“The Chris Christie Scandal Just Got Worse”: Amid New Gale Force Winds, Will Christie Be ‘Stronger Than The Storm’?

When there is still snow on the ground past St. Patrick’s Day, thoughts turn longingly to the beach. Say, the Jersey Shore. Which in turn brings to mind the extreme yet comically ham-handed efforts of Governor Chris Christie’s administration to keep secret the process that led to the controversial selection exactly one year ago of a firm to run a $25 million ad campaign for last summer’s tourist season touting the Shore’s comeback from Superstorm Sandy.

As you may recall, Christie came under criticism during his reelection campaign last summer for having inserted himself and his family into the rousing “Stronger than the Storm” ads encouraging tourists to come back to the Jersey Shore. The ads had been funded by federal Sandy recovery aid, and it seemed eyebrow-raising, at the least, for them to feature beaming pictures of a governor in the middle of a reelection campaign, rather than just your average smiling New Jerseyans. The eyebrows shot up quite a bit further when it emerged that the firm that had gotten the job after proposing to feature Christie in its ads, public relations giant MWW, had bid at a much higher price—$4.7 million versus $2.5 million—than a well-regarded New Jersey ad firm that had proposed ads that did not feature the governor. Making matters even more interesting was that the award had been made by a selection committee led by Christie’s very close longtime aide, Michele Brown, whom Christie appointed to run the New Jersey Economic Development Authority, a $225,000 post. Also noteworthy was that MWW had hired just a few months earlier the former executive director of the influential Burlington County Republican Party. (It was also hard not to notice that MWW’s founder and CEO, Michael Kempner, who is normally a loyal Democratic donor, was not writing any big checks to Barbara Buono, Christie’s opponent, last year.) New Jersey congressman Frank Pallone, a Democrat, in January asked the inspector general of the U.S. Department of Housing and Urban Development to audit the awarding of the job to make sure federal contracting rules were followed.

Further raising the intrigue around the “Stronger than the Storm” ads has been the lengths to which the Christie administration has gone to keep secret the relevant documentation. When Shannon Morris, the president of the New Jersey company, Sigma Group, that came in second to MWW, last summer requested the state’s evaluations of the proposals to better understand why her firm had lost, she received almost nothing in response. “Typically when you have a state-run bid like that you have…it fully transparent, it’s all posted online,” Morris told me. “There was nothing like that in this case.” When Asbury Park Press reporter Bob Jordan made an open-records request for the scoresheets that the selection committee members filled out to rank the ad proposals, the state returned to him in January the scoresheets—with the names of the committee members redacted.

Knowing this, I was heartened to find that my own request for the scoresheets was returned to me later in January with the names of the committee members fully disclosed. I planned to include details from the scoresheets in a cover story on Christie that I was in the process of writing, but the piece’s main thrust veered away from the Sandy ads, and I decided to revisit that issue later. This week, when I went to do just that, I discovered that the Internet link the Economic Development Authority had given me for the reams of documents I had requested was no longer operable. I asked that the documents be resent. They were, and lo, this time the names of the committee members were redacted from the scoresheets. When I asked the authority’s legal officer, Shane McDougall, about the discrepancy, he replied that “if the original documents had been disseminated without these redactions, it was done inadvertently.” He added that the redaction of names was done “on the basis of the advisory, consultative, and deliberative privilege, the expectation of privacy and the protection of the competitive bidding process.”

This retroactive redaction might have been maddening were it not so ineffective: I had seen enough between what had been sent before and what was in the newly redacted documents to piece together the story behind the evaluation process. Put simply, there was no contest whatsoever between MWW on the one hand and Sigma Group and the two other finalists on the other hand. In fact, reading the scoresheets is a bit like looking at the scores of the East Bloc figure skating judges at the Olympics during the height of the Cold War.

The average score the six committee members gave MWW’s proposal, out of 1000 possible points, was 953. The average score for Sigma Group’s proposal was 718.

And as I had taken note of when I had first seen the unredacted scoresheets, the differential was the largest of all in the evaluation by Michele Brown, who has a very long history with Christie: she is a longtime close neighbor of his in Mendham Township, she traveled extensively with him when she worked alongside him in the U.S. Attorney’s Office, she received a $46,000 loan from him in 2007 that he failed to report on his income taxes, and she took the lead in screening open-records requests for his tenure as U.S. Attorney while he was campaigning for governor in 2009. In her new role as head of the Economic Development Authority, she was in charge of the selection committee for the Sandy ad. And she, more than anyone else on the committee, made sure to put MWW far ahead of the competition—she gave MWW a score of 970, above even the high average score it received overall, and she gave Sigma Group only 590, by far its lowest score. (A spokesman at the Economic Development Authority did not respond to a request for comment from Brown.)

