“A Naïve View Of Politics”: The Poison-The-Well Myth, And How Politics Really Works
There are certainly some serious critiques of President Obama’s new immigration policy. It could encourage more illegal immigration in the long run. It may be another step toward an imperial presidency, detached from Congress. It definitely could have been executed less cynically, given that Mr. Obama all but admitted he delayed the announcement until after the midterms, in an (unsuccessful) effort to help Democrats on the ballot.
But there is also one critique that’s getting a lot of attention and isn’t so serious.
It’s the “poison the well” argument — the notion that Mr. Obama’s executive action to shield as many as five million people from deportation will prevent a bigger immigration bill from passing Congress and maybe prevent a whole bunch of other legislation, too.
John Boehner, the speaker of the House, and Senator Mitch McConnell, the next majority leader, have both used the phrase “poison the well.” A spokesman for Mr. Boehner said the move by Mr. Obama would “ruin the chances for congressional action on this issue and many others.” While maybe we should excuse politicians for trying to score political points, neutral commentators have picked up the argument, too. It’s one of those ideas that has the aura of sober-minded political analysis.
Obviously, we can’t run the final two years of the Obama presidency multiple times under different circumstances and see what happens in each. So it’s impossible to know for certain how any one action affects the course of events. But there are all kinds of reasons to believe that the poison-the-well theory is based on a naïve view of politics. And understanding why it’s wrong helps illuminate how politics really does work.
Whatever you may think of today’s politicians, they are highly successful people who have climbed to the top of a competitive profession. Most of the time, they make decisions that are in their interests — whether political interests or policy interests. A few notable exceptions aside (like Newt Gingrich’s infamous pique in 1995 over getting a bad seat on Air Force One), they do not make major decisions the way a small child would, based mostly on whether someone else is being nice or mean to them.
If you ask political scientists what they consider to be the biggest misconceptions about politics, you’ll often hear a version of the Nice-Mean Fallacy. The Obama presidency has offered a particularly rich set of examples. It’s true that Mr. Obama and his White House haven’t done a very good job of building relationships with Congress, and it’s true that the administration’s aloofness has probably hurt its effectiveness in some ways.
But consider the recent president whose relationship skills are often contrasted with Mr. Obama’s: Bill Clinton. Many members of Congress really did seem to prefer Mr. Clinton’s personality to Mr. Obama’s. And yet which of the two presidents failed to keep Democrats united on a major health care bill and thus failed to pass one? And which president held onto every single congressional Democrat he needed to pass such a bill?
Were the roles reversed, we no doubt would hear tales about how the gregarious president used his people skills to pass the biggest expansion of the safety net in a generation while the distant, professorial one failed. In truth, congressional Democrats weren’t making decisions based on either Mr. Clinton’s or Mr. Obama’s personality. They were making them based on bigger issues.
The Democratic Party of the early 1990s included more conservative Southerners than the 2009-10 version of the party, for example. The 2009-10 Democrats were also more desperate to succeed, remembering the disappointment of the Clinton bill and probably aware that economic inequality had worsened over the intervening decades. The Democrats stuck together because they believed doing so was in their interest.
Republicans have done the same in the Obama presidency. From the beginning, Mr. McConnell has understood that Republicans could veto Mr. Obama’s promise to be a bipartisan bridge-builder. “It’s either bipartisan or it isn’t,” Mr. McConnell said in 2010, explaining his caucus’s united opposition to the health care bill. No wonder that Republicans didn’t bite when the White House suggested adding medical-malpractice reform to the bill.
Many Republicans voters back this stance. Polls show that most want their leaders to stand on principle rather than to compromise. Democratic voters are fonder of compromise.
The story on an immigration overhaul has been similar. Some Republicans leaders see a bill as in their interests — helping them with Latino voters — and the Senate passed such a bill, 68-32, last year. Yet most House Republicans have philosophical objections and have few Latino voters in their district. House leaders have refused to bring the bill to the floor.
To accept the poison-the-well argument is to believe, first, that Republicans would have passed an immigration bill if Mr. Obama had not acted. This seems unlikely but not totally out of the question: Perhaps more Republicans want to show they can compromise now that they control both chambers, hoping their presidential nominee can win swing voters in 2016. In that case, an immigration bill might be more feasible in 2015 than it was in 2013.
