“On Invincible Ignorance”: The G.O.P.’s Intellectual Leader Is Still Making The Same Old Claims
Remember Paul Ryan? The speaker of the House used to be a media darling, lionized as the epitome of the Serious, Honest Conservative — never mind those of us who actually looked at the numbers in his budgets and concluded that he was a con man. These days, of course, he is overshadowed by the looming Trumpocalypse.
But while Donald Trump could win the White House — or lose so badly that even our rotten-borough system of congressional districts, which heavily favors the G.O.P., delivers the House to the Democrats — the odds are that come January, Hillary Clinton will be president, and Mr. Ryan still speaker. So I was interested to read what Mr. Ryan said in a recent interview with John Harwood. What has he learned from recent events?
And the answer is, nothing.
Like just about everyone in the Republican establishment, Mr. Ryan is in denial about the roots of Trumpism, about the extent to which the party deliberately cultivated anger and racial backlash, only to lose control of the monster it created. But what I found especially striking were his comments on tax policy. I know, boring — but indulge me here. There’s a larger moral.
You might think that Republican thought leaders would be engaged in some soul-searching about their party’s obsession with cutting taxes on the wealthy. Why do candidates who inveigh against the evils of budget deficits and federal debt feel obliged to propose huge high-end tax cuts — much bigger than those of George W. Bush — that would eliminate trillions in revenue?
And economics aside, why such a commitment to a policy that has never had much support even from the party’s own base, and appears even more politically suspect in the face of a populist uprising?
But here’s what Mr. Ryan said about all those tax cuts for the top 1 percent: “I do not like the idea of buying into these distributional tables. What you’re talking about is what we call static distribution. It’s a ridiculous notion.”
Aha. The income mobility zombie strikes again.
Ever since income inequality began its sharp rise in the 1980s, one favorite conservative excuse has been that it doesn’t mean anything, because economic positions change all the time. People who are rich this year might not be rich next year, so the gap between the rich and the rest doesn’t matter, right?
Well, it’s true that people move up and down the economic ladder, and apologists for inequality love to cite statistics showing that many people who are in the top 1 percent in any given year are out of that category the next year.
But a closer look at the data shows that there is less to this observation than it seems. These days, it takes an income of around $400,000 a year to put you in the top 1 percent, and most of the fluctuation in incomes we see involves people going from, say, $350,000 to $450,000 or vice versa. As one comprehensive survey put it, “The majority of economic mobility occurs over fairly small spans of the distribution.” Average incomes over multiple years are almost as unequally distributed as incomes in any given year, which means that tax cuts that mainly benefit the rich are indeed targeted at a small group of people, not the public at large.
And here’s the thing: This isn’t a new observation. As it happens, I personally took on the very same argument Mr. Ryan is making — and showed that it was wrong — almost 25 years ago. Yet the man widely considered the G.O.P.’s intellectual leader is still making the same old claims.
O.K., maybe I’m just indulging a pet peeve by focusing on this particular subject. Yet the persistence of the income mobility zombie, like the tax-cuts-mean-growth zombie (which should have been killed, once and for all, by the debacles in Kansas and Louisiana), is part of a pattern.
Appalled Republicans may rail against Donald Trump’s arrogant ignorance. But how different, really, are the party’s mainstream leaders? Their blinkered view of the world has the veneer of respectability, may go along with an appearance of thoughtfulness, but in reality it’s just as impervious to evidence — maybe even more so, because it has the power of groupthink behind it.
This is why you shouldn’t grieve over Marco Rubio’s epic political failure. Had Mr. Rubio succeeded, he would simply have encouraged his party to believe that all it needs is a cosmetic makeover — a fresher, younger face to sell the same old defunct orthodoxy. Oh, and a last-minute turn to someone like John Kasich would, in its own way, have similar implications.
What we’re getting instead is at least the possibility of a cleansing shock — of a period in the political wilderness that will finally force the Republican establishment to rethink its premises. That’s a good thing — or it would be, if it didn’t also come with the risk of President Trump.

“A New American Ethos”: In America These Days, You Can Never Be Punished Enough
We will call her Jane Doe.
We really have no choice, given that that’s the only identification found in the court document. Jane is 57, a Jamaica-born permanent U.S. resident living in New York City. She is a licensed nurse and a mother. She is also a convicted felon.
In 2000, Jane, trying to raise two young daughters on $15,000 a year and an $80 weekly child-support check, was recruited by her then-boyfriend for an insurance scam. They staged a car accident and tried to collect on a claim.
It didn’t work. Jane was convicted on fraud charges and sentenced to 15 months in prison. She was released in 2004.
