“McConnell, Boehner”: Sorry Voters, You Just Put Crazy People In Charge Of Congress
For as long as John Boehner has been Speaker of the House, his majority has been defined by its intransigence. This isn’t spin cooked up by Boehner’s liberal critics or by Democrats on the other side of the aisle. Boehner himself has at times seemed to revel in the barking madness of his hardline members.
That’s not to say Boehner enjoys this aspect of his job. It’s generally been a problem for him. But his willingness to grapple publicly with the difficulties he faces isn’t just self-effacing charm. It’s also cunning. To make progress, it follows, his members must be placated. How can he be expected to corral his herd of beasts if Democrats refuse to appease them?
It’s what has allowed him to say things like, “[t]he votes are not in the House to pass a clean debt limit,” when the opposite is clearly true.
But that was before. Starting in January, Republicans will control Congress completely. Obviously this doesn’t obligate them to advance any particular, or constructive agenda. The last six years have demonstrated that there’s more political upside for Republicans in gridlock than in cooperation with Democrats. But now that they’re calling all of the shots, you might think Boehner, along with incoming Senate Majority Leader Mitch McConnell, would stop talking about their own members as irrational animals that can’t easily be controlled.
Nope!
Per Bloomberg: “McConnell said Obama’s plans to take executive action on immigration, if Congress doesn’t act, would amount to ‘waving a red flag in front of a bull.’”
It’s hard to fault GOP leaders for playing expectations games, if expectations games allow them to escape accountability for the actions and agency of their members. But that really shouldn’t be an effective tactic anymore. Republicans and Democrats are coequals now. President Obama will do some stuff that Congressional Republicans won’t like, and vice versa. But the fact that Boehner and McConnell announced that they would “renew our commitment to repeal Obamacare” doesn’t give Obama an excuse to write off Congress, or act recklessly, or even to duck negotiations over specific reforms to the Affordable Care Act.
The administration would endure endless derision if Obama or his top aides said Obama wouldn’t cooperate with Republicans because their latest Obamacare repeal vote had “poisoned the well.” When congressional Republicans used the same language prior to the election, you could at least chalk it up to the fact that the Democrats controlled more of the agenda than they did, and that they weren’t pleased with the terms. But that’s not true anymore. If Republicans decide not to tee up immigration legislation, it’s because they don’t want to pass immigration legislation.
They shouldn’t be able to lay that decision at Obama’s feet, on the grounds that they’re too unruly to be controlled. And if they are, then consider the implications of placing a party that’s been commandeered by such waspish politicians in charge of votes on issues like ISIS, Ebola, or the debt limit.

“Barack Obama Is A Big Meanie!”: John Boehner Already Making Excuses For His Failure
It only took a couple of days before John Boehner made clear that when it comes to his approach to legislating in the wake of the Republicans’ victory in the midterms, absolutely nothing has changed. All that talk about “getting things done” and “showing they can govern”? Forget about it.
In his press conference the day after the election, President Obama got asked about immigration reform and repeated what he’s been saying all along—that if Congress doesn’t pass anything, he’ll take some (as yet undisclosed) actions based on executive authority. He also noted for the umpteenth time that the Senate already passed a reform bill, one that included lots of gettin’-tough provisions demanded by Republicans, which Boehner refused to bring to a vote in the House even though it would have passed. He also emphasized that if Congress does pass a bill, it would supplant whatever executive actions he might take, so taking some executive actions might provide a nice inducement for them to do something.
So yesterday when Boehner had his own press conference, he got super-mad:
“I’ve made clear to the president that if he acts unilaterally, on his own, outside of his authority, he will poison the well, and there will be no chance of immigration reform moving in this Congress. It is as simple as that,” he said. “When you play with matches, you take the risk of burning yourself. And he’s going to burn himself if he continues to go down this path.”
Let’s think about this “poisoning the well” idea. Boehner is saying that if President Obama takes executive action, congressional Republicans will be angry and distrustful, which would make legislating harder. While up until now, they’ve been friendly and trusting toward Obama, and willing to work together.
Just a couple of days after the election, Boehner is already preparing excuses for why he failed. Why didn’t immigration reform pass? Because Barack Obama is a big meanie!
