“A Path To Second-Class Citizenship”: Marco Rubio Takes The Dream Out Of “DREAM Act”
Senator Marco Rubio missed the mark on the DREAM Act today when he said that he’d consider offering a path to legal status, but not citizenship, for undocumented students. As a Latino Republican, Rubio has been criticizedfor his stance against the DREAM Act, which in its original form would permit students who had completed high school and either gone to college or joined the military, a path to eventual citizenship.
During a radio interview with Geraldo Rivera today, Rubio teetered between defending his current opposition to the DREAM Act and trying to find a way to appease Latino voters who will prove an important demographic for Republicans during the election season. Rubio delved into his new position on the DREAM Act:
The DREAM Act, as it is currently structured, has a series of problems that not only denies it the support that it needs, but I think would be counterproductive to our goal of having a legal immigration system that works. … It could be expanded to millions of people, which is problematic. But I do think that there is another way to deal with this. And I think that one of the debates that we need to begin to have is there is a difference between citizenship and legalization. You can legalize someone’s status in this country with a significant amount of certainty about their future without placing them on a path toward citizenship. And I think that is something that we can find consensus on and it is one of the ways to address the issue of chain migration.
Rubio’s suggestion for a DREAM Act would mean that potentially millions of kids who grew up in the United States without the right papers would be forced to be non-voting residents of their home country. Rubio may be using the rhetoric of defending Latinos against right-wing attacks, but the Republican policies don’t play out well for Latinos, specifically on the DREAM Act. The Republican presidential candidates are running on extreme immigration policies, and it would take a lot for Latinos to regain trust in the party. Offering a path to second-class citizenship is not exactly the olive branch Latinos are looking for.

Mitt Romney”s “Anti-Immigrant Extremist” Friends: The Worst Kind Of Company One Could Keep
Mitt Romney’s endorsement sheet is beginning to read like a who’s-who of tough talk, anti-immigrant extremists: Former California Governor Pete Wilson, Arizona Sheriff Paul Babeau, and Kansas Secretary of State Kris Kobach, the architect of immigration laws in Arizona and Georgia, have all signed on to his campaign. Unfortunately for Romney, these names alone have the potential to embolden the very community they seek to disempower.
Until this week, Romney was boasting the endorsement of Pinal County Sheriff Paul Babeau, a co-chair of his Arizona campaign. Babeau came to national attention after starring in John McCain’s 2010 “Complete the Dang Fence” ad, part of McCain’s effort to fend off a right-wing primary challenger. Babeau went on to become a frequenter commentator on Fox News. He’s even running for Congress. Then, last week, the Phoenix New Times revealed that Babeau had maintained a multi-year relationship with a Mexican immigrant who he allegedly threatened with deportation if any details of their relationship were to become public. Babeau swiftly stepped down as co-chair of Romney’s Arizona campaign, leaving some big shoes to fill.
Enter America’s self-proclaimed “Toughest Sheriff,” Joe Arpaio. Sheriff Joe, who the Department of Justice recently accused of systematically profiling and abusing Latinos, is busy lining up presidential hopefuls to kiss his ring. On February 13th, Arpaio took to Twitter to announce that he’d received a call from Republican hopeful Newt Gingrich seeking his endorsement. “Nice surprise and what a gentleman he really is,” Arpaio wrote. Then on February 18th he gave a shout out to yet another suitor, tweeting, ”Big week ahead, I’ll be meeting another presidential candidate.” Arpaio doesn’t exactly have a Midas touch— he’s endorsed the failed campaigns of former U.S. Senate candidate J.D. Hayworth, Arizona Senate President Russell Pearce, and Republican drop-out Rick Perry. But polls find that over 30 percent of Republican primary voters are more likely to vote for a candidate if he boasts Arpaio’s endorsement.
