have been laughable if it had not been so pernicious. The provision in question would simply have paid for consultations by terminally ill patients — if they wanted them — with their physicians on their best options for their care. Few things are more important to the future of health care than thinking straight about the costs and benefits (to patients and not just the system) of end-of-life treatments. For those of us who oppose physician-assisted suicide, it’s urgent to promote, rather than block, serious, moral and compassionate discussions of the difficult issues raised by high-tech medicine.

Or take the health-care law’s creation of the Independent Payment Advisory Board, known as IPAB. It’s a 15-member body charged with finding ways of cutting the costs of treatment under Medicare. Congress would have the final say, but through a fast-track process. Yet the ink was barely dry on Obama’s signature of the Affordable Care Act (ACA) when a group of Republican senators introduced what they called the Health Care Bureaucrats Elimination Act, to get rid of IPAB. Thus did an innovative effort to save money meet with a slap in the face. Conservatives barely acknowledge other cost-saving experiments in the ACA.

Is it any wonder that our fiscal politics are so dysfunctional? Yes, we liberals are very reluctant to cut access to various government health-insurance programs. With so many Americans still uninsured, we are wary of depriving more people of coverage. But we fully accept the need to contain government health spending.

Yet given the conservatives’ habit of walking away even from their own ideas (the exchanges, for example) and of rejecting progressive efforts to save money, is it any wonder that liberals suspect them of greater interest in dismantling programs than in making them more efficient? We won’t find genuine common ground on deficits until we resolve this dilemma.

“John Boehner’s Christmas Gift”: A Guarantee That The Republican House Will Destroy The Economy

Last week, we learned that Speaker of the House John Boehner has no control over his majority. We’ve seen Boehner have trouble with his caucus before, of course — a significant portion of these people are crazy — but the failure of “Plan B” was different. In the past Boehner has had trouble whipping votes to support things that were destined to become law. Boehner couldn’t get his caucus to support TARP because TARP was awful and was also definitely going to happen. Boehner couldn’t get the votes for the 2011 debt deal because conservatives thought they’d eventually force an even better deal. But this was a totally symbolic gesture that never had any shot at passing the Senate or getting signed by the president. Boehner’s “Plan B” was a stupid pointless empty gesture, and that is why its failure is actually slightly scary, in addition to being hilarious.

The point of “Plan B” was to give Republicans a means of blaming Democrats when everyone’s taxes go up next year, while also giving them an opportunity to claim that they supported raising taxes on rich people. The problem was, Republicans really don’t support raising taxes on rich people, and they feel so strongly about this that they didn’t want to pretend to support a tax increase.

What is especially silly about all of this is that in any sort of sensible political system none of it would be happening. A majority of Americans just voted for Democrats to control the White House, Senate and House of Representatives, which would seem to indicate that a majority of American voters would just prefer it if Barack Obama, Harry Reid and Nancy Pelosi decided all of this for themselves. But that’s not the way our archaic political system works, and instead we will watch this unpopular anthropomorphic Camel 100 carefully negotiate a compromise with the president that his party will refuse to support, until we either extend all tax cuts forever or “go over the cliff” and cause every Sunday show panelist in the country to hyperventilate until losing consciousness.

How did we get here? Keep in mind, your average congressperson is as dumb as your average regular person, and Republican members listen to the same talk radio and read the same right-wing blogs and watch the same Fox News as every other conservative. It’s always been comforting to imagine that canny evil masterminds huddle in backrooms plotting how to use the right-wing media machine to manipulate the rubes into accepting whatever the corporate elites want, but the story now is that the canny masterminds have no control over the media operation they’ve built and the “grownups” cannot convince the true believers to do shit. There’s really no talking sense into Michele Bachmann and Steve King, and every two years gerrymandered ultra-conservative districts send more and more Kings and Bachmanns to the House. And Republicans know that their safe districts are only safe from Democrats, not even-crazier Republicans.

John Boehner will probably be fine. He’ll likely remain speaker even, mostly because no one else wants that horrible job. America might not be fine.

“Going over the fiscal cliff” will be a fun adventure at first, especially because it has been so long since America has had any sort of tax hike or defense budget cut, but shortly after the “cliff” comes the debt ceiling increase vote, and there is really no chance, at all, of the House raising the debt ceiling, under any circumstance. Maybe if the president agrees to block grant Medicare and return America to the gold standard. And promises to personally fire 100 teachers.

The idea that “going over the cliff” would give the president enough leverage to get a halfway decent deal — with some stimulus up front and everything! — depended on a House of Representatives capable of acting rationally. It’s apparent that they are in fact prepared to intentionally tank the entire American economy.

