“Who Says Money In Politics Doesn’t Buy Influence?”: The Distorting Impact Of Money, Enabled By Supreme Court Rulings
One recent day, my newspaper had two front-page stories related to money and politics. One was about financial contributions made from the political action committees of prospective presidential candidates to Iowa office-seekers of the same party. Another reported that former Texas Governor Rick Perry has been appointed to the board of the corporation planning the controversial Bakken pipeline.
The U.S. Supreme Court ruled money in politics is free “speech,” and doesn’t buy influence. But both of those stories offered small examples of how it might. In the first, potential presidential candidate Rand Paul wants Iowa operatives in his camp, so he donates some of his PAC funds — a thousand here or there — to their campaigns. They in turn may feel grateful enough to repay the favor by talking Paul up to their supporters.
In the second case, prospective presidential candidate Perry gets a direct financial stake in a controversial oil-pipeline proposal. The Bakken pipeline, which would stretch from North Dakota to Illinois, is widely opposed by environmental and other groups. But by investing in Perry and his campaign, the company could bank on having a friend in the White House to create a climate favorable for such projects. In 2012, the head of Energy Transfer Partners gave a quarter million dollars to a SuperPAC for Perry. And now Perry has a seat on its board.
A Perry spokesman said Perry won’t be publicly promoting the pipeline, but he doesn’t have to. His board presence is endorsement enough.
Traditional PACs are chicken feed compared with the filet mignon influence SuperPACs can buy. The first allow a group of people with a common goal — say, reducing environmental regulations — to donate up to $5,000 to a candidate in each round of an election campaign, and $15,000 a year to a national political party. But SuperPACs — authorized by the 2010 Supreme Court ruling, Speechnow vs. FEC — can raise and spend unlimited amounts of corporate, union or private dollars to promote or discredit a candidate in a federal election. They just can’t donate directly to the candidate or party.
The Center for Responsive Politics reports that in 2014 elections, 1,300 SuperPACs had raised more than $695 million. They ranged from the liberal Senate Majority PAC, which raised $67 million, to the conservative American Crossroads PAC, which raised $23 million. Ten billion dollars were spent in the 2012 election cycle — combining the presidential, local, state and regional races — according to national journalist/author John Nichols. But for all that spending, Nichols told a Des Moines audience, 2014 had the lowest turnout in midterm elections since 1942.
Nichols, the Washington correspondent for the progressive Nation magazine and co-author of Dollarocracy: How the Money and Media Election Complex is Destroying America was brought to Iowa by the Quaker American Friends Service Committee to kick off a project provocatively titled “Governing Under the Influence.” It aims to focus attention in Iowa and New Hampshire, the leadoff presidential selection states, on the distorting impact of money in politics, enabled by Supreme Court rulings.
In a rousing speech in the basement of a United Methodist Church, Nichols said most Americans feel too overwhelmed to know what to do. Rather than motivate voters, the excess negativity of political ads causes many not to vote. But Nichols maintains that Iowans get more one-on-one time with presidential candidates than anyone else and should use that to grill them. “Iowans should be saying, ‘How much money have you taken from this interest?’” and how do they stay independent of it, he said. He suggested everyone ask the candidates if they agree with the Supreme Court that corporations are people, and if unlimited spending to influence elections is protected free speech.
Ultimately, those rulings can only be overridden by a constitutional amendment. But history, notes Nichols, was filled with people organizing in response to an injustice and getting the constitution changed — like the 19th amendment, ratified in 1920, granting women the right to vote, the 13th amendment (1865), abolishing slavery and the 15th amendment (1870) giving black people voting rights.
It takes either a two-thirds majority in both houses of Congress or in two-thirds of state legislatures to amend the constitution. That must be ratified by three-quarters of the states. But some states have begun the process. Montana and Colorado voted differently for president in 2012, but both voted to amend the constitution to curb money in elections.
It’s a long and laborious process. The 27th amendment, on congressional pay, was submitted in 1789, but not ratified until 1992. On the other hand, the 26th amendment, giving 18-year-olds voting rights, took only three months to be ratified in 1971. Most Americans understood the absurdity of drafting young people who couldn’t even vote. I hope most Americans also understand the absurdity of politicians using their office to return a debt to the deep pockets that helped get them elected.

“He Must Not Merely Lose, He Must Be Humiliated”: If Mitt Romney Insists On Running For President, Then He Needs To Be Trounced
The main reason democracy works is not the ballot box. It is accountability.
