“Deeply Confused”: The Republican War On Data

The politics of paranoia can lead policymakers into some unfortunate directions. On everything from homeland security to education to guns, paranoid politicians invariably end up pushing some truly bizarre proposals for no good reason.

In the latest example, some far-right congressional Republicans have decided to wage a war on census data because they have paranoid ideas about “big government.”

A group of Republicans are cooking up legislation that could give President Barack Obama an unintentional assist with disagreeable unemployment numbers — by eliminating the key economic statistic altogether.

The bill, introduced last week by Rep. Jeff Duncan (R-S.C.), would bar the U.S. Census Bureau from conducting nearly all surveys except for a decennial population count. Such a step that would end the government’s ability to provide reliable estimates of the employment rate. Indeed, the government would not be able to produce any of the major economic indices that move markets every month, said multiple statistics experts, who were aghast at the proposal.

“They simply wouldn’t exist. We won’t have an unemployment rate,” said Ken Prewitt, the former director of the U.S. Census who is now a professor of public affairs at Columbia University.

The core issue is something called the American Community Survey, which the Census Bureau uses as a supplemental to the decennial reports, providing information on commuting, income, family structure, educational attainment, housing, and finance. The results are used extensively by businesses, researchers, academics, and government agencies, and have been an invaluable tool for decades.

Right-wing lawmakers, however, have come to believe nefarious government officials are collecting the information as part of a larger scheme — it’s never been entirely clear to me what they see as the point of the plot — that must be stopped. Sen. Rand Paul (K-Ky.), who revels in strange conspiracy theories, proposed legislation in March to make elements of the American Community Survey optional, apparently because he didn’t realize that they were already optional.

But it’s not just the American Community Survey that congressional Republicans are eager to crush.

Indeed, Rep. Jeff Duncan’s (R-S.C.) bizarre proposal, which has 10 co-sponsors, would also explicitly eliminate the agricultural census, economic census, government census, and mid-decade census.

As a consequence, Duncan’s bill would eliminate the existence of the unemployment rate and the measurement of the nation’s GDP, among other thing.

Maurine Haver, founder of business research firm Haver Analytics and a past president of the National Association for Business Economics, told the Huffington Post‘s Michael McAuliff, “Do they understand that these data that the Census Bureau collects are fundamental to everything else that’s done? They think the country doesn’t need to know how many people are unemployed, either?”

The answers to these questions are unclear — Duncan and other supporters of this proposal have not explained why they oppose the data, why they see the need to eliminate the data, or even if they understand what it is they’re doing.

Duncan, incidentally, is the same deeply confused congressman who spewed bizarre conspiracy theories about the Boston Marathon bombing, going so far that Homeland Security Secretary Janet Napolitano felt the need to say Duncan’s ignorant inquiries were “full of misstatements and misapprehensions,” and “not worthy of an answer.”

“Nullification, Symbolism Over Substance”: How States Are Making It A Felony To Enforce Federal Gun Laws

In mid-April, Kansas passed a law asserting that federal gun regulations do not apply to guns made and owned in Kansas. Under the law, Kansans could manufacture and sell semi-automatic weapons in-state without a federal license or any federal oversight.

Kansas’ “Second Amendment Protection Act” backs up its states’ rights claims with a penalty aimed at federal agents: When dealing with “Made in Kansas” guns, any attempt to enforce federal law is now a felony. Bills similar to Kansas’ law have been introduced in at least 37 other states. An even broader bill is on the desk of Alaska governor Sean Parnell. That bill would exempt any gun owned by an Alaskan from federal regulation. In Missouri, a bill declaring federal gun laws “null and void” passed by an overwhelming majority in the state House, and is headed for debate in the Senate.

Mobilizing the pre-Civil War doctrine of “nullification,” these bills assert that Congress has overstepped its ability to regulate guns — and that states, not the Supreme Court, have the ultimate authority to decide whether a law is Constitutional or not.

The head of the Kansas’s State Rifle Association, an affiliate of the National Rifle Association, says she put the bill together and found it a sponsor. While the NRA regularly lauds passages of states’ gun-rights laws, it stayed silent on Kansas’ law, and, so far, has kept a low profile on nullification. (The group did not respond to our requests for comment.)

