“Miscreants Escaping Accountability”: The Senate Torture Report; Crimes Without Punishment

With the release of the Senate Select Committee on Intelligence report on the use of torture by the Central Intelligence Agency after 9/11, the final defense of the indefensible by its perpetrators, advocates, and publicists is falling apart before our eyes.

Not only did “enhanced interrogation,” the Nazi euphemism adopted by the Bush-Cheney administration, employ methods outlawed and prosecuted by our country for more than a century, such as waterboarding; and not only did those “activities,” as Dick Cheney called them, violate American law, the Constitution, the Geneva Conventions, and the conventions on torture; but we now know with great certainty that the agency executed this secret program with horrific incompetence — and that it produced nothing of significant value.

Indeed, the Senate Intelligence report concludes, contrary to the boasting of Cheney and many others, that torture was proved “not an effective means of gathering intelligence,” let alone saving millions of Americans from jihadi plots, and actually “complicated and in some cases impeded the national security missions.” The overseers of the torture program, themselves of dubious competence, were unable even to assess the impact or effectiveness of their orders.

As Micah Zenko of the Council on Foreign Relations points out, the CIA itself has admitted, in its otherwise aggressive response to the SSCI, that it lacked the “structure, expertise, and methodologies” to “systematically evaluate the effectiveness of our covert programs. They literally didn’t know what they were doing. But they were doing grave damage to themselves and to us.

Unavoidably, the Senate Intelligence report dwells on the details of these true nightmares, revealing facts that anyone would regret learning: the “rectal rehydration” of detainees by shoving food up the wrong way, with the infliction of excruciating pain; the “black sites” where detainees were held for months in total darkness, loud music constantly playing, and only a bucket for their waste; the cells where detainees suffered such freezing temperatures that at least one died of hypothermia overnight; the beatings, the near-drownings, the constant infliction of pain, hunger, and threats of rape and murder.

According to the report, some episodes of interrogation were so blatantly sadistic and so obviously criminal that the men who witnessed them actually wept. More than one officer broke down and fled, through retirement or transfer, while the White House and the Pentagon continued to lie about the extent – and the supposed necessity – of these unprecedented crimes. Those lies were designed to prevent investigations or oversight from revealing the horrific facts that are now emerging.

Yet despite a long and ongoing cover-up –and notwithstanding the specific revelations highlighted in the report – the basic outline has been known since 2009, when portions of the CIA inspector general’s report on torture were released by the Obama Justice Department in 2009.

Back then, the spy agency’s own investigation – in the words of a Bush appointee and torture enthusiast — “[found it] difficult to determine conclusively whether interrogations have provided information critical to interdicting specific imminent attacks.” In other words, the agency could never prove any instance when the sole justification for these gross violations of US and international law – breaking up a plot targeting American lives – had been fulfilled since 9/11. And unsurprisingly, that is still the case.

The searing issue we now confront, as a society governed by law, is that these lawbreakers will not be prosecuted or even required to testify publicly about their grave offenses. The Obama administration is apparently willing to expose their lawlessness, but unable to do anything to punish it. Even the executive director of the American Civil Liberties Union, Anthony Romero, has abandoned any hope of prosecutions, noting that the torturers have in effect been pardoned. Romero has urged President Obama to make those pardons official – which would at least stamp the actions of the torturers and their accomplices as crimes.

What we have needed for years, but evidently will never get, is a truth and reconciliation process that might have granted freedom from prosecution to witnesses who testified publicly, honestly, and completely about the crimes of the Bush administration. Instead, those miscreants will escape accountability altogether – except in the pages of history, where the Senate Intelligence report will indict them over and over again.

“Congratulations Mitch”: The New Cruzians Are Ready To Make Life Hell For Mitch McConnell

Congratulations, Mitch McConnell! You now have the hardest job in Washington.

That dubious distinction used to belong to belong to House Speaker John Boehner, who has struggled since 2011 to manage a GOP majority so unwieldy he called it everything from “frogs in a wheelbarrow” to the “knucklehead” caucus.

But as the incoming Senate majority leader, it will now fall to McConnell to receive legislation from the House, shepherd it past his 53-member majority, and deliver completed bills to the president, all while keeping the government open for business.

McConnell’s difficult job will be made enormously more complicated by the makeup of his incoming three-seat majority. It includes at least three senators eyeing a run for president (Ted Cruz, Marco Rubio, and Rand Paul), and 11 new Republican members, three of whom have been pegged by grassroots activists as the conservative cavalry riding in as reinforcements for the Cruz wing of the party.

