“Chief Justice John Roberts Just Isn’t Far Enough To The Right”: When Even Conservative Justices Aren’t Conservative Enough

Over the weekend, Sen. Ted Cruz (R-Texas) added a new line of attack to his offensive against his party’s Beltway establishment: the Republican presidential hopeful insisted that Supreme Court Chief Justice John Roberts just isn’t far enough to the right.

In fact, the GOP senator, who was an enthusiastic Roberts booster in 2005, even criticized former President George W. Bush for his reluctance to “spend some political capital” in support of a genuinely right-wing nominee.

Jeb Bush was asked in last night’s debate whether Cruz was right, and though the former governor’s answer meandered a bit, Bush suggested he’d nominate different kinds of justices than his brother: “Roberts has made some really good decisions, for sure, but he did not have a proven, extensive record that would have made the clarity the important thing, and that’s what we need to do. And I’m willing to fight for those nominees to make sure that they get passed. You can’t do it the politically expedient way anymore.”

Cruz added in response:

“I’ve known John Roberts for 20 years, he’s amazingly talented lawyer, but, yes, it was a mistake when he was appointed to the Supreme Court. […]

 “It is true that after George W. Bush nominated John Roberts, I supported his confirmation. That was a mistake and I regret that. I wouldn’t have nominated John Roberts.”

Watching this unfold last night, some viewers might have been left with the impression that Chief Justice Roberts is, well, retired Justice David Souter. One President Bush nominated a jurist who seemed conservative enough, but who turned out to approach the law from a center-left perspective, and then another President Bush did the same thing.

Except, that’s not even close to being true.

When Cruz and others on the right complain bitterly about Roberts, they’re generally referring to the justice’s rulings on the Affordable Care Act. But the fact remains that both of the major “Obamacare” rulings were genuinely ridiculous cases – and it’s not Roberts’ fault that he took the law, court precedent, and common sense seriously.

Health care cases notwithstanding, though, Roberts is not a moderate by any fair measurement. We are, after all, talking about a court that handed down the Citizens United ruling. And then later gutted the Voting Rights Act. Roberts didn’t even support marriage equality.

Souter he isn’t.

If Roberts isn’t radical enough for Cruz, who exactly would the Texas Republican like to see on the court? Three times last night he mentioned Judge Edith Jones of the 5th Circuit Court of Appeals. Given Jones’ jaw-dropping record, that tells us an awful lot about Cruz.

“Obama Has Plenty Of Reasons To Smile”: A Useful Reminder That There Is No Such Thing As The “Twilight” Of A Presidency

Attention has been focused on who becomes our next president, but meanwhile the incumbent is on quite a roll.

Throughout his tour of Alaska, President Obama looked full of his old swagger. He took a photo of Denali — the former Mount McKinley — through a window of Air Force One and shared it via Instagram. He used melting glaciers as a backdrop to talk about climate change, posed with small children and large fish, and became the first sitting president to venture north of the Arctic Circle.

He seemed to smile throughout the trip, and why not? The nuclear agreement that Secretary of State John F. Kerry negotiated with Iran is now safe from congressional meddling. U.S. economic growth for the second quarter was a healthy 3.7 percent. Unemployment has fallen to 5.1 percent, according to figures released Friday. Saudi King Salman — portrayed by Obama’s critics as peeved with the president — dropped by the White House on Friday for a chat, reportedly renting an entire luxury hotel for his entourage. And this month, Chinese President Xi Jinping is scheduled to arrive for what promises to be the most important state visit of the year.

Obama gives the impression of having rediscovered the joy of being president. Maybe he really needed that Martha’s Vineyard vacation. Or maybe he is beginning to see some of his long-term policies finally bearing fruit — and his legacy being cemented.

Watching him now is a useful reminder that there is no such thing as the “twilight” of a presidency. Until the day his successor takes office, Obama will be the leading actor on the biggest and most important stage in the world.

