“Disturbing Events From ‘Behind The Scenes'”: “Criminal Referral Smear”; What Trey Gowdy Knew — And When He Knew It

Suspicion grows that the leaks behind the bungled New York Times “criminal referral” story came from the Republican side of the House Select Committee on Benghazi chaired by Rep. Trey Gowdy (R-SC). First Times public editor Margaret Sullivan hinted that the original “tip” came from “Capitol Hill.” Over the weekend, Rep. Elijah Cummings (D-MD), ranking Democrat on the select committee, revealed proof that Gowdy knew of the (utterly non-criminal) referrals by the inspectors general for the intelligence community and the State Department to the Justice Department, in advance.

Criticizing the stumbling scramble to publish without checking what turned out to be inaccurate information, Cummings complained in an article on the Huffington Post of “a series of inaccurate, partisan leaks designed to attack former Secretary of State Hillary Clinton. Many of these attacks rely on anonymous sources to describe – and often mischaracterize – documents reporters have not seen.” The Maryland Democrat’s post ought to have received much more attention than it has received so far. It offers a disturbing perspective on events from “behind the scenes,” on the day that the Times broke its ill-fated scoop:

On Thursday morning at 10:27 am, my staff received a copy of a letter sent from Select Committee Chairman Trey Gowdy to FBI Director James Comey. To the best of my knowledge, that letter has never been made public.

Chairman Gowdy’s letter warned the FBI Director that the Chairman was aware of a “formal referral” that was made to the FBI “by impartial officials within the Executive Branch” related to “classified information.”

I had no idea then — and still have no idea today — how Chairman Gowdy knew about this referral before everyone else, and his office has refused to respond to my staff’s inquiry.

At 12:03 p.m., the office of the State Department Inspector General (IG) sent an email to staff on several committees with a copy of a memorandum describing its joint work with the Intelligence Community IG reviewing the FOIA process for Secretary Clinton’s emails. This memo did not mention any sort of referral to the Department of Justice.

At 2:30 p.m., my staff and I had a previously scheduled meeting with the State Department IG, so we asked him about Chairman Gowdy’s letter and whether he was aware of any referral.

He told me he never asked the Justice Department to launch a criminal investigation of Secretary Clinton’s email usage. Instead, he said officials from the Intelligence Community IG — not the State Department IG — notified the FBI and Congress that they had identified information they believed was classified in several mails that were part of the FOIA review.

Importantly, the State Department IG made clear that none of those emails had been marked as classified when Secretary Clinton received them.

At 5:44 p.m. that evening, the Intelligence Community IG’s office sent a notification to the Intelligence Committees describing — for the first time — its referral to the FBI. This notification detailed a counter-intelligence referral, not a request for a criminal investigation of Secretary Clinton.

When I woke up on Friday morning and read the news, I was stunned. I immediately issued a public statement and released the congressional notification from the Intelligence Community IG.

I then got on the phone with both IGs from the State Department and the Intelligence Community. They confirmed that they never asked the Justice Department to launch a criminal investigation of Secretary Clinton’s email usage. Instead, they said this was a “routine” referral, and they said they had no idea why the Times story was so flawed.

But Cummings has his own ideas about that problem — and wonders why the Times reporters never checked with him or other Democrats on the committee, who could have corrected the ruinous mistake before publication. Combined with the timeline posted last week by the Clinton campaign’s Jennifer Palmieri, the Cummings post indicates just how irresponsibly this story was handled by the paper of record. Yet so far, the Times‘ editors and proprietors have offered nothing much beyond that public editor’s note — no apology for smearing Clinton, no accountability for any reporter or editor. Just an implausible excuse or two and a deflection of responsibility to those naughty sources, whose identities will of course remain protected. So why shouldn’t they perpetrate more inaccurate smears? They will.

Meanwhile, reporters covering the House might start asking some tough questions of Gowdy and the man who appointed him, Speaker John Boehner. Most likely, they never will.

“Gross Failures In Journalism”: The Media Needs To Get Over Its Blind Hatred Of Hillary Clinton

Last week, Hillary Clinton got in one of her periodic fights with the press, extending a long-running battle that has been raging for decades now. In the media corner was The New York Times, which beclowned itself with a false report alleging that Clinton was about to be the subject of a criminal inquiry over emails she sent while at the State Department.

The episode is the latest evidence that the Times needs to take a hard look at its Clinton coverage. But there’s also a lesson here for the broader mainstream media, which needs to get over its blind hatred of the Clintons. It not only leads to gross failures in journalism, but ends up being a massive distraction from the actual scrutiny Hillary Clinton deserves.

