“Not A Single GOP Ripple”: So Much For Politics Stopping At The Water’s Edge

We talked earlier about Sen. Rand Paul (R-Ky.), who brought three television cameras, three photographers, six reporters, a political aide, two press secretaries, and far-right activist David Bossie to Guatemala for a “stage-managed political voyage.” But it appears that wasn’t the only reason for the trip.

Sen. Rand Paul (R-Ky.) told the Guatemalan president the surge of child immigrants flooding the U.S. border this year is a result of President Obama’s policies, not problems in Central America.

“I told him, frankly, that I didn’t think the problem was in Guatemala City, but that the problem was in the White House in our country, and that the mess we’ve got at the border is frankly because of the White House’s policies,” Paul told Brietbart News in an article published Thursday.

According to the report in The Hill, the Kentucky Republican sat down with Guatemalan President Otto Perez Molina for 45 minutes, and the senator discussed politics with the foreign head of state.

“I think what’s happened at the border is all squarely at the president’s lap,” Paul said. “The problem and the solution aren’t in Guatemala. The problem and solution reside inside the White House.”

As a substantive matter, the senator’s position is tough to defend or even understand. President Obama didn’t sign the 2008 human-trafficking measure into law; he didn’t create awful conditions in Central American countries; and he didn’t encourage anyone to lie to desperate families about what would happen to their children. If there’s a coherent explanation for why the White House is to blame, it’s hiding well.

But even putting that aside, since when is it kosher for U.S. officials to travel abroad to condemn U.S. leaders like this?

In fairness, it’s hard to say with certainty exactly what Rand Paul told President Molina during their discussion. I haven’t seen a video of the meeting and all we have to go on is the senator’s own claims.

But if Paul is telling the truth, he traveled abroad, visited with a foreign leader, and spent time trashing the president of the United States.

I seem to remember a time when there were norms that deemed actions like this unacceptable.

Under traditional American standards, some considered it inappropriate to criticize the president when he was overseas. More importantly, when U.S. officials were outside the country, norms called on those officials to refrain from criticizing America’s elected leaders.

I guess that doesn’t apply anymore? These standards were certainly in place during the Bush/Cheney era.

Here’s what happened in 2006 when Al Gore gave a speech at a conference in Saudi Arabia in which he criticized Bush policies towards the Muslim world – as summarized by The New York Times’ Chris Sullentrop:

“As House Democrats David Bonior and Jim McDermott may recall from their trip to Baghdad on the eve of the Iraq war, nothing sets conservative opinionmongers on edge like a speech made by a Democrat on foreign soil. Al Gore traveled to Saudi Arabia last week, and in a speech there on Sunday he criticized ‘abuses’ committed by the U.S. government against Arabs after the attacks of Sept. 11, 2001. A burst of flabbergasted conservative blogging followed the Associated Press dispatch about the speech… The editorial page of Investor’s Business Daily accused Gore of ‘supreme disloyalty to his country’….”

The Wall St. Journal’s James Taranto accused Gore of “denouncing his own government on foreign soil” and quoted the above accusation of “disloyalty.” Commentary was abundant all but accusing Gore of treason for criticizing the U.S. in a foreign land.

I’ll concede that such niceties may be antiquated, and maybe no one cares about this anymore. But if presidential criticism abroad was outrageous in the Bush/Cheney era, why does it barely cause a ripple now?

Update: Just to flesh this out further, in 2010, then-House Minority Leader Eric Cantor (R-Va.) traveled to Israel in the hopes of undermining U.S. foreign policy towards Israel. At the time, this caused quite a stir in foreign-policy circles – it seemed extraordinary for an elected American official to travel abroad in order to work against his own country’s position.Perhaps now, with the Rand Paul example in mind, the practice is becoming more common.

For even more context, note that in 2007, then-House Speaker Nancy Pelosi (D-Calif.) met with Syrian officials in Syria. Republicans, including Cantor, suggested Pelosi may have violated the Logan Act, “which makes it a felony for any American ‘without authority of the United States’ to communicate with a foreign government to influence that government’s behavior on any disputes with the United States.”

