“A Naïve View Of Politics”: The Poison-The-Well Myth, And How Politics Really Works

There are certainly some serious critiques of President Obama’s new immigration policy. It could encourage more illegal immigration in the long run. It may be another step toward an imperial presidency, detached from Congress. It definitely could have been executed less cynically, given that Mr. Obama all but admitted he delayed the announcement until after the midterms, in an (unsuccessful) effort to help Democrats on the ballot.

But there is also one critique that’s getting a lot of attention and isn’t so serious.

It’s the “poison the well” argument — the notion that Mr. Obama’s executive action to shield as many as five million people from deportation will prevent a bigger immigration bill from passing Congress and maybe prevent a whole bunch of other legislation, too.

John Boehner, the speaker of the House, and Senator Mitch McConnell, the next majority leader, have both used the phrase “poison the well.” A spokesman for Mr. Boehner said the move by Mr. Obama would “ruin the chances for congressional action on this issue and many others.” While maybe we should excuse politicians for trying to score political points, neutral commentators have picked up the argument, too. It’s one of those ideas that has the aura of sober-minded political analysis.

Obviously, we can’t run the final two years of the Obama presidency multiple times under different circumstances and see what happens in each. So it’s impossible to know for certain how any one action affects the course of events. But there are all kinds of reasons to believe that the poison-the-well theory is based on a naïve view of politics. And understanding why it’s wrong helps illuminate how politics really does work.

Whatever you may think of today’s politicians, they are highly successful people who have climbed to the top of a competitive profession. Most of the time, they make decisions that are in their interests — whether political interests or policy interests. A few notable exceptions aside (like Newt Gingrich’s infamous pique in 1995 over getting a bad seat on Air Force One), they do not make major decisions the way a small child would, based mostly on whether someone else is being nice or mean to them.

If you ask political scientists what they consider to be the biggest misconceptions about politics, you’ll often hear a version of the Nice-Mean Fallacy. The Obama presidency has offered a particularly rich set of examples. It’s true that Mr. Obama and his White House haven’t done a very good job of building relationships with Congress, and it’s true that the administration’s aloofness has probably hurt its effectiveness in some ways.

But consider the recent president whose relationship skills are often contrasted with Mr. Obama’s: Bill Clinton. Many members of Congress really did seem to prefer Mr. Clinton’s personality to Mr. Obama’s. And yet which of the two presidents failed to keep Democrats united on a major health care bill and thus failed to pass one? And which president held onto every single congressional Democrat he needed to pass such a bill?

Were the roles reversed, we no doubt would hear tales about how the gregarious president used his people skills to pass the biggest expansion of the safety net in a generation while the distant, professorial one failed. In truth, congressional Democrats weren’t making decisions based on either Mr. Clinton’s or Mr. Obama’s personality. They were making them based on bigger issues.

The Democratic Party of the early 1990s included more conservative Southerners than the 2009-10 version of the party, for example. The 2009-10 Democrats were also more desperate to succeed, remembering the disappointment of the Clinton bill and probably aware that economic inequality had worsened over the intervening decades. The Democrats stuck together because they believed doing so was in their interest.

Republicans have done the same in the Obama presidency. From the beginning, Mr. McConnell has understood that Republicans could veto Mr. Obama’s promise to be a bipartisan bridge-builder. “It’s either bipartisan or it isn’t,” Mr. McConnell said in 2010, explaining his caucus’s united opposition to the health care bill. No wonder that Republicans didn’t bite when the White House suggested adding medical-malpractice reform to the bill.

Many Republicans voters back this stance. Polls show that most want their leaders to stand on principle rather than to compromise. Democratic voters are fonder of compromise.

The story on an immigration overhaul has been similar. Some Republicans leaders see a bill as in their interests — helping them with Latino voters — and the Senate passed such a bill, 68-32, last year. Yet most House Republicans have philosophical objections and have few Latino voters in their district. House leaders have refused to bring the bill to the floor.

To accept the poison-the-well argument is to believe, first, that Republicans would have passed an immigration bill if Mr. Obama had not acted. This seems unlikely but not totally out of the question: Perhaps more Republicans want to show they can compromise now that they control both chambers, hoping their presidential nominee can win swing voters in 2016. In that case, an immigration bill might be more feasible in 2015 than it was in 2013.

