“Paul Ryan’s Stale Ideas On Poverty”: Retreaded Idea’s Surrounded With The Language Of Innovation
Paul Ryan is counting on this: Because he says he wants to preserve a safety net, speaks with concern about poor people and put out a 73-page report, many will elide over the details of the proposals he made last week in his major anti-poverty speech.
The Wisconsin Republican congressman is certainly aware that one of the biggest political difficulties he and his conservative colleagues face is that many voters suspect them of having far more compassion for a wealthy person paying taxes than for a poor or middle-income person looking for a job.
So Ryan gave a well-crafted address at the American Enterprise Institute in which the centerpiece sounded brand spanking new: the “Opportunity Grant.” The problem is that this “pilot program” amounts to little more than the stale conservative idea of wrapping federal programs into a block grant and shipping them off to the states. The good news is that Ryan only proposes “experiments” involving “a select number of states,” so he would not begin eliminating programs wholesale. Thank God for small favors.
Ryan surrounds his retread idea with the language of innovation. “The idea would be, let states try different ways of providing aid and then to test the results — in short, more flexibility in exchange for more accountability,” he declared. “My thinking basically is, get rid of these bureaucratic formulas.”
Who can possibly like those “bureaucratic formulas”? The phrase is another disguise. Among the programs Ryan would block grant are food stamps (now known as the Supplemental Nutrition Assistance Program or SNAP). Food stamps are one of our most valuable initiatives because people are automatically eligible for them when they lose a job or their income drops sharply. Studies have amply documented how important food stamps are to the well-being of children.
For the economy and for the disadvantaged, curtailing SNAP would be devastating. While providing nutrition help to families in desperate need, food stamps also offer an immediate economic stimulus at moments when the economy is losing purchasing power. Economists call such programs “automatic stabilizers.”
Ryan’s block grant would not be nearly as responsive to economic changes. If Congress would have to step in, its reaction would be slow. And the history of Ryan’s own budgets shows that increasing spending for poor people is not exactly a priority on his side of politics.
Food stamps aren’t the only programs that get wrapped into the grant. Housing vouchers go there, too, which could lead to more homelessness. So does money for child care. Ryan says there would be rules barring states from using funding from his Opportunity Grant for purposes other than helping the needy. But it’s not clear from his outline how he’d stop states from using their new flexibility to move spending away from the needy indirectly by substituting block grant money for existing expenditures.
Ryan might reply: You just don’t trust the states! And my answer would be: You’re absolutely right, there are some states I don’t trust to stand up for their poor people. I’d point specifically to the 24 states that are depriving roughly 5 million Americans of health insurance because they refuse to participate in the Medicaid expansion under the Affordable Care Act.
In his speech and report, Ryan movingly described two hypothetical Americans, “Andrea” and “Steven,” and how much they could benefit from intense counseling by a case worker. There may well be something to this, but it’s expensive. How much would states have to cut basic assistance to the poor to hire additional case workers?
And by the way, one of the programs Ryan would eliminate to pay for an undoubtedly positive part of his plan — a roughly $500-a-year increase in the Earned Income Tax Credit (EITC) for childless workers — is the Social Services Block Grant, which helps pay for the kinds of interventions he wants for Andrea and Steven.
There is such a hunger for something other than partisanship that the temptation is to praise the new Ryan for being better than the old Ryan and to leave it at that. It’s good that he moved on the EITC and also that he embraced sentencing reform. I also like his suggestion that we re-examine occupational licensing rules.
But forgive me if I see his overall proposal as a nicely presented abdication of federal responsibility for the poor. “Experimenting” with people’s food-stamp money is not something we should sign onto.

“Republicans Are Gonna Be Really Mad!”: Boehner Sues Obama In Order To Implement Health Law Faster
When I learned that House Speaker John Boehner is suing President Barack Obama, I thought about a number of good reasons for something to limit executive actions. Would it be to limit NSA spying on its citizens? Could it have something to do with limiting IRS hazing of liberal and conservative groups (the Tea Party gets most of the attention, but the Congressional panel revealed that all new groups got special scrutiny)?
Would it end executive orders by the executive branch, or terminate signing statements, something done by Obama and George W. Bush (who did both with more frequency)? Might it require less immunity for advisers in the presidential administration?
Actually, it wouldn’t involve any of these good reasons for a lawsuit.
Instead, House Speaker Boehner wants to sue President Obama to implement the health care law, known as the Affordable Care Act (ACA), sooner.
Huh?
That’s right, Boehner claims that the Obama administration overstepped its legal bounds by delaying the employer mandate for a year. Businesses won’t be mandated to provide health care for their employees for a year.
What’s ironic is that House Republicans, when they weren’t voting to repeal the ACA, they also tried to vote for the exact same delay in the employer mandate.
So the lawsuit clearly isn’t about policy. It is about who has the power.
