“The Party Of Nothing”: Republicans, An Immovable Wall of Nays
So far, it doesn’t look like the story of the Tsarnaev brothers is killing Republican support for immigration reform. John McCain and Lindsey Graham insisted that their identity makes reform all the more important. But Boston aside, if you pay a little attention you see signs that the right is getting a bit restive about all this reasonableness. There’s a long and winding road from here to there, but if the GOP does drop immigration, then it will essentially be a party of nothing, the Seinfeld Party, a party that has stopped even pretending that policy is something that political parties exist to make.
Yesterday in Salon, political scientist Jonathan Bernstein wrote up the following little discovery, which has to do with the numbering of bills. Historically, the party that controls the House of Representatives reserves for itself the first 10 slots—HR 1, HR 2, and so on. Usually, the majority party has filled at least most of those slots with the pieces of legislation that it wants to announce to the world as its top priorities. When the Democrats ran the House, for example, HR 1 was always John Dingell’s health-care bill, in homage to his father, a congressman who pushed for national health care back in the day.
Today, nine of the 10 slots are empty. Nine of the 10. The one that is occupied, HR 3, is taken up by a bill calling on President Obama to approve the Keystone XL pipeline. Even this, insiders will tell you in an honest moment, is completely symbolic and empty: the general expectation among Democrats and Republicans is that Obama will approve the pipeline sometime in this term, but that eleventy-jillion lawsuits will immediately be filed, and the thing won’t be built for years if at all, and nothing about this short and general bill can or is designed to change that. One other slot, HR 1, is provisionally reserved for a tax-reform bill, so at least they have settled on a subject matter, but if you click on HR 1, you will learn that “the text of HR 1 has not yet been received.”
This wasn’t true of even the GOP in earlier vintages. Newt Gingrich had an aggressive agenda, as we remember all too well, and even Denny Hastert filled most of the slots. (The Democrats of 2009 didn’t, for some reason, but obviously the Democratic Congress of 2009 was the most agenda-heavy Congress since 1981 or arguably 1965.) Today’s GOP can’t be bothered to pretend.
I became a grown-up, to the extent that I am one, right around the time Ronald Reagan took office. Lots of people say things like, “Gee, the Republican Party was really a party of ideas then.” I argue that that assertion is vastly overaccepted today. The central conservative “idea,” after all—supply-side economics—was and remains a flimsy and evidence-free lie that has destroyed the country’s economic vitality and turned our upper classes into the most selfish and penurious group of people history has seen since the Romanovs. Other conservative ideas of the time were largely critiques of extant liberalism or gifts to the 1 percent dressed up in the tuxedoes of “liberty” and “freedom.” I’ll give them credit for workfare and a few other items. But the actual record is thinner than most people believe.
Still, there was some intellectual spadework going on. And still (and this is more important), there were people in the Republican Party who tried to bring those ideas into law. The Orrin Hatch of the 1980s and 1990s was a titan compared with the Orrin Hatch of today. When I look at Senate roll-call votes and see that immovable wall of nays on virtually everything of consequence that comes before them, I wonder what someone like Hatch really thinks deep down, but of course we’ll never know. He is doing what the party’s base demands of him, and those demands include that he clam up and denounce Obama and not utter one sentence that could be misinterpreted as signaling compromise.
This brings me back to immigration. The Tsarnaevs may not have derailed things, but other cracks are starting to show. Last Thursday—before we knew who the Boston bombers were—Rush Limbaugh speculated that immigration reform would constitute Republican “suicide.” A Politico article yesterday made the same point—an analysis showed that if 11 million “undocumented residents” had been able to vote in 2012, Obama might have won Arizona and would even have made a race of it in Texas. This did not go unremarked in right-wing circles yesterday. The Big Bloviator himself weighed in: “Senator Schumer can taste this. He’s so excited. All the Democrats. Why would we agree to something that they are so eager to have?”
Immigration is the one area today on which a small number of Republicans are actually trying. Limbaugh’s position last week is a change from a couple of months ago, when Marco Rubio had him admitting that maybe the GOP needed to embrace reform. It’s not hard to imagine him and Laura Ingraham and others turning surlier as the hour of truth on the bill approaches.
I will be impressed and more than a little surprised if the day comes and a majority of Republicans back an immigration bill. Passing such a bill is undoubtedly in their self-interest, as everyone has observed. What fewer have observed is that doing so is just not in their DNA. And life teaches us that genes usually get the better of reason.