Matching the other scoresheets to the committee members was not exactly a forensic challenge. One of the sheets had an evaluator’s name accidentally left unredacted—Jackie Kemery, a procurement analyst in the state’s Department of the Treasury, who gave MWW a score of 940 and Sigma a score of 750—and it required only rudimentary handwriting analysis to match with a high degree of confidence the other scoresheets with the handwriting on other, unredacted paperwork filled out by the committee members that had been included in records I received. (The other committee members included Maureen Hassett, senior vice president for finance and development at the Economic Development Authority; Sara Maffey-Duncan, deputy director of the authority’s Office of Recovery; Melissa Orsen, chief of staff in the Department of State within the Lieutenant Governor’s office; and Gabrielle Gallagher, director of legal and regulatory affairs at the Department of Community Affairs, which oversees state aid to towns and cities.)

Which raises the question: why in the world was the Christie administration going to such lengths to obscure such basic facts about the selection process as which committee members awarded which sky-high scores to MWW? Morris, the head of Sigma Group, has a pretty good hunch: that the administration is doing anything it can to cover up the fact that the selection process had been essentially rigged from the get-go, which is the thought that came to her when she got to see the proposal from MWW. MWW and the ad firm it was partnering with, Brushfire, had less experience in this realm than did Sigma and the big national ad firm it partnered with, Weber Shandwick; whereas Weber Shandwick had produced comeback ads for New Orleans following Hurricane Katrina, MWW’s application cited Brushfire’s experience making ads for Minwax, Thompson’s Water Seal and DeLonghi cappuccino machines. Given that contrast, Morris thought “we had a slam dunk here” to get the job.

But then she saw MWW’s proposal, and it was far, far beyond what her firm had managed to put together in the four days they’d been given to submit a proposal. Whereas Sigma had basic storyboards for the ads it was proposing, MWW had “fully conceptualized” apps, video games, and other digital components on top of its conventional ad proposal. “It was like looking at a 10-day term paper versus a 150-page book,” she said. “I don’t know how you do that unless someone had a head start.” (MWW did not respond to a request for comment.)

As it happens, Morris did get one communication back from Michele Brown after her repeated attempts to get an explanation for being passed over: Brown sent Morris a form letter congratulating her for being named one of New Jersey’s “Best 50 Women in Business.” The letter urged Morris to reach out to Brown if she ever needed any assistance, so Morris wrote her asking again for an explanation of the contract award.

She never heard back.

“Why The GOP Won’t Change”: A Year After Their “Autopsy”, The Recommendations Haven’t Been And Won’t Be Followed

Exactly one year ago, a committee of Republican party bigwigs issued the report of its “Growth and Opportunity Project,” better known as the “autopsy.” The idea was to figure out what the party was doing wrong, and how on earth Barack Obama had managed to get re-elected when everybody knows what a big jerk he is. There were some recommendations on things like improving the party’s use of technology and its fundraising, but the headline-grabbing message was that the party had to shed its image as a bunch of grumpy old white guys and become more welcoming to young people and racial minorities.

It was always going to be a tricky thing to accomplish, both because the GOP is, in fact, made up in large part of grumpy old white guys, and because “outreach” can only go so far if you aren’t willing to change the things you stand for. Mike Huckabee, that clever fellow, used to say, “I’m a conservative, but I’m not angry about it.” Which is all well and good, but if, for instance, you say to young people that you don’t think their gay friends ought to be allowed to get married, saying it with a smile doesn’t really help.

And a year later, it’s not just that the Republican party hasn’t changed, it’s that they don’t have much reason to change. The coming election may or may not be the GOP “tsunami” that Reince Priebus predicts, but they’re certainly going to pick up seats, just because of which seats are up in the Senate, the standard pattern of the president’s party losing seats in the 6th year of his presidency, and the fact that that president isn’t particularly popular right now. So why would a member of Congress—especially one from a conservative district or state—feel any need to undergo some kind of wholesale reinvention? Particularly when the people who put him where he is, and the people who are going to keep him where he is, aren’t the kind of people he’s being asked to “reach out” to. If your job is to get re-elected this fall, everything’s looking just fine.

And even in the upcoming presidential election, the non-old-white-guy-outreach may not look all that important. As Jamelle Bouie notes, things like the economy and President Obama’s popularity at the end of his term are going to matter much, much more than whatever outreach has been accomplished. What that means is that at the moment, no one whose name is or will be on a ballot in the near future has any particular interest in rethinking the party’s identity. The members of Congress are thinking about their next election. Those running for president in 2016 will be thinking about 2016. It’s fine for some party strategist to look 20 years down the road at the country’s inevitable demographic changes and predict doom about the party’s future. But the people who will actually implement the changes they suggest (or not) have no interest in looking that far ahead. And so they aren’t going to change.

