“Most Glaring Drawback Is He’s A Bush”: Jeb Bush Cannot Escape His Brother’s Undeniably Disastrous Presidency
Earlier this year, Mitt Romney had a Galadriel moment. He appeared to be briefly seized by a vision of himself as an all-powerful, world-striding President Romney, before turning away from temptation and settling for the plain old Mitt Romney he has always been. It was political theater at its most bizarre, a flack-driven frenzy that doubled as a flashback to the self-delusion that blinded the Romney 2012 campaign in its final days.
With Romney now out of the way, Jeb Bush has consolidated the support of the GOP’s moneyed class with surprising alacrity. As Politico noted last week, the contest for the Republican nomination was previously seen as a “free-for-all among a half-dozen or so viable candidates” but has since shifted to a game of catch-up, with a clear leader way out front who has a “bull’s-eye on his back.” He may soon be out of sight: The Washington Post reported that Bush is amassing so much money so quickly that his potential rivals “do not even claim they can compete at his level.”
The Republican primary process is a fearsome thing for any establishment candidate, but history shows that he (and it is always a he) will win in the end. None of this is good news for Bush’s would-be competitors, whether they be on the fringe (Rand Paul, Ted Cruz), slow starting out of the gates (Chris Christie), or Pawlenty-esque (Scott Walker, Bobby Jindal).
The problem for the GOP is that a Bush running in 2016 is almost as eye-rubbingly bizarre as another Romney campaign.
I’m not talking about Jeb Bush’s policies or his abilities as a campaigner (though for the most part he has been deft in avoiding the usual pitfalls and has handled the media well). I’m talking about his most glaring drawback: the fact that he’s a Bush. It seems too obvious to mention, but as Republican elites rally around his flag, it appears they need a reminder. Just a few years ago, the idea of another Bush running for president would have been laughable. Today, the party is so desperate for a winner that it is willing to entirely overlook eight disastrous years in the White House.
In early February, Jeb Bush said his brother was a “great president.” Maybe that’s just what a younger brother has to say to avoid seeming like a heartless backstabber. Then again: Really?
George W. Bush’s Iraq War was a horrible blunder — the worst foreign policy disaster since Vietnam. There was a brief moment at the dawn of the Arab Spring when conservatives were crediting Bush’s pro-democracy agenda for a wave of anti-authoritarian protests across the region, but you don’t hear them saying that anymore. Iraq was a really, really bad idea, and nothing has changed that.
Then there’s the economy. There are not many modern presidents who enjoy the dubious honor of overseeing a recession so bad that it compares only to the Great Depression. In fact, there is only one: George W. Bush. While it would be unfair to lay the entire economic collapse at his feet, it’s clear that the financial crisis stemmed from a stew of GOP policies, from deregulation to crony capitalism to overly prizing homeownership. Again, not great. Not even good.
Next up: the budget. Bush entered office with a budget surplus, then gave a huge chunk of it away to the rich. That’s not good. That’s very, very bad.
Then there’s all the rest of it: Katrina, Scooter Libby, torture, wiretapping, Dick Cheney, and on and on and on.
George W. Bush’s approval rating has improved since its 2008 nadir, but it doesn’t take a genius to figure out that it will plummet once the Bush years are relitigated in the context of a hypercompetitive presidential race in which another Bush is on the ballot.
To win a general election, Jeb Bush would have to come up with a way to disown his brother’s legacy — and so far he has only embraced it. That means that, should Hillary Clinton be the Democratic nominee, the 2016 election could very well come down to a contest between the 1990s and the 2000s.
Americans have fond memories of the 1990s. The 2000s? Not so much.

“The Country Paid Heavily For The Risks He Took”: It’s Not Too Soon To Judge George W. Bush’s Presidency On Key Issues
In the six years since he left the White House, President George W. Bush has often claimed that it is too early for historical judgments about his presidency. “It’s too soon to say how many of my decisions will turn out,” he wrote in Decision Points, his presidential memoir.
