“NRA’s Constitutional Fraud”: The Truth Behind The “Right To Bear Arms”
In the wake of the horrific Isla Vista, California, mass killing, Americans have once again engaged the debate over gun proliferation. Victims’ families issue primal cries for regulation of these deadly weapons and gun activists respond by waving the Constitution and declaring their “fundamental right” to bear arms is sacrosanct. Indeed, such right-wing luminaries as Joe the plumber, who not long ago shared the stage with the Republican nominees for president and vice president, said explicitly:
“Your dead kids don’t trump my constitutional rights.”
Iowa Republican Senate candidate Jodi Ernst, known for her violent campaign ads in which she is seen shooting guns and promising to “unload” on Obamacare, had this to say when asked about Isla Vista:
“This unfortunate accident happened after the ad, but it does highlight that I want to get rid of, repeal, and replace [opponent] Bruce Braley’s Obamacare. And it also shows that I am a strong supporter of the Second Amendment. That is a fundamental right.”
This argument is set forth by gun proliferation advocates as if it has been understood this way from the beginning of the republic. Indeed, “fundamental right to bear arms” is often spat at gun regulation advocates as if they have heard it from the mouths of John Adams and Thomas Jefferson themselves. But what none of them seem to acknowledge (or, more likely, know) is that this particular legal interpretation of the Second Amendment was validated by the Supreme Court all the way back in … 2008. That’s right. It was only six years ago that the Supreme Court ruled (in a 5-4 decision with the conservatives in the majority, naturally) that there was a “right to bear arms” as these people insist has been true for over two centuries. And even then it isn’t nearly as expansive as these folks like to pretend.
For instance, that gun-grabbing hippie Justice Antonin Scalia went out of his way in that decision to say that beyond the holding of handguns in the home for self-defense, regulations of firearms remained the purview of the state and so too was conduct. He wrote that regulating the use of concealed weapons or barring the use of weapons in certain places or restricting commercial use are permitted. That’s Antonin Scalia, well known to be at the far-right end of the legal spectrum on this issue. Most judges had always had a much more limited interpretation of the amendment.
Justice John Paul Stephens discussed his long experience with Second Amendment jurisprudence in his book “Six Amendments: How and Why We Should Change the Constitution,” and notes that when he came on the Supreme Court there was literally no debate among the justices, conservative or liberal, over the idea that the Second Amendment constituted a “fundamental right” to bear arms. Precedents going all the way back to the beginning of the republic had held that the state had an interest in regulating weapons and never once in all its years had declared a “fundamental right” in this regard.
So, what happened? Well, the NRA happened. Or more specifically, a change in leadership in the NRA happened. After all, the NRA had long been a benign sportsman’s organization devoted to hunting and gun safety. It wasn’t until 1977, that a group of radicals led by activists from the Second Amendment Foundation and the Citizens Committee for the Right to Keep and Bear Arms took control and changed the direction of the group to one dedicated to making the Second Amendment into a “fundamental right.”
What had been a fringe ideology was then systematically mainstreamed by the NRA, a program that prompted the retired arch conservative Chief Justice Warren Burger to say that the Second Amendment:
“Has been the subject of one of the greatest pieces of fraud, I repeat the word ‘fraud,’ on the American public by special interest groups that I have ever seen in my lifetime”
The results are clear to see. Mass shootings are just the tip of the iceberg. Today we have people brandishing guns in public, daring people to try to stop them in the wake of new laws legalizing open carry law even in churches, bars and schools. People “bearing arms” show up at political events, silently intimidating their opponents, making it a physical risk to express one’s opinion in public. They are shooting people with impunity under loose “stand your ground” and “castle doctrine” legal theories, which essentially allow gun owners to kill people solely on the ground that they “felt threatened.” Gun accidents are epidemic. And this, the gun proliferation activists insist, is “liberty.”