It is useful to recall that George W. Bush practically had one foot out the door when the financial system threatened to collapse in 2008. It was Bush and his advisers who put together a massive $700 billion bank bailout and managed to sell it to Congress. Bush signed the rescue bill into law on Oct. 3 — barely a month before his successor would be chosen.

The banks were saved, but nothing could stop the economy from falling into its worst slump since the Great Depression. I believe historians will conclude that one of Obama’s greatest accomplishments was bringing the economy back to real growth and something close to full employment — more slowly than Americans may have wished, perhaps, but steadily.

The Iran deal, in my view, is another remarkable achievement. Beyond the fact that it definitively keeps Tehran from building a nuclear weapon for at least 15 years, the agreement offers Iran’s leaders a path toward renewed membership in the community of nations. The mullahs may decide to remain defiant and isolated, but at least they now have a choice.

Obama’s White House has often been clumsy at inside-the-Beltway politics, but the handling of the Iran deal has been adroit. The drip-drip-drip of announcements from Democratic senators who favor the agreement has created a sense of momentum and inevitability. Now Obama knows that if Congress passes a measure rejecting the deal, he can veto it without fear of being overridden. The question, in fact, is whether a resolution of disapproval can even make it through the Senate. If Obama convinces 41 senators to filibuster the measure, it dies.

All is not sweetness and light, of course. The Syrian civil war is a humanitarian disaster of enormous and tragic proportions, as evidenced by the heartbreaking refugee crisis in Europe. I don’t believe there is anything the United States could have done to prevent the war, but all nations bear a responsibility to help ease the suffering. The fact that some nations refuse to do their share does not absolve us from doing ours.

Domestically, the good economic numbers ignore the fact that middle-class incomes remain stagnant. Even without healthy wage growth, an economic recovery feels better than a slump — but only in relative terms. One doesn’t hear people breaking into “Happy Days Are Here Again.”

All in all, though, it looks like a good time to be President Obama. The Affordable Care Act, as he had hoped, is by now so well-established that no Republican successor could easily eliminate it. Industries are already making plans to accommodate new restrictions on carbon emissions. Oh, and despite what you hear from all the Republican candidates, the border with Mexico is more secure than ever before.

Obama’s legacy will have a few blemishes. But he has good reason to smile.

“The Equivalent Of Thinking The Iraq War Would Be A Cakewalk”: Why The GOP Presidential Candidates Can’t Reform Health Care

In the last few days, Scott Walker and Marco Rubio released health care plans, and other Republican candidates are sure to follow soon. Most will probably be pretty similar, even if some are more fully fleshed out than others.

But they’ll all share one feature, the thing that tells you that they aren’t even remotely serious about this issue: they will take as their starting point that the entire Affordable Care Act should be repealed.

I say that that shows they aren’t serious not because I think the ACA has done a great deal of good, though I do think that. I say it because it shows that they’re completely unwilling to grapple with both the health care system as it exists today, and how incredibly disruptive the wholesale changes they’re proposing would be. Walker’s plan even says, “unlike the disruption caused by ObamaCare, my plan would allow for a smooth, easy transition into a better health care system.” This is the health care equivalent of thinking the Iraq War would be a cakewalk.

The reality is that repealing the ACA now that it has been implemented would mean a complete and utter transformation of American health care. Republicans have often lamented that the law was so terribly long and included many different rules and regulations — yet now they act as though the law amounts to just a couple of rules here and there that can therefore be tossed out without too much trouble. But they were right the first time: the law is indeed complex, and has brought hundreds of changes big and small to American health care, not just in how people get insurance but in how Medicare and Medicaid work, how doctors and hospitals are paid, and in all sorts of other areas.

The ACA established health care exchanges. It brought millions of people into Medicaid, it closed the Medicare prescription drug “doughnut hole.” It gave subsidies to small businesses. It funded pilot projects to explore new means of providing and paying for care, it imposed new regulations on insurance companies. It created new wellness and preventive care programs, it provided new funding for community health centers. It did all that, and much more. You can argue that each one of these was a good or a bad idea, but you can’t pretend that unwinding them all would be anything resembling a “smooth, easy transition.”