It’s worth noticing what a stupendous journalistic faceplant this was. As Kevin Drum points out, pretty much every single word in the original headline was wrong:

Clinton was not a target. The referral was not criminal. The emails in question had not been classified at the time Clinton saw them. When the dust settled, it appeared that the whole thing was little more than a squabble between State and CIA over whether certain emails that State is releasing to the public should or shouldn’t be classified. In other words, just your garden-variety bureaucratic dispute. [Mother Jones]

This isn’t the first time the Times has printed a gravely mistaken story suggesting ethical lapses on the part of a Clinton running for president. Back in 1992, Times reporter Jeff Gerth wrote a story about how the Clintons were involved in a seemingly shady real estate deal called Whitewater. It suggested that the Clintons had gotten a big share of potential profits without putting up much cash, and that Bill Clinton had used his power as Arkansas governor to protect a savings and loan owned by a Whitewater associate from being closed down by the feds.

Just as with the most recent story, about every part of Gerth’s account was wrong or misleading, as Joe Conason and Gene Lyons wrote in their book on the Clinton impeachment, The Hunting of the President. The Clintons actually lost a ton of money on the deal, and the Arkansas government had recommended to the feds that the S&L be liquidated.

But that was only the start of hundreds of Whitewater articles and reports. The political press ditched any notion of objectivity and pursued the Clintons with a deranged, prudish zealotry. These journalists never actually revealed any concrete wrongdoing, but the incessant repetition convinced many that the Clintons must have done something wrong — which eventually led to the appointment of a special prosecutor. The rest is history.

Not much has changed. Much of the centrist press still quite obviously loathes the Clintons. Ron Fournier, the id of centrism, knocks her PR strategy (that is, writing a devastating, accurate takedown of the Times report), insists where there’s smoke there’s fire, and generally makes dim excuses to keep hounding her.

On the other hand, the Times’ atrocious report was caught out almost immediately. Unlike the 90s, there is a reasonably powerful left-leaning press today, and fact-checking can spread rapidly through social media. It is much harder to get away with that kind of lazy hack job on a prominent candidate.

It’s hard to figure out how the Times could have been so incredibly sloppy. But I suspect the traditional media suspicion of the Clintons played a big role. The Clintons’ reputation is so bad that reporters tend to discard their vaunted skepticism the moment a bad piece of news about them comes over the transom.

And that, as we see, leads to disastrous mistakes. A story that confirms a strong prior belief is exactly the point at which journalists ought to be at their most skeptical.

And perhaps more importantly, this annoying, narcissistic media spectacle is proving to be an enormous distraction from the important task of actually reporting on Hillary Clinton. There are all manner of things to cover, from her poor choice in advisers, to her foreign policy views, and yes, even the deleted emails from her years at the State Department. Just make sure to actually, you know, check the facts before hitting publish.

“Ignorance Never Takes A Break”: Conservatives Launch Pre-Emptive Attacks On Sec. Julian Castro

One year ago, Julian Castro (former Mayor of San Antonio, TX) was sworn in as the Secretary of the Department of Housing and Urban Development. Many people (including this writer) assume that he is the most likely prospect to be Hillary Clinton’s running mate in 2016. Apparently a lot of conservatives share that assumption because lately they have launched some interesting attacks on Castro.

First of all, there was Samuel Rosado writing in the National Review that Julian Castro was never a “real” mayor.

Julian Castro is often introduced as the former mayor of San Antonio, Texas. Presumably, journalists and the general public think of this as a major accomplishment and a useful dose of executive experience — it is, after all, a city of 1.4 million people. But San Antonio doesn’t work like most high-profile American cities, such as New York and Chicago, which are largely run by their mayors. It runs under the council-manager form of government, meaning the city council appoints a city manager who actually handles the day-to-day operations of government.

It is true that cities around the country vary in terms of the organizational structure of their government. But working with a city manager (who usually handles administrative tasks) in no way strips a mayor of his/her title – much less most of the associated responsibilities.

I would also point out that Sec. Castro served on the San Antonio City Council for four years and is rightly credited with some significant accomplishments as Mayor.

In 2010 Castro created SA2020, a community-wide visioning effort. It generated a list of goals created by the people of San Antonio based on their collective vision for San Antonio in the year 2020. SA2020 then became a nonprofit organization tasked with turning that vision into a reality.

In 2010 he established Cafe College, which offers college guidance to San Antonio area students. In 2012 he led a voter referendum to expand pre-kindergarten education.