Michael Waldman of the Brennan Center for Justice (at NYU School of Law) has thoroughly documented all this history in his book, “The Second Amendment: A Biography,” a bit of which was excerpted in Politico magazine. He recommends that progressives who care about this issue think long and hard about how the right was able to turn this around, making a specific case for taking constitutional arguments seriously and using their “totemic” stature to advance the cause. He suggests that they adopt a similarly systematic approach, keeping this foremost in mind:
Molding public opinion is the most important factor. Abraham Lincoln, debating slavery, said in 1858, “Public sentiment is everything. With public sentiment, nothing can fail; without it, nothing can succeed. Consequently he who molds public sentiment goes deeper than he who enacts statutes or pronounces decisions. He makes statutes and decisions possible or impossible to be executed.” The triumph of gun rights reminds us today: If you want to win in the court of law, first win in the court of public opinion.
In his book, Justice John Paul Stevens suggest a modest tweak to the Second Amendment to finally make clear what the founders obviously intended:
“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms when serving in the Militia shall not be infringed.”
Emotional claims that the right to possess deadly weapons is so important that it is protected by the federal Constitution distort intelligent debate about the wisdom of particular aspects of proposed legislation designed to minimize the slaughter caused by the prevalence of guns in private hands. Those emotional arguments would be nullified by the adoption of my proposed amendment. The amendment certainly would not silence the powerful voice of the gun lobby; it would merely eliminate its ability to advance one mistaken argument.
This is important. As Waldman notes, where the NRA Headquarters once featured words about safety on the facade of its building, it is now festooned with the words of the Second amendment. Well, some of them anyway:
Visitors might not notice that the text is incomplete. It reads: “.. the right of the people to keep and bear arms, shall not be infringed.”
The first half—the part about the well regulated militia—has been edited out.
If they truly believed the 2nd Amendment was absolute and totally clear, you’d think they’d show all the language, wouldn’t you? One can only conclude that they are trying to hide something: its real meaning.

“What Did The Framers Really Mean?”: It Wasn’t To Trump The Public Good
Three days after the publication of Michael Waldman’s new book, “The Second Amendment: A Biography,” Elliot Rodger, 22, went on a killing spree, stabbing three people and then shooting another eight, killing four of them, including himself. This was only the latest mass shooting in recent memory, going back to Columbine.
In his rigorous, scholarly, but accessible book, Waldman notes such horrific events but doesn’t dwell on them. He is after something else. He wants to understand how it came to be that the Second Amendment, long assumed to mean one thing, has come to mean something else entirely. To put it another way: Why are we, as a society, willing to put up with mass shootings as the price we must pay for the right to carry a gun?
The Second Amendment begins, “A well-regulated Militia, being necessary to the security of a free State,” and that’s where Waldman, the president of the Brennan Center for Justice at the New York University School of Law, begins, too. He has gone back into the framers’ original arguments and made two essential discoveries, one surprising and the other not surprising at all.
The surprising discovery is that of all the amendments that comprise the Bill of Rights, the Second was probably the least debated. What we know is that the founders were deeply opposed to a standing army, which they viewed as the first step toward tyranny. Instead, their assumption was that the male citizenry would all belong to local militias. As Waldman writes, “They were not allowed to have a musket; they were required to. More than a right, being armed was a duty.”
Thus the unsurprising discovery: Virtually every reference to “the right of the people to keep and bear Arms” — the second part of the Second Amendment — was in reference to military defense. Waldman notes the House debate over the Second Amendment in the summer of 1789: “Twelve congressmen joined the debate. None mentioned a private right to bear arms for self-defense, hunting or for any purpose other than joining the militia.”
In time, of course, the militia idea died out, replaced by a professionalized armed service. Most gun regulation took place at the state and city level. The judiciary mostly stayed out of the way. In 1939, the Supreme Court upheld the nation’s first national gun law, the National Firearms Act, which put onerous limits on sawed-off shotguns and machine guns — precisely because the guns had no “reasonable relation” to “a well-regulated militia.”
But then, in 1977, there was a coup at the National Rifle Association, which was taken over by Second Amendment fundamentalists. Over the course of the next 30 years, they set out to do nothing less than change the meaning of the Second Amendment, so that it’s final phrase — “shall not be infringed” — referred to an individual right to keep and bear arms, rather than a collective right for the common defense.