We know why every Republican health care plan has to start with repealing the ACA: politics. Republicans have spent the last five years telling their constituents that they’re going to repeal it any day now, and they’ve held over 50 repeal votes in Congress. They’ve refused to admit that a word of it has any merit, even as they try to incorporate some of its more popular reforms (like protections for people with pre-existing conditions) into their own plans. So they’ve backed themselves into a corner where whatever any Republican offers has to start with repeal.

Which is why all their plans, the ones that have been released and the ones yet to come, are absurdly unrealistic. They pretend that it will be no problem to completely transform the American health care system — and there will be no losers in such a transformation, only winners — which shows that they have no intention of actually doing so. In fact, I’d go so far as to say that if a Republican gets elected next November, he’ll be relieved when his health care plan dies in Congress.

Let’s contrast that with how Democrats acted in 2008, when there was a vigorous debate in the presidential primary over health care. The three leading candidates, Barack Obama, Hillary Clinton, and John Edwards, all had very similar plans, similar because they reflected the Democratic consensus on health care reform that had evolved in the decade and a half since Bill Clinton’s reform effort failed. One major disagreement was over whether there had to be an individual mandate — Clinton’s plan had one, and Obama’s didn’t — but when he took office, Obama accepted that the mandate was necessary to make the entire plan work. It wasn’t a fantasy plan that just pandered to liberal hopes, it was something that could actually pass and be implemented.

Whenever liberals told Obama that a single-payer health plan would be far superior to what he was proposing, he would respond that if we were starting from scratch, that would probably be true. But, he’d say, we aren’t starting from scratch, so the ACA has to accommodate itself to the health care system that already exists. The result was a gigantic kludge, new complexity layered on top of an already complex system in an attempt to solve its varied shortcomings. Like all kludges, it seemed like the realistic option given the situation we confronted, but it left us with something that was far from perfect.

A Republican who actually wanted to pass real health care reform would have to approach the problem the same way: by saying that for better or worse, the Affordable Care Act has already affected the system in profound ways, so any realistic plan has to understand what those changes are, and find the most efficient way to keep the ones that are working and change the ones that aren’t. That doesn’t mean that repeal is impossible, just that it would be a spectacular upheaval, one that I promise you Republicans have no genuine appetite for. Remember all the screaming and shouting they did over the people on the individual market whose previous plans didn’t qualify under the new regulations, and who had to shop for new plans? Multiply that by ten or twenty times, because that’s how many people would likely lose their existing coverage if you repealed the ACA in one fell swoop.

And that would be only the beginning. So when any Republican candidate says he or she has a plan to reform health care, take a close look. If it starts with repealing the ACA — and it will — then you’ll know it isn’t serious and it’s never going to happen.

“Another Shutdown Psychodrama”: Why The GOP’s Threat To Shut Down The Government Over Planned Parenthood Will Fail

So here we are again: Republicans want to make a policy change, but since doing so will be difficult through the ordinary legislative process, they are threatening to shut down the government to get what they want.

This time it’s about Planned Parenthood, long a target of conservative loathing. Galvanized by selectively edited videos made by conservative activists trying to make it seem as though the organization is profiting from the sale of fetal tissue, Republicans in Congress are now trying (as they have before) to “defund” Planned Parenthood. The White House says it will veto any budget bill that does that.

In response, at least some conservatives have reverted to a time-worn tactic: Shutdown! Ted Cruz says if that is what it takes to eliminate funding for Planned Parenthood, so be it. Some of his allies in the House seem to agree. Conservative pundit Erick Erickson demands, “If Republicans are not willing to make this their hill to die on…the Republican Party needs to be shut down.”

For the record, most of the money Planned Parenthood receives from the federal government comes from reimbursement for health care services through Medicaid. Precisely zero goes to abortion services; by law, no federal funds can go to abortions. So when Republicans say they want to “defund” Planned Parenthood, what they’re talking about is taking away medical services — breast cancer screenings and the like — from poor women.