Ever the desperate salesman, Mitt Romney continues to trade Latino general election votes for the votes of his primary’s fringe electorate. No one should understand this trade-off better than Pete Wilson, a godfather of the anti-immigrant movement. In 1994, then-Governor Wilson led the fight for Proposition 187, the “Save Our State” initiative, which would have barred undocumented immigrants from access to social services like health care and public education. But then the effort boomeranged: the Republican push for Prop 187 galvanized the state’s Latinos, inspiring drives for naturalization and voter registration and turnout that turned Reagan’s state into a Democratic stronghold. In a general election, Pete Wilson doesn’t have enough fans to offset the potential cost of his endorsement. Ask Meg Whitman. She flaunted Wilson as chairman for her 2010 gubernatorial campaign as a way to build conservative credibility in a tough primary. Then she spent the general election unsuccessfully trying to distance herself from Wilson when he became a liability with Latino and independent voters. That’s of no immediate concern to Romney. Facing a primary that just won’t end, he’ll do what it takes to get some of California’s proportional delegates, no matter the cost.
If Romney’s other endorsements are any indication, there can be no doubt that he’d gladly swap general election Latino votes for 32 percent of Republican primary voters, even in a state where he has no real competition. Democrats are already portraying Romney as having two faces: wooing Latino voters out of one side of his mouth and courting anti-immigrant champions out of the other. In advance of last month’s Florida primary, the Romney campaign aired Spanish-language spots aimed at Hispanic voters, while in South Carolina he touted the endorsement of Kobach. Immigration advocates decried the hypocrisy. The problem is that Romney doesn’t see himself that way because he misunderstands the Latino community. Romney believes that he can call the DREAM Act a “handout” and sell Draconian immigration laws to those of us who are citizens by telling us that they only affect those of us who are not. He claims that he’s pro-legal immigration, just anti-illegal immigration, as though that clarifies the issue. What Romney doesn’t realize is that even those Latinos who are American-born or naturalized citizens often come from mixed-status families, learn in mixed-status classrooms, and live in mixed-status communities. For us, the “undocumented” aren’t anonymous; they are people we know and love. For us, the Wilsons, Babeaus, Arpaios and Kobachs of the world aren’t brave problem solvers. They are simply put, the worst kind of company one could keep.

“Self Deportation”: Attrition Through Enforcement Is A Real Thing, And It Isn’t Pretty
Mitt Romney unveiled a novel solution for illegal immigration during Tuesday night’s GOP debate, saying that he’d rely on “self-deportation” to reduce the number of unauthorized immigrants in the US.
Or at least it sounded novel. As my colleague Clara Jeffery notes, while “self-deportation” might sound like something you don’t want your parents to catch you doing, it’s actually an old euphemism for an immigration strategy of “attrition through enforcement.” What “self-deportation”—the favored approach to immigration of the GOP’s right-wing—actually means is making life so miserable for unauthorized immigrants that they “voluntarily” leave. Here’s Mark Krikorian of the Center for Immigration Studies (the anti-immigrant think tank that tried to mainstream the “terror baby” conspiracy theory) explaining the concept in 2005:
Among the other measures that would facilitate enforcement: hiring more U.S. Attorneys and judges in border areas, to allow for more prosecutions; passage of the CLEAR Act, which would enhance cooperation between federal immigration authorities and state and local police; and seizing the assets, however modest, of apprehended illegal aliens.
These and other enforcement measures would enable the government to detain more illegal aliens; additional measures would be needed to promote self-deportation. Unlike at the visa office or the border crossing, once aliens are inside the United States, there’s no physical site to exercise control, no choke point at which to examine whether someone should be admitted. The solution is to create “virtual choke points”—events that are necessary for life in a modern society but are infrequent enough not to bog down everyone’s daily business. Another analogy for this concept to firewalls in computer systems, that people could pass through only if their legal status is verified. The objective is not mainly to identify illegal aliens for arrest (though that will always be a possibility) but rather to make it as difficult as possible for illegal aliens to live a normal life here.
This is the right-wing’s answer to the question of how you deport 11 million unauthorized immigrants: You don’t. You force them to “deport themselves.” Although immigration reform advocates would prefer a solution that involves a path to citizenship for unauthorized immigrants already here, Romney and his top immigration advisers believe they can remove millions of people through heavy-handed enforcement that makes life for unauthorized immigrants intolerable. This approach is notable for its complete lack of discretion and flexibility. Unauthorized immigrant parents with citizen children who need to go to school? Americans who are married to an undocumented immigrant who needs medical treatment? “Self-deportation” hits them all with the same mailed fist.