Many observers see nullification bills as pure political theater, “the ultimate triumph of symbolism over substance,” as UCLA law Professor Adam Winkler put it. He said he doubts the laws will ever be enforced, and, if they are, expects them to be struck down by the courts.

Winkler and others say nullification laws violate the Constitution, which makes federal law “the supreme law of the land…anything in the Constitution or laws of any State to the contrary notwithstanding.” Indeed, U.S. Attorney General Eric Holder wrote a letter last week to Kansas governor Sam Brownback, asserting that Kansas’ law is “unconstitutional.” (Brownback, who signed the bill into law, did not immediately respond to our requests for comment.)

But the growing number of such bills — which have passed by large majorities in at least one chamber of seven state legislatures–highlight the challenge gun control advocates face in their attempt to fight for gun regulation at the state level.

It also shows how nullification is fast becoming a mainstream option for state politicians. In Pennsylvania, 76 state legislators signed on to sponsor a measure that would invalidate any new federal ban of certain weapons or ammunition. The bill would impose a minimum penalty of one year in prison for federal agents who attempt to enforce any new law.

Supporters of nullification are not simply frustrated at what they see as congressional and presidential overreach. During a hearing about one of the nullification bills she had introduced, Tennessee state senator Mae Beavers called the Supreme Court a “dictatorship.”

“You think that the Supreme Court is the ultimate arbiter of any of these laws. I don’t believe that. I don’t believe it was ever granted the authority under the Constitution,” Beavers was quoted as saying in The Tennessean. (Reached by phone, she asked to comment later, then did not respond to further requests.)

The Supreme Court rejected nullification in 1958, after Southern states tried to use the concept to avoid desegregating public schools. “No state legislator or executive or judicial officer can war against the Constitution without violating his solemn oath to support it,” the Court ruled.

Winkler, the UCLA law professor, said that even though the nullification trend was likely to be ineffectual, “It represents a strong, powerful opposition to our government.”

The concept of nullification has had a resurgence since the beginning of President Obama’s administration. More than a dozen states have introduced bills to nullify Obamacare.

The Tenth Amendment Center, a group that advocates nullification as the solution to a range of policy issues, from marijuana legalization to Obamacare, publishes model gun nullification language. The center has little direct contact with state legislators, Michael Boldin, the center’s founder, said.

The roots of guns law nullification trace back nearly a decade.

In 2004, Montana gun rights activist Gary Marbut drafted a bill stating that any guns manufactured and retained in Montana are not part of interstate commerce, and thus are exempt from federal regulation. The bill failed twice, but it became law in 2009 after Republicans took control of the state House. By Marbut’s count, at least eight states soon enacted “clones” of the Montana law. (Those laws don’t go quite as far as the more recent nullification legislation. For instance, most of them don’t make it a crime to enforce federal law.)

The federal Bureau of Alcohol, Tobacco and Firearms responded to the earlier laws with letters to local firearms dealers explaining that federal laws and regulations “continue to apply.”

The day the Montana law went into effect, Marbut filed a lawsuit in federal court asserting the right to manufacture weapons in the state without a federal license. The suit, now before the Ninth Circuit Court of Appeals, has been backed by a large group of supporters, including Gun Owners of America, the Second Amendment Foundation, the Cato Institute, the Goldwater Institute, and a group of nine attorneys general, some of them from states that had passed their own versions of the Montana law.

Representatives of Goldwater and the Cato Institute said they see the case as not primarily about guns. Instead, they say, it’s meant to persuade the Supreme Court to roll back the Congress’ power to regulate commerce within a state.

“The likelihood of victory is low,” said Trevor Burrus, a research fellow at the Cato Institute’s Center for Constitutional Studies.

The latest set of bills — including Kansas’ new law —represent a far broader and more aggressive challenge to federal law. Even conservative organizations have been skeptical of the trend.

“A state law that criminalizes federal activity — I would oppose that as both imprudent and wrong,” Burrus said. The Cato Institute’s chairman wrote an op-ed recently arguing this kind of nullification is invalid.

Goldwater Institute’s Nick Dranias, a Constitutional expert, said the term “nullification” is sometimes applied to legitimate attempts to exert state sovereignty, “and sometimes it is essentially lawless civil disobedience.”