Boehner claims that the Obama administration shouldn’t have the power to write the law. But isn’t the executive branch allowed to implement the law? Is the timing part of writing a law, or implementing a law?
Actually, there’s a long history of delays in implementing the law, even about health care. And I don’t remember Boehner filing a lawsuit, or even objecting, when President George W. Bush delayed the implementation of his prescription drug law 10 years ago (passed by Congress, of course).
Boehner also claims that the White House has been abusing the executive actions, even though Obama has used the fewest executive actions since Grover Cleveland, according to the Washington Post. Granted, Boehner admitted that he thinks presidents should be allowed to use executive orders, but that the president has been abusing such authority with recess appointments.
If that term sounds familiar, it’s something President George W. Bush would use when making appointments that weren’t approved by Congress. Nobody remembers Boehner suing Bush over these, or even objecting to them.
When making his case for the lawsuit in his op-ed in a CNN article, Boehner didn’t say anything about implementing the health care law sooner, or even that he supported some recess appointments made by Obama’s predecessor. Instead, he cited Senate Democrats and President Obama refusing to pass House Republican jobs bills.
I don’t remember that being unconstitutional.
When Republican voters realize that the lawsuit has nothing to do with illegal immigration, the IRS, the NSA and spying, or repealing the health care law, but making the mandates occur faster, how will they react? I foresee a lot of disappointment in GOP ranks when they read the lawsuit.

“Our Political System Is Morphing”: The Problem With The Koch Brothers Isn’t Their Politics. It’s Their Copycats
Did you see the “Creepy Carnival” from the Koch brothers on the Washington Mall the other day? Sponsored by the youth-outreach tentacle of the brothers’ operation, it featured Pennywise the Clown doppelgangers dunking millennials into “High-Risk Pools” – though, surely, they missed an opportunity to nail some old people to death panels. (There was no word about the presence of funhouse mirrors to artificially shrink the outsize influence of the Kochs on our national agenda.)
These two men have commanded center stage in the dark-money circus since the US supreme court started the political money free-for-all four and a half years ago. The Kochs have become the focus of electoral campaigns themselves.
But however effective they may be as conservative bogeymen, the real problem with the Kochs is not that they are ultra-conservative. The problem is that they are a leading indicator that our political system is morphing from elections based on ideology to elections based on the preferences of individual donors.
Big “fundraisers” like the Kochs don’t care so much about candidates or parties. They care about policies, and that tendency to narrowly target their dollars naturally pushes candidates to tailor their platforms to issues more than coherent ideologies. Jjust look at Sheldon Adelson and Israel, or Tom Steyer and green energy, or Paul Singer and gay rights – or the Koch brothers themselves, whose political manipulations have always been based in a fervent economic libertarianism more than purely Republican politics.
The negative focus on mega-donors on both sides of the aisle is having one effect: it’s turning Americans firmly against the current electoral financing system. According to Gallup, fully 50% of the country would support a federally funded campaign finance system with no private contributions whatsoever; 79% would vote for a law limiting contributions in some way.
As a result, the movement for a small-donor revolution in campaign finance is slowly clawing its way into the mainstream. The leading general in that revolution, Lawrence Lessig – who launched Mayday Pac to blow up big money in politics by raising big money – just surpassed his initial fundraising goal of $5m by raking in $7.6m in small donations. (Ironically, a few mega-donors will be kicking in another $5m in matching funds.)
But Lessig’s Kickstarter-esque project is itself the kind of single-issue project that has, to date, been the purview of fundraising behemoths: he plans to give the money only to candidates who hew to his vision of campaign finance reform. Like them, it lays the groundwork for the decentralization of parties, whether or not Lessig’s own goals are achieved.
As it stands, the number of Americans who identify with a particular political party do so now with unprecedented intensity, and the number of Americans who don’t identify with either party has grown as well. Sheer frustration could move some – or perhaps many – independents who currently favor a particular party to a more radicalized center.
Disillusioned with actual politicians, apolitical activists could make the candidates the least important part of a ballot by donating to and campaigning for policies, rather than politicians. And that is what issue-oriented Super Pacs, like Lessig’s and others, are counting on: small donors, and voters interested in issues over ideology – or, at least issues-as-ideology.
The idea of non-partisan issue activism is an old one, but what’s changed is the degree of overall partisanship and our expectations of infinite, individualized choice today. When we’ve got Uber in our hands and Spotify playlists inside our headphones, it seems reasonable to expect technology could do the same for democracy.
Anil Dash, a tech activist and entrepreneur, envisions a kind of Amazon for activism – a literal marketplace of ideas, wherein a donor with a little money and a few major passions could shop for candidates that fit an issue checklist. They could even target those who appear particularly “flexible”, based on a database matching their voting history to donors, or particularly in need of cash to keep the campaign going. These, of course, are tactics that big money donors have long used to sway the opinions of politicians. The question is whether the aggregation of enough small donors could be equally effective.
