“Government Shutdown Deja Vu”: House Republicans Forgot The Lessons Of The Clinton Shutdowns

Regardless of what you think of the Patient Protection and Affordable Care Act (aka Obamacare), the Republican effort to derail it through the government shutdown currently underway is miserably poor politics and even worse public relations.

I tried to resist writing about this topic because the partisans are hopelessly locked into their positions and my opinion on the law isn’t of any value to anyone other than my dog, who hangs on my every word. But communications is my business, and I happen to have been a young, Republican congressional chief of staff during the two shutdowns of 1995, and what I see today is worse than what happened then.

The shutdowns of ’95 were part of a budget fight between cocky new Republican majorities in both the House and Senate and a stumbling Democratic president who was about to begin his dalliance with Monica Lewinsky. Hardly anyone today remembers that the issue then was about getting the president to agree to a plan to balance the budget over the next seven years. In ’95, Newt Gingrich was the first Republican Speaker of the House in half a century, and he had just led a 100-day legislative assault on business as usual that resulted in a series of popular reforms to make government smaller, more responsive and transparent known as the “Contract with America.”

That summer, Republicans were looking for ways to keep the ball rolling and the prospect of using a government shutdown as a cudgel in this struggle between the legislative and executive branches was already on the table. If the government shuts down, Gingrich told Time magazine, President Clinton “can run the parts of the government that are left, or he can run no government. Which of the two of us do you think worries more about the government not showing up?”

By November, the freshmen Republicans in the House were practically chanting “shut it down” in the hallways. Many of them thought this would be popular back home, almost to the degree that the Contract had been.

First came a brief shutdown for a few days in November. And then, when negotiations with the White House broke down, came a shutdown that began on December 15 and which lasted for 21 days.

Guess what happened? People stopped talking about the need for a plan to balance the budget and began talking about all the government services they couldn’t get. Basic services halted. Fears arose about Social Security checks not going out and missing paychecks to members of the military. Thousands of federal workers were forced on furlough days before Christmas.

Republicans had made a fundamental political error – we shifted the debate from the topic on which we really wanted victory (balancing the budget) to one that not only was off-topic, but reminded people that there actually is a lot about government that they like, want and need. Oh, and we scared and hurt a lot people whose confidence and support we were trying to win.

Does this sound familiar?

Here in Central Florida, the front page of my local newspaper features the story of a couple who have been planning a wedding at the Jefferson Memorial for months. Now their plans are in jeopardy. That’s not a story about health care; it’s a story about how politicians are screwing up somebody’s nice event.

A few weeks after the shutdown ended in January 1996, President Clinton masterfully exploited the nation’s mood in his State of the Union Address. Near the end of the speech, standing in the well of the House of Representatives, Clinton turned toward the first lady’s balcony in a move that has been used by every president since Ronald Reagan, and introduced a special guest:

I want to say a special word now to those who work for our federal government. Today our federal government is 200,000 employees smaller than it was the day I took office as President. (Applause.) Our federal government today is the smallest it has been in 30 years, and it’s getting smaller every day. Most of our fellow Americans probably don’t know that. And there’s a good reason — a good reason: The remaining federal work force is composed of hard-working Americans who are now working harder and working smarter than ever before to make sure the quality of our services does not decline. (Applause.)

I’d like to give you one example. His name is Richard Dean. He’s a 49 year-old Vietnam veteran who’s worked for the Social Security Administration for 22 years now. Last year he was hard at work in the Federal Building in Oklahoma City when the blast killed 169 people and brought the rubble down all around him. He reentered that building four times. He saved the lives of three women. He’s here with us this evening, and I want to recognize Richard and applaud both his public service and his extraordinary personal heroism. (Applause.)

But Richard Dean’s story doesn’t end there. This last November, he was forced out of his office when the government shut down. And the second time the government shut down he continued helping Social Security recipients, but he was working without pay.

On behalf of Richard Dean and his family, and all the other people who are out there working every day doing a good job for the American people, I challenge all of you in this Chamber: Never, ever shut the federal government down again. (Applause.)

Clinton’s State of the Union address ended all talk among Republicans that the shutdowns had been successful.

Around this time, Gingrich was fond of calling for dramatic change by citing the saying that one of the definitions of insanity is to do the same thing over and over again, expecting different results.

What are we to make of this situation now?

“James Madison For Dummies”: An Obstructionist, Compromised Reputation Among The GOP

The effort to defund Obamacare, culminating in Sen. Ted Cruz’s marathon speech on the Senate floor, has been symbolic in ways its sponsors did not intend.