But when it comes to ridiculous critiques, it will likely come as no surprise to anyone that Rep. Steve King tops the charts.

As I have often said, there are times when the only appropriate response to nonsense like that is to point and laugh. Apparently someone at Wikipedia had the same reaction. Mediaite caught the screen grab with King’s name changed to Esteban Arnaldo “Steba” Rey.

So far the criticism of Castro has been pretty laughable. If he gets the nod as the VP nominee, I’m sure it will only escalate.

“The ‘Clinton Rules’ Of Journalism”: Why Clinton-Bashing Articles Are A Golden Goose For Her Detractors

We’re beyond corrections now.

The New York Times issued a lengthy editors’ note Tuesday regarding the paper’s tangled, bungled coverage of Hillary Clinton’s emails, which, they conceded, “may have left readers with a confused picture.”

That’s a rather gentle gloss on the media tempest that made landfall Thursday night, after an article that purported to break news of a criminal investigation into Clinton, was published on the Times site and front page Friday morning, and was the subject of an email blast.

But then the Times silently amended the story, whittling the headline, and the story’s claims, down from “Criminal Inquiry Sought in Hillary Clinton’s Use of Email” to “Criminal Inquiry Is Sought in Clinton Email Account,” and then finally, “Inquiry Sought in Hillary Clinton’s Use of Email,” where it stands as of this writing.

Of course by then, it had been copied, repeated, and aggregated all over the Web.

Per Reuters:

The New York Times originally reported that two government inspectors general had asked the Justice Department to open a criminal investigation into Clinton’s use of her private email account

It altered its report on its website overnight without explanation to suggest she personally was not the focus of a criminal referral.

Then, the Justice Department said the inspectors general had requested a criminal investigation into the emails, before backtracking and saying that there was a request for a probe but not a criminal one.

When the crux of the original story — that Clinton was under criminal investigation — was tweaked to indicate that the investigation was not criminal in nature, nor was Clinton the target, the Times editors quietly corrected it on the online edition of the paper, after it had been online for a few hours, with none of the fanfare that attended the original story’s publication: no email blast; no correction.

Times public editor, Margaret Sullivan, published a long note outlining exactly how and why Times reporters fouled it up. She concluded that, in the Times’ haste to publish an earth-shattering exposé on the Democratic frontrunner, the paper of record had rushed to print an overly sensationalistic story that relied on dubious sources. She also lamented editors’ decision to discreetly revise the story without first issuing a proper correction. Her prescription: “Less speed. More transparency.”

National Memo editor Joe Conason argued Monday that:

Sullivan lets the Times editors and reporters off a bit too easily, allowing them to blame their anonymous sources and even to claim that the errors “may have been unavoidable.” What she fails to do, as usual, is to examine the deeper bias infecting Times coverage of Hillary and Bill Clinton — a problem that in various manifestations dates back well over two decades.

It seems clear that the Times article was written in accordance with the “Clinton rules” of journalism — which, as articulated by Jonathan Allen, state that “the scoop that brings down Hillary Clinton and her family’s political empire” is the primary goal for journalists. Clinton rules endorse the use of tabloid-worthy headlines (“Criminal!”) and dubious sources, presume guilt, and operate under the assumption of a massive Clintonian conspiracy of widespread collusion and ill intent.

The Times finally ran two belated, garrulous corrections — the first on Saturday, the second on Sunday — which together read:

An article and a headline in some editions on Friday about a request to the Justice Department for an investigation regarding Hillary Clinton’s personal email account while she was secretary of state misstated the nature of the request, using information from senior government officials. It addressed the potential compromise of classified information in connection with that email account. It did not specifically request an investigation into Mrs. Clinton.

It was a “security referral,” pertaining to possible mishandling of classified information, officials said, not a “criminal referral.”

These are not corrections on the order of “Mr. McDougal’s name is actually MacDougal,” and it’s baffling that they would be treated as such, quietly airbrushed onto the site like fixing a typo. Which, of course, became the next phase of the story.

It didn’t help that the Times reporter who wrote the piece conceded that the corrections were “a response to complaints we received from the Clinton camp that we thought were reasonable.” This is how a Clinton-bashing story evolves from one of sloppy journalism to the way Hillary Clinton muscled a media titan into reporting what she wanted them to report.

Of course this episode is already becoming subsumed into the vast Clinton conspiracy, as when S.E. Cupp accused the Times of altering its headline “because Hillary asked them to.” A Breitbart headline similarly proclaimed: “New York Times Stealth-Edits Clinton Email Story At Her Command.”

