A Conservative Defense Of Government: You’re A Fan Of Government, So Stop Pretending Otherwise

Everyone knows that Ronald Reagan famously said, “Government is not the solution to our problem; government is the problem.” But as Ramesh Ponnuru recently pointed out, there is a “less famous yet crucial beginning of that sentence”: “In our present crisis.”

Conservatives rightly hate nanny-state government and big-spending bureaucracy. But too often, the word “government” has become unfair shorthand for what is actually only bad or oppressive government.

Conservatives aren’t anarchists, after all. We don’t want Big Brother, but none of us should want to live in a Hobbesian state where every person is absolutely and entirely for himself, either. Instead, we believe in ordered liberty via limited government.

Certainly, the size and scope of government has increased over the years. But still, we shouldn’t conflate all government with bad government. We need a functioning state, and yes, there is such a thing as a government that is too weak.

This is a lesson that goes back to our founding. And it’s one conservatives should appreciate. Judging from their colonial garb and tri-cornered hats, Tea Party activists are fond of the Constitution and its Founders. So you might expect that they, of all people, would appreciate the importance of having a government that isn’t laughably weak.

As Baylor professor and Patrick Henry author Thomas Kidd tells me, “Most of the major Founders became convinced that Americans needed a stronger national government to coordinate trade policy and protect against domestic and foreign threats.”

Under the Articles of Confederation, the government was impotent. “Major decisions — declaring war and signing treaties — needed the approval of nine states,” writes Richard Brookhiser in his book James Madison. Congress couldn’t even tax, and “as a result, the United States was perpetually broke,” Brookhiser adds.

To be sure, some patriots, like Patrick Henry and Samuel Adams, opposed the Constitution precisely because they feared big government. But as Kidd points out, “the majority of the best-known Founders believed that the new republic needed a bigger, stronger government for the United States to survive and compete on the world stage.”

“If men were angels, no government would be necessary,” wrote Madison, who (in fairness) added, “If angels were to govern men, neither external nor internal controls on government would be necessary.”

So, a natural question: What should a limited government do?

For starters, preserve law and order, ensure the rule of law, enforce contracts, provide for our defense — and yes, control the border. (I’m also partial to clean water, but that’s just me.)

Max Weber said the government has a “monopoly on legitimate violence in society.” This is needed to enforce law and order. Otherwise, whoever has the biggest gun — or the most brothers — takes your property.

“Government is the most common form of hierarchy,” Robert Kaplan recently noted. “It is a government that monopolizes the use of violence in a given geographical space, thereby preventing anarchy. To quote Thomas Hobbes, the 17th-century English philosopher, only where it is possible to punish the wicked can right and wrong have any practical meaning, and that requires ‘some coercive power.'”

But government functions don’t just keep us safe, they also make us prosperous. Sure, overregulation can be a job killer. But consider the extreme alternative. If you believe that someone could steal your business if he wants to, then you are much less likely to start one. If you believe that someone can break a contract with you — or steal your invention — without fear of punishment, that might make it less likely that you will go into business or to invest in research and development.

In their 2012 book Why Nations Fail, economists Daron Acemoglu and James A. Robinson provide a largely free market argument for why some nations succeed. For example, Acemoglu and Robinson fault protectionist policies instituted to avoid the process of creative destruction as a primary reason some nations fail.

But interestingly, they also frequently cite a lack of a strong central government as a prime reason nations fail. For example, the authors lament Somalia’s “lack of any kind of political centralization, or state centralization, and its inability to enforce even the minimal amount of law and order to support economic activity, trade, or even basic security of its citizens.”

I can’t imagine that any conservatives who decry government would prefer this sort of extreme chaos to our current, albeit imperfect, government.

So maybe the answer is to be more specific about our concerns with government. Attempting to do just that, Nobel Prize-winning economist James M. Buchanan distinguished between the productive state, the protective state, and the redistributive state.

Essentially, the productive state would constitute infrastructure like roads and bridges, the protective state would encompass the police, criminal justice, etc., and the redistributive state is obviously the entitlement state.

