“The Constitution The Republicans Can’t Stand”: They Use Their Pocket Constitutions For The Parts That Come In Handy

If you are running for office as a Republican today, you have to mention your reverence for the Constitution at least as much as you mention your love for Ronald Reagan.

The Second Amendment — every word should be taken literally because it was literally ordained by God! The First Amendment protects my right to discriminate against gay people! Neither the Constitution nor the Bible contains the word “Obamacare”!

But Republican politicians have a few glaring blind spots when it comes to the Constitution. One of those is the 14th Amendment, a pillar of our inclusive democracy, a key component of which Republican presidential candidates are now asking us to ignore or change.

In its infamous Dred Scott decision in 1857, the U.S. Supreme Court ruled that the descendants of enslaved people were disqualified from U.S. citizenship. After we fought a civil war, the U.S. ratified the 14th Amendment to the Constitution in 1868, which overturned Dred Scott in its opening lines, declaring, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

During the congressional debate over the 14th Amendment, both its supporters and detractors recognized that this birthright citizenship clause would apply to everyone born on U.S. soil, not just the descendants of slaves. In 1898, the Supreme Court ruled that even after the passage of the discriminatory Chinese Exclusion Act, the U.S. could not deny citizenship to Wong Kim Ark, a California-born son of Chinese immigrants, because the 14th Amendment guaranteed him citizenship.

Yet, anti-immigrant activists and their allies in the GOP are now fighting against this most American of constitutional principles.

In an immigration plan released this week, GOP presidential front-runner Donald Trump called for ending birthright citizenship. No matter that he didn’t say how he would do that (while most people acknowledge that it would take a constitutional amendment to change the policy, some claim it was never included in the 14th Amendment in the first place). His Republican rivals started jumping to join him. Scott Walker told reporters that he “absolutely” wanted to change the Constitution’s definition of citizenship, adding, paradoxically, that “to me it’s about enforcing the laws in this country.” Ben Carson said it “doesn’t make any sense” to allow “anchor babies.” Bobby Jindal joined the fray. So did Lindsey Graham. Rand Paul and Rick Santorum had already expressed their support for undoing the citizenship provision, with Paul sponsoring a constitutional amendment to do so and Santorum saying the 14th Amendment doesn’t even say what it says.

Jeb Bush has been getting unearned credit for acknowledging that birthright citizenship is a “constitutional right” that we shouldn’t “take away” — just a few days after implying that if he had a “magic wand” to change the Constitution he would use it to do just that. Similarly, John Kasich has renounced his previous support for repealing birthright citizenship, but now says he doesn’t want to “dwell on it.” Carly Fiorina’s and Rick Perry’s passionate defense of the 14th Amendment is that it would take too much work to change it. This is what now passes for moderation. What ever happened to defending basic constitutional rights?

The Republican presidential contenders’ rush to badmouth a basic constitutional right — in an apparent attempt to appeal to their supposedly Constitution-loving far-right base — speaks volumes about what they really mean when they talk about constitutionalism. They use their pocket Constitutions for the parts that come in handy. The rest of it? Not so much.

“The Worst-Foot-Forward Problems”: Look Out, Republicans; Donald Trump Is Shaping Policy Now, Too

The moment he officially entered the Republican presidential race, and through the first debate, Donald Trump began to influence (or cheapen, if you prefer) the antics and rhetoric of other candidates.

This wasn’t new or unexpected in presidential politics, let alone Republican presidential politics. But the specter of someone like Trump driving the dynamic—as opposed to a more polished or pragmatic candidate—terrified Republican elites for obvious reasons. Many of them were hoping that 2016 would be the year that Republicans managed to avoid the worst-foot-forward problems that hobbled their nominees in 2008 and 2012, yet here was the GOP frontrunner calling Mexican immigrants rapists, another contender comparing nuclear diplomacy with Nazism, and still another one cooking bacon on the tip of a semi-automatic rifle.