But the poison-the-well theory then requires a second belief, too: That even if an immigration bill were in Republican interests, they would refuse to pass one, out of spite from Mr. Obama’s executive action. This belief seems strangely dismissive of Republicans’ instinct for self-preservation. It also conflicts with the history of both parties.
On the same day in August 1981 that President Ronald Reagan threatened to fire striking air traffic controllers, many Senate Democrats voted for his tax cut, and House Democrats did the same the next day. Mr. Clinton and congressional Republicans, less than a year after impeachment, collaborated on a sprawling bank deregulation bill in 1999. A few years later, many congressional Democrats voted for the Homeland Security Act even as President George W. Bush was calling them soft on terrorism.
In each of these cases, politicians voted with their interests, not their feelings. There is every reason to believe the same will happen over the next two years.
Some of the same Republicans worrying aloud about poisoned wells no doubt understand this reality. But they continue making the point partly because it helps unify the party on a divisive issue. “It’s a way the G.O.P. can achieve consensus,” as Brendan Nyhan, a Dartmouth political scientist and Upshot contributor, says. “They’re internally divided on policy on immigration but agree on a process critique of Obama’s actions.”
Jeb Bush and Marco Rubio may be on one side of some big immigration questions and conservative House Republicans may be on the other, but they can come together on metaphorical well water. Which is to say that politicians generally act in their interests, even when doing so involves pretending otherwise.

Smoke and fire, sirens blaring, horns honking, a sudden hail of bullets. This is what passes for the American dialogue on race and justice.
It’s hidden until it explodes.
“By 10 p.m., a St. Louis County Police squad car burned just down the street from the Ferguson Police Department, with spare ammunition ‘cooking off’ or exploding in the car,” the Wall Street Journal informed us.
Those who want to shake their heads in disgust can do so. American institutional racism conceals itself so neatly from those who prefer not to see it and, of course, aren’t victimized by it. And then every so often something sets off the public trigger — an 18-year-old young man is shot and killed by a police officer, for instance — and the reality TV that is our mainstream news brings us the angry, “violent” response, live. And it’s always one side against another, us vs. them. It’s always war.
“But what is justice in a nation built on white supremacy and the destruction of black bodies?” Mychal Denzel Smith wrote in The Nation the day after the grand jury announced that police officer Darren Wilson would not be indicted. “That’s the question we have yet to answer. It’s the question that shakes us up and makes our insides uncomfortable. It’s the question that causes great unrest.”
What is justice, indeed? And beyond that question are the real questions, perhaps unanswerable. What is healing? What is peace?
If the officer had been indicted for Michael Brown’s killing and then convicted on one charge or another, maybe that would have been justice, in a “case closed” sort of way. In our limited legal bureaucracy, “justice” means nothing more than punishment. Even when such justice is done, it changes nothing. The state’s “interest” has been satisfied, and that’s all that matters. The terrible loss suffered by parents, friends and community would remain a gaping wound. And beyond that, the social brokenness and racism that caused the tragedy in the first place would remain unaddressed, unhealed.
But not even that minimal justice was in the cards for the loved ones of Michael Brown or the occupied community in which he lived — because that’s not how it works. Officer Wilson, whatever he did inside or outside the state’s rules on the use of lethal force when he confronted Brown on the afternoon of Aug. 9, was just doing his job, which was controlling and intimidating the black population of Ferguson. He was on the front line of a racist and exploitative system — an occupying bureaucracy.
The New York Times, in its story about the grand jury’s decision, began thus: “Michael Brown became so angry when he was stopped by Officer Darren Wilson on Canfield Drive here on Aug. 9, his face looked ‘like a demon,’ the officer would later tell a grand jury.”
This sort of detail is, of course, of immense value to those who sympathize with the police shooting and accuse the black community of endemic lawlessness. See! Michael Brown wasn’t just a nice, innocent boy minding his own business. He and his companion were trouble incarnate, walking down the middle of the street spoiling for a fight. He was Hulk Hogan. The cop had no choice but to shoot, and shoot again. This was a demonic confrontation. Politeness wouldn’t have worked.
If nothing else, such testimony shows the stark limits of our “who’s at fault?” legal system, which addresses every incident in pristine, absurd isolation and has no interest beyond establishing blame — that is to say, officially stamping the participants as either villains, heroes or victims. Certainly it has no interest in holistic understanding of social problems.