“What States’ Rights?”: House GOP Fights For Food-Stamp Cuts

Ordinarily, when conservative policymakers complain about “fraud” and “cheating” in federal programs intended to help poor people eat food, they’re referring to individuals accused of abusing the system unfairly. But over the last few days, congressional Republicans are using familiar rhetoric in an unfamiliar way.

Republican leaders are threatening to take congressional action to stop state governors from flouting the food stamp cuts contained in the 2014 farm bill.

The governors of at least six states – New York, Connecticut, Rhode Island, Pennsylvania, Montana and Oregon – have now taken measures to protect more than a combined $800 million in annual Supplemental Nutrition Assistance Program benefits, and more states are expected to follow suit. Their actions threaten – over time – to wipe out the more than $8 billion in cuts over 10 years to the food stamp program that were just passed by Congress as part of the 2014 farm bill.

But those who initially supported the food stamp cuts are warning that retaliatory actions may be coming.

As a policy matter, the underlying change is a little tricky. Republicans successfully cut food aid to the poor – though not nearly as much as they’d hoped – which mostly affected 17 states that participate in the “Heat and Eat” program, which connects federal LIHEAP (Low-Income Home Energy Assistance Program) assistance with SNAP (Supplemental Nutrition Assistance Program).

At last count, six of the affected governors – five Democrats and one Republican – have decided to start fiddling with the books, moving money around so low-income constituents won’t lose their food benefits. Other governors appear eager to do the same.

And this has apparently outraged Republicans on Capitol Hill. House Speaker John Boehner (R-Ohio) told reporters late last week that he wants Congress to “try to stop this cheating and this fraud from continuing.” Rep. Frank Lucas (R-Okla.), who helped write the relevant legislation, wants a full congressional investigation and new measures intended to guarantee food-stamp cuts.

Remember, the “cheating” and “fraud” is in reference to state officials trying to help low-income residents access food.

For its part, the Obama administration seems a lot less concerned than Congress.

Rep. Kevin Yoder (R-Kan.) expressed anger Friday over the possibility that none of the cuts to the SNAP program would be realized and asked USDA Secretary Tom Vilsack during an appropriations hearing whether he had any inside knowledge that states would nullify the benefit reductions.

Vilsack said he didn’t know or suspect what the states would do, but defended their right to take action.

“Frankly, as a former governor and former state senator, I respect the role of governors and legislatures to make decisions that they think are in their state’s best interests,” Vilsack said.

GOP lawmakers found this unsatisfying. Expect to hear quite a bit more about this in the coming weeks.

“Unregenerated Paulism Strikes Again!”: What Changed In The Last Six Years For “Paul The Younger”?

Last week MoJo’s David Corn drew attention to the rather large flip-flop being executed by the junior senator from Kentucky with respect to America’s relationship with Russia:

Earlier this week, Sen. Rand Paul (R-Ky.) slammed President Barack Obama for not doing enough in response to Russian President Vladimir Putin’s incursion into Crimea….

Paul went on to outline a number of steps he would take, were he president, including imposing economic sanctions and visa bans (which Obama has already implemented), kicking Russia out of the G-8, and building the Keystone XL pipeline. (He did not explain how helping a Canadian firm export tar sands oil would intimidate Putin.) He added, “I would reinstitute the missile-defense shields President Obama abandoned in 2009 in Poland and the Czech Republic.” He griped, “The real problem is that Russia’s President is not currently fearful or threatened in any way by America’s President, despite his country’s blatant aggression.”

This was, Corn noted, a million miles away from Rand Paul’s reaction to Russian aggression towards Georgia.

[W]hen Russia sent troops into Georgia (on George W. Bush’s watch), Paul didn’t want to provoke Russia by placing missiles in Poland. Yet today, when Russia moves into Ukraine (on Obama’s watch), he’s all for dispatching missiles to Poland to send a message to Putin. Does Paul care more about Crimea than Georgia? Or does he care more about keeping a foot on the GOP’s anti-Obama bandwagon? Paul’s office did not respond to a request for comment.

It appears that Paul, an isolationist who doesn’t want to be isolated within the GOP, spotted the opportunity to develop some Obama-bashing hawk cred as the presidential campaign nears. “I stand with the people of Ukraine,” Paul declares now, though that was not what he said about Georgians. What’s changed in the past six years: geopolitics or Paul’s own political calculations?

Paul the Younger can safely survive exposure of his flip-flop by David Corn. But it’s a little more difficult for him to ignore Paul the Elder, who sees no need to change his own take on U.S. foreign policy, as indicated by his pungent op-ed at USAT today:

Residents of Crimea voted over the weekend on whether they would remain an autonomous region of Ukraine or join the Russian Federation. In so doing, they joined a number of countries and regions — including recently Scotland, Catalonia and Venice — that are seeking to secede from what they view as unresponsive or oppressive governments.