States should only pass laws challenging federal power “when there is a reasonable legal argument for sustaining them,” he said. And the penalty for enforcing federal law in “hard cases” should be “a misdemeanor at most.”

The Heritage Foundation, a conservative research group, released a “fact sheet” last year titled “Nullification: Unlawful and Unconstitutional.” (The fact sheet does not address guns in particular.)

The Montana activist who helped inspire the nullification movement in Kansas is also a bit skeptical. While he simply chose to challenge the federal government’s commerce power, Kansas is “bucking federal power more generally,” he said.

“I think, maybe tactically, they may have gone a little further than they needed to,” Marbut said.

Though he supports the principles behind the Kansas law, “I don’t know how much of that they can uphold when it gets to the courts.”

But Marbut hopes that the rapid spread of gun law nullification bills across the country will encourage the Supreme Court to hear his case.

“I see the tide moving our way,” Marbut said. “I think the Supreme Court has figured out that the people of America are gathering their torches and pitchforks and it’s time to settle things down by reeling in the federal giant.”

A spokeswoman for Alaska’s Parnell, who has not either approved or vetoed the state’s nullification bill, said last month that “he is supportive of it.” But, she added, “The bill (as with all bills that pass) is currently undergoing a thorough review by the Department of Law.”

In Kansas, Patricia Stoneking, the president of the Kansas State Rifle Association, said she was recommending that Kansans not start manufacturing guns under the new law until its legal status has been clarified.

Even if Kansas’ law ends up being struck down in court, “We actually are not going to roll over and play dead and say, ‘Oh, no, shame on us,’” Stoneking said. “The fight will not be over.”

Don’t Like The Facts, Stop Collecting Them”: The Conservative Quest To Eliminate Facts

The very first post at FactCheck.org referenced that great line from the late Sen. Daniel Patrick Moynihan: “Everyone is entitled to their own opinion — but not their own facts.”

During the years I spent at FactCheck, I certainly wittnessed my share of politicians trying to make up their own facts. And while I wasn’t allowed to say this at the time, it was always pretty clear (to me, anyway), that one side was making up a lot more facts than the other. Republicans have happily embraced half-truths and outright falsehoods. From “Death Panels” to climate change denialism to the austerity discussion to Paul Ryan’s budget math, the GOP appears to have embraced a policy of Making Stuff Up.

But now it seems that conservatives’ War on Facts has entered a new phase. If the facts are against you, just stop collecting them.

Rep. Jeff Duncan, a South Carolina Republican, has introduced a bill that would prevent the federal government from collecting data about the economy.

That’s right. The bill would require that the Census Bureau stop collecting the information that economists use to calculate (among other things) the unemployment rate, the labor force participation rate, housing construction rates, trade deficits, and much more.

So you might well be saying, “This sounds like a pain for economists, but why should I care if a bunch of stuffy economists are inconvenienced?”

The answer is that without this information, it will be impossible to tell how much any legislation coming out of the Congress costs.

When the Congressional Budget Office calculates the cost of a particular piece of legislation, they have to have something to compare it against. They do this by calculating a budget baseline—that is, they look at how much the federal government will spend and how much revenue it will collect under current law. It’s that last part that’s important here.

To know how much money the government will collect in taxes, you have to know a lot of things about the economy generally. Much of this is incredibly complicated, and a whole lot of extremely smart CBOers spend hundreds of person-hours each year trying to produce an economic forecast. Not being an economist, I can’t tell you exactly what goes into all of those models, but I do know one thing for sure. If you want to know how much tax revenue you’ll collect, you pretty much have to know how many people have jobs.

But, then, if you’re just planning to make up your own numbers anyway, you probably don’t much care whether the CBO has the data it needs to produce accurate estimates.

“Making Governing As Miserable As Possible”: Republicans Discover Sequester Budget Cuts Are Politically Unpopular

Back in February, a Pew Research Center poll showed that while Americans like the abstract idea of “spending cuts,” they don’t support reducing actual spending on, well, anything. Foreign aid very nearly (but not quite) achieved a majority in support of cuts, but for every other government activity – including education, entitlements, environmental protection and infrastructure – Americans are loathe to reduce the level of investment.

