“The Case For Gun Liability Laws”: Guns Are The Only Consumer Product In America With No Safety Oversight

Knives. Automobiles. Cold medicine. Alcohol. Cigarettes. Coffee.

What do these items have in common?

They’re all held to a higher safety standard than firearms.

Because of product-liability law, manufacturers must equip them with proper warnings, limitations and built-in designs that enhance their safety.

If they don’t, consumers can sue them for harm caused by the product. And all consumer products manufacturers are required to ensure that their products are free of design defects and don’t threaten public safety.

Guns, as Jonathan Lowy of the Brady Center to Prevent Gun Violence’s Legal Action Project has said, are “the only consumer product in America with no federal safety oversight.”

Firearms haven’t always been a protected class; but as the industry lost millions in lawsuits over the years, liability protection became the NRA’s holy grail.

Before 2005, the Brady Center — named for President Reagan’s press secretary James Brady, who was shot and paralyzed in a failed assassination attempt on the president — had launched multiple lawsuits around the country. Los Angeles, New York and 30 other cities, counties and states had filed civil lawsuits against gun manufacturers — including a $100 million suit against the gun industry by Bridgeport, Connecticut in 1999. The pain inflicted on negligent manufacturers was real and it was expensive. In 2003, Bryco Arms declared bankruptcy after paying $24 million in the case of a 7-year-old boy who was paralyzed by a defective gun.

Then, in 2005, after a civil lawsuit brought after the Washington, D.C., sniper killings left the manufacturer Bushmaster with a $2 million bill, the NRA aggressively and successfully lobbied for the passage of the Protection of Lawful Commerce in Arms Act , which offered permanent protection to gun makers.

There is absolutely no reason that the manufacturers of deadly weapons should be given a free pass. Yet, after a week of carnage that included the Navy Yard shooting and a Chicago killing spree, Congress — a wholly owned subsidiary of the NRA — isn’t even bothering with gun-control legislation.

The public is expected to move on, with a weary shrug of the shoulders and a passive shake of the head, resigned to the inaction of our elected officials.

But the seventh mass shooting in a year combined with data predicting another one in February are not signs that we should give up.

They are a reminder that change takes time, patience and resolve, even when the moving images of tearful families are pushed to the back of our collective cultural memory.

Following the 1981 shooting of Brady, it took over five years for Congress to introduce meaningful gun legislation. The Brady Law requiring background checks wasn’t signed until 1993.

As gun violence increases, so too does the NRA’s stock — and the stock price of the publicly held gun manufacturers that fund it. In the wake of the December 2012 Newtown massacre, gun sales increased across the country. And the NRA gets a dollar for every gun or package of ammunition sold at participating stores.

A lot of those dollars go directly into Congressional coffers. The Center for Public Integrity reported that the NRA, Gun Owners of America and other allied groups have poured nearly $81 million into House, Senate and presidential races since 2000. Of the 46 senators who blocked a federal background checks bill in April, 43 have received millions of dollars from pro-gun interests in the last decade. And if elected officials weren’t already scared of being unseated by NRA-funded ads and campaigns, they need only look to the two Colorado state legislators who were recently recalled for supporting gun-control legislation.

Yet, there may be an opening to once again revisit common-sense legislation, including changing liability laws. After all, those who voted against the background check bill saw their approval ratings in their states drop as a result. And as recalled Colorado Sen. Angela Giron recently wrote, there is, in fact, a growing counterbalance to the gun lobby, with more organizations standing up for those who favor sensible gun reform.

Before the gun lobby successfully killed all gun-control legislation, there were some key wins in the fight to hold gun manufacturers liable. Last year, the New York State appellate court ruled that a Buffalo man who was shot nearly a decade ago could sue the gun manufacturer, distributor and dealer. In August of this year, the Kansas Supreme Court ruled in favor of a plaintiff who filed a negligence lawsuit against the owners of a gun shop.

The NRA will paint product liability legislation as a threat to law-abiding gun owners. After all, guns are meant to injure and kill. But gun manufacturers could control distribution enough to prevent guns from entering the criminal market.

When the government is worried that you might use that second bottle of NyQuil to cook meth, it’s not unreasonable to ask why someone needs to buy 15 assault rifles in one sitting.

Washington’s shameful cowardice aside, there are leaders across the country who have courageously done the right thing, paying a political price so that innocent Americans don’t have to pay the ultimate price. As Sen. Giron said of her experience, “Today, Colorado is safer because of the laws we passed. I have no regrets about that.”

If more of our elected officials were inspired by her example, we might all have fewer regrets.