Those senators—Joni Ernst of Iowa, Tom Cotton of Arkansas, and Ben Sasse from Nebraska—were all breakout stars for activists in the 2014 cycle. They raked in millions of dollars from outside groups like the Senate Conservatives Fund, and are the three that conservatives like Steve Deace, the nationally syndicated conservative radio host from Iowa, say they expect the most from.

“What I heard from conservatives I talked to around the country during the election was ‘Who is going to go there and help out Cruz and [Sen. Mike] Lee? Who is going to help out the wacko birds?’” said Deace, referring to the derisive term Sen. John McCain once used to describe Cruz that conservatives now wear as a badge of honor. “Our expectation is that [Ernst, Cotton and Sasse] are going to join the ranks of the wacko birds. That’s our expectation.”

Deace and his listeners won’t be the only ones looking to the trio to for results. So will conservative donors. The Senate Conservatives Fund and its affiliate Senate Conservatives Action, for example, plowed millions into the Iowa, Nebraska and Arkansas races. Ernst received nearly $450,000 in bundled contributions and $475,000 in independent expenditures from the groups for her race. Sasse got $487,000 in bundled contributions and more than $835,000 in outside expenditures in his GOP primary. Cotton picked up about $200,000 in bundled SCF money and saw more than $500,000 in outside SCF money in his race against Democratic Sen. Mark Pryor.

Another major conservative group, Club for Growth Action, poured more than $800,000 into Cotton’s race against Pryor, about $500,000 against Sasse’s primary opponents, and another $297,151 and $186,587 in bundled donations for Cotton and Sasse, respectively.

The first place conservatives will look to the new freshmen to make their voices heard is on immigration, which Ernst and SCF both call “executive amnesty.” The president has indicated he’ll soon take sweeping unilateral action, a move McConnell said won’t draw him into a government shutdown fight when he takes over the majority.

“There won’t be a government shutdown,” McConnell pledged Thursday, a commitment that left conservatives livid.

“Mitch McConnell is making promises he can’t keep,” Deace said. “Whatever enjoyment McConnell got out of being elected leader, enjoy it. Because from this point forward, power is going to be leaving his hands.”

Jim Manley, a former top aide to Senate Majority Leader Harry Reid, predicted that McConnell and the Republicans will safely navigate the lame-duck session, but once the new senators are sworn in, “All bets are off.”

“Sen. McConnell has got a whole bunch of people in his caucus, including those up in 2016, who realize the current strategy [of obstruction] is not going to work, and they need to put some legislative points on the scoreboard,” Manley said. “But whether that’s going to play out remains to be seen, in part because there are three Republicans running for president, none of whom care much about the Senate as an institution nor about their other colleagues’ views, quite frankly. And there are a handful of incoming senators who are very, very conservative.”

But Ron Bonjean, who was a senior staffer to Sen. Trent Lott when he was majority leader, said McConnell not only will have to consider the instincts of conservatives during those votes, but also the needs of several Republicans like Pat Toomey, who is up for reelection in 2016 the blue state of Pennsylvania.

“I do think McConnell knows how to manage his caucus,” Bonjean said. “While there will definitely be turbulence because he has more members to deal with, there are also some other dynamics at play for some of these members.”

Bonjean predicted that like Boehner, McConnell will need to have a majority of his majority on board to get a bill to the floor, but also will have to make the bills bipartisan enough to avoid a Democratic filibuster.

“Here’s the problem: Even if McConnell has all 53 Republicans, he’s got to get to 60 votes,” Bonjean said. “That’s very difficult to do, so they’re going to have to go for bipartisan victories to begin with, low-hanging fruit that can move through the Senate to show that they can get the work done.”

But low-hanging, bipartisan bills are exactly what Cruz and the grassroots conservatives backing Ernst, Sasse, and Cotton say they don’t want, especially in the face of an Obama executive order.

“I took an hour of calls yesterday asking what Congress should do if the president acts alone on immigration,” Deace said. “Every call, all over the country, men and women, all said the same thing: Impeach him.”

“The GOP Didn’t Deserve To Win”: Congressional Republicans’ Behavior Over The Last Four Years Deserved No Reward

Voters on Tuesday gave Republicans control of the Senate. But the GOP did not earn this victory.

That’s not because Senate Democrats, led by Majority Leader Harry M. Reid (D-Nev.), deserved to win in the GOP’s stead, and it’s not because this country can do without a sensibly conservative party. It is because the GOP has not been a sensibly conservative party. Congressional Republicans’ behavior over the last four years deserved no reward.

This is the party that repeatedly used the country’s full faith and credit as a bargaining chip during successive, manufactured budget crises.

This is the party that still cannot bring itself to admit that climate change is a risk that deserves a serious response.

This is the party that scuttled even modest immigration reform because elements of the GOP base will label seemingly any viable bill “amnesty.”