We can see how this concept has been applied in states like Arizona and Alabama, where local authorities have been empowered to act as enforcers of immigration law. Alabama takes the choke point theory even more seriously than Arizona—everything from enrolling in school to seeking health treatment has been turned into a so-called choke point. The moral, social, and economic consequences of the strategy are secondary to inflicting enough suffering on unauthorized immigrants in order to force them out of the country.
Kris Kobach, the Kansas Attorney General secretary of state who helped write both restrictive immigration laws and recently endorsed Romney, bragged about the impact of the Alabama law after it passed last year:
“There haven’t been mass arrests. There aren’t a bunch of court proceedings. People are simply removing themselves. It’s self-deportation at no cost to the taxpayer. I’d say that’s a win.”
Alabama’s immigration law has actually been such a disaster that the state is trying to figure out a way to repeal parts of the law. But make no mistake, when Romney is discussing “self-deportation,” he’s talking about creating a United States where parents are afraid to register their kids for school or get them immunized because they might be asked for proof of citizenship. He’s talking about the type of country where local police can demand your immigration status based on mere suspicion that you don’t belong around here. “Self-deportation” is just a cleaner, less cruel-sounding way of endorsing harsh, coercive government polices in order to make life for unauthorized immigrants so unbearable that they have no choice but to find some way to leave. The human cost of such an approach, let alone what it might do to American society, is viewed as a price worth paying.

Whose Tea Party Is It?
Newt Gingrich’s brief turn as presidential front-runner was only the latest paroxysm of a tumultuous Republican primary season. What’s going on? Tensions within the Tea Party help explain the volatility of the Republican primary campaign, as candidates seek to appeal to competing elements of the Tea Party with varying success.
For our new book, “The Tea Party and the Remaking of Republican Conservatism,” we interviewed Tea Party activists across the country over a sixteen-month period and found that the movement is not the monolith it is sometimes portrayed as. The conservative political upsurge has grassroots and elite components with divergent interests and goals. Mitt Romney, no favorite of the Tea Party grassroots, is currently pitching his candidacy to Tea Party elites, while Newt Gingrich and other contenders are vying for the rank-and-file Tea Party supporters.
We learned about grassroots Tea Party groups by attending their meetings, interviewing active members and reading hundreds of their websites and message boards. In early 2011, these Tea Partiers had no consistent favorite for the Republican nominee, supporting everyone from Ron Paul to Mike Huckabee to Donald Trump, but they did have one goal in mind for 2012: beating Barack Obama. As one Tea Party member we met in Virginia put it, “we have to get Obama out. Obama and the Communists he’s surrounded himself with.”
In recent weeks, Gingrich has reached out to these grassroots Tea Party voters, older white middle-class conservatives who remember him from his glory days as an insurgent Democrat slayer. Gingrich’s aggressive style and blistering critiques of the Democrats resonate with Tea Party voters. Gingrich has accused Democrats of socialist tendencies for decades; as early as 1984, he claimed that a Democratic member of the House of Representatives was distributing “communist propaganda.”
But Gingrich has also tapped into what we identified as Tea Partiers’ most fundamental concern: their belief that hardworking American taxpayers are being forced to foot the bill for undeserving freeloaders, particularly immigrants, the poor and the young. Young people “just feel like they are entitled,” one member of the Massachusetts Tea Party told us. A Virginia interviewee said that today’s youth “have lost the value of work.”
These views were occasionally tinged with ethnic stereotypes about immigrants “stealing” from tax-funded programs, or minorities with a “plantation mentality.” When Gingrich talks about “inner-city” children having “no habits of working,” he is appealing to a widely held sentiment among the Tea Party faithful.
What’s more, Gingrich’s comparatively humane stance on immigration reform — offering immigrants a path to legal status with the approval of local community members — is more palatable to Tea Party members than one might expect. First, it reduces federal authority over a key Tea Party issue, a policy that appeals to the “states’ rights” conservatives who fill the seats at Tea Party meetings. Crucially, Gingrich is not offering, as Rick Perry did, taxpayer-funded benefits to unauthorized immigrants, a policy described by one Tea Party activist we spoke to as money wasted on “moochers.”