Waldman is scornful of much of this effort. Time and again, he finds the proponents of this new view taking the founders’ words completely out of context, sometimes laughably so. They embrace Thomas Jefferson because he once wrote to George Washington, “One loves to possess arms.” In fact, says Waldman, Jefferson was referring to some old letter he needed “so he could issue a rebuttal in case he got attacked for a decision he made as secretary of state.”
Still, as Waldman notes, the effort was wildly successful. In 1972, the Republican platform favored gun control. By 1980, the Republican platform opposed gun registration. That year, the N.R.A. gave its first-ever presidential endorsement to Ronald Reagan.
The critical modern event, however, was the Supreme Court’s 2008 Heller decision, which tossed aside two centuries of settled law, and ruled that a gun-control law in Washington, D.C., was unconstitutional under the Second Amendment. The author of the majority opinion was Antonin Scalia, who fancies himself the leading “originalist” on the court — meaning he believes, as Waldman puts it, “that the only legitimate way to interpret the Constitution is to ask what the framers and their generation intended in 1789.”
Waldman is persuasive that a truly originalist decision would have tied the right to keep and bear arms to a well-regulated militia. But the right to own guns had by then become conservative dogma, and it was inevitable that the five conservative members of the Supreme Court would vote that way.
“When the militias evaporated,” concludes Waldman, “so did the original meaning of the Second Amendment.” But, he adds, “What we did not have was a regime of judicially enforced individual rights, able to trump the public good.”
Sadly, that is what we have now, as we saw over the weekend. Elliot Rodger’s individual right to bear arms trumped the public good. Eight people were shot as a result.

“Crazy Climate Economics”: These Days, Republicans Come Out In Force To Oppose Even The Most Obviously Needed Regulations
Everywhere you look these days, you see Marxism on the rise. Well, O.K., maybe you don’t — but conservatives do. If you so much as mention income inequality, you’ll be denounced as the second coming of Joseph Stalin; Rick Santorum has declared that any use of the word “class” is “Marxism talk.” In the right’s eyes, sinister motives lurk everywhere — for example, George Will says the only reason progressives favor trains is their goal of “diminishing Americans’ individualism in order to make them more amenable to collectivism.”
So it goes without saying that Obamacare, based on ideas originally developed at the Heritage Foundation, is a Marxist scheme — why, requiring that people purchase insurance is practically the same as sending them to gulags.
And just wait until the Environmental Protection Agency announces rules intended to slow the pace of climate change.
Until now, the right’s climate craziness has mainly been focused on attacking the science. And it has been quite a spectacle: At this point almost all card-carrying conservatives endorse the view that climate change is a gigantic hoax, that thousands of research papers showing a warming planet — 97 percent of the literature — are the product of a vast international conspiracy. But as the Obama administration moves toward actually doing something based on that science, crazy climate economics will come into its own.
You can already get a taste of what’s coming in the dissenting opinions from a recent Supreme Court ruling on power-plant pollution. A majority of the justices agreed that the E.P.A. has the right to regulate smog from coal-fired power plants, which drifts across state lines. But Justice Scalia didn’t just dissent; he suggested that the E.P.A.’s proposed rule — which would tie the size of required smog reductions to cost — reflected the Marxist concept of “from each according to his ability.” Taking cost into consideration is Marxist? Who knew?
And you can just imagine what will happen when the E.P.A., buoyed by the smog ruling, moves on to regulation of greenhouse gas emissions.
What do I mean by crazy climate economics?
First, we’ll see any effort to limit pollution denounced as a tyrannical act. Pollution wasn’t always a deeply partisan issue: Economists in the George W. Bush administration wrote paeans to “market based” pollution controls, and in 2008 John McCain made proposals for cap-and-trade limits on greenhouse gases part of his presidential campaign. But when House Democrats actually passed a cap-and-trade bill in 2009, it was attacked as, you guessed it, Marxist. And these days Republicans come out in force to oppose even the most obviously needed regulations, like the plan to reduce the pollution that’s killing Chesapeake Bay.
Second, we’ll see claims that any effort to limit emissions will have what Senator Marco Rubio is already calling “a devastating impact on our economy.”
