“Voters Send A Loud Anti-NRA Message”: The Days Of The NRA Hostage Taking Are Coming To An End
Robin Kelly, who as a young state representative sponsored gun-safety legislation with state Senator Barack Obama, swept to victory Tuesday night in an Illinois US House primary that sent a powerful signal about the National Rifle Association’s dwindling influence within the Democratic Party.
Kelly won 58 percent of the vote in a crowded field, easily defeating former Congresswoman Debbie Halvorson and other Democrats to win the nomination to replace former Congressman Jesse Jackson, Jr., as the representative from Illinois’s 2nd district.
In a multiracial district that includes parts of Chicago, as well as suburbs and rural regions of a district that stretches across northeastern Illinois, Halvorson began the race as the front runner. In addition to her status as a former House member, she was the only white candidate in a field where the African-American vote was divided among more than a dozen contenders.
After the Newtown, Connecticut, shootings focused the attention of the country—and Illinois—on the gun debate, however, Kelly made support for gun-safety legislation central to her campaign.
Kelly’s “Help Me Fight Gun Violence” message united African-American and progressive white voters against Halvorson, who had accepted NRA support in previous races and who continued to support NRA positions on many issues.
Though President Obama, who has made the fight for gun-safety legislation a priority of his second term, stayed out of the race, Kelly promised to champion legislation backed by the president—who her ads noted she had worked with a decade ago, when they both served in the Illinois legislature.
As she claimed victory Tuesday night, Kelly told her backers, “Today you did more than cast a vote. You did more than choose a Democratic candidate for Congress…You sent a message that was heard around our state and across the nation; a message that tells the NRA that their days of holding our country hostage are coming to an end.”
New York Mayor Michael Bloomberg, who has pledged to fight the NRA’s political influence nationwide, used his Independence USA political action committee to air more than $2 million to oppose Halvorson and back Kelly.
The Illinois Rifle Association, an NRA affiliate, backed Halvorson with late-stage mailings.
But it was Kelly’s steady focus on the gun debate that gained her the upper hand in the race.
The NRA and its apologists will, of course, claim that the Illinois district was a bad battleground for the group and its message. Illinois is not West Virginia or North Dakota, after all. And the Chicago area has bitter experience with gun violence, as Kelly noted in a campaign that focused on the anger and pain felt in neighborhoods where too many young lives have been lost to shootings.
But advocates for tougher gun laws recognized the significance of the Illinois result.
“Robin Kelly’s victory tonight is a withering blow to the NRA and others who think we shouldn’t do anything to prevent the gun violence that took the lives of 20 children in Connecticut in December and ravages the streets of cities like Chicago every single day,” announced Arshad Hasan, the executive director of Democracy for America, which backed Kelly. “This was the first time since the tragedy of Newtown that advocates for gun violence prevention have taken on the NRA and their allies—and we won. We’re incredibly proud of the over $15,000 and hundreds of volunteer hours Democracy for America members contributed to Kelly’s win tonight, because we know she’ll fight in Congress for the stronger, common sense gun laws that most Americans support.”
Whatever the dynamic of the district and the state, there is no question that Halvorson had initial advantages that were undone by her association with the NRA and by Kelly’s decision to run on a five-point pledge that declared she would work to:
1. Pass a comprehensive ban on assault weapons.
2. Eliminate the gun show loophole.
3. Pledge never to receive support from groups that oppose reasonable gun safety legislation.
4. Ban high capacity ammunition magazines.
5. Support laws that prohibit conceal-and-carry permits.
“While we don’t know who will represent Illinois’ second district in Congress, we do know that addressing the issue of gun violence will be among the very first issues they face,” Kelly declared early in the campaign. “I believe we need more leaders in Congress addressing the issue of gun violence in our cities and our communities. For this reason, I believe we must all speak with one voice on this urgent matter.”
Primary voters in the 2nd district of Illinois spoke with that united voice Tuesday. And they said “no” to the NRA. Loudly. Perhaps so loudly that Democrats in Congress, many of whom have been cautious gun-safety advocates, will help Robin Kelly fight gun violence.

“Absolute Opposition”: How The NRA Is Helping To Pass Gun Control
We’re in the early stages of a lengthy process that will involve hearings, competing bills, horse-trading, and the usual ugliness of life in the Capitol Hill sausage factory, but the contours of gun legislation are beginning to take shape. Though President Obama is out campaigning for the full package of reforms he has been advocating, there are indications that the assault weapons ban may get dropped in order to forestall a Republican filibuster in the Senate, and a bipartisan group is about to introduce a bill in the House on gun trafficking and straw purchases. (I’ll discuss the assault weapons question in a later post). In other words, the actual legislative process is getting underway.