The GOP recently seems to have taken the public’s position to heart. Exhibit A is Rep. Michele Bachmann, R-Minn., who took to the House floor last week to decry the so-called “sequester” because it “breaks everyone’s heart” to see services such as Head Start and Meals on Wheels cut. “There are numerous Republicans that voted against the sequestration because we knew all of these calamities were in the future,” Bachmann said. “Didn’t you know this was going to happen? We knew it. That’s why we voted against this bill.”

As the Washington Post’s Glenn Kessler ably details, Bachmann is significantly rewriting history by claiming that she was against the sequester because it cuts too much from key services. At the time, she very publicly explained that she was against it – and other far more severe budget plans – because it did not cut enough.

But this trend goes far beyond Bachmann. Take, for instance, the GOP’s latest debt ceiling gambit. Come the fall, the federal debt limit will have to be raised again, and Republicans are already making noise about which policy concession they hope to wring out of the White House this time.

Unlike previous episodes, though, it seems that the GOP won’t demand entitlement cuts, but has instead decided that a revenue-neutral rewrite of the tax code (which would do nothing to reduce the deficit) will be the price of avoiding a self-induced economic calamity.

The reason for this shift is Republicans fear that embracing entitlement cuts such as those included in the president’s most recent budget “would be political suicide.” As New York magazine’s Jonathan Chait puts it, “Oh! So you threaten to melt down the world economy unless Obama agrees to cut spending on retirement programs, and then he offers to do that, and then you decide it’s too unpopular?”

The only GOP goal at the moment seems to be making governing as miserable as possible for the Obama administration. That leads to a lot of heated rhetoric about the threat of the deficit and the imminence of a debt crisis, scaremongering about the U.S. turning into Greece and creating the impression that there are gobs of taxpayer dollars being flushed down some bureaucrat’s toilet somewhere, thus playing off the public’s fear of a budget deficit that it doesn’t understand but knows it doesn’t like.

But when push comes to shove – and people are actually living with the effects of government spending cuts as they, for instance, try to travel by air – the GOP’s true colors show.  So we wind up with a cockamamie budget discourse in which one party doesn’t really want to cut spending but offers to do so anyway, while the other demands spending reductions but then turns them down when the president agrees.  (Unless, of course, those cuts affect discretionary spending on the poor, in which case, the GOP does nothing to stop them, but, ala Bachmann, wants none of the credit.) And all the while, the economy sputters along without the support it so desperately needs.

“Brace Yourselves Republicans”: Three New Facts About The Tea Party That You’re Not Going To Like

For a movement that’s helped to reshape the Republican Party—and by extension, reshape American politics—we know shockingly little about the people who make up the Tea Party. While some in the GOP once hoped to co-opt the movement, it’s increasingly unclear which group—the Tea Party or establishment Republicans—is running the show. Politicians have largely relied on conjecture and assumption to determine the positions and priorities of Tea Party activists.

Until now. The results of the first political science survey of Tea Party activists show that the constituency isn’t going away any time soon—and Republicans hoping the activists will begin to moderate their stances should prepare for disappointment. Based out of the College of William and Mary, the report surveyed more than 11,000 members of FreedomWorks, one of the largest and most influential Tea Party groups. The political scientists also relied on a separate survey of registered voters through the YouGov firm to compare those who identified with the Tea Party movement to those Republicans who did not. (Disclosure: The political scientist leading the survey was my father, Ronald Rapoport, with whom I worked in writing this piece.)

For the first time, we can now look at what a huge sample of Tea Party activists believe, as well as examine how those who identify with the Tea Party differ from their establishment GOP counterparts. Here are the three biggest takeaways from the study:

1. Tea Party activists are not Republicans.

Republicans are now reliant on the Tea Party. While the number of Tea Party supporters has declined since 2010, they still make up around half of Republicans, according to NBC/Wall Street Journal surveys. More important, they are the most active supporters when it comes to voting in primaries, volunteering on campaigns, and participating in various other activities political parties are reliant upon. Seventy-three percent of Republicans who attended a political rally or meeting identified with the Tea Party. The activists are vehemently anti-Democratic. Among the FreedomWorks sample, only 3 percent of people voted for Obama or a Democratic House candidate in 2008, and less than 6 percent identify as either independents or Democrats.