While most conservatives concede that we need some social safety net, they are mostly worried about the out-of-control growth of the redistributive state. And yet, too seldom is that distinction made. Instead, the criticism is usually directed at “government.”

When it comes to government, a lot of conservatives are probably too obsessed with size. Grover Norquist famously wants to shrink government to such a small size that you can drown it in a bathtub.

But I’m not sure most Americans want that. And trying to force it via draconian cuts doesn’t work, especially if they don’t address the specific problem, such as the need for entitlement reform. “You can’t make a fat man skinny by tightening his belt,” observed John Maynard Keynes.

Whether you’re a conservative who cares about preserving law and order, or a free marketer who appreciates the importance the rule of law plays in providing confidence and incentives to entrepreneurs, you’re a fan of government. Stop pretending otherwise.

“Notes On A Pseudo-Scandal”: With No Credibility On Issues, Republicans Demand For Scandal Is Intense And Unflagging

OK folks, if you have the patience for some meta-blogging on the subject of Benghazi, let me share with you some of the thoughts that have been running around my head as I struggle with how to talk about this story. Whenever a topic like this comes up, you have to ask yourself a couple of questions. Do I have something worthwhile to contribute to this discussion? Is there something that needs to be said but hasn’t been yet? Is this thing even worth talking about? Much as I’d like to be immune to the consideration of whether I’m doing a favor for those pushing the story for their own partisan ends by keeping the discussion going, it’s hard to avoid that question popping into your head from time to time.

There’s an objective reality out there, hard though it may sometimes be to discern—either there was or was not actual wrongdoing, and the whole matter is either trivial or momentous—but everyone’s perception of that reality is formed within the context of a partisan competition. Irrespective of any facts, Democrats would like this story to just go away, and Republicans would like it to become The Worst Scandal In History. I’ll be honest and say it’s hard to avoid thinking about that when you’re writing about it. Even doing something like refuting the latest crazy thing someone on the right is alleging does, to at least a small degree, help maintain the story’s momentum.

To step back to the big picture, a “scandal” can proceed regardless of whether any wrongdoing is ever found. If you have your own media system, you can keep talking about it (combined with, always always always, accusations that the mainstream media are ignoring it not because of a reasonable news judgment but because of their liberal bias) until the mainstream media start doing their own reporting on it, pushing the story ahead. This is a routine conservative media are practiced at, and they seem to be having some success yet again. If you have control of one house of Congress, furthermore, you can start investigations and hold hearings, which may not uncover anything incriminating, but it creates news events and produces information, which can be spun to be something nefarious even if it’s utterly mundane.

For instance, conservatives continue to froth at the mouth over whether a set of talking points the administration produced contained the words “terrorism” or “Islamic extremists” or “extremists,” as though one answer means everything was above-board and another answer means there was a cover-up so sinister that impeaching the president is the obvious response. You may be shocked to learn that talking points on national security matters are routinely edited by representatives of different agencies! Or maybe you’re not shocked, but just in case, Republicans are going to act as though it’s shocking. If you’re an Obama partisan, the fact that your opponents think that the key to the President’s undoing will be found in some Microsoft Word “track changes” should make you feel pretty secure, since those opponents are plainly a bunch of buffoons.

Trouble is, that may not stop the “scandal” from continuing to generate momentum. Brendan Nyhan just put out a paper in which he posits a theory of scandals, arguing that they are a “co-production” of the media and the opposition party. Specifically, the less popular a president is with the opposing party, the more likely a scandal is to emerge.Other factors have an impact as well, including competing news stories, the time a president has been in office, and the time since the last scandal. This is essentially what Jamelle noted yesterday, that while there may not be much of a supply of actual Obama administration wrongdoing, the demand for scandal on the right is intense and unflagging. That demand is met by the conservative media, whose coverage pushes Republican lawmakers to get involved, which generates more coverage, which generates more demand in the Republican rank and file, and on and on.