But the poison-the-well theory then requires a second belief, too: That even if an immigration bill were in Republican interests, they would refuse to pass one, out of spite from Mr. Obama’s executive action. This belief seems strangely dismissive of Republicans’ instinct for self-preservation. It also conflicts with the history of both parties.

On the same day in August 1981 that President Ronald Reagan threatened to fire striking air traffic controllers, many Senate Democrats voted for his tax cut, and House Democrats did the same the next day. Mr. Clinton and congressional Republicans, less than a year after impeachment, collaborated on a sprawling bank deregulation bill in 1999. A few years later, many congressional Democrats voted for the Homeland Security Act even as President George W. Bush was calling them soft on terrorism.

In each of these cases, politicians voted with their interests, not their feelings. There is every reason to believe the same will happen over the next two years.

Some of the same Republicans worrying aloud about poisoned wells no doubt understand this reality. But they continue making the point partly because it helps unify the party on a divisive issue. “It’s a way the G.O.P. can achieve consensus,” as Brendan Nyhan, a Dartmouth political scientist and Upshot contributor, says. “They’re internally divided on policy on immigration but agree on a process critique of Obama’s actions.”

Jeb Bush and Marco Rubio may be on one side of some big immigration questions and conservative House Republicans may be on the other, but they can come together on metaphorical well water. Which is to say that politicians generally act in their interests, even when doing so involves pretending otherwise.

“Try Getting To Know Each Other”: Don’t Argue About Politics This Thanksgiving. Just Don’t

Imagine this scene on Thanksgiving day. The turkey is partly carved, the mashed potatoes are being passed around.

Your Mother: What are you thankful for?

You: Well, if I can say so, I’m thankful for ObamaCare because it was great that I was able to sign up for health insurance on the internet.

Caricatured Uncle: Hope Reverend Wright isn’t on your death panel! Payback for Ferguson coming to you.

Your Mother [hoping to get control of the situation]: I did something different this year with the sweet potatoes! Do you like it?

Never fear. The pundits are here to save you. Think Progress has a guide on “how to argue with your Evangelical uncle” about marriage equality. Vox is advising you on Bill Cosby, Ferguson, and immigration (you’re for it as much as possible, of course).

Last year, some of Michael Bloomberg’s dollars trickled down to someone who gave you talking points on gun control. Chris Hayes is once again dedicating an hour of his MSNBC show to the cause.

Less combatively, Conor Friedersdorf advises you to adopt his brand of nodding empathy: “Before you focus on any point of disagreement, ask questions of your interlocutor to figure out why they think the way they do about the subject at hand.”

These advice columns are becoming a genre unto themselves. The stock villain: crazy right-wing uncle, the jokes about stuffing. But I recognize them by what they unwittingly emulate: guides for religious evangelism. The gentle, righteous self-regard, the slightly orthogonal response guides, the implied urgency to cure your loved ones of their ignorance. Your raging uncle will know the truth, and the truth will set him free.

That’s a problem. Our politics are taking on a religious shape. Increasingly we allow politics to form our moral identity and self-conception. We surround ourselves with an invisible community of the “elect” who share our convictions, and convince ourselves that even our closest and beloved relatives are not only wrong, but enemies of goodness itself. And so one of the best, least religious holidays in the calendar becomes a chance to deliver your uncle up as a sinner in the hands of an angry niece.

I’m as guilty of this as anyone. As a conservative raised in an argumentative and left-leaning Irish-American family, Thanksgiving and other holiday dinners did more than any professional media training to prepare me for MSNBC panels. But arguments like these, particularly when we allow politics to dominate our notions of ourselves, can leave lasting scars. And precisely because our familial relationships are so personal, the likely responses to our creamed and beaten talking points will be defensive, anxious, off-subject, or overly aggressive.

You might think you can sneak in a killer talking point about immigration reform, only to touch off a sprawling congress about the personhood of unborn children, the Vietnam War, and whether it is really sexist to describe Nancy Pelosi as a “tough broad.”

Instead, what we really need are guides for gently deflecting the conversation away from politics, as our polite grandmothers once did.