I’m not going to go too deeply into the videos, other than to say that nothing in them shows that the organization did anything illegal. The worst anyone has been able to say is that the “tone” used by Planned Parenthood officials was callous. You can object to fetal tissue research if you like, even though it’s done with the consent of patients and can yield valuable medical insights, but there’s no evidence that Planned Parenthood isn’t complying with the laws that cover how that tissue can be used.

Until Barack Obama became president, most government shutdowns happened for one reason: because Congress and the president couldn’t agree on a budget. Sometimes the issues were broad, like cuts to domestic spending, and sometimes they were more specific. But they were usually connected in some rational way to the perceived necessity for a shutdown, in that there was disagreement on how to spend the money that will keep the government operating.

But Republicans in the Obama era have been nothing if not creative thinkers when it comes to policy procedures and norms. And in this area, their innovation was to say, “We have a policy disagreement with the other side, but we can’t get our way through the normal channels. So how about if we shut down the government until we get what we want?”

There’s one important fact about this threat that you’d think Republicans would have learned by now: It always fails. The public doesn’t rally around the shutdowners’ cause, because it violates a basic sense of how policy-making ought to operate. Congress can bicker and fight, but the way it makes decisions is that legislators vote on things, and the side with more votes wins (except for proposals that are filibustered, but that’s a different story), subject to the presidential veto. If you lose through that process, you’ve lost, period. Even if you were right on the merits, the system’s rules are longstanding and familiar enough that they seem fair, since everyone understands the rules and agrees to live under them.

But relying on a shutdown is like a baseball team that’s trailing at the start of the ninth inning, so they hide all the balls and say they won’t return them until they’re declared the victor. It just doesn’t seem right.

And it isn’t just that Republicans can’t get enough public support for the shutdowns — more importantly, they don’t actually get what they want. In 2013, they shut down the government in an attempt to repeal the Affordable Care Act. The Affordable Care Act, you may have noticed, is still around. In 2014, they nearly shut down the government in an attempt to stop Obama’s executive actions on immigration. That failed there, too (though some of those actions have been held up in the courts).

It should be noted that the congressional GOP leadership is smart enough to say they’re not interested in another shutdown psychodrama. But if they’re in a tough spot, besieged by their more conservative members — not to mention outside groups and pundits — there’s no denying the part they’ve played in making this a regular demand of conservatives. It was the congressional leaders who devised the strategy of opposing Barack Obama on everything and filibustering every bill of any consequence. They’ve happily gone along with the hysteria on the right that says that Obama isn’t just a president they disagree with, but an enemy of America who seeks to destroy everything we hold dear. They’ve encouraged the belief that compromise is always, and by definition, an act of betrayal.

Given all that, is it any surprise that whenever a new issue comes up, at least some on the right think it’s a hill worth dying on? Shutting down the government might be doomed to fail, but I suppose it feels like fighting.

“Expand Medicare, You Damn Idiots”: On Its Anniversary, We’re Going To Start Hearing The Usual Attacks On Medicare

Every so often—okay, not very often actually, but more often than I hunt, or “take” (what a verb!), lions—I feel a little wistful about the Republican Party we all once knew. And that feeling is never stronger than when I reflect on the history of Medicare and Medicaid, which I spent part of yesterday doing, what with it being the 50th anniversary of the passage of the bill and all.

Lyndon Johnson went into the 1964 election knowing that he wanted to pass a universal health-care bill. He figured he couldn’t get full-bore socialized medicine, so he settled on socialized medicine for old people, reckoning that was a winner. Immediately upon winning election, he directed aides to get cracking, saying as I recall something to the effect that he was going to lose a little political capital every day, so the sooner the better.