These latter three are proceeding without much notice, while the overwhelming Crimea vote to secede from Ukraine has incensed U.S. and European Union officials, and has led NATO closer to conflict with Russia than since the height of the Cold War.

What’s the big deal? Opponents of the Crimea vote like to point to the illegality of the referendum. But self-determination is a centerpiece of international law. Article I of the United Nations Charter points out clearly that the purpose of the U.N. is to “develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples.”

Why does the U.S. care which flag will be hoisted on a small piece of land thousands of miles away?

Critics point to the Russian “occupation” of Crimea as evidence that no fair vote could have taken place. Where were these people when an election held in an Iraq occupied by U.S. troops was called a “triumph of democracy”?

Perhaps the U.S. officials who supported the unconstitutional overthrow of Ukraine’s government should refocus their energies on learning our own Constitution, which does not allow the U.S. government to overthrow governments overseas or send a billion dollars to bail out Ukraine and its international creditors.

Suffice it to say that “What’s the big deal?” is not a terribly popular position to take in contemporary Republican politics towards the infamous “weakness” of Barack Obama towards the rapacious Russian Empire. I suppose it’s possible Rand Paul is going to triangulate on his old man as a definitive illustration of his acceptability to the conventional conservative movement and its militaristic tendencies. Otherwise, there may be some tense moments at the next Paul family dinner.

“If You Go Back To 1933”: Another Billionaire With A Victim’s Complex And An Unhealthy Nazi Fixation

Ben White and Maggie Haberman report this morning that the political winds seem to have shifted lately in the One Percenters’ direction. Whereas a few months ago, economic populism looked like it’d give Democrats a boost in 2014, and polls showed strong public support for addressing economic inequality, Wall Street and its allies are feeling more confident.

In two-dozen interviews, the denizens of Wall Street and wealthy precincts around the nation said they are still plenty worried about the shift in tone toward top earners and the popularity of class-based appeals…. But wealthy Republicans – who were having a collective meltdown just two months ago – also say they see signs that the political zeitgeist may be shifting back their way and hope the trend continues.

“I hope it’s not working,” Ken Langone, the billionaire co-founder of Home Depot and major GOP donor, said of populist political appeals. “Because if you go back to 1933, with different words, this is what Hitler was saying in Germany. You don’t survive as a society if you encourage and thrive on envy or jealousy.”

Oh for crying out loud. Do we really have to deal with another billionaire with a victim’s complex who sees a parallel between economic populism and Nazis?

Apparently so.

If this sounds familiar, it was just two months ago that venture capitalist Tom Perkins caused a stir in a Wall Street Journal letter, arguing that the “progressive war on the American one percent” is comparable to Nazi genocide. “Kristallnacht was unthinkable in 1930,” he wrote, “is its descendent ‘progressive’ radicalism unthinkable now?”

He later said he regretted the Kristallnacht reference, but nevertheless believed his point had merit.

Despite the controversy surrounding Perkins’ bizarre concerns, Home Depot’s Ken Langone apparently decided to embrace the exact same message.

This shouldn’t be necessary, but as a rule, Nazi comparisons in domestic political debates are a bad idea. But they’re an especially egregious mistake when they’re rooted in a ridiculous fantasy.

Whether Langone understands this or not, the scope of contemporary economic populism is often quite narrow. In a political context, it tends to focus on stagnant wages, regressive tax policies, and safeguards against the worst of Wall Street excesses. As a policy matter, we’re generally talking about a higher minimum wage, extended unemployment benefits, food stamps, access to affordable medical care, and lately, expanded access to overtime compensation.

Billionaires may have substantive disagreements with these concerns and their proposed remedies, but to see them as somehow similar to Nazi genocide is more than a little twisted.

The more annoying phenomenon isn’t an American mainstream that believes the wealthy can afford to pay a little more in taxes, but rather, coddled billionaires benefiting from a modern-day Gilded Age feeling sorry for themselves.

As we talked about in January, it’s comparable in a way to a curious strain of political correctness. The more progressive talk about the concentration of wealth at the very top, tax rates, poverty, and stagnant wages, the more some of the very wealthy tell each other, “Oh my God, they may be coming to get us.”

If liberals would only stop talking about economic justice, maybe the richest among us wouldn’t have their feelings hurt.

Or maybe billionaires should just let go of this fantasy, stop seeing themselves as victims, and abandon the disgusting notion that American liberals have something in common with Hitler because they’re concerned with the consequences of growing economic inequality.