“It’s Official, The Tea Party Is Back”: Once Again, Fantasies Of A Pragmatic GOP Prove Illusory
Say what you will about Politico, but aside from the many bits of useful phenomenological data its vast minions gather each day, it serves as a sort of public utility in instantly and thoroughly expressing the shifting perspectives of the MSM. Today, having misinterpreted and buried the Tea Party Movement a thousand times, Politico (in this piece by Tarini Parti) now takes judicial notice of its return on Capitol Hill:
The Tea Party Caucus is back in action with a new strategy and a growing membership.
Roughly 20 House Republicans attended a closed-door meeting Thursday evening in the Rayburn House Office Building, along with staffers from nearly 40 congressional offices, including those of Senate Minority Leader Mitch McConnell and fellow Kentucky Republican Sen. Rand Paul.
It comes as conservatives continue to flex their muscle, making life difficult for GOP leaders in the House on issues like Obamacare, and as the debate on immigration legislation heats up.
Conservative mainstays such as Reps. Paul Broun (R-Ga.), Louie Gohmert (R-Texas), Tom Price (R-Ga.), Trent Franks (R-Ariz.) and Steve King (R-Iowa) were among those at the meeting. A source said the entire GOP House delegation from South Carolina was there as well.
Mike Shields, chief of staff to Republican National Committee Chairman Reince Priebus, spoke at the meeting – an indication that the GOP establishment is making an effort to work with the tea party lawmakers.
Also in attendance: Conservative radio talk show host Rusty Humphries and representatives from organizations including the Tea Party Express and U.S. Chamber of Commerce. TheTeaParty.net organized the meeting, which was closed to press.
The possibility that high attendance at the caucus meeting might reflect a continuing presence rather than a sudden resurgence was indirectly addressed by this quote from Louie Gohmert:
“I thought it was the energy we had when we first started things,” Gohmert told POLITICO after the meeting. “The Tea Party beliefs and movement never really went away. It was just that the caucus wasn’t really having meetings.”
True dat. You could make the case, in fact, that the relative quiescence of the Tea Party Caucus was attributable to its consolidation of power within the Republican “Establishment.” Now that strategic disagreements within the congressional GOP are re-emerging, it’s time to get loud and proud again. But the whole phenomenon shows how shallow all the talk about the GOP “rebranding” and “adjusting to new circumstances” really was–much less the fatuous chatter about “bipartisan breezes wafting through Congress.”
It’s entirely possible, not soon but in the foreseeable future, that the Republican Party and even the conservative movement can genuinely move beyond the “Spirit of 2010” and begin to act like a political party rather than a wrecking crew. But anyone who has paid genuine attention to the Tea Party Movement must understand that these are people who violently oppose the idea of “moving on” or “adjusting to circumstances.” The whole point of “constitutional conservatism” is the belief in an eternal, perhaps even divinely ordained, governing model that never, ever, goes out of season. Maybe they’ll lose influence in the GOP and the country as a whole, but they aren’t going away or changing. Their periodic rediscovery by the MSM when once again fantasies of a “pragmatic” GOP prove illusory is one of the maddening but abiding aspects of contemporary political journalism.

“Everything That’s Rotten About Congress”: Fixing The Part Of Sequestration That Affects Rich People
After a month or so of the sequestration budget cuts only affecting people Congress doesn’t really care about, the cuts hit home this week when mandatory FAA furloughs caused lengthy flight delays cross the country. Suddenly, sequestration was hurting regular Americans, instead of irregular (poor) ones! Some naive observers thought this would force Congress to finally roll back the purposefully damaging cuts that were by design never intended to actually go into effect. Those observers were … sort of right! The U.S. Senate jumped into action last night and voted to … let the FAA transfer some money from the Transportation Department to pay air traffic controllers so that the sequestration can continue without inconveniencing members of Congress, most of whom will be flying home to their districts today. The system works! (For rich people, like I’ve been saying.)
The Washington Post says, “The Senate took the first step toward circumventing sequestration Thursday night,” though in fact what it did was work to ensure that the sequester continues not affecting elites, who fly regularly. I am embarrassed that I did not predict this exact outcome in my column Tuesday morning. The Senate, which can’t confirm a judge without months of delay and a constitutional crisis, passed this particular bill in about two minutes, with unanimous consent. The hope is that the House can get it taken care of today, I guess in time for everyone to fly to Aspen or wherever people whom Congress listens to fly to on Fridays.
After that Congress will be done fixing all the various problems with the design and implementation of the sequestration:
But House action on a broader deal to undo the across-the-board cuts appears remote. House conservatives say much of the impact has been exaggerated by the White House, and they have relished the success of forcing visible spending cuts on a Democratic administration.
“I think it’s the first time we’ve saved money in Washington, D.C.,” said Representative Raúl Labrador, Republican of Idaho. “I think we need to move on from the subject.”
Move on, people who may become homeless! We fixed the airports, what more do you want?