Humans are weak and prone to corruption, and one problem with authoritarian regimes is that there is no mechanism for holding people accountable when corruption inevitably occurs. In a democracy, there is. It’s far from perfect, but in the long run accountability leads to democratic countries being more prosperous, peaceful, and powerful. Just look at the rampant corruption and pollution in China, or Russia’s slide into fascism.
The ballot box is just a mechanism for accountability. I suspect that the U.S. would more or less achieve the same results if it had a computer that replaced one clique of megalomaniacal Ivy League graduates with another clique of megalomaniacal Ivy League graduates every time GDP growth and unemployment hit a certain number — this is essentially what the ballot box does.
Accountability is a different phenomenon. If you have the ballot box without a culture of accountability, you get Iraq’s chaos or Hugo Chavez’s bread lines. Only culture generates and sustains accountability — the rules of the game are the product of a culture that is willing to enforce them. Such a culture creates secular saints like John Profumo, who, after resigning from the British government over a sex scandal, didn’t join a private equity firm, but instead spent years mopping toilets at a charity.
All of which brings us to Willard Mitt Romney.
In the political realm, you want a culture that says you can only be a major party’s presidential nominee once (unless you win the presidency, of course). Why? Because. Because it allows new blood to emerge. Because otherwise you risk becoming a place like France, where the same politicians have been playing musical chairs for decades. Both Jacques Chirac and François Mitterrand ran for president twice on a major party ticket before being elected to the top job, and the country would have been better off if their parties had held them accountable instead. Party machines run like feudal systems, doing everything to protect the Boss, including tolerating a culture of corruption. Healthy political parties realize that the cemeteries are full of indispensable men and rotate their troops.
This means that if Mitt Romney is to run for president, which it increasingly looks like he will do, he must not merely lose — he must be humiliated. This is not only because he would be a terrible standard bearer for the GOP (although that’s certainly true), but also because an example must be made of him. He must suffer a defeat so stinging that it will deter anyone else who might try that trick in the future.
Romney’s candidacy is clearly an exercise in self-delusion. For the GOP to nominate a painfully wooden private-equity baron — at a time when its biggest problem is its image as the party of rich white men — was excusable the first time; a second time, it would be a joke. No American would take the party seriously. And if Romney thinks talking about poverty — an issue on which no mainstream journalist would give him the benefit of the doubt — will change his public perception, he clearly has departed from reality. Even without the accountability aspect, a Romney candidacy would be a disaster.
I personally find it impossible not to have sympathy for Mitt Romney, the man. But there seems to be two Romneys. There’s “Mitt,” the fair-dealing businessman, the talented technocratic governor, the Christian man deeply involved in his church, the devoted husband and father. And then there is “Candidate Romney,” a man who seems to be so consumed by his self-regard, his unshakeable faith in his own world-historical significance, that he is willing to say anything, and do anything, to reach the highest office in the land. The question was always which one would end up at 1600 Pennsylvania Avenue if elected. But now it is moot.
What was most endearing about Mitt Romney was what seemed like a genuine, basic human decency. But this selfsame decency should have told him that, no matter how great a president he thinks he would be, he could not run again, for the good of his party and country. Since he seemingly does not understand this, the country must make him understand.

“The Lion Of Liberalism”: Remembering Mario Cuomo, 1932-2015
When I met Mario Cuomo in the summer of 1978, he was already a celebrated public figure, if not yet a political powerhouse. We were at the Democratic state convention in Albany, where I was reporting for the Village Voice, and he was pondering an offer from New York governor Hugh Carey, then seeking re-election, to join the ticket as lieutenant governor. Mario frankly didn’t much trust Carey, who needed him more than he needed a largely ceremonial promotion from his then-position as secretary of state.
But in the end he accepted the deal, both because he believed that New York needed a Democratic administration, regardless of his personal feelings toward the governor — and because he knew that this step would advance his own political career.
That was my introduction to the Cuomo style of “progressive pragmatism” – and to a charming, thoughtful, highly literate, and occasionally volatile figure who became one of the most compelling orators of the late 20th century.
His speech at the 1984 Democratic convention, delivered at the zenith of Ronald Reagan’s reign, remains a remarkably inspirational assertion of progressive values against conservative complacency and cruelty. His address at Notre Dame on religious belief and public morality that same year courageously defended the independence of Catholic elected officials from subservience to church doctrine on reproductive rights.