Yet the Tea Party activists doing work for the Republicans are surprisingly negative about the party they’re helping. While 70 percent of FreedomWorks activists identify as Republican, another 23 percent reject the Republican label entirely and instead, when asked which political party they identify with, choose “other.” Asked if they considered themselves more Republican or more a Tea Party member, more than three-quarters chose Tea Party.

Given that so many don’t identify with the GOP, it’s perhaps not surprising that the activists also rate the party they vote for so poorly. Given a spectrum of seven choices from “outstanding” to “poor,” only 9 percent of activists rated the Republican Party in the top two categories. Meanwhile, 17 percent put the party in the bottom two. In total, 32 percent rated the party in one of the three positive categories while a whopping 40 percent rated the party in one of the negative ones.

In other words, the activists providing a huge amount of the labor and enthusiasm for Republican candidates are, at best, lukewarm on the party they’re voting for. Few are concerned about what their impact on the future of the GOP will be. Which brings us to:

2. Tea Party activists aren’t nearly as concerned about winning.

Or at least they’re significantly more concerned with ideological purity than with political pragmatism. The survey asked FreedomWorks activists if they agreed or disagreed with the statement, “When we feel strongly about political issues, we should not be willing to compromise with our political opponents.” Altogether, more than 80 percent agreed to some extent. Thirty-two percent of respondents “agree strongly” with the statement. Meanwhile, less than 10 percent disagreed even “slightly.” In another series of questions sent out to FreedomWorks activists, the survey asked whether they would prefer a candidate with whom they agree on most important issues but who polls far behind the probable Democratic nominee or a candidate with whom they agree “on some of the most important issues” but who’s likely to win. More than three-fourths of respondents preferred the candidate who was more likely to lose but shared their positions.

In other words, the Tea Party cares more about what nominees believe than whether they can win—and compromising on politics means compromising on principle.

The findings help explain what’s happened in so many GOP primary races.  Both nationally and at the state level, moderate GOP officeholders found themselves with primary challengers. The Tea Party has helped propel several upstart candidacies, like Christine O’Donnell’s infamous effort to win Delaware’s Senate seat or more recently, Richard Mourdock’s successful challenge to sitting Senator Dick Lugar. In both of those cases, and several others, the Tea Party candidate has proved too extreme for the general election and lost. But despite the losses, the push toward conservative purity continues. A recent New York Times story showed that even House Majority Leader Eric Cantor, seen as the leader with the most clout in the Tea Party movement, has been unable to move the faction’s members in his party into more moderate terrain. In light of these survey results, that makes sense—Tea Party elected officials are simply reflecting their supporters. Meanwhile, those left in the establishment fear the party’s new direction.

3. Attempts to bridge the gap between establishment Republicans and the Tea Party are doomed to fail.

There’s no shortage of moves from Republicans to keep the Tea Party in the fold while shifting things more to the center. After the dismal GOP performance in the 2012 elections, establishment figures began pushing back against the Tea Party. Famous consultant Karl Rove announced a new political action committee designed to challenge extreme GOP candidates with more marketable ones. The national party even put out a report after the 2012 losses that pushed for more pragmatic candidates that could have a broader appeal. As noted, even Eric Cantor is trying.

But the gap between the two groups is huge. In the YouGov survey the study uses, more than two-thirds of Tea Partiers put themselves in the two most conservative categories on economic policy, social policy, and overall policy. Only 23 percent of non-Tea Partiers place themselves in the most conservative categories on all three issues; nearly 40 percent don’t locate themselves in the most conservative categories for any of the three policy areas.

Most jarring: On some issues, like abolishing the Department of Education and environmental regulation, the establishment Republicans are actually closer to Democrats than they are to the Tea Party respondents. That’s a gap too large to be overcome by a few political action committees and gestures of goodwill.

Tea Party activists dominate the Republican Party, and they’re no less willing to compromise with the GOP than they are with Democrats. FreedomWorks President Matt Kibbe summed it up nicely in his book title: Hostile Takeover.

Simply put, the GOP is too reliant on the Tea Party—and based on these survey results, the Tea Party doesn’t care about the GOP’s fate. It cares about moving the political conversation increasingly rightward.