One wonders who, if anyone, will raise similar allegations against Rand Paul.

“Taking Cover Behind What’s Left Unsaid”: The GOP’s Midterm Strategy Is As Hollow As Their Ideas Are

The most interesting thing about Senator Mark Pryor’s decision to tout his support for the Affordable Care Act in a well-financed, statewide television ad isn’t that he stands apart from other embattled Democrats this election cycle. It’s that Republicans scrambled to spin the story, insisting to reporters that Pryor couldn’t possibly be running on Obamacare if he won’t refer to the law by name.

This was poorly disguised Calvinball, a standard that Republicans invented for the special case of the ACA. Literally no other members of Congress are expected to refer to the laws they’ve helped pass by name or nickname. Republicans in the aughts weren’t expected to refer to the “Economic Growth and Tax Relief Reconciliation Act,” or “EGTRRA,” or “the Bush tax cuts,” or “the Bush tax cuts for the rich,” no matter how unpopular the moniker became. They ran on having cut taxes, and wanting to renew those tax cuts. And sure enough when President Obama set about trying to let “the Bush tax cuts” expire, he conveniently omitted the popular ones. Which is to say, the vast majority of them. He made those permanent.

Nevertheless, several reporters fell into line. And good for the ref workers. Score one for them.

But if Obamacare is a huge liability for Democrats, why are conservatives and GOP operatives desperate to control the narrative surrounding Pryor’s decision to run on the law? If your opponent’s stepping on rakes, why not just stand back and let him?

The answer is that with respect to both Obamacare and other issues Republicans must rely on diversions from policy and outcomes when expressing their substantive and strategic views. We’ve reached a point in the fight over Obamacare where the best thing Republicans have on their side is the law’s unpopular brand. Particularly in states like Arkansas, where President Obama is widely loathed but his signature law has cut the uninsurance rate nearly in half. It’s deeply silly to argue that Pryor isn’t running on Obamacare unless he refers to it using one of two unpopular slogans. But that’s the argument.

Instead, Pryor says, “I helped pass a law that prevents insurance companies from canceling your policy if you get sick or deny [sic] coverage based on pre-existing conditions.” Maybe he shouldn’t have said anything about “a law” at all, but that’s a niggling, semantic critique. That Republicans working to defeat Pryor are asking reporters to squeeze the word “Obamacare” into this sentence is an admission that they’ve lost the policy fight. They criticize Pryor for eschewing the label, because the label’s just about the only thing they’re comfortable assailing. In this way, they resemble Democrats six and eight years ago, running against the Bush tax cuts (for the rich), knowing that they had no intention of letting anything but the most regressive of those tax cuts expire.

In that sense, the GOP’s obsession with the moniker, and only the moniker, is excellent news for Obamacare’s political durability. But only if the people who cover politics are clear about the implications of the GOP’s rhetoric. Unlike Democrats, who were generally clear about the fact that they planned to make most of the Bush tax cuts permanent, Pryor’s opponent, Representative Tom Cotton, acknowledges that the pre-Obamacare status quo, in which insurers denied coverage to people with pre-existing health conditions, was “broken,” but nevertheless maintains that his goal is to repeal the law that makes that practice illegal.

Cotton repeated that mantra just this week, on the trail with Mitt Romney, who, in an amusing twist, tried to save Cotton from himself. “Tom Cotton is going to make sure that we change Obamacare, making sure that people can keep insurance and those that have pre-existing conditions can have coverage,” Romney said, “but he doesn’t want to see the federal government telling people in Arkansas what kind of insurance they have to have or making it more expensive.” Those are remarkably accommodating priorities. They’re just not ones Cotton is prepared to espouse just yet.

In this way, the politics of Obamacare in Arkansas mirror the politics of legislative brinksmanship in Kentucky. Just two days ago, Mitch McConnell, the embattled Senate minority leader who hopes to become majority leader next year, vowed to lard up appropriations bills with partisan policy riders and allow the president to choose between a veto, precipitating a government shutdown, and a bitter pill. A classic take it or leave it proposition.

McConnell said it would be up to the president to decide whether to veto spending bills that would keep the government open.