And though it’s by no means assured that some gun measures will pass Congress, if any do, we’ll partly have the NRA to thank. That’s because, I believe, the organization fundamentally misread the role it plays in the minds of the average voter. They’ve become more extremist in the last two decades, but most people didn’t realize it, because unless you’re a member and are getting their magazines and emails or seeing their representatives appear at conventions, you had no idea just how extreme they’d become. So the idea that the NRA is just the guardian of Americans’ gun rights could persist. An average gun owner who saw that the NRA endorsed a candidate could say, whatever else he thought of that candidate, “I suppose he’s all right when it comes to guns.” But now that Wayne LaPierre has been appearing on television shows, the whole country has gotten to see just what a maniac he is, and how extreme the organization has become. And now that there are concrete proposals on the table, voters can see that the NRA will oppose even universal background checks, which every opinion poll taken in the last couple of months has shown are supported by an astonishing 90 percent of the public. When even the host of Fox News Sunday is calling your arguments “ridiculous” and “nonsense,” you’ve got a problem.
So now, members of Congress who just a few months ago would never have considered bucking the NRA on anything may realize that it isn’t that much of a risk to oppose them on a particular measure, provided it has wide public support. Instead of worrying that they’ll be branded “anti-gun” for disagreeing with the NRA on anything, they may be saying to themselves that if they’ve got the public behind them, it may not be such a risk after all to support something like universal background checks.
The NRA’s model of influence—absolute opposition to any measure to restrict guns combined with apocalyptic rhetoric aimed at its supporters—worked as long as the gun issue was out of the spotlight. But now that we’re having an actual debate, things have changed. It’s becoming clear that while they represent a certain portion of gun owners, they definitely don’t speak for all gun owners, which is what they’d like legislators to believe. And that may provide just enough of an opening for legislation to pass.

“What An Honor”: What Do I Have To Do To Make The NRA’s ‘Enemies List’?
I can’t tell you how let down I am that I didn’t make the National Rifle Association’s so-called “enemies list,” which has surfaced again as the gun lobby comes under closer fire, if you’ll excuse the expression.
The NRA keeps so many scores of groups in its sights as anti-gun-control that it beggars belief. Among them are the American Academy of Pediatrics, the United Methodist Church, the American Civil Liberties Union, the American Jewish Congress, the National Coalition Against Domestic Violence, the Women’s International League for Peace and Freedom, the YWCA, and Physicians for Social Responsibility. Those from the creative arts named include Bruce Springsteen, Alec Baldwin, Jerry Seinfeld, Matt Damon, Kyra Sedgwick, and Maya Angelou, to name but a few.
What an honor. Some newspaper columnists, notably E.J. Dionne, Jr., and Cynthia Tucker, got the nod. Congratulations to all, but count me in for next time. Another columnist, the economist Paul Krugman, who writes for the New York Times, is also mysteriously missing. He recently described the NRA as “insane,” in the wake and ashes of the Newtown school shooting tragedy.
Well, I go farther than that. The NRA may as well be criminally insane for the part it plays in American society, terrorizing legislators like a loose junkyard dog. It has intervened to block medical treatment and lawsuits relating to gun ownership and violence. Deaf to the urgent words of wounded former representative Gabrielle Giffords, whose congressional career was cut short by a lone white young gunman, the NRA was unmoved by the cold blooded murder of women and children in Newtown by a lone white young gunman. For its aggressive stance over the last decades, NRA has the blood of children on its hands.
Wayne LaPierre, executive vice president of the NRA, didn’t bat an eye in front of a Senate panel where Giffords and Newtown parents made eloquent pleas for better gun laws, such as background checks for buyers. LaPierre didn’t move an inch on working with Congress on an assault weapons ban. And there was no apology to President Obama for the ludicrous, lowdown ad suggesting that his daughters’ school, Sidwell Friends, has armed guards (“his kids are protected by armed guards at their school”). Of course the Secret Service protects every president’s family, but the daughters’ school does not have armed guards. (Note to LaPierre’s outfit: Society of Friends schools are Quaker, a pacifist faith founded in 17th century England. “Pacifist” is a word NRA leaders should go look up in the dictionary.)
Assault weapons are more sacred than preventing human tragedy, both civilian and police deaths. It’s just that simple in the NRA’s sinister worldview. Obama could not have done anything better with his Monday than visiting Minneapolis to talk to citizens about stemming the tide of gun deaths. He stated he didn’t intend to wait for another Newtown in taking this fight to the people. Thank you, Mr. President, for acting like one.