In this, Bush was indulging in what we will call the Truman Consolation. President Harry S. Truman was deeply unpopular during most of his time in the White House and in the years immediately afterward. Only decades later did historians begin to rate his presidency highly for the actions he took in the early years of the Cold War. At one time or another, when their poll ratings are slumping and their media coverage is biting, most modern American presidents like to believe they will eventually be vindicated, just as Truman was.
But Bush is largely wrong: In some of the most important areas of his presidency, it’s not too soon to draw conclusions. Just by judging against Bush’s own forecasts, some of the most far-reaching and important initiatives of his presidency didn’t work — or turned out poorly.
At the top of the list is the war in Iraq. Bush and his advisors badly misjudged what it would entail. They overestimated the international support the United States would be able to obtain for military action. They asserted before the war that American troops would need to stay in Iraq for no more than a couple of years. The administration’s public estimate before the war was that it would cost less than $100 billion; instead, it cost $2 trillion.
Intended originally as a short-term demonstration of American power and influence, the Iraq war over the longer term brought about the opposite. In its unhappy aftermath, Americans became increasingly cautious, more reluctant to become involved overseas. Overall, the war will go down as a strategic blunder of epic proportions, among the most serious in American history.
A similar fate will befall the second-most far-reaching aspect of Bush’s legacy, his historic tax cuts. Bush argued that they would stimulate the economy and spur economic growth. The short-term benefits proved dubious at best, but the harmful long-term consequences were incalculable, both for the federal government and, more importantly, for American society.
When Bush took office, America was in a brief period of budgetary surplus. There was actually a debate, forgotten and almost unimaginable today, about how to use the surplus: Pay down the debt? Launch new federal initiatives? Bush chose to cut taxes, and then did so in ways (tax cuts on dividends and capital gains) that proved immensely beneficial to the wealthiest Americans.
It’s true that President Barack Obama eventually allowed the Bush cuts on upper-income Americans to expire. But the damage had been done. Over the course of nearly a decade, the federal government became increasingly short of funds, while wealthy Americans built up greater and greater assets. Whenever you use a road, bridge or airport that needs repairs (or read a news story about the Pentagon complaining about budget constraints), you might pause to think about the Bush tax cuts and the role they played in shaping the America we see today.
Bush’s second round of tax cuts, in 2003, were historic in another sense. By then, he had already dispatched American troops to Iraq. In every previous military conflict since the Civil War, American presidents had raised taxes to help defray the costs. Bush bucked this historical trend: He lowered them.
It’s true that in a few other policy areas judgments of Bush’s presidency may improve over the years as events unfold and as more information comes to light.
The primary example could be counter-terrorism. The Senate’s recent report on enhanced interrogation techniques makes current judgments on that dark era even harsher than they would have been otherwise. Torture is torture, and no passage of time will change the moral judgments on that.
On the other hand, in the immediate aftermath of the Charlie Hebdo attacks in Paris, some Europeans began to ask why the attackers had not been kept under greater surveillance. If such terrorist attacks were to continue over many years, then judgments on the Bush-era surveillance programs might eventually come to be less harsh than they are today. Or they may come to be seen as the true beginning of a new surveillance state. More time needs to pass before historical judgments on this issue can take shape.
Overall, Bush’s presidency is likely to be remembered for his lack of caution and restraint. Once, in the midst of a discussion with his military advisors, Bush made a telling observation: “Someone has got to be risk-averse in this process, and it better be you, because I’m not.”
George W. Bush was certainly not risk-averse. He took gambles both in foreign policy and with the economy. Sometimes they paid off. Yet overall, the country paid heavily for the risks he took. History isn’t likely to revise that judgment.

“Crossed The Line”: Even John Yoo Has His Limits
John Yoo’s reputation is well deserved. The conservative law professor at UC Berkeley is perhaps best known as the principal author of the Bush/Cheney “torture memos” – defending the so-called “enhanced interrogation techniques” – during Yoo’s tenure at the Justice Department’s Office of Legal Counsel.