“Letting The Debt Ceiling Cave In On Seniors”: Republican Actions Could Well Spell Disaster For Them In The Mid-Term Elections

Democrats used to be able to count on the senior citizen vote.  After all, it was FDR who created Social Security and Lyndon Johnson who created Medicare. But, hello, that was about 75 years ago and 50 years ago, respectively! Times do change.

As I like to scream at my Democratic friends, the post-65 generation were Ronald Reagan voters and had zip to do with FDR and LBJ.

As most now know, the only age group to support John McCain was the 65+ crowd and Romney beat Obama handily among seniors in 2012. Romney got 56 percent of the senior vote and McCain go 53 percent to Obama’s 45 percent in 2008.

The 45-64 group was very close in 2008 and Romney narrowly won it in 2012. And this was when Obama was the first Democrat since Carter in 1976 to receive more than 50 percent of the vote.

So what is my point?

Republicans have taken serious hits for their efforts to shut down the government and their possible refusal to raise the debt limit. In my blog post last week, I quoted Ronald Reagan on the debt limit. He got the message; he never drank the Kool Aid on that one.

But here is a very serious problem for the Republicans. If they really go through with their draconian plan, sure it hurts everyone, hurts the economy big time. But who does it especially freak out? You got it, senior citizens.

Why? The retired and those who live on fixed incomes and who have to draw on their retirement accounts get hammered. The last time the Republicans even threatened to hold the debt limit hostage in 2011, the stock market went down 17 percent.

Let me repeat that: After the debacle of 2008 and the economic meltdown, the stock market took a 17 percent hit for one reason and one reason only  – Republicans doing what Reagan had warned against. Plus, the U.S. credit was downgraded, which was unprecedented.

Seniors can’t afford to have that happen again and they know it – their 401(k)’s can not become 201(k)’s. The crash in 2008 and the double digit hit in 2011, if repeated, will affect those who are retired and those planning on retirement, and that is about 50 percent of the voters. If Republicans lose substantial numbers of those who are over 50 years old, it won’t just impact their chances of winning the presidency, with the changing demographics of race and ethnicity, but it could well spell disaster for them in the mid-term elections as well. Republicans could lose the House and not make the gains they want in the Senate.

Republicans may think they are going strong with their base of tea party radicals bashing the Affordable Care Act, but nothing impacts voters as much as watching their monthly savings and retirement statements tank.

Seniors and upcoming retirees watch their stocks and bonds and IRAs and 401(k)’s like a hawk and if Republicans get the blame for big losses, trust me, they will feel it big time at the polls next November and for many Novembers to come.

Shutting down the government and defaulting on our obligations are not just bad policy, but they are really bad politics for the Republicans. They simply cannot afford to watch their advantage with the 50+ age group evaporate.

The real question is will the Republicans come to their senses?  It is not a sure bet.

“So What If the Syria Solution Is Messy”: President Obama Got Putin And Syria To The Table, And That’s What Matters

The U.S. came close (we are told, anyway) to bombing Syria in retaliation over the alleged use of chemical weapons in the civil war there. Since then, democracy-challenged Russian President Vladimir Putin has stepped in, and is helping to broker a deal by which another bad actor, Syria, would give up its weapons.

That should sound like a pretty good outcome, if it works out. But in Washington, the conversation has been all about image and what has become known in Beltway speak as “messaging.”

President Obama has been criticized for looking weak – first, more than a year ago, for not being tougher on Syria, and now, for vocalizing his understandable reluctance to bomb a Middle Eastern country. He’s been accused of offering mixed messages, by saying the U.S. needed to enforce the “red line” against chemical weapons, but then saying he took no pleasure in doing so. He was criticized for thinking about bombing without consulting Congress, then chided as indecisive for listening to those criticisms and asking for Congress’s opinion (though not its advance approval, Obama was quick to note).

Then Putin wrote a critical op-ed in The New York Times, criticizing the U.S. for its assertion of “exceptionalism,” and saying the rest of the world had grown tired of being pushed around by America.

There is some legitimacy to much of this criticism. But the more important point is, so what?

Who cares if Obama didn’t deliver an unequivocal, we’re-going-to-bomb-them speech, especially if such a speech would lock us more securely into a wartime box? Was it the threat of an attack that got Syrian leader Bashar Assad to talk to Putin? Was it Putin’s desire to gain some level of legitimacy and credibility on the world stage that led him to talk to Assad? Was it Putin’s own concerns about chemical weapons being used by insurgents in his own country that led him to get involved? Who cares?