One more thing: Gayle Trotter, a senior fellow at the NRA-allied Independent Women’s Forum, also testified in front of the same Senate panel as LaPierre last week. How she could make the absurd claim that mothers need to protect their children from intruders with guns is beyond the reach of reason. It is pure right-wing fiction, since studies show that women are actually less safe with a gun in the house. Sen. Sheldon Whitehouse of Rhode Island tried to set the record straight with some facts, but Trotter wasn’t having any of that.
Trotter’s testimony goes to show that the enemies of a more peaceful public square remain ruthless. We more temperate Americans can’t let them take Thomas Jefferson or James Madison away from us. We have to work harder to oppose their locked-in conviction, knowing that it won’t be perfect or pretty (to paraphrase Baltimore Ravens champion Head Coach John Harbaugh). But we have to get on the field and engage. Obama has started the dialogue out in the open where it belongs.

“Everyone But Us”: The NRA Should Add Its Own Members To Its “Enemies List”
Last September, The National Rifle Association released its annual “enemies list” of organizations and individuals who endorse “anti-gun positions.” The bizarre list of 525 names includes mainstream organizations from AARP to the National Association of Police Organizations, and celebrities, national figures and journalists from Maya Angelou to Henry Winkler to E.J. Dionne Jr.
But why aren’t NRA members on the enemies list? After all, 75 percent of NRA members support universal background checks for gun sales, which the NRA opposes.
And why aren’t women on the enemies list? A majority 67 percent of women support a ban on semi-automatic weapons, which the NRA opposes.
And why aren’t gun owners on the enemies list? A majority 60 percent of gun owners favor a federal database to track gun sales, which the NRA opposes.
Lastly, why aren’t the American people on the NRA’s enemies list? The majority of Americans support an assault weapons ban, a ban on high-capacity magazines, and universal background checks… all of which the NRA opposes.
There is one group that the NRA would never add to its enemies list — gun manufacturers. One must always remember on which side one’s bread is buttered.

“Reasonable Expectations”: Why The NRA’s Best Argument Is Still Bunk
Wayne LaPierre, chief executive of the National Rifle Association was back in the spotlight on Wednesday—this time to appear before a congressional committee contemplating new gun violence legislation. And while LaPierre got emotional at a few points, he spent most of his testimony trying to make a pragmatic argument: “We need to be honest about what works and what does not work,” LaPierre said, in a prepared statement. “Proposals that would only serve to burden the law-abiding have failed in the past and will fail in the future.”
LaPierre didn’t specify which past laws he had in mind, but it’s a safe bet that he was thinking about two high-profile pieces of legislation from the early 1990s. One was the Brady Law, which created a system of background checks for people purchasing guns. The other was the 1994 crime bill, which included a ban on some assault weapons. LaPierre is hardly the only person who thinks those laws demonstrate the futility of gun control. Most experts agree that the cumulative effect of the laws was, at best, modest.1
It’s one thing to say gun laws haven’t significantly reduced gun violence, but quite another to say they couldn’t.
But it’s one thing to say gun laws haven’t significantly reduced gun violence, quite another to say they couldn’t. Both the Brady Law and assault weapons ban had serious, specific flaws. The most conspicuous problem with the Brady Law was that it didn’t affect private sales: You could buy a gun from a non-licensed dealer—say, at a gun show—without anybody checking to make sure you didn’t have a criminal record or some other characteristic that made it illegal for you to have a weapon. The big loophole in the assault rifle ban was that its definition of prohibited weapons, which manufacturers were able to circumvent by making minor modifications to existing guns. But gun control advocates have learned a lot since that time. And that’s one reason to think the proposals now on the table could have a bigger impact than their predecessors did.
To be fair, it’s not as if architects of the Brady Law or assault weapons ban thought either law would have a huge impact on crime. It’s easy to forget now, but enactment of the Brady Law culminated a decade of political struggle against the opponents of gun control, particularly the National Rifle Association. It took the election of Bill Clinton, who had promised to sign such a bill as president, to break the logjam—and even then it was a struggle. “I remember going up to the final day of that vote, we were whipping it for over a month,” says Jim Kessler, who was an aide to then-Congressman Charles Schumer, one of the law’s co-sponsors, and is now senior vice president for policy at Third Way. “We did not have the support of the speaker, we did not have the judiciary chairman, Jack Brooks of Texas, we had to do it on our own—and up to the day of the vote, we felt we might not have the votes to pass.” Given that political reality, the advocates of gun laws knew they would be settling for highly imperfect legislation. One hope was that passing Brady would demonstrate the political viability of gun legislation, making it possible to pass stronger legislation later on. “The NRA had such a stranglehold around the neck of Congress, we knew that if we were going to get anything through, it had to be narrow,” says Richard Aborn, a former prosecutor who was president of the Brady Campaign during the early 1990s.