It was big and messy and complicated, just like Obamacare, and frankly, Johnson lied about the cost, back in those pre-Congressional Budget Office days. But it passed, and it passed in a way that wasn’t just like Obamacare at all. Thirteen Republican senators voted for it, and 17 against; and in the House, 70 Republicans supported it, while 68 voted no. In other words, almost exactly half of all voting congressional Republicans, 83 out of 168, voted for the program that Ronald Reagan at the time was warning heralded the arrival of Marxism on our shores.

Pretty different GOP, eh? Well, now check out the numbers from 1983. This was, to be sure, more of a compromise piece of legislation. The Social Security Trust fund was in trouble at the time, so the 1983 amendments raised the payroll tax while increasing the retirement age to 67 for those born in 1960 or after, with the new revenue going to Medicare and Social Security. And of course you had a Republican president then, and not just any Republican president; so if Ronald Reagan was okay with a tax increase, they were, too. It passed both chambers overwhelmingly; House Republicans backed the 1983 changes 97-69, while Republican senators supported them by 47-6. (PDF)

It’s worth recalling all this on the anniversary of this great law because soon enough, we’re going to start hearing the usual attacks on Medicare. Wait, did I say soon enough? We already are! And not from the wingnut caucus. It was the, uh, moderate, Jeb Bush, who said just last week that Medicare is “an actuarially unsound system” and that “we need to figure out a way to phase out this program.”

All right. Now I’ll grant that times have changed since 1965 and 1983, and that we’re going to see all those Baby Boomers retire in the coming years. But let’s be clear about a central fact. The Medicare Trust Fund is not in big trouble right now. A few years ago, it was; there were desperate predictions that it was going to go broke in five years, three. I remember 2017 being mentioned as the ominous year, and 2017 is pretty close.

But that has changed. Now, the experts say Medicare is stable until 2030. Now 2030 isn’t infinity and beyond, but it’s not tomorrow either. The crisis has eased, and it has eased considerably.

What changed? Some of the reasons are just too wonky for me to go into with you in any detail, having to do with things like new strategies to reduce preventable hospital admissions. But another seems to be…wait for it…Obamacare. Ever since the passage of the Affordable Care Act, per-enrollee Medicare costs have decreased a little and are rising more slowly than overall health-care costs, and somehow or another the Medicare trustees have added 13 years to the program’s solvency.

In fact, let’s go mildly wonky here. This is worth knowing. Before the ACA passed, projections of Medicare bankruptcy were pegged, as noted, at 2017. Then shortly after the ACA became law, that was pushed to 2024. Then in 2013, it was nudged to 2026. Now it’s at 2030. See a pattern here? The main reason is simple. Overall spending is lower. You might remember Mitt Romney’s famous attacks on Obama for cutting $716 billion from Medicare, which took some cheek given that a) Republicans’ own projected cuts under Paul Ryan’s budget were far more severe and b) Ryan and other Republicans used the same budgetary assumptions Obama used for all their Medicare “reform” plans.

Just remember all this, will you, as you hear more from the Republicans on this topic. They are all going to say: Medicare is a disaster; it’s broke; Obamacare has made it far worse. They’ll say things that one can hardly believe can be said by a person we’re allegedly supposed to be taking seriously, like Marco Rubio’s amazing comment that Social Security and Medicare “weakened us as a people.”

None of what they say will be true. But they’ll say it and say it, and the conservative media will repeat it and repeat it, and we’ll be in that “no, the sky is green and the grass is blue” territory that we know so well. And of course, their “reform” plans are, aside from being just mean, a total fantasy. The way Medicare works is so complicated and so embedded into our national life that the disruptions to doctors and hospitals and service providers of all kinds would be horrific. Only rich people, who don’t really need Medicare, and ideologues, who despise it, think you can do this. They might as well propose rerouting every single Interstate highway in America.

But most of all, it doesn’t need changing. Or actually it does, but in the direction of being expanded, as Bernie Sanders says. That’s probably not in the cards for the foreseeable future, although it will certainly come one day, perhaps by the time of Medicare’s own 65th birthday, when the people will surely be due for another “weakening.”