This is the party whose leaders resist bringing broadly popular bills up for an up-or-down vote because its right fringe is in constant preparation to stage a revolt.

This is the party so in thrall to comical anti-government activists that it treated simple lightbulb efficiency standards as severe attacks on personal liberty.

This is the party that voted dozens of times to dismantle Affordable Care Act — but never united behind a credible, or even a non-credible, alternative, despite promising for years to offer one.

This is the party that took its fixation with Obamacare so far that it shut down the government in a bizarre political tantrum.

This is the party that has styled its refusal to compromise as a virtue rather than as a pernicious insult to responsible leadership.

Unsurprisingly, exit polls showed little regard for the GOP. It is a measure of midterm voters’ dissatisfaction with the state of the country, President Obama and feckless Democratic candidates that they held their noses and empowered Republicans. The results also fit into a broader trend of red states becoming redder. Yet Republicans — and Democrats — might also take the message that reckless, shortsighted, counterproductive behavior makes for good politics — better, in fact, than having actual results to run on. If fully internalized, that lesson would shut down Congress most of the time.

With President Obama still in office, it is up to Republican leaders to conclude that voters outside the hardcore GOP base did not demand more pettiness in this year’s midterm elections. Among other things, they will have to reign in hectoring partisans such as Sen. Ted Cruz (R-Texas), the architect of the shutdown who, on CNN Tuesday night, argued that Washington can compromise over the next two years — if you define compromise as doing exactly what Republicans want.

And if GOP leaders fail at that, it will be up to voters to give them what they really deserve.

“Theatrical Posturing, Not Much Lawmaking”: What We Talk About When We Talk About A Republican Senate

Presuming we have a Republican Congress next year, there’s going to be a lot of talk right after the election about what that will change 1) politically and 2) substantively. While I’m ordinarily an advocate of more substantive discussion and less political discussion (not that I have a problem with political discussion, since I do plenty of it myself, it’s just that it should be leavened with consideration of the things that actually matter), there’s a potential problem in the substantive discussion that I think we should be on the lookout for.

For instance, this morning on the radio I heard some energy expert whose name I didn’t catch say that if Republicans take over the Senate, we’re likely to see the government shift its focus toward fossil fuels and away from renewables. Which sounds perfectly logical until you ask how such a shift is supposed to take place.

This is what is often missing from policy discussion: enough acknowledgment of the institutional processes that determine how policies actually get set and altered. If you’re going to say that a Republican Congress is going to produce a particular policy change, you have to be clear that you’re saying the following events will occur:

1. Republicans will write a bill to do the thing.

2. The bill to do the thing will not only pass the House but more importantly garner 60 votes in the Senate, which means it will get the votes not only of Republicans but also of some Democrats, thereby overcoming a Democratic filibuster.

3. President Obama will sign the bill to do the thing.

It’s possible that that sequence of events could occur in some cases. For instance, Republicans have had a feverish desire to build the Keystone XL pipeline for some time, and they’ve come to attach an importance to it that’s way out of proportion to its actual impact. They seem to say with all sincerity that building the pipeline is a key to American prosperity, which is beyond absurd—building the pipeline would create a few thousand temporary jobs, and the number of permanent jobs maintaining it would literally be in the dozens. But President Obama never seemed adamantly opposed to the pipeline, and one could imagine him signing on if he got something in return. You could also see the pipeline getting a few Democratic votes from red state Democrats who want to show that they love the world’s dirtiest fuel (tar sands oil) and are therefore not hippies, so it could get 60 votes.

That might or might not happen, but it’s at least conceivable. It wouldn’t, however, represent some massive shift in our nation’s energy policy, whatever else you might think about it. And it’s an extremely unusual case.

On almost everything else Republicans want to do, either the bills they write won’t overcome Democratic filibusters, or they’ll be vetoed by the President. Much of the time, that will be because instead of embarking on a good-faith effort to find some accommodation with Democrats, they’ll just propose the thing they really want. It might be possible to forge a compromise on tax reform, but that would be a lengthy and involved process, so Republicans will just try to pass a bill slashing corporate tax rates, which won’t become law. There are ways the Affordable Care Act could be improved, but instead of working with Democrats to find them, they’ll be much more inclined to just pass repeal votes, whether it’s repeal of the entire law or repeal of individual provisions one by one (or, more likely, both).

In other words, we’re going to get an awful lot of theatrical posturing, and not very much lawmaking. We shouldn’t mistake the latter for the former.

“Complicated Lies?”: The Amazingly Two-Faced Mitch McConnell

Alison Lundergan Grimes has been getting a lot of grief lately, not least from the Democratic Senatorial Campaign Committee, which pulled the plug on her campaign yesterday. Her team quickly sent out a press release noting that she has $4.4 million in cash on hand, which the release said was “more than any Democrat in a competitive U.S. Senate race.” So she probably has enough to see her through to the end, but obviously, the DSCC move isn’t exactly a vote of confidence.