Taking Wilson’s testimony at face value, one could choose to ask: Why was Michael Brown so angry?
Many commentators have talked about the “anger” of Ferguson’s black community in the wake of the shooting, but there hasn’t been much examination of the anger that was simmering beforehand, which may have seized hold of Brown the instant the police officer stopped him.
However, an excellent piece of investigative journalism by Radley Balko of the Washington Post, “How municipalities in St. Louis County, Mo., profit from poverty,” which ran in September, addresses the issue head-on. He makes the point that local municipal governments, through an endless array of penny-ante citations and fines — “poverty violations” — torment the locals for the primary, or perhaps sole, purpose of keeping their bureaucracies funded.
“Some of the towns in St. Louis County can derive 40 percent or more of their annual revenue from the petty fines and fees collected by their municipal courts,” Balko writes. The fines are mostly for traffic offenses, but they also include fines for loud music, unmown lawns, “wearing saggy pants” and “vague infractions such as ‘disturbing the peace,'” among many others, and if the person fined, because he or she is poor, can’t pay up, a further fine is added to the original, and on and on it goes.
“There’s also a widely held sentiment that the police spend far more time looking for petty offenses that produce fines than they do keeping these communities safe,” Balko writes. “If you were tasked with designing a regional system of government guaranteed to produce racial conflict, anger, and resentment, you’d be hard pressed to do better than St. Louis County.”
Regarding the anger and resentment in communities like Ferguson, he quotes a longtime racial justice activist, Jack Kirkland, who says, “I liken it to a flow of hot magma just below the surface. It’s always there, building, pushing up against the earth. It’s just a matter of time. When it finds a weak point, it’s going to blow.”
And when it blows, we get to watch it on TV: the flames, the smoke, the rage, the ammo “cooking off.” This is what institutional racism looks like when we finally notice it.

“Telling My Son About Ferguson”: He Will Soon Be Forced To Live It
My son wants an answer. He is 10 years old, and he wants me to tell him that he doesn’t need to worry. He is a black boy, rather sheltered, and knows little of the world beyond our safe, quiet neighborhood. His eyes are wide and holding my gaze, silently begging me to say: No, sweetheart, you have no need to worry. Most officers are nothing like Officer Wilson. They would not shoot you — or anyone — while you’re unarmed, running away or even toward them.
I am stammering.
For the past few years, I have traveled from coast to coast speaking to just about anyone who will listen about the horrors of our criminal injustice system. I have written and lectured extensively about the wars that have been declared on poor communities of color — the “war on crime” and the “war on drugs” — the militarization of our police forces, the school-to-prison pipeline, the millions stripped of basic civil and human rights, a penal system unprecedented in world history. Yet here I am, on Monday evening, before the announcement about the grand jury’s decision has been made, speechless.
My son wants me to reassure him, and tell him that of course Darren Wilson will go to jail. At 10 years old, he can feel deep in his bones how wrong it was for the police to kill Michael Brown. “There will be a trial, at least — right, Mom?” My son is asking me a simple question, and I know the answer.
As a civil rights lawyer, I know all too well that Officer Wilson will not be going to trial or to jail. The system is legally rigged so that poor people guilty of relatively minor crimes are regularly sentenced to decades behind bars while police officers who kill unarmed black men almost never get charged, much less serve time in prison.
I open my mouth to speak, look into my son’s eyes, and hear myself begin to lie: “Don’t worry, honey, you have nothing to worry about. Nothing like this could ever happen to you.” His face brightens as he tells me that he likes the police, and that he always waves at the cops in our neighborhood and they always wave back. His innocence is radiating from him now; he’s all lit up with relief and gladness that he lives in a world where he can take for granted that the police can be trusted to serve and protect him with a wave and a smile.
My face is flushing red. I am embarrassed that I have lied. And I am angry. I am angry that I have to tell my son that he has reason to worry. I am angry that I have to tell him that I already know Darren Wilson won’t be indicted, because police officers are almost never indicted when they kill unarmed black men. I must tell him now, before he hears it on the school bus or sees it in the news, that many people in Michael Brown’s town will be very angry too — so filled with pain, sadness and rage — that they may react by doing things they shouldn’t, like setting fires or breaking windows or starting fights.
