“Same Monstrous Reasoning That Defended Slavery”: The U.S. ‘Right’ To Own Guns Came With The ‘Right’ To Own Slaves
For most of the last two centuries, Europeans have been puzzling over their American cousins’ totemic obsession with guns and their passion for concealed weapons. And back in the decades before the American Civil War, several British visitors to American shores thought they’d discerned an important connection: people who owned slaves or lived among them wanted to carry guns to keep the blacks intimidated and docile, but often shot each other, too.
In 1842, the novelist Charles Dickens, on a book tour of the United States, saw a link between the sheer savagery of slave ownership and what he called the cowardly practice of carrying pistols or daggers or both. The author of Oliver Twist listened with a mixture of horror and contempt as Americans defended their utterly indefensible “rights” to tote guns and carry Bowie knives, right along with their “right” to own other human beings who could be shackled, whipped, raped, and mutilated at will.
As damning evidence of the way slaves were treated, in his American Notes Dickens published texts from scores of advertisement for the capture of runaways. Often these public notices described the wanted men and women by their scars. One especially memorable example:
“Ran away, a negro woman and two children. A few days before she went off, I burnt her with a hot iron, on the left side of her face. I tried to make the letter M.”
Dickens also compiled a list of several shooting incidents, not all of them in the South: a county councilman blown away in the council chamber of Brown County, Wisconsin; a fatal shootout in the street in St. Louis; the murder of Missouri’s governor; two 13-year-old boys defending their “honor” by dueling with long rifles, and other examples.
What could one expect, he asked, of those who “learn to write with pens of red-hot iron on the human face” but that they carry guns and daggers to use on each other. “These are the weapons of Freedom,” Dickens wrote with brutal irony. “With sharp points and edges such as these, Liberty in America hews and hacks her slaves; or, failing that pursuit, her sons devote themselves to a better use, and turn them on each other.”
When Dickens was writing in the 1840s, remember, keeping Negro slaves was defended as a Constitutional right with the same vehemence that we hear today when it comes to keeping and bearing arms, and perhaps with more foundation. The original U.S. Constitution was built on an explicit compromise (Article 1, Section 2, Paragraph 3) that allowed slave-holding states to count human chattel, described as “other persons,” as three-fifths of a human being for purposes of taxation and state representation in the House, but allowed them no rights as human persons whatsoever.
The Second Amendment, adopted a couple of years later as part of the Bill of Rights (of free white people), was essentially written to protect the interests of Southerners in the states that formed militias—often known as “slave patrols”—to crush any attempt at what was called, in those days, a “servile insurrection.” That’s why the full text of the Second Amendment reads:
“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
To keep slaves in slavery, you needed militias and they needed to be armed. Such is the fundamental “right” assured by the Second Amendment.
Dickens, who saw a lot that he disliked about America, but disliked slavery and the irrational and immoral thinking behind it the most, wrote quite correctly that there was a substantial, stubborn class of people “who doggedly deny the horrors of the system, in the teeth of such a mass of evidence as never was brought to bear on any other subject.”
A few years later, after the messianic abolitionist John Brown tried and failed to start a slave uprising by attacking the Federal arsenal at Harper’s Ferry in 1859, Southern paranoia reached new heights, and so did gun sales.
“I do not exaggerate in designating the present state of affairs in the Southern country as a reign of terror,” wrote British Consul Robert Bunch in Charleston, South Carolina, the epicenter of secession and slavery. “Persons are torn away from their residences and pursuits, sometimes ‘tarred and feathered,’ ‘ridden upon rails,’ or cruelly whipped; letters are opened at the post offices, discussion upon slavery is entirely prohibited under penalty of expulsion, with or without violence, from the country.”
Bunch, the central figure in my recent book Our Man in Charleston: Britain’s Secret Agent in the Civil War South, noted that “on the part of individuals the sense of danger is evinced by the purchase of fire-arms, especially revolver pistols, of which very large numbers have been sold during the last month.”
In 1861, the great British war correspondent William Howard Russell, traveling through the South in the early days of the Civil War, was as bemused as he was appalled by what passed for “dueling” in Mississippi, which amounted to little more than random, often drunken murders. One resident told him “without the smallest animus, and in the most natural way in the world … tale after tale of blood, and recounted terrible tragedies enacted outside bars of hotels and in the public streets close beside us.”