That’s when her ordeal began.
Her debt to society paid, Jane set out looking for work. She was rehired by a former employer and worked there two years. Then the state Office of Professional Discipline suspended her license for two years for professional misconduct — not because she had done anything wrong, but because of the old conviction.
In the years since, Jane has found barricades on every avenue of gainful employment. Job interviews and even job offers mysteriously evaporate when employers learn about her record. She tried to get a business license to start her own company, only to be rejected twice because of it.
Last year, Jane tried to have her record expunged. Judge John Gleeson denied the request a few days ago, explaining that Jane doesn’t meet the legal standard. But Gleeson — the same judge who sent her to prison — then did something extraordinary. He appended to his 32-page opinion a “federal certificate of rehabilitation.”
Understand: There is no such thing. The official-looking document carries no legal force. It’s just something Gleeson had made for Jane so she can show prospective employers that a federal judge considers her rehabilitated. He says a woman who was convicted once, a long time ago, of a nonviolent crime from which she saw no profit and for which she has served her time, ought not be punished for it the rest of her life.
“I had no intention,” wrote Gleeson, “to sentence her to the unending hardship she has endured in the job market.”
If you consider this a heartwarming story, you miss the point.
Yes, Gleeson did a good and generous thing. One hopes it has the desired effect. But it is unconscionable that Jane Doe’s situation ever reached this extreme.
The shift of American penal philosophy from rehabilitation to punishment has had many disastrous effects: prison overcrowding, mass disenfranchisement, fatherless homes. But the most self-defeating effect is embodied in denying ex-felons employment once they’ve served their time. If you deny them the ability to do lawful work, what obvious option is left?
Granted, there are sometimes good reasons to deny a given ex-felon a given job; no daycare should hire a newly released child molester, for example. But what Jane Doe is facing is rooted less in common sense caution than in a new American ethos where punishment never ends.
That should be anathema to a nation of second chances. Lawmakers must enact reforms that curb the power of employers to discriminate against former felons — or that incentivize their hiring. Questions about criminal records should not be allowed on job applications; a person should have the chance to make a good impression at the job interview without being automatically ruled out for doing some stupid thing a long time ago.
Jane Doe was lucky to have Gleeson on her side, but she shouldn’t have needed him. She did something stupid, yes, but she was duly punished for it.
Except that in America these days, you can never be punished enough.

“The Same Wrongheaded Justifications”: Republicans Introduce A Bill To Monitor Refugees Who Settle In New York
Last week, Republican New York state senator Terrence Murphy introduced a bill that would make it legal to register and monitor refugees entering the state. The move was opposed by refugee advocacy groups, who called the proposed legislation “heinous” and said that it only stigmatized refugees further.
The bill, S6253-2015, has been a long time in the making and is cosponsored by a variety of Republican and independent senators. In a post on the New York Senate’s website last December, Murphy wrote, “The provisions of the bill allow New York to create its own mechanism to properly vet and monitor individuals seeking asylum within the state’s borders while continuing necessary humanitarian efforts.” His bill was a criticism of the federal government’s current screening process, which was characterized as having insufficient screening measures, despite the Obama administration’s step-by-step breakdown of how Syrian refugees are granted asylum in the U.S.
Murphy’s bill calls for the homeland security and emergency agencies to make plans with refugee agencies to monitor refugees for either a year or until they are given permanent residency by American immigration authorities. The bill proposed “requiring refugee resettlement agencies to submit quarterly reports to the bureau of refugee and immigrant assistance and requiring such agencies to monitor refugees for a certain period of time.” This is in addition to the two years of background checks performed by the federal government before refugees can even set foot in the country.
But exploring the bill reveals the same wrongheaded justifications used by other Republican governors and politicians who have vowed to keep Syrian refugees out of the country since the Paris attacks in November. The attackers were almost entirely European citizens who slipped back into Europe undetected. Of those who made it into the country posing as refugees, they took advantage of the European Union’s mismanaged handling of the refugee crisis. That in itself is a huge difference between the attacks in Paris and the likelihood of a Paris-style attack in the U.S.: it’s simply not as geographically close to hotbeds of extremism.
Furthermore, if terrorists were dressing up as refugees and entering the U.S. to commit attacks, it would’ve happened already. This country has accepted 2 million refugees since 1990 and yet not a single terrorist attack has been attributed to any of them. Anti-immigrant groups, on the other hand, have carried out numerous terrorist attacks over the same period. The same applies in Europe, which took in over a million refugees last year and has suffered a single attack which involved refugees, though the vast majority of conspirators in Paris were European.