I know I must explain this violence, but not condone it. I must help him see that adults often have trouble managing their pain just like he does. Doesn’t he sometimes lash out and yell at friends or family when he’s hurt or angry? When people have been hurt over and over, and rather than compassion or understanding you’re given lectures about how it’s really all your fault, and that no one needs to make amends, you can lose your mind. We can wind up harming people we care about with words or deeds, people who have done no harm to us.
I begin telling him the truth and his face contorts. The glowing innocence is wiped away as his eyes flash first with fear, then anger. “No!,” he erupts. “There has to be a trial! If you kill an unarmed man, don’t you at least have a trial?”
My son is telling me now that the people in Ferguson should fight back. A minute ago, he was reminiscing about waving to Officer Friendly. Now he wants to riot.
I tell him that sometimes I have those feelings too. But now I feel something greater. I am proud of the thousands of people of all colors who have taken to the streets in nonviolent protest, raising their voices with boldness and courage, capturing the attention and the imagination of the world. They’re building a radical movement for justice, one that would make the freedom fighters who came before them sing from the heavens with joy.
I tell my son, as well as my daughters, as we sit around the dinner table, stories of young activists organizing in Ferguson, some of them not much older than they are. I tell them about the hip-hop artist Tef Poe, who traveled with Michael Brown’s parents to Geneva to testify before a United Nations subcommittee about police militarization and violence. I tell them about activists like Phillip B. Agnew, Tory Russell, Brittany Ferrell and Alexis Templeton, who marched in the streets and endured tear gas while waving signs bearing three words: “Black Lives Matter.”
I’ve met some of these activists, I say. They believe, like you do, that we should be able to live in a world where we trust the police and where all people and all children, no matter what their color or where they came from, are treated with dignity, care, compassion and concern. These courageous young people know the tools of war, violence and revenge will never build a nation of justice. They told me they’re willing to risk their lives, if necessary, so that kids like you can live in a better world.
My son is stirring his mashed potatoes around on his plate. He looks up and says, “Right now, I’m just thinking I don’t want anything like this ever to happen again.”
I’m tempted to tell him that it will happen; in fact, it already has. Several unarmed black men have been shot by the police since Aug. 9, when Michael Brown was killed. But I don’t say another word. It’s much easier telling the truth about race and justice in America to strangers than to my son, who will soon be forced to live it.

“Try Getting To Know Each Other”: Don’t Argue About Politics This Thanksgiving. Just Don’t
Imagine this scene on Thanksgiving day. The turkey is partly carved, the mashed potatoes are being passed around.
Your Mother: What are you thankful for?
You: Well, if I can say so, I’m thankful for ObamaCare because it was great that I was able to sign up for health insurance on the internet.
Caricatured Uncle: Hope Reverend Wright isn’t on your death panel! Payback for Ferguson coming to you.
Your Mother [hoping to get control of the situation]: I did something different this year with the sweet potatoes! Do you like it?
Never fear. The pundits are here to save you. Think Progress has a guide on “how to argue with your Evangelical uncle” about marriage equality. Vox is advising you on Bill Cosby, Ferguson, and immigration (you’re for it as much as possible, of course).
Last year, some of Michael Bloomberg’s dollars trickled down to someone who gave you talking points on gun control. Chris Hayes is once again dedicating an hour of his MSNBC show to the cause.
Less combatively, Conor Friedersdorf advises you to adopt his brand of nodding empathy: “Before you focus on any point of disagreement, ask questions of your interlocutor to figure out why they think the way they do about the subject at hand.”
These advice columns are becoming a genre unto themselves. The stock villain: crazy right-wing uncle, the jokes about stuffing. But I recognize them by what they unwittingly emulate: guides for religious evangelism. The gentle, righteous self-regard, the slightly orthogonal response guides, the implied urgency to cure your loved ones of their ignorance. Your raging uncle will know the truth, and the truth will set him free.
That’s a problem. Our politics are taking on a religious shape. Increasingly we allow politics to form our moral identity and self-conception. We surround ourselves with an invisible community of the “elect” who share our convictions, and convince ourselves that even our closest and beloved relatives are not only wrong, but enemies of goodness itself. And so one of the best, least religious holidays in the calendar becomes a chance to deliver your uncle up as a sinner in the hands of an angry niece.