Even so, I’d like to pay her a compliment: I can’t conceive of how she managed to sit there next to Mitch McConnell at that debate Monday night and hear him say some of the things he said without her head exploding. That took admirable self-control.

I’m not sure which suffix to add to “shame” to better describe McConnell’s performance: Was it –less, or was it –ful? Remember Mitt Romney during the first debate of 2012, how he routinely said “my position is X” (invariably a more centrist posture) when for the preceding umpteen months his position had been the much more right-wing Not X? Well, McConnell made Romney look like an ironman of forthright constancy. So this is how, with a 30-year Senate record that you’d think you might be able to boast about, you win reelection: By completely misrepresenting who you’ve been for the last six years, and by saying “Obama” every 45 seconds.

Misrepresentations were numerous, but let’s just zero in on student loans. Grimes raised the issue and noted the rising costs of the loans, which Congress hasn’t addressed. McConnell responded that the Senate had taken care of the issue in a bipartisan fashion. But it didn’t. The Elizabeth Warren-sponsored bill failed in the Senate by four votes, getting only 56 yeas but needing 60 to end debate and make it to the floor. Two Republicans voted with the Democrats, but McConnell wasn’t one of them. And McConnell said publicly at the time that he was against Warren’s plan because it was “designed to fail” since it would raise taxes on rich people.

McConnell similarly talked out of both sides of his mouth on the minimum wage, the Earned Income Tax Credit, and other issues. And he, too, dodged a question, and it was one that’s rather more important than the one Grimes dodged about whether she had voted for President Obama. McConnell wouldn’t say whether climate change is real and whether humans contribute to it, so if he wins, Kentuckians will have the pleasure of knowing who their senator voted for in 2012 while he spends the next six years positioning himself to the right of Exxon-Mobil (which at least supports a carbon tax) and blocking any attempt to do anything about global warming.

McConnell’s real howler, of course, had to do with Obamacare. As you may know by now, he said yes, sure, keep Kynect, the state’s roaringly successful health-insurance exchange set up under the health-care law. After all, it’s “just a website.”

This was the moment when I was wondering how Grimes’s head could possibly stay in one piece. As McConnell well knows, Kynect is not just a website. It’s a state health-care program that citizens happen to be able to access through a website. Kentuckians go on to the Kynect website to see what types of insurance coverage are available to them under the Kynect program, which exists solely because of Obamacare. So if you repeal Obamacare “root and branch,” which is still McConnell’s position, you can leave the Kynect website up, but those coverage options people find via the site will no longer exist. Saying keep the website but kill the program is like saying that someone can keep that nice-looking home page that says “Google,” but it just won’t perform searches anymore.

It’s amazing, the audacity of it. If what Grimes did on the Obama-vote question is “disqualifying,” as Chuck Todd put it, then what is an incumbent senator telling a whopper like this? Given that half a million Kentuckians have signed up for insurance through Kynect, isn’t this just a little more important? What’s worse is that he knows he can get away with saying something like that because he is well aware that the explanation of why he’s lying is a little complicated for the average voter to take in. The media just aren’t set up to correct the record very well on things like this. I read a handful of write-ups of the debate from within Kentucky yesterday, and none among the few I read actually burrowed into an explanation of McConnell’s lie. It just gets summarized as a “testy exchange” or some such.

There was one event during this campaign season when McConnell did tell his audience the truth. But that didn’t happen in Kentucky in front of voters. It happened over the summer in California, at the St. Regis Monarch Bay Resort, where rooms run upwards of $500 a night, at a gathering put together by the Koch brothers. McConnell has been saying on the trail that if he wins and the GOP takes the Senate, he’ll open up the amendment process, implying that he’d permit votes on issues Democrats wanted to push—notably, of course, raising the minimum wage.

But behind closed doors at the Koch event, McConnell said the opposite, promising the 1 percenters that, should they win, his Republicans  are “not going to be debating all these gosh darn proposals. That’s all we do in the Senate is vote on things like raising the minimum wage [inaudible]—cost the country 500,000 new jobs; extending unemployment—that’s a great message for retirees; uh, the student-loan package the other day, that’s just going to make things worse, uh.”

That was—speaking of comparisons to Mitt Romney—McConnell’s 47 percent moment. The sentiment is not as clearly put, so it wasn’t as usable for the opposition. But that was the probable (let’s face it) future majority leader saying to his real base: Don’t worry, boys, I got you covered.

That is how he will operate if he becomes majority leader. An inspiring campaign, all right.
