Why Killer Cops Walk Free”: It’s Time To Try To Rebuild The Trust Between Police And The Communities They’re Sworn To Protect

When I was a white, I viewed the police as a friend.  But now that I’m a minority, my view has changed.

I know that to many I still look like a white guy. However, since I’m of Arab heritage and Muslim, I morphed into a minority in the post-9/11 world. After all, white people aren’t racially profiled nor called to answer for the worst of their community. Only minorities are. Thus, I’m a minority, and I view the police through that prism.

Don’t get me wrong. I don’t consider the police an enemy. I just no longer give them the benefit of the doubt. When I hear their version of the facts, I now require corroborating evidence. And I can just as easily believe the version of events proffered by a defendant or other witnesses.

Being a minority, I have also become much more sensitive to the fact that the police can kill you without good reason. And while exact numbers are hard to come by, recent estimates are that the police have killed about 400 people per year over the last decade.  Our police kill more people each year than those killed by gun violence in countries like the United Kingdom, Germany and Australia.

I would predict that few have issues with the police shooting dangerous criminals who are truly threatening them or the public at large.  Regardless if we are white or a minority, we want the police to protect us. In fact, we pay them to do just that.

But the problem arises when we see the police kill a person in circumstances that shock our conscience. In these instances, our sense of right and wrong demands that the police officer be held criminally responsible for his actions.

However, this happens very infrequently. Why? In large part, this is due to a 1989 U.S. Supreme Court decision that held a police officer can legally use deadly force if the officer has an “objectively reasonable fear” that someone will be killed or suffer serious bodily injury. This ruling, by design, insulates police officers from criminal liability because of the unique, life-threatening challenges of being in law enforcement.

In fact, many legal experts believe that Darren Wilson, the police officer who reportedly shot Michael Brown, will not be convicted of a crime. Indeed, Missouri Governor Jay Nixon acknowledged that Wilson might not even be charged with one.

The Brown case would be far from the most outrageous incident involving a police officer not being criminally charged for killing an unarmed person. In 2012, for example, Brian Claunch, a wheelchair-bound double amputee living in a group home in Houston, became unruly. After the cops arrived, Claunch, who had a history of mental illness, verbally threatened them from his wheelchair and waved a shiny object—a ballpoint pen. After Claunch refused to drop the pen, one of the officers shot him in the head, killing him.

Is it shocking the officer wasn’t charged? Yes. Unexpected? No. As The Texas Observer noted, between 2007 and 2012, Houston police officers shot and killed 109 people and injured another 111. How many of these shootings were deemed unjustified? Zero.

Claunch was white. I mention his race only because white people should, too, be concerned with being shot by law enforcement. In fact, the police have killed more whites than black people in recent years. But those numbers don’t paint the full picture. On a percentage basis, blacks are being shot and killed by the police in much higher numbers.

For example, as Mother Jones noted, between 2004 and 2008, Oakland police officers shot 37 people. How many were black? All of them. And even though in 40 percent of the cases the suspect was unarmed, not one police officer was charged with a crime. And Oakland is not unique here—similar numbers can be found in other big cities.

Consequently, few will be surprised that a recent poll found blacks and whites view the police differently. While 56 percent of whites had a great deal of confidence in the police, only 37 percent of blacks felt the same way.

Still, Americans overall are apparently viewing the police in more negative terms. A 2009 Gallup poll found that 63 percent of Americans viewed the police as honest and ethical. (The peak being 68 percent in 2001 shortly after 9/11.)  But a Gallup poll conducted at the end of 2013 found that number has now fallen to 54 percent, the lowest number since the 1990s.

What may be legal might not always be right.  While the police may walk away scot-free, we still remember what they did. And I would predict that if we see more cases like Michael Brown or Eric Garner—the unarmed man killed in July after NYPD officers placed him in an illegal chokehold—the more negatively the police will be viewed by everyone going forward.

This poses a very real policing problem. Police officials will tell you that one of the most important components in combatting crime is building relationships within the community they are policing. How can the police do that if the community views them as dishonest, or even dangerous?

A good move toward rebuilding trust would be affixing cameras to police officers so that the public can see the events that lead to the use of deadly force. Police could also do more community relationship building by interacting with minority communities now—not after there is an incident. And if a police officer is clearly at fault, police chiefs should not blindly defend that person.