Immigration was always a central, and sometimes the central, concern expressed by Tea Party activists, usually as a symbol of a broader national decline. Asked why she was a member of the movement, a woman from Virginia asked rhetorically, “what is going on in this country? What is going on with immigration?” A Tea Party leader in Massachusetts expressed her desire to stand on the border “with a gun” while an activist in Arizona jokingly referred to an immigration plan in the form of a “12 million passenger bus” to send unauthorized immigrants out of the United States.
In a survey of Tea Party members in Massachusetts we conducted, immigration was second only to deficits on the list of issues the party should address. Another man, after we interviewed him in the afternoon, took us aside at a meeting that evening to say specifically that he wished he had said more about immigration because that was really his top issue.
Tea Party activists are not uniformly opposed to government social programs, however. Our interviewees were very anxious that Social Security and Medicare be maintained. “I’ve been working since I was 16 years old, and I do feel like I should someday reap the benefit. I’m not looking for a handout. I’m looking for a pay out of what I paid into,” one Tea Party member explained. Their support for these programs was not just self-interested; several Tea Partiers said they would take a benefit cut if the savings stayed in the Social Security fund. One woman, a regular attendee of her local Tea Party, offered solutions that seemed totally out of keeping with the stereotypes of Tea Party members as knee-jerk tax cutters. After suggesting that any benefit cuts be aimed at those in the “upper income brackets,” she went so far as to say that she “would not mind a tax increase to try to get the country right again.”
Given the Tea Partiers’ abiding support for two key pillars of the American social safety net, it is no surprise that Gingrich’s plan for a Social Security overhaul is aimed only at young workers, not the retirees filling the rows at Tea Party meetings. But Mitt Romney has taken a different path, expressing his support for the Ryan budget plan that features huge tax cuts for the very wealthy paid for with relatively near-term Medicare cuts.
Many observers have suggested that Romney’s support for the unpopular Ryan budget was a misstep. But considered from another perspective, Romney is making a strategic move to aim for a different part of the Tea Party, the free-market elites and funders.
Long-standing elite advocacy organizations that rallied around the Tea Party label in 2009 and 2010, like FreedomWorks and Americans for Prosperity, were crucial to the Tea Party phenomenon, providing funding for national rallies and conservative candidates, and focusing attention on well-practiced spokespeople to represent the Tea Party in the media and in Washington. But the national advocates have only tenuous ties to the grassroots Tea Party groups and are in no way accountable to the Tea Party at the local level. Their policy agenda is different as well. FreedomWorks and Americans for Prosperity have sought major reforms of Social Security and Medicare for years — long before the Tea-Party label gained currency.
Cutting these programs is unlikely to appeal to the grassroots Tea Party, but local Tea Party members are only marginally aware of the national advocacy occurring in their name. Asked about national groups, local activists tended to shake their heads in confusion. In a typical complaint, one leader of a local Arizona Tea Party group told us, “sometimes when you sign up for a site, it puts out tentacles,” sharing information so that visitors receive a bewildering array of emails from other groups.
Tea Partiers also receive their information primarily, or in some cases exclusively, from Fox News and talk radio, outlets that are unlikely to turn a critical eye on conservative advocacy organizations. This lack of connection between grassroots and elite Tea Party-ism may allow Romney to placate the wealthy opponents of Social Security and Medicare without irking the Tea Party base.
For both Romney and Gingrich, appealing to the Tea Party is a bit of a stretch. Both men have been around too long not to have taken positions too moderate for the new, extreme-right, tea-infused Republican Party. In particular, there is little Romney can do to make Tea Party activists enthusiastic about him during the primary season. Though his claims to a businessman’s expertise should appeal to the many small business owners in the Tea Party, no one we interviewed had good things to say about anything but his potential electability.
But Republican primary voters, including those in the Tea Party, want to win the 2012 general election. As one Tea Partier told us, Romney is “not quite conservative enough – but we have to get Obama out.” They will overlook past heresies, even “RomneyCare,” in a candidate they believe can win the general election.