And when it came to torture and national security, the conservative lawyer was largely in the “anything goes” category. But apparently, even Yoo has his limits.
As former Vice President Dick Cheney argued on Sunday that the CIA’s aggressive interrogation of terrorism suspects did not amount to torture, the man who provided the legal rationale for the program said that in some cases it had perhaps gone too far.
Former Justice Department lawyer John Yoo said the sleep deprivation, rectal feeding and other harsh treatment outlined in a U.S. Senate report last week could violate anti-torture laws.
“If these things happened as they’re described in the report … they were not supposed to be done. And the people who did those are at risk legally because they were acting outside their orders,” Yoo said on CNN’s “Fareed Zakaria GPS.”
In an interview on C-SPAN, Yoo added, “Looking at it now, I think of course you can do these things cumulatively or too much that it would cross the line of the anti-torture statute.”
Just to be clear, this is not to suggest Yoo endorses or agrees with the torture report released last week by the Senate Intelligence Committee. On the contrary, it’s quite clear that he does not.
But as a political matter, his willingness to draw legal lines now, in light of the new revelations, creates an interesting dynamic.
We know, for example, that according to the CIA’s records, rectal feeding and hydration were forced on detainees without medical need.
According to former CIA director Michael Hayden, that wasn’t illegal and it wasn’t torture.
According to former Vice President Dick Cheney, that wasn’t illegal and it wasn’t torture.
According to Karl Rove, that wasn’t illegal and it wasn’t torture.
But according to John Yoo, this crossed the line. In other words, a variety of leading Republican voices haven’t just embraced torture as a legitimate tool, they’ve positioned themselves to the right of the torture-memo author who helped give the Bush/Cheney White House the green light in the first place.

“Bush’s Willful Ignorance”: Why He Wanted To Know As Little About Torture As Possible
It’s happening more than 10 years too late (and in a better world it wouldn’t need to happen at all), but now that the Senate Intelligence Committee has released its so-called torture report, the American people are finally having an informed debate over their government’s use of “enhanced interrogation” during the presidency of George W. Bush. The process is not always pretty — at times, in fact, it is downright chilling. But now that we know some of the harrowing details of what was done in our name, it’ll be easier for us Americans to step a bit closer to the mirror and see what we’ve become. As Glenn Greenwald put it earlier this week, “Everybody’s noses got rubbed in [the torture program] by this report.”
Still, the human brain has an awesome capacity to reject information it finds upsetting — like proof that one’s leaders embraced practices refined by the Bolsheviks and the Gestapo. At least that’s my explanation for why some people would rather talk about alleged partisanship than “rectal rehydration.” Or why there’s been increasing focus on the question of whether the CIA “misled” President Bush about the effectiveness of the program, as well as its essential nature. The whining from conservatives over the Committee not interviewing CIA agents is a red herring, of course (as Chris Hayes has noted, arguments about process are almost uniformly disingenuous). But I think the chatter about Bush the Younger really being Bush the Clueless gets to something deeper.
Before we get into that, though, let’s lay out the basic thrust of the Bush-as-patsy narrative. The key data point for the argument, which the report’s authors say is based on the CIA’s own records, is the fact that Bush wasn’t officially briefed on the agency’s use of waterboarding until 2006. By that point, CIA agents had been subjecting “more than three dozen prisoners” to a series of “near drownings” for years. The report also found that when the president was told of some of the program’s details — specifically, the practice of chaining alleged “evildoers” to the ceiling and forcing them to soil themselves — he “expressed discomfort.” He was, after all, the ultimate compassionate conservative.