Bringing up politics can be a form of self-assertion, or a way for a family member to test whether he is accepted for who he is. One of the reasons the “conservative uncle” has become the cliched oaf of the Thanksgiving dinner is precisely because he may feel, rightly or wrongly, that the country is moving away from him. He could be testing to see whether his family is ready to reject him, too. Or he could just be an oafish, self-regarding lout. Either way, it doesn’t have to be that hard to show he is appreciated as a family member and human being.

Caricatured Uncle: Obummer sure got waxed in that election. Guess he isn’t the Messiah, huh?

You: Har har, you got me. But hey, I get to read and think about the news every day. I only see you twice a year. How is the renovation going?

Instead of honing your argument on tax reform into unassailability, maybe ask your parents or siblings ahead of time what some of the further-flung or more volatile members of your family are up to in their lives before they sit down. Get the family’s talking points, rather than Mike Bloomberg’s.

And if you do want to pointlessly and frustratingly argue about politics with your uncle, just friend him on Facebook.

“The Undeniable Truth”: Why I’m (Still) Thankful For President Obama

On a day when we pause to consider those things for which Americans ought to be thankful, I feel obliged to mention my appreciation for many of the things that Barack Obama has accomplished as President of the United States, and my profound relief that he is in the Oval Office rather than any of the Republicans who sought to displace him.

On this day, it seems appropriate to reflect not only on Obama’s considerable achievements, but on how much worse our situation might be if his opponents had been in control of events from January 2009 until now.

With our continuous immersion in harsh commentary from factions and ideologues across the spectrum, a mindless negativity tends to dominate assessments of his presidency. He is certainly more flawed than his most zealous supporters would ever have admitted six or seven years ago, which is why some of them are disproportionately disappointed today; he has made regrettable mistakes in both policy and politics; and, as we saw in this month’s midterm election, he has suffered declines in public confidence that injured his image and the fortunes of his party. His approval ratings remain low.

And yet, whatever his fellow citizens may feel, the undeniable truth is that Obama righted the nation in a moment of deep crisis and set us on a navigable course toward the future, despite bitter, extreme, and partisan opposition that was eager to sink us rather than see him succeed.

So I’m thankful that Obama was president at the nadir of the Great Recession, rather than John McCain, Mitt Romney, or any other Republican who might have insisted on austerity and prevented the stimulus spending that saved us from economic catastrophe. It wasn’t large enough or long enough to prevent the human suffering of unemployment, but it was sufficient to bring recovery, more rapidly than most countries have recovered after a major panic.

The simple proof may be found in the record of growth that outpaced every other industrialized country in the world – a record that seems even more impressive because the crash began here, as a consequence of irresponsibility and criminality in American financial markets. Undergirding the stimulus was his courageous decision to bail out the automotive industry, denounced as “socialism,” saved at least a million jobs and prevented the further deindustrialization of America.

I’m also thankful that Obama – a politician who respects science and listens to scientists — was president as we began to encounter the difficult realities of climate change. Having declared his determination to double the production of renewable energy in this country, he has far exceeded that objective already. Under his guidance, the federal government has acted against excessive carbon dioxide in the atmosphere, required automakers to double their fuel economy by 2025, ordered agencies to achieve sustainability in operations and purchases, and invested tens of billons in smart electric grids, conservation, and clean fuels.

I’m thankful that he oversaw passage of financial reform, despite his overly cautious failure to prosecute the financial felons who caused the crisis and his refusal to take down any of the big banks. Like the stimulus and the auto bailout, the Dodd-Frank Act is imperfect but useful and necessary – and wouldn’t have occurred if the bankers and their most abject Republican servants had been fully in charge.

I’m even more thankful that he pushed through the most extensive and generous reform in American health care since the passage of Medicare and Medicaid, the Affordable Care Act – which, despite its troubled debut, has proved to be a remarkable success. It isn’t Medicare for all, but Obamacare is insuring and protecting millions of Americans who would otherwise be subject to the Tea Party Republican policy, pithily summarized by that mob screaming “let ‘em die” at the GOP debate in 2012. Health care costs are falling, Medicare’s solvency has improved, and millions more of the country’s poor and working families are covered by Medicaid, in spite of Republican legislators and governors who would, quite literally, let them die.