I hesitate to even use the word “scandal” to describe Benghazi, because so far we haven’t learned of anything scandalous anyone did. Conservatives themselves don’t seem to be able to say exactly what the Obama administration is supposed to have done wrong, particularly since lethal attacks on American diplomatic mission are a frequent occurrence, even under Republican administrations. “Talking points were edited to make the attack sound less terrorist-y” isn’t exactly a high crime. “Some different decisions in those first chaotic hours might have made a difference” isn’t much of an indictment either; that’s always true of any tragedy. Yes, there are some people on the right who will speculate that Barack Obama and Hillary Clinton actually said, “Go ahead and let those people in Benghazi die, because even though we could save their lives, doing so might harm our re-election, so screw ’em.” But those people are obviously nuts, and everybody knows it.

It may well be that, as it was during the Clinton years, even many of the people pushing the alleged scandal realize there’s not much to it, but they find political utility in keeping the president under siege. If he’s worried about this, he’ll have less time to devote to his other priorities. Spend tens of millions investigating a failed land deal, and even if you don’t find that he did anything wrong there, maybe along the way you’ll discover that he got a blow job from an intern.

As reluctant as I am to feed that beast, in the end I suspect they’ll be punished for their obsession with Benghazi, assuming that they fail, just as they have so far, to uncover any actual wrongdoing. And that’ll happen whether people like me write about it or not.

“Extortion For The Sake Of Extortion: Republicans Taking The Politics Of Extortion Past The Breaking Point

With the House and Senate both having passed budget resolutions, the next step in the process should be a conference committee, which Republican leaders said they wanted. Recently, however, they changed their mind and now refuse to allow the process to proceed.

Why? I’ve worked under the assumption this is the result of GOP lawmakers feeling apprehension about their unpopular ideas and fearing a public backlash. But the Washington Post reports there may be a little more to it.

[The shrinking deficit] might seem like good news, but it is unraveling Republican plans to force a budget deal before Congress takes its August break. Instead, the fiscal fight appears certain to bleed into the fall, when policymakers will face another multi-pronged crisis that pairs the need for a higher debt limit and the fresh risk of default with the threat of a full-scale government shutdown, which is also looming Oct. 1.

In the meantime, Republicans face a listless summer, with little appetite for compromise but no leverage to shape an agreement. Without that leverage, House Budget Committee Chairman Paul Ryan (R-Wis.) said Tuesday, there is no point in opening formal budget negotiations between the House and the Senate, because Democrats have no reason to consider the kind of far-reaching changes to Medicare and the U.S. tax code that Republicans see as fundamental building blocks of a deal.

“The debt limit is the backstop,” Ryan said before taking the stage at a debt summit organized by the Peter G. Peterson Foundation in Washington.

I realize talking about budgets, conference committees, and debt ceilings is dry. This no doubt strikes some readers as inside baseball, of little interest to anyone other than political junkies and wonks.

But I hope folks will take a moment to consider what Ryan and his colleagues are saying here. They’re admitting, publicly and without shame, that they can’t engage in budget negotiations unless they can also threaten to deliberately crash the economy. GOP lawmakers want a “backstop” that will give them “leverage” in talks — whereas the conference committee is ostensibly about finding a bipartisan, bicameral compromise, Republicans need the possibility of a brutal self-inflicted crisis to hang over the process.

And if they can’t have it, they won’t engage in the budget process at all.

Wait, it gets worse.

Congressional Republicans made a series of assumptions, all of which have turned out to be wrong. They assumed Senate Democrats couldn’t pass a budget. They assumed Democrats wouldn’t want a budget process considered under regular order. And they assumed the budget talks, if they occurred, would happen around the same time as the need for a debt-ceiling increase.

GOP lawmakers were terribly disappointed, then, to see Senate Democrats do exactly what they were asked to do, and the economy improved quickly enough to push off the debt-limit deadline until fall.

But with their plans foiled, Republicans are stuck with no Plan B, no leverage, and no credible threat. Consider how remarkable this is:

[S]enior Senate Republicans, including several who recently dined with Obama and huddled with administration officials, conceded that it may be tough to bring their colleagues to the table too far ahead of the debt-ceiling deadline.