Ironically, while relations between the police and minority communities might be strained, we now share something in common: Neither of us wants to be defined by our worst examples.

“Our ‘Real’ America”: Whiteness Is Still A Proxy For Being American

Anyone can make a fool of himself. So it’s tempting to dismiss last Thursday’s mega-gaffe by Florida Representative Curt Clawson as indicative of nothing more than the fallibility of the human brain.

But think about the nature of Clawson’s goof. Sitting across a congressional hearing room from Nisha Biswal, an official at the State Department, and Arun Kumar, who works at the Department of Commerce, Clawson addressed the two Indian-Americans as if they were representatives of the government of India. Which is to say: He had trouble recognizing that two Americans who trace their ancestry to the developing world are really American.

In today’s Republican Party, and beyond, a lot of people are having the same trouble. How else to explain the fact that, according to a 2011 New York Times/CBS poll, 45 percent of Republicans think President Obama was born outside the United States? Is it because they’re well versed in the details of which kind of birth certificate he released and when? Of course not. It’s because they see someone with his color skin and his kind of name and think: Doesn’t seem American to me.

In fact, Obama’s opponents, including Democrats, have been raising questions about his Americanness since he began seeking the presidency. In a March 2007 memo, Mark Penn, Hillary Clinton’s chief campaign strategist, argued that she should attack Obama for “not [being] at his center fundamentally American in his thinking and his values.” Had Obama been white and named Joe Smith, Penn’s line of attack would have been inconceivable, since Obama’s thinking and values were typical of a liberal Democrat’s, and similar to Clinton’s own. Penn’s effort to question Obama’s Americanness was entirely a function of the fact that he traced his ancestry to the third world and had spent some of his childhood abroad.

Since Obama defeated Hillary Clinton, it has been the Republicans’ turn. Newt Gingrich has claimed Obama possesses a “Kenyan, anti-colonial worldview.” Dick Cheney has said, “I don’t think that Barack Obama believes in the U.S. as an exceptional nation.” Indeed, a major thrust of the GOP’s attack on Obama is that he doesn’t understand America, doesn’t believe in America and wants to turn it into something fundamentally different from what it has always been. Bill Clinton, by contrast, was attacked relentlessly for his supposed lack of personal integrity and failure to serve in Vietnam. But conservatives rarely questioned his connection to the United States.

It’s not just Obama. In various ways in recent years, conservatives have questioned the Americanness of American Muslims. Michele Bachmann suggested that Huma Abedin and other Muslim-Americans serving in the national-security bureaucracy might be more loyal to foreign Islamist movements than to the United States. Another former Republican presidential candidate, Herman Cain, in 2011 said he would not appoint a Muslim to his cabinet because “Muslims in this country, some of them, try to force their Sharia law onto the rest of us.” A Public Religion Research Institute poll that same year found that 63 percent of Republicans believed Islam contradicts American values.

The link between the GOP’s tendency to question the Americanness of Muslim- Americans and Clawson’s assumption that the Indian-Americans sitting across from him were not American becomes clearer when you realize that in contemporary American discourse, “Muslim” is often seen as a race. Several of the most high-profile hate crimes committed in “retaliation” for 9/11 occurred not against Muslims but against South Asian Hindus or Sikhs. Representative Peter King has called for profiling suspected terrorists based upon their “religious background or ethnicity,” even though Islam is no more an ethnicity than is Christianity. The implication, of course, is that Muslims are brown.

One even sees traces of this tendency to un-Americanize immigrants from the developing world in the way some Americans see Hispanics. When Arizona in 2010 passed a law empowering law enforcement to detain anyone who presented a “reasonable suspicion” of being in the country illegally, critics rightly wondered what criteria the police could possibly use to suspect someone of being undocumented other than the fact that they looked or sounded Hispanic. A 2012 poll by the National Hispanic Media Coalition found that one-third of Americans believed most Hispanics in the United States were undocumented. In other words, many Americans associate being Hispanic with not being legally American. That’s pretty similar to the assumption Congressman Clawson made about Biswal and Kumar.