This, in the end, was the strategy: For procedural reasons, senators needed to vote against a House spending bill defunding Obamacare — in order to force a government shutdown, in order to cut off federal spending unrelated to Obamacare, in order to trigger a wave of public revulsion against Obamacare, in order to force President Obama to trade away his signature legislative accomplishment. And any elected Republican, by the way, who questions the practicality of this approach is a quisling.

It is the fullest expression (so far) of the view of leadership held by the new, anti-establishment conservative establishment: Exploit a legitimate populist cause to demand a counterproductive tactic in an insufferable tone, then use the inevitable failure to discredit opponents in an intra-party struggle. More Pickett’s charges, please. They are emotionally satisfying (and good for fundraising). And the carnage may produce new generals, who are more favorable to future Pickett’s charges.

In the process, the GOP is made to look unserious and incapable of governing. But that is beside the point. The advocates of defunding have bigger ideological fish to fry. They argue that, over the decades, Republican compromisers have been complicit in producing a federal government so overgrown that our constitutional order has collapsed beneath it. “I don’t think what Washington needs,” argues Cruz, “is more compromise.”

In this case, the evidence of GOP compromise is not the acceptance of Obamacare. It is insufficient enthusiasm for an absurd procedural maneuver. But never mind. The real target is the idea of compromise itself, along with all who deal, settle or blink.

In the middle of this unfolding Republican debate comes a timely National Affairs article by Jonathan Rauch. It is titled “Rescuing Compromise,” but it might well have been called “James Madison for Dummies.”

Rauch argues that Madison had two purposes in mind as he designed the Constitution. The first was to set faction against faction as a brake on change and ambition — a role that tea-party leaders have fully embraced. Madison’s second purpose, however, was “to build constant adjustment into the system itself, by requiring constant negotiation among shifting constellations of actors.”

Following the Articles of Confederation, America’s founders wanted a more energetic government. But they made action contingent upon bargaining among the branches of government and within them. “Compromise, then, is not merely a necessary evil,” argues Rauch, “it is a positive good, a balance wheel that keeps government moving forward instead of toppling.”

Compromise, of course, can have good or bad outcomes. But an ideological opposition to the idea of compromise removes an essential cog in the machinery of the constitutional order. “At the end of the day,” says Rauch, “the Madisonian framework asks not that participants like compromising but that they do it — and, above all, that they recognize the legitimacy of a system that makes them do it.”

We are seeing that an anti-compromise ideology can make for bad politics. In our system, Obamacare will not be overturned by one house of Congress. A tea-party shutdown strategy — if implemented — would make securing the other house and the presidency less likely for Republicans. And the political energy consumed by Cruz and crew has not been available to promote incremental limits on Obamacare that might have aided GOP political prospects.

But the problems with this view run deeper. A belief that compromise is always favorable to liberalism is historically ill-informed. Ronald Reagan’s 1986 tax reform and Bill Clinton’s 1996 welfare reform were the results of bipartisan compromise. So were Clinton’s four budgets that kept federal spending below 20 percent of GDP. And addressing the long-term debt crisis — really a health entitlement crisis — will not be possible without a series of difficult political compromises on benefit restructuring and revenues.

It is a revealing irony that the harshest critics of compromise should call themselves constitutional conservatives. The Constitution itself resulted from an extraordinary series of compromises. And it created the system of government that presupposes the same spirit. “Compromise,” says Rauch, “is the most essential principle of our constitutional system. Those who hammer out painful deals perform the hardest and, often, highest work of politics; they deserve, in general, respect for their willingness to constructively advance their ideals, not condemnation for treachery.”

But such condemnation, it seems, is an easier path to attention.

“Moment Of Truthiness”: Stuck With Politicians Who Gleefully Add To The Misinformation And Watchdogs Who Are Afraid To Bark

We all know how democracy is supposed to work. Politicians are supposed to campaign on the issues, and an informed public is supposed to cast its votes based on those issues, with some allowance for the politicians’ perceived character and competence.

We also all know that the reality falls far short of the ideal. Voters are often misinformed, and politicians aren’t reliably truthful. Still, we like to imagine that voters generally get it right in the end, and that politicians are eventually held accountable for what they do.

But is even this modified, more realistic vision of democracy in action still relevant? Or has our political system been so degraded by misinformation and disinformation that it can no longer function?

Well, consider the case of the budget deficit — an issue that dominated Washington discussion for almost three years, although it has recently receded.

You probably won’t be surprised to hear that voters are poorly informed about the deficit. But you may be surprised by just how misinformed.

