“A Get-Out-Of-Jail-Free Card”: Boehner Offered Free Pass Out Of Shutdown Mess, But He Doesn’t Want To Take It
U.S. District Judge Andrew Hanen’s Monday night ruling temporarily blocking President Obama’s Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) program provided a political lifeline for congressional Republicans. But whether or not they’re smart enough to take it remains unclear.
For weeks, Republicans have been hurtling towards another catastrophic shutdown debacle. Furious over President Obama’s immigration action, congressional Republicans devised an illogical scheme to fight back: They would separate the Department of Homeland Security from December’s government funding bill, and then use it as a hostage. Unless President Obama abandons his policy by February 27, DHS would enter a partial shutdown.
The strategy never had a prayer of working, for several reasons. President Obama has long since proven that he is done giving in to Republican ransom demands. Shutting down DHS would not actually do anything to stop President Obama’s deferral plan. And the American public was always going to blame the GOP for any shutdown crisis. (This was confirmed by a CNN poll released Tuesday, which found that 53 percent of Americans would hold Republicans responsible, while just 30 percent would blame the president, and 13 percent would blame both.) Unless they planned to never pay DHS workers again, the only possible outcome for the GOP was embarrassing defeat.
But still, Republicans went all in. One month ago, the House passed a bill linking DHS funding with blocking DAPA. Although it repeatedly failed to pass the Senate, House Speaker John Boehner insisted that “the House has done its job,” and has flatly refused to consider a clean funding bill. Meanwhile, even if the Senate somehow does pass a bill limiting Obama’s authority, the president would veto it. A politically catastrophic shutdown seemed increasingly inevitable.
So one might think that House Republicans would welcome Judge Hanen’s ruling as a get-out-of-jail-free card. With DAPA blocked, pending appeal, they could pass a clean DHS funding bill with a clean conscience, tell their constituents that the matter is in the courts’ hands now, and save the fight for another day.
But it’s never that easy with the Republican caucus.
Speaker Boehner’s reaction to the ruling suggests that he’s still committed to taking this all the way.
“The president said 22 times he did not have the authority to take the very action on immigration he eventually did, so it is no surprise that at least one court has agreed,” Boehner said in a statement. “We will continue to follow the case as it moves through the legal process. Hopefully, Senate Democrats who claim to oppose this executive overreach will now let the Senate begin debate on a bill to fund the Homeland Security Department.”
In case there was any doubt, Democrats are still not ready to begin debate on forcing a maximum-deportation policy on the White House.
“It’s perfectly appropriate to take this issue to court, but it is completely unacceptable for Republicans to hold up funding for the Department of Homeland Security while the case wends its way through the legal system,” Senator Chuck Schumer (D-NY) said in a statement. “This procedural ruling, in our opinion, is very unlikely to be upheld, but regardless of the outcome Democrats remain united in our belief that funding for the Department of Homeland Security should not be used as a ransom by Republicans, period.”
Republicans clearly learned the wrong lessons from their last government shutdown, which they overcame at the ballot box in November. They are extremely unlikely to be so lucky again in 2016, when the elections will be fought on a much friendlier terrain for Democrats. On Monday night, Judge Hanen threw the GOP a lifeline; they’d be wise to grab it.

“A Lesson Not Learned”: There’s Another Shutdown Fight In Washington. Republicans Will Lose This One, Too
Congressional Republicans are in a tough spot. Funding for the Department of Homeland Security expires on February 27, but conservatives are demanding that any DHS funding bill also block President Barack Obama’s executive actions on immigration. That’s unacceptable to Senate Democrats, who filibustered the legislation three times last week.
And now we’re stuck. Some Republican senators are urging their House colleagues to accept a “clean” funding bill that doesn’t block Obama’s unilateral actions, but that’s unacceptable to House Republicans. “The House did its job,” Speaker John Boehner said Wednesday. “Now it’s time for the Senate to do their work.” No one is quite sure how this will end. “I guess the lesson learned is don’t put yourself in a box you can’t figure out a way to get out of,” Republican Senator Shelley Moore Capito said.
The exact outcome may be unpredictable, but this impasse wasn’t.
Think back two months ago, when Congress needed to reach an agreement to fund the entire government. Conservatives were still seething at the president for taking executive action on immigration and wanted to use the government funding deadline as leverage to enact concessions from Obama. Republican leadership, on the other hand, was terrified that another government shutdown would be a political disaster for the GOP, just as they regained full control over Congress. And, they argued, Republicans would have more leverage in the 114th Congress, having won the Senate in November. The compromise was to fund the government through the rest of the fiscal year—with the exception of the Department of Homeland Security, which was funded only until February 27.
