“The Electability Conundrum”: Scalia’s Death Only Reinforces The Need For Democrats To Choose Their Nominee Wisely
The death of Antonin Scalia has brought home two truths about the presidential race to voters in both parties. First, there may be no more important issue in the campaign than the Supreme Court (which some of us have been saying for some time). And second, if that’s true, then there may be no more important criterion in picking your party’s nominee than who has the best chance of winning in November.
Unfortunately, electability is a difficult thing to predict, no matter how much you know about politics. During the 2008 primaries, for instance, many intelligent Democrats believed there was no way that the voting public would ever elect an African American with a name like “Barack Hussein Obama.” Four years before, many Democrats thought that John Kerry was the most electable Democrat because Republicans couldn’t possibly attack the patriotism of a war hero, especially with a couple of draft-dodgers like George W. Bush and Dick Cheney at the top of their ticket. Neither of those assessments turned out to be correct.
Nevertheless, it’s an impossible question for partisans to ignore, given the stakes of the election. And just how high are they? Someone (usually someone running for president) will always say “This is the most important election of my lifetime,” and it’s easy to dismiss. After all, no matter what happens, the republic will survive. If you’re a Democrat, you can console yourself with the fact that it survived Ronald Reagan and George W. Bush, as much damage as they might have done; if you’re a Republican you can say the same about Bill Clinton and Barack Obama.
Nevertheless, there are some reasons why this election could be particularly consequential, particularly for Democrats. The first is the Supreme Court, and Scalia’s passing is only part of that story. When the next president is sworn in, Ruth Bader Ginsburg will be 83, Anthony Kennedy will be 80, and Stephen Breyer will be 80. What if Republicans succeed in keeping President Obama from seating a replacement, then a Republican is elected, and some or all of those three fall ill or retire? You could have a Court made up of seven relatively young conservative justices and only two liberals, Sonia Sotomayor and Elena Kagan. The days of liberals losing cases by a 5-4 margin would be but a happy memory, and the overturning of Roe v. Wade, the end of affirmative action, and the crushing of labor union rights would be only the beginning of a judicial scorched-earth campaign that would not only lay waste to rights liberals hold dear, but would keep doing so for decades to come.
And then there’s the matter of what a Republican president would be able to accomplish through legislation. If the GOP nominee wins in November, it will almost certainly also mean that Republicans have held on to the House and the Senate. That president might or not not be a radical conservative, though Donald Trump looks like the only contender with a chance who couldn’t be described that way. But Congress certainly will be radical. The Republican Party has been moving sharply to the right in recent years, and with unified control for the first time in a decade, it’s safe to say they will pretty much go nuts. Repealing the Affordable Care Act, slashing upper-income taxes, gutting the safety net, rolling back environmental regulations, passing federal restrictions on abortion—if it’s in any Republican’s fantasies, it’ll be able to pass through both houses and get signed by the president. And don’t think Democrats having the filibuster will stop that train; given the respect Republicans have shown for norms and traditions, do you think they’ll let that stand in their way?
So if you think electability ought to be part of your calculation, what do you need to consider? The Democratic primary makes it a little easier because there are only two candidates, but it’s still complicated. Here are the variables to consider:
- The reward to be gained from a Bernie Sanders presidency
- The reward to be gained from a Hillary Clinton presidency
- The chances of Sanders winning in November if he’s the nominee
- The chances of Clinton winning if she’s the nominee
- The consequences of a Republican victory in November
That’s not to mention how each Democrat would match up against any given Republican, which introduces another dimension of complexity. But here’s the basic calculation you have to make: Figure out whether, for your preferences, (1) is larger than (2) or vice-versa, and by how much; then figure out whether (3) or (4) is larger, and by how much; then weigh both of those figures against (5).
For instance, you might decide that Bernie Sanders’s presidency would be superior to Hillary Clinton’s, but Clinton has a higher chance of winning in November, and since a Republican presidency would be so dreadful, you’ll support Clinton even though you like Sanders better. Or you might decide that a Sanders presidency would be so good that even if Clinton might have a slightly better chance in November, it’s worth some measure of risk in nominating Sanders because the reward of him winning is so high.