Why is this crazy? Normally, conservatives extol the magic of markets and the adaptability of the private sector, which is supposedly able to transcend with ease any constraints posed by, say, limited supplies of natural resources. But as soon as anyone proposes adding a few limits to reflect environmental issues — such as a cap on carbon emissions — those all-capable corporations supposedly lose any ability to cope with change.
Now, the rules the E.P.A. is likely to impose won’t give the private sector as much flexibility as it would have had in dealing with an economywide carbon cap or emissions tax. But Republicans have only themselves to blame: Their scorched-earth opposition to any kind of climate policy has left executive action by the White House as the only route forward.
Furthermore, it turns out that focusing climate policy on coal-fired power plants isn’t bad as a first step. Such plants aren’t the only source of greenhouse gas emissions, but they’re a large part of the problem — and the best estimates we have of the path forward suggest that reducing power-plant emissions will be a large part of any solution.
What about the argument that unilateral U.S. action won’t work, because China is the real problem? It’s true that we’re no longer No. 1 in greenhouse gases — but we’re still a strong No. 2. Furthermore, U.S. action on climate is a necessary first step toward a broader international agreement, which will surely include sanctions on countries that don’t participate.
So the coming firestorm over new power-plant regulations won’t be a genuine debate — just as there isn’t a genuine debate about climate science. Instead, the airwaves will be filled with conspiracy theories and wild claims about costs, all of which should be ignored. Climate policy may finally be getting somewhere; let’s not let crazy climate economics get in the way.

“Remedial Education On Birth Control”: It Never Fails, Arrogance And Ignorance Often Go Together
You’d really think that an institution with as rich an intellectual history and educational capacity as the Roman Catholic Church could find ways to keep its national spokespeople from saying things as dumb as this:
Is the ability to buy contraceptives, that are now widely available — my Lord, all you have to do is walk into a 7-11 or any shop on any street in America and have access to them — is that right to access those and have them paid for, is that such a towering good that it would suffocate the rights of conscience?
That would be Timothy Cardinal Dolan, Archbishop of New York, on Face the Nation yesterday. It was Dolan who, as president of the U.S. Conference of Catholic Bishops from 2010 until 2013, guided the bishops into a firm alliance with conservative evangelicals (and implicitly, with the Republican Party) in a crusade for “religious liberty” defined as the right of employers to refuse their employees insurance coverage for contraceptives–typically those they regard, in defiance of standard medical profession and scientific definitions, as “abortifacients.”
Dolan’s dismissive comments about contraceptives and 7-11’s are reminiscent of those of conservative Catholic layperson Justice Antonin Scalia, who said this during oral arguments in the Hobby Lobby case:
You’re talking about, what, three or four birth controls, not all of them, just those that are abortifacient. That’s not terribly expensive stuff, is it?
Well, yes, IUDs, the real crux of the “abortifacient” argument being made by Hobby Lobby’s lawyers, are quite expensive, and you cannot simply acquire them by strolling into a convenience store.
Arrogance and ignorance often go together, but you’d figure men as accomplished as Dolan and Scalia would have the wherewithal to avoid sounding like yahoos. Men–especially celibate men like Dolan–should go to the trouble of becoming at least marginally expert on reproductive science and economics before devoting so much of their time and attention to denying women reproductive rights.

“Dignity Is A Constitutional Principle”: Institutionalized Humiliation And The Constitutional Requirements Of Equal Protection
With gay marriage litigation moving forward at warp speed — federal judges have struck down five state bans on same-sex marriage since December — we may soon witness one of the worst shouting matches in Supreme Court history. Passions were already running high last June, when a divided court struck down federal, but not state, laws defining marriage exclusively as a relationship between a man and a woman. Justice Antonin Scalia denounced the majority opinion, which cited the demeaning and humiliating effects of the Defense of Marriage Act, as “legalistic argle-bargle” lacking any basis in our constitutional tradition. Writing for the five justices in the majority, Justice Anthony M. Kennedy countered that the assault on human dignity should be decisive in condemning the statute as unconstitutional.