That well was poisoned long ago, and it was Republicans who did the poisoning. This is an important reminder that the fundamental dynamic within the GOP—in which appeasing the party’s right wing is the primary concern of the leadership—has not changed at all. In fact, it’s been intensified. In both the House and Senate, the incoming GOP caucus will be more conservative than they are right now. The problem was never that John Boehner didn’t think it was good for the country or his party to pass comprehensive immigration reform, the problem was that he didn’t have the courage to stand up to the Tea Party right. And now there are even more of them.
Meanwhile over in the Senate, you’ll have a combination of Republicans up for re-election in two or four years who will be increasingly nervous about a primary challenge from the right, and new members who hail from the Ted Cruz caucus. You think you’ll get a yes vote for comprehensive reform from Tom Cotton, who claimed during the campaign that ISIS and Mexican drug gangs were conspiring to attack us via the Rio Grande? How about Joni Ernst, who talked about shooting government officials and believes the United Nations has a secret plan to force Iowa farmers off their land and relocate them to urban centers? Or James Lankford, who thinks too many American children are on ritalin “because welfare moms want to get additional benefits”? Is this the group of sensible moderates that is going to vote for comprehensive reform?
I’ll bet that John Boehner would like nothing better than to have Barack Obama issue some executive orders on immigration. Then he’d have an easy answer every time someone asked when he was going to allow a vote on a comprehensive immigration package. What can I do? Obama poisoned the well. It’s not my responsibility anymore.

“Theatrical Posturing, Not Much Lawmaking”: What We Talk About When We Talk About A Republican Senate
Presuming we have a Republican Congress next year, there’s going to be a lot of talk right after the election about what that will change 1) politically and 2) substantively. While I’m ordinarily an advocate of more substantive discussion and less political discussion (not that I have a problem with political discussion, since I do plenty of it myself, it’s just that it should be leavened with consideration of the things that actually matter), there’s a potential problem in the substantive discussion that I think we should be on the lookout for.
For instance, this morning on the radio I heard some energy expert whose name I didn’t catch say that if Republicans take over the Senate, we’re likely to see the government shift its focus toward fossil fuels and away from renewables. Which sounds perfectly logical until you ask how such a shift is supposed to take place.
This is what is often missing from policy discussion: enough acknowledgment of the institutional processes that determine how policies actually get set and altered. If you’re going to say that a Republican Congress is going to produce a particular policy change, you have to be clear that you’re saying the following events will occur:
1. Republicans will write a bill to do the thing.
2. The bill to do the thing will not only pass the House but more importantly garner 60 votes in the Senate, which means it will get the votes not only of Republicans but also of some Democrats, thereby overcoming a Democratic filibuster.
3. President Obama will sign the bill to do the thing.
It’s possible that that sequence of events could occur in some cases. For instance, Republicans have had a feverish desire to build the Keystone XL pipeline for some time, and they’ve come to attach an importance to it that’s way out of proportion to its actual impact. They seem to say with all sincerity that building the pipeline is a key to American prosperity, which is beyond absurd—building the pipeline would create a few thousand temporary jobs, and the number of permanent jobs maintaining it would literally be in the dozens. But President Obama never seemed adamantly opposed to the pipeline, and one could imagine him signing on if he got something in return. You could also see the pipeline getting a few Democratic votes from red state Democrats who want to show that they love the world’s dirtiest fuel (tar sands oil) and are therefore not hippies, so it could get 60 votes.
That might or might not happen, but it’s at least conceivable. It wouldn’t, however, represent some massive shift in our nation’s energy policy, whatever else you might think about it. And it’s an extremely unusual case.
On almost everything else Republicans want to do, either the bills they write won’t overcome Democratic filibusters, or they’ll be vetoed by the President. Much of the time, that will be because instead of embarking on a good-faith effort to find some accommodation with Democrats, they’ll just propose the thing they really want. It might be possible to forge a compromise on tax reform, but that would be a lengthy and involved process, so Republicans will just try to pass a bill slashing corporate tax rates, which won’t become law. There are ways the Affordable Care Act could be improved, but instead of working with Democrats to find them, they’ll be much more inclined to just pass repeal votes, whether it’s repeal of the entire law or repeal of individual provisions one by one (or, more likely, both).