Conservatives weren’t happy with the deal, but Boehner’s job was safe. More importantly, the Republican leadership had limited the political downside of a potential shutdown. Now, it wouldn’t be a full government shutdown, just one department. Given the Tea Party’s fury at Obama, that was a huge victory for Boehner.
But even though the current impasse was the best case scenario for Republicans, they still are in a tough position. The practical effects of a DHS shutdown are relatively minor, since most of DHS’s employees are classified as essential and thus would continue to work in the case of a shutdown. But the political implications of it are much worse. Obama can criticize the GOP for putting the U.S.’s national security at risk. “I can think of few more effective ways for Republicans to re-surrender national security as an issue to Obama than by taking the Department of Homeland Security hostage like this,” The New Republic’s Brian Beutler wrote in December. And that’s exactly what Obama has done in recent weeks. As February 27 approaches, Obama and other Democrats will only amplify that message.
Republicans are already trying to avoid blame for a DHS shutdown. “If there’s a shutdown, it wouldn’t be because of us,” Republican Senator Orrin Hatch said Tuesday. “The Democrats are filibustering it. I don’t know how we get blamed for that this time.” Hatch is right—Democrats did filibuster the House-passed legislation on three separate occasions. But Republicans will probably take the blame. That’s how the politics of the filibuster work. The minority uses it to obstruct legislation and the majority takes the blame. Americans know that Republicans control both chambers of Congress. They aren’t paying attention to parliamentarian rules.
In all likelihood, this will end the same way every funding fight ends these days: Republican leadership will eventually bring up a clean bill and it will pass with mostly Democratic votes. That’s long been the GOP game plan. It’s also possible that Republican leadership will see this fight, with its relatively small stakes, as a good opportunity to build credibility with the Tea Party by standing up to Obama and refusing to pass a clean bill.
Neither of those outcomes are good for the GOP. But this is what happens when one ideological group has outsized control over a party and wants to pick funding fights that they are certain to lose.

“Money Makes Crazy”: The GOP Consensus On Money Is Crazy, Full-On Conspiracy-Theory Crazy
Monetary policy probably won’t be a major issue in the 2016 campaign, but it should be. It is, after all, extremely important, and the Republican base and many leading politicians have strong views about the Federal Reserve and its conduct. And the eventual presidential nominee will surely have to endorse the party line.
So it matters that the emerging G.O.P. consensus on money is crazy — full-on conspiracy-theory crazy.
Right now, the most obvious manifestation of money madness is Senator Rand Paul’s “Audit the Fed” campaign. Mr. Paul likes to warn that the Fed’s efforts to bolster the economy may lead to hyperinflation; he loves talking about the wheelbarrows of cash that people carted around in Weimar Germany. But he’s been saying that since 2009, and it keeps not happening. So now he has a new line: The Fed is an overleveraged bank, just as Lehman Brothers was, and could experience a disastrous collapse of confidence any day now.
This story is wrong on so many levels that reporters are having a hard time keeping up, but let’s simply note that the Fed’s “liabilities” consist of cash, and those who hold that cash have the option of converting it into, well, cash. No, the Fed can’t fall victim to a bank run. But is Mr. Paul being ostracized for his views? Not at all.
Moreover, while Mr. Paul may currently be the poster child for off-the-wall monetary views, he’s far from alone. A lot has been written about the 2010 open letter from leading Republicans to Ben Bernanke, then the Fed chairman, demanding that he cease efforts to support the economy, warning that such efforts would lead to inflation and “currency debasement.” Less has been written about the simultaneous turn of seemingly respectable figures to conspiracy theories.
There was, for example, the 2010 op-ed article by Representative Paul Ryan, who remains the G.O.P.’s de facto intellectual leader, and John Taylor, the party’s favorite monetary economist. Fed policy, they declared, “looks an awful lot like an attempt to bail out fiscal policy, and such attempts call the Fed’s independence into question.” That statement looks an awful lot like a claim that Mr. Bernanke and colleagues were betraying their trust in order to help out the Obama administration — a claim for which there is no evidence whatsoever.
Oh, and suppose you believe that the Fed’s actions did help avert what would otherwise have been a fiscal crisis. This is supposed to be a bad thing?
You may think that at least some of the current presidential aspirants are staying well clear of the fever swamps, but don’t be so sure. Jeb Bush appears to be getting his economic agenda, such as it is, from the George W. Bush Institute’s 4% Growth Project. And the head of that project, Amity Shlaes, is a prominent “inflation truther,” someone who claims that the government is greatly understating the true rate of inflation.
So monetary crazy is pervasive in today’s G.O.P. But why? Class interests no doubt play a role — the wealthy tend to be lenders rather than borrowers, and they benefit at least in relative terms from deflationary policies. But I also suspect that conservatives have a deep psychological problem with modern monetary systems.