It is a grim irony, therefore, that the legal precedents set in the antebellum South are still with us today, embedded in recent federal court rulings that make it easier and easier for more people to carry guns, as Fordham University historian Saul Cornell and New York University law professor Eric M. Ruben pointed out in The Atlantic in September.
As Cornell and Cohen made clear, “gun-rights advocates find themselves venerating a moment at which slavery, honor, violence, and the public carrying of weapons were intertwined.”
Back in the day, what Dickens, Russell and Bunch understood was a basic truth that seems to have escaped our contemporary legislators and jurists, just as it did those of the slave-holding South. As Russell observed in Mississippi, the government seemed unable and unwilling to rein in gun violence, and the consequences would be inevitable. “The country in which it is tolerated,” he wrote, “will become as barbarous as a jungle inhabited by wild beasts.”
Day after day, week after week, we see in America the toll taken by gun “rights,” whether the shooters wear beards and veils and murder colleagues in California in some bizarre Bonnie-and-Clyde version of jihad, or shoot people at a Planned Parenthood center in Colorado, or settle scores in Chicago, or slaughter children at a school in Connecticut.
The guns are still with us, and so are the beasts.

“Death Comes From The Gun”: The Tragic Choice We Make About Guns
The common denominator in mass shootings is the use of firearms. Variables such as political ideology, religious fervor and mental illness are motivating factors, but death comes from the gun.
Until our society recognizes that simple truth, the list of place names to which Colorado Springs and San Bernardino were recently added will have no end.
I don’t know which is more obscene, the fact that deadly shooting rampages have become almost routine or the way we so quickly seek to make each incident follow a familiar script.
This process played out Wednesday after 14 victims were gunned down in San Bernardino, Calif. Quickly the speculation began. The carnage happened at an agency that worked with the developmentally disabled — not the kind of public place that terrorists generally choose for attacks. One of the alleged assailants worked for the county health department, which was having a holiday party there, so maybe this was a “disgruntled employee” story line. But there were two shooters, which would be weird in a workplace dispute. And they had Muslim-sounding names. And one of them was described as religiously “devout,” a word often used to imply saintliness in Christians and fanaticism in Muslims. So maybe it was terrorism after all.
But it turns out that one of the alleged shooters was a woman. And that the couple was man and wife. And that before the shooting, they casually dropped their infant off with Grandma, saying they had a doctor’s appointment. Is that what you do when you’re about to kill a bunch of people and then die in a Bonnie-and-Clyde-style shootout with police?
As of this writing, the San Bernardino massacre does not yet conform to one of the politically convenient templates. We’ll make it fit eventually, though. If the motive is deemed to have anything to do with religion, the far right will be able to rail about putting mosques under surveillance and giving the National Security Agency carte blanche to snoop into Americans’ lives. If an office-related grudge was the cause, we can all spend a couple of weeks bemoaning the inadequacy of mental-health services in this country, then do nothing about it.
In the case of the Planned Parenthood mass shooting in Colorado Springs, by contrast, we’ve already retreated to our ideological corners. The accused killer reportedly told police “no more baby parts,” so he must have been inspired by incendiary antiabortion rhetoric. Or else political speech had nothing to do with the atrocity, since the man is clearly deranged.
The truth is surely “all of the above.” What balanced, well-adjusted person is capable of mass murder?
After every incident, someone launches the mental-health discussion but it goes nowhere. Is Congress going to approve some sort of massive new program of screening and treatment? Is the nation ever going back to the days of involuntary commitment? No and no.
Likewise, we can argue to no end about political or religious motivations. I do fear that Muslims will become even more stigmatized, but the Constitution’s guarantee of religious freedom is absolute. Similarly, I deplore extreme political rhetoric that might inspire the vulnerable to commit violence — but the truth is that I probably deplore it more if it’s rhetoric I disagree with.
What we ought to do is stick to the facts, and the facts of these mass shootings are the guns.
More than 30,000 people are killed by firearms in this country each year. We are riveted when the victims number in double digits or hostages are taken or the venue is a place such as Planned Parenthood or Sandy Hook Elementary School, but these killing sprees are but a drop in the bucket of blood.
About two-thirds of deaths by gunshot are suicides. (Cue the mental-health discussion.) How many of these people would find other ways to kill themselves if a gun were not at hand? Some, surely, but not all.