In recent years, it has been fashionable to draw contrasts between Mario, who passed away yesterday at the age of 82, and his older son Andrew, who was sworn in for a second term as governor of New York only hours earlier. According to the conventional wisdom, Mario was liberal while Andrew is conservative; Mario was too self-doubting to run for president, while Andrew is too self-confident not to run, someday.
Whatever the differences in personality between father and son, however, Mario’s reputation as the conscience of the Democrats grew more from what he said than what he did. “We campaign in poetry but we govern in prose,” he famously remarked – and much of his governance was prosaic indeed.
He spoke out bravely against capital punishment, for instance, yet built more prison cells than any governor in state history. He approved tax cuts, held down spending, and was proud of his balanced budgets – even while the number of homeless on New York’s streets swelled during his administrations. But he borrowed billions to stimulate spending and create jobs with major public works in environmental protection, education, roads, bridges, and mass transit.
As a columnist for the Voice, I didn’t always agree with his priorities, to put it mildly, and wrote many columns criticizing his policies. More than once I picked up a jangling telephone to hear an angry, argumentative Governor Cuomo railing on the line, without the pleasantry of a “hello.” It was an experience that other reporters shared from time to time. But I have met very few elected officials who were as kind or as genuine.
And I’ve known few politicians as engaging in conversation, or as erudite without pretension. He wrote wonderful diaries of his first campaign for governor, published by Random House in 1984, and could speak as cogently about the history of Lincoln’s presidency as the philosophy of the Jesuit visionary Teilhard de Chardin. But he was still a tough lawyer who went to public schools and grew up on the streets of Queens.
Among the most amusing Cuomo anecdotes is one from the 1977 New York City mayoral campaign, when he is supposed to have confronted Michael Long, the unsavory chairman of the state’s Conservative Party, on a street corner – and knocked him out with a single punch. (Long later claimed this report was an “embellishment,” but I heard it straight from an impeccable source.)
Exaggerated or not, that little legend captures the feisty essence of Mario Cuomo – a man of passionate intellect and spirit, who sought to make his values real in this world. He worked diligently and spoke powerfully, reminding millions of Americans about values we ought to cherish. I have no doubt he will rest in peace.

“The Duck That Roared”: Obama Has Demonstrated That The Term “Lame Duck” Has Its Limits
Politics in a democracy is a team sport that leans heavily on individual high performers. This explains the paradoxical closing of President Obama’s most difficult year in office.
He ends 2014 in surprisingly buoyant spirits, having proved that he still has the power to push policy in new directions in foreign affairs and on issues ranging from immigration to climate change.
But his underlying political position is weaker, meaning that Obama and his aides are aware that changing the trajectory of the nation’s debate and the fortunes of his party are among his primary obligations over the next two years. Just as Ronald Reagan’s legacy was secured by the presidential victory of George H. W. Bush in 1988, so does Obama need a Democrat — at the moment, this would seem to be Hillary Clinton — to win in 2016.
In the short run, Obama has demonstrated that the term “lame duck” has its limits. Over the seven weeks since the Democrats’ pummeling in November’s midterm elections, the president has moved forcefully to show he will use all the power he still has.
He used executive action to legalize the situations of up to 5 million undocumented immigrants and in doing so created a political problem for Republicans. They are split on the immigration question and will greatly weaken their ability to appeal to Latino voters in 2016 if they are too aggressive in trying to reverse what Obama has done.
He reached an agreement with China setting ambitious targets to reduce greenhouse gases. It was a signal, his senior aides say, that acting on climate change will be a central focus of Obama’s final two years in office.
And last week, he upended 53 years of American policy by opening diplomatic relations with Cuba. Republican opposition was fierce. Yet, as on immigration, Obama’s opponents will have difficulty altering the course he has set unless they win the presidency in 2016. And by then, both initiatives may be too widely accepted to uproot.
In the meantime, Obama continued with negotiations to stop Iran’s quest for nuclear weapons, even as some of his older bets were paying off. The Russian economy is reeling from sanctions imposed in response to its invasion of Ukraine (and from low oil prices). An approach seen by its critics as not tough enough is beginning to show its teeth.
The health care website, whose crash was an enormous political and practical problem for Obama and his party in 2013, is working smoothly. The fact that so many Americans are interested in obtaining health insurance under the Affordable Care Act, his aides argue, is a vindication of the effort Obama put in to passing it. And the economy continues to hum with the unemployment rate at its lowest in six years while gas prices are also sharply down. This year is set to produce the largest increase in payrolls since the late 1990s.