Obama “needs to be challenged, and the best way to do that is through the funding process,” McConnell said. “He would have to make a decision on a given bill, whether there’s more in it that he likes than dislikes.”

It wouldn’t be much of a challenge to Obama if McConnell plans to cave the moment the president whips out his veto pen. So the threat is pretty clear. Nevertheless, McConnell’s campaign wasn’t pleased by the ensuing deluge of stories about how a GOP majority would embrace high-stakes confrontations and potentially shut down the government again. And in a very narrow sense they have a pointMcConnell never said he’d shut down the government. Political scientist Jonathan Bernstein, no McConnell partisan, was among those who defended McConnell on this score.

But much like Cotton can’t credibly claim to support protections for people with pre-existing medical conditions when his plan is to repeal Obamacare, McConnell can’t sidestep the implications of his publicly declared strategy. He can’t say “when we’re in power, we’re going to put two and two together,” and then get angry when the headlines say, “McConnell promises four.”

That won’t stop him from trying to, though. And to an unappreciated extent, the broader Republican strategy heading into November is to speak in abstractions, and take cover behind what’s left unsaid.

“McConnell’s Genius Pitch”: Vote GOP, Get Another Shutdown

Senate Minority Leader Mitch McConnell (R-KY) is often hailed as one of Washington’s most tactically cunning politicians, and for the most part it’s true. But McConnell does have a serious political flaw: His tendency to actually tell the truth about those tactics.

Senator McConnell did it again in an interview with Politico, published on Wednesday. Previewing a Republican-controlled Senate, McConnell made it clear that he plans to escalate congressional confrontation with the president, potentially leading to another government shutdown:

In an extensive interview here, the typically reserved McConnell laid out his clearest thinking yet of how he would lead the Senate if Republicans gain control of the chamber. The emerging strategy: Attach riders to spending bills that would limit Obama policies on everything from the environment to health care, consider using an arcane budget tactic to circumvent Democratic filibusters and force the president to “move to the center” if he wants to get any new legislation through Congress.

In short, it’s a recipe for a confrontational end to the Obama presidency.

“We’re going to pass spending bills, and they’re going to have a lot of restrictions on the activities of the bureaucracy,” McConnell said in an interview aboard his campaign bus traveling through Western Kentucky coal country. “That’s something he won’t like, but that will be done. I guarantee it.”

When asked if this strategy could force a government shutdown, McConnell “said it would be up to the president to decide whether to veto spending bills that would keep the government open.”

“He could,” McConnell later said of the probability that President Obama would veto must-pass appropriation bills that are loaded with riders to undo policies that the White House supports. “Yeah, he could.”

It’s difficult to overstate what a horrible idea this is. Although some Republicans may not have noticed it, the last government shutdown was a debacle. The GOP’s hopeless effort to blackmail President Obama into defunding the Affordable Care Act failed miserably, wasting $24 billion and dragging Republicans’ poll numbers into the sewer along the way.

The poll numbers haven’t really recovered, but the combination of President Obama’s own political struggles and a very favorable electoral map still have them set up to make gains in 2014. In fact, Republicans have a good chance of winning the Senate. But promising to ramp up the brinksmanship that caused the last shutdown gives Democrats their best argument for why voters should deny Republicans full control of Congress.

Democrats recognize this, of course; numerous party leaders have already turned McConnell’s remarks against him, and they are certain to resurface in Democratic campaign pitches from now until November. Alison Lundergan Grimes, the Democrat giving McConnell the fight of his career in Kentucky’s Senate race, surely appreciates the minority leader’s Kinsley gaffe most of all.

If Republicans do manage to win the majority and follow through on McConnell’s threat, it would virtually guarantee that they don’t hold control for long. The 2016 Senate map is as favorable to Democrats as this year’s is to the GOP. It will be difficult enough for Republicans to hold on to seats in blue states like Florida, Illinois, New Hampshire, Pennsylvania, and Wisconsin; if they spend the next two years threatening vital services for the sole purpose of making a hopeless ideological stand, it will be nearly impossible.