Most of the remaining gun deaths are homicides. Other countries have people with mental illness and disgruntled employees and jihadist preachers and political fanatics of every stripe, but no other developed nation has a body count remotely this high. The only difference is that, in the United States, virtually anyone can amass an arsenal of handguns and assault rifles.
As long as there are as many guns in this country as there are people, as long as we don’t meaningfully restrict firearm purchases or keep track of weapons, we will have mass shootings and individual killings and gun suicides. Tragically, this is the choice we make.

“Not Just An Abstract Idea”: Want To Make Buying Guns Hard? Make It As Tough As Getting An Abortion
It’s not just an abstract idea. It’s a bill going through the state house in Missouri. Mandatory evaluations. Mandatory talks with local leaders. Mandatory accountability. One state rep wants it to happen—and soon.
Hours before shots rang out in San Bernardino, California, leaving 14 dead and 21 injured, Missouri State Rep. Stacey Newman introduced a bill with a simple premise:
What if the process to buy guns in America was as difficult as the one to get an abortion?
A flight crew member turned political consultant, Newman was inspired to run for office after watching her daughter Sophie, then 6, talk about guns and kids on The Rosie O’Donnell Show. After founding a statewide political action committee called Harriet’s List, she was elected to office in 2009, where she’s built a reputation of being tough on firearms.
Her Twitter bio, beneath a pink StandWithPP picture, describes her as: “wife, Mom, Nana, obsessive about reproductive justice, voters rights, women’s rights, equality & of course—gun violence prevention.”
Her bill, first reported on by St. Louis Magazine, isn’t modeled after the general restrictions to getting an abortion in America, but her state’s specifically. Missouri has some of the toughest in the nation. Missouri is one of just a few states operating with fewer than five abortion clinics, and one of four that enforces a 72-hour waiting period.
Beyond the difficulty of getting an abortion in Missouri, Newman’s bill was likely inspired by the level of firearm violence in her state. In 2010 Missouri’s rate of homicide, 5.6 per 100,000 people, was 56 percent higher than the national average—making it the fourth-highest in the nation. Gun deaths in the state have surpassed motor vehicle fatalities since 2013.
When The Daily Beast asked Newman for the impetus behind the bill, she replied, “utter frustration.”
“We were at our wit’s end,” she said. After spending 15 years arguing against guns the traditional way, she decided to get creative.
This bill, she knows, will never get a hearing, much less approved. That’s not the point.
“I’m on the defense team, I understand that,” she said. “A lot of my job is getting the word out there.”
Using an unconventional bill to raise awareness for an issue is a move she’s tried before. In 2012, she introduced a bill that would prohibit men from getting vasectomies unless the procedure was meant to prevent serious injury or death.
After the story gained traction this year, Newman decided to try the radical method again—this time using an issue for which conservatives have an “endless appetite”: abortion access.
There is only one abortion clinic in the entire state. There are at least 3,000 places to buy guns. But what if those numbers were reversed? From attending the funeral of a gun victim under 18, to watching videos of fatal firearm injuries, here is what it would look like if buying a gun in Missouri was as difficult as getting an abortion.
Prior to any firearm purchase in this state, a prospective firearm shall:
— Confer and discuss with a licensed physician the indicators and contraindicators and risk factors, including any physical, psychological, or situational factors, that may arise with the proposed firearm purchase at a firearm dealer located at least 120 miles from the purchaser’s legal residence.
— Submit to an evaluation for the physician to search the individual for indicators and contraindicators and risk factors and determine if such firearm purchase would increase the purchaser’s risk of experiencing an adverse physical, emotional, or other health reaction.
— Listen to oral statement regarding the risks associated with the purchase as well as read and sign a written statement that includes the following:
1. The name and license number of the licensed firearm dealer.
2. The immediate and long-term medical risks associated with firearms, along with medical descriptions and photographs of fatal firearm injuries, as collected by emergency pediatric medical professionals, law enforcement, and prosecutors’ offices.
3. Alternatives to purchasing a firearm, which shall include materials about peaceful and nonviolent conflict resolution.
4. A statement that the dealer is available to answer any questions concerning the purchase of a firearm, together with the telephone number of the dealer that the dealer may be reached to answer any questions the purchaser may have.