The truth, of course, is that because we aren’t rational people we constantly construct post-hoc justifications for the choices we make. In this case, that means we’ll convince ourselves that whichever candidate we prefer is also the more electable one. While it might seem logical that Clinton has a higher chance of winning a general election than Sanders, I’ve yet to encounter a Sanders supporter who actually thinks so. They say that Clinton has her own electability problems (undoubtedly true), and that Sanders will bring in so many new voters that it will overcome the effect of the attacks Republicans will launch on him for his leftist views. Clinton supporters, on the other hand, find this argument laughable; they’ll tell you that Republicans will positively disembowel Sanders, and by the time they’re done with him he’ll seem like he’s too much of an extremist to get elected to the Burlington City Council.
I’ve also found that Sanders supporters are more likely to minimize the negative consequences of a Republican presidency. That might be because they don’t see as much of a difference between Clinton and the Republicans, but it’s also because they’re focused on the first variable, the potential rewards of a Sanders presidency. Clinton supporters, on the other hand, have no sweeping expectations from their candidate; for them, staving off disaster is more than enough reason to support her.
Even if your heart goes aflutter at Sanders’s mention of things like single-payer health care and free public college tuition, you’d have to grant that achieving those goals is anything but guaranteed even if he wins the White House. And most of what he would do doesn’t differ from what Clinton would do. That’s particularly true of the Supreme Court: Any Democratic president who had a chance to name a new justice would be choosing from the same pool of liberal jurists now serving in federal appeals courts or perhaps a few state supreme courts.
But even if you find the substantive differences between Clinton and Sanders to be enormous, it’s hard to see them as actually being bigger than the difference between them on one hand and the tsunami of change that will occur if a Republican is elected on the other. Which leaves Democratic voters with no choice but think hard about which candidate is more electable—even if there are no perfect answers to the question.

“Sanders’ ‘Medicare For All'”: The Devil Is In The Details
Bernie Sanders is a proud and self-described socialist, a veteran Vermont senator who wants to bring some European ideas to the United States. One of those ideas is a single-payer health care system: a government-funded program in which the patient bears little to no cost. Sanders describes it as “Medicare for all.”
It’s an excellent idea. The United States is the richest country in the world, and it ought to grant every citizen guaranteed access to doctors and hospitals. That’s what Canada, Japan and the countries of Western Europe have all done.
But Sanders is vague — and his supporters quite naive — about the prospects of bringing a single-payer system to the United States. He insists that he could accomplish that in a prospective first term “if many millions of people demand it.”
Here’s the rub: They won’t — at least not in the systematic and sustained manner that would be required to bring about that sort of, well, revolutionary change to the American medical-industrial complex.
There’s a reason that the U.S. doesn’t have “Medicare for all”: politics. Do Sanders and his supporters remember the epic battle to pass the Affordable Care Act?
Democrats have been trying to pass a version of universal health care since the days of Franklin Delano Roosevelt. But conservatives have fought every proposal that would increase access for ordinary Americans, including Medicare; Ronald Reagan, then a neophyte political activist, toured the country campaigning against it.
Bill Clinton made universal health care a cornerstone of his presidential campaign in 1992, and he appointed his wife, Hillary, to head a task force to propose legislation after he won. They tried mightily to pass it, but conservatives denounced it, and the insurance industry spent millions to defeat it.
That’s why President Barack Obama brought the insurance industry on board when he started toward the Affordable Care Act. He knew he needed their support to have a prayer of passage. So the ACA preserves the business of selling health insurance through private companies.
Still, it has helped millions of families; nearly 9 million more Americans had health insurance in 2014 than the year before, according to government data. Moreover, the ACA prevents insurance companies from banning patients because they are sick and prohibits insurers from placing “lifetime caps” on the amount of money any person can collect for health care.
Would a single-payer plan have been even better? You bet. But listen to Obama’s former aide, David Axelrod, describe the difficulties of trying to pass such a proposal.
“I support single-payer health care, but having gone through health reform, we couldn’t even get a national consensus around the public option! It was Democratic votes that were ultimately missing on that issue,” Axelrod remembered. (The public option was a proposal for a government-run health insurance plan to compete with private health insurers.)
History shows that Obama and his allies spent months trying to make the ACA more palatable to conservatives to entice a few GOP votes. Actually, the mandate requiring that all adults have health insurance was originally a conservative idea. While the federal government provides subsidies to help families with modest incomes buy insurance, it doesn’t pay the full cost. (Obamacare also sets aside billions for states to expand Medicaid, but the Supreme Court made that optional, and many states have refused to expand.)
Still, the ACA did not get a single Republican vote in the end — not one. Republicans are still trying to repeal the law, taking more than 60 votes in Congress and going to the Supreme Court with challenges. Most of those Republicans will be easily re-elected to Congress.