I’m as guilty of this as anyone. As a conservative raised in an argumentative and left-leaning Irish-American family, Thanksgiving and other holiday dinners did more than any professional media training to prepare me for MSNBC panels. But arguments like these, particularly when we allow politics to dominate our notions of ourselves, can leave lasting scars. And precisely because our familial relationships are so personal, the likely responses to our creamed and beaten talking points will be defensive, anxious, off-subject, or overly aggressive.
You might think you can sneak in a killer talking point about immigration reform, only to touch off a sprawling congress about the personhood of unborn children, the Vietnam War, and whether it is really sexist to describe Nancy Pelosi as a “tough broad.”
Instead, what we really need are guides for gently deflecting the conversation away from politics, as our polite grandmothers once did.
Bringing up politics can be a form of self-assertion, or a way for a family member to test whether he is accepted for who he is. One of the reasons the “conservative uncle” has become the cliched oaf of the Thanksgiving dinner is precisely because he may feel, rightly or wrongly, that the country is moving away from him. He could be testing to see whether his family is ready to reject him, too. Or he could just be an oafish, self-regarding lout. Either way, it doesn’t have to be that hard to show he is appreciated as a family member and human being.
Caricatured Uncle: Obummer sure got waxed in that election. Guess he isn’t the Messiah, huh?
You: Har har, you got me. But hey, I get to read and think about the news every day. I only see you twice a year. How is the renovation going?
Instead of honing your argument on tax reform into unassailability, maybe ask your parents or siblings ahead of time what some of the further-flung or more volatile members of your family are up to in their lives before they sit down. Get the family’s talking points, rather than Mike Bloomberg’s.
And if you do want to pointlessly and frustratingly argue about politics with your uncle, just friend him on Facebook.

“The Great National ‘Franksgiving’ Uproar”: Imagine The Reaction If Obama Used An Executive Order To Change Date Of A Major Holiday
The story of Franklin Roosevelt moving Thanksgiving is probably pretty well known, but with the holiday coming up tomorrow, and with the ongoing debate about executive powers apparently fresh on the political world’s mind, it’s probably worth a trip down memory lane.
Historically, Thanksgiving was celebrated on the final Thursday of November. But in 1939, with the nation still dealing with the effects of the Great Depression and the unemployment rate above 15%, there was a small problem with the calendar: Thanksgiving fell on Nov. 30.
This may not sound especially important, but for businesses relying on holiday sales, this was a threat to bottom lines – it shortened the number of shopping days between Thanksgiving and Christmas. Business owners, pointing to the weak economy, demanded action.
And FDR delivered, issuing an executive order that moved the official date of Thanksgiving up a week, from Nov. 30 to Nov. 23. As Andrew Prokop explained, this really didn’t go over well.
What may have seemed like a wonkish, technocratic, good-government policy clashed with what turned out to be deeply-ingrained feelings among many Americans about when Thanksgiving should be celebrated. The Associated Press story announcing the move said Roosevelt “was shattering another precedent,” and quoted a town official of Plymouth, Massachusetts saying the traditional date was “sacred.” […]
Republicans pounced, and used the move to portray Roosevelt as a power-mad tyrant. In an early example of Godwin’s Law, FDR’s recent presidential opponent Alf Landon said Roosevelt sprung his decision on “an unprepared country with the omnipotence of a Hitler.” Senator Styles Bridges of New Hampshire suggested that while Roosevelt was at it, he should abolish winter.
One Republican mayor labeled the new date “Franksgiving.” Extending the protest further, roughly half the states chose to honor the old date rather than the new one.
The date then bounced around for a couple of years, until Congress eventually passed a new law, moving the date from the final Thursday in November to the fourth Thursday in November.
So, FDR and businesses owners scored a partial win, at least insofar as the Nov. 30 problem is concerned.
The thing I like about this story now is its contemporary salience: President Obama, for example, is not the first Democratic president that Republicans compared to Hitler.
Plus, try to imagine the reaction if Obama used an executive order to change the date of a major holiday without congressional approval. If his critics go berserk when he uses prosecutorial discretion on immigration, Republicans might very well faint if Thanksgiving moved to create more shopping days.