You see, in the conservative worldview, markets aren’t just a useful way to organize the economy; they’re a moral structure: People get paid what they deserve, and what goods cost is what they are truly worth to society. You could say that to the free-market true believer, to know the price of everything is also to know the value of everything.
Modern money — consisting of pieces of paper or their digital equivalent that are issued by the Fed, not created by the heroic efforts of entrepreneurs — is an affront to that worldview. Mr. Ryan is on record declaring that his views on monetary policy come from a speech given by one of Ayn Rand’s fictional characters. And what the speaker declares is that money is “the base of a moral existence. Destroyers seize gold and leave to its owners a counterfeit pile of paper. … Paper is a check drawn by legal looters.”
Once you understand that this is how many conservatives really think, it all falls into place. Of course they predict disaster from monetary expansion, no matter the circumstances. Of course they are undaunted in their views no matter how wrong their predictions have been in the past. Of course they are quick to accuse the Fed of vile motives. From their point of view, monetary policy isn’t really a technical issue, a question of what works; it’s a matter of theology: Printing money is evil.
So as I said, monetary policy should be an issue in 2016. Because there’s a pretty good chance that someone who either gets his monetary economics from Ayn Rand, or at any rate feels the need to defer to such views, will get to appoint the next head of the Federal Reserve.

“Christian Exceptionalism”: Conservatives Want To Rewrite The History Of The Crusades For Modern Political Ends
At the National Prayer Breakfast, President Obama made a statement that you wouldn’t expect to be controversial: violence in the name of religion is a global problem and it’s bad.
He referenced the war in Syria, the killings in Nigeria, anti-Semitism’s resurgence in Europe and religious violence in India. He admitted that it can be hard to “counteract such intolerance. But God compels us to try.” Then he offered a longer thought about humility:
Humanity has been grappling with these questions throughout human history. And lest we get on our high horse and think this is unique to some other place, remember that during the Crusades and the Inquisition, people committed terrible deeds in the name of Christ. In our home country, slavery and Jim Crow all too often was justified in the name of Christ.
The subsequent controversy fuelled by right-wing American commentators and politicians has shown that humility is in short supply.
The response was furious. Right-wing radio and TV talking heads aired long rants about Obama’s “attacks on Christianity”. Jonah Goldberg claimed the Crusades were a justified action against Muslim aggression and the Inquisition was a well-intentioned anti-lynching measure. Ross Douhat spent his morning on Twitter defending conservative Catholicism more generally. Redstate.com’s Erick Erickson declared that Barack Obama was not a Christian in “any meaningful way”. Louisiana Gov. Bobby Jindal argued that since the medieval Christian threat was over a long time ago, we should just focus on combating radical Islam.
Jindal is wrong. While relatively few contemporary Christians are calling for the crusades these days (although crusader iconography is not uncommon in the US military), it’s a mistake to believe in Christian exceptionalism – the idea that Christianity alone has solved its problems – while other religions are still “medieval”. One of history’s lessons is that any ideology, sacred or secular, that divides the world into ‘us versus them’ can and will be used to justify violence.
But when we talk about the past, we’re often really talking about ourselves. In my scholarship, for instance, I look at the ways in which medieval people developed stories about holy war as a response to contemporary problems – which often had little to do with the Crusades.
This kind of tale-telling happens today as well. Matthew Gabriele, a history professor at Virginia Tech, has written about the dangerous nostalgia for the Crusades by right-wing commentators and politicians. In an email, Gabriele told me, “It stems from an understanding of the past as unchanging, one where Christians have always been at war with Muslims and always will be at war with Muslims. It’s an argument that doesn’t care for historical context and one that relies on a false equivalence — either “they” (Muslims) were worse than “us” (Christians) or “they” (Christians of the past) are not “us” (Christians of the present).”
In other words, either the bad stuff done by long-dead Christians has nothing to do with modern Christianity; or maybe the Crusades weren’t so bad for Muslims and Jews after all.
But the Crusades were pretty bad. Historians debate the precise extent and savagery of the violence, but we generally agree that the intensity of the religiously-motivated brutality was staggering. We argue, for example, whether there really was cannibalism during the First Crusade (probably), and whether blood really flowed up to the combatants’ ankles in the Temple of David in 1099 (probably not). But there’s no question that crusaders were sometimes driven to slaughter non-Christian civilian populations both in Europe and in southwest Asia, all in the name of religion.
Obama’s statements therefor reflect well-accepted historical knowledge. The Inquisition led to the execution of many people guilty – at most – of thought crime. Christianity has been regularly and explicitly used to justify colonization, slavery, cultural destruction and racial discrimination. These are simply undisputed facts, and if they make us uncomfortable, it’s worth thinking about why. Moreover, it’s vital to recognize that abolitionists and pacifists, just like those calling for inter-faith harmony today, have drawn strength from their religious convictions.