“It’s Our System On The Cliff”: Republicans Can Spend Two Years Doing Absolutely Nothing Or Try To Help Solve The Country’s Problems

The United States faces a crisis in our political system because the Republican Party, particularly in the House of Representatives, is no longer a normal, governing party.

The only way we will avoid a constitutional crackup is for a new, bipartisan majority to take effective control of the House and isolate those who would rather see the country fall into chaos than vote for anything that might offend their ideological sensibilities.

In a democratic system with separated powers, two houses of Congress, split between the parties, a normal party accepts that compromise is the only way to legislate. A normal party takes into account election results. A normal party recognizes when the other side has made real concessions. A normal party takes responsibility.

By all of these measures, the Republican majority that Speaker John Boehner purports to lead is abnormal. That is the meaning of his catastrophic failure to gather the votes for his “Plan B” proposal on the “fiscal cliff.” Many of his most radical members believe they have a right to use any means at their disposal to impose their views on the country, even if they are only a minority in Congress.

There may, however, be good news in the disarray: The right wing of the Republican House has chosen to marginalize itself from any serious negotiations. The one available majority for action, especially on budgets, is a coalition uniting most Democrats with those Republicans who still hold the old-fashioned view that they were elected to help run the country.

To avert a fiscal nightmare in the short run, this potential majority needs to be allowed to work its will. The result may well be a modestly more progressive solution than President Obama offered Boehner, a deal with somewhat fewer cuts and more revenue. That’s the price the right wing will have to pay for refusing to govern.

This is almost exactly what happened in 1990, when the most conservative Republicans rejected a deficit-reduction agreement negotiated by President George H.W. Bush and Democrats in Congress. After a conservative rebellion brought the initial bill down, a more progressive measure was enacted with more Democratic votes.

In the longer run, the non-tea party wing of the GOP will have to decide whether it wants to be subject to the whims of colleagues to their right or look to the center for alliances with the Democrats. The choice is plain: We can spend two years doing absolutely nothing, or we can try to solve the country’s problems. This includes the problem of gun violence, and the question is whether the GOP will reject the tone-deaf extremism of NRA chief Wayne LaPierre’s bizarre response to the killings in Newtown, Conn.

Our political structure has been disfigured in another way: In November’s election, Democrats failed to win the House even though they received about a million more votes in House contests than the Republicans did. Republicans were protected by gerrymandered districts and by political geography: Democrats tend to win urban and certain suburban districts by overwhelming margins.

In Pennsylvania, to pick a stark case, Democrats edged out the Republicans in the popular vote for House races. But given how the districts were drawn, this resulted in the Republicans winning 13 seats to only five for the Democrats.

Both parties gerrymander, of course, but Republicans had far more influence over the process this time because the 2010 election gave them dominance of so many legislatures. Thus did one election shape our politics for a decade, even though the country changed its mind one election later.

This unfortunate moment is a vindication of those like my colleagues Thomas Mann and Norman Ornstein, who have been arguing that today’s Republicans are fundamentally different from their forebears. In their appropriately named book, “It’s Even Worse than It Looks,” Mann and Ornstein called the current GOP “an insurgent outlier in American politics,” and described the party this way: “It is ideologically extreme; scornful of compromise . . . and dismissive of the legitimacy of its political opposition.”

Their words are a rather precise description of why Boehner was unable to deliver a majority of his party to his budget bill.

It’s true that Boehner miscalculated, foolishly asking Republicans to vote for a symbolic tax increase that had no chance of becoming law. And the speaker fed the fires of rebellion with repeated false claims that Obama had made no meaningful concession when the president had, in fact, annoyed his base by making rather big ones.

But now, at least, we know something important: The current Republican majority in the House cannot govern. Only a coalition across party lines can get the public’s business done.

“The NRA’s Worse Nightmare”: Gun-Rights Advocates Should Fear History Of Second Amendment

On Sunday, New York Sen. Chuck Schumer went on CBS’s Face The Nation and argued that people who support gun control “have to admit that there is a Second Amendment right to bear arms”.

Schumer’s effort to reach out to the gun-rights community may be well-intentioned, but it is also deeply ironic. If the nation truly embraced the Second Amendment as it was originally written and understood, it would be the NRA’s worst nightmare.

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

It’s time for a history lesson about one of America’s most popular and least understood rights. It’s also long past time to expose the hollow, ignorant fawning over the Second Amendment by gun-rights advocates for what it is.