“I think there’s a better atmosphere for a solution than there’s been in the past, but I’m a little worried about people here in the Senate having fiscal fatigue. There isn’t any sense of urgency right now,” said Sen. Bob Corker (R-Tenn.), one of three senators who joined Obama on Monday for a round of golf.

“We need to realize this debt ceiling is out there. It’s inevitable. It’s coming. And [the later deadline] should not relieve pressure,” said Sen. Jeff Sessions (Ala.), the senior Republican on the Senate Budget Committee. But “sometimes we don’t want to act until a gun is at our heads.”

Think about that for a second. The ranking member of the Senate Budget Committee is willing to admit — out loud and on the record — that there can’t be a budget process unless he and his Republican colleagues can threaten to trash the full faith and credit of the United States on purpose.

And here’s the kicker: Republicans aren’t even asking for anything specific yet. They know they want to hold the nation hostage, but they’re not sure why, and haven’t figured out what their demands are. Jonathan Bernstein argued persuasively yesterday that we’re looking at “extortion for the sake of extortion.”

The House crazy caucus is demanding not debt reduction, not spending cuts, not budget balancing, but blackmail itself. That’s really the demand: The speaker and House Republican leaders absolutely must use the debt limit as extortion. What should they use it to get? Apparently, that’s pretty much up for grabs, as long as it seems really, really, big — which probably comes down to meaning that the Democrats really, really don’t like it.

It’s the extortion that’s the point. Not the policy.

I’ve run out of adjectives to describe how crazy this is, but I’ll just conclude with this: those pundits who assume Republicans are a mainstream political party, and it’s a mystery as to why President Obama hasn’t had more success negotiating with these folks, just aren’t paying close enough attention.

“Politics Dressed Up As Math”: The GOP Starts Eating Its Own On Immigration

The conservative Heritage Foundation today – in a re-run of theirs from 2007 – released a “cost estimate” for immigration reform. Not surprisingly, Heritage predicts that the price tag of immigration reform will be just shy of astronomical: $6.3 trillion over the next few decades.

Back in 2007, Heritage helped prevent comprehensive immigration reform from becoming law by claiming that it would cost $2.6 trillion (in the last six years, something evidently happened to more than double Heritage’s estimate). In the intervening years, the GOP’s trouble attracting minority voters has only increased, so this time, Republicans in Congress and their allies who want to see immigration reform become a reality were ready.

“Here we go again,” tweeted Sen. Jeff Flake, R-Ariz., one of the so-called “gang of eight” in the Senate. “New Heritage study claims huge cost for Immigration Reform. Ignores economic benefits.” Former Congressional Budget Office director and McCain campaign adviser Douglas Holtz-Eakin wrote that the study “failed to consider the implications of reform and instead looked solely at the cost of low-skilled immigrants.” The Immigration Task Force at the Bipartisan Policy Center, cochaired by Republican former  Gov. Haley Barbour and former Secretary of State Condoleeza Rice, said in a statement, “We strongly believe that this study’s modeling and assumptions are fundamentally flawed.”

For the record, the Congressional Budget Office found that the 2007 immigration bill – which Heritage said would cost $2.6 trillion – would have actually boosted revenue by tens of billions of dollars. And past Heritage studies on immigration have been, to put it mildly, a bit off the mark.

But critiquing the Heritage study on an economic basis means accepting that it is meant as a good-faith effort to assess the impact of proposed legislation. As the Washington Post’s Greg Sargent and the Daily Beast’s Michael Tomasky both note, that isn’t really the point. As Tomasky writes:

The Heritage Foundation has now come out against immigration reform, without exactly taking that position, indeed while claiming to take the opposite position … This is an old conservative play – go after the cost of something, which permits them not to be against the idea per se, only against its fiscal ramifications. “We’re not against immigration reform. Quite the contrary! We’re just against the cost of this particular bill.” It’s a cousin of the old saw one always heard back in the Cold War days: “We’re not against arms-control treaties in general at all, but we are certainly against this one,” which just happened to be the case with regard to every single one.