5. The prospective firearm purchaser shall obtain written consent of his or her parents in order to qualify for the purchase of any firearm.
— Watch a 30-minute video on fatal firearm injuries, as collected by urban medical professionals, law enforcement, and local prosecutors, and verify in writing he or she viewed the entire video in the presence of a licensed firearm dealer.
— Verify in writing by a licensed physician that the purchaser has toured an emergency trauma center in the nearest qualified urban hospital on a weekend between the hours of 10:00 p.m. and 6:00 a.m. when gun violence victims are present.
— Within 72 hours of a firearm purchase, the prospective firearm purchaser meet with at least two families who have been victims of violence involving a firearm and two local faith leaders who have officiated, within the past year, a funeral of a victim of violence involving a firearm who was under the age of eighteen.
Perhaps if these measures were in place, Newman suggests, some of the more than 32,000 people who die from gun violence in the U.S. each year would be saved. It’s a sentiment echoed eloquently in a now-viral Facebook post by Brian Murtagh, who suggested (like Newman) that we treat young men who want to buy guns the same as we treat women who want an abortion.
“Make him walk through a gauntlet of people holding photos of loved ones who were shot to death, people who call him a murderer and beg him not to buy a gun,” he writes. “It makes more sense to do this with young men and guns than with women and health care, right? I mean, no woman getting an abortion has killed a room full of people in seconds, right?”
With 20 to 30 abortion bills filed each year, Newman wants to capitalize on the momentum. Mirroring the restrictions for abortion access, she says, allowed her to show the “ridiculousness” of both the pro-gun lobby and the pro-life one.
“If this is one way that I can influence a voter to keep this their number one issue, then it’s something,” she said. “It’s something.”

“Prayers Are Not Enough”: Your ‘Prayers’ Should Be For Forgiveness If You Do Nothing – Again
In October, following a deadly mass shooting in Oregon, a visibly angry President Obama delivered a message from the White House: “[T]houghts and prayers are not enough. It’s not enough. It does not capture the heartache and grief and anger that we should feel. And it does nothing to prevent this carnage from being inflicted someplace else in America, next week or a couple of months from now.”
Two months and one day later, an even deadlier mass shooting unfolded in Southern California, prompting Sen. Chris Murphy (D-Conn.) to take the president’s sentiment about “thoughts and prayers” a little further. “Your ‘thoughts’ should be about steps to take to stop this carnage,” the senator said on Twitter. “Your ‘prayers’ should be for forgiveness if you do nothing – again.”
Whether Murphy intended to cause a stir or not, his message sparked some criticism. The Hill published a piece under the headline, “Dem senator criticizes post-shooting ‘prayers.’”
Sen. Chris Murphy (D-Conn.) says people who pray for the victims of shootings should be asking for forgiveness for their inaction. […]
Murphy drew criticism from users on Twitter who said his remarks were “offensive” and demeaning toward religious people.
I think this badly misses the point of an important sentiment. Murphy can certainly speak for himself, but the “prayers are not enough” argument generally has nothing to do with criticizing prayer or those who worship. It has everything to do with the idea that extending thoughts and prayers should be the start, not the end, of a constructive conversation about reducing gun violence.
In other words, when politicians – officials who can take steps to save lives through effective policymaking – offer thoughts and prayers after mass shootings, it’s fine, but it’s also inadequate. The sentiment warrants a follow-up question: “The thoughts and prayers are appreciated, but what’s next?”
If the answer is, “We’ll offer more thoughts and prayers after the next mass shooting,” the response isn’t enough.
The New Republic’s Elizabeth Bruenig made an interesting observation yesterday when highlighting Twitter responses to the San Bernardino shooting from the Democratic and Republican presidential candidates.
If you’re keeping score, that’s prayers, luck, and blessings from Republicans, and gun policy prescriptions from Democrats. One hundred and forty characters isn’t much, to be fair, but I can think of at least one way to split the difference: praying for the strength and wisdom to fix our heinously broken gun policy, for starters.
And that’s ultimately what this is about. I haven’t seen any politicians or public officials suggest people shouldn’t extend thoughts and prayers to the victims and their families, but there seems to be some disagreement over what should follow the well-wishes.
For their part, congressional Democrats have vowed to continue pushing policy measures intended to curtail gun violence and congressional Republicans will very likely continue to reject those proposals reflexively, just as they did this week.