In making this “dignitarian” move, Justice Kennedy relied principally on his two earlier pathbreaking opinions supporting gay rights, in 1996 and 2003. He did not link his guiding philosophy to the broader principles hammered out during the civil rights revolution of the 1960s. Yet that constitutional legacy would strongly support any future Supreme Court decision extending Justice Kennedy’s reasoning to state statutes discriminating against gay marriage. Indeed, the court should reinforce its dignitarian jurisprudence by stressing its roots in the civil rights revolution — and thereby demonstrate that it is Justice Scalia, not Justice Kennedy, who is blinding himself to the main line of constitutional development.
Consider the great speeches made 50 years ago today as the Senate began its decisive debate on the Civil Rights Act of 1964. The bill’s floor managers were the Democrat Hubert H. Humphrey and the Republican Thomas H. Kuchel. As they surveyed the scene on March 30, 1964, it was far from clear that they had the 67 votes required to break a filibuster led by Southern senators. So they were determined to make their case to the larger public and mobilize popular support for a sustained effort to win a cloture vote.
As The Washington Post reported at the time, the two floor leaders dominated the first day’s proceedings with elaborate presentations that set the stage “for a serious no-nonsense debate” on the fundamental issues. Humphrey began with a remarkable three-and-a-half-hour speech that introduced the central theme of humiliation by comparing two travel guidebooks: one for families with dogs, the other for blacks. “In Augusta, Ga., for example,” Humphrey noted, “there are five hotels and motels that will take dogs, and only one where a Negro can go with confidence.” He argued that if whites “were to experience the humiliation and insult which awaits Negro Americans in thousands and thousands of such places, we, too, would be quick to protest.” Kuchel followed up with a second major presentation, emphasizing the “urgency” of ending the “humiliating forms of discrimination” confronting blacks.
On other occasions, Humphrey repeatedly linked this anti-humiliation principle to the larger aim of securing “freedom from indignity” for blacks and other groups. This link was further reinforced by President Lyndon B. Johnson. “We cannot deny to a group of our own people,” he argued, “the essential elements of human dignity which a majority of our citizens claim for ourselves.” In making their case to the American people, these leaders succeeded in pressuring Senate fence-sitters to close down the filibuster, on June 10, after it had monopolized the floor for more than two months.
But they failed in their larger aim. Their elaborate speeches were also addressed to future generations, articulating fundamental principles that Americans should consider in defining the terms of constitutional equality. Yet as Justice Scalia’s denunciation of Justice Kennedy’s opinion illustrates, America’s lawyers and judges are in danger of consigning these views of Congress and the president to legal oblivion. They seem to suppose that the only civil rights opinions worth studying are those of the Warren and Burger courts — even though the judicial initiatives of those courts would have gone nowhere without the mobilized support of the political branches and the American people.
This is a mistake. To be sure, the judges of the civil rights era also emphasized the link between institutionalized humiliation and the constitutional requirements of equal protection. Most famously, Brown v. Board of Education declared school segregation unconstitutional precisely because it stigmatized blacks, generating “a feeling of inferiority as to their status in the community that may affect their hearts and minds in a way unlikely ever to be undone.” Yet once we recognize that Congress and the president broadened and deepened the nation’s commitment to Brown’s anti-humiliation principle, we can gain a larger perspective on contemporary civil rights struggles.
This point applies not only to gay marriage but also to sexual harassment. When the courts condemn “harassment” on the job or in schools, they are using a different word to describe the very same dynamics of institutionalized humiliation repudiated by the framers of the Civil Rights Act.
This constitutional legacy should also shape our understanding of future civil rights struggles. Consider the situation of undocumented immigrants as they seek to attend school, get a job or drive to the supermarket. They face pervasive humiliation in sphere after sphere of social life. Does this not amount to a systematic denial of the “equal protection of the laws” guaranteed by the Constitution to all persons “within the jurisdiction” of the United States?
Fifty years ago, our parents and grandparents faced the same question when confronting the humiliations imposed on blacks. As we search for guidance on the great constitutional issues of our own time, the place to begin is with the words of Humphrey as he explained why Americans could no longer “justify what we have done to debase humanity.” He argued that we “do not have to be lawyers to understand, ‘Do unto others as you would have them do unto you.’ ”