Heritage analysts even freely admit that their estimate isn’t of the gang of eight’s specific proposal, but about some phantom comprehensive reform bill. Adding in one more level of absurdity, Heritage chose not to use so-called “dynamic scoring” when assessing the impact of immigration reform, even though most of the time it screams bloody murder when dynamic scoring is not used to figure out how much a bill might cost.

So Heritage is not really trying to figure out what immigration reform will actually do to the economy; it is just giving the right-wing base a number to wield as a cudgel. But this time, other conservatives, rather than progressives, are trying to show Heritage’s politics-dressed-up-as-math for what it really is. Those of us on the other end of the political spectrum just get to sit back and watch.

“Facing Republican Intransigent Extremism”: How President Obama Can Still Win In Washington

The Washington pundits of the moment – a group that includes such blinding lights as Maureen Dowd and Ron Fournier – seem to believe that if only President Obama would provide adequate “leadership,” the partisan polarization on Capitol Hill would evaporate and America’s problems could be solved at last. While the president rightly mocked this notion as a fantasy worthy of Hollywood’s Aaron Sorkin, it does raise the vital question, however obtusely, of what Obama might do as he confronts an oppositional Republican-led Congress.

Whatever the punditocracy may imagine, there is no way for Obama to force his agenda on the Republicans in the House and the Senate, who range from scheming partisans like Mitch McConnell and Eric Cantor to Tea Party zealots like Ted Cruz and Michele Bachmann. Unlike Abraham Lincoln or Lyndon Johnson, the two brilliant manipulators with whom he is sometimes compared and found wanting, the president is not equipped to bribe, blackmail, or herd in the style of those Machiavellian chief executives. If he were so equipped — and indeed used his power as ruthlessly as Lincoln or Johnson — the same pundits who now complain that he isn’t controlling the agenda would shriek about his misuse of power.

In this journalistic mindset, the president (especially a Democratic president) is always wrong; using power is bad/unethical/cynical, while failing to use power is weak/aloof/naïve. Both ends of this stick have been repeatedly applied to Obama, of course, just as they were constantly used to punish Bill Clinton.

Alternatively, those calling for presidential “leadership” — especially the oh-so-serious Beltway types — want Obama to prove his bona fides by abandoning Democratic programs and principles, even though the Republicans have showed no willingness to cross their redline on taxes. In fact, the president has offered an excess of compromise already, while failing to elicit any fresh initiative from the opposition. Yet somehow, in the pundit mindset, Obama and the Republican leadership are equally at fault.

The president understands that critics who play such jejune Beltway games don’t deserve much of his time or attention, unless they can serve as absurdist foils for a funny dinner speech. The most salient fact in American political life is (and for some time has been) the intransigent extremism of the Republican Party. Any columnist who tries to ignore or excuse that extremism has nothing useful to tell any president.

What Obama evidently doesn’t understand, despite years of bitter experience, is the significance of that right-wing extremism for someone like him, whose nature is to accept differences and seek compromise. Unable to negotiate with a reasonable counterpart on either side of the Hill, he too frequently negotiates with himself – whether over Obamacare, the debt ceiling, the budget, deficit reduction, taxes, or “reforming” Social Security.

Yet whenever he discards a progressive position, such as the public option in health care, or adopts a conservative position, such as reducing Social Security cost-of-living increases, he only succeeds in demoralizing his base. Meanwhile, rejection by the Republicans is preordained.

So what is left for President Obama to do if he wishes to see any of his second-term agenda enacted? By now he ought to have noticed that when he speaks out firmly on behalf of progressive principles, in support of working families, his polling numbers improve and his power increases. (And whenever he vacillates, his numbers diminish and his authority weakens.)

The recent battle over gun background checks indicates that even some of the most reactionary Republicans – like Pennsylvania senator Pat Toomey, formerly of the Club for Growth – can be pushed into supporting sensible reform. But that doesn’t mean seeking a “grand bargain” with politicians who want no bargain at all. It does mean mobilizing citizens on the largest possible scale, every day; it means making sure they know that the president is on their side, shares their values, and will uphold his promises to them. It means explaining to the American people, with fearless candor, that the Republican Party is unfit to participate in national governance – and unless that party is defeated decisively next year, no important objective can be achieved.