“We’re Ignoring The Real Gun Problem”: Exactly Which Forms Of Gun Violence Do Republicans Support?
Today President Obama spoke briefly to the press about yesterday’s mass shooting in San Bernardino, and he began by noting: “So many Americans sometimes feel as if there’s nothing we can do about it.” But what’s the “it” we’re talking about here? Is it just our spectacular and never-ending run of mass shootings?
Because if it is, we’re on the lesser of our gun problems. I’ll explain why in a moment, but here’s a bit more of what Obama had to say:
“It’s going to be important for all of us, including our legislatures, to see what we can do to make sure that when individuals decide that they want to do somebody harm, we’re making it a little harder for them to do it, because right now it’s just too easy. And we’re going to have to, I think, search ourselves as a society to make sure that we can take basic steps that would make it harder — not impossible, but harder — for individuals to get access to weapons.”
His mention of “legislatures” is an implicit acknowledgement that any movement that happens on gun laws will happen at the state and local level, because congressional Republicans are emphatically against any legislation that would even inconvenience, let alone restrict, anyone’s ability to buy as many guns of as many types as they want. But what are those “basic steps” we can take, and would they actually work? And which kinds of gun violence would they stop?
It’s not surprising that we focus on mass shootings, because they’re sudden and dramatic — the very fact that they’re unusual compared to ordinary shootings is why they’re newsworthy. That’s despite the fact that we have them so often that the victim count has to get pretty high before the national news pays attention. But as this blog has noted before, they’re actually the smaller part of our gun violence problem.
Using the now-common definition of a mass shooting as one in which four or more people are injured or killed, there were 351 mass shootings in the United States this year before San Bernardino, or more than one per day. In those shootings, a total of 447 people died and 1,292 people were injured.
Now let’s use a year for which we have complete data on gun violence, 2013. That year, there were 363 mass shootings resulting in 502 deaths. But overall, 33,636 Americans died from gun violence that year. The number of gun homicides was 11,208. That means that victims of mass shootings made up 1.5 percent of all gun victims and 4.5 percent of gun homicide victims.
Democrats advocating for gun restrictions take the opportunity when there’s a mass shooting dominating the news to say: “This is why we need these restrictions.” Which is understandable as far as it goes, but it still keeps attention on the smaller part of the problem.
Republicans and conservatives, on the other hand, see mass shootings as regrettable but say that any government action to restrict access to guns either won’t stop such shootings, or would represent an unacceptable trade-off in terms of surrendering liberty. Some will instead say, “we need to reform the mental health system. ” But nine out of ten GOP congressmen probably couldn’t tell you a single thing they’d do to reform it, let alone how whatever they support would actually reduce the yearly death toll. There are a couple of related bills in Congress that Republicans support to make some reforms to the mental health system, but they could actually wind up making it easier for some people with a history of mental illness to get firearms.
And of course Republicans don’t address this simple fact: the overwhelming majority of gun homicides in America are not committed by people who have been declared mentally ill. They happen when abusive men kill their spouses or partners, when an argument between neighbors gets out of hand, when an angry ex-employee shoots his boss, when cycles of revenge spiral onward.
But if we only try to talk about guns when there are mass shootings, it allows Republicans to say, “It’s not about the guns — this guy was just crazy!” (Never mind that there are people with mental illness everywhere in the world; only here is it so easy for them to arm themselves to the teeth.)
If Republicans (and I’d put special focus on the presidential candidates, since they’re the ones who can get the most attention) are going to argue that the answer to gun violence is mental health reforms, they ought to be forced to get specific. Exactly which forms do they support? How exactly will each of those forms reduce gun violence? Will any of their ideas do anything to help the 95 percent of gun homicide victims who don’t die in mass shootings?
We’re now getting reports that Syed Farook, one of the shooters in San Bernardino, may have been in touch with an international terrorism suspect, and so this shooting may have been politically motivated (even though he chose to target his co-workers). Had that not been the case, Republicans would have said that all that matters is that Farook was crazy — how could anyone who killed 14 people not be? Now they’ll say that all that matters is that he was a terrorist. But if that turns out to be true, it would bring the number of Americans killed at home in jihadist attacks since 9/11 to 45. That’s about the number of Americans murdered with guns in an average day and half.