There’s no point in continuing to ridicule Clawson. Everyone’s entitled to a dumb mistake. But it’s worth noting how unlikely it is that he would have mistaken an Irish-American for a representative of the government of Ireland or a German-American for a representative of the government of Germany. Throughout our nation’s history, whiteness (itself a shifting category) has been used as a proxy for Americanness. And as Clawson reminded us last Thursday, it still is.

“A Nation Divided, With Liberty And Justice For Some”: White-Collar Crimes Are Not Considered “Appropriate For Jail”

It swallowed people up.

That’s what it really did, if you want to know the truth. It swallowed them up whole, swallowed them up by the millions.

In the process, it hollowed out communities, broke families, stranded hope. Politicians brayed that they were being “tough on crime” — as if anyone is really in favor of crime — as they imposed ever longer and more inflexible sentences for nonviolent drug offenses. But the “War on Drugs” didn’t hurt drugs at all: Usage rose by 2,800 percent — that’s not a typo — in the 40 years after it began in 1971. The “War” also made America the biggest jailer on Earth and drained a trillion dollars — still not a typo — from the Treasury.

Faced with that stunning record of costly failure, a growing coalition of observers has been demanding the obvious remedy. End the War. The Obama administration has been unwilling to go quite that far, but apparently, it is about to do the next best thing: Declare a ceasefire and send the prisoners home.

Attorney General Eric Holder announced last week that the government is embarking upon an aggressive campaign to extend clemency to drug offenders. Those whose crimes were nonviolent, who have no ties to gangs or large drug rings and who have behaved themselves while incarcerated will be invited to apply for executive lenience to cut their sentences short.

Nobody knows yet how many men and women that will be. Easily thousands.

Combined with last year’s announcement that the government would no longer seek harsh mandatory minimum sentences for nonviolent drug offenders, this may prove the most transformative legacy of Barack Obama’s presidency, excluding the Affordable Care Act. It is a long overdue reform.

But it is not enough.

As journalist Matt Taibbi observes in his new book The Divide: American Injustice in the Age of the Wealth Gap, Holder’s Justice Department has declined, essentially as a matter of policy, to prosecute the bankers who committed fraud, laundered money for drug cartels and terrorists, stole billions from their own banks, left taxpayers holding the bag, and also — not incidentally — nearly wrecked the U.S. economy. But let some nobody get caught with a joint in his pocket during a stop-and-frisk and the full weight of American justice falls on him like a safe from a 10th-story window.

For instance, a man named Scott Walker is 15 years into a sentence of life without parole on his first felony conviction for selling drugs. Meantime, thug bankers in gangs with names like Lehman Brothers and HSBC commit greater crimes, yet do zero time.

We have, Taibbi argues, evolved a two-track system under which crimes committed while wearing suit and tie — or pumps — are no longer considered jailable offenses. Taibbi said recently on The Daily Show that prosecutors have actually told him they no longer go after white-collar criminals because such people are not considered “appropriate for jail.”

Who is “appropriate”? Do you even have to ask?

Black people. Brown people. Poor people of whatever hue.

Thousands of whom are apparently coming home now. One hopes there will be a mobilization — government agencies, families, churches, civic groups — to help them assimilate into life on the outside. But one also hopes we the people demand reform of the hypocritical system that put them inside to begin with.

These men and women are being freed from insane sentences that should never have been imposed, much less served. Contrary to the pledge we learned in school, it turns out we are actually one nation divided, with liberty and justice for some.

So yes, it is good to see the attorney general dismantle the War on Drugs. But while he’s at it, let him dismantle the War on Fairness, too.

“The Right’s New Racial Math”: How Its View Of Nonwhite Voters Got So Demented

The news is so depressing for conservatives these days. All the demographic trends are moving against them.With every election showing a large majority of single women, young people and people of color voting for the Democrats, thus solidifying their identification with the party, the less likely it is that Republicans can outrun the shift to a multiracial majority. But they still don’t seem to understand exactly what this means for them.