But do today’s policy crises even lend themselves to the micro-targeted solutions that app-enabled voters could select? Do we wind up with solutions to climate change, or just pockets of pollution? And what issues disappear entirely when pressures from both special interest big donors and special interest small donors push parties to the breaking point?
As it is, just the system is broken – or bent, leaning heavily in the direction of that easy mega-donor money. The undoing of campaign finance reform has made more and more obvious to more and more people; Larry Lessig’s project to leverage that disgust will spotlight the ugliness just in time for 2016. Perhaps it will drive at least some conversations, if not solutions.

“It’s Funny How That Happens”: GOP Discovers The Virtue Of Unilateral Presidential Action
With less than a week before Congress leaves town for a month-long break, legislative prospects appear bleak. President Obama called weeks ago for action on the border crisis, but there’s now very little hope that lawmakers will get anything done.
Yesterday, as msnbc’s Jane Timm reported, House Speaker John Boehner gave the White House an ultimatum: accept changes to the Bush/Cheney-era human-trafficking law that allows immigrants from non-contiguous countries to seek asylum in the U.S., or House Republicans will refuse to pass a bill.
It’s reached the point at which the same GOP lawmakers who’ve condemned the president for trying to work around Congress are now urging the president to circumvent Congress.
Even as Congress jousts over a legislative response to the influx of child migrants from Central America, [a group of Texas Republican lawmakers] contend the president can take unilateral steps to end the crisis immediately. “You have the authority to stop the surge of illegal entries by immigrant minors today,” the Republicans wrote Thursday in a letter to Obama. […]
The recommendations include empowering local law enforcement agencies to prosecute federal immigration laws; cracking down on immigration fraud; speeding up deportations of the new arrivals; and ending the administration’s deferred action program, which allows some illegal immigrants brought to the country as children to remain and work without fear of deportation.
Apparently, some GOP lawmakers believe unilateral White House actions are evidence of a tyrannical dictatorship, unless Obama is acting unilaterally on an issue they care about, in which case they’re all for executive authority.
It’s funny how that happens.
There is, however, a related question that’s gone largely overlooked lately: if House Republicans support a far-right proposal that deploys the National Guard and changes the 2008 human-trafficking law, why don’t they just pass one? After all, the GOP is in the majority in the House and if they want to approve a conservative plan, they can, right?
Well, it’s not quite that simple. In theory, sure, House Republicans can pass anything they please, but in this case, that’s not possible. As Greg Sargent reported this week, far-right lawmakers are pushing to make sure the House approves literally nothing on this issue, in part because they don’t want to address the problem at all and in part because if the lower chamber does pass a bill, it might lead to a compromise with the Senate,
And as we know, Republicans really won’t tolerate compromises.
It’s led to a bizarre scenario: Boehner is whining that Obama isn’t doing enough to push House Democrats to support a Republican bill. Indeed, if House Republicans do absolutely nothing, after complaining for months about the need for action, the Speaker will say it’s the president’s fault for not telling Dems to vote the way Republicans want them to.
No, seriously, that’s the argument. Boehner once again can’t round up Republican votes for a Republican bill, so he’s convinced himself that Obama’s to blame.
It’s also why the very same GOP officials who claim to hate unilateral presidential action have suddenly discovered the virtues of Obama making policy moves irrespective of Congress.

“Magically Becoming Irish”: If Corporations Are People, Shouldn’t They Have To Expatriate Like People?
It’s a common complaint among American expatriates: no matter how far away you go, you can’t escape Uncle Sam’s taxes.
But that’s not the case with American corporations that move their putative “headquarters” overseas, as President Obama noted the other day:
In his toughest comments yet on the subject, he accused big US corporations of trying to play “the system” by “magically becoming Irish” through so-called tax inversion deals.
“I don’t care if it’s legal, it’s wrong,” Mr Obama said. “It sticks you for the tab to make up for what they’re stashing offshore.”
There has been a raft of such deals in recent months which have seen big American companies become “Irish” for tax purposes through buying smaller firms registered here. The same trend is happening in the UK and Switzerland. Fears America is losing out on taxes have made the deals controversial.
It’s understandable if businesses have a different tax code that subjects them to different rules to a certain extent, though shady tax dodging is still an enormous moral and financial problem.
But the issue starts to become even more open and shut once we start claiming that corporations are people. If a corporation has “free speech rights” to buy elections, then it should be subject to American taxes even if it “moves” overseas just like actual American people are. If a corporation like Hobby Lobby has personal “religious rights” not to cover its employees’ contraception, then it’s enough of a person to pay expatriate taxes if it decides to move to Ireland.
It has to be one or the other. You can’t become a person when it’s convenient to your bottom line, but not when it isn’t.