“Watching A Bad Idea Backfire”: Republican Antics Are Killing The GOP Among Swing Voters

For the last several weeks, the more congressional Republicans talked about suing, and possibly impeaching, President Obama, the more Democrats smiled. Aaron Blake explained why: the Republican antics are “killing the GOP among swing voters.”

The McClatchy-Marist College poll shows political moderates oppose the impeachment of Obama 79 percent to 15 percent. That’s a stunning margin. And not only that, if the House GOP did initiate impeachment proceedings, moderates say it would turn them off so much that they would be pulled toward the Democrats. By 49-27, moderates say impeachment would make them more likely to vote Democratic than Republican in 2014.

But it’s not just impeachment. As we’ve noted before, the House GOP’s lawsuit against Obama’s use of executive orders is turning out to be a political loser too. In fact, it’s not much more popular than impeachment.

Americans say 58 percent to 34 percent that the GOP should not sue Obama, and moderates agree 67-22. Moderates also say by a 50-25 margin that the lawsuit makes them more likely to back Democrats in 2014.

Oops.

Congressional Republicans, by targeting the president so aggressively, probably assumed this would motivate the GOP base, if nothing else, but even that isn’t entirely going according to plan. Greg Sargent, looking at the same data, explained this morning, “The poll also finds that 88 percent of Democrats say the lawsuit would make them more likely to vote for their side, while 78 percent of Republicans say the same.it…. [T]his effort may scratch the hard-right GOP base’s impeachment itch, but it could end up motivating Democrats more.”

And yet, GOP officeholders and candidates still can’t help themselves.

Even as Republican leaders try to downplay their anti-Obama schemes, and dismiss impeachment rhetoric as a Democratic “scam,” the message doesn’t seem to have reached everyone in the party. Just yesterday, we heard more impeachment talk from a House GOP candidate

Matthew Corey, the Republican challenging Rep. John Larson (D-CT) in Connecticut, said Saturday that he believes President Obama should be impeached, according to the Bristol Press. Corey said that Obama has violated the constitutional provision that gives Congress “all legislative powers” and said the president has been “breaking the oath of office.” He also said he supported the House’s efforts to sue Obama for choosing “what parts of a law he wants to enforce.”

… and a current House GOP lawmaker.

Rep. Steve King called into Glenn Beck’s radio program this morning to discuss his confrontation last week with advocates of immigration reform. During the interview, King told Beck that it is vitally important for House Republicans to rein in President Obama for the remainder of his term so that he cannot destroy America before this nation can elect a new president “whom God will use to restore the soul of America.”

Saying that Republicans cannot “unilaterally disarm” by taking the threat of impeachment off the table, King declared that the GOP must work to “restrain this president so that he doesn’t do serious destructive damage to our constitution” in order to allow this nation to “limp our way through his terms of office.”

This sort of talk has practically become a daily occurrence. If the McClatchy-Marist data is correct, Democrats are likely hoping it doesn’t stop anytime soon.

“The Right’s Impeachment Trap”: How Pundits Blame Obama For GOP Extremism

Every once in a while, those of us who were slow to board the magical Barack Obama 2008 Hope and Change Express get to say “We told you so,” and then go back to work. This is one of those times. Forgive me.

As Ezra Klein insists Obama has achieved success only by “breaking American politics,” and Ron Fournier tells us “the fundamental reason he became president was he was promising there’s no red state, there’s no blue state, I’m going to bring the country together,” people who resisted candidate Obama’s wispy, post-partisan rhetoric back then shake our heads and feel a little bit vindicated. Personally, I have to say: I hate being vindicated (on this, anyway). It would feel so much better to have been wrong.

Somebody broke politics, but it wasn’t Barack Obama — and yet he gave his enemies plenty of evidence to frame him.

Even President Obama has to regret some of his 2008 rhetoric, which partly blamed the Clintons for the right’s vengeful crusade against them, as pundits use it to claim that he not only broke politics, but that he will actually deserve the blame if Republicans impeach him for doing his job. Journalists still blame Democratic presidents for the unhinged behavior of Republicans.