But advocates of gun legislation in the 1990s didn’t simply lack sufficient political power. They also lacked know-how. At the time, experts didn’t really understand gun shows—and they certainly didn’t grasp the role that gun shows might play in facilitating sales once the Brady Law was in effect. “The notion of private sales and, in particular, gun show leakage was not on ours, or anybody else’s, radar screen,” Aborn says. And even if lawmakers had been thinking about gun shows, it’s not clear how much they could have done to restrict sales, at least in that political environment: Requiring private dealers to run full background checks, cross-checking identifications with criminal records and such, would have been time-consuming and in some cases unwieldy. Tom Diaz, a former Democratic staffer for the House Judiciary Committee and former policy analyst at the Violence Policy Center, explains, “There was no established system to do the background check. It seems easy now, but in the mid-1990s there were no ‘apps’ and the communication among computers was fragile. It was just much easier and more realistic to require federal firearms licensees—i.e., dealers—to do the background check, since they were already regulated under existing law.”
Veterans of the assault weapons ban fight recall facing similar obstacles. Lack of technology wasn’t an issue, but lack of understanding about guns was. Diaz, author of a forthcoming book called The Last Gun: How Changes in the Gun Industry Are Killing Americans and What It Will Take to Stop It, remembers the crafting of that bill as a decidedly amateur exercise:
In the case of the assault weapons ban, it was as inelegant as this: a bunch of politicians (mostly in the Senate, then in the House as the Senate bill became the vehicle) who knew (and some still know) precious little or even nothing at all about guns in general and assault weapons in particular literally sewed together (1) a list of guns, like Uzis and AKs, and (2) a silly list of “features” (bells and whistles) that “defined” in law what an assault weapon was supposed to be. If the gun had two or more of these features, well, it was an assault weapon. The defect was that manufacturers easily just eliminated the bells and whistles, but kept the major design features that make assault weapons so problematic, namely the ability to accept a high-capacity magazine, and a pistol grip to hold the gun for rapid fire.
One sign that the advocates of new gun laws have learned from the past is that their proposals are more sophisticated, and savvy, than the ones they put forward last time.2 Under the assault weapons proposals circulating now, including the proposal from California Senator Diane Feinstein, a gun would be illegal if it had just one criteria of an automatic rifle, rather than two. Lawmakers are also talking about new restrictions on high-capacity magazines. Christopher Koper, a criminologist at George Mason who was co-author of the official Justice Department review of the old assault weapons ban, thinks a stronger law has potential. “Restrictions like the old ones on assault weapons and large capacity magazines probably won’t lower the overall rate of gun crime,” he says, “but they may modestly reduce shootings by reducing gun attacks with particularly high numbers of shots fired. My best estimate is that the impact on shootings would be under 5 percent overall. I wouldn’t consider this trivial, however, given the seriousness and social costs of shootings.”
More important, advocates for gun laws have quietly shifted their priorities. The assault weapons ban continues to get the most publicity, but the real focus—for advocates and the lawmakers they support—is on a better system of background checks. “Universal background checks… would have much greater impacts,” Koper says. “That could be a game-changer, but they also need to make sure the law is accompanied by meaningful penalties and enforcement.” The advocates for new gun laws seem to grasp that last point. And that includes the president. Obama has already ordered law enforcement agencies to trace the history of guns they seize in crimes. It was one of the executive orders he issued when he unveiled his full gun plan.
To be clear, this doesn’t mean that the new push for gun legislation is destined to succeed—or to have dramatic effects on crime. Lawmakers in more conservative and rural districts remain reluctant to take on the National Rifle Association and its allies. And even the new laws will have loopholes. The more government regulates gun purchases from legal dealers, for example, the more criminals will seek to get them illegally. And the more government limits the manufacturer certain types of weapons, the more criminals will use older, grandfathered versions—or get them from overseas.
But even a modest impact on violence would represent progress. It would create a framework on which future lawmakers can build stronger regulations and, in the meantime, it would save at least a few lives. “Just because we can’t do everything doesn’t mean we shouldn’t do everything we can,” says Aborn. “Will it stop all gun crime? No. But … we don’t say repeal the murder statutes because it doesn’t stop all murders. There have to be reasonable expectations and a reasonable expectation is that it will make a difference and save some lives.”