In contrast to the libertarian fantasies that drive the contemporary debate about firearms in America, the Founders understood that liberty without regulation leads not to freedom, but anarchy. They understood that an armed body of citizens easily becomes a mob. In other words, a bunch of guys grabbing their guns and waving a flag emblazoned with a rattlesnake is not a militia.

A cursory look at the history of the Second Amendment shows that regulation was a central part of its rationale—putting “well regulated” at the very start of the amendment was no accident. For instance, starting in the colonial period, states enacted a variety of “safe-storage” measures to deal with the danger posed by stored gunpowder. A 1786 law went as far as prohibiting the storage of a loaded gun in any building in Boston.

But many people who defend gun rights today are more than happy to skim over the first part of the amendment in their zeal to embrace the second. (The NRA itself literally chopped off that pesky first half when it chiseled the words on the face of its old headquarters.) As a result, our modern gun-rights ideology is often unmoored from any sense of corresponding civic obligation.

This ideology claims to rely heavily on the Second Amendment, and yet it is rooted not in the Founders’ vision, but in the insurrectionary ideas of Daniel Shays and those who rose up against the government of Massachusetts in 1786 and 1787. Indeed, there are gun-rights advocates today who think the Second Amendment actually gives them the right to take up arms against the government—but if that were true the Second Amendment would have repealed the Constitution’s treason clause, which defines treason as taking up arms against the government!

This is all so deeply twisted: after all, the Founders framed the Constitution in part as a response to the danger posed by Shays’ Rebellion.

As a result, our modern debate over gun rights has virtually nothing to with the Founders’ Second Amendment; that debate actually started about 30 years after the Amendment was adopted. What emerged was the notion that reasonable regulation was not inconsistent with the right to bear arms. In fact it was the only option in a heavily armed society.

Up until the 1980s, there was no “individual-rights” theory of the Second Amendment. Many states had adopted provisions protecting an individual right to own guns, but this tradition was distinct from the Amendment. All that changed when right-wing think tanks undertook a conscious effort to fund new scholarship to rewrite the amendment’s history. At first that effort was not well received, even in conservative circles. As late as 1991, former Supreme Court chief justice Warren Burger famously called the idea of an individual right to bear arms “one of the greatest pieces of fraud—I repeat the word ‘fraud’—on the American public by special-interest groups that I have ever seen in my lifetime.”

But the revisionism ultimately won over most of the legal establishment, reaching its zenith in 2008, when the Supreme Court broke with 70 years of established jurisprudence and affirmed that the Second Amendment protects an individual right to have guns in the home for reasons of self-defense.

In order to do this, the majority followed the lead of gun-rights advocates and essentially excised the first clause of the amendment—the “well-regulated militia” part—from the text.

(Let us pause briefly to note the irony that the opinion, District of Columbia v. Heller, was written by none other than Justice Antonin Scalia—America’s staunchest defender of originalism, or reading the Constitution according to its supposed original meaning.)

If the Heller court had simply said, “Look, most Americans think the Amendment is about an individual right, and no one really cares what James Madison or the average man on the street in 1791 thought”—then the case would be pretty uncontroversial. Instead, Scalia produced a pompous, error-filled opinion that has done more to discredit his beloved originalism than a generation of liberal academics ever could.

Even leading conservative legal scholars have harshly criticized the ruling: federal judge Richard Posner said most professional historians reject Scalia’s historical analysis in the case, and described Scalia’s jurisprudence as “incoherent”. Perhaps even more damning, J. Harvie Wilkinson, a federal judge appointed by Ronald Reagan, compared Heller to Roe v. Wade.

Of course, the fact that the Second Amendment is now treated as an individual right has almost no bearing on gun regulation, because no right is absolute. You can’t shout “Fire!” in a crowded theater, nor can you fire a gun in one.

And most Americans—including those who own guns—are open to reasonable gun regulation. The only people who oppose such policies are the NRA, extreme gun-rights advocates, and the craven politicians who do their bidding.

But what would such regulation look like?

For one thing, we could have a comprehensive system of firearm licensing and registration. At the moment we have none (even though it is hard to fathom how one might ever muster a militia without such a system). To avoid the irrational fears of gun confiscation, such a system ought to be instituted by the states, which maintained militias long before the Second Amendment existed. Could anyone with even a minimal understanding of the history of the Second Amendment seriously maintain that a state-based system violated the Amendment’s text or spirit?

The bottom line is that although we hear the Second Amendment invoked all the time, few of those who trumpet it the most vehemently realize that restoring the Founders’ vision of the Second Amendment would be a call for more gun regulation, not less.