As Sullivan said, “you can’t put stories like this back in the bottle – they ripple through the entire news system.”

Clinton-bashing articles are the gifts that keep on giving, a veritable golden goose of insinuation, innuendo, and dishonesty: Even once the initial specious recriminations have crumbled, the storm of media attention and confusion that follows creates a feedback loop that reinforces Clinton’s detractors’ view of her as a media-manipulating mastermind. And for voters — even those who support Clinton — it’s a reminder that this kind of thing is just going to happen again and again.

“Enthusiasm Does Not Equal Organization”: Decentralized Political Organizing Could Be A Problem For Team Sanders

Journalists are just now coming to grips with this, and there’s always a danger on such subjects of buying campaign spin. But there does seem to be a growing recognition that Hillary Clinton’s campaign differs from its 2008 predecessor because of a pervasive emphasis on organization-building in the states.

WaPo’s Matea Gold and Anu Narayanswamy come at the story from a different angle today, noting that HRC’s high “burn rate” for contributions is being driven by systemic investments in campaign infrastructure:

Details in the newly filed reports paint a picture of a campaign harnessing the latest technological tools and constructing the kind of deep ground operation that Clinton lacked in her 2008 bid. That kind of organizing capability has gained importance as Sen. Bernie Sanders (I-Vt.), one of Clinton’s rivals for the Democratic nomination, has drawn large crowds and gained ground in polls….

Clinton’s operation is paying rent in 25 cities across nine states, Federal Election Commission filings show. Along with about 340 staff members on the payroll, the campaign had hired nearly 60 field organizers by the end of June.

“It’s a sign that she’s approaching the campaign differently than the last time,” [David] Axelrod said. “They didn’t have as thoughtful an approach to laying the foundation for that campaign, and it ended up hurting them when it ended up being an organizational fight.”

At the “Politico Caucus” subsite, where there’s a sort of large focus group of early-state “Insiders,” the judgment is even clearer, per Katie Glueck:

Asked to assess what Clinton is doing right, and wrong, in their states, almost every Caucus participant — Democrats and Republicans — answered the question of what she’s doing right by saying Clinton has pulled together a strong staff and is doing all of the little things right when it comes to being organized for the early state contests and beyond.

“Doing right: building and investing in a monster field operation. Scares the hell out of this Republican knowing that many of those staff will easily pivot to organizing for the general election,” an Iowa Republican said.

“HRC is building a campaign rooted in organizing,” added a New Hampshire Democrat. “I’ve been to several house parties & campaign events and there are always new faces present — faces that weren’t involved in the 2012 presidential race. There is absolutely no one taking this primary race for granted whatsoever.”

“The organizing strategy is straight out of the Obama 2007 playbook,” an Iowa Democrat added. “The crew is enthusiastic and well-trained on the basics (pledge cards, pledge cards, pledge cards). Sanders and O’Malley will find it impossible to compete with the sheer size of the organizing.”

In New Hampshire, in particular, Democrats also largely lauded Clinton for visiting more rural parts of the state that are often overlooked. And across the board, her staff was praised for keeping cool amid the rise of Bernie Sanders.

Meanwhile, there’s also some recognition that the impressive enthusiasm that suffuses Bernie Sanders’ campaign is not automatically transmittable into a good organization, helpful as it is. At TNR earlier this week, Suzy Khimm suggested that the Occupy-influenced passion for decentralized political organizing could be a problem for Team Sanders:

Sanders is betting that passion will enable him to surmount the serious obstacles he faces in broadening his base of support. But that also means the campaign needs to find a way to corral popular enthusiasm into more traditional, on-the-ground organizing if Sanders wants a real shot at expanding his base beyond largely white, liberal enclaves. That means convincing more supporters to embrace a more centralized, hierarchical type of organizing, while still preserving the authentic, grassroots populism that Sanders embodies for his fans.

Iowa will be the acid test of this challenge. Caucus rules place an emphasis on local organizers knowing exactly what is expected of them in almost any circumstance, within the rubric of a Caucus Night strategy with some central direction. The epitome of the organization-outbids-enthusiam hypothesis occurred in 2004, when Howard Dean’s armies of orange-hatted volunteers may have done more to alienate than to organize Iowa Democrats, leading to a disastrous third-place finish despite strong poll numbers and an endorsement from Tom Harkin.

It’s all hypothetical at this point, of course. But neither crowd sizes nor expenditure numbers precisely capture the kind of qualities a campaign needs to win in a place like Iowa.