Given recent history, it’s clear that Sanders’ plan would face very long odds — and that’s before details become clear. The Vermont senator proposes an extraordinary range of patient care — dental and vision coverage, mental health care, long-term care — while, he says, saving trillions of dollars. Many health care experts say that can’t be done, so health care spending would likely increase. You don’t have to be a conservative voter to fear where that would lead us.
If Vermont’s audacious senator has a plan for overcoming an ultraconservative GOP caucus in Congress, a right-leaning U.S. Supreme Court, and millions of voters who still flinch from the word “socialist,” he ought to lay it out. It would be quite a revolutionary plan, indeed.

“Far, Far More Right-Wing”: Marco Rubio Isn’t The Second Coming Of George W. Bush. He’s Much Worse
With his unexpectedly strong third-place showing in the Iowa caucuses, Marco Rubio demonstrated that he’s the Republican establishment’s best shot to scuttle the Donald Trump and Ted Cruz insurgencies. And now, in the aftermath of Iowa, thoughtful critics of that establishment, from the liberal Jonathan Chait to my paleoconservative colleague at The Week Michael Brendan Dougherty, have begun to describe Rubio as the second coming of George W. Bush.
The comparison makes sense in a purely formal way. Like W in 2000, Rubio promises to unite the party’s grumpy, warring factions (which have grown much grumpier and more belligerent over the past 16 years), making Rubio a strong consensus choice within the party. It’s also true that this formal unity would be built out of the same old planks that have formed the party’s platform since Reagan’s first election: deficit-fueled tax cuts for upper-income earners, strident military interventionism abroad, and lots of speeches (but few policies) in support of traditional faith and families.
But this obscures the fact that substantively, Rubio is far, far more right-wing than George W. Bush ever was. That Rubio has a chance of serving as a consensus candidate positioned somewhere near the ideological center of his party is a tribute to just how far right the GOP has lurched since Bush left office seven years ago.
Here are five areas where Rubio clearly and sharply outflanks W on the right.
Bush signed Medicare, Part D into law, vastly expanding drug benefits for millions of Americans. Rubio, by contrast, has promised with great fanfare that he will eagerly work with Congress to repeal the Affordable Care Act, which would strip millions of Americans of health insurance. It’s also true that, like all the Republican presidential candidates, Rubio talks vaguely about replacing the ACA with a wonderful, unspecified market-based alternative. But no informed commentator on either side of the issue expects any Republican proposal to strive for coverage of as many people as the ACA currently does — let alone as many people as it would have covered if a series of Republican governors hadn’t refused to participate in the law’s expansion of Medicaid.
Bush cut taxes drastically. Rubio, meanwhile, would cut them…even more drastically. How much more? His proposed tax cut amounts to more than three times the size of the Bush tax cuts, with nearly half of it going to the top 5 percent of income-earners. These cuts would produce a revenue shortfall of $6 trillion after 10 years. That’s an amount that even staunch conservatives have described as “huge” and “irresponsible.”
Pro-lifers loved Bush, and for good reason. He appointed a string of conservative judges to the bench, and he spoke frequently about how every child, born and unborn, should be “protected in law and welcomed in life.” Yet on abortion, too, Rubio manages to place himself several steps to Bush’s right, refusing to permit exceptions for terminating pregnancies in cases of rape or incest.For all of Bush’s manifest foreign policy failings, he consistently upheld the distinction between the religion of Islam and terrorists who murder in its name. Compare that to Rubio, who has picked up the bad habit common to post-Bush Republicans of speaking much less precisely and responsibly about the supposedly severe danger that Muslims pose to the United States. Rubio has even suggested that the federal government should shut down any place that Muslims gather to be “inspired,” including mosques — a move that would place Rubio on a collision course with several clauses of the First Amendment.
Rubio resembled Bush most closely in the months following the 2012 presidential election, when the junior senator from Florida took on a leadership role in the Senate’s efforts to revive a failed initiative of W’s second term — a reform of the nation’s immigration laws, including a push to devise a path to citizenship for undocumented immigrants. The reform effort failed, and his role in it is now widely presumed to be Rubio’s greatest electoral liability. (Sort of like how the rightward listing GOP treated Mitt Romney’s signature achievement as governor of Massachusetts as a potentially fatal electoral defect during his 2012 presidential campaign.) The result? On immigration, too, Rubio now finds himself far to Bush’s right, railing about the need to close and seal the nation’s southern border before even beginning to talk about any other kind of reform.