As long as the big Tea Party funders back Romney’s candidacy or stay on the sidelines, Romney has a good chance of riding out other candidates’ surges in popularity and using his vast organizational and financial advantages to beat out his opponents for the Republican nomination. At that point, the grassroots Tea Party members will have little influence; instead, momentum will shift even further towards the elite policy advocates. And these well-funded groups, which benefited from the Tea Party’s momentum in the first years of the Obama administration, will continue to seek their own policy goals, including those at odds with the positions of local Tea Partiers.

With “Radicalized Right-Wing Obstructionism”, Divided Moderates Will Be Conquered
The deficit that should most worry us is a deficit of reasonableness. The problems the United States confronts are large but not insoluble. Yet sensible solutions that are broadly popular can’t be enacted.
Why? Because an ideological bloc that sees every crisis as an opportunity to reduce the size of government holds enough power in Congress to stop us from doing what needs to be done.
Some of my middle-of-the-road columnist friends keep ascribing our difficulties to structuralproblems in our politics. A few call for a centrist third party. But the problem we face isn’t about structures or the party system. It’s about ideology — specifically a right-wing ideology that has temporarily taken over the Republican Party and needs to be defeated before we can have a reasonable debate between moderate conservatives and moderate progressives about our country’s future.
A centrist third party would divide the opposition to the right wing and ease its triumph. That’s the last thing authentic moderates should want.
Let’s look at the record, starting with the congressional supercommittee’s failure to reach agreement on a plan to reduce the fiscal deficit. It’s absurd to pretend that we can shrink the deficit over the long term without substantial tax increases.
No matter how hard policymakers try to trim spending on Medicare, its costs will go up for many years simply because so many baby boomers will be retiring between now and 2029. Moreover, employers will keep cutting back on coverage for their workers as long as the price of insurance continues to go up.
However we manage it, in other words, government will be required to pay an ever larger share of our nation’s health-care bills. That means the government’s share of the economy is destined to rise — unless we decide to leave a large part of our population with little or no protection against illness.
The least we can do under those circumstances is to repeal the tax cuts for the wealthy enacted under President George W. Bush. Yet the only revenue conservatives on the supercommittee put on the table involved $300 billion, most of it from ill-defined tax reforms, in exchange for lower tax rates on the rich and making something like $3.7 trillion worth of tax cuts permanent.
Progressives have already made clear that they are willing not only to increase revenue but also to cut Medicare costs. The Obama health-care law did both, and it was attacked by Republicans for doing so. Democrats on the supercommittee offered substantial entitlement cuts. But they rightly refused a deal that would squander years of future revenue in the name of keeping taxes low on the wealthiest Americans.
What might a reasonable budget argument look like? Progressives would propose fewer spending cuts in exchange for tax increases that would fall mainly on the wealthy: higher rates on top incomes, capital gains and estates, along with a financial transactions tax. Conservatives would counter with larger spending cuts coupled with taxes on consumption rather than on investment. Out of such a debate might come a sensible deal, based on a shared acknowledgment that long-term balance requires both thrift and new revenue.
In the meantime, a broad range of economists agree that America’s sputtering jobs machine needs a sharp and quick jolt. It is unconscionable that in the face of mass unemployment, Republicans continue to foil measures to spur employment, including an extension of the payroll tax holiday. How can conservatives declare simultaneously that (1) it would be a terrible crime to raise taxes on the rich in the long term, and (2) it is an act of virtue to raise taxes on the middle class immediately? Has class warfare ever been so naked?
Then there is immigration. Common sense says there is no way the United States can or should deport some 11 million illegal immigrants. But when Newt Gingrich spoke of this reality — and suggested that conservatives ought to worry about how deportations would break up families — he was said to have committed a gaffe that will end his ride as the Republican front-runner. In today’s GOP, it’s becoming dangerous to be sensible.
We need moderation all right, but a moderate third party is the one way to guarantee we won’t get it. If moderates really want to move the conversation to the center, they should devote their energies to confronting those who are blocking the way. And at this moment, the obstruction is coming from a radicalized right.