Thus did Obama’s good mood at his news conference on Friday defy the political obituaries that proliferated after the election. “My presidency is entering the fourth quarter,” he said brightly. “Interesting things happen in the fourth quarter.”
But in that quarter, Republicans will control both houses of Congress, and Obama will have to work with them just to keep the government running. He will also have to pick his fights. A senior administration official said the president would lay out bottom lines — one imagines especially on health care and financial reform — where he cannot compromise with the GOP and will count on congressional Democrats to uphold potential vetoes.
On the economy, Obama will try to square a circle that flummoxed Democrats in the midterms. His aides say he wants to highlight what’s working in the economy while also making clear that ending wage stagnation will require government to invest in variety of areas, including infrastructure, education and economic development. Democrats can also be expected to press fights on issues related to employee rights, including overtime rules, the minimum wage and family leave.
The irony is that while Republicans can certainly make life more difficult for Obama, the president and his party can also make life more difficult for the newly empowered GOP by casting them as obstructing broadly popular measures.
Obama has shown he can still accomplish a lot on his own. The harder test will be whether he can advance ideas and arguments that strengthen the ability of his allies to sustain his policies beyond the life of his presidency.

“Not Cowering Or Conceding”: President Obama Plays The Long Game
The media is settling on a new narrative about President Obama. It’s always interesting watching one after another join in that process. For example, Timothy Egan calls it Obama Unbound.
Perhaps the best thing to happen to him [Obama] was the crushing blow his party took in the midterm elections. Come January, Republicans will have their largest House majority in 84 years — since Herbert Hoover was president. Granted, no politician wants to join Hoover and history in the same sentence. But Obama is not cowering or conceding. He’s been liberated by defeat, becoming the president that many of his supporters hoped he would be.
He promised to be transformative. Instead, especially in the last two years, he’s been listless, passive, a spectator to his own presidency. Rather than setting things in motion, he reacted to events. Even Ebola, the great scare that prompted so much media hysteria it was awarded Lie of the Year by PolitiFact, was somehow his fault. No more. Of late, the president who has nothing to lose has discovered that his best friend is the future.
Glenn Thrush calls it Operation Revenge.
“He needs to run, to compete – or more to the point, he needs someone to run against,” a former top Obama adviser told me.
He’s got that now, in a Republican-controlled Capitol Hill. Obama, a political counterpuncher who often needs a slap in the face to wake up, got a gut-shot in November. The Democrats’ staggering loss in the midterms – like his disastrous performance in the first presidential debate against Mitt Romney in 2012 – seems to have jolted him to the realization that he’ll have to act boldly to preserve what he’d assumed was a settled legacy.
The trouble with this kind of analysis is that it is ahistorical. Every one of the things these pundits name as an example of the President’s newfound persona – executive actions on immigration, new EPA rules, climate change agreement with China, Russian sanctions, normalization of our relationship with Cuba – has been in the works for at least the last 1-2 years (during the time he was supposedly a listless, passive spectator). Back in January of this year, he announced his intention to implement the “pen and phone strategy” we’re all witnessing unfold.
President Barack Obama offered a brief preview Tuesday of his State of the Union address, telling his Cabinet that he won’t wait for Congress to act on key agenda items in 2014.
“I’ve got a pen, and I’ve got a phone,” he said at his first Cabinet meeting of the year. Outlining the strategy, Obama said he plans to use his pen to sign executive actions and his phone to convene outside groups in support of his agenda if Congress proves unable or unwilling to act on his priorities.
It’s true that President Obama might have a new lightness in his step. But that could just as well be because he’s finally off for a much-needed vacation in Hawaii with his family. Anyone who has really watched this President operate knows that he plays the long game. Here’s how Michelle Obama described that back in 2011.
Here’s the thing about my husband: even in the toughest moments, when it seems like all is lost, Barack Obama never loses sight of the end goal. He never lets himself get distracted by the chatter and the noise, even if it comes from some of his best supporters. He just keeps moving forward.
And in those moments when we’re all sweating it, when we’re worried that the bill won’t pass or the negotiation will fall through, Barack always reminds me that we’re playing a long game here. He reminds me that change is slow — it doesn’t happen overnight.
If we keep showing up, if we keep fighting the good fight and doing what we know is right, then eventually we will get there.
We always have.