In a well-known paper with a discouraging title, “It Feels Like We’re Thinking,” the political scientists Christopher Achen and Larry Bartels reported on a 1996 survey that asked voters whether the budget deficit had increased or decreased under President Clinton. In fact, the deficit was down sharply, but a plurality of voters — and a majority of Republicans — believed that it had gone up.

I wondered on my blog what a similar survey would show today, with the deficit falling even faster than it did in the 1990s. Ask and ye shall receive: Hal Varian, the chief economist of Google, offered to run a Google Consumer Survey — a service the company normally sells to market researchers — on the question. So we asked whether the deficit has gone up or down since January 2010. And the results were even worse than in 1996: A majority of those who replied said the deficit has gone up, with more than 40 percent saying that it has gone up a lot. Only 12 percent answered correctly that it has gone down a lot.

Am I saying that voters are stupid? Not at all. People have lives, jobs, children to raise. They’re not going to sit down with Congressional Budget Office reports. Instead, they rely on what they hear from authority figures. The problem is that much of what they hear is misleading if not outright false.

The outright falsehoods, you won’t be surprised to learn, tend to be politically motivated. In those 1996 data, Republicans were much more likely than Democrats to hold false views about the deficit, and the same must surely be true today. After all, Republicans made a lot of political hay over a supposedly runaway deficit early in the Obama administration, and they have maintained the same rhetoric even as the deficit has plunged. Thus Eric Cantor, the second-ranking Republican in the House, declared on Fox News that we have a “growing deficit,” while Senator Rand Paul told Bloomberg Businessweek that we’re running “a trillion-dollar deficit every year.”

Do people like Mr. Cantor or Mr. Paul know that what they’re saying isn’t true? Do they care? Probably not. In Stephen Colbert’s famous formulation, claims about runaway deficits may not be true, but they have truthiness, and that’s all that matters.

Still, aren’t there umpires for this sort of thing — trusted, nonpartisan authorities who can and will call out purveyors of falsehood? Once upon a time, I think, there were. But these days the partisan divide runs very deep, and even those who try to play umpire seem afraid to call out falsehood. Incredibly, the fact-checking site PolitiFact rated Mr. Cantor’s flatly false statement as “half true.”

Now, Washington still does have some “wise men,” people who are treated with special deference by the news media. But when it comes to the issue of the deficit, the supposed wise men turn out to be part of the problem. People like Alan Simpson and Erskine Bowles, the co-chairmen of President Obama’s deficit commission, did a lot to feed public anxiety about the deficit when it was high. Their report was ominously titled “The Moment of Truth.” So have they changed their tune as the deficit has come down? No — so it’s no surprise that the narrative of runaway deficits remains even though the budget reality has completely changed.

Put it all together, and it’s a discouraging picture. We have an ill-informed or misinformed electorate, politicians who gleefully add to the misinformation and watchdogs who are afraid to bark. And to the extent that there are widely respected, not-too-partisan players, they seem to be fostering, not fixing, the public’s false impressions.

So what should we be doing? Keep pounding away at the truth, I guess, and hope it breaks through. But it’s hard not to wonder how this system is supposed to work.

“Gingrich’s Revisionist History Of Himself”: Bizarre Anyone Would Take Newt’s Advice About How To Engineer A Government Shutdown

Newt Gingrich has often relied on short memories of his political career (as I can attest from the shocked reaction I got in 2011 when writing about his well-known history as a Rockefeller Republican), but he’s clearly going too far in pretending the government shutdown he engineered in 1995 was some sort of triumph. Conservative Ramesh Ponnuru slaps him down pretty emphatically today:

Newt Gingrich is telling Republicans not to fear a government shutdown because the last one went so well for them. This is pure revisionist history, and they would be fools to believe him….

Gingrich’s current spin on the events of 1995-96 is just wrong. The election of a Republican Congress in 1994 put government spending on a lower trajectory, as the election of a Republican House did again in 2010. Whether the shutdowns contributed to that result is a different matter.

Almost nobody back then believed it. Democrats thought that they had won the battle over the shutdowns, and that the agreement to end them was a Republican surrender. Clinton made a point, in his next State of the Union address, to criticize Republicans for their strategy. It was an applause line. Clinton’s job-approval numbers started to rise as soon as the shutdown fight was over, and they never really sank again.

Republicans thought they had lost, too. A minority of them thought that they should have kept the government shuttered longer, and that Gingrich and Senate Republican leader Bob Dole had caved. (Gingrich was widely reported at the time to have told unhappy colleagues, “I melt when I’m around him,” referring to Clinton.) Most of them decided that bringing on a shutdown at all was a mistake.