There was a big to-do yesterday about a Politico story insisting — explosively! morning-winningly! — that Congress was trying to exempt itself from Obamacare. Because this is Politico, the story was based on equal parts misunderstanding of policy and desire to create a fuss. The actual story is that Republicans proposed forcing members of Congress and their staffs to only use healthcare plans created by Obamacare or available in the exchanges. Democrats passed the amendment, as a sort of fuck you. But the exchanges are designed for people who don’t have employers who pay for healthcare. Congressional staffers get employer-sponsored health benefits. The exchanges are explicitly not designed for employees of large employers who pay for healthcare, so some people are right now trying to figure out how to make sure staffers continue to get healthcare. It may end up not being a big deal, or it may require a tweak to the law. But it’s not a scandal. (Honestly, it’s all a pretty good argument for ditching employer-based healthcare in favor of universal single-payer but then again everything is.)
But the fuss was already created. The story will live forever, and no amount of debunking in the world will kill the popular myth that Congress attempted to secretly “exempt” itself from Obamacare. So self-serving!
Their staffers are generally the poorest people members of Congress know, and trying to make sure their healthcare is paid for is seriously the closest our legislature gets to altruism. But while the story of Congress working to make sure its staffers don’t have to shoulder the entirety of their premium costs because of Republican political stuntmanship was treated as a scandal and an example of everything rotten about Congress, the story of Congress hurriedly making sure the well-off minority of Americans who fly regularly don’t get briefly inconvenienced — while ignoring the costs of brutal cuts on programs for low-income Americans facing housing or hunger crises — is treated as a wonderful and encouraging display of bipartisanship.

The Unending War On Obamacare: Count On Republicans To Stand In The Way Of Fixing Whatever’s Wrong With It
I’m not a historian, so maybe there’s something I don’t know, but it seems to me that there may never have been a piece of legislation that has inspired such partisan venom as the Affordable Care Act. Sure, Republicans hated Medicare. And yes, their rhetoric at the time, particularly Ronald Reagan’s famous warning that if it passed, “We are going to spend our sunset years telling our children and our children’s children, what it once was like in America when men were free,” was very similar to what they now say about Obamacare. But once it passed, their attempts to undermine it ran more to the occasional raid than the ongoing siege.
I bring this up because Kevin Drum makes an unsettling point today about the future of Obamacare:
No, my biggest concern is what happens after 2014. No big law is ever perfect. But what normally happens is that it gets tweaked over time. Sometimes this is done via agency rules, other times via minor amendments in Congress. It’s routine. But Obamacare has become such a political bomb that it’s not clear that Congress will be willing to fix the minor problems that crop up over time. There’s simply too big a contingent of Republicans who are eager to see Obamacare fail and are actively delighted whenever a problem crops up. This has the potential to be a problem that no other big law has ever had to face.
It’s hard to overstate just how enormous a symbolic presence Obamacare has come to occupy in Republicans’ minds. They’ve invested so much time in not just criticizing it but telling their constituents that it is the worst thing to ever happen to America—and yes, sometimes they literally say things like that—that they’ve lost all moral perspective. To them, trying to fix a feature of the law so that it works better or helps people more would be a horrifying moral compromise, tantamount to sending fur coats to the guards at Stalin’s labor camps in Siberia. If you say to them, “Look, it’s the law now—why don’t we make sure it works as well as possible?” it just won’t register.
Combine that with the fact that in general, congressional Republicans have stopped caring much about policy at all, and they never cared about health care in the first place. They don’t want to know the details of issues; it just isn’t their priority. In the House, conservatives are spending their time clamoring for an opportunity to cast yet another vote to repeal Obamacare. “The guys who have been up here the last two years, we can go home and say, ‘Listen, we voted 36 different times to repeal or replace ObamaCare,” said Mick Mulvaney of South Carolina. “Tell me what the new guys are supposed to say?” Your tax dollars at work.
You can look at this state of affairs and assume that as new difficulties with the law come to light, it will be possible for the Obama administration to address them with administrative action, through the Department of Health and Human Services. And that may be true to an extent. But other changes could require legislation, and it’s a fair bet that no matter what is involved, Republicans in Congress would reject anything having to do with the law that didn’t involve repealing it. You could tell them that there was a typo in the bill which was causing orphans to be turned into Soylent Green and all it would require to fix was a quick voice-vote, and they’d say no, because Obamacare kills freedom.
And let’s not forget, it’s entirely possible that 45 months from now, there will be a Republican president. If that happens, it’s possible that in order to get confirmed, his or her nominee to be secretary of Health and Human Services will have to pledge to Senate Republicans to work every day to dismantle Obamacare. The clock is ticking.