In other words, we’re going to get an awful lot of theatrical posturing, and not very much lawmaking. We shouldn’t mistake the latter for the former.

“No Wave, No Mandate”: Be Extremely Skeptical Of Republican Claims Of Any Mandate
With Republicans increasingly likely to take the Senate, we can be sure of one thing: Whether their victory is narrow or enormous, Republicans will claim a sweeping mandate to enact a radical shift in policy on pretty much any issue that they care about. The American people have spoken, they’ll say. This was a wave that swept us into power and washed away Barack Obama’s right to pursue his agenda.
We should be extremely skeptical of that claim, for a number of reasons.
The first is that it isn’t really looking like much of a wave. Every election analyst projects that Republicans will pick up a few seats in the House — maybe five, maybe ten — but nothing like the 63 seats they gained in 2010 or the 54 they netted in 1994. If they manage to take the Senate, it will be because most of the incredibly close races this year tipped their way in the end. Which would undoubtedly be a victory, but it would be hard to argue that the GOP squeaking out wins in deep-red states in the South and adding a couple in swing states like Iowa or Colorado represents some huge shift in public sentiment.
New polling data suggests that even if Republicans do take the Senate, we’re hardly looking at a “GOP wave.” The final pre-election poll from NBC News and the Wall Street Journal was released today, and it shows the two parties nearly deadlocked (46-45 in Republicans’ favor) in the generic ballot test among likely voters. Democratic voters’ interest in the campaign has risen to match Republicans’, and approval of the GOP as a party remains abysmal. There’s also evidence to suggest that turnout will be low.
Of course, that poll could be inaccurate on any given question. But a perfectly plausible outcome would be that Republicans end up with a Senate majority of 51, 52, or 53 seats, but the election as a whole looks not like a wave but like a mixed victory amid conditions that already favored them.
And yet, if Republicans are victorious, they’ll repeat over and over that quote from Barack Obama when he said his administration’s policies were on the ballot. They’ll say the country has repudiated his administration and its agenda, and therefore he should agree to the things they want to do instead. They’ll say they were given a mandate by the American people.
Which, when you think about it, is absurd. Given how many close elections there are this year, it would be odd to say that if Bruce Braley and Mark Udall had managed to get slightly more of their voters to the polls, then that would have meant America chose one course, while if those two candidates’ turnout operations couldn’t quite get them over the finish line, then America made a different choice.
The outcome in Congress is likely to reflect this. Republicans are now claiming they will “pass a lot of legislation” once they control both chambers, but in reality, we’re likely to see more gridlock, dysfunction, and stalemate. Congressional Republicans will find themselves stymied by other institutional procedures — the filibuster and the presidential veto. And they’ll probably complain that the voters’ will is being thwarted.
But they won’t have much of a case to make. Getting the ability to repeal the Affordable Care Act, slash environmental regulations, cut corporate taxes, and enact the rest of the GOP agenda is going to take more than prevailing in a close Congressional election. It will take winning the White House, something they seem to have all but forgotten how to do.

“Dark Money And Our Looming Oligarchy”: At Some Point Soon, Untraceable ‘Dark Money’ Will Likely Overtake The System
There is something obscene in looking at the raw numbers, is there not? More than $500 million being spent on House races, and north of $300 million on Senate contests. A half-billion dollars! In the House! Where, as of yesterday, the Cook Political Report was counting a mere 17 contests as toss-ups, with 19 others as vaguely competitive. [This paragraph originally said $300 billion, which was incorrect.]
But the gross (double entendre intended) amounts aren’t the money story of this campaign. The money story of this campaign is that undisclosed money is starting to overtake the system and overtake our politics, and that at the heart of this corruption sits a lie peddled to us by the Supreme Court when it handed down the Citizens United decision. Whether it did so naively or cynically, I honestly do not know. But let’s just say that if it was naïve, it was almost too naïve to believe, Steve.