It’s true, as Gingrich now says, that Republicans lost only a few House seats in the next election. But it’s also true that the shutdowns ended what had been called the “Republican revolution” of the mid-1990s. Before the shutdowns, the Republicans had talked about eliminating four cabinet departments. Afterward, they quit….

Gingrich himself accepted the conventional wisdom that his party had lost. That’s what associates of his told me (among others) at the time, and that’s how they recollect it now.

I’d say Ramesh is really pulling his punches here. The rationalization that the GOP “lost only a few seats” reflects some serious amnesia. This was the only time in U.S. history that the party holding the White House for two consecutive terms gained House seats in the second midterm election. It was perceived as a disaster at the time–after all, Gingrich stepped down as Speaker almost immediately–and was largely blamed on Gingrich’s handling of the budget negotiations that led to the shutdown. Ponnuru mentions Clinton’s rising approval ratings after the confrontation with Newt, but here’s what Gallup’s Frank Newport had to say about the saga’s effect on Gingrich’s popularity:

The public appeared to turn particularly strongly against the Speaker after his budget confrontation with Bill Clinton and the resulting U.S. Government shutdown in late 1995. (Publicity at the time, including a famous front page caricature in the New York Daily News, included the allegation that Gingrich had closed down the government because he was given a bad seat at the back of Air Force One when returning from the funeral of Yitzhak Rabin in Israel.) By January of 1996, 57% of Americans said that their image of Gingrich was unfavorable, compared with 37% who had a favorable image of him. This nearly two-to-one negative-to-positive image ratio persisted throughout most of 1996 and 1997.

It’s just bizarre that anyone would take Newt Gingrich’s advice about how to engineer a fiscal confrontation involving a government shutdown threat, and an example of the man’s invincible chutzpah that he’s offering it.

“Forgiveness, Unless You’re A Democrat”: Anthony Weiner Is No Bill Clinton Or David Vitter

Republicans, the party of forgiveness … unless you’re a Democrat.

Anthony Weiner ain’t no Bill Clinton, although many Republicans consider them one and the same, which is why many on the right are perplexed about Weiner’s popularity rapidly dropping in the polls this week in his bid to become mayor of New York. Democrats have pulled their support from him and, so it would seem, have the Clintons.

Weiner’s problem isn’t that Democrats can’t be forgiving. Weiner’s problem is that he continued his inappropriate behavior after stepping down from Congress. The Weiners like to compare themselves to the Clintons, but the situations are not the same, though many of my Republican friends love the comparison. Let me break it down as to why the situations are quite different:

Weiner isn’t, nor ever will be, president. Weiner was a congressman, and not a popular one. Bill Clinton was a popular president, the economy was good and we were at peace. In other words, Bill Clinton was doing his job, despite his behavior, and a good job at that. Weiner on the other hand, it could be argued was distracted by his…umm…hobby.

Hilary wasn’t pregnant. As a woman, I think it was even more reprehensible to many of us ladies that Anthony Weiner was having cybersex, if you will, while his wife was pregnant with his child.

Weiner’s marriage was new. Hilary and Bill have been together a lifetime. Hilary had already suffered through Bill’s indiscretions. She had forgiven him and decided long ago to stand by her man. Although I am sure this was quite painful for her, she was used to forgiving him, and I am sure his behavior was not shocking to her as it was a pattern of behavior.

The “affair” of Bill Clinton and Monica Lewinsky was behind closed doors, albeit those doors were that of the oval office. They were not out for the public to see. On the other hand, Weiner’s penchant for taking photos of his own body parts is, well….a bit perverted. And putting it out there, online for all the world to see, makes it public and a public embarrassment for his wife as well.

I also find it odd that Republicans couldn’t wrap their heads around Democrats forgiving Bill Clinton, and for a time, Anthony Weiner. Isn’t David Vitter still in his political seat after soliciting a prostitute? Not only engaging in adultery, but breaking the law? And how about Mark Sanford? A guy who lied not only to his wife and kids, but to his state when he fled to South America to see his mistress?

So when Anthony Weiner stepped down and, at first, New Yorkers forgave him and gave him a chance, why were Republicans so harsh to judge when their own “sinners” had been forgiven? And what about Eliot Spitzer, who did the same thing as David Vitter, but had the decency to step down, get help, work on his marriage and come back, perhaps soon to be a winner again?

It’s obvious. You can hire prostitutes, play footsies with guys under a bathroom stall, run off from your post, commit adultery and use tax dollars to fly to South America to visit your mistress, and it will be forgiven … unless, you’re a Democrat.