Admittedly, there’s much in this formulation that’s seductive, confirming as it does a few widely held beliefs about Bush and his administration. For one thing, it jibes perfectly with the trope that depicts Bush as little more than a figurehead, the emptiest of suits. For another, because the torture program has been so vociferously defended by the former vice president, the story also seems to confirm the related suspicion that, for most of the Bush era, Dick Cheney was the real president. Last but not least, the idea that Bush was kept in the dark (not literally; that was reserved for detainees) lines up with another popular Bush motif: that he was, at least for a commander-in-chief, a “regular guy,” just like us, and not a sadistic authoritarian.
To paraphrase CIA Director John Brennan’s remarks this week, what Bush knew and when he knew it is “unknowable” to the rest of us. And to some extent, depending on how much “discomfort” he feels over being a war criminal, it may not even be knowable to him. All the same, there are a few signs that the Bush-as-patsy explanation is a little too pat. And there are historical reasons to believe that he not only knew enough to be culpable, but that he purposefully avoided finding out more than the bare minimum of what he needed. As Andrew Sullivan put it recently, there was “a desire not to know, not to have direct and explicit knowledge of what was actually being done, because of the immense gravity of the crimes.”
The first, most obvious, reason to question whether Bush really knew so little is the fact that in “Decision Points,” his listicle-cum-memoir, he claims to have directly given the thumbs-up in 2002 when the CIA asked if Abu Zubaydah, a high-ranking al-Qaeda detainee, could be waterboarded. “I thought about the 2,971 people stolen from their families by al Qaeda on 9/11,” Bush writes. “And I thought about my duty to protect my country from another act of terror.” After so judiciously weighing his duty to protect Americans from harm (which up to that point he hadn’t done so well) against his obligation not to be a war criminal, Bush came to his conclusion: “’Damn right,’ I said.”
Of course, just because Bush had his ghostwriter Christopher Michel include this anecdote in his book doesn’t make it true. As a New York Times article on Bush’s response to allegedly being misled suggests, it’s quite possible that Bush is lying about giving the go-ahead to torture Zubaydah in order to shield the CIA — as well as to mitigate his embarrassment. “I suspect,” Sullivan writes in the post I mentioned previously, “Bush decided that, in his book, he had a duty to provide cover for the people who worked for him.” But even if you reject that explanation, there’s still good reason to doubt Bush was on the periphery — or, to be more precise, he was more marginalized than he may have wanted.
That reason has a name: Richard Bruce Cheney, also known as the United States’ most powerful vice president. The theory here isn’t that Cheney was doing a whole lot of dirty work behind Bush’s back, but rather that he had taken the gloves off with the tacit encouragement and approval of the president. As Cheney-watchers — especially the Washington Post’s Barton Gellman and former Cheney co-worker John Dean — have noted, Cheney’s experience in the Nixon administration during its final days did not lead him to the same conclusion as most of us, that an unchecked president is dangerous for American democracy, but instead to conclude that Watergate was proof that if you’re going to break the law, you’d better do it in a way that insulates the president. And as Greenwald noted in my interview with him this week, and historian Sean Wilentz wrote about in a 2007 New York Times op-ed, Cheney reached a similar conclusion after Iran-Contra (which, like Watergate, he believed to be a power grab by Democrats).
Plausible deniability, in other words, is the key phrase to understand what Bush “knew” about the global network of torture chambers and dungeons that will stand as one of the most enduring legacies of his tenure as president. And I suppose in a bitter, depressing way, that’s all too fitting. Because while Bush is the American who bears the most responsibility for the evil unleashed by the United States in the wake of 9/11, the truth is that all of American society let fear and panic overwhelm its values and senses; all of American society was desperately willing to believe that impossible promise: that it had nothing to fear. And when the true costs of its panic and its terror began to float to the surface, all of American society was content to ask no further questions, and to look the other way.

“Paying For Bush’s 2003 Invasion Of Iraq”: Decision To Launch An Unwarranted Invasion Is Directly Responsible For The Chaos Today
As President Obama struggles to deal with the crisis in Iraq, it’s useful to remember who gave the world this cauldron of woe in the first place: George W. Bush and Dick Cheney.