The problem persists to this day, thanks to Trump’s persistent polling advantage and command of the media. But it just got meaningfully worse and now threatens to deteriorate into an outright catastrophe. For the first time since he joined the race several weeks ago, Trump has laid out a comprehensive policy approach—perhaps the most nativist, antagonistic, right wing immigration plan any leading Republican has ever proposed—and it’s earning rave reviews and approving nods from conservatives and other candidates.

Trump isn’t just shaping Republican rhetoric and antics anymore. He’s starting to shape Republican policy as well.

By design, the primary campaign is putting rightward pressure on everyone, forcing viable candidates to stake out positions they’ll ultimately regret, even in realms where Trump isn’t much of a player. At the first debate, both Governor Scott Walker and Senator Marco Rubio claimed to favor abortion bans without rape, incest, and life-of-mother exceptions. But Trump’s foray into policy will make him a standard-bearer in realms like economic and foreign policy, where he has thus far skated by on trash talk and empty sloganeering.

On Monday, Walker said his own immigration ideas are “very similar” to Trump’s—both want a wall built along the U.S.-Mexico border—and his campaign promised, like Trump, to “end the birthright citizenship problem.”

Birthright citizenship is a longstanding right wing bugaboo. It emerged briefly at the zenith of the Tea Party movement, when several leading Republican members of Congress proposed examining remedies to the Constitution’s broad citizenship guarantee. In 2011, Senator Rand Paul proposed amending the constitution “so that a person born in the United States to illegal aliens does not automatically gain citizenship unless at least one parent is a legal citizen, legal immigrant, active member of the Armed Forces or a naturalized legal citizen.”

Neither Walker, nor Trump, has specified how they’d achieve their goals. Trump’s white paper is more consistent with support for a constitutional amendment, while Walker’s comment is more consistent with support for ramping up enforcement so dramatically that unauthorized immigrants are deported before they can give birth. But the details are almost beside the larger point, that as cruel and damaging as the immigration debate was during the last Republican primary, it has become more so this time around. After they lost in 2012, Republicans set about to neutralize immigration as a campaign issue, by moving quickly to the left and helping Democrats update immigration policy for a generation. Instead they have moved significantly to the right.

That reflects a broader, more troubling trend. Three years ago, the GOP recognized the need to move in a subtly but meaningfully different direction. What they’re finding instead is that their coalition lacks the cultural and ideological space to nurture that kind of moderating impulse. Now, as on immigration, Republicans have moved right on a host of other issues, from abortion rights to voting rights. This massive strategic failure by the party apparatus has been investigated at length, and the party’s inability to prevent the 2016 primary from degenerating into another 2012-like fiasco will become the focal point of a thousand postmortems if Republicans lose the presidency again. Their mistake would be to blame it all on Trump, a GOP tourist. The problem runs so much deeper.

“Greed Is Always In Fashion On Wall Street”: Republicans Or Social Security? On 80th Anniversary, Still An Easy Choice

Ten years ago, as Americans celebrated the 70th anniversary of Social Security, the presidency of George W. Bush was already disintegrating over his attempt to ruin that amazingly successful program. The people’s rejection of the Bush proposal to privatize the system was so powerful that Republicans in Congress scurried away – and his political reputation never recovered.

Since then, the United States has endured a market crash and a crushing recession that proved how much this country needs its premier social insurance plan. Those events demonstrated that ceding control of Social Security and its revenues to Wall Street, in accordance with the Bush scheme, would have been a national disaster. And yet the Republican candidates for president seem utterly unable to learn that simple economic lesson.

To paraphrase the old French adage, the more things change, the more conservatism remains the same. On this 80th birthday of Social Security, the increasingly right-wing Republicans continue to blather the same old nostrums, as if they missed everything that has happened since 2005 – and as if they still want revenge against Franklin Delano Roosevelt for the humiliations he inflicted on their ideological ancestors.