The lesson? Don’t oppose Rubio because his presidency would amount to a third term for George W. Bush. Do it because a Rubio presidency would be a whole lot worse.

“Just Get Out Of My Way”: This Progressive Doesn’t Need Your Lectures
Have I mentioned lately how much I’m enjoying the lectures from self-avowed liberals who insist my respect for Hillary Clinton is proof that I am not a “real progressive”?
I haven’t had this much fun since I had my sinuses packed with 40 miles of gauze after polyp surgery.
It’s not just men — my sisters, you disappoint me — but it’s particularly entertaining when the reprimands come from young white men who were still braying for their blankies when I started getting paid to give my opinion. They popped out special, I guess.
I became a columnist in the fall of 2002. Immediately, I found myself on the receiving end of right-wing vitriol so vile it made “The Sopranos” cuddly by comparison. My first death threats came within weeks, after I wrote that the Confederate flag should be retired. After I supported stronger gun control measures, an NRA zealot posted on a gun blog what he thought was my home address and identified me as “unarmed.” I was a single mother at the time. I bought new locks and kept writing. But by all means, do tell me what I don’t understand about being a progressive.
First, though, let me tell you what you clearly don’t understand about me — I almost added, “and women like me,” but that would be presuming to speak for other women, which would make me sound just like you.
I am a 58-year-old wife, mother and grandmother, who first knew I was a feminist at 17. I was a waitress at a family restaurant and a local banker thought he could stick his hand up my skirt because my hands were full of dinner. In the time it took me to deposit that steaming pile of pasta onto his lap, I realized I was never going to be that girl.
Like so many other women, I soon learned that knowing who you are is no small victory, but making it clear to the rest of the world is one of the hardest and longest nonpaying jobs a woman will ever have. I’ll spare you my personal list of jobs with unequal pay and unwelcome advances. No good comes from leading with our injuries.
It helped — it still helps — that my working-class parents raised me to be ready for the fight. My father was a union utility worker, my mother a nurse’s aide. Both of them died in their 60s, living just long enough to see all of their children graduate from college and start their lives. I’ve said many times that my parents did the kind of work that wore their bodies out so that we would never have to. That, too, is my legacy.
But, please, tell me again how I don’t know what it means to be a progressive.
Last month, I started teaching journalism at Kent State University. One of the first things I did was to lug to my office the large metal sign that used to hang over the tool shed at my father’s plant. “THE BEST SAFETY DEVICE IS A CAREFUL MAN,” it reads. Nice try, management.
I’m stickin’ with the union, Woody Guthrie sang.
Every time I walk into my office, that sign is the first thing I see. Remember, it whispers.
What does any of this have to do with why I admire Hillary Clinton? Nothing. But it has everything to do with why I don’t need any lecture from somebody who thinks he or she is going to tell me who I am because I do.
One of the hallmarks of a progressive is a willingness to challenge a power structure that leaves too many people looking up and seeing the bottom of a boot. I want power for the people who don’t have it. And for the rest of my conscious days, I will do my small part to help get it. I love it when detractors describe Clinton as too angry and not “warm and fuzzy” enough. I want a leader, not a Pooh Bear.
I don’t want to diminish anyone who supports Bernie Sanders. I’m married to Sanders’ colleague, Sen. Sherrod Brown, which is how I’ve gotten to know him over the last 10 years. He’s a good man.
If you support Sanders in this Democratic presidential primary, I don’t assume that you hate women.
See how that works?
But if you tell me that, should Sanders lose, you won’t vote for Hillary Clinton, then stop calling yourself a liberal or a progressive or anything other than someone invested in just getting your way.
There is so much at stake here. The fight for women’s reproductive rights is not a sporting event. Our cities are rife with racial tensions, and too many of us white Americans fail to see this as our problem, too. The Affordable Care Act is not enough, but it is the first fragile step toward universal health care. It is already saving lives of people who had nothing — no health care, no safety net, nothing — before it passed.
Finally, the growing gulf between the obscenely privileged and everyone else is a reason to get out of bed every morning — if we care about the future of the people we are supposed to be fighting for.
If you would sacrifice those who need us most because you didn’t get your way, then please, save me your lectures and get out of my way.

“Utopian Fantasy?”: Bernie Sanders’s Single-Payer Health Care Plan Failed In Vermont
When Sen. Bernie Sanders regales his campaign crowds with a portrait of The Way Things Are Going to Be, his “Medicare for All” program takes center stage. In a Sanders administration, the candidate promises, every man, woman, and child in America will share in a government-run, government-funded health-care system.