The New York Immigration Coalition responded critically to the proposed legislation. “In places like Rochester and Buffalo where larger refugee populations have been settled, we have seen these communities help grow the economies of these localities,” read the group’s statement. “The ‘special registration’ called upon by this bill does not “protect” anyone, but puts up more red tape and ostracizes refugees.”
The New York bill is not the only one under consideration by state legislatures. In South Carolina, a similar bill is being proposed, along with civil liabilities for sponsors of refugees from Syria, Sudan and Iran who end up committing a terrorist act. “If it is not illegal, it is at least un-American,” said Ibrahim Hooper, communications director at Council on American-Islamic Relations, to the AP. That law may face a legal challenge, though, because it discriminates against people of a specific national origin.
Meanwhile, New York’s own refugee registration law is being reviewed by the Senate Finance Committee, where if approved, it will go to the state legislature for a vote. State Democrats, whose leaders have already pledged support for Syrian refugees entering the state, are most likely to oppose it.

“Sanders Surprises With Controversial Superdelegate Strategy”: Going To Do The Best We Can In Any And Every Way To Win
Strictly speaking, Democratic primary and caucus voters are principally responsible for choosing their presidential nominee, but the power is not entirely in their hands. While those voters elect pledged delegates for the party’s national convention, the Democratic process also includes superdelegates – party officials who are able to cast their own votes, separate from primary and caucus results.
The system is not without critics. Though it’s never happened, the existing Democratic process leaves open the possibility that actual, rank-and-file voters – the folks who participate in state-by-state elections – will rally behind one presidential candidate, only to have party officials override their decision, handing the nomination to someone else. For many, such a scenario seems un-democratic (and un-Democratic).
It therefore came as something of a surprise this week when Bernie Sanders’ presidential campaign first raised the prospect of doing exactly that. Sanders aides told reporters that he may not be able to catch Hillary Clinton through the primary/caucus delegate process, but the campaign might come close, at which point Team Bernie might ask superdelegates to give Sanders the nomination anyway, even if he’s trailing Clinton after voters have had their say.
On the show last night, Rachel asked the senator himself about the possibility. Initially, Sanders responded by talking about his optimism regarding upcoming contests and some national polling, but he didn’t answer the question directly.
So, Rachel asked again whether he might try to convince superdelegates to side with him, even if he’s behind in pledged delegates. Sanders said he and his campaign are “going to do the best we can in any and every way to win,” but he still avoided comment on the specific approach he’s prepared to take.
So, Rachel asked again. For those who missed it, this was the exchange that stood out.
MADDOW: I’m just going to push you and ask you one more time. I’ll actually ask you from the other direction. If one of you – presumably, there won’t be a tie – one of you presumably will be behind in pledged delegates heading into that convention. Should the person who is behind in pledged delegates concede to the person who is ahead in pledged delegates in Philadelphia?
SANDERS: Well, I – you know, I don’t want to speculate about the future and I think there are other factors involved. I think it is probably the case that the candidate who has the most pledged delegates is going to be the candidate, but there are other factors.
It was arguably one of the more controversial things Sanders has said this year.
When the race for the Democratic nomination first got underway, many saw this same scenario, but in reverse: it seemed possible that Sanders would do well in primaries and caucuses, and Clinton would turn to powerful superdelegates to elevate her anyway.
That possibility, not surprisingly, enraged many of Sanders’ backers. The Hill published this report in early February:
MoveOn.org Political Action and a group of backers of White House hopeful Bernie Sanders have launched petitions calling for superdelegates to support the candidate chosen by Democratic voters, not party insiders.
Ilya Sheyman, the group’s executive director, in a statement Thursday said voters “will not allow Democratic Party insiders to determine the outcome of this election.” … “The race for the Democratic Party nomination should be decided by who gets the most votes, and not who has the most support from party insiders,” Sheyman said.
Except, now Democrats face the prospect of seeing the entire scenario flipped on its head: Sanders and his team may ask those party insiders to help him, even if the results from primaries and caucuses favor Clinton.
For what it’s worth, such a strategy seems unlikely to succeed. As things currently stand, Clinton’s lead over Sanders among superdelegates is roughly 467 to 26. It’s difficult to imagine the circumstances in which most of Clinton’s official backers switch allegiance to Sanders, especially if Clinton leads the overall race once the primaries and caucuses are over.
But the fact that Sanders and his team are thinking along these lines is itself striking – and the sort of strategy his progressive backers may find difficult to explain after months of making the exact opposite argument.