Reminding the public about ugly moments in the history of Christianity does not make one anti-Christian. To compare the Jordanian pilot who was burned to death by Isis militants to the public burning of Jesse Washington in Waco, Texas does not make one un-American. To acknowledge such comparisons instead gives one the moral authority to call out other acts of violence and atrocity, including those that are justified via religion.
That’s the real message of President Obama’s address at the National Prayer Breakfast. We need humility. We must recognize our fallibility, we must study the past to understand why things happen, and then we must try to do better. History – and not just the one written by the “victors” – is critical for illuminating both our present and our future; how ideologues try to rewrite it reveals the power of the stories we tell about the past to shape the future they hope to construct.

“Rigging The Rules”: Scott Walker’s War On Good Government
Here’s a good government rule of thumb: foxes ought not guard the henhouse. When self-interested politicians rig the rules to protect themselves against independent scrutiny, citizens have a reason to be concerned. Common sense tells us that any politician – especially one with White House dreams like Wisconsin’s Governor Scott Walker – should know that undermining an independent government agency sure makes it look like you’ve got something to hide.
Gov. Walker gained office – and won reelection last fall – by casting himself as a conservative reformer. His zeal for cutting budgets and bashing unions has made him popular on the right. Following a reportedly “strong performance” at Iowa’s Freedom Summit, sponsored by Citizens United, the same organization that brought you unlimited and unaccountable secret money in politics through its infamous Supreme Court case, Gov. Walker filed paperwork last week to set up a 527 political organization, “Our American Revival,” to explore a run for President in 2016.
This first move towards a presidential run is sure to bring Walker plenty of attention from reporters and Republican activists. Yet it seems Walker’s dreams for the Oval Office might lead him, or allies helping to position him, to interfere with an independent investigation into his campaigns. Walker’s loyalists are attempting to defund, undermine, and destroy Wisconsin’s Government Accountability Board (GAB), an independent investigative agency, which enforces ethics, campaign finance, and election laws. It’s an agency that investigated alleged illegal campaign finance violations that plagued Walker’s 2012 recall election.
Top election law experts around the country call Wisconsin’s GAB, “America’s Top Model” of agencies charged with administering state elections. Most modern democracies around the world have independent election overseers to avoid partisan hacks writing election rules to favor their party. Unfortunately, impartial election boards are not common in American democracy yet. Wisconsin’s GAB is the gold standard, and is watched closely by reformers eager to modernize our political system so that voters set the rules for politicians, instead of politicians writing rules for themselves.
The GAB was created in 2007 with virtually unanimous, bipartisan support in the state legislature. It replaced a collection of ineffective, partisan state elections and ethics boards. By law, six retired judges make up the board. They are selected in a deliberate, three-part process to ensure that they’re non-partisan and politically impartial. A key provision of the law blocks legislative appropriators from meddling in the agency’s investigations.
Allies of Gov. Walker are unhappy because in 2012 the GAB voted unanimously to investigate possible illegal coordination between the governor’s recall campaign and two outside special interest groups, Wisconsin Club for Growth and Wisconsin Manufacturers and Commerce. Those organizations spent millions of dollars on Walker’s behalf in the recall election. The GAB also cooperated and pooled resources with another probe, “John Doe II,” led by Republican and Democratic District Attorneys and a Republican Special Prosecutor.
The John Doe investigators considered potential criminal charges of illegal coordination between Wisconsin Club for Growth and other groups with the Walker campaign during the 2012 recall elections. The John Doe process in Wisconsin is similar to a grand jury investigation – it’s largely secret and permits grants of immunity from prosecution to witnesses in exchange for their testimony.
Some of Gov. Walker’s political allies want to eviscerate the GAB. Others are trying to gut longstanding campaign finance protections. Wisconsin Club for Growth has filed a lawsuit against the GAB, claiming that it lacked power to investigate the possible illegal campaign coordination. Another lawsuit implies that anti-coordination rules, designed to prevent circumvention of contribution limits, impinge on free speech.
Meanwhile, the GAB also is facing legislative attacks. The legislature has cut GAB funding in the last three state budgets and launched an audit of the agency in an attempt to embarrass and undermine it. Most recently—and alarmingly – Wisconsin’s speaker of the assembly and the senate majority leader, both Republicans, have pledged an ill-advised effort to ram through legislation adding partisan appointments to the nonpartisan panel of retired judges, or replace it altogether with partisans.
Either move would destroy the agency’s independence and ability to hold Wisconsin’s government accountable. To date, the ongoing John Doe investigation (now enjoined by a federal court) has not produced charges against Gov. Walker or his campaign. But if the governor allows allies in the Legislature to eviscerate an independent state agency that voted unanimously to investigate his past campaign, he will face plenty of questions about his role in the debacle that may turn his White House dream into a nightmare.