Since August 14, 1935, Republicans and their financial backers have sought to undo the progress that Social Security represents for workers, the elderly, the disabled, and their families. Today’s Republican presidential wannabes all claim to be offering something new, but whenever they talk about Social Security, they sound as if they’re stuck in 2005 – or 1935.

From Rand Paul to John Kasich, from Marco Rubio to Rick Perry, from Lindsey Graham to Ted Cruz, from Bobby Jindal to Jeb Bush and George Pataki, they all agree that Social Security should be privatized. And with the possible exception of Mike Huckabee, all agree on undermining the only program that keeps millions of older Americans from ending their lives in poverty rather than dignity. Chris Christie, robber of public employee pensions, would swiftly raise the retirement age to 69, threatening grave hardship for blue-collar, lower-income Americans. Carly Fiorina would inflict similar suffering on workers who weren’t fortunate enough to snag an undeserved $40 million “golden parachute,” like she did.

Behind Republican warnings about the solvency of Social Security – and their enduring desire to privatize – are major financial interests that would like to seize the system’s revenue streams for their own profit.

Greed is always in fashion on Wall Street. But working Americans see no reason to hand Social Security over to the banks, when its administrative costs amount to well under 1 percent of its revenues. They know that the financial geniuses who almost sank the world economy eight years ago would charge far more than 1 percent, while imposing enormous risks on everyone but themselves.

So thanks, but — most emphatically — no thanks. As we mark this anniversary, most surveys show negligible support for privatizing Social Security or reducing its benefits; indeed, there is growing public support for proposals to expand and improve the system.

Yet polls also show many young Americans worrying that the system may not be sufficiently robust to pay full benefits by the time they reach retirement age. The latest report of the Social Security trustees, issued last month, suggested that the system’s trust fund could be exhausted by 2034.

Even then, the system’s revenues are projected to pay at least 75 percent of the benefits owed. But that wouldn’t be good enough when benefits are already too low – and there are several simple ways to fix Social Security’s finances so that nobody need worry. Long before the trust fund runs out of money, Congress can follow the example Ronald Reagan set in 1983 by raising the payroll tax rate — or mandate more progressive policy changes, such as lifting the cap on earnings subject to the tax, and broadening the tax base.

Declaring the nation’s “ironclad commitment” to Social Security, Reagan – who had once opposed the system as a symptom of creeping socialism – also expanded its base by bringing government employees into the system. Comprehensive immigration reform, which the Republicans oppose in nativist lockstep, would also create a stronger future foundation for all retirees and disabled workers.

So whenever these would-be presidents start barking about the need to pare, prune, or privatize this country’s most effective government program, remember this: Saving Social Security for future generations — even with higher payroll taxes — is far more popular than any of them ever will be.

“The EPA Messed Up The Animas River”: But The Real Threats Are Still Private Industry And The GOP

The American Southwest suffered a serious environmental crisis last week, after an Environmental Protection Agency effort to clean up old mining waste went disastrously awry, breaching a containment dam and releasing millions of gallons of contaminated water into the Animas River. The city of Durango and San Juan County in Colorado, as well as the Navajo Nation (the largest Native American reservation in the U.S.), have declared a state of emergency, instructing their citizens to stay out of the water and avoid using it for agriculture or drinking for the time being.

It’s a giant screw-up by the EPA, which is scrambling to fix the problem. Yet it’s one that could not have happened without a monstrous failure of private industry, which means it bears directly on the 2016 presidential race, in which environmental issues will play an important role. The Animas River debacle shows that Republican dogma — which says that pollution is basically no problem and that the EPA should be sharply restricted, if not abolished altogether — is tantamount to a pro-poisoning position.

Mining has long been a fixture of the Mountain West, but it has slowed considerably from the go-go days of the 19th and early 20th centuries. Much of that was hardrock mining of gold and silver, which require very dangerous chemicals and the processing of thousands of tons of ore. Colorado is thus littered with thousands of abandoned mines, and the Animas watershed was no exception, with 400 old mines.