Finally, I’m appreciative of many other policy decisions Obama has made – promoting human rights by ending anti-gay discrimination in the military, banning the Bush era tolerance of torture, outlawing unequal pay for women, and most recently his executive order on immigration. I’m grateful that he is seeking peace through negotiation with Iran, instead of going directly (and insanely) to war as McCain or Romney would almost surely have done. I’m glad he had the guts to order the operation that finished Osama bin Laden.

None of this diminishes the president’s political errors, his sometimes naïve attitude about “bipartisanship,” his excessive deference to the national security and defense establishments, or his persistent susceptibility to wrongheaded cant about entitlements and deficits.

But he remains admirably cool under attacks that would madden most people. He refuses to mimic the cynical, mindless, and ugly conduct of his adversaries. He still proclaims American values of shared responsibility and prosperity, of cooperation and community, of malice toward none and charity for all.

In different ways, those ideals were epitomized by the presidential founders of this national holiday – George Washington, Abraham Lincoln, and Franklin Roosevelt – and their persistence is reason for thanksgiving, too.

“There’s No Line Between Law And Politics”: A Reminder; Our Justices Are Politicians In Robes

Linda Greenhouse, the longtime Supreme Court reporter for the New York Times, declared surrender Thursday. For decades, she argued that the Court was a higher form of government, engaged in Law, not just politics. Now she has decided that the justices are politicians in robes.

The straw that broke her faith?  The Court’s decision to review King v. Burwell, a case confirming that Obamacare subsidies can go to people in insurance exchanges that the federal government sets up in states that haven’t created the exchanges themselves. Without those subsidies, the worst-case scenario has Obamacare entering a fiscal death spiral. The best case is that it would be another body blow to a law that is managing to work despite design flaws and relentless opposition.

Greenhouse is absolutely right that the Court’s hasty grab at a hot-button case it doesn’t need to decide is unseemly and partisan-feeling. And as Greenhouse is a very smart and sincere person who loves the Court and the law, her crie de coeur is striking.

But the Supreme Court has been political since the day it was born. It’s just that the way it is political today is a symptom of the nastiness and futility of our politics.

Cast an eye over the history of the Supreme Court, and you will see no golden age of apolitical judging. Today’s conservative judicial activists—especially the older generation, such as Justices Scalia and Thomas—came onto the Court in reaction against an earlier generation of liberal activists. The liberals had established abortion rights, extended constitutional equality to women, increased the rights of criminal defendants, and briefly declared the death penalty unconstitutional.

The conservatives saw all of this as blatantly political activism. They sought control of the Court to restore the Constitution and protect law from politics—at least as they understood it. Now those conservative restorationists are the partisan activists who have broken Linda Greenhouse’s faith.

And what about those liberal activists who made the young Scalia and Thomas so indignant? They were the children of another revolution. Their predecessors—and some of them—also came onto the Court to restore the Constitution and save the law from politics. Only the activists they overthrew were conservatives: anti-New Deal justices who upheld “economy liberty” and “limited government” by striking down minimum-wage laws and the first wave of Franklin Roosevelt’s legislation.

And so it goes, back through judicial struggles over Reconstruction, slavery, and the now-esoteric bloodletting of the early nineteenth century, which pivoted on questions like the constitutionality of the national bank. Someone has always been trying to save the law from politics and restore the Constitution. But when you look at it clearly, saving the law from politics turns out to be a thoroughly political job.

First you have to convince people to accept your version of the boundary between law and politics. Then you have to get judges onto the bench who agree with you. The history of law is the history of politics, and vice-versa.

So why do so many smart people believe in the difference between law and politics? Why do they sincerely try to restore, or preserve, the line between the two, and get heartbroken when the line fails?

It’s not just naivete. The special role of the American courts, particularly the Supreme Court, is to administer principles that have won so decisively in politics that they get taken off the table.

The triumph of the New Deal brought in a generation of judges who implemented new principles—above all, the legitimacy of the regulatory and welfare state—across the legal system as the shared framework of a national consensus. The era of the Civil Rights Movement and the Great Society led a generation of elite liberals, including many of the current Justices, to embrace broader principles of personal liberty and equality, which they saw as perfecting the American social compact. They were busily implementing these in cases like Roe v. Wade when a right-wing insurgency took them by surprise.