“The Reagan Democrats Are Gone”: Hillary Clinton Doesn’t Need White Men
The New York Times today has an article of a kind we’ve seen before and will likely see many times again before this election is over, warning that Hillary Clinton has a serious problem with white men, a problem that could threaten her ability to win a general election:
White men narrowly backed Hillary Clinton in her 2008 race for president, but they are resisting her candidacy this time around in major battleground states, rattling some Democrats about her general-election strategy.
While Mrs. Clinton swept the five major primaries on Tuesday, she lost white men in all of them, and by double-digit margins in Missouri, North Carolina and Ohio, exit polls showed — a sharp turnabout from 2008, when she won double-digit victories among white male voters in all three states…
The fading of white men as a Democratic bloc is hardly new: The last nominee to carry them was Lyndon Johnson in 1964, and many blue-collar “Reagan Democrats” now steadily vote Republican. But Democrats have won about 35 to 40 percent of white men in nearly every presidential election since 1988. And some Democratic leaders say the party needs white male voters to win the presidency, raise large sums of money and, like it or not, maintain credibility as a broad-based national coalition.
I’m not sure who the “Democratic leaders” are who think that, because the only one the article quotes is Bill Richardson, who’s been out of politics for a few years and frankly was never considered a strategic genius to begin with. But here’s the truth: Hillary Clinton doesn’t need white men.
Let’s be more specific. Clinton will have the support of tens of millions of white men. But she doesn’t need to do any better among them than any Democrat has, and even if she does worse, she’ll probably be completely fine.
That’s because whites are declining as a proportion of the electorate as the country grows more diverse with each passing year. In 1992, just 24 years ago, whites made up 87 percent of the voters, according to exit polls. By 2012 the figure had declined to 72 percent. Since women vote at slightly higher rates than men, white men made up around 35 percent of the voters.
Those numbers will be lower this year, which means that even if nothing changes in how non-whites vote, Republicans will need to keep increasing their margins among whites to even stay where they are overall — in other words, to keep losing by the same amount.
By way of illustration, in 1988, George H.W. Bush won 60 percent of white voters on his way to beating Michael Dukakis by seven points. In 2012, Mitt Romney did just as well among whites, winning 59 percent of their votes. But he lost to Barack Obama by four points. The electorate is now even less white than it was four years ago, which means that Donald Trump (or whoever the GOP nominee is) will have to do not just better among whites than Romney did in order to win, but much better.
Exactly how much better is difficult to say because we don’t know exactly what turnout will look like among different groups (David Bernstein recently estimated that Trump would have to get at least 70 percent of the white male vote, compared to Mitt Romney’s 62 percent). But as turnout increases among groups other than white men, the need to run up the score among white men gets higher and higher. And for certain groups — particularly Latinos and women of all races — Donald Trump provides an extraordinary incentive to get out and vote. Not only that, as I argued yesterday, women are likely to vote in even stronger numbers for Clinton.
It’s true that Clinton has done worse among white male voters in this year’s primaries than she did in 2008. But we should be extremely wary of taking voting results in primaries and extrapolating them out to the general election. For starters, the overwhelming majority of people who vote in primaries will vote for their party’s nominee in November, whether they supported him/her in the primary or not. Furthermore, the general electorate is a completely different group of people than the primary electorate, and they’ll be presented with a different choice.
The Times article talks to some white men who don’t like Clinton, and it’s always worthwhile to hear those individual voices in order to understand why certain people vote the way they do. But when you pull back to the electorate as a whole, you realize that there just aren’t enough votes among white men for Republicans to mine. The reason is simple: they’ve already got nearly all they’re going to get. While some people entertain the fantasy that there are huge numbers of “Reagan Democrats” just waiting to cross over, the Reagan Democrats are gone. They all either died (it was 36 years ago that they were identified, remember) or just became Republicans. The GOP already has them, and it isn’t enough.
Finally, the idea that the Democrats can’t “maintain credibility as a broad-based national coalition” unless they get more votes from white men is somewhere between absurd and insane. We have two main parties in this country. One of them reflects America’s diversity, getting its votes from a combination of whites, blacks, Latinos, Asian-Americans, and people of other ethnicities. Its nominee got 55 percent of his votes in 2012 from whites — smaller than their proportion of the population as a whole, but still a majority of those who voted for him.
The other party is almost entirely white; its nominee got 90 percent of his votes from whites in 2012. And we’re supposed to believe that if that party gets even more white, then it will be the one that’s “broad-based”?
Obviously, every candidate would like to get strong support from every demographic group. But if there’s one group Hillary Clinton can afford not to worry too much about, it’s white men. Most of them are going to vote against her anyway, and even if they do, she still would have a decent chance of winning the election.