Being an adult, being a diplomat, and, yes, being a leader means staying focused on the final goal – not on how you got there. So what if Putin wags his finger at the U.S. in an American newspaper? He can bully us on Facebook if he wants. Does it matter, if the end result is Syria giving up chemical weapons without the U.S. having to risk American lives or spend American dollars to make it happen?

Obama had indeed gotten himself into something of a box by drawing a “red line” against chemical weapons (and it should be noted that many of his critics on the right were some of the ones pushing him to get tough on Syria). But Assad was in a box, too. He didn’t want to get bombed. He threatened retaliation if he was bombed – and didn’t really have much to back that up. But politically, he couldn’t be viewed as giving in to Obama or to Secretary of State John Kerry. His only face-saving measure was to deal with someone like Putin – an “imperfect messenger,” to borrow a phrase from Anthony Weiner. But Putin was probably the only person who could deliver it.

Style points do matter, sometimes. But they are not an end in themselves. Looking tough or decisive is not success. Getting rid of the chemical weapons is what will count as a win.

“Hostages Are A Pre-requisite”: Coming To Terms With The Normalization Of Republican Extortion Politics

President Obama spoke yesterday to the Business Roundtable, and used some language to describe Republican tactics that raised a few eyebrows — not because he was incorrect, but because his word choice was provocative.

In his remarks, Mr. Obama accused what he called “a faction” of Republicans in the House of trying to “extort” him by refusing to raise the nation’s debt ceiling unless the president’s health care plan is repealed.

“You have never in the history of the United States seen the threat of not raising the debt ceiling to extort a president or a governing party,” Mr. Obama said. “It’s irresponsible.”

Mr. Obama called upon the business leaders to try to convince lawmakers to avoid the kind of “brinksmanship” that would lead to promises of “apocalypse” every few months. “What I will not do is to create a habit, a pattern whereby the full faith and credit of the united states ends up being a bargaining chip to make policy,” he said. “I’m tired of it,” he added. “And I suspect you are too.”

For the president to publicly reference Republican “extortion” tactics struck some as excessive. That’s a shame; Obama’s right.

Let’s step back for a moment. A traditional, transactional method of governing was in place in Washington for generations, and it worked fairly well. In some cases, policymakers would rely on intra-policy cooperation (“I’ll go along with some of the provisions you want if you go along with some of the provisions I want”), and in other cases it’s been inter-policy cooperation (“I can help move that bill you like if you help me move this other bill that I like”).

The transactional model was never easy, of course, and parties that were supposed to disagree usually did, but governing happened. Bills passed. Policymaking and compromises existed. The nation did not simply bounce from one self-imposed, manufactured crisis to the next.

In the wake of the radicalization of Republican politics, the system broke down, largely because GOP officials came to believe they can no longer accept concessions on anything, and anyone who dares compromise with those they disagree with deserves to lose in a Republican primary.

What matters, of course, is what’s replaced transactional politics.

I tend to describe it as extortion politics, which we may be getting used to, but which has no modern precedent in the American system of government.

Consider an example from earlier this year. House Republicans approved a budget plan and challenged Senate Democrats to do the same, assuming they’d fail. The GOP miscalculated and Senate Dems approved their own budget plan in the spring.

From there, lawmakers were supposed to enter bipartisan, bicameral negotiations, which is what always happens when the House and Senate approve competing budget blueprints. But a funny thing happened — Republicans refused to enter the budget talks they said they wanted.

It hasn’t generated much attention, but it’s important to understand why. GOP lawmakers couldn’t go to the negotiating table because that would mean … negotiating. Republicans weren’t prepared to compromise on anything, so why bother with budget talks? What GOP officials wanted instead was to wait until the fall when they might at least try to claim leverage in an extortion plot.

In other words, hostages have become a prerequisite to Republican governance.

We’ve actually reached the point at which the GOP seems genuinely and literally confused about the meaning of the word “compromise.” Consider this item from a week ago:

One group of conservatives on Thursday pressed what they called a compromise: a one-year stopgap spending bill that would raise the debt ceiling for a year, delay all aspects of the health care law for a year, and give back some of the Pentagon cuts as a sweetener. Backers insisted on Thursday that it was a package Mr. Obama should be able to accept.

Got that? In this approach, Republicans would get the health care delay they want and the spending levels they want. What would Democrats get? Nothing except the relief that comes with knowing that the hostage the GOP was threatening would live to see another day.

This, in the delusional minds of congressional Republicans, is not only a “compromise,” it’s the kind of deal the White House might actually go for.