Take, for example, Michael Medved’s latest in the Wall Street Journal in which he explains that the Democrats’ strategy of wooing women voters by pointing out the GOP’s hostility to reproductive rights and equal pay is nothing but a sham. Sure, Barack Obama won the female vote by a commanding 11 points in the last election but it’s not as if he won a mandate for his message. After all, he lost the white female vote:

A closer look at the numbers reveals that Mr. Obama’s success with the ladies actually stemmed from his well-known appeal to minority voters. In 2012, 72% of all women voters identified themselves as “white.” This subset preferred Mitt Romney by a crushing 14-point advantage, 56% to 42%. Though Democrats ratcheted up the women’s rhetoric in the run-up to Election Day, the party did poorly among the white women it sought to influence: The Republican advantage in this crucial segment of the electorate doubled to 14 points in 2012 from seven points in 2008. In the race against Mr. Romney, Obama carried the overall female vote—and with it the election—based solely on his success with the 28% of women voters who identified as nonwhite. He carried 76% of Latina women and a startling 96% of black women.

The same discrepancy exists when considering marital status. In 2012, nearly 60% of female voters were married, and they preferred Mr. Romney by six points, 53% to 46%. Black and Latina women, on the other hand, are disproportionately represented among unmarried female voters, and they favored Mr. Obama by more than 2-to-1, 67% to 31%.

A similar pattern emerges among young voters, suggesting the president’s popularity among millennials also came from racial minorities, not any special resonance with young people. While nonwhites compose 28% of the electorate-at-large, they make up 42% of voters ages 18-29. Mr. Obama won these young voters handily—60% to 37%. He lost young white voters by seven points, 51% to 44%.

If the majority of women who vote for Democrats are young, single and black or brown, how can anyone say the war on women was a legitimate issue? True, those votes do come in mighty handy Election Day but let’s take a look at the reality: If young, female racial minorities couldn’t vote, the Republicans would win in a landslide!

I’m sure this makes them feel better. The right women are all on their side. Well, actually it’s just a small majority, even by that unfortunate standard: 46 percent of white women went with the Democrats so I wouldn’t be too sure that they’ve got them quite as locked up as Medved supposes.

This isn’t the first time we’ve heard such embarrassing rationalizations coming from the Republicans after a loss. They often explain that they actually won — it was just all those young nonwhites who messed up the proper results. Take this one from Romney’s adviser Stuart Stevens who explained his boss’s loss this way:

On Nov. 6, Mitt Romney carried the majority of every economic group except those with less than $50,000 a year in household income. That means he carried the majority of middle-class voters. While John McCain lost white voters under 30 by 10 points, Romney won those voters by seven points, a 17-point shift.”

There was a time not so long ago when the problems of the Democratic Party revolved around being too liberal and too dependent on minorities. Obama turned those problems into advantages and rode that strategy to victory. But he was a charismatic African American president with a billion dollars, no primary and media that often felt morally conflicted about being critical. How easy is that to replicate?

It’s interesting how he assumed that none of the African-Americans, women and young people who voted for Obama are middle-class. But then that was the campaign that famously derided “the 47 percent” for being parasites so it’s not all that surprising. He also assumes that the “minorities” the Democrats are traditionally “too dependent” upon will not vote in future elections and thus deliver the presidency to the candidate who represents what are apparently the Real Americans: white people who make over 50K a year.

None of this is to say that studying the demographics of the voting public is unacceptable. It’s a big part of American politics, and slicing and dicing the electorate is how the two parties strategize their campaigns and that’s fine. But to constantly bring up the fact that Democrats can’t win if they don’t have the votes of racial minorities and young people implies that there’s something not quite legitimate about it.

As Politico helpfully spelled out for us in 2012:

If President Barack Obama wins, he will be the popular choice of Hispanics, African-Americans, single women and highly educated urban whites. That’s what the polling has consistently shown in the final days of the campaign. It looks more likely than not that he will lose independents, and it’s possible he will get a lower percentage of white voters than George W. Bush got of Hispanic voters in 2000.

A broad mandate this is not.

Right. The popular choice of all racial minorities, unmarried women and urban whites of of all ages isn’t a mandate. It doesn’t include enough of the right kind of votes. You know, the best kind. The older, rural, married white kind. Also known as “Republicans.”

Michael Medved, at least, understands the GOP’s demographic challenge, even as he foolishly discounts the salience of issues that directly affect half the population, regardless of race or age. He counsels the Republicans to forget women and work harder to attract racial minorities. Here’s a tip, free of charge: A good first step would be to stop talking about their votes as if they aren’t quite as valuable as white votes.