This is a problem, because the mountain mines inevitably fill with water that has leached through the rock, carrying heavy metals and other toxins with it. Cleaning this up is very expensive, and mine companies would obviously prefer not to do it. Early mine investors were notorious for setting up a shell mining company, extracting the material while paying their executive class a fantastic salary, setting up a token cleanup operation (or forgoing it altogether), then declaring bankruptcy and starting all over again.

That’s the profitable, job-creating businessman’s solution to mining waste: just poison the neighborhood, then skedaddle. Hey presto, someone else’s problem!

However, as regulations became more stringent (especially thanks to the Clean Air and Clean Water Acts), things changed. In general, companies (like Anaconda Copper) now work with the EPA and local communities to clean up old sites, often at great expense.

It was one of those old pools of mining waste — around Silverton, Colorado — that the EPA was testing when it accidentally breached a containment dam and released the water. It’s been a big problem for years; the EPA and the mine company have pushed for Superfund designation (which would have made more money available for cleanup), while locals have resisted, fearing for their property values.

Again, clearly the EPA is at fault here. But it’s also worth noting that this spill is relatively minor compared to previous similar incidents, and that the dam would have likely burst on its own eventually. The question is what to do about it. Left to its own devices, it’s quite obvious what private industry would do: nothing. When it comes to environmental externalities, there is simply no alternative to some kind of government policy. And since the waste is already in place, there is no way to set up a Pigovian tax scheme that would deter such waste in the first place. It’s the EPA or bust.

Nevertheless, bust is basically the Republican position. At every turn during the Obama years, they have advocated for fewer environmental controls, greater freedom for corporations to pollute the environment, a cut in EPA funding, and attacks on the science that makes the regulations possible. During the 2012 campaign, the EPA’s “job killing regulations” became something of a Republican catechism. These days, Sen. Joni Ernst (R-Iowa) wants to abolish the agency altogether, while Sen. James Inhofe (R-Okla.), the chair of the Senate’s environment committee, has merely compared it to the Gestapo.

Ironically, new rules stemming from the Clean Water Act have been the subject of particular conservative ire of late. A minor update in a rule interpreting the Clean Water Act sparked furious Republican outrage, as well as a proposal to abolish the rule that would make it dramatically harder to regulate American rivers and streams.

On pollution, the magic of the free market is supposed to be what takes the place of sclerotic EPA bureaucracy. You only have to look back to the Gilded Age to see what a farcical idea that is. The Republican utopia is one where cities suffocate under a cloud of choking smog; where the hearts of American children pump lead-clouded blood; and where drinking water will be sacrificed to pad corporate profits.

“What Do They Know About Diplomacy?”: Republicans Who Oppose The Iran Deal Are Making Promises They Can’t Keep

The partisan debate over international efforts to forestall an Iranian nuclear weapons program has been stuck in a loop of self-parody ever since Israeli Prime Minister Benjamin Netanyahu attempted to sabotage the negotiations with an address before Congress this past March. In the ensuing months, Republican opponents have continuously echoed Netanyahu’s unsubstantiated insistence that he and other Iran deal skeptics don’t propose war or regime change or outright failure to keep Iran from manufacturing a weapon, but a “better deal,” the particulars of which remain mysterious to everyone.

“We’re being told that the only alternative to this bad deal is war,” Netanyahu said in his joint session address. “That’s just not true. The alternative to this bad deal is a much better deal.”

“It’s either this deal or a better deal, or more sanctions,” Senate Majority Leader Mitch McConnell argued just last week.