The fight that started then has only become more pitched. There’s no line between law and politics now because our politics is too divided to generate one. We cannot begin to agree which issues should be taken off the table and handed to courts.

The conservatives on the Supreme Court are aligned, intellectually, politically, and institutionally, with lawyers and activists who want to dismantle much of the regulatory and welfare state and stop or reverse the extension of civil rights and liberties.

The liberals are aligned with those who have opposite aims: preserving and extending civil rights and upholding the regulatory state as a legitimate aspect of government. The country is divided, sharply and unrelentingly, over the same questions. What one side tries to take off the table, to turn from “politics” into “law,” the other side is always trying to grab back. With every grab, the idea that law and politics are separate becomes harder for anyone to believe.

Politics gives law its premises, its basic commitments. Law has its own kind of integrity, based in applying principles consistently, integrating competing goals, giving the same words the same meaning in different places and explaining why not when it doesn’t. If you have worked closely with judges who practice this craft, you know it isn’t just politics, any more than architecture is just drawing.

Law, in this sense, is essential work, but its fabric gets torn when the premises change—like ripping a weaving project suddenly into a new kind of garment. It changed in the Civil Rights era, and in the New Deal. And then it stabilized. Now it is not stabilizing, and the constant contest at all levels, from basic premises to craft, means that, increasingly, everything feels partisan. All that is solid melts into fetid air.

We’ve been denied what Americans seem perennially to wish for—a Supreme Court that is better than we are—surer, clearer, wiser and more unified. It turns out that was really a wish to be a better version of ourselves. On the one hand, it’s good to be rid of the illusion and stand on the real ground of democratic politics. On the other hand, what broken and disappointing ground it is.

“Third Time’s The Charm?”: New Hampshire Says ‘No’ To Interloper Scott Brown

In New Hampshire, the Massachusetts invasion has been staved off—for now.

Incumbent Democrat Jeanne Shaheen has been declared the victor in the closely-fought race against Scott Brown, the former Massachusetts senator who slid across the border to the state where he keeps a family vacation home, declaring residency and announcing his candidacy in one fell swoop.

Brown had achieved national fame in 2009 when he crisscrossed Massachusetts in his pickup truck, going on to defeat attorney general Martha Coakley in a special election for the Senate seat formerly held by the late Ted Kennedy. That race presaged the Tea Party wave that was to come in 2010. Brown’s victory was short-lived however; in 2012, he was defeated by liberal favorite Elizabeth Warren.

Brown was a favorite of Wall Street and of moderate Republicans cheered by the possibility that a type of Rockefeller Republicanism was returning to the northeast. In the run-up to the midterms, he publicly flirted with running for president, before eventually being lured into the Senate race in neighboring New Hampshire.

It was a long shot to say the least. New Hampshire remains one of the most conservative states in the Northeast, with Republicans regularly competing in the presidential elections, but it is also fiercely independent, and resentful of the encroachment of the Boston suburbs.

Shaheen often played up her local roots. Brown did himself no favors when, in the campaign’s final debate, he seemed to flub a question about basic Granite State geography, calling Sullivan County north of Concord, when it is in fact west of Concord. The Shaheen campaign pounced, spending part of the next day hitting the hustings in Sullivan County.

“The key is that Brown said what he—and probably a lot of other people—think,” wrote a columnist for the Boston Globe. “That ‘anyplace past Concord’ faces the exact same set of issues.”

Brown tried to counter this narrative by focusing on national issues, describing a nation and hence a state that was left insecure and unstable thanks to President Obama’s leadership, and of course, by Shaheen’s support of that leadership. He combined a number of crises facing the president, including the threats of Ebola and ISIS, mismanagement in the Secret Service and child migrants coming over the border, to argue for a change in direction.

Those attacks though fell flat among charges that Brown was an interloper who would vote to limit the reproductive choices of women in the U.S. Senate.

Things took an especially awkward turn for Brown in the race’s final hours, when the former senator was asked by an MSNBC reporter if he planned to move back to Massachusetts if he lost.

Brown did not answer.