Exhibit A is an allegedly “balanced” Wednesday Fox News panel where the non-right-wingers – journalists Fournier and A.B. Stoddard – joined conservative Charles Krauthammer in suggesting Obama could be responsible for his own impeachment, if he goes ahead with an executive order deferring deportation action on the parents of children who already enjoy deferred status. (Krauthammer called the move “impeachment bait” in Thursday’s Washington Post column.)

But the reaction of Stoddard and Fournier is worth breaking down in detail. (Thanks, Daily Caller, for capturing it.)

“If President Obama goes too far on this — whether it’s within his legal right or not — the outrage will be so incredible on the Republican side, it will probably bring more Democratic losses this fall,” the Hill’s Stoddard began. “Because I don’t know that Latinos are going to turn out this fall as a result of this issue. But it also could become a constitutional crisis.”

So it’s a bad move, “whether it’s within his legal right or not,” because a) it might not work politically and b) “it could also become a constitutional crisis.”

Fournier quickly agreed.

Let’s assume for a second that legally he can do this — just stipulate that, just for a second. Should he do it?  Even if you agree, like I do, that we really need to do something about these 12 million people who are in the shadows, even if you agree that it is legal, I still think there is an argument to be made that he should not do it.

OK, let’s stop there. The president shouldn’t do something to ease the immigration crisis, “even if you agree that it is legal.” Why is that? Fournier has a quick answer:

“Because the fundamental reason he became president was he was promising ‘there’s no red state, there’s no blue state, I’m going to bring the country together.’ He’s been a polarizing president.”

I’m not sure what qualifies Fournier to pronounce “the fundamental reason” Obama was elected, either in 2008 or 2012. Some people may have indeed admired his post-partisan rhetoric. But speaking as a two-time Obama voter, many of us wanted to see healthcare reform and less income inequality. Many members of the Obama coalition, who make less than $50,000, wanted economic relief from the Bush recession and the 30-year downward economic spiral that began under Ronald Reagan. Many of the Latinos who voted for Obama very much wanted immigration reform.

The political desires of the Obama coalition don’t much concern Fournier. “This would be a nuclear bomb that would blow open and make this country even more divided,” he warned. “In a way that most Americans just don’t want.”

In case you missed his point, Fournier followed up his Fox appearance with a whole column elaborating on it. The headline sums up the wrong-headed argument: “Even if reform is needed and legal, endowing the presidency with new, unilateral powers is a dangerous precedent.”

Obviously if reform is “legal,” then it wouldn’t endow the presidency with “new, unilateral powers.”

Kevin Drum boils the argument down to this: “President Obama shouldn’t do anything that might make Republicans mad.”

It really is that simple. If you grant, as Fournier seems to, that the president can legally change deportation priorities, but you think he shouldn’t, because it will further divide the country and Republicans will use it as an excuse to impeach him, you’re granting irrational people control of the nation. This is largely what happened during the debt ceiling crisis of 2011, but that time, Obama was listening to the Fourniers and Stoddards of the world, and trying to both be bipartisan, and also to appease the crazy Tea Partyers who would blow up the global economy rather than raise the debt limit.

That only enabled the crazies, who were being coddled by supposed moderates like Senate Minority Leader Mitch McConnell, who crowed approvingly that his party’s right flank proved the debt ceiling was “a hostage worth ransoming.”

So we know Republican leaders aren’t going to stand up to the party’s far-right base. And we know Krauthammer is going to accuse the president of creating a constitutional crisis to turn out his base for the midterm elections, because that’s Krauthammer’s job. But it would be nice if writers who don’t identify themselves with conservatism could describe this dynamic, maybe even critique it — not become part of it.

For the record, I can’t say conclusively whether the executive action the president is pondering is “legal,” and neither can Fournier or Krauthammer. (They both rely on Obama’s own previous statements denying that he has such powers; so he was right then, but he’s wrong now?) Anyway, it’s a perfectly legitimate point to debate. But I feel confident in saying that the enormously cautious Obama, who is sometimes too cautious for my taste, won’t do it cavalierly – not to turn out his base in November, and certainly not as “impeachment bait.”

The right is setting an impeachment trap for the president, and the media are starting to play along.