But the single-payer system that Sanders is evangelizing isn’t just a figment of progressive utopian fantasies. Single-payer health care has already been tried—and failed—in Sanders’s home state of Vermont, where the proposal collapsed under its own weight last year before it was ever implemented.
Deciding why it failed in Vermont is key to whether you buy into the candidate’s promise to extend the program nationwide.
According to critics, from The New York Times’ Paul Krugman to USA Today’s editorial board, Sanders’s single-payer plan is something between a well-intentioned fool’s errand and a political pipe dream, an unrealistic idea that has been proven not to work in the senator’s own backyard.
But closer to home, activists say Vermont’s failure even to implement its plan for universal health care was a failing of political will, not the policy itself. In better hands, they say, the policy can still work. To know the difference, it’s important to understand how Vermont got so close to single-payer in the first place.
In 2011, the state’s Democrat-controlled legislature approved a government-run, government-financed health-care system for all Vermonters. The state’s new Democratic governor, Peter Shumlin, signed the bill into law after campaigning on a pledge to enact single-payer himself. A cost estimate of the program, known as Green Mountain Care, was ordered, but long delayed.
Elections came and went, including Shumlin’s own 2014 reelection, which was so close Vermont law required the final decision to go to the legislature after Shumlin failed to win a majority of the vote in November. As the state waited for the legislature to take up the election results, Shumlin announced that he would not pursue single payer after all when the long-awaited financial projections showed “the promise and the peril” of a single-payer system. The promise, of course, was a chance to give nearly every Vermonter reliable access to quality health care.
But the very real peril came in the cost for the program, an estimated $4.3 billion a year, almost the size of the state’s entire $4.9 billion budget. To make up for the $2 billion shortfall, taxes would have to go up, a lot. Businesses would see an 11.5 percent payroll tax increase, on top of whatever they chose to provide for employee health care, while individual income taxes could jump by up to 9 percent. The report recommended against moving forward “due to the economic shock and transition issues,” and Shumlin agreed.
“I wanted to fix this at the state level. And I thought we could,” Shumlin said in a statement issued with the financial report. But he called implementing single-payer health care in 2015 “unwise and untenable.”
Despite the ominous budget projections at the time, single-payer advocates now say they believe Shumlin’s decision was purely political.
“Right up to the last gubernatorial election, Gov. Shumlin was saying he was going to do everything he could to make single-payer health care a reality in the state. That was quite frankly why we didn’t run a candidate against him,” said Kelly Mangan, the executive director of the Vermont Progressive Party. “Almost immediately, he turned around and said, ‘Oh, yeah, we can’t afford single-payer health care. It’s not going to happen.”
Mangan described single-payer advocates today as “fatigued and very disheartened.” As Vermont’s state budget continues to be squeezed by Medicaid costs, she said the possibility of returning to the issue any time soon seems unlikely. She also worries that Vermont’s example will damage future prospects nationally. “I think it will have a ripple effect. People will use it as an excuse to do nothing by saying, ‘If they couldn’t do it there, then it can’t be done,’” she said.
Dr. Gerald Friedman, an economics professor at UMass-Amherst and a part-time Vermonter, has worked with Sanders to develop and calculate the cost of his plan and says the budget wasn’t the problem for the Vermont proposal. The governor was the problem.
“On the economics, it would have been cheaper, but the governor just lost the political will,” Friedman said.
But the professor acknowledged that any national health care proposal from Sanders would face the same political headwinds that Shumlin ran into. “It’s going to be a tough road, and Vermont is a lesson,” he said. “It’s unfortunate that it happened the way it did.”
Even with the Vermont debacle in the rearview mirror and Friedman’s own projections that Sanders’s “Medicare for All” would cost north of $14 trillion over 10 years, the politics of single-payer are still working for Sanders. The latest Kaiser poll showed 81 percent of Democrats favor a “Medicare for All” proposal, while 60 percent of independents favor it, too.
Clinton has dismissed Sanders’s proposal as unrealistic and a danger to the reforms that have already been enacted through the Affordable Care Act. That argument seems to be falling flat in New Hampshire, where the latest WMUR poll showed Sanders trouncing Clinton by nearly 30 points. But at least Clinton can count on some support when the campaign gets to Vermont. Gov. Shumlin, who will not run for reelection, has announced he’s with her.