This has become the norm in every major legislative fight since January 2011. Faced with a challenge, Republicans won’t compromise or consider possible concessions; they’ll instead reach for the nearest hostage and start making threats. The nation shifts from one crisis to the next, not because we have to, but because Republicans have made it their m.o. In the last Congress, Republicans created a debt-ceiling crisis and three separate shutdown threats. In this Congress, we’re only nine months in and we’re already facing a shutdown crisis this month and a new debt-ceiling crisis next month.

In each instance, the GOP approach is the same: so long as our demands are met, and we don’t have to compromise, we won’t have to hurt anyone on purpose.

So before the Beltway gets too bent out of shape over Obama using the word “extort” in a speech, I have a question: can anyone think of a more apt description of what’s tragically become the new status quo in Washington?

“The Crazy Party”: The GOP Has Made Its Transition From Being Just The Stupid Party

Early this year, Bobby Jindal, the governor of Louisiana, made headlines by telling his fellow Republicans that they needed to stop being the “stupid party.” Unfortunately, Mr. Jindal failed to offer any constructive suggestions about how they might do that. And, in the months that followed, he himself proceeded to say and do a number of things that were, shall we say, not especially smart.

Nonetheless, Republicans did follow his advice. In recent months, the G.O.P. seems to have transitioned from being the stupid party to being the crazy party.

I know, I’m being shrill. But as it grows increasingly hard to see how, in the face of Republican hysteria over health reform, we can avoid a government shutdown — and maybe the even more frightening prospect of a debt default — the time for euphemism is past.

It helps, I think, to understand just how unprecedented today’s political climate really is.

Divided government in itself isn’t unusual and is, in fact, more common than not. Since World War II, there have been 35 Congresses, and in only 13 of those cases did the president’s party fully control the legislature.

Nonetheless, the United States government continued to function. Most of the time divided government led to compromise; sometimes to stalemate. Nobody even considered the possibility that a party might try to achieve its agenda, not through the constitutional process, but through blackmail — by threatening to bring the federal government, and maybe the whole economy, to its knees unless its demands were met.

True, there was the government shutdown of 1995. But this was widely recognized after the fact as both an outrage and a mistake. And that confrontation came just after a sweeping Republican victory in the midterm elections, allowing the G.O.P. to make the case that it had a popular mandate to challenge what it imagined to be a crippled, lame-duck president.

Today, by contrast, Republicans are coming off an election in which they failed to retake the presidency despite a weak economy, failed to retake the Senate even though far more Democratic than Republican seats were at risk, and held the House only through a combination of gerrymandering and the vagaries of districting. Democrats actually won the popular ballot for the House by 1.4 million votes. This is not a party that, by any conceivable standard of legitimacy, has the right to make extreme demands on the president.

Yet, at the moment, it seems highly likely that the Republican Party will refuse to fund the government, forcing a shutdown at the beginning of next month, unless President Obama dismantles the health reform that is the signature achievement of his presidency. Republican leaders realize that this is a bad idea, but, until recently, their notion of preaching moderation was to urge party radicals not to hold America hostage over the federal budget so they could wait a few weeks and hold it hostage over the debt ceiling instead. Now they’ve given up even on that delaying tactic. The latest news is that John Boehner, the speaker of the House, has abandoned his efforts to craft a face-saving climbdown on the budget, which means that we’re all set for shutdown, possibly followed by debt crisis.

How did we get here?

Some pundits insist, even now, that this is somehow Mr. Obama’s fault. Why can’t he sit down with Mr. Boehner the way Ronald Reagan used to sit down with Tip O’Neill? But O’Neill didn’t lead a party whose base demanded that he shut down the government unless Reagan revoked his tax cuts, and O’Neill didn’t face a caucus prepared to depose him as speaker at the first hint of compromise.

No, this story is all about the G.O.P. First came the southern strategy, in which the Republican elite cynically exploited racial backlash to promote economic goals, mainly low taxes for rich people and deregulation. Over time, this gradually morphed into what we might call the crazy strategy, in which the elite turned to exploiting the paranoia that has always been a factor in American politics — Hillary killed Vince Foster! Obama was born in Kenya! Death panels! — to promote the same goals.

But now we’re in a third stage, where the elite has lost control of the Frankenstein-like monster it created.

So now we get to witness the hilarious spectacle of Karl Rove in The Wall Street Journal, pleading with Republicans to recognize the reality that Obamacare can’t be defunded. Why hilarious? Because Mr. Rove and his colleagues have spent decades trying to ensure that the Republican base lives in an alternate reality defined by Rush Limbaugh and Fox News. Can we say “hoist with their own petard”?

Of course, the coming confrontations are likely to damage America as a whole, not just the Republican brand. But, you know, this political moment of truth was going to happen sooner or later. We might as well have it now.