The putative existence of this “better deal” is meant to trump supporters of the global powers agreement, who argue quite sensibly that the agreement itself must be held up against an array of feasible alternatives, rather than a fantastical scenario in which Iran capitulates to every demand Netanyahu would have made. Netanyahu and Republicans can’t articulate a preferable, feasible alternative, but they also don’t like the intimation that their position amounts to a Trojan Horse, so they say “better deal” over and over again, overwhelming the entire debate with vagueness, deception and hysteria.

But there’s something particularly maddening about this story, above and beyond the fact that the deal’s opponents are equivocating and hiding the ball and generally unwilling to level with the public about their goals. The structure of their critique suggests not that they think cutting a deal with Iran, in which everyone makes concessions, is per se unwise, but that the global powers screwed up the negotiations and gave away too much. They argue in essence that the diplomacy was conducted incompetently, and that they would’ve done a better job.

But there is no reason to believe this, because so many of the deal’s prominent critics have thin or failed diplomatic records of their own or have built their careers around the notion that negotiating with enemies is a sign of inherent weakness.

Netanyahu epitomizes the disconnect better than anyone else. Why should anybody in America or anywhere lend a favorable view to Netanyahu’s pronouncements about diplomatic tradecraft? He doesn’t boast a record of cutting “better deals” or even really of cutting deals at all. To the contrary, the political balance he’s struck in Israel, quite transparently, is to promise a “better deal” with Palestinians at some point in the future, while governing without any intention of reaching it. As his most recent election approached, he briefly campaigned on the promise not to cut one, then sheepishly and unconvincingly backtracked after his premiership was secured. He’s brokered no major deals elsewhere in the region, either, or really treated diplomacy as a useful problem-solving tool in general. Viewed as a diplomatic effort, his campaign of sabotage against the global powers agreement is a reckless disaster, which risks causing irreparable damage to the relationship between his country and its one true, powerful ally.

To underscore that point, there is a pronounced strain of thought within Israel among skeptics of the agreement that Netanyahu is making a profound error by waging a scorched-earth campaign against it—that the only thing worse than the deal itself is interfering to sabotage it. As the Wall Street Journal reported this weekend:

In unusually direct terms, Israeli President Reuven Rivlin this week warned Mr. Netanyahu that his aggressive campaign to defeat the deal risked harming a relationship central to Israel’s security. “The prime minister has waged a campaign against the United States as if the two sides were equal, and this is liable to hurt Israel,” Mr. Rivlin, a member of the premier’s Likud party, said in an interview published Friday in the daily Maariv. Yedioth Ahronoth and Haaretz carried similar interviews with the president.

“I have told him, and I’m telling him again, that struggles, even those that are just, can ultimately come at Israel’s expense,” said the president, adding: “We are largely isolated in the world.”

This isn’t a quirk unique to Netanyahu either. Most Republican presidential candidates have adopted the same approach to global affairs. They support a comically ineffective embargo over normalization with Cuba. They debate each other, as Scott Walker and Jeb Bush just did, over whether it might be necessary to bomb Iran on the first day of a Republican presidency, or only after waiting to get a cabinet in place. President Barack Obama’s foreign policy record isn’t unblemished, but he can boast of real diplomatic successes—reaching climate change agreements with China, Brazil, and Mexico, re-establishing relations with Cuba, to say nothing of the global powers agreement itself. Republicans, by contrast, say things like, “What we object to is the President’s lack of realism—his ideological belief that diplomacy is good and force is bad.”

Yet at the same time, they stipulate that critics should take their promise that a “better deal” is possible at face value. In this way they are like, well, themselves, in the domestic realm—forever promising to repeal Obamacare and replace it with “something that doesn’t suppress wages and kill jobs,” or “something terrific,” without elaboration. Another “better deal” that for some reason can’t be put to paper in a way that convinces anyone of its seriousness. But at least in the similarly farcical debate over Obamacare, much of the public has learned not to place stock in promises like this. The same can’t be said of the Iran deal opponent’s false promises, and against that backdrop the Republican position is beginning to seep into the mainstream.