Their decision to launch a foolish and unwarranted invasion in 2003, toppling Saddam Hussein and destroying any vestige of the Iraqi state, is directly responsible for the chaos we see today, including the rapid advance of the well-armed jihadist militia that calls itself the Islamic State.
Bush has maintained a circumspect silence about the legacy his administration’s adventurism bequeathed us. Cheney, however, has been predictably loud and wrong on the subject of, well, just about everything.
“Obama’s failure to provide for a stay-behind force is what created the havoc we see in Iraq today,” Cheney told CNN last month. “When we left, Iraq was a relatively stable place. We defeated al-Qaeda, we had a coalition government in place.”
Cheney predicted “the history books will show” that Obama bears much responsibility for squandering the peace and stability that the Bush administration left behind. If so, they will have to be books that don’t go back very far.
Let’s review what actually happened. The U.S. invasion toppled a Sunni dictatorship that had ruled brutally over Iraq’s other major groups — the Shiite majority and the ethnic Kurds — for decades. It seems not to have occurred to anyone planning the invasion that long-suppressed resentments and ambitions would inevitably surface.
The leader of that “coalition government” Cheney mentioned, Prime Minister Nouri al-Maliki, turned out not to be a Jeffersonian democrat. Rather, his regime acted quickly and shamelessly to advance a Shiite sectarian agenda — and to marginalize Sunnis and Kurds.
What followed, predictably, was anger and alienation among the disaffected groups. The Kurds focused largely on fortifying their semi-autonomy in the northeast part of the country. Sunni tribal leaders twice cast their lot with violent Sunni jihadist forces that stood in opposition to the Shiite-dominated government in Baghdad — first with al-Qaeda in Iraq and now with the Islamic State.
Obama opposed the U.S. invasion and occupation from the beginning. He was nominated and elected president largely because of his pledge to end the war. He withdrew all U.S. troops only after Maliki refused to negotiate a viable agreement to leave a residual force in place.
Could Obama have found a way to keep more of our soldiers in Iraq if he really wanted to? Perhaps. But this would have required trusting Maliki, who has proved himself a far more reliable ally to the terrorist-sponsoring government of Iran than to the United States. And anyway, why would U.S. forces be needed to keep the peace in the “relatively stable” democratic Iraq of Cheney’s hazy recollection?
As I write, Maliki has barricaded himself inside Baghdad’s Green Zone and is refusing to leave office, despite that Iraq’s president has named a new prime minister. The United States has joined with respected Iraqi leaders to try to force Maliki out, but he holds enormous power — he is not only prime minister but also heads the Iraqi armed forces and national police.
Rewind the clock. If there had been no U.S. invasion, Iraqis surely would have suffered grievously under Saddam’s sadistic rule. But at least 110,000 Iraqis — and perhaps several times that many — died violently in the war and its aftermath. Is it likely that even the bloodthirsty Saddam would have matched that toll? Is it conceivable that the Islamic State’s ad hoc army would have even been able to cross the Syria-Iraq border, much less seize huge tracts of territory and threaten religious minorities with genocide?
Even after the invasion, if the U.S. occupation force had worked to reform the Iraqi military rather than disband it, there would have been a professional army in place to repel the Islamic State. If Maliki had truly acted as the leader of the “coalition government” that Cheney describes, and not as a glorified sectarian warlord, Sunnis likely would have fought the Islamic State extremists rather than welcome them.
Why is Obama intervening with airstrikes in Iraq and not in Syria, where the carnage is much worse? My answer would be that the United States has a special responsibility to protect innocent civilians in Iraq — because, ultimately, it was our nation’s irresponsibility that put their lives at risk.
Obama’s cautious approach — ask questions first, shoot later — may or may not work. But thanks to Bush and Cheney, we know that doing things the other way around leads to disaster.