Here’s the situation. Outside spending—that is, the spending not by candidates’ own committees—may possibly surpass total candidate spending, at least in the competitive races, for the first time. And of that outside spending, an increasing amount is the category they call “dark” money, which is money whose sources and donors don’t have to be disclosed. I mean, don’t have to be disclosed. At all. That’s because these aren’t SuperPACs, which at least do have to disclose their donor lists, but are 501c4 “social welfare” (!) groups that don’t have to file anything with the Federal Elections Commission.
You’ve heard a lot about how bad SuperPACs are, and they are, but they’re not even the main problem these days. Most SuperPAC money has to be disclosed. But social welfare money does not. This recent study by the Brennan Center tells the tale. It totaled up the outside money being spent in the nine most competitive Senate races and found that 33 percent of these outside dollars weren’t subject to disclosure requirements. This includes the aforementioned social welfare organizations along with trade associations, the 501c6’s, like the U.S. Chamber of Commerce, which is one of 2014’s biggest spenders, possibly spending more this cycle than it did even in the presidential year of 2012.
A further 23 percent is subject only to partial disclosure. So more than half of this outside money is now spread around behind either partial or total secrecy. That percentage is assuredly going to grow. Almost all of the Koch Brothers’ money—they earlier announced a goal of spending $300 million on these elections, just $100 million less than they spent in the presidential year of 2012—is dark, and if they succeed, others will surely follow their example.
Oh yes, there are Democratic dark money groups too. Interestingly, the League of Conservation Voters is a big player here. But overall there isn’t as much Democratic dark money coursing around out there. For example, in the nine key Senate races, GOP dark money tops Democratic dark money in eight of nine of them (Louisiana is the exception), and in many cases not by two-to-one but three, six, 10, 12 to one. The disparities are highest in Kentucky and Georgia—not coincidentally, the two races considered most of the year to be the best chances for Democratic pickups, and therefore the two races where someone deemed it vital that the most unaccountable money possible be used to finance attack ads.
Okay. So what’s this mean? Well, it means this. Under the quaint old corrupt system, at least you and I could in theory learn the names of nearly every donor to a candidate or committee. And yes, there were 501c4’s then, and c6’s, but they simply didn’t spend much money on electoral politics back then. Karl Rove and others figured out that there’s nothing stopping a c4 from doing almost pure electoral work (even though the law says it’s not supposed to be its “primary purpose”), and from there it proliferated, because they knew the IRS couldn’t enforce it. (And they went after the IRS, claiming to be victims of Lois Lerner, just to make sure.) And so it’s come to pass that people whose names you and I will never have a chance to know donate vastly more amounts of cash.
Of course, someone knows them: the candidates. If and when Iowa Republican Joni Ernst (roughly $7 million in dark money so far) and David Perdue in Georgia (a little more than Ernst) make it to the United States Senate, we can be sure they’ll remember who wrote the checks.
And now, to the Supreme Court. Anthony Kennedy wrote the majority opinion, which opened the sluices to corporate money. But as you might recall, Kennedy insisted that there should be no problem with this. Why? Because there would be no more secret money: “With the advent of the Internet, prompt disclosure of expenditures can provide shareholders and citizens with the information needed to hold corporations and elected officials accountable for their positions and supporters. Shareholders can determine whether their corporation’s political speech advances the corporation’s interest in making profits, and citizens can see whether elected officials are ‘in the pocket’ of so-called moneyed interests.”
Kennedy describes a good-government Valhalla here, where campaigns and committees get a check in the mail and instantly scan it and send it along to the FEC, and bam, Bob’s your uncle, it’s there for the whole world to see. Of course, few citizens are going to go poring through FEC tables, but at least they’d be there for timely public review for reporters. That would be…tolerable, maybe.
But that is not remotely where things are headed. One of our parties is against full disclosure. They used to be for it, the Republicans did. But then they saw which way the post-Citizens United wind was blowing and became anti-disclosure. McConnell, the little Satan on his party’s shoulder on these matters, made the switch in 2012.
So that’s what this election marks: The routinization, in all contested races, of undisclosed money coming to dominate these campaigns, and the clear majority of it on the corporate, pro-Republican side. And yep, it can get worse.
